Martinez Pleads Guilty

David Martinez, who stood right in front of me and insisted that he didn’t tell the Houston-owned Herald-Zeitung that he had committed a crime began a six-month sentence for that crime after pleading guilty to it last week. The crime in question: Martinez had signed the bottom of petition forms stating that he had been present when the signatures were collected, when he had not been present at all.

We devoted a lot of space to defending his assertion that the HZ had “played Scrabble with his words”, only to find out they had a recording of him saying exactly what they said he said. David Martinez lied to us, and, well, you know what happens when we find out somebody lied to us.

We’re going over the case file now. We’ll have a breakdown for you in upcoming issues. This one’s not going to be pretty.

Locals Voice Displeasure Over City Appeal

showing how little grounding she has and how easily she’s influenced...

But how stupid is Ron Reaves (District Three)? I don’t believe he’s that stupid and it’s insulting to say the least that he thinks we are. I was screaming at the radio (KGNB) when they played his comments....that’s what you have a city attorney, not to mention hired outside counsel for!!! And I don’t ever want to hear him again say anything about being “fiscally conservative”... To vote to put more taxpayer money into this losing case the city has led by the inept legal counsel it employs is a slap to the face of the taxpayer.

Mayor Pospisil and Councilman Reaves,

As a citizen of New Braunfels and particularly District 3, I am directing these comments to you, I have a problem with the cities Mission Statement and Core Values posted on the cities website. Although they flow nicely and sound enlightened, they do not reflect the behavior of our city government. It is easy to record lofty ideals but apparently more difficult to incorporate these concepts into your actions.

Specifically:1. You have created ordinances

that resulted in lawsuits which the city lost and was directed to pay the plaintiffs significant sums of tax payer resources – This does not reflect Stewardship.

2. You have decided to appeal this decision – This does not reflect Fiscal responsibility

3. You have taken more than three years to repair 3 flood damage pedestrian bridges in Landa Park – This does not reflect Service

4. Actions at the municipal airport certainly do not reflect Integrity

5. Although attractive, Walnut Street does not reflect 25+ million dollars worth of Visionary Leadership.

Since you chose not to emulate these core values by your actions, I respectfully request that you revise them to agree with your behaviors.

I have provided the current statements below from the city website.

Forbidden Island Gets Forbidden-er

The Forbidden Island of Booneville Avenue got some sweet renovations over the last few weeks, including gates to keep taxpayers off the Island and fencing to keep the public from entering a State waterway at the end of a street, as it is entitled to by law. Here’s a little something regarding the extra fencing to keep you from getting into the water, courtesy of Texas Parks and Wildlife: Cornelison v. State, 40 Tex. Crim. 159, 49 S.W. 384 (1899), a private party owned land on both sides of a 30 foot wide roadway. A 14 foot wide bridge spanned a creek. The landowner ran fences to the bridge corners, obstructing 8 feet of right of way on each side of the bridge. The court upheld a criminal conviction of the landowner for obstructing a public road. In other words, somebody already got criminally prosecuted for doing what they just did. Case law is full of stuff like this. So cool.

Take note the “wings” mounted next to the gate, over the water, to discourage those inclined to climb around the gate to access what the Islanders haven’t been able to prove is private property, and upon which no one has ever paid of dime of property tax.

They’ve also made a correction to the signage down there, clarifying their position that common people have no right to frolic in the area. You can’t see it in print, but here’s where they painted over the word “taxpayers”:

The trespassing sign, however, is still misspelled:

Remember, kids, details like spelling or the law only get in the way of a good time. Have some vision, embrace the big picture, and you can pretty much take whatever you want.

False Start, Quick Finish in District Five RaceTurns out Kelly Mochel, who was running against the Kitchen Cabinet’s Wayne Peters for the District Five seat on City Council, doesn’t live in District Five. She owns property in the district, but resides elsewhere in the city. Peters will run unopposed, as the deadline to file as a candidate has passed.

Much is being made of a pie-in-the-sky legal technicality that would force a run-off election for Peters and a candidate to be named later, but that scenario would require that votes for Mochel outnumber those for Peters in the May election. As Mochel was a long-shot against the well-organized Peters when she was actually running, the chances of her beating him now that she’s out of the race are infinitesimal. (That means super small, Canyon Lake readers.)

While many of us are scratching our heads over the City’s recent appeals of the can ban and tow truck cases, some comfort should be taken in the fact that these are far from the City of New Braunfels’ most bizarre appeals.

What follows is what we consider the most notorious four appeals made by the City in the past 20 years.

James Wallace vs. City of New Braunfels (1997)James Wallace, an African-American and recent post-grad from UCLA, was an environmental scientist. He came to work for the City in 1996 in hopes of working on the rivers. Soon, however, Wallace realized something was amiss when, after more than five weeks of moving boulders, he had not received a paycheck. When he asked about the discrepancy, he was told to stop being so “mouthy” or he would be “sold to a farmer near Vidor.”

