Primary and basic issues are not considered but lodged in cold storage. The blanket ban on creation of posts has continued for twenty-two years even in our operational services since 1985. Adding salt to injury, unscientific reduction of existing establishment is carried out by the Screening Committee over five years and further stands extended for another three years. The dominant leadership of the Central Government Employees movement have abdicated their role of exercising compulsions through organised strength and movement but just relying on the meetings of the Joint Consultative Machinery that hardly negotiates seriously and generally accepts the decisions of the Government. If the Government has a veto to reject the proposals of the Staff Side in the Council and even to reject the Board of Arbitration Awards and take decision outside the Council, what is the purpose of such negotiating machinery? The ban on creation of posts and formation of Screening Committee are some of the major policy decisions taken ignoring the Staff Side. The Awards of the Board of Arbitration, which is vested with the judicial status, are set aside by the Government in a cavalier style. The glaring cases are that of conveyance allowance, encashment of leave and bonus ceiling in the past and now seventeen awards facing same fate like compassionate appointments, transport allowance, HRA arrears, Cash handling allowance etc. The JCM hardly meets once in two years. The items are not discussed and decided when it meets. The rules of JCM are very categorical that decisions must be taken in the same Council meeting. This is never being done. The position is much worse in the Departmental Council JCM in the Postal Department. No JCM meeting over years! No periodical meetings too! A total static and stalemate! The dilution of the JCM has devalued the efficacy of the body to negotiate. If this lamentable state of affairs is to continue, the Central Government Employees will be rendered impotent for any industrial action. Remember! There is no collective industrial action of the entirety of CG Employees movement after 1968. Even the 1974 show down was confined generally to Railway only. We must identify issues that are of a common nature and involves all the workers and their class interests and muster their strength to wrest the same. We must challenge the decisions of the Government taken unilaterally without any discussion with the respective representative trade unions. The Confederation of Central Government Employees and Workers has come forward to break the silence and organize one-day token strike on 30.10.2007 with a 12 Point of Charter of demands. The problems confronting the CG Employees, particularly the formation of Judicial Commission to GDS became the Charter of Demands. This is only just a beginning; cutting ice frozen since 1968. Let us sincerely act and organize the rank and file for the massive one-day token strike on 30.10.2007 at all levels. All demands pertain to the Government employees. Let us break the stalemate and stagnation persisting since 1968. Let us restore our credibility by challenging the Government to implement its commitments like implementation of arbitration awards, formation of Judicial Committee to GDS, grant of IR etc. Let us fight for scrapping of New Pension Scheme. Let us liberate the GDS from the clichés of bureaucratic committee and form a Judicial Commission to end the prolonged exploitation. Let us awake from the deep slumber and rise up in this occassion to wrest the demands and establish the worker's misht. FIGHT AGAINST INJUSTICE

We are not forecasting. We are much concerned andinterested that we should not drift but proceed alongthe correct path. What is the present position?

Primary and basic issues are not consideredbut lodged in cold storage. The blanket ban on creationof posts has continued for twenty-two years even in ouroperational services since 1985. Adding salt to injury,unscientific reduction of existing establishment is carriedout by the Screening Committee over five years andfurther stands extended for another three years.

The dominant leadership of the CentralGovernment Employees movement have abdicated theirrole of exercising compulsions through organisedstrength and movement but just relying on the meetingsof the Joint Consultative Machinery that hardlynegotiates seriously and generally accepts thedecisions of the Government.

If the Government has a veto to reject theproposals of the Staff Side in the Council and even toreject the Board of Arbitration Awards and take decisionoutside the Council, what is the purpose of suchnegotiating machinery? The case mentioned above in the reference isone among them. The case was rejected on the pleaof want of vacancies under relaxation quota and thecandidate cannot be absorbed within a period of oneyear. Postmaster, HSG.I, Khandwahas not been promoted to the LSG, HSG.II & HSG.Irespectively. More than twenty juniors have beenaccorded HSG.I promotion.

