We know the constraints, difficulties and problems incollecting Declaration forms from all members in the
midst of peak summer prevailing with Loo…, Generalelection etc. But we have to do it. The same constraints
are available to other organisations also.
We are having more leaders and cadres in
each division/branch. It is quite possible to obtain100% declaration forms from our members besides
attracting others by our activities, aims, objects andfunctioning. Our leaders and cadres, as usual, shall
proceed on immediate leave; go round the entiredivision; collect declaration forms; Assist SBCO, P4,
GDS Unions to collect more declarations for theirunions too;
We are having the history; Still we are the
sine-qua-non of Postal Employees. We are committedto work for the betterment of Postal workers.
Popularize our activities among the Postal workers.Compare the CHQ activities and works. We can
proudly say that 90% of problems brought to the CHQnotice had been resolved ; of course except the issues
related to Government policy and programme - YourCHQ is the only CHQ contacting the Divisional
Secretaries frequently; ascertain the problems andtaking appropriate action. Educate and Explain all
these to the basic workers. We are not only old butalso youth in activities. We will leave no stone unturned
in mitigating the issues of Postal workers.
We are proud to hear that there is no second
union in Patiala, Faridkot in Punjab Circle. TheDivisional Secretary, Koppal Karnataka confirmed the
same. In Delhi Capital, there is no second union in P3in New Delhi South West Division. We are receiving
reports that in many divisions, the Divisional/BranchSecretaries are taking all out efforts to increase the
membership around 15 to 20%. Let it be spread to theentire nation. Let us strengthen our capacity of
collective bargaining at Division/Circle and All Indialevels with our increased membership.
The CHQ will honour by presentingawards and mementos to the best branches
which enrolled more membership in the next AllIndia conference. Why not, your branch is one
among the winner. Time is too short. Act, advanceand achieve the target and intimate the CHQ for
ensuring the award.
v Amendment to Service Rules/Recruitment Rules: -
The DOPT vide its OM No. AB 14017/61/2008-Estt (RR) dt. 24.03.09 has amended the Service rules

From the above, the qualifying service of LSG,
HSG II and HSG I may be determined as 5 years, 6
years and 5 years respectively. It will disturb thepresent qualifying service of 3 years from LSG to HSG
II and 3 years from HSG II to HSG I.
We placed our demand to the department to
follow the present prescribed 3 years of qualifyingservice for HSG II & HSG I promotion. The Department
has assured to take up the issue and revise therecruitment rules as per the present qualifying service.
v Classification of Posts - GazetteNotification:
The DOPT & Training vide its Gazette Notification dt.09.04.2009 under S. O. 946 (E) has classified the Civil
Posts with the following revised classification.
after the revision of Pay scales as per the 6th CPC.
(i) The existing pay scales have to be substituted by
new pay and Grade Pay straightaway withoutmaking any reference.
(ii) Single set of recruitment rules may be formulatedand notified for merged grade.
(iii) Minimum eligibility for promotion etc in a grade
was prescribed as follows:

All posts carrying the Grade pay right from
Rs.4200/- to Rs.5400/- (Pay band II) are now classified
as Group 'B' as per the above said order. This has created
some confusion about the application of Gazette status
& others. The said notification was brought into effect
from 09.04.2009
v Cadre Restructuring & Formation of Anomaly
Committee: -
The proposals for cadre restructuring was
submitted by us on 02.08.2008 itself. Similarly NFPE has
nominated the members for the Anomaly Committee. It
is told that the formation of Anomaly Committee is being
delayed due to non submission of nomination of two
members from FNPO. Similarly, they have not submitted
any proposals on cadre review so far. The NFPE
delegation met DDG (Establishment) on 22.04.09 and
conveyed our concern over the delay in processing the
cadre restructuring proposal and formation of anomaly
committee.
v Meeting with DDG (Establishment): -
We met the DDG (Establishment) on 22.04.2009.
The issues like Cadre Restructuring, Road Mileage
Allowance to Systems Administrators, Doubling of PO &
RMS Accountant's Special Allowance, Grant of Special
Allowance to the Accountants holding TBOP,
implementation of Group D higher pay for all Group D,
Stoppage of recovery of OTA amount paid to ineligible
officials, Formation of anomaly committee, Revision of
FSC, the recovery case of APM Accounts, Pune H.O due to
overdrawal for Postmen etc were discussed threadbare.
The DDG assured for early decisions on all the issues.
v Filling up of Vacant HSG I Posts
The DOPT has approved the proposal of the
Department relaxing the HSG I Recruitment Rules again
as one time measure and fill up the Posts on adhoc
basis with the HSG II officials without observing any
minimum qualifying service. Similarly, the Present HSG I
officials promoted on adhoc basis will continue further in
the posts. Orders are under issue and is expected before
the end of this week. The recruitment rules for HSG I will
be submitted soon to DOPT for approval.
v BCR from the date of completion of 26 years
service
Consequent upon the High court, Hyderabad
judgment on the issue, the Department is now pursuing
to the modify the orders to grant BCR promotions on
completion of 26 years of Service. It is told that the opinion
of the law ministry has been obtained for this effect.
v GDS Pay revision: -
The file related to GDS committee
implementation has gone to Finance Ministry. No further
progress or information is available at present. The
implementation of the Committee's report or Ad hoc
payment of arrears etc may be only after the conclusion of
General Section.
v Three ACP: -
The File had been returned back by the Election
Commission with the instructions to cause order after
the General Election. As such, ACP orders for Government
employees is expected only after the General Election.
There after, it should be discussed with the Department
to implement the same to the Postal officials besides
processing the cadre review for ensuring more
promotional avenues to the existing employees.
v Sixth CPC - National Anomaly Committee:
The following items were placed in the National Anomaly
Committee for discussion
(1) Pay Fixation in case of merger of pre-revised pay
scale.
(2) Issues on revised Pay Rules 2008 like (i) Option (ii)
Special Allowance for fixation purpose on promotion
w.e.f. 01.01.2006 (iii) Existing pay should not be
less than the minimum of upgraded pay scales.
(iv) Removal of disparity about direct recruits &
promotees (v) Date of next increment between 1st
Feb to June'06 - Grant one increment as one time
measure (vi) No Tax from arrears for Group D &

others be allowed to exercise option to tax arrears
either on receipt basis or accrual basis. (vii)
Temporary status casual labourers - up gradation
by imparting training to non matriculates.
(3) Benefit on promotion: - Minimum benefit of not less
than 10% of the pay & Grade pay of the feeder post.
(4) Refixation of pension/Family pension - Para 9 of
MOP PG & Pensions O.M. dt. 01.09.2008 to be
revised including both paras 4.1. & 4.2 thereof.
(5) Anomaly in pension for Government servants who
retired/died in harness between 1.1.2006 and
1.9.2008. - Application of 6th CPC
recommendations that pension should be paid at
50% of average emoluments during the past ten
months or last pay drawn with minimum
pensionable service of 20years should be made
to them also.
(6) Commutation of Pension - Suitable amendment to
the table is requested.
(7) Grant Revised Allowance with effect from
01.01.2006 - All allowances may be granted at the
revised rates w. e. f. 1.1.2006.
(8) Transport Allowance - (i) Below the Grade Pay of
Rs.4200/- should be revised to Rs. 1600 + DA for A/
A1 Towns and Rs.1200/- +DA for other towns.
(ii) Absence of more than a month for disentitling the
employees for TA may be done away with.
(iii) 50% TA may be counted as wages for
determining overtime rates.
(9) Revision of Existing Allowance: - Risk Allowance,
Patient care allowance etc. which were withdrawn
be paid with doubled rates till alternate schemes
are implemented.
(10) Parity in Pension of all Pre 1996 retirees with those
who retired on or after 01.01.96 - Notional Pension
as on 01.01.96 may be revised first as per the 5th
CPC and revision of pension be granted with 50%
of the Grade Pay of the Pay Scale from which retired
and not 40% of Basic pension.
(11) Anomaly in Pension to those retiring with in first 9
months of 2006 not fully rectified - The period
preceding between 1.10.06 and 30.09.08 should
be taken as 'Basic Pay multiplied by 1.86 plus
notional increase in the basic pay by the Grade pay
applicable and not 40% of basic pay in the pre-
revised pay scale.
(12) Revision of Pension of those retired during the
period 01.01.2006 to 01.09.2008 - Not only those
retired between 1.1.2006 to 1.9.2008 but even those
who retired prior to 1.1.2006 may be granted full
pension if they had rendered 20 years of service
(i.e.) 50% of the average emoluments for the last
10 months or the last pay if that be more beneficial.
(13) Allowance - Daily Allowance on Tour: - Demanding
Fixed Daily Allowance for stay, Local travel food etc
as before. The proposed DA: -
Grade pay 4800 to 4200 -50% of hotel rates i.e.
Rs.500/- plus 350 for local travel and food i.e.
Rs.850/-
Below Rs.4200/- -50% of hotel rates i.e. Rs.350 +
Rs.350 (i.e.) Rs.700/-
(14) 50% of revised Pay band +Grade Pay not correctly
determined - The revised table worked out & placed
with the subjects to correct the irregularities.
(15) Revision of Pension of those who are receiving two
pensions.
Minimum floor ceiling should apply separately
to each pension and not to the total of the pension
taken together.
(16) Special Provision for those retired on or after
1.1.2006 but retain pre-revised scales of Pay - Such
cases may be very few. Provision be made in Para
13 for suitable amendment/amplification.
(17) Commutation of additional pension on
retrospective revision of pension in respect of post
31.12.2005 retirees - Request to maintain status
Quo by applying the provisions of Rule 10 of CCS
(commutation of Pension) Rules 1981.
(18) Constant Attendant Allowance - Correction/
amendment to the orders about the increase of
allowance after the DA crosses 50% is required.
(19) Grant of Grade pay of Rs.5400 in PB 2 for Asst.
Accounts/Audit officers - Demanded to upgrade the
grade pay of Rs.5400/- in PB II.
(20) Revision in Base Index for DA: The base index in
(2001=100) series for the computation of DA in Pay
scale of 6th CPC may be taken as 115.12 and not
115.76.
(21) Child Care Leave - The clarification dt. 18.11.2008
may be withdrawn since the 6th CPC had not
indicated that the leave will be available only in the
event of there being no leave at credit.
(22) Cumulative loss in wages as a result of New
Fixation Formula on promotion to the next higher
grade: Demanding that the pay of the existing
employee shall not be fixed at a stage lower than
the pay at which a fresh recruit appointed on or
after 1.1.2006 is fixed.
(23) Fixation of Pay on Promotion: - On promotion to the
next higher grade pay, an employee should be fixed
by adding 10% of pay plus the grade pay as
demanded by NC/JCM.
(24) Denial of monetary benefit in the matter of fixation
of pay while granting higher replacement scale: -
when a post is upgraded the fixation of pay should
be done on the basis of upgraded pay scale.
(25) Reopening of option for fixation of pay on promotion:
- The existing employees who have been promoted

