NCBJ 2020 2 SAN DIEGO

Message from the NCBJ President The NCBJ looks forward to welcoming you to San Diego in October. At this time the conference planning is moving forward as we hope that by the Fall we will all be traveling. I know we are all looking ahead to the excellent educational programs that are being developed and seeing our industry colleagues.

However, we all know that the course of the pandemic is dynamic. NCBJ leadership is following all developments closely, including all city, state and federal health directives as they evolve. We understand that not having predictable health guidance now for October is unsettling. We continue to closely monitor the situation, as well as keep in contact with our conference partners and the Marriott. The NCBJ will keep you regularly advised of our conference plans. Should the NCBJ need to pivot away from an in-person gathering, you will hear from us immediately. Refund Policy: If the conference goes forward, then our regular refund policy will remain in place. Until September 11, 2020, NCBJ will refund fees paid by check or credit card for conference registration, additional options such as luncheons or NCBJ tours that have been paid to NCBJ, less a $100 service fee. Refunds will not be available after September 11th although, as always, registration is transferable to another attendee. If the conference is cancelled at any time prior to October 17, 2020 NCBJ will refund all fees paid to NCBJ by check or credit card for conference registration, and additional options such as luncheons and NCBJ tours. There will be no service fee deducted from refunds issued if the meeting is cancelled by the NCBJ. Hotel information and refunds: The Marriott Marquis San Diego Marina is closed until a projected re-opening date of June 1st. The Marriott group guest reservation links on the NCBJmeeting.org website are open and guest rooms can be reserved now for the annual conference. Should your personal travel plans change, or the hotel’s expectations of when they can host guests changes, or if the hotel will be closed over the NCBJ dates, the Marriott will refund deposits paid for guest rooms booked through the NCBJ website in accordance with the hotel’s published cancellation and refund policies. You must cancel your own reservation as it is a personal transaction between you and the hotel. For so many reasons I hope to see you all in San Diego in October. In the meantime, stay well and stay safe. Laurel Isicoff Hon. Laurel Isicoff NCBJ 2019-2020 President

The International Women’s Insolvency & Restructuring Confederation is an organization committed to the connection, promotion and success of women in the insolvency and restructuring professions worldwide. NCBJ Opening Reception Wednesday, October 14th from 5:30-7:30 pm the “Welcome to San Diego” opens the social activities for the NCBJ 94th Annual Conference at the Marriott Marquis San Diego Marina. We expect 1,400 insolvency professionals, judges, and guests to kick off the conference. Make plans for dinner at one of the many restaurants in the nearby Gaslamp District or along the waterfront. Next Generation Alumni Dinner

Alumni from the first ten years of NCBJ Next Generation are invited to participate in the Class of 2020 Wednesday social and networking activities in San Diego. By August you should have received an email about the Next Gen plans. If not, contact: [email protected].

Dine Around It was a huge hit in DC and expanding in San Diego. It’s a no host dinner at a local restaurant with the

table coordinated by a judge. Varied cuisines and price points within walking distance of the hotel are planned. Watch for the email announcing that sign up is open, reply, and save your spot. It’s a great way to network, make new friends and have dinner, especially if you are a solo attendee or first time NCBJ’er. Dine Around restaurants are being finalized, but Wednesday and Friday look like the nights. Breakfast with Friends! Hot breakfast is provided on Thursday, Friday, and Saturday mornings. From 7:30-9:00 am Thursday and Friday meet in Pacific Ballroom Salon 21 for a healthy buffet breakfast. Saturday morning is Eggs & Ethics - Breakfast with the Judges on the Grand Ballroom Terrace.

Attendee Lounge and Speaker Huddle Following the Plenary sessions on Thursday and Friday will be a 30-minute break, and a 15-minute

break on Saturday. These breaks are the time to meet the speakers from morning sessions, relax with snacks and beverages, visit with the exhibitors and reconnect with colleagues. The breaks are in the exhibits area of the Grand Ballroom Foyer.

Sail The Bay Regatta – the Best End of Conference Activity Ever! Sail the Bay on Saturday 11:45 am — 5:30 pm in the NCBJ Regatta in San Diego

Bay. Twelve boats with six passengers and a USCG Captain will practice sailing basics, then the hit the start buoys for the Regatta. You can book a whole boat or book a solo spot. We expect the boats will sell out quickly, so don’t delay in drafting your crew and reserving your boat. Champagne and Bragging Rights are up for grabs. If you like being on the water, bring your shorts, rubber-soled shoes, sunglasses and join in the fun. Novice to old salts welcome. The regatta is in the Bay and Harbor, and not in the open ocean. FRIDAY, OCT 16 8:45 AM – 9:00 AM GRAND BALLROOM 5-9 Inns of Court Award Presentation and Announcement

