The Stated Meeting of the Presbytery of San Jose was called to order at 9:01 a.m. by the Moderator, the Reverend Irene Pak Lee, who offered the opening prayer.

WELCOME FROM HOST CONGREGATIONPastor David Watermulder welcomed presbyters to the Presbyterian Church of Los Gatos, noting location of restrooms, inviting presbyters to stay for lunch, and welcoming the Los Gatos choir for Saturday worship.

WORSHIP

The Presbytery of San Jose celebrated worship. The Reverend David Watermulder preached on Luke 15:25-32, focusing on the reaction of the elder brother to the return of the prodigal son.

1. The Presbytery APPROVED the minutes of the November 17, 2018 Stated Meeting of the Presbytery of San Jose.

Committee on Ministry1. The Presbytery APPROVED the parish associate agreement between the

Reverend I Sil Yoon and the Reverend Dr. Margaret Boles, pastor of Covenant Presbyterian Church, Palo Alto.

Financial Affairs1. The Presbytery APPROVED a Synod Loan for Westminster Presbyterian

Church for up to $50,000 to replace the HVAC system in the sanctuary, pending completion of the loan documents.

2. The Presbytery APPROVED the lease between Westminster Presbyterian Church and Promise Public Schools for 4.5 years with options extending to 20 years.

WRITTEN REPORTS1. Report of Presbytery Council

Presbytery Council met at the Presbytery office on January 10, 2019. The purpose of the Presbytery Council is to coordinate the life and ministry of Presbytery in accordance with policies, priorities, and goals enacted by the Presbytery. Implementation of the purpose was discussed. Polity and Government Subcommittee and the Nominating Committee reported. Two members of Council were identified to explore video conferencing options. Prayers were offered for various members of Presbytery.

2. Report from Synod CommissionersThe Synod of the Pacific met from October 3-5, 2018, at Mercy Center in Burlingame, CA. The Synod elected the Reverend Nancy Martin Vincent as the new Synod Executive, who will begin February 1, 2019. The Synod elected the

Reverend Kathy Runyeon as Synod Stated Clerk, working half-time beginning January 1, 2019. The Reverend Joshua Trautmann was installed as Synod Moderator and the Reverend Laura Baarda was installed as Synod Vice-Moderator. Several other Synod personnel and volunteer situations were outlined. Several loans and grants were approved. The Synod has been studying racism by reading and discussing various resources. The 118th Stated Synod Assemly is scheduled for May 8-10, 2019, at Zephyr Point Presbyterian Conference Center.

3. Report from Mission and Outreach Task ForceMission and Outreach submitted its Annual Report for 2018. Goals of the Task Force were outlined as well as the ways the Task Force worked toward the goals. Connections were made with Mission Co-Workers and in Puerto Rico and Africa. The Presbytery Mission Adventure took place in October with mission opportunities for congregation members happening around the presbytery. More than 400 people participated.

NOMINATING COMMITTEEElder Claudia Hamm reported on the work of the Nominating Committee, placing the following name in nomination for the Committee on Ministry, and which was APPROVED by the presbytery:

Action Item:1) The Presbytery EXAMINED Ms. Sharon LeClaire for ordination into a stated

supply ministry at Stone Church of Willow Glen. After several questions which were answered by Ms. LeClaire, the Presbytery VOTED to arrest the examination and APPROVED Ms. LeClaire's ordination.

2) The Presbytery APPROVED the ordination commission, consisting of the following members: the Reverend Irene Pak Lee, Moderator of San Jose Presbytery; the Reverend Joey Lee, Executive Presbyter; the Reverend Mark Peake, First Presbyterian Church Monterey; the Reverend Samantha Evans, Stone Church of Willow Glen; the Reverend Margaret Boles, Covenant Palo Alto; Elder Steve Nelson, Stone Church of Willow Glen; Elder Alice Thorn, Stone Church of Willow Glen; Elder Jerry Keifer, Stone Church of Willow Glen. The ordination will take place at 3 pm on February 17, 2019, at Stone Church of Willow Glen.

2) COM approved the contract between Rev. Evie Macway and Santa Teresa Hills Presbyterian Church, as transitional pastor for a one-year term beginning February 1, 2019.