to the higher post during 2005, 2006, 2007 or prior
to 2.9.2008 may be allowed fresh option for fixation
of their pay.
v Departmental Anomaly Committee:-
The following items have been notified for
discussion in the anomaly committee constituted in the
Postal department.
(i) TBOP/BCR Postal Asst. - The anomaly prevailing
between Postal & Telecom may be taken in to
account and the TBOP/LSG should be placed in
Pay band 2.
(ii) PO & RMS Accountants: - The special Allowance
should be taken for Pay fixation on promotion.
(iii) Systems Administrators: - Promotional cadre to PAs,
10% Pay + Grade Pay as Special Pay.
(iv) Marketing Executive: - 10% pay + Grade Pay as
special pay.
(v) Supervisory Allowance: - Revival of Supervisory
Allowance to LSG, HSG II & HSG I, PRI (P) - 10%
Pay + Grade Pay.
(vi) Technical Postal Assistant: - Anomaly in grant of PB
2 with Grade Pay at par with other Department
'diploma' qualified cadres.
(vii) Head Mail peon - The relativity with Postman/
mailguard to be restored.
(viii) Charge Hands - Should be placed in PB 2 with Grade
Pay Rs.4200/-
(ix) Artisan Grade - Parity from 1.1.96 at par with Railways
& Defence sought for.
(x) Data Entry Operator - Should be placed with Rs.2400/
- Grade Pay at par with other C. G. Departments.
(xi) Cash handing Allowance to PO Treasurers - It should
be common for PO & RMS and the disparity should
be set aside.
(xii) P & T Dispensaries - the anomaly for Laboratory
Technicians, Medical Store Keepers, Staff Nurse,
be removed at par with other C. G. Hospitals.
(xiii) Sorters in DAP - should be placed in PB 1 with Grade
Pay Rs.1900/-

(i) Continuation of ad-hoc promotion made in the
cadre of HSG-I
(ii) Fresh ad-hoc promotions in HSG-I
(iii) Filling up of resultant chain vacancies by ad-
hoc promotions.
I am directed to refer to this Department's letter
of even number dated 2nd December 2008 and 10th
December 2008 regarding continuation of ad-hoc
promotions made in the cadre of HSG-I and to say that it
has been decided with the approval of Department of
Personnel & Training to continue the said ad-hoc
arrangements for a further period of one year i.e. till 19th
May 2010 or till the Recruitment Rules are finalized and
regular arrangements are made in accordance with that,
whichever is earlier.
2. As many posts in HSG.I are at present lying
vacant in various Postal Circles for want of finalisation of
Recruitment Rules, it was proposed to the Department
of Personnel & Training to allow the Department to fill up
the existing vacant posts in HSG.I as a one time measure
on ad-hoc basis, from amongst officers holding the
HSG.II norm-based post, (without prescription of any
minimum service in HSG.II). The DoP&T have, since,
agreed as a special case to allow the Department to fill
up the existing vacancies by promotion on purely ad-hoc
basis from amongst the officers holding HSG.II norm-
based posts on regular basis (without prescription of
any minimum service in HSG.II), for a period of one-year
or till the Recruitment Rules are notified and
appointments are made according to the revised
Recruitment Rules, whichever is earlier.
3. In view of the above, it is requested that Circles
may take following action:-
(i) Ad-hoc promotions made as per instructions
contained in this Department's letter of even number dated
20-11-2006 in HSG.I may be further continued for a period
of one year i.e. till 19th May 2010 or till the Recruitment
Rules are finalized and regular arrangements are made
in accordance with that, whichever is earlier.
(ii) Fill up the existing vacancies by promotion on
purely ad-hoc basis from amongst the officers holding
HSG.II norm-based posts on regular basis (without
prescription of any minimum service in HSG.II), for a
period of one-year or till the Recruitment Rules are
notified and appointments are made according to the
revised Recruitment Rules, whichever if earlier
(iii) The resultant chin vacancies in HSG.II , LSG etc.
may be filled up by promotion on ad-hoc basis for a period
not exceeding one year as per the instructions contained
in DOP&T Oms No. 28036/8/87-ESTT. (D) dt. 30.03.1988
and AB. 14017/542003-Estt. (RR) dt. 04-12-2003
circulated by this Department vide letters No. 6-6/88-SPB-

lllll Inordinate delay in settlement of personalclaims like T.A, O.T.A Medical etc for want of funds -case of U. P. Circle
The issue of allotment of adequate funds for
payment of pending personal claims like T.A, OTA, Medical
etc have been discussed in the past several times and it
is repeatedly replied that required funds are available to
dispose the claims.
But the fact is otherwise, Complaints are pouring
into this union that a large number of personal claims
are pending unsettled in U.P. circle since long. During
discussion in the periodical meeting (4 monthly) with the
Chief Postmaster General U.P. Circle. It is replied that, if
sufficient allotment of funds are not made, the issue will
remain unsettled.
You are requested to kindly bestow your kind
attention in this pertinent issue of U. P. Circle and arrange
special sanction of funds for payment of all personal
claims at the earliest.

neither the letters were acknowledged nor any action so
far been taken for payment of incentive bills.
This union wages upon you to cause necessary

lllll Proposed reorganization of Divisions inChennai City region in Tamilnadu Circle
It is brought to our notice that the regional
administration has proposed a reorganisiaton of divisions
with the following:
(i) Transfer of Sub Divisions of Arni and Vadavasi
from Tiruvanmalai Division.
(ii) Transfer of Tambaram Sub Division from
Tambaram Division to Chennai City South Division and
shifting the head quarters of Chennai City South Division
to Tambaram and the proposed residual Tambaram
Division to Ambattur and naming as Chennai West
Division.
At the outset, we wish to record that the proposals
are unwarranted at this juncture and it will create many
problems in the operations and to the staff.
LETTERS TO DEPARTMENTThe regional administration desired to transfer
the major areas of the present Tiruvannamalai Division,
a Group B Postal Division to the Vellore Division headed
by the SSPOs. The reason for the transfer is stated to be
the wieldy and long distance from the head quarters of
Tiruvannamalai to the remoted BO of the division which
is at present as follows.
Tiruvannamali HO to Tellar - 98Kms.
Tiruvannamalai HO to Dusi BO - 118Kms.
Tiruvannamalai HO to Desur - 106Kms.
If the said areas are attached with vellore division
the distance from Vellore will be as follows.
Vellore HO to Tellar - 94Kms.
Vellore HO to Dusi BO - 118 Kms.
Vellore HO to Dusur - 83Kms.
From the above, it is evident that the
reorganization will simply transfer the workload to Vellore
division where existed is more work by reducing the
Tiruvannamalai Division as smaller compact division.
Secondly if the Arni HO is attached to Vellore
Division, the existing GDS who are getting earlier
promotion at Vellore Division due to availability of more
departmental posts could loose their fair chances and
they will not get their due promotions on seniority basis.
The abovesaid proposal will cause serious
dislocations in the Postal operations and also to the
employees working in the division by extending the areas
on transfer etc.
Similarly, the piecemeal bifurcation of Chennai
division by transferring Tambaram HO to Chennai South
Division will freeze the facilities in transfer, GDS promotion
etc to the existing staff of Chennai City South Division.
More number of non HRA offices are being attached to
South Division which causes serious staff problem on
transfer. Earlier also, there were several such proposals
causing unnecessary tension and restless among the
employees which were dropped subsequently due to the
unwarranted dislocation of service.
The entire staff feels that the proposed
reorganization in a piecemeal operation will not serve
any practical purpose as desired but cause severe and
serious problems to the employees working in these
divisions.
It is therefore requested to intervene and cause
instructions not in proceed further in the said
reorganization of Vellore, Tiruvannamalai Chennai city &
Tambaram divisions.
A line in reply about the action taken is highly
appreciated.

Apropos reference, it is constrained to note that
neither our reference is acknowledged not replied so far.
Consequent upon the bifurcation of Chhattisgarh
Circle, the formation of DPA office for the Circle at Raipur
becomes absolute necessary.
Now the officials working in Jagdalpur and
Raigarh divisions have to travel for their needs at DPA
office, Bhopal to the distance of 800 & 750 KMs
respectively.
The entire circle is depending on the Postal
Accounts for every items or work and now there is
abnormal delay in settlement of many personal claim
including the pay Commissions arrears. The officials
could not exert pressure through their Circle
administration also since the DPA is situated in other
circle administration. The formation of separate DPA office
at Raipur is the absolute necessary.
It is requested to consider the proposal and
cause immediate action.

lllll Harassment to women employees unleashedby Sri Jose Kokanoor, SSPOs, Pune City West Division.
It is constrained to bring the following to your
kind notice about the atrocities, highhandedness and
abuses unleashed by the SSPOs, Pune City West
Division for immediate intervention and rein in the SSPOs
who is running amuck.
The SSPOs is unleashing terror in the minds of
women employees working in the divisional office and
the following are few examples.
1. He is always using unparliament words while
talking with women employees like 'Nonsense', 'Bloody
Buggers' etc. Always shouting is his attitude towards all
which disturbs the office environment and invited mental
stress.
2. He used to through the files on the floor for
showing his anger which found very difficult to women
employees to pick up those files from the floor. He may
have other intention to behave like this with all women
employees. He neither gives instruction/decision orally
or in writing but always shouting at the staff very loudly.
3. During his visit at Ex-Servicemen Colony, he has
broken the water pot kicking by his foot to exhibit his anger
towards the lady SPM.
4. He used to abuse all the staff resulting mass
declination to work at D.O. On 24th November 2008. He
accepted his mistakes in front of all employees and
promised for the improvement in his behavior but nothing
has been emerged. Frequently he used the phrase 'I will
not spare you'.
5. He does not behave properly with women
employees and always shout at them. He has very bad/
disgusting facial expressions when he deals with the
Dealings Assistants. They are often crying and weeping
and the working atmosphere gets disturbed.
6. While visiting any office when he found any lapse
or any incomplete work, he used to insult the SPMs by
using abusive and filthy language in front of subordinate
staff without considering the difficulties of the SPMs. He
asked Sri. R. N. Talakar, SPM, Swargate to credit the
amount of his arrears of pay on Sixth CPC to make up the

7. Without understanding the fact/truth behind the
case, he express his anger, dissatisfaction regularly by
shouting, insulting or by using improper remarks which
ultimately have adverse effect in the office decorum and
create unnecessary mental stress to women employees.
The attitude of this rude officer has created bad
impact in office environment and ultimately on the family
and social life of the women employees. If an enquiry
over these episode is ordered, many more grievances of
the women employees which could not be recorded shall
come out.
It is requested to cause instructions to enquire
and rein in the SSPOs in order to ensure peace and
congenial atmosphere to the officials for the uninterrupted
and efficient work.