9:00 AM – 10:00 AM GRAND BALLROOM 5-9 NCBJ Friday KEYNOTE Restructuring in the Wake of Coronavirus The economic catastrophe created by the Coronavirus is unique. In the past, recessions have been prompted by sustained periods of high interest rates. This recession has been caused by a virus and it is hitting the United States and world economy already saddled with record levels of debt. Almost all businesses are dealing with the prospect of sudden ends to cash flow, yet a relatively new generation of companies, "zombies" who earn too little to make even interest payments on their debt are faced with the ultimate challenge. The level of debt in America's corporate sector amounts to 75% of the country's gross domestic product, breaking the previous record set in 2008. Debt burdens are precariously high in numerous industries that are now taking a direct hit from the Coronavirus. Join us for a fascinating fireside chat with Professor Troy McKenzie of New York University School of Law, Jamie Sprayregen or Kirkland & Ellis and Jennifer Hagle of Sidley. They will explore and discuss strategies to use in this unique time in economic history. Is the Bankruptcy Code useful, are there strategies outside the Code which are helpful and how can professionals work to benefit their clients in a world like we have never experienced?

10:30 AM – 11:30 AM GRAND BALLROOM 5-9 You be the Judge! Come join us for a fun and interactive learning experience. While “donning a robe,” you can rule on a thorny bankruptcy issue that judges face. After a scenario is presented by a judge, the participants will discuss in a small group how they would resolve the issues. Each group will have a judge and a NextGen person to assist in the discussions. The groups will report their “decisions” and then the presenter will offer their thoughts on how they ruled (or would) rule on the matter.

THURSDAY, OCT 15 12:45 PM - 2:45 PM PACIFIC BALLROOM SALON 21 CLLA Luncheon, presentation of the Lawrence P. King Award & Keynote Making It In a Man's World Keynote, Jackie Kallen Learn how a very ordinary little girl ended up leading a very extraordinary life. By have confidence, taking risks, beating the odds, and overcoming adversity, anyone can be the champion of their own life. Jackie Kallen is the world’s most successful female boxing manager. She fought against all odds to prevail in a male-dominated professional. A journalist-turned publicist for Thomas Hearns and Detroit’s Kronk Boxing Team, Kallen spent ten years learning the ropes of the boxing world. As a manager, she groomed James Toney to become a world champion shortly after launching her business. At the podium, Kallen reveals her secrets to overcome adversity in all forms-sexism, discrimination and even life-threatening illness-to triumph overall. Kallen, a writer since elementary school, had a colorful career before she ever met a boxer. An entertainment journalist who interviewed everyone from the Rolling Stones to Elvis and Sinatra, her work led her from hometown Detroit to New York City and back home to raise her family. A 1977 interview with six-time world champion boxer Thomas Hearns set her on her path, beginning as a publicist for him and the legendary Kronk Boxing Team. For ten years Kallen learned the ins and outs of the business. By 1988, she was ready to strike out on her own,

managing fighters including a scrappy you man named James “Lights Out” Toney. Three years after she started managing him, Toney was a champ and Jackie was on top of the game. Still, despite two nominations for Manager of the Year, a stint as commissioner of the Female Boxers Association and a wall full of awards and honors, Kallen continues to fight for acceptance. Jackie is the author of Hit Me with Your Best Shot: A Fight Plan for Dealing with All of Life’s Hard Knocks. She is also driven to raise awareness about women’s health issues, specifically the early detection of heart decease and breast cancer. A dynamic and inspiring speaker, Kallen motivates audiences to empower themselves and fight against adversity to achieve personal success. Jackie currently resides in Los Angeles.

3:15 PM - 4:45 PM GRAND BALLROOM 21 CLLA Frank Koger Memorial Program (CLE) Disrupted Industries and the Bankruptcy Fallout The global pandemic and resulting economic fallout, along with federal, state and local government responses have modified the landscape of bankruptcy. The panel will address the effects and issues relative to multiple distressed industries.