3) COM approved the contract (1/4 time) between Rev. Mike Garner and San Martin Presbyterian Church for the calendar year 2019.

4) COM approved the contract between Rev. Ted Esaki and El Estero Presbyterian Church for calendar year 2019.

ADMINISTRATIVE PERSONNEL ASSOCIATION CERTIFICATIONBethann Merriam, Church Administrator at Sunnyvale Presbyterian Church reported on the work of the Administrative Personnel Association and encouraged participation by church administrators with the support of their pastors. Look for the Pacific Region Conference at Zephyr Point, Nevada, September 24-27, 2019.

POLITY AND GOVERNMENTElder Carol Holsinger announced three upcoming events for Clerks of Session: an informational lunch meeting after the presbytery meeting today; the deadline for submission of each church's Statistical Report is February 8, 2019; Review of Session Records will be held on Saturday, March 16, 2019, between 9:30 and 11:30 am at the Presbyterian Church of Los Gatos.

The Reverend Bryan Franzen described the Manual of Administrative Operations Outline which has been developed by the Polity and Government Committee in order to assist congregations to be in compliance with G-3.0106.

CHURCH HEALTH AND GROWTHThe Reverend David Watermulder reported on the work of the Church Health and Growth Task Force. Thank you to participants of programs focused on growing relationships between pastors. 2019 plans are being developed.

SAFE CHURCHElder Jane Odell reported on the work of the Safe Church Task Force. Clergy Boundaries Training will be held on February 9 and May 4, 2019, from 9-1 at the Presbytery Office. Lunch is included. Clergy must attend one of these events.

Safe Church Training (new or refresher) will take place on Saturday, March 30, 2019, at San Jose Westminster from 9:30-1. This training is for clergy, officers of the church, and anyone who works with children, youth, or other vulnerable populations.

The winner of the contest for the new name for the Safe Church Task Force is the Reverend Jenni Bales. The new name is GPS: Guiding, Preparing, Safeguarding.

FINANCIAL AFFAIRSThe Reverend Edd Breeden reported on the work of the Financial Affairs Committee. Training for Church Treasurers will take place on Saturday, March 16, 2019, from 9:30-noon at the Presbytery Office.

The Stewardship Kaleidoscope Conference will take place from September 30 through October 2, 2019, in San Diego. The Presbytery of San Jose will pay registration for anyone who wishes to attend.

Information One-year lease between Westhope PC and Genentech approved by committee. Two one-year leases between St. Andrews PC and Iglesia de Dios Santa Cruz

approved by the committee. Six-month lease between Westminster PC and Promise Public Schools was

approved by the committee. One-Year lease between Taiwanese American PC and Cha Cha Percussion, Inc.

was approved by the committee. Promissory note approved between the Presbytery and Westminster PC for

$50,000 as bridge funding until Westminster’s receipt of the Synod loan. $1,000 sponsorship for the 2019 Kaleidoscope Stewardship Conference was

approved. The conference will be in San Diego this year. Change in our investment policy from 40% stock/ 60% fixed income to a 50%/

TRANSITIONSMembers of the presbytery participated in a Litany of Departure and Dissolution for the Reverend Tom Coop. Tom said a few words and offered a prayer with members of Santa Teresa Hills Presbyterian Church surrounding him.

ANNOUNCEMENTS/JOYS AND CONCERNS/OPEN MICThe Reverend Joey Lee offered a Commissioning Prayer for the 20 people from 4 churches in the presbytery who will be going to the United States/Mexico border from February 15-20, 2019, asking God for safety and discernment.

The Reverend Margaret Boles noted that four of the youth who went on the mission trip to Puerto Rico want to return so they are considering another trip in June 2019. Presbyters are invited to participate.

Trinity Presbyterian Church and GKI (Indonesian Christian Church), both in San Jose, will hold a fundraising event to assist victims of the two tsunamis which hit Indonesia in 2018. Join them for a Musical Play and Fundraising Night on Saturday, February 23, 2019, at 5 pm, at Trinity Presbyterian Church, San Jose. $30 price includes dinner and 100% of proceeds will be for aid.