HSG II & HSG I promotion thereafter.
Aggrieved due to the denial of due promotion,
the official has approached the CAT, Chandigarh in O.A.
15-HP/2005 and the CAT held that since the official's LSG
promotion should be treated as norm based promotion
with consequental benefits.
The officials representation seeking HSG II &
HSG I promotions to the DPS, Shimla has been referred
to Directorate for implementation of CAT judgment stated

against her in the Civil line police station, Bilaspur.
But to the surprise and shock, the Police officers
arrested Sri Sheker Mone APM on 30.05.2008 without
any evidence of proof and released on bail on 21.06.2008.
They have also summoned another 11 officials for enquiry.
Instead of proceeding against the MPKBY agent, the police
harassed the postal officials due to her influence and the
divisional administration has not come in the way to
protect the postal officials.
The police is not in a position to secure evidence
against the said APM Sri. Sheker Mone so far and no
charge sheet has been filed in the court of law. Due to
wrong notion, they apprehended the staff without any proof.
Adding salt to injury, the department has also placed the
official under suspension from 30.05.2008 and four more
officials namely Sri. G. R. Banerjee (24.05.2008) Sri.
Tarkeshwar Baghel (30.05.08), Sri Neipal Singh
(24.05.08) and Sri Kishore Kumar Yadav (24.05.08) on
the grounds of contemplated disciplinary action. None of
the officials is at fault and no disciplinary action has so
far been initiated. The officials are still under suspension.
The agent who got anticipatory bail exerts
pressures outside to humiliate the postal officials who
brought the case in to light. The Postmaster who was
responsible in this episode having nexus with the agent
has been safely allowed to retire. There is a total tension
and unsafe condition prevailing in the minds of the officials
of Bilaspur Division.
It is requested to intervene and render justice to
the aggrieved officials duly reinstate them and pressurize
the Police to take deterrent action against the main
offender.

lllll Arbitrary recovery under contributory factorsfor the loss sustained in the Dacoity - case of MungerHPO in Bihar Circle
It is brought to our notice that there was a dacoity
in the night of 26/27.01.2008 by burglars at Munger HPO
who took away the Government cash to the extent of
Rs.26,04,990.18 from the iron safe embedded in the
strong room of the Head Post office after breaking and
cutting all the locking arrangements in Public Hall, PO
Hall, Treasury room, Strong room and iron safe.
It is a paradoxical to note that the said HO is
provided with ten Armed Police guards and three Arm
guards on their turn round the clock for the security and
safety of the buildings, property and valuables of the HPO.
Besides there is one departmental night guard working
in this HPO.
Instead of tracing the burglars and also enquiring
the arm guards, the Postmaster of the HO who was having
only 33 days for his superannuation has been proceeded
under Rule 16 and the case has been now converted as
Rule 9 after his retirement even though he submitted his
defence before his retirement. No payment of DCR gratuity,
leave encashment, commutation has been made so far.
Only he has been granted with provisional pension.
The Treasurer of the HPO has been proceeded
under Rule 16 merely on flimsy grounds to recover the
amount looted by dacoits despite the fact that the
maximum cash balance of the HO was fixed as Rs.50
lakhs and minimum of Rs.20 lakhs.
The APM SB has been proceeded and awarded
with the punishment of recovery of Rs.1,46.398 alongwith
stoppage of increment for sixth months. The Deputy
Postmaster is also charge sheeted who is also at the
verge of retirement.
The Divisional/Regional heads instead of
tracing the real culprits and enquire the duties and
responsibilities of the Armed guards are punishing the
innocent on one pretext or the other just to recover the
loss sustained to the department.
This is nothing but misuse of contributory factors which
should not be imposed on any official if he is not directly
responsible for the loss sustained to the department.
While the miscreants entered the HPO from the
main hall and broke many doors and locking
arrangements including the safe, what was the
responsibilities of the Armed guards provided in the PO
and how can it be possible to the entruders to take hours
together to break all the locks and doors. Till date the
case has not been enquired properly about the nexus
between the dacoits with the Armed guards or the
responsibility of such huge number of armed guards
provided for the safely and security of the office.
The action is inhuman and terrible. The poor
innocent officials should not be fixed as scapegoats
leaving the culprits scat free. A full fledged directorate
level enquiry or entrusting the case to CBI may reveal so
many hidden skeletons rolling on the cupboard.
It is requested to intervene and ensure
appropriate action to safe guards the innocents duly
refunding the amount arbitrarily and unilaterally recovered
towards the loss sustained to the department despite
they are not directly responsible and drop the pending
charge sheets.

A kind attention is invited to the discussions we
had on the subject and the assurances to cause action
to fill up the vacant posts available at DAP offices with the
wait listed candidates in JAO cadre and also to consider
the requests of qualified officials to work in other states
in case of non availability of vacancies in parent circles in
the DAP offices.
No orders have so far been issued from the
Directorate for that effect. In Tamilnadu Circle, about 125

JAO qualified officials are awaiting for promotion since
1992. There are unfilled vacancies in the JAO cadre
available both in regular/Adhoc. In utter violation of rules
unqualified and ineligible officials of senior Accountant
cadres are irregularity posted as JAOs in the 90% quota
earmarked for qualified wait listed candidates.
Despite instructions from Directorate, the
irregular postings ordered by the DAP Chennai have not
been cancelled. In Andhra Pradesh, such irregular
postings were set aside by the Hon'ble CAT recently.
The Secretary (P) has taken a decision not to
absorb the JAO Qualified officials in Telecom despite the
fact that the Ministry of Communications & IT vide its letter
no. 27-1/2006-SEA II dt. 1.10.2007 ordered for the
amalgamation of JAO cadre of both the Department of
Posts & Department of communications. However, at
least in Postal, if the irregularities prevailing in adhoc
and officiating vacancies in JAO cadre is DPA in set aside,
several eligible wait listed candidates may be absorbed
on regular basis.
It is therefore requested to bestow your personal
attention to review the irregular arrangement made in
most of the DPAs and absorb the wait listed candidates
either in their home circles or in the nearby circles.

prevailing in PA cadre. Further in many places, the SDPAs
are not carrying forward due to the restriction of 12 days
in a month.
If the restriction is removed and authorized the
divisional head to utilize the SDPA services optimum, this
will resolve the existing problems of shortage to some
extent.

The above officials were under suspension on
the date of issue of the notification but the officials at Sl
No. 7, 9, & 10 were on duty on the date of notification but
the provision of Note 4 ibid has been applied to all the
said officials irrespective of the date of suspension.
The action is nothing but violating the provisions
of GOI (2) below FR 53 (1) according to which the
Government Servant under suspension shall be allowed
to exercise the option under FR 23 even if the period
during which he is to exercise the option falls within the
period of suspension and he will be entitled to the benefit
of increase in pay, if any, in respect of duty period before
suspension, as a result of such option.
The above said officials are still awaiting for
justice and facing mental torture due to non payment of

The Post of liftman is lying vacant since
December 94 and the post could not be filled up for want
of candidate of desirable qualification either in the
Department or through employment exchange. Similarly
the technician and two unskilled labourers are looking
after all the maintenance of electrical installation in the
division which is difficult.
It is requested to expedite the proposal of the
Circle and accord sanction to fill up the posts at the earliest.

No.12011/03/2008-Estt (Allowance) dt. 11.11.08 has
clarified under Para (ii) that the Children Education
Allowance for the year 2008-09 may be calculated on
prorate basis at the maximum of Rs.1000/- per month
per child w.e.f. 01.09.2008.
In many circles, the spirit of the orders stated in
para supra has not been implemented. For instance, in
Tamilnadu Circle, the Chief Postmaster Anna Road HPO
is relectant and not considering the requests of the
officials to effect payment proportionately w.e.f. 01.09.08
for the bills the officials had submitted before the issue of
orders but restricted payment to the earlier rate. Even the
fresh bills are also not entertained for the current period
after 01.09.2008.
Suitable instructions may please be issued to
all Circle Heads to implement the clarifications of the
DOP&T in true spirit and effect arrear payment,
proportionately if the officials had paid amount in advance
to the institutions and submitted the receipts earlier.

It is brought to our notice that the SSPOs,
Faridabad division is not exerting any action in mitigating
the staff problems despite they are being repeatedly
brought to his notice in every monthly meeting. The
following are the few examples: -
i. The Aqua Guard provided at the NIT HO is under
repairs over 2 years. No action has so far been taken to
resolve the water problem. The staff are either purchasing
water or bringing from their home. No water facility is
available.
ii. The UPS provided to the computers are not
working. over two years. Similarly is the case of sub offices
also. No tangible action has so far been taken to repair
the same.
iii. The post of PRI (P) has not been filled up over
one year despite there are suitable volunteers. which has
adversely affected the service in verifying the papers and
checking the delivery staff.
iv. The post of Cash Overseer at NIT HO has not
been filled up resulting the PAs are entrusted with cash

conveyance despite their hard work in the presence of
acute shortage.
v. There is no basic amenities like toilet, potable
water etc in the present building of Amarnagar delivery
LSG office. The proposal to shift the PO into better building
has not been pursued by the divisional administration
years together.
vi. The electricity connection to Surajkund P.O. has
been disconnected two years before. Similarly the
telephone connection was disconnected. No tangible
action has so far been taken either to shift the PO into
better building or restore electricity.
vii. The personal claims like TA Bills, MIS incentive
bills are not disbursed over six months.
The above are few examples and in general
there is a feeling that the SSPOs is not interested in
mitigating the staff problems which causes resentment
amidst officials.
It is therefore requested to cause appropriate instructions
to attend the staff problems and mitigate their grievances
at the earliest.

While thanking the gesture in accepting our
demand for uniform fixation of incentive related to NREGS
work, it is pertinent note that the condition put forth in the
said orders that ten transactions in one account in a
financial year for governing the grant of incentive is
unjustified and arbitrary.
The instructions seems that if there is no ten
transactions in one account in one year, incentive is not
payable for the said account. In such cases opening of
ledgers, Specimen book, entries in the Pass book will
become unproductive labour. This may please be
reconsidered and removed such conditions.
Further, the calculation of ten transactions etc in
each account will be cumbersome exercise. The
provisions which were made earlier for MSY Accounts
will be more suitable for easy calculation and payments.
It is therefore requested to kindly reconsider the
same and cause early orders.