If the initial tour for 24 guests fills, we will have a wait list to try and accommodate more participants. If you pay to hold a spot on the wait list and the second bus does not fill, your tour payment will be fully refunded. Balboa Park is one of the oldest (est. 1868) and most varied parks in the United States. Named for Vasco Nuñez de Balboa, the first European to spot the Pacific Ocean while on exploration in Panama, it sprawls over 1,200 acres. San Diego hosted the 1915 Panama-California Exposition here, with some of these original buildings still home to some of the many museums in the park. You won’t have time to explore all of the many museums, gardens, zoo, walks, and other attractions here… but that doesn’t mean you can’t try! Grab a friend, or explore on your own or stick with the guides … this is your opportunity to enjoy this historic park and choose how you spend your time in the park. Entrance fees to museums or the zoo are not included in the NCBJ tour pricing. Be prepared to pay $9 - $15 per museum. Travel by coach from the Marriott to one of two drop off locations. The tour guide will tell you what is near each location, so you can make you way to the things you find most alluring. Maps will be provided. After an hour on your own 10 – 11 am, you may choose to rejoin the tour guides in the central plaza to stroll down a palm-lined street to the Spanish Village Art Center (or not… you are welcome to continue exploring on your own, if you wish). The Center was patterned after a typical Spanish village, with many small shops and galleries clustered around a central plaza with shaded seating. This plaza is home to nearly 200 local artists, with dozens of studios and featuring paintings, pottery crafts, sculptures, jewelry, and other forms of art. Browse, admire, or purchase, the choice is yours. Next the guide will lead the group on an easy walk along the upper Palm Canyon boardwalk, on the

way to Prado, a popular Mexican restaurant located in the Hospitality Center. The unique décor blends the historical aspects of the House of Hospitality and whimsical accessories inspired by the Park museum collections. You will have time to relax, and savor the foods from a special limited menu especially for the NCBJ group. You’ll be able to choose your entrée meal choice in advance included in the tour price. Any extras or other options that you choose to order at Prado are on your individual tab. After lunch we’ll board the bus at 2 pm sharp for the return to the Marriott by 2:30 pm. You will be informed by the guide of the exact 2 pm pick-up location near Prado Restaurant when you arrive at 10 am. If you miss the 2 pm group return, you will need to make your way back to the hotel on your own. "Hello, Uber!" Remember: sun screen, comfortable walking shoes, sunglasses, and cameras. Flash photography is not permitted inside the fine arts museums. This tour can be enjoyed by leisurely-paced strolling on nearly flat sidewalks and streets if going to the museums mentioned in this article. The overall park also offers moderate to active hiking with steep terrain, steps and elevation changes and park features that are a distance from each other across 600 acres. Some museum are closed for changing exhibits or rehabilitation of the building. Consult the Balboa Park website for posted closures. ComiCon’s new location will not open until fall 2021. Departure from the hotel: Bring your ticket. Meet at the curb just outside the Pacific Ballroom foyer doors (lower level) at 9:15 am. The bus will depart

promptly at 9:30 am. Best Known Museums Near the Central Plaza: The Museum of Man is an anthropological museum, and is housed in four of the historic building constructed for the 1915 Panama-California Exposition. These ornate buildings include the California Quadrangle and the

California Tower, two of the most famous structures in San Diego. The collections here focus on pre-Columbian history of the western hemisphere, including the Maya and many local native American tribes. Their Egyptian collection is one of the most collections in the United States. You will enjoy the many interactive displays and informative exhibits. The buildings of this museum are adjacent to the Central plaza. Entry fee: $13 The San Diego Museum of Art’s mission is to inspire, educate, and cultivate curiosity through great works of art. The museum regularly features major exhibitions from around the world, bringing new works of art to San Diego. The museum’s nationally renowned collections include Spanish and Italian old masters, South Asian paintings including the Edwin Binney 3rd Collection of Indian paintings, and 19th and 20th century American paintings and sculptures. This museum is on the Central Plaza. Entry fee: $10-15

"Choo, choo!" The San Diego Model Railroad Museum has amazing track layouts and model designs, sure to delight the most discriminating train enthusiast. Elaborate dioramas and to scale models and tracks fill entire rooms with the vintage history of how the railroads shaped our country. This museum is located on the walking route from the Central Plaza to the Spanish Art Center. Entry fee: $9-12.50 Also along the walking route to the Spanish Arts Center, and across the street from the Railroad Museum is the Conservatory and surrounding gardens. Space… the Final Frontier! San Diego was home to some of the earliest aviation efforts in the country. John Montgomery likely made the first human-carrying glider flight in America in 1883 at Otay Mesa. The museum’s exhibits span the history of aviation. Your journey through the history of flight begins as you stand beneath a model of the

Montgolfier brothers’ hot air balloon of 1783 - the first manned vehicle in recorded history to break the bonds of gravity and lift humans above the Earth. Rare aircraft from WWI, WWII, the Korean and Vietnam conflicts provide a glimpse into the increasingly complex technology used in flight. This culminates with our entry into space… with

the actual command module from Apollo IX, launched in March 1969, mere months before our first lunar landing. This museum is at coach stop # 1 and is a 10-minute stroll from the Space Museum to the Central Plaza. Space Museum Entry fee: $17-20. For more information about the park visit: www.BalboaPark.org.