Presbyterian Women in the Presbytery of San Jose will present a Forum: God's Promise . . . Overcoming Adversity on Saturday, March 23, 2019, from 9 am to noon at Los Gatos Presbyterian Church. Three women will share their stories.

Youth Triennium registration is open. The Presbytery pays for travel and the participant or their church pays registration. The Reverend Irene Pak Lee is the registrar in our Presbytery so please be in touch with her for more information.

Needs relating to the Camp Fire in Paradise, California, are ongoing. Donations to Presbyterian Disaster Assistance are helpful. There is also an option to Adopt-A-Family. If you are interested, please contact Peacemaking Advocate Geoff Browning.

Elder Robert Fitch reminded Presbyters that there is a stole that circulates during the Presbytery meetings. People wearing the stole are actively praying for our work together.

Members of the presbytery shared joys and concerns and prayed for God's will and work to be done in the world.

STATED CLERKThe Stated Clerk, the Reverend Erica Rader, thanked the Presbyterian Church of Los Gatos for hosting our meeting. After years of faithful ministry, in the face of declining membership, our oldest congregation has been faithfully undergoing a process of discernment about the future of their church.

The Presbytery Council received notification that the congregation of First Presbyterian Church of San Jose approved two motions at a called meeting on February 17, 2019.

First, the congregation of First Presbyterian Church of San José requests that it be dissolved by the Presbytery of San Jose as of June 30, 2019. Secondly, the congregation of First Presbyterian Church of San Jose requests that the Presbytery appoint a Commission to establish plans for the usage of First Presbyterian Church of San Jose’s real property at 49 N 4th Street, or reinvestment of proceeds from sale of that real property for the purpose of establishing a base for ongoing urban ministry that continues the legacy of First Presbyterian Church of San José.

First Presbyterian Church San Jose

First Presbyterian Church of San Jose:Faithfully Serving San Jose for 170 Years

Organized in 1849

On February 23, 1849, the first steamship to venture up the California coast entered the Bay of Monterey. Among its passengers was Rev. John W. Douglas, newly commissioned by the American Home Missionary Society. A month later Rev. Douglas chose the Pueblo de San Jose de Guadalupe for his field of ministry.

Rev. Douglas considered San Jose an important place, and subsequent events confirmed his judgment. The California Constitutional Convention, meeting at Monterey on September 4, 1849, changed the state capital from Monterey to San Jose. A few years later, San Jose would lose its status as state capital, but San Jose continued to boom. Santa Clara County became a center of agriculture that fed the Gold Rush miners. As transportation improved, Santa Clara County, with San Jose as its seat, became known as “The Garden of the World” for the fruits and vegetables grown here.

In March 1849, this young and enthusiastic Presbyterian minister began his ministry in San Jose. From his letters to the American Home Society, we read: “My audience on the Sabbath is much larger than I anticipated it would be in March, owing to the fact that many of those who left two months ago for the mines have returned to reside until September.”

Sanctuaries built: 1851, 1863, 1908

A few months later, in October 1849, he wrote: “I have organized a Presbyterian Church here of 6 members.” Although not officially called the First Presbyterian Church until 1858, they first met in the Juzgado, or courthouse of the Alcalde, then in a hastily erected building where the State Legislature met; and several times in Grandma Bascom’s Blue Tent on Second Street. A Church structure of wood was soon built on North Second Street, across from the present Trinity Episcopal Church. The dedication took place in 1851.

First Presbyterian Church San Jose

In a little over a decade, the original wooden building proved inadequate and a $20,000 brick structure was erected in the midst of Civil War days in 1863. This building, repaired after the earthquake in 1868, continued in use until the earthquake of 1906 demolished the church. The steeple was thrown into the street. The east wall fell on the pipe organ and the building was deemed unsafe to enter. Nineteen deaths were reported in downtown San Jose. The new building, located at 48 N. Third Street, was completed and dedicated in April 1908.

Birthing New Churches

Over the years, First Presbyterian Church of San Jose has given birth to numerous other Presbyterian churches. In 1892, 77 members were dismissed to organize Second Presbyterian Church, now known as Westminster Presbyterian Church. In 1944, a committee of Elders from First Presbyterian laid the foundation for Foothill Presbyterian Church. In 1953, nearly 250 members from First Presbyterian became the charter members of Calvin Presbyterian Church. Calvin Presbyterian closed in 2007 and is now the home to Cornerstone Church of Silicon Valley and the Presbytery of San Jose offices.