According to Directorate clarifications vide letter
No. 2-54/2005- PAP dt. 28.02.06, the official appointed on
adhoc basis in any promotional post may be initially fixed
under the provisions of FR 22 (i) (a) (i) but restricted the
Pay under FR - 35
In the context of Revised pay Rules 2008, and
the officials holding adhoc/officiating arrangements will
get the corresponding grade pay. As such, the relevance
of FR 35 restricting the limit of Rs.1000/- become absolute.
In some divisions, while officiating in IPO cadre
etc, the officiating pay is being restricted to the limit of
Rs.1000/- by applying FR 35 which causes resentment.
It is requested to cause appropriate clarifications
on this to all the Circle Heads at the earliest possible
either removing the conditions under FR 35 or enhance
proportionately the limit based on the Sixth Pay
Commissions increase over the earlier emoluments.

The Department has prescribed training module
on Computer Operations for imparting training to the Non-
matriculate Group 'D' employees vide its letter No. 1-55/

Such non matriculate Group 'D' should be given
training for six days at divisional level or at WCTC etc.
However no incentive/honorarium has been fixed to the
trainers who are imparting such training. In many places,
the Systems Administrators have been ordered to impart
training in the midst of their overburdened works. But no
incentive/honorarium is paid for them at divisional level
and also at the Computer Training Centre. This causes a
concern.
It is requested to kindly consider to fix incentive/
honorarium to the trainers who have been entrusted with
this laborious and hard task.

The SBCO, Mysore HO has raised an objection
about the payment of interest on two PPF accounts
opened on self name & another in the name of a minor
prior to 06.12.2000.
According to PPF Act 1968, an individual can
open a PPF Account in his own name and also separate
account in the name of minor. But on 06.12.2000, theFinance Ministry has issued another order stating that
the total investment in such two accounts should not
exceed Rs.60000/- (Now Rs.70000/- in a year)
The date of effect of revised provisions has not
been mentioned in the MOF order dated 06.12.2000. Assuch it should be taken with prospective effect only and
shall not be applied this effect to the accounts openedprior to 06.12.2000. The SBCO Mysore has wrongly
objected with retrospective effect and raised objections
to the tune of Rs.29 lakhs which is against to the spirit ofPPF Act 1968.
Further, MOF has caused guidelines thatirregular accounts opened earlier prior to issue of
clarification and exact date of receipt of those orders by
the lower operate offices should be regularized.

Apropos reference, I wish to state that the Chief
PMG, Maharashtra Circle has sanctioned Rs.10000/-
from the Circle Welfare Fund and directed the official to
pay the difference amount between the CGHS rates &
hospital charges amounting to Rs.17367.
The official was admitted in hospital in
emergency condition due to his brave and historic act of
saving many lives and their belongings in his residential
area during the mega flood of Mumbai City and the
disease called 'leptospirosis' is a new kind of disease
which was not brought under the rules earlier.
This case is entirely different one there is clear
justification to reimburse the full claims as no package
was there for the disease. As such asking the official to
remit Rs.17367 is causing concern. Either the entire bill
may be admitted as if the official was admitted in
emergency and the disease is a new one not brought
earlier in any CGHS package or the remaining amount in
full may be adjusted from the Circle/Central welfare fund
appreciating his yeomen service caused to the humanity
during the mega flood of Mumbai.
It is requested to consider his case as a special
one and accord reimbursement of full claim at the
earliest.

arbitrarily and without any orders from the Directorate.
Despite the issue was taken by the Circle Union,
there is no improvement and the SPMs are denied anddeprived of their dues in NE Circles.
It is therefore requested to kindly causeappropriate orders to draw the dues forthwith
retrospectively from the date it was stopped arbitrarily.

Revision of Cash Allowance to the SPMshandling cash in the absence of treasurer
It is brought to our notice that the cash allowance
drawn to the SPMs working in Triple/Four handed offices
who are entrusted with the treasury work in the absence
of treasurer has been stopped in many places after the
implementation of Sixth CPC.
This is arbitrary, unjust and against to the
decisions arrived on the subject. Further the amount
requires revision based on the increase after the Sixth
CPC implementation.
It is requested to consider the same and cause
appropriate orders at the earliest.

Anomaly in fixation of Pay in respect of theofficials promoted on 01.01.96 under BCR Scheme -reg.
According to Biennial Cadre Review (BCR), the
officials are to be placed in the higher pay scale w.e.f. 1st
Jan or 1st July and had the option to get their pay fixed
from date of promotion in the higher pay scale or from the
date he earns his next increment in the lower pay scale.
According to rule 5 of CCS (Revised Pay) rules,1997 "Save as otherwise provided in these rules, a
Government servant shall draw pay in the revised scaleapplicable to the post to which he is appointed.
Provided that a Government servant may electto continue to draw pay in the existing scale until the dateon which he earns his next increment or any subsequentincrement in the existing scale or until he vacates his
post or ceases to draw pay in that scale."
According to Explanation 2 below Rule 5 of CCS(Revised Pay) Rules, 1977: -
"The aforesaid option shall not be admissible to anyperson appointed to a post on or after the 1st day ofJanuary, 1996, whether for the first time in Governmentservice, or by transfer or promotion from another post
and he shall be allowed pay only to the revised scale."
Consequent to this explanation, officials who

were placed in BCR on 1.1.1996 could not get their
promotion in the pre-revised pay scale which resulted in
drop in their emoluments. Had these officials been
allowed to get their promotion in the pre-revised pay scale
on 1.1.1996, they were at the advantage.
Considering the above views, the Directorate
vide its letter no. 1-28/2004-PCC dt.23.08.06 addressed
all circles seeking the information about the no. of
officials affected by the Explanation No. 2 below Rule 5 of
CCS (RP) Rules 1997 and its financial upgradation.
Thereafter there is no improvement or action in
this regard. The issue remains unsettled so far due to
which such officials affected due to the explanation stated
in preparas remained looser in the fixation of pay after
the Sixth Pay Commission recommendations.
It is therefore requested to kindly expedite action
and accord orders at the earliest.

lllll Arbitary recovery from innocent officials oncontributory factor towards irregular payment ofinterest on non eligible TPF accounts at Palakal HO,Narsapur and Royepet in Bhimavaram division, A.P.Circle.

Apropos reference, it is constrained to note that
neither our reference is replied nor the issue is settled
so far. Besides the recoveries from the innocent officials
are being continued which causes a serious concern.
The gist of the case is reproduced onceagain for your
kind notice and immediate action.
The SSPOs, Bhimavaram has issued noticed
to many officials stating that in view of PMG, Vijayawada's
observation there is a proposal to recover the amount as
irregularly paid to the TPF account holders and also fixed
huge sum to each individuals.
The fact of the case is as follows: -
The Ministry of Finance vide its notification no.
286 (E) dt. 13.05.05 amended the Post Office Savings
Account Rules 1981 in which under Rule 4, the clause
(b) group accounts and (e) institutional accounts were
deleted. The Rule 4 (a) and all other entries were
continued to be in existence as per the amendment.
As per the table under Rule 4 (a) 1 (e) under the
category of individual account, 'an authority controlling a
provident fund, Superannuation fund or gratuity fund on
behalf of individual members, without any limit, one on
behalf of each member can be operated by the member
on the production of a letter from the controlling authority."
The Ministry of Finance, subsequently vide its
notification GSR 509 (E) 27.07.05 amended further the
Posts Office Savings Accounts Rules 1981 in which, a
time frame was fixed to implement the provisions of the
amendment stated in para supra.
Based on the same, the Postal Directorate vide
its letter No. 113/10/2004 - SB. Dt. 12.08.05 caused
instructions to close all the savings accounts other than
individual accounts. The Accounts holder were issued a
notice asking them to close their account with eligible
interest by 15.12.2005.
The Chief PMG, A.P. Circle has further issued
clarifications vide letter no. SB/1-4/Rulings/corr IV dt. 2.2.06
that 'as per the amendment, S.B. accounts other than
individuals are to be closed. The TPF accounts opened
in the individual names can be continued. However, the
TPF accounts standing in the name of institutions, trusts
etc have to be closed."
The above clarification was issued based on
the Finance Ministry's amendment as the provisions of
rule 4 (a) 1 (e) contained and retained under which the
P.F. accounts in the name of individual can be opened
and operated even today.
Accordingly, the TPF accounts operated in the
name of individual names are allowed to continue in all
circles and in particular to A.P. Circle.
The Finance Ministry vide its letter No. F7/12/05-
NS II dt. 10.11.06 has issued a clarification that 'however'
provident fund accounts can't be opened in the name of
individuals as such accounts as implied by their name
are opened and operated by provident funds and
therefore are not covered within the ambit of the principal
Acts and Rules as amended from 13th May 2005.
Since the above said clarification was not
specific and there were no detailed procedure with time
frame to implement the instructions and infact the
instructions are not as specific as the Chief PMG's clear
cut clarifications dt. 2.2.06, the same has not been
implemented in many divisions.
Suddenly, the SSPOs Bhimavaram has initiated
action against all the officials on the basis of the
observation of the PMG and started recovery proceedings
to the tune of lakhs of rupees from all the LCS, Supervisors
& Postmasters. This has caused a serious tension and
turmoil in the minds of the officials. The orders are arbitary
unjust and against to the canon of natural justice.
(i) This is quite contrary to the provisions of Rule 4
(A) and most particularly violate of sub rule 1 (e) of the
Rule 4 (A) which clearly stated that' An authority controlling
a provident fund, Superannuation fund or gratuity fund,
may open, an account on behalf of its individual
members."
(ii) There is no amendment issued for the Rule 4
(A) in its totality or substituted till to day. unless amending
the Rules, the clarification order as if amendment will not
hold good before law.
(iii) It appears in the latest volumes of Sri A.N. Dureja
Guide and also in the version of Post. Office small savings
scheme, part two of 2008 that the said rule was not
amended. Thus the individual depositors under TPF are
eligible for payment of interest.
(iv) There was no clear cut directions from the

Directorate on the said clarification. However after it was
felt, the TPF accounts were closed hurriedly in the entire
division without giving any notice to the depositors. As no
notice was issued to the depositors regarding non
eligibility of interest from a particular date, interest was
paid to them which cannot be treated as excess payment.
(v) Even the Department feels that it is excess
payment the Department would have initiated action to
recover the amount from the depositor in the same
manner, as arrears of land revenue. The poor Postal
officials should not be made as scapegoats and recover
the entire amount under one pretext or other by using the
weapon of contributory negligence.
(vi) It is most pertinent to note that even in A.P. Circle,
except Bhimavaram division, no action has so far been
initiated in other divisions due to the non existence of
amendment to the P.O S.B. Rules. 4 (A). Which cannot be
set aside by any clarificatory orders.
(vii) Further, the incharge SBCO, Palakal HO has
sought clarifications on 4.9.2007 from the R.O about the
existence of TPF accounts in the name of individuals as
per Rule 4 (a) on the background of the Finance ministry
letter dt. 10.11.06 for which no reply was given by R.O.
(viii) It is most unfortunate that the recovery has been
ordered retrospectively from the date of issue of the OM
and not considering the ambiguity in the clarification
issued by MOF on 10.11.06 without amending the
statutory rules.
Under these circumstances, it is requested
onceagain to stall the entire proceedings and review the
decision based on the above factors and relieve the
officials from the cluches of unjustified and untenable
factor of contributory negligence and unbecoming of a
Government Servant.