The official has represented his case to ChiefPMG, Bhopal much earlier and no consideration hasbeen exercised on his appeal. He is due forsuperannuation in November 2007. l Irregularities in the grant of notionalpromotion to LSG -- case of Orissa Circle

It is constrained to note that despite yourassurance to depute an officer from Directorate toOrissa Circle to verify the date of notional promotionsin LSG, the issue remains unsettled. The irregularnotional promotions granted only to the retirees thattoo with effect from 1992 remains uncorrected. Theseniors are retiring every month without availing thefruits of the orders of the Directorate dated 20-11-2006.

Adding salt to the injury, the Chief PMG is nowresorting mass scale transfer of FTP qualified officialswho posses Accounts qualification from divisions todivisions to fill up the vacant LSG APM Accounts postsinstead of filling up the post on divisional basis withthe officials possessing Accounts qualification in thedivision.

This will affect all the officials in the middle ofthe academic session and cause serious dislocationswhich is against to the spirit of orders on the subject.

It is requested to cause instructions to the ChiefPMG, Orissa to keep the move in abeyance and deputethe officer to verify and set right everything at theearliest.

Arbitrary closure of post offices -- resorted inPunjab Circle - reg.

It is rather constrained to note that the PMG,Punjab Circle, Region II has resorted series of closureof post offices in all the divisions. The following postoffices were closed arbitrarily on 01-07-2007.Faridkot Division

This is against to the assurances made duringthe talks in April 2007. The closure of post officeswithout consulting the staff side and without any basisis causing a concern.

It is requested to intervene and causeinstructions not to resort closure of post offices withoutany discussions with the Circle / Divisional unions.

Kovilpatti Division in Tamilnadu Circle - request

A kind attention is invited to the reference andit is dismayed to note that the situation becomes veryalarming in the entire division.

Fifteen active office bearers of this union havebeen awarded with punishments like reduction by astage of pay w.e.f. 01-08-07 with a ban to earnincrement for 2 years under Rule 16 charges which isagainst to the rules 11 (4) of CCS (CCA) Rules 1965.More than 550 notices have been sent to the officialsmerely for participation in strike.

The office bearers of this union have beentransferred to far off places in the R.T. and thegrievances have not been redressed despite appealingto DPS / PMG. The PMG, Southern Region who nevervisits to Madurai but remaining at Chennai doingbusiness activities did not care the developments andnot allowed the DPS to take decision also.

Even though the SSPOs Sri V. Venkatasamihas been asked to proceed on leave for a month, allthe vindictive orders he issued during this periodremains as it is. No monthly meeting is granted evennow to redress the problems. No representation ofofficials against their genuine grievances in RT is beingattended. There is a total panic and fear situatedamidst the entire division.

The divisional / circle unions have decided tolaunch struggle culminating to indefinite strike in thesecond week of August 2007 if the situation is notrestored to normal.

It is fervently requested to intervene immediatelyand set right matters as if fire on the top of the roof.

subject to absorb all the approved candidates ofTamilnadu Circle as one time measure irrespective ofthe outcome of the Chennai High Court judgement, Iwish to bring to your kind notice that the Chennai HighCourt in its judgement dated 20-06-2007 dismissedthe writ petitions duly confirming the orders passedby the Central Administrative Tribunals to absorb allthe approved candidates and directed to complete theprocess within three months from the date of receiptof the order.

l Unwarranted proposal of shifting the

Apropos reference, I wish to inform that the PMGCentral Region has appreciated the Circle Union,Tamilnadu for the suggestion offered by them to keepthe Divisional Office at Vridhachalam itself by reducingthe expenditures incurred towards rent.

It is dismayed to note that the same PMG isnow resorting action to shift the Divisional Office toKallakurichi which is a remote corner of the VillipuramDistrict against the interest of officials.

In fact there is no proper space available atKallakurichi and the terrace of the first floor is underleakage which is stated as building cancer. Providingasbestos will not be a solution. Above all there is norailway route at Kallakurichi. The present arrangementat Vridhachalam which is in the main line betweenChennai-Trichy is practically covering to the needs ofall the divisions. The shifting will further causedislocations to the officials working in the Divisionaloffice and it will be against the interest of the entiredivision.

It is therefore to intervene and instruct the PMGto honour his assurance not to shift the divisionalheadquarters from Vridhachalam which is in existenceover fifty years.