Changes in the last 50 years

During the 1950s, First Presbyterian Church witnessed what many downtown churches experienced in the era of “suburban flight.” By 1969, it was clear that First Presbyterian Church must redefine itself in order to continue to be a meaningful presence in the downtown community. The long-range planning committee spent considerable time assessing the needs of the surrounding community. It was clear that building deterioration, shrinking membership, and the need for a residential facility for low-income seniors required the demolition of the 1908 church. On its footprint was built Town Park Towers, a not-for-profit ten-story apartment building with 216 residential units.

In 1973, First Presbyterian Church dedicated a new, smaller sanctuary with classrooms and a parking lot fronting Fourth Street.

Compassion for the Homeless

In the early 2000s, San Jose City Hall and the San Jose Public Library became church neighbors on Fourth Street. By the late 2000s the plight was evident of homeless and food-insecure neighbors who surrounded the church downtown. This population was a sharp contrast to the increasing prosperity of local businesses. First Presbyterian Church began a program to pack April 6, 2019 Presbytery of San Jose Meeting Docket 14

and distribute lunches to whomever came to the front door. These lunches now total approximately 600 lunches each week. First Presbyterian Church invited other churches and community groups to join them in providing resources and support.

In 2014 First Presbyterian Church started a women’s drop-in center to give homeless women a respite from the streets. First called Women’s Gathering Place and now called Lifted Spirits, the program provides hot meals, clothing, toiletries, and a safe resting place three afternoons a week.

As the ministries of compassion grew, in 2017 the church sought to broaden support of these by organizing the morning bag lunch program and the women’s drop-in center under a non-profit corporation “Front Door Communities.”

An Ending and Resurrection Hope

In 2019, after declining and aging membership reduced their numbers, the Session and congregation of First Presbyterian prayerfully discerned that they could no longer continue as a viable congregation. The congregation has requested that the Presbytery dissolve the church as of June 2019. First Presbyterian has requested the Presbytery use their property as a base for ongoing urban ministry, with resurrection hope that their missional legacy in downtown San Jose will continue.

PRESBYTERY OF SAN JOSEDEED PROGRAM

Action From Council:Move that the Presbytery establish a program for churches in the Presbytery of San Jose to transfer title of their church property to the Presbytery and collect copies of church bylaws.

BACKGROUND AND BENEFITS: Presbytery staff and Financial Affairs became aware that church property deeds are held in a variety of ways. Half of our churches include the name of the Presbytery on their title. In 2018 we incurred legal expenses in resolving a deed complication for our Meridian Way church property which could have been avoided with a consistent title on property deeds. We began researching and determined that this would be a good project for the Presbytery to fund and coordinate for the following reasons:

Alignment with Polity:

Under the PC(USA) Constitution, all church property is held in trust for the use and benefit of the denomination, reflecting that churches are part of a connectional body.

Approximately half of the churches in the Presbytery already have their property held in the name of the Presbytery.

All congregations across the maintain the agency and responsibility for their property, with Presbytery oversight as constitutionally require.

Alignment with financial inter-dependency:

Churches generally rely on the Presbytery for their tax-exempt status.

The Presbytery guarantees loans obtained by churches. Thus, a church’s borrowing capacity is increased by its relationship with the Presbytery.

Having the Presbytery on title will simplify recordkeeping and expedite Synod loans and other transactions involving the property.

The Presbytery signs leases entered into by churches and therefore shares liability with churches on lease transactions.

Because of the close bonds between a church and the Presbytery, the Presbytery has exposure for other losses or liabilities sustained by a church.

Contingency planning and risk management:

If a church closes or does not have a Session able to act on its behalf, having title in the Presbytery’s name will expedite dealing with financial and property issues.

Presbytery staff can review and resolve any non payment of property taxes that endangers property status.

If a church suffers a fire, flood, or other catastrophe, the Presbytery staff could more effectively assist the church in dealing with insurance companies and other agencies on their behalf as well as securing insurance loans from the Synod if the Presbytery is on the deed.