lllll Highhandedness of Senior Postmaster, PatialaHO in Punjab Circle.
It is brought to our notice that the
highhandedness of the Sr. Postmaster, Patiala duly
harassing and abusing the staff has created a tension
and panic situation in the Patiala Ho and the congenial
and cordial atmosphere hitherto prevailed has totally been
spoiled. The following are few examples: -
1. The Sr. Postmaster has arbitrarily changed the
distribution of work of Patiala HO without keeping in view
the workload and sanctioned strength of office. The New
distribution is practically impossible to work in counters.
2. The Senior PM is calling the Staff on Sundays
and holidays regularly. The women employees are
specifically hard hit by these orders.
3. The Sr. Postmaster is calling the counter
Assistants, PAs and APMs again and again to her chamber
and keeping them for a long period and disturbing the
counters and smooth functioning of the office. Many times
public have to stand on counters for a long period due to
her frequent calls.
4. The Sr. Postmaster is abusing the Senior Staff
and in charges unnecessarily and unwarrantly in the midst
of all and demoralizing the staff.
It is pertinent to mention that the present Sr.
Postmaster worked as Postal Asst., Patiala for a long period
and she remained as IPOs and ASPOs for long periods
and again she was posted as Senior Postmaster, Patiala.
This has developed vested interests and formation of
coterie group and she is directly favouring to her near and
dear ones including in the payment of personal claims.
She is abusing and shouting against those whom they
were not liked by her since her earlier days.
The staff are very much agitated and all the
unions have submitted memorandum to the SSPOs
seeking his intervention to set right things before it
becomes out of control. But to their dismay there is no
improvement in her attitude and is continuing the same
harassment on staff.

In the absence of clear cut clarifications about
the officiating arrangements in HSG I Cadre, there wereinstances of allowing officiating arrangements in HSG ICadre beyond one year in Tamilnadu Circle.
There are about seventy cases of such officiatingarrangements and the due amount for the officiatingperiod exceeding one year has not been drawn to such
officials and many of them were retired on superannuationnow resulting in denial of due retirement benefits.
The Principal Chief PMG, Tamilnadu Circle hasalso sought approval to regularize officiating periodsbeyond one year to those officials as one time measuresince the arrangements are now ensured to with in oneyear.

Under relevant provisions of Postal Manual
Volume-IV an entrant has to submit an obligatory
declaration in connection with having read Postal Manual
Volume-IV, CCS (CCA) rules, 1965 & CCS (Conduct)
Rules, 1964. Perhaps you too will appreciate that it is not
quite realistic that an outsider or a new entrant have gone
through & understood the ruling provisions as laid down
in these named books. Even only a minimum portion of
relevant ruling provisions as is laid down in these manual
are being taught during the Induction Training
Programme at respective Postal Training Centres.
As such, it is our considered view that the
conditionality for submitting such a declaration shall be
waived with immediate effect.
It is therefore requested to cause necessary
orders to this effect at the earliest convenience.

Apropos reference and further reference in the
discussions on charter of demands held in April 2007, it
was agreed to drop the confirmation examination since it
becomes irrelevant and assured to introduce the
certification by the Postal Training Centers itself in lieu of
the existing confirmation examination.
After the Government had issued orders
delinking the confirmation for promotion etc, the existence
of confirmation examination has no relevance and it
should be dropped.

lllll Revised Syllabus for LGO Examination - reg.
Apropos discussions and earlier references on
the subject, it is constrained to note that the revised
syllabus finalized in the midst of 2008 for the LGO exam
has not been brought in to effect so far.
The revised syllabus as formulated earlier has
been circulated in the journals of the Unions to the
divisional levels and there are lot of enquiries about its
implementations.
It is requested to expedite the process and
cause orders duly implementing the revised syllabus in
the ensuing LGO examination.
THE CENTRAL Administrative Tribunal (CAT)
has ruled that government employees can claim
medical reimbursement beyond the prescribed limit in
complicated cases of pregnancy and other serious
medical procedures which can reasonably be
categorized as "emergency".
Observing that medical reimbursement to an
employee is not charity by the government, the CAT
Principal Bench said restricting medical emergency to
only a few cases- like kidney failure, heart surgery,
malignant tumour surgery and serious accidents -was
not logical
The ruling will benefit lakhs of central
government employees as it expands the scope and
ambit of the term "emergency" used under the medical
reimbursement rules.
The verdict came on a petition filed by Veena
Bhatia, an employee of the Department of
Telecommunications, who was denied reimbursement
for expenses on her treatment during pregnancy "over
and above the prescribed limit" on the grounds that it
was not an emergency case. Bhatia had on September
17,2004 delivered a boy via caesarean section
prematurely. Thirty-eight years old then, she had been
35 weeks pregnant. Doctors had acknowledged her
surgical procedure as an emergency but the department
had rejected her claim.
Medical Reimbursement Boost For Govt. WorkersAccording to the Medical Reimbursement
Rules of CDOT, emergency includes open heart surgery,
serious accidents while on official tour, accidents leading
to surgery, surgery for malignant tumour, renal failure
and medical reimbursement over and above the limit is
to be made only in exceptional circumstances.
Rejecting the department's contention, the CAT Bench
said: "An emergency in medical science is to be viewed
with a resultant damage to the person, who is
undergoing treatment." It also took note of the fact that
"exceptional circumstances" weren't defined under the
Rules. After examining the medical records, the tribunal
concluded that the procedure Bhatia had under gone
was an emergency and ordered the department to
reimburse her within two months.
Bhatia's counsel had pointed out that her client
was being discriminated against as in a similar case in
the past, another employee was given similar benefits.
The counsel contended that any medical emergency
would include an emergency within the meaning of the
Medical Reimbursement Rules.
But the government counsel had opposed the
contentions on the ground that the relevant rules allowed
reimbursement of medical expenses beyond the
prescribed limit only in exceptional circumstances.

The Central Information Commission, New Delhi while disposing
a reference of Coimbatore division, Tamilnadu Circle, ordered
to supply the copy of the 'Confidential Report' of the applicant
sought under the RTI Act. 'Confedential Report' shall not be the
secret document and it should be supplied on demand to the
concerned officials, it observed.

In another case of Mayiladuthurai Division, Tamilnadu
Circle, the Central Information Commissioner, New Delhi directed
the department to supply the copy of the answer sheets of the

that however, the names of officers who valuated the answer
papers should not be disclosed.
Many can utilize this provision to verify their answer
sheets of the Departmental examination in case if they are having
doubts about valuations of and answer papers.

nnnnn SUPPORT FOR PAYMENT OF WAGES UNDERNATIONAL RURAL EMPLOYMENT GUARANTEE SCHEME- ALLOTMENT OF FUND FOR THE YEAR 2008-09.1. A provision has been made in the Plan funds to
meet the expenditure incurred towards implementation
of National Rural Employment Guarantee Scheme
(NREGS) made available during the year 2008-09, the
activities on which this amount is to be utilized and the
head of account are given in the table of allotment
enclosed (Annexure - I)
2. The funds under the above scheme are placed
at the disposal of Circles for implementation of the NREG
Scheme. A provision has also been made for North East
region consisting of Assam and North East Circles
separately in the Annexure - II.
3. The guidelines and conditions governing the
payment of incentive to the officials on account of
additional work due to opening and operations of NREGS
accounts in enclosed in Annexure - II.
4. All expenditure incurring offices may prepare a
monthly statement giving date, amount, nature of work in
respect of all items booked against present fund
allotment.
5. The funds should be utilized within the allotment
made under each activity for this financial year 2008-09
after obtaining expenditure approval of the competent
authority in each case. Director (Budget), Department of
Posts to whom a copy of this letter has been endorsed is
being requested to allot necessary funds as aforesaid to
the respective Circles. It must be ensured that the funds
allotted are utilized within the current financial year and
booked in the appropriate head of account as indicated
in Annexure - I.

The demands of the workers like cadre restructuring,
three promotions, settlement of anomalies arisen after the
implementation of the Sixth CPC, better promotional prospects,
and improvement in the service conditions are still in doldrums
and there is no proper discussion in settlement of the demands.
There was no periodical meeting and the collective bargaining
through JCM as it seems as outmoded and outdated due to the
scant regard and discard extended to the forums by the Govt
and its departments.
The workers have to meet these challenges posed
and defeat the moves to undermine their interests. Our intention
is to bring mounting and massive force behind our plea for the
settlement of our demands. Mobilization of strength to achieve
the demands should be our strategy and idea. We should stick to
the guns of content and character of Trade union that there will
be no lasting truce till our just demands are conceded and genuine
grievances are redressed. The Road to salvation and success
is that of organized strength, unity, collective bargaining and
struggle. This is the one and only Road.
The challenges have to be met and will be met by thePostal workers and by the lakhs of the Central Govt employees.