The young scientist soon filed charges and a suit against New Braunfels for using him as slave labor. It took less than 30 minutes for Wallace to win the case. While initially denying that it considered Wallace a slave, the City’s arguments were quickly undermined by its own ledgers, which referred to him as “Big Ol’ Buck Slave Jim.” Several City officials were also arrested and sentenced to prison.

The City appealed, arguing that neither the plaintiff nor the judge cited any cases that proved slavery was illegal.

In swift response, the Third Court of Appeals’ verdict opened with the now famous line, “What the hell is wrong with you people?” In its blistering ruling, the court said the City was “vicious, morally corrupt and possibly insane.”

The City then appealed to the Texas Supreme Court, who responded by scrawling “go to hell” on the appeal, wadding it up and mailing it back.

PowerMan vs. City of New Braunfels (2002)PowerMan was New Braunfels’ own superhero. He was much beloved and saved many of the city’s denizens from various threats throughout the years. He rescued numerous people from fires by blowing the flames out with his super-breath, he stopped criminals in their tracks with his criminal stopping power and once prevented a school bus filled with children from driving on Walnut Avenue. PowerMan offered these services to the people of New Braunfels for five years without once asking for compensation.

In 2001, New Braunfels decided to open up the position of superhero to bidding. The City Council made this decision while on a group trip to Oslo, not bothering to tell anyone.

In the bid request, the City demanded that its official superhero have super breath, super strength, the ability to fly and “some kind of eye power.” While PowerMan met three of criteria, he was not selected because he didn’t submit a bid.

The City, instead, chose Super Steve, who was actually Steve Morset, the mayor’s secretary’s brother. Super Steve was paunchy, had flat feet and a critical lack of people skills. The only criteria that Steve met, sort of, was that he had a messed-up eye.

PowerMan successfully sued the City, claiming nepotism and a violation of the Open Meetings Act. However, the City appealed, arguing that it didn’t violate the Open Meetings Act because anyone could have attended if they were in Oslo and, besides, “‘nepotism’ isn’t even a real word.”

The Third Court of Appeals ruled in favor of PowerMan, concluding its ruling with, “You people suck.” This led to yet another appeal to the High Court, whose unanimous ruling read, “We concur with the lower court that you do, indeed, suck.”

Crazy Mary vs. City of New Braunfels (2005)Crazy Mary, the Official Town Character, slipped in her driveway during a rain shower. She sued the City, claiming it had manipulated the weather to make her fall. Mary said officials controlled the weather from a secret underground facility beneath the downtown gazebo.

The City successfully had the suit dismissed but, in true Pavlovian fashion, appealed. When asked why it would appeal a judgment in its own favor, the City’s attorney replied, “I don’t know. It’s what we do.”

City of New Braunfels vs. City of New Braunfels (2007)In a case that tore asunder all laws of logic, the City accidentally sued itself and then appealed the ruling, whatever it was. The appeal was argued before the Third Court by the City’s hired attorney, Steve “Lawyerman” Morset. When the justices asked why the City was wasting the Court’s time, Morset responded, “Huh? What?”

He was disbarred and the City of New Braunfels was fined for filing a frivolous appeal, which it promptly appealed.

Last Saturday, over $4,000 was raised toward the construction of our local dog park at New Braunfels Puppy Playland’s Third Annual Doggie Dash at Cypress Bend Park! Grown man James Thompson and eight-year-old Clare Anne Dasso won the 5K event in the male and female categories, respectively.

As for this Saturday, well, it’s Cardboard Boat Race time again, where 13-year-old Jack Bosmans is anticipated to be the youngest captain through the tube chute in this year’s competition. Bosmans is a member of the New Braunfels Yacht Club, which organizes the annual event. Veteran cardboard boater and Yacht Club President Kris Bolstad provided sage advice to the young builder, who will brave the City Tube Chute this Saturday from 9am to noon. The race is always great time, so be there, and bring a chair!

Also last Saturday, CCFA’s Chilifest‘s annual Mutton Bustin’ event took place at the Fairgrounds, with a whole mess of kids taking on a pack of savage wool-machines. The competition was part of a triathlon of sorts, with a tractor pull and chili cook off also on the card.

Dear Mexican: I’m a second-generation Orange County-raised pocho. Both sides of my family have been civil rights activists since the 1940s. My mother’s family took part in the landmark case Mendez, et al vs. Westminster, et al. in 1946. My father was a Chicano activist in the 1960s and 1970s.