5) COM examined Rev. Bruce Reyes-Chow for membership in the Presbytery, and approved his membership, pending the vote of the congregation of First Presbyterian Church of Palo Alto to call Rev. Reyes-Chow as its pastor for a designated term of four years. Statement of faith and brief bio are attached.

6) The congregation of First Presbyterian Church of Palo Alto voted to call Rev. Reyes-Chow as its pastor for a designated term of four years, beginning April 1, 2019. Financial terms are set forth in a separately-distributed sheet.

7) COM examined Rev. Jaeguen Lee for membership in the Presbytery, and approved his membership. COM will take up the question of validation of Rev. Lee’s ministry as pastor of iChurch, a Presbyterian group seeking to join PC(USA).

8) COM reviewed the mission study report of Santa Teresa Hills Presbyterian Church and approved that congregation’s appointing a Pastor Nominating Committee.

4. REVENUE, the income of the Presbytery is divided into broad categories for better understanding. 5. PER CAPITA, this is the Presbytery’s portion of the amount paid by the individual congregations based

upon the number of members on their roles at the time of the previous year report. 6. CONGREGATIONAL MISSION, this the Presbytery portion of the Basic Mission Giving from the churches of

the Presbytery. 7. POOLED INVESTMENT, some of the returns from Presbytery’s investment pool are used to help fund the

budget of the Mission and Ecclesiastical Program.8. SYNOD AND GA FUNDING, Synod of the Pacific has extra income from their Savings and Loan program and

they share some of their excess with each of the Presbyteries in the Synod. There are a few endowments set up at the Synod (Anne Penke) and the GA (Walker) that send income to the Presbytery and some of our expenses are part of the GA funding programs (i.e. Hunger, Peace).

9. IMMANUEL HOUSE, this is a pass through account, the money that comes in for IH is given to them. 10. OTHER INCOME, this represents the amounts from the “interest” on the dismissal money used for various

Community Mission Projects, Congregational Renewal Projects, Per Capita assistance, etc. 11. DISBURSEMENTS, the expenses of the Presbytery are divided into three areas based upon our vision

statement. We are seeking to build connections between churches and the community, we are seeking to provide needed resources to congregations, and we are seeking to help individual ministries as well.

2. MISSION/PROGRAM Budget, the revenues come from the Basic Mission Giving of our congregations with some assistance from Presbytery investment income and supports the general mission programs of the Presbytery.

3. ECCLESIASTICAL Budget, the revenues come from the Per Capita of our congregations with some assistance from Presbytery investment income and supports the operations of the business of the Presbytery.

4. ASSETS, the assets are defined as any real asset, like a bank account, the value of investments, the value of real property and the like. See Note 1 regarding Real Estate not mentioned in this report.

5. LIABILITIES, the liabilities show how much of the assets are allocated to specific projects. For example, your home bank account might have 5,000 in it. But some of that money is specifically earmarked for the upcoming insurance payment and future property taxes so you cannot spend all of the money in the checking account. The Presbytery has obligations as well.

6. Cash Accounts, these monies are in bank and savings accounts and in “demand” accounts at the Synod. They are to help meet the short term obligations of the Presbytery; i.e. day-to-day cash flow.

7. Bank & Savings Accts, are the balances of various bank and savings accounts.8. Synod Cash Accts, are the balances of various deposits with the Synod of the Pacific in Custodial Funds

that receive interest. These include accounts where the money is deposited on demand just like a savings account. (Note: These accounts are available to local PCUSA churches in the Synod but not to individuals.)

9. Investment Accounts, these accounts include mutual funds, ETFs, Bonds, and some investment related cash.

10. Synod (MDC) Accts, are similar to CDs which pay a higher rate of return depending on the length of time the money is invested. This is a product of the Synod of the Pacific; and is available to local churches in the Synod but not to individuals.

11. Presbyterian Foundation (NCF) Accts, are mutual funds invested by the New Covenant Funds. The Growth fund invests in stocks of the S&P 500 companies with the Socially Responsible guidelines of the General Assembly. The Income Fund includes government bonds and similar fixed income opportunities. You can see information about these investments on their website; NewCovenantFunds.com

12. Brokerage Acct, The Stock portion of the Brokerage account is invested in S&P 500 vehicles SPY, SPYX and SUSA. The Bond portion of the Brokerage account is invested in a variety of corporate available on the open market; laddered out over a 8-10 year time horizon.