Despite clear orders that the officials workingon the MPCM in post offices are entitled for drawal ofMachine Allowance of Rs. 100/- per month vide youroffice letter No. 43-3/93-PMR (Pt. II) dated 17-01-97,this has not been paid to the Postal Assistantsdeployed in MPCM Counters at Dehradun Division.

The Chief PMG has not instructed the SSPOsso far despite it is being brought to his notice by theCircle Union.

It is requested to cause necessary instructionsin this regard and ensure payment of MPCM Allowanceto the officials deployed in MPCM counters.

A kind attention is invited to the referencewherein we mentioned about the burning problemsprevailing in the circle with the request for your effectiveintervention. But no improvement could be seen in thesettlement of the problems.

The Circle Union which has left with no alternatesince the Chief PMG did not discuss the burningissues and arrive an amicable settlement has startedagitation programmes since 23-07-2007 (Dharna) atRaipur demanding the mitigation of their genuinedemands. The circle union has further decided tolaunch serious programme from 06-08-2007. There isa total panic prevailing in the circle.

It is requested to intervene and ensure peace

l Unwarranted & unjustified transfer orders

caused against Sri V.K. Jain, APM Accounts, New

Delhi GPO - reg.It is constrained to bring to your kind notice

that the Circle Administration, Delhi has shifted oneShri V.K. Jain, an office bearer of this union from NewDelhi GPO to Delhi West Division based on the lettersent by the Chief Postmaster, New Delhi GPO withoutconducting any enquiry in the middle of the academicsession.

In fact, the said official Shri V.K. Jain has raisedsome serious objections in the capacity of APMAccounts about the unlawful charges made under O.E.and also sought some information under RTI Act aboutthe corrupt functionary of the then Dy. Chief Postmaster(Admn.) Shri Devanand and the Chief Postmaster ShriB.L. Bhati. Many instances of obvious considerationslike modifying the dies non cases of very old period inone day for some officials were unearthed due to hisquestion under RTI Act.

The Chief Postmaster has thus sent a false andfabricated complaint to the Chief PMG to shift himfrom New Delhi GPO as an act of revenge and vendettawhich has been simply considered without any enquiryby the Circle Administration.

The official's representation and its enclosureswhich are enclosed herewith will prove the corruptiveactivities of the New Delhi GPO Administration andthe official who brought the corruption under light hasbeen penalised and punished due to this unwarrantedtransfer. There are many more hidden skeletons inthe cupboard rolling down if an enquiry is constitutedagainst the malpractices of New Delhi GPOAdministration.

Now the innocent is punished and the guilty isflourished with the blessings of the Delhi CircleAdministration which is causing a serious concern.

It is requested to kindly order an enquiry in thiscase and take appropriate action and keep the transferorders issued against the official in the middle of theacademic session under abeyance.

l Unrealistic target fixed for SPMs under

Business Post like e-Post & UTI children's carrier

plan -- case of Hissar Division in Haryana Circle

It is brought to our notice that the Chief PMG,Haryana has fixed unrealistic target to the divisions insecuring business under 'E-Post' and UTI Children'scareer plan business and in turn, the Divisional Head,Hissar is unleashing all harassment and exertingpressure upon every SPM / PA to realise the target inanyway either from the public or on his own.

This causes a serious concern and we recordour serious protest over the unrealistic targets fixedupon the officials who are suffering very hard in theexistence of acute shortage of staff. This will negatethe business activities in future.

Suitable instructions may please be given toChief PMG, Haryana not to harass the officials by fixingunrealistic targets on E-Post and UTI work.

Provision of wire -- gauze shutters in postalpool quarters -- recovery of 20% from allottees -

reg.

Anent reference, the department has decidedto provide Fly Proof / Wire Gauze / Wire Mesh Shuttersfor all windows / doors to arrest the inconveniencescaused to the occupants due to flies and mosquitoesby collecting 10% of the cost from the allottee.

Similarly 20% of the cost shall be borne by theallottee for providing grilled door shutters on entrance doors.

It is needless to mention that the provisionsstand above are much essentials to prevent theepidemics and diseases due to flies & mosquitoes.As such, the recovery of a portion of the cost from theallottees is unjust and unfair.