nnnnn Accountability for delay in decision making.
A core Group on Administrative Reforms (CGAR) has been
constituted under the chairmanship of Cabinet Secretary in
February. 2003 to formulate specific changes in the systems
and procedures in consultation with the ministries/departments
concerned and to advise strategies for changing attitudes. The
Core Group has decided that the existing provisions about
accountability mechanism should be reiterated with a view to
bring to everyone's notice that these provisions are adequate
for initiating disciplinary proceedings when an officer adopts a
dilatory attitude leading to delay in decision - making and/or
harassment of the public.
(ii) In view of the above the following provisions of CCS
(Conduct) Rules, 1964 are brought to the notice of all Ministries/
Departments for information and necessary action: -
Rule 3 General
(1) Every Government servant shall at all times-
(i) maintain absolute integrity;
(ii) maintain devotion to duty; and
(iii) do nothing which is unbecoming of a Government
servant
(2) (i) Every Government servant holding a supervisory
post shall take all possible steps to ensure the integrity and
devotion to duty of all Government servants for the time being
under his control and authority;
(ii) No Government servant shall, in the performance of his official
duties, or in the exercise of powers conferred on him, act
otherwise than in his best judgment except when he is acting
under the direction of his official superior;
Explanation I :- A Government servant who habitually fails to
perform the task assigned to him within the time set for the
purpose and with the equality of performance expected of him
shall be deemed to be lacking in devotion to duty within the
meaning of clause (ii) of sub rule (I).
Explanation II :- Nothing in clause (ii) of sub-rule (2) shall be
construed as empowering a Government servant to evade his
responsibilities by seeking instructions from, or approval of , a
superior officer or authority when such instructions are not
necessary under the scheme of distribution of powers and
responsibilities.
Rule 3A promptness and courtesy
No Government servant shall
(a) in the performance of his official duties, act in a
discourteous manner;
(b) in his official dealings with the public or otherwise
adopt dilatory tactics or willfully cause delays in disposal of the
work assigned to him.
3. Rule 11 of the CCS (CCA) Rules, 1965 provides that
the penalties (ranging from 'censure' to 'dismissal') mentioned
therein may be imposed on a Government servant 'for good and
sufficient reasons'. Thus any Government servants violating the
provisions of conduct Rules can be proceeded against as it will
form 'good and sufficient reasons' for imposing the penalties
prescribed in Rule 11. In other words, disciplinary proceedings
could be initiated if an officer adopts a dilatory attitude, leading to
delay in decisions making and/ or harassment of the pubic.
4. Ministries/Departments are also requested to bring the above
cited provisions of the Conduct Rules and CCA Rules to the
notice of all the officers and officials in the Ministry/Department
(proper) and in the organizations/offices under their administrative
control to clarify that if they are found responsible for willful
delay in disposal of the various types of cases dealt with by
them, finally leading to delay in decision making, they shall be
liable for disciplinary action in terms of the relevant provisions
referred to in para 2 and 3 of this OM.

A reference is invited to note (iv) below rule 3 of GDS
(Conduct & Employment) Rules, 2001 according to which a Sevak
shall not be eligible for transfer in any case from one post/unit to
another post/unit except in pubic interest.
To mitigate the hardship to the CDS, Directorate, vide
letter No. 19-10/2004-GDS dated 17.7.2006 issued amendment
to rule 3 of GDS (Conduct & Employment) Rules 2001 and allowed
limited transfer facility to GDS on specific grounds on fulfillment
of specific conditions.
The matter has been further examined and it has been
decided that consequent upon the abolition of GDS posts, the
surplus Gramin Dak Sevaks should be accommodated in the
alternative posts in the following manner: -
(1) The surplus Gramin Dak Sevak may be accommodated
as far as possible under the accounts jurisdiction of the Sub
Office where he is working subject to availability of vacancies
and also fulfillment of the conditions of educational qualification
prescribed for the post etc.
(2) If there is no vacancy in the Branch Offices under the
Accounts jurisdiction of the Sub Office, the surplus Gramin Dak
Sevak may be informed of the details of the vacancies available
in the whole division/sub division and he will be asked to exercise
option for choosing the post.

Commission- clarification regarding encashment leave
With regard to entitlement of encashment of leave
during LTC, a doubt has arisen whether the leave encashment
during LTC can be allowed per less than 10 days period. The
issue was referred to department of personnel & Training for
clarification.
Department of personnel & Training as clarified wide
their U.O. No. 14028/2/2009-Estt (L) dated 09.02.2009 that interms
of Rule 38-A of the CCS (Leave) rules, 1972. Government
Employees are entitled to encash up to 10 days Earned Leave at
the time of availing LTC subject to the condition that earned leave
of an equivalent duration is also availed of simultaneously. Hence,
the applicant is entitled to encash leave for less than 10 days but
and earned leave of an equivalent duration is also required to be
availed of simultaneously.

after the implementation of recommendations of 6th
CPC.
The undersigned is directed to say that in accordance
with the instructions contained in this Department's OM. No. 38/
37/2008-P & PW (A) dated 2nd September, 2008, in the case of
those pensioners, in whose case commutation of pension
became absolute on or after 01.01.2006 but before the issue of
that OM, the pre-revised Table of Commutation Value for Pension
will be used for payment of commutation of pension based on
pre-revised pay/pension. Such pensioners shall have on option
to commute the amount of pension that has become additionally
commutable an account of retrospective revision of pay/pension
on implementation of the recommendation of the Sixth Central
Pay Commission. On exercising such an option by the pensioner,
the revised Table of Commutation Value for Pension will be used
for the commutation of the additional amount of pension that has
become commutable on account of retrospective revision of
pay/pension.
2. A number of references have been received in this
Department seeking clarifications in regard to various issues
relating to commutation of pension in case a pensioner opts for
commutation of pension that has become additionally commutable
on account of retrospective revision of pay pension. The matter
has been examined in consultation with the Ministry of Finance
(Department of Expenditure) and the following clarification are
issued in this regard:
Points raised :
1. What would be the age to be used for commutation of
additional Commutable pension and which factor would be used
for such additional commuted value of pension.
The age reckoned for calculation of commuted value
of pension at the time of original application for commutation of
pension will apply for calculation of commutation value of
additional commutable pension. However, as mentioned in the
O.M. dated 02.09.2008, the commutation factor in the revised
Table of Commutation Value for Pension will be used for the
commutation of the additional amount of pension that has
become commutable on account of retrospective revision of
pay/pension.
2. From which date the reduction in pension on account
of additional commutation of pension will take effect?
Reduction in pension on account of additional
commutation of pension will be in two staged as per the provision
contained in Rule 6 of the CCS (Commutation of Pension) Rules,
1981.
3. What will be the date of restoration of additional
commutation of pension?
The Commuted portion of pension shall be restored
after 15 years from the respective dates of commutation as
provided in Government of India decision No. 1 under Rule 10
of CCS (Commutation of Pension). Rules 1981. Necessary
endorsement should be made in the PPO.
It is impressed upon all the Ministries/Department of
the Government of India to keep in view the above clarification
while disposing of the cases of commutation of additional pension.
They are also advised to dispose the representation received by
them from pensioners on the above issues without referring
them to this Department.
4. This issues with the concurrence of Ministry of Finance
(Department of Expenditure) vide their UO No.43/EV/2009 dated
13.02.2009.

The undersigned is directed to say that in
implementation of the decisions on the recommendation contained
in Para 5.1.45 of the Report of the Sixth Central Pay Commission,
the rates of ex-gratia in cases of death occurring due to accidents
in the course of performance of duty, death attributable to acts
of violence by terrorists, anti-social elements etc., death occurring
due to enemy action in international war or border skirmishes or
action against militants, terrorists, extremists etc. or death on
account of natural disasters, extreme weather conditions while
on duty in the specified high altitude, inaccessible border posts,
etc., have been revised vide this Department's O. M. No. 38/37/
08-P&PW (A) dated 2nd September, 2008.
2. In certain cases, relief is also provided to families of
deceased Government servants from sundry Government
sources, such as the Prime Minister's Relief Fund, Chief Minister's
Relief Fund, etc. In such cases, it should be ensured that the
aggregate of the relief/ex gratia compensation paid from different
sources does not exceed Rs. 20 lakhs in each individual case.
Para 12 of Annexe to this Department's OM 45/55/97-P&PW (C)
dated 11th September, 1998 will stand modified to this extent.
3. All other terms and conditions in the O.M. dated 11th
September, 1998 shall remain unchanged.
4. This issues with the concurrence of the Ministry of
Finance, Department of Expenditure U.O. No. 4.2/39/2009-IC dated
11.2.2009.
5. In so far as persons serving in the Indian Audit &

nnnnn Criteria for assessing suitability of officerswhere there is revision/upgradation/merger of payscales.
The undersigned is directed to invite reference
to the Department of Personnel & training OM No. 22011/
10/84-Estt.(D) dated 04-02-1992 wherein the criteria to
be adopted for assessing the suitability of incumbents of
posts and the date of appointment to the upgraded post,
wherever there is a revision of pay scale/upgradation of
post, have been laid down.
2. There has been merger of a number of pre-
revised scales without any pre-condition for possession
of higher qualifications for placement of incumbents in the
higher/upgraded scale, in the revised pay structure
recommended by the 6th CPC and accepted by the
Government. In this context, the instructions of 4.2.92 have
been reviewed and it has been decided in consultation
with Ministry of Finance (Department of Expenditure) who
have issued certain instructions in this regard under OM
No. 1/1/2008-IC dated 13.09.2008, and the UPSC that the
procedure for assessment of suitability in such cases may
be as follows for placement in the upgraded/merged grade:
(i) Where all posts in one or more pre-revised scales
are merged with a higher pre-revised scale and given a
common replacement scale/grade pay/pay scale, the
suitability of the incumbents need not be assessed for
granting them the higher replacement scale/grade pay/pay
scale; there is also no need for the incumbents to complete
any minimum eligibility service in the earlier scale of pay.
There will be no change in the inter se seniority of the
incumbents in the merged grade which shall be decided
based on the general instructions on the subject ; and
(ii) Where all posts in a particular grade have been
granted a higher replacement pay scale/grade pay, as
per upgradation recommended by the 6th CPC, suitability
of the incumbents need not be assessed for granting
them the higher replacement scale/grade pay. Here also,
there is no need for the incumbents to complete any
minimum eligibility service in the earlier scale of pay; and
(iii) Where there is a change in the Group (that is
classification of the post) consequent upon the merger
of upgradation and where there is no higher responsibility
or higher qualification involved, assessment of the
suitability will not be necessary before the revised grade
is allowed. There will also be no need for the incumbents
to complete any minimum eligibility service in the earlier
scale of pay. However, suitability of the officer who has
been placed in a upgraded/replacement pay scale which
fall in Group 'A' by recommendation/ award of the pay
Commission will continue to be assessed.
3. Assessment of suitability will continue to be
necessary in the following situations arising out of cadre
reviews, restructuring etc., not covered in the
recommendations of the 6th CPC:
(i) Where the upgradation involves higher
responsibilities and higher eligibility service;
(ii) Where the upgradation or merger is part; where
the upgraded post will be the promotion grade for the
posts left in the lower grade and the normal DPC
procedure will apply.