13. Credit Lines Outstanding, in certain extraordinary circumstances the Presbytery has loaned monies at interest for specific projects that seemed beneficial. Presbytery encourages churches who are looking for loans to take advantage of the Synod Loan Program and their various different interest rates and loans.

14. Restricted Funds, have been set aside for specific projects, with the expectation that they will be used in the future for those purposes.

15. Special Funds, set aside to pay for programs in the future, like the Youth Triennium, Camperships, Christian Education projects, Cong Development, Representation, Justice & Mission, and COM projects.

16. Scholarship Funds, the proceeds of these funds, primarily coming from the sale of the Corralitos Camp property and set aside at the time by a vote of Presbytery, are used for scholarships for people within the Presbytery to attend camps and conferences.

17. Evergreen (Property), money from the sale of the church property produces income to help the Evergreen church with some of its ongoing expenses.

18. Cypress Ave. Funds, came from the sale of the Cypress Ave Property and were set aside at the time for Korean American ministries.

19. Dismissal Receipts to date, these funds have come from the settlement agreements of the dismissal of churches in our Presbytery. The proceeds of these investments will fund per capita, community mission, and congregational renewal through grants to churches in our Presbytery. See the criteria and the application forms under the Financial Affairs Committee on the Presbytery website; sanjosepby.org.

20. Reserve Fund, with an ongoing combined Mission Program and Ecclesiastical Program Budget of 750,000, the reserve monies are designed to produce enough Return on Investment (ROI) to cover approximately 1/4 of the annual budget if so needed.

21. UnRestricted Funds, these funds are monies that have not been earmarked for a particular purpose or projec

RESPONSIBILITIES OF PRESBYTERY COMMITTEES COMMITTEE ON MINISTRY The purpose of the Committee on Ministry is to assist congregations as they call, employ, and work with Ministers, and to facilitate relations among Ministers, congregations and the Presbytery. Some of the Committee on Ministry’s responsibilities:

• Periodic visits with sessions and congregations in the Presbytery • Counseling and guidance for congregations during transitions between pastors • Monitoring of compensation for Ministers in parish ministry • Communication with all Ministers, including those at large• Approval of Ministers seeking membership in the Presbytery • Periodic continuing education events/retreats for Ministers

COMMITTEE ON PERSONNEL The purpose of the Committee on Personnel is to provide oversight of all staff employed by the Presbytery . Some of the Personnel Committee’s responsibilities:

• With Presbytery Council develop position descriptions • Provide oversight of all staff employed by Presbytery • Conduct annual reviews for Executive Presbytery, Stated Clerk, Treasurer • Review annual evaluations of administrative support staff performed by Executive

Presbyter • Recommend appropriate compensation for all staff within limits recommended by

Financial Affairs Committee • Submit recommendations to Presbytery Council for action in disciplinary matters

• Manage all real property and assets of the Presbytery • Oversee all financial policy matters• Execute all legal documents on behalf of the Presbytery when so ordered • Set ecclesiastical budget • Obtain Presbytery or Committee approval before any church or organization shall lease

or rent any real property for one year or more

PRESBYTERY COUNCIL The purpose of the Presbytery Council is to coordinate the life and ministry of Presbytery in accordance with policies, priorities, and goals enacted by the Presbytery. Some of the Presbytery Council’s responsibilities:

• Helps set priorities for Presbytery meeting dockets • Make adjustments to the Presbytery budget • At its discretion, act on behalf of the Presbytery on administrative and ecclesiastical

matters between Presbytery meetings • Recommend Task Forces for Presbytery approval and oversees with liaisons • Annual interpretation and presentation of the Mission budget • Polity & Government is a sub-committee of Presbytery Council • Members of the Committee on Nominations and the chair of the committee are

nominated by the Presbytery Council

• Develop leadership among those historically excluded from leadership in the church • Identify name, and respond to the many forms of discrimination in church and society • Educate the Presbytery and its congregations on issues of racial and gender justice,

diversity, and empowerment.•