Without exaggerating, S/Y America is the world’s most famous racing yacht! The reason is simple: The original America put yachting on the map. The America’s Cup was named after this vessel (not the country). It is also one of the most beautiful yachts in the world. Decked out in Old World splendor, with teak decks and polished wooden furniture, you will feel as though you have been transported back in time to the Victorian era. You will set sail from the Marriott Marquis Marina enjoying the sights (and a variety of wines, beers, and sodas) as we traverse the sparkling water of San Diego Bay. With luck we may see dolphins, sea lions, or perhaps even whales! NCBJ participants will have the option of helping sail the vessel, raising sails, steering, handling lines… or just lounging about the decks enjoying libations and the beautiful bay. Be prepared for a 3-4 hours of breezes, a salty tang to the air, and sunshine! Bring sneakers or rubber-soled shoes, sunscreen, a hat, sunglasses, and a windbreaker…. and your sense of adventure! You will board America from the Marriott dock immediately after the educational lunches at 3:15 pm, with departure from the marina dock at 3:30 pm. Return to the hotel about 6:30 pm. Note: Space on this activity is limited, so sign up early!

S/Y America History In 1851, a boat named America won the "Royal Yacht Squadrons" 100 Guinea Cup, given to the winner of a race around the Isle of Wight. It is said that the margin was so great that watching America sail past the royal yacht, Queen Victoria famously asked "Who came second?"

"Your majesty… there is no second," was the reply. The winners, members of the New York Yacht Club, donated the trophy to the Club, to be held as a "challenge" trophy. It is why the most famous trophy in sailing is called The America’s Cup. Her later career was equally as colorful – conveyor of secret agents, Confederate blockade runner, Union warship, Naval Academy training vessel, and the pride and joy of a famous Civil War general and politician. By her end in 1945, she was one of the most honored vessels in the United States. The original was destroyed during World War II, but the vessel NCBJ will be boarding in San Diego is a near-perfect replica built in 1995 at a cost of more than $6 million. Boat Specs Length: 39 feet Weight: 226,000 pounds Mast Height: 105 feet (main mast) Sail: 5,900 square feet NOTES: The Marriott Marquis Marina is located on the backside of the hotel behind the swimming pools and Roy’s Restaurant. From your guest room, allow 15 minutes to walk to the Marina Gate. Wear rubber-soled shoes, bring sunscreen, hat and light weight jacket.

The captain will coach all aboard in boating procedures, sail handling, and navigation. The fleet will venture into San Diego Bay for an afternoon of racing, team building, and fun!! A professional regatta judge will oversee the races, keeping official times and handicaps, and scoring the individual vessels on their race times and performance. We will sail a variety of craft, including Catalina 270s, Catalina 290s, Hunter 33s, and similar vessels.

Teams ABI and NCBJ have reserved their boats, and are raring to go! Come join the fun!

Groups may reserve an entire boat (6 persons), or you may come solo and join a group of your fellow bankruptcy professionals for this adventure. We will arrange for storage on the bus, which will make a stop at the San Diego airport before returning to the Marriott. Even better… stay Saturday night at the Marriott for another evening of fun on the city!

San Diego… Sunshine on the bay, swaying palm trees, missions… and the Gaslamp Quarter! Our 2-hour walking tour will visit many of these famous locations. Along the way we will stop in several adult establishments, sampling flights of the unique brews for which they are famous. We expect to stroll 2-3 miles during this interesting and illuminating tour. Come prepared with comfortable walking shoes, hat, sunglasses, and sunscreen. RESERVE YOUR GUEST ROOM EARLY Please use the green button to book your hotel reservation; do not book through the hotel’s website or 800 number – you cannot access the NCBJ rate there. The NCBJ rate is lower than any rate you will find online! Reservations require a one night deposit at the time of booking and the deposit is refundable if the reservation is cancelled 72 or more hours before the date of arrival. The NCBJ group rate is available now through September11th at midnight or whenever certain days or the whole NCBJ block sells out, whichever comes first. American College of Bankruptcy and IWIRC programs begin on Tuesday afternoon, ABA’s CLE education and many ACB and IWIRC programs are on Wednesday. The Welcome Reception is 5:30 – 7:30pm on Wednesday. Come on Tuesday, October 13th and stay through Saturday, October 17th so you don’t miss the Saturday afternoon NCBJ Sailing Regatta. Ten sail boats with conference participant crew and a licensed captain will be vying for bragging winner’s rights. The NCBJ 2020 community service financial education program at the Veterans’ Center is also on Saturday afternoon. This inspiring facility delivers a full service program to help veterans become independent and productive citizens in a new role in life. If you are not a sailor, please consider staying Saturday afternoon or overnight so you can experience a “community give back” that will be very satisfying.