Under the Central Civil Services (Classification,
Control and Appeal) Rules, 1965, all Central Government
posts are classified into four categories, viz., Groups "A",
"B", "C" and "D". This classification at present is based
on the norms prescribed by the Department of Personnel
and Training vide S.O. 332(E) dated 20.04.1998
published in the Gazette of India Extraordinary.
2. As per clause (4) of the Central Civil Services
(Revised Pay) Rules,2008 notified vide notification No G.
S.R. 622(E) dated 29-08-2008, the pay band and grade
pay or the pay scales, as applicable, of every post/grade
specified in column 2 of the First Schedule thereto shall
be as specified against it in columns 5 and 6 thereof,
Consequent upon the notification of the said rules, it had
become necessary to prescribe revised norms for
categorization of posts into the abovementioned four
categories based on the pay band and grade pay or the
pay scales as applicable, as approved by the Government.
Accordingly, an Order classifying the various Central Civil
Services posts into Group "A", "B", "C" and "D" based on
the revised norms of pay has been notified in the Gazette
of India Extraordinary vide S.O. 946 (E) dated 09-04-2009.
A copy of the Order is enclosed. All posts in the Central
Civil Services would now stand classified strictly in
accordance with the norms of pay band and grade pay or
pay scales as prescribed in the said Order.
3. In some Ministries/Departments, posts may exist
which are not classified as per the norms laid down by
this Department. If, for any specific reason, a Ministry/
Department proposes to classify the posts differently, it
would be necessary for that Department to send a specific
proposal to Department of Personnel and Training giving
full justification in support of the proposal within threemonths of this O.M. so that the exceptions to the norms of
classification laid down in S.O. 946 (E) dated 09-04-2009
can be notified.

nnnnn Sixth Central Pay Commission's
recommendations-revision of pay scales-amendment
of Service Rules/Recruitment RulesThe recommendation of 6th CPC have been
considered by the Government and the CCS (Revised
Pay) Rules 2008 have since been notified on 29th August,
2008. Consequently, in place of the pre-revised pay
scales, the revised pay structure comprising the Pay Band
and Grade Pay/Pay Scale has come into effect. Some of
the pre-revised pay scales have been merged and some
others are upgraded/likely to be upgraded. In the light of
these, it has been decided that the following
consequential steps to amend the existing service Rules/
Recruitment Rules shall be undertaken on a priority basis:
(i) Substituting the existing scales by the Grade
Pay alongwith the Pay BandThe existing pay scales have to be substituted
by the new pay structure (Pay Band and Grade Pay/Pay
scale) straightaway without making a reference to the
Department of Personnel and Training (DOP&T)/ Union
Public Service Commission (UPSC). The heading of
column No. 4 of the Schedule on RRs may be modified to
"Pay Band and Grade Pay/Pay Scale". In cases where
deputation is also one of the methods of recruitment, the
field of selection for deputation, which might include
various grades, should also reflect the corresponding
Grade Pay alongwith the Pay Band /Pay Scale, and the
minimum eligibility service as per the revised guidelines,
as enclosed in Annexure.
(ii) Where there is an upgradation of postsThe instructions issued by Department of
Expenditure under OM No. 1/1/2008-IC dated 13th
September, 2008 and DoPT O.M. Mo. AB-14017/66/08-
Esst (RR) dated 9th March, 2009 may be applied in such
case.
However, for each of the merged grades, a single
set of Recruitment Rules may be formulated and notified.
(iii) Consequential changesIt is necessary to make consequential changes
in the Recruitment Rules/Service Rules so as to prescribe
eligibility conditions with reference to the revised Grade
Pay/Pay scale. It is also necessary to review other columns
of the Recruitment Rules/ Service Rules, where some
minimum service in a particular scale/grade is prescribed
for consideration for appointment on deputation/
absorption etc., keeping in view particularly the merger of
a number of pre-revised scales, upgradation of some
scales and the consequential changes in the minimum
eligibility service in a grade.
(iv) Department promotion Committee (DPC)Where two or more scales have been merged,
the existing DPC for the higher/highest grade will be the
DPC for the merged grade.
(v) Regulation of regular service rendered in the
pre-revised scales
The revised pay structure approved includes a
number of 'merged grades' with a common grade pay
and the concept of pay bands with grade pay introduced
effective from 1.1.2006. Insofar as the issue of regulation
of service rendered prior to 1.1.2006 is concerned, while
the general rule may be that such regular service be
deemed to be service rendered in the corresponding
grade pay/pay scale approved effective from 1.1.2006 or
from a subsequent date, as the case may be, this
formulation cannot apply in cases where there has been
merger of more than one grade into one with a single
grade pay/pay scale. Since the merger is effective from

1.1.06 only, even notional benefits of the merger cannot
be extended for periods falling prior to 1.1.06. A note to
the following effect may, therefore, be inserted under
col.12 of the Schedule on RRs, and under relevant
provisions in Service Rules, to take care of the
requirements:
Note:For the purpose of computing minimum
qualifying service for promotion, the service rendered
on a regular basis by an officer prior to 1.1.2006/ the
date from which the revised pay structure based on the
6th CPC recommendations has been extended, shall
be deemed to be service rendered in the corresponding
grade pay/pay scale extended based on the
Commission. For purposes of appointment on
deputation/absorption basis, the service rendered on a
regular basis by an officer prior to 1.1.2006/ the date
from which the revised pay structure based on the 6th
CPC recommendations has been extended, shall be
deemed to be service rendered in the corresponding
grade pay/pay scale extended based on the
recommendations of the Commission except where
there has been merger of more than one pre-revised
scale of pay into one grade with a common grade pay/'
pay scale, and where this benefit will extend only for the
post(s) for which that grade pay/pay scale is the normal
replacement grade without any upgradation.
2. The Recruitment Rules/Service Rules are of
statutory nature. Therefore, the changes brought out by
other relevant instructions have to be incorporated in
the Recruitment Rules/ Service Rules by suitable
amendments so that the necessary steps like holding
of DPC etc. are taken to fill the post carrying the revised
Grade Pay/Pay Scale on regular basis. All the Ministries/
Departments are, therefore, requested to effect
necessary amendments to the Recruitment Rules/
Service Rules notified by them after following the normal
procedure of furnishing proposals to the Department of
Personnel and Training and the UPSC in the format
prescribed in the general guidelines on Recruitment
Rules circulated by the DOPT OM No. 14017/12/87-
Estt.(RR) dated 18.3.1988, and also in consultation with
the Legislative Department.
3. Ministries/Departments may initiate action to
complete the review in this regard and furnish necessary
amendment proposals to the DOPT and the UPSC in the
case of Group A and Group B posts within six months
from the date of issue of this Office Memorandum. They
may also, simultaneously, take similar action in respect
of Recruitment rules for Group C and D posts, which are
within their delegated powers. Appropriate action to
update the Service Rules for organized Group A,B Services,
etc. shall also be taken up with DOPT/UPSC within a
period of six months.

The undersigned is directed to say that from
some time past, fraud cases relating to opening of
accounts by use of bogus Advice of Transfers (AT) and
then misappropriation of money are being reported. To
control such type of frauds, it has been decided that from
16.3.2009, the transferring Head Post offices will dispatch
Advice of Transfer (AT) by Service Insured Post for Rs.
100/- duly sealed instead of Service Registered Post.
The AT received by other than Insured Post after this date,
should be returned to the Transferring HPO by Transferee
HPO for sending the same by Insured Post and account
should not be opened.
2. This may kindly be brought to the notice of all
post offices and strict compliance of the aforesaid order
may be ensured.

nnnnn Providing Acrylic Paints on the External wallsof Assets/ Buildings.
DG (Works), CPWD has issued circular vide No.
54/S&S Unit/Finishing/06 dated 19-01-2005. As per
circular acrylic paint has been allowed on the external
walls of the building. Accordingly it has now been decided

to switchover to the acrylic paint on external walls of Post
Office Buildings & Staff Quarters. Following steps should
be taken to ensure proper execution of the work.
1. The acrylic paints manufactured by reputed paint
manufacturing company shall only be used. A list of
specific makes brands of acrylic paint may be got
approved from Zonal CEs (Civil) and same should be
indicated in the tender documents.
2. The surface preparation before applying the
paint shall be required to be done as per manufacturer's
specifications. It should be ensured that before works
are taken up, necessary repairs to plaster, chajjas etc.
have been done and seepage, if any, has been arrested.
3. Since the financial implication of providing acrylic
paint at the initial stage is higher than that of providing
white washing or cement paint, the work shall be done in
phases, keeping in view the availability of funds.
4. Necessary provision for obtaining suitable
performance guarantee for the lifecycle of the product
against fading and/or peeling of the paint should be kept
in the contract.
5. To alleviate spurious quality paint, a special
condition should be inserted in the tender document that
all purchases of paint shall be made directly from the
manufactures or their authorized dealers. The delivery
challan shall be issued by the manufacturer's stock-yard
directly with full description of the work for which the
purchase is being made. This condition shall apply for
all purchases for 100 liters or more in a work.

Since long, the matter regarding payment of SB
allowance to SPM of Single Handed SOs has beenfiguring in meetings with union representatives at variouslevels. Directorate in its communication No. 113-8-SBdated 9-01-2009, quoting its earlier letter No. 55-2/90-SBdated 4-05-1990 has now informed that SPMs of Single
Handed SOs are only PAs but have been designated asSPMs and, therefore covered under para 1(iii)(a) of orderNo.2-3/86-SB dated 27-04-1989 (substituted videDirectorate letter No. 2-3/86-SB dated 12-09-1989). Thisclarification still holds good.
In other words, if by calculation of workload of
single handed post office SB work alone is more than 4hours (i.e. at least 0.5 of the work hours justifying sanctionof Postal Assisstant) the S.B. Allowance will be payable,subject to fulfillment of conditions laid down in Directorateletter No. 2-3/86-SB dated 27.04.1989.(Chief PMG, Maharashtra letter No. Estt/7-1/II/Allowance