It is requested to reconsider the issue onceagain and cause instructions not to collect any amountfor providing the Fly Proof / Wire Gauze / Wire Meshshutters etc. in the staff quarters from the allottee.

l Obtaining completion report fromPostmasters before effecting payment to civil

contractors - reg.

The earlier practice of collecting completion reportfrom the Postmasters for any civil work carried at hisoffice has been suddenly dispensed with for no reasons.

Now a days, the postmasters have not beeninformed about the specification of each work to becarried out at his office or any copies of sanction forentrusting work to any private contractors. There is no

transparency prevailing in the work carried out by thecivil wing.

On several occasions, it is brought to our notice

that bills are being paid before carrying out the work

or in the half way. We suspect that there are

malpractices and corruptions in the civil works and

the instructions stipulated in the Directorate orders

issued based on the guidelines of CVC have not been

given any credence.

In order to avoid all such malpractices and

corruption, the earlier method of obtaining completion

report from the Head of the Office be revived before

making final payment to the contractors. Similarly,

the sanction memos should also be supplied to the

Postmasters for cross checking of the civil work

executed at his office.

It is requested to consider the same and cause

appropriate orders early.

had on 19-04-2007 on the Ten Charter of demands and

the assurances to cause orders on the following issues.

(i) Grant of OTA to postal operative staff to manage

the shortage of staff;

(ii) Formation of internal committee to fix

honorarium / incentive for the works like

Western Union Money Transfer, Passport

Applications Processing, Acceptance of Income

Tax returns, RPLI etc.

(iii) Assurances made to cause instructions to all

Heads of Circles to fix incentive on the order

itself when any new business activities is

implemented at their levels.

(iv) Engagement of Short Duty Pensioners to

manage the absenteeism.

(v) Review the orders restricting the tenure of SPMs

& MD dated 02-05-06, the remuneration received from

the Election Commission should be credited under

Retail Post and payment of honorarium shall be made

to the staff who performed the job.

The Chief PMG, Kerala referred to BD

Directorate on 07-12-06 in this regard to clarify whether

the honorarium can be sanctioned by the circle before

claiming the remuneration from the Election

Commission and if so, the head of account from which

the amount to be sanctioned.

Having extracted the work, by utilising the staff

overburdenly, the dues shall be paid to the staff in

time. It need not be linked with the payment to be

received under retail post and it is against to the

principle of natural justice.

Necessary clarifications may please be issued

without any further loss of time delinking the payment

of incentive from the amount received from Election

Commission which should be dealt separately by the

department.

It is brought to our notice that despite supply of

Genset made to many offices some one-year back,

they are lying kept uninstalled and being exposed to

Sun and rain in open areas.

The reason for such non-installation is stated

that the supply contractor has not been turned up for

such work since he had been paid with the quantum

of more than 90% payment. This should be verified.

However, it is realiable fact that in Delhi Circle also,

we could see such cases like Patel Nagar, Rajinder

Nagar etc. and the generators are being kept exposed

outside.

It is requested to expedite action to install the

generators already supplied to post offices in a time frame.

A line in reply about the action taken is highly

solicited.

No Issues Report

The customers were utilizing the services of BPC

situated in their area. The merger with offices

located approximately 6 km to 10 km away only

drives them away towards private run couriers

The BPCs of Mylapore and T. Nagar showed a

business growth of Rs. 25 Lakhs and above per

month. But its merger with Anna Road results in

sharp decline in traffic and revenue collections

The huge amounts incurred to build infrastructure

at these offices exclusively for Business Post

have become a wasteful expenditure, as the rooms

are redundant and vacant now.

Similarly more than 10 high speed franking

machines utilized in these offices so far have

become unutilized.

The service rendered by the ME(s) and PRI (P)s of

city postal units to improve business in their area

have become nullified and the customers are not

willing any more travel long distance

When we are trying to improve our revenues

through various new schemes and products. This

order defies the logic of our valued customers

from our fold.

Most of the small and major bulk mailers favour the

BPCs to be located in their business area itself.