From the time I was a child, I had met various figures like Reies López Tijerina, César Chávez, Bert Corona and Emigdio Vasquez. In 1975 my dad took me and my older brother to a demonstration against la migra where we marched to the federal buildings in Santa Ana. As an adult, after graduating with a B.S. and M.S., I have improved my Spanish with classes, books, magazines, television, films and travel to countries de habla española.

Despite my efforts to acculturate myself in Spanish, I am often met with the macho attitude of wabs and pochos apparently because I do not dress or act like them. At 6 feet tall and 250 pounds, I’m not being dissed for appearing to be a wimp. I have gone to gabacho businesses where the wab or pocho cashier has provided courteous service to Anglos and Asians with a smile, referring to them as “sir” and saying, “Thank you.” While being served, I’m treated like a second-class citizen.

I have been nearly run off sidewalks by wab pedestrians while walking with my two-year-old son. A favorite of some wabs is to ask me to speak in English after I have said something in Spanish clearly and grammatically correct. I now live in Los Angeles, where for some reason I get much more respect from African-Americans than other Latinos. Is there a seemingly logical reason for this disrespect from wabs and pochos alike?

Dear Big-Bellied Pocho: Just a quick

refresher for people who ain’t from la naranja:

a wab is a term specific to OC and is what

assimilated Mexicans and gabachos call

recently arrived Mexicans (before other

Chicanos dismiss my homeland again as a

fountain of anti-Mexican hate—all Chicano

communities across los Estados Unidos have

their own unique terms, as we discussed in this

columna a couple of years back).

While I understand your pain, you’re

going to have to deal with the realidad

that Mexicans are always going to hate on

other Mexicans for one reason or another.

Pochos will hate other pochos for being too

successful or not Mexican enough; pochos

will hate wabs for not being successful

enough or too Mexican; wabs will hate

pochos for definitely not being Mexican

enough; and wabs will hate wabs for being

too successful or not being Mexican enough.

Pochos get the brunt of it because they’re the

most gabacho, the one group all Mexicans

can agree to hate. But truth is, Mexicans

hate Mexicans more than gabachos hate

Mexicans, and the sooner we get rid of this

pendejada from our psyche, the quicker the

full Reconquista will be complete.

On a recent trip to New Braunfels Farmer’s Market to visit with friends, listen to music andsample the local goods, I came upon various oils and vinegars made by Texas Olive Ranch.These flavorful oils inspired me to create a pork dish that was light and refreshing with theflavors of tropical fruit. This recipe is great for backyard grilling or tailgating. You can servethese kabobs over rice or use quinoa, which is a high protein grain and cooks just like rice. Themarinade also serves as lovely vinaigrette when served over greens.

Orange Balsamic Glazed Pork Kabobs with Tri-Colored Quinoa

• 3lbsCountryStylePorkRibs(orpork loin or pork shoulder/Boston Butt)• ¼cupTexasOliveRanchRioOrange Olive Oil• ½cupTexasOliveRanchOrange & White Balsamic Vinegar• ½cuphoney• ¼tsporangezest• Salt&peppertotaste• 1freshpineappleskinnedandcubed• 2eachred,yellow,greenbellpeppers• 1largepurpleonion

Debone pork and cut into 1-inch cubes. Whisk together oil, vinegar, honey, orange zest, and salt & pepper in a large bowl. Reserve some glaze for brushing kabobs while grilling. Add pork and stir making sue all cubes are coated in the glaze. Refrigerate for 4 hours or more. When ready to prepare kabobs, cut up pineapple and quarter peppers and onion. Soak bamboo skewers water for at least 20 min. Prepare your gas or charcoal grill. Assemble kabobs alternating pork, pineapple, peppers, and onions. Grill at about 300° rotating the kabobs once so that each side gets grill marks and meat is browned with edges are slightly charred. Using reserved glaze that has not had raw pork in it, brush glaze over kabobs using a grill brush after each rotation. Once kabobs are fully cooked, remove from grill and serve over rice or quinoa.

While kabobs are marinating, you can prepare your quinoa. Pre-heat oven to 350°• 2tblsbutter,melted• 2cupsvegetablebroth• 1cuptri-coloredquinoa,rinsedanddrained• 1clovegarlic,minced• 2tblsfreshlimejuice• 1/3cupchoppedcilantro• 1/4tspgranulatedsugar• Saltandpepper,totaste

In a medium covered baking dish, combine, butter, vegetable broth, tri-colored quinoa and garlic. Cover with lid and bake for 20 minutes. Stir in lime juice, cilantro, and sugar. Season with salt and pepper, to taste. Serve warm.

Change for the BetterIt has been nearly four years since I came out of the closet, so to speak, and began writing openly as a libertarian (of sorts). At the time, libertarian ideas were a rare thing in political discussions, but I was heartened to see that the Tea Party Movement had created a toe-hold for libertarian ideas in the Republican Party. I was concerned, though, that republicans would welcome our votes and then paint us as cranks and crackpots who didn’t understand political reality. I wrote, in no small part to protect against that, to show that even the most strident of libertarian thinkers could understand the political game and make necessary compromises to get some movement in the right direction where before there had been none.