Matriculate Group 'D' Employees.Kindly refer para 3 of DDG (Estt.) memo No. 1-
20/2008-PCC dated 27.03.2009 on which is reproduced
below:
"The issue was referred to Ministry of Finance
for fixation of pay scales of these employees of the
Department of Posts before completion of the training
and that Ministry has concurred in the proposal subject to
the conditions that necessary computer training may be
provided to enhance their skill. Action may be initiated by
Heads of Circles to complete the required training on
computer operations in consultation with the Training
division of the Directorate. Training division of the
Directorate will take necessary action to get the module
developed to train all such Non-matriculate employees
in basic data entry and circulate to all Circles ."
2. The module for the multi skilled employees in
computer training is enclosed. The module is in two parts:
(a) Be able to make data entry in MS Word and MS
excel,
(b) Booking articles on Point of Sale in Meghdoot
Millennium.
The total duration of the training is of two hours for 6 days.
The programmer is mainly hands on experience of
performing basic functions on computers on computers.
3. Imparting Training:
(a) Training on data entry be imparted at local level
at divisional centers/computerized post offices or it
required at institutes, which provide such training.
Preference to institutes involved in literacy Mission of State/
Central Government may be given where charges are
reasonable.
(b) Training on "Point of Sale" in Meghdot Millennium
may be given by System Administrator/Computer knowing
SPM/PA in the local/ nearby computerized post office.
(c) In case WCTC are used for such training, please
ensure that the Project training is not hold up.4. The expenditure for the training will be met from
Non Plan funds under 'PS' for payment to professional
agency, if outside Institute is engaged and 'TE' forTraveling. Kindly work out the tentative expenditure for

public administration require that all entries (whether poor, fair,
average, good or V. good) in the annual confidential report of
public servant, whether in civil, judicial, police or any other State
service (except Military) must be communicated to him within a
reasonable period so that he can make a representation for its
upgradation. This rule prevails even if there may be no rules/G.O.
prohibiting it, because principles of non-arbitrariness in State
action as envisaged by Article 14 of the constitution requires
such communication. Article 14 overrides all rules of Government
orders.
8. When an entry is communicated to a public servant, he
should have a right to make a representation to the authorities
concerned who must decide the representation in a fair manner
and within a reasonable period. The representation must be
decided by an authority higher than the one who gave that entry,
otherwise likelihood is that, the representation would be
summarily rejected without adequate consideration. All this would
be summarily rejected without adequate consideration. All this
would be conducive to fairness and transparency in public
administration and would result in fairness to public servant. The
State must be a model employer and must act fairly towards its
employees. Only then a good governance is possible. These
directions do not apply to Military Officers because their position
is different. These direction, however, apply to employees of
statutory authorities, Public Sector Corporation and other
instrumentalities of the State (in addition to Government servants).
9. Non-communication of entries ACRs of a public servant,
whether he is in Civil, Judicial, Police or any other service (other
than Military) has civil consequences because it may affect his
chances of promotion or get other benefits. Such non-
communication would be arbitrary and therefore violative of
Article 14 of the Constitution".
In view of the above, the judgments of the High Court
was set aside. In the meantime as the Appellant, had retired, he
may be conveyed the "Good" entry in CR 93-94 for his
representation and it upgradation. If his representation is allowed
and the entry is upgraded as "V. Good" he may be given promotion
retrospectively if selected by DPC. His arrears to be paid due to
this promotion may be paid with 8% interest per annum.
Appeal is allowed as above.

CASE LAW - AN IMPORTANT SUPREME COURT JUDGMENT ONAPPLICATION OF BENCH MARKS ON PROMOTION
1. When an entry in the confidential report of a
Government servant is going to affect his further career
prospects, it should be communicated to the employeeeven if it is not an adverse remark.
2. All gradings in the confidential reports are to
be communicated to adhere to the principles of natural
justice within a reasonable period after CRs are finalized
Facts: The Appellant joined Border Road Engineering Services
as Group 'A' Officer. The Border Road Group 'A'. Services Rules
governs the service. He was promoted as Executive Engineer
on 22.2.1988. He is eligible for further promotion as
Superintendent Engineer after five years of service as Executive
Engineer from 21.2.1993. But he was overlooked for promotion
and his juniors were promoted as Superintendent Engineer on
the ground he obtained only 'Good" grading in CR for the year
1993-94. For promotion as Superintendent Engineer, he should
have got the grading of "Very Good" which is the benchmark in
terms of the OM, dated 10.4.1989 and hence he was overlooked.
The grading of good was also not communicated to him. Hence
he filed a writ petition in Gauhati High Court which by its Order,
dated 26.11.2001 in W.P. No.447 of 2001 dismissed his application.
Hence the present appeal lies before the Supreme Court.
The legal issue involved in this case was whether
"good" entry n the ACR which adversely affected the Appellant's
promotion ought to have been communicated to him so as to
afford him an opportunity of making representation against it.
Communication of Government of India, dated 10/11.9.1987
provides for communication of only adverse entries in the
confidential report is to be communicated.
The Appellant argued that non-communication of
grading "Good" affected him against which he could have
represented. That non-communication violated the principles of
natural justice.
The Respondent submitted that only adverse entries
are to be communicated as per standing instructions. As 'Good'
is not an adverse entry, it need not be communicated. To state
so, the Respondents relied on the case of Vijay Kumar v. State of
Maharashtra [1988 SCC (L&S) 42] to state only non-communicated
adverse entries only cannot form the foundation to deny
promotion. In the case of State of Gujarat v. Suryakant Chunilal
Shah [1999 SCC (L&S) 317], it was held that adverse entries
only are to be communicated to improve his performance and to
represent against it. Other entries not adverse need not be
communicated.
The views of the Respondent was not agreed to by
the Apex Court and in its opinion all entries from bad to outstanding
are to be communicated. An opportunity need to be given to
represent if any of the entries are detrimental to his progress.
In view of the above, the observation of the Apex
Court are noted as below: -
Held: "1. In this situation, the "good" entry is in fact adverse
entry because it eliminates the candidate from being considered
for promotion. Nomenclature is not relevant; it is the effect which
the entry is having which determines whether it is an adverse or
not. It is thus the rigours of the entry which is important, not the
phraseology. Grant of "Good" entry is of no satisfaction to an
incumbent if it in fact makes him in eligible for promotion or has an
adverse effect on his chances. "Good" entry should have been
communicated to the Appellant so as to enable him to make a
representation praying that the said entry for the year 1993-94
should be upgraded from "good" to "Very Good". After considering
such a representation, It was open to the authority concerned to
reject the representation and confirm the "good" entry (though in
a fair manner), but at least an opportunity of making such a
representation should have been given to the Appellant and that
would only have been possible had the Appellant been
communicated "good' entry. Non-communication of 'good" entry
was arbitrary and hence illegal.
2. Every entry (not merely a poor or adverse entry)
relating to an employee under the state or an instrumentality of
the state, whether in Civil, Judicial, Police or other service (except
the Military) must be communicated to him within a reasonable
period and it makes no difference whether there is a benchmark
or not. Even if there is no benchmark, non-communication of an
entry may adversely affect the employees' chances of promotion
(or getting some other benefits) because when comparative
merit is being considered for promotion (or getting some other
benefits) a person having a 'Good' or 'Average' or 'Fair' entry,
certainly has a less chances of being selected than a person
having "Very Good" or "outstanding' entry. In most of the services,
gradation of entries usually is, (i) Outstanding (ii) Very Good, (iii)
Good, (iv) Average, (V) Fair and (Vi) Poor. A person getting any
of the entries at Serial Nos. (ii) to (Vi) should be communicated
such entries so that he has an opportunity of making a
representation praying for its upgradation, and such a
representation must be decided fairly and within a reasonable
period by the authority concerned. If it is to be held that only
'poor' entry is to be communicated, consequences would be that
persons getting "Fair, Average, good or Very Good" entries would
not be able to represent for it upgradations and this may
subsequently adversely affect their chances of promotion (or
get some other benefits). If Office memorandum, dated 10/
11.9.1987 is interpreted to mean that only adverse entries (i.e.
'poor' entry) need to be communicated and not "fair, average or
good" entries, it would become arbitrary (and hence illegal) since
it may adversely affect the incumbent's chances of promotion or
get some other benefit.
3. Every entry in the ACR of a public servant mush be
communicated to him within a reasonable period, whether it is a
"poor", "Fair", " Average", "Good" or "V.Good" entry. This is
because non-communication of such an entry may adversely
affect the employee in two ways: (i) Had the entry been
communicated to him, he would know about the assessment of
his work and conduct by his superiors which would enable him
to improve his work in future; (ii) he would have an opportunity
of making a representation against the entry ihhe feels it is

unjustified and pray for its upgradation. Hence non-communication
of an entry is arbitrary. It is only when there is a bench mark, but
in all cases that an entry (whether it is "Poor, Fair, Average,
Good or V.Good") must be communicated to a public servant,
otherwise there is violation of principles of fairness, which is
the soul of natural justice. Even an outstanding entry should be
communicated since that would boost the morale of the employee
and make his work harder.
4. Communication of entries and giving opportunity to
represent against them is particularly important on higher posts
which are in a pyramidical structure where often principles of
elimination is followed in selection for promotion, and even a
single entry can destroy career of an officer which has otherwise
been outstanding throughout. This often results grave injustice
and heart-burning, and may shatter the morale of many good
officers who are superseded due to this arbitrariness, while
officers of inferior merit may be promoted. In the present case,
action of the Respondents not communicating "Good" entry for
the year 1993-94 to the Appellant is arbitrary and violative of
natural justice because in substance 'Good' entry operated as
an adverse entry.
5. Rules of natural justice are not codified nor are they
unwarying in all situations, rather they are flexible. They may,
however, be summarized in one word: Fairness. What they
require is fairness by authority concerned. What is fair would
depend on situation and context. Rules of natural justice are
flexible. The question to be asked in every case to determine
whether the rules of natural justice have been violated is, have
the authorities acted fairly?
6. Originally, there were said to be only two principles of
natural justice (i) Rule against bias and (ii) right to be heard (audi
alteram partem). However, subsequently, some more rules came
to be added namely, requirement to give reasons. Natural justice
has also been held to be part of Article 14 of the Constitution.
Natural Justice is not a stagnating but an expanding concept. It is
open to Court to develop new principles of natural justice in
appropriate cases.
7. In the present case a new principle of natural justice is
being developed by holding that fairness and transparency in

v Federal Secretariat of NFPE has met on25th May 2009 in the Office of the AIPEU Group 'C' at
Dada Ghosh Bhawan under the chairmanship ofComrade Ishwar Singh Dabas Deputy Secretary
General NFPE. The Secretariat reviewed theundergoing process of fresh re-verification and decided
to make an effort to at least increase the membershipof all NFPE Unions by 10 to 15%. The Secretariat
also decided to depute office bearers of NFPE andthe General Secretaries of Affiliated Unions to
whichever circle that feels the need to organize anymeetings in connection with the Membership
Campaign. The Secretariat also decided that there shallbe no denial of membership to any employee due to
intra-union rivalry etc at any place and to view thecomplaints in this regard very seriously by the
respective All India Union.

to NFPE to depute a representative to the four daysInternational Seminars on Posts and Logistics to be

v UNI Apro is organizing the Posts & Logistics
Conference of its member organizations in the AsiaPacific Region in Jakarta (Indonesia) from 25th July to
29th July 2009 and has extended the invitation to theSecretary General NFPE to participate in the
Conference. The membership of NFPE in the UNI Aprois under process and the Application for membership
is being sent to the UNI in the proforma sent to us bythe UNI. The Federal Secretariat has decided to remit
membership to the extent of 35000 and increase it toour full level in due course.
v TUI (Trade Union International) is holding itsInternational Conference of all Government Sector and
Financial Sector organisations of PSUs in Bracilia,Capital City of Brazil (South America) from 28th to
29th June 2009. The confederation of CG Employeesis a member affiliate of TUI and is offered two delegates
to attend the above Conference. The Confederationdelegation will consist of Comrades K. K. N. Kutty