At the time my concerns were well-founded. Libertarians had always been easy to marginalize before; they often helped out with their own antics. I knew that libertarians and Republicans were not natural allies, but rather, that they were like-minded in a limited range of political issues. I knew that at the first opportunity, Republican leaders would try to limit the voice libertarians had. We have seen over the last few years that the Republican leaders have not disappointed. But a funny thing happened when libertarians were held up as being too stiff and uncompromising for politics in Washington.

Nothing.Libertarians weren’t chastised by

their constituents. They weren’t recalled or voted out or run out of town on a rail. They weren’t (for the most part) co-opted into the republican machine to maintain the status quo. They weren’t even made to back down or compromise.

Establishment republicans had instead made themselves targets for removal. They appeared to be lacking the spine necessary to make change in Washington. Tea Party Members and Republicans with a libertarian bent looked like heroes. The establishment Republicans that opposed them looked old, tired, and out of touch; they looked as though they were more concerned with being politicians than with fulfilling their roles as politicians.

Things seemed to have changed.A few weeks ago, I found myself looking

for something to write about that had not been covered. There was a time when simply offering the libertarian perspective on an issue of the day was enough, but now that

perspective is everywhere. I can even depend on a few elected representatives to frame the issues that way themselves. The libertarian point of view has become mainstream, boring even. How did that happen?

While it would be nice to take credit for having changed the world’s mind, it’s probably not true, so I won’t try to take credit for it. It is also probably not true that the Tea Party has been the cause of this change. They were a welcoming haven for libertarians, but their own rise has been a response to an outside force.

The truth is that when I began writing a column as a libertarian, I had not yet fully realized how much had changed in American politics and how much had changed in libertarian thought. It’s odd that I didn’t recognize this at the time. I was aware of the events as they happened but couldn’t see what those events were doing to the way people viewed their government.

For years libertarians had decried both Republicans and Democrats as differing in name only. Both parties inevitably voted for a larger, more bloated federal government. The only difference was in what areas each party expected the government to grow.

A perfect example of this can be found in President Ronald Reagan. He was a president who seemed truly skeptical of the increase of government size and power, and yet, his terms saw an increase in both. President Reagan is beloved by the Republican Party, but his spending is either explained away or overlooked, not addressed as a failing. The only reliable direction for the Republican Party was regarding government involvement in social issues. The newly empowered “religious right” was pushing government in a direction of enforcing values, making the government an unnecessary player in that arena.

The Democrats moved themselves to the “left” in response to the Republican move to the “right.” Anti-capitalist notions were pushed as far as they could go without breaking the electorate. President Clinton pushed forward with his own healthcare scheme before it fell flat with the American public. He is seen as a centrist now only because his inclinations were tempered by a need to work with Republicans after his scandals wounded him and his party significantly.

And so it went. Republicans and Democrats pulling away from one another on social issues and developing their own set of cronies on fiscal ones. Each party demonized

the other as a means to play to their base, and the unserved center grew.

Initially, the Libertarian Party and those of a libertarian bent were on the outside, the fringe of American politics, but somewhere along the line, the major parties overtook them. Suddenly, people like me were in the center. Suddenly, people like me were in a position to be listened to.

In fairness, there was a certain amount of libertarian movement during this time as well. The Libertarian Party began finding more mainstream candidates to run for president, and libertarians in general became less focused on individual issues and more focused on the direction of liberty in America.

Libertarianism was growing up. They started considering what types of compromise was acceptable. They hid the bong under the couch and cleared the Oreos off the sheets as they made the futon. They accepted the idea of voting for the lesser of two evils if it meant some movement in the direction of liberty. They took off the hemp sandals and banished them to the closet. They aligned themselves with constitutionalists, and accepted that the income tax would not be repealed overnight.

None of this would make any difference but that it gives libertarians a broader audience than they have ever had before. Toward the end of his career Ron Paul was receiving some attention from the popular press, but this was something he had to build to over years. His son (and West Virginia Senator), Rand, is a major player in Republican politics even though he is a relative newcomer. Similarly, issues like marijuana legalization are no longer scoffed at, and the idea of replacing the income tax with some smarter revenue stream is no longer unimaginable.

None of this is to say that libertarianism has won; it hasn’t. Libertarians still need to be careful in walking the line between the ethically correct and the politically possible if they expect to keep the level of influence that has fallen into their laps. Suggest the stars, but plan for the moon: this should be our guide. Libertarianism is as much principle as politics. We should never stop teaching the underlying ideas, but we need to remember that society, in some areas, may remain unconvinced.