Mails of the customers of the merged BPCs are being picked up

from their premises through pick up agents and brought to the

identified BPCs and hence distance does not make any difference

as far as customers are concerned.

A statement showing revenue realization thro BPCs before & after

merger is enclosed. It shows that there is no loss of revenue due

to merger of BPCs. Though there was decline in revenue initially,

revenue realization has shown gradual increase in the subsequent

months. Here it is to intimate that BSNL has switched over from

"Business Post" (Book Post Rate Rs. 4/-) to "BMS'(Rs.3/-) w.e.f.

Jan 2007, and there is loss of revenue to the DoP @ Rs.1/- per

article. Inspite of that, revenue realization remains the same, which

implicitly indicates increase in revenue.

No huge amount has been spent on building infrastructure of BPCs.

Old sorting cases, already existing light facilities and old/surplus

furniture are used.

High Speed/Medium Speed Franking Machines have been ordered

to be transferred to the identified 5 BPCs where traffic has increased

multifold. Low Speed franking machines will be utilized for postal

operations. Hence no franking machine will remain unutilized. Further

high speed FMs are required.

MEs/PRI (P)s continue to coordinate with customers and link the

customers' mails to the identified BPCs without any inconvenience

to them.

Each BPC is functioning under supervision of an in-charge to ensure

prompt disposal of mails. In addition, Manager (Operations), BPCs

has been designated as overall incharge for all 5 BPCs in Chennai

City to monitor the following :

a) No business/customer is lost from our fold.

b) Linking of customers and their mails to BPCs in

coordination with concerned MEs/PRI(P)s.

c) Mail routing.

d) Procurement of new business

Small quantum of mails continued to be handled at local BPCs.

Articles are franked and dispatched from the local BPC itself

As on 31.03-2005 the Department of Posts had822 Head Offices and 25113 Sub Post Offices. As on31-03-2006 the Department had 4484 Departmental &22020 Rented buildings housing its various offices.The DOP also had 24674 departmental staff quarters.

Question 1:

Is the number of existing Post Offices inthe country sufficient to meet the requirementsof the population? Has the Department done anysurvey to assess the requirements of POs indifferent parts of the country? If so, please furnishdetails of finding of the survey and therequirement of POs assessed.

Reply 1:

Since Independence the number of Post Officesin India has increased 7- fold and stands at 1,55,333posts offices (as on 31-03-2006), including 1,39,074post offices in rural areas and 16,259 post offices inurban areas. A post office in India serves an averagepopulation of 6623 and an area of 21.16 sq. kms, whichcompares favourably with countries like China andUSA. Daily delivery of mail, collection of mails throughletterboxes and provision of basic postal facilities inall parts of the countries being ensured to meet theUniversal Service Obligation, irrespective of economicimplications. The norms for opening and retention ofpost offices are liberal and allow for subsidy to theextent of 66.2/3% in normal rural areas and 85% inhilly, tribal, desert and inaccessible areas. However,there is constant demand for opening of more postoffices in areas where a post office is not available inthe vicinity, particularly in newly developing areas.

Opening and relocation of post offices is acontinuing exercise, which is carried out by the PostalCircles by appraising the emerging requirement forpostal facilities, in accordance with the prescribedpopulation, distance and income norms for openingand retention of post office.

Question 29:

A proposal has been languishing in thePostal Life DOP for starting postal banking? Atwhat stage is the proposal pending and by whenis banking facility in post office expected tobecome operational?

Reply 29:

The proposal to set up Post Bank of India during

the Eleventh Five Year Plan to exploit the reach andcredibility of the Deprtment and its experience inmobilizing deposits is in conceptual stage. Themodalities for its implementation are presently beingworked out. However, since many statutory obligationswould be required to be fulfilled in terms of seekingapproval of Ministry of Finance, Reserve Bank of Indiaand Ministry of Law, it may not be possible to indicateany time frame by which the proposal of Post Bankwould be fully crystallized.

Question 30:

Please furnish details of the pilot projectlaunched in Chennai in collaboration withNABARD for giving loans through post offices toself-Help Groups (SHGs)? Has the project beenfound viable? What are the plans of the DOP forextending the facility to other parts of thecountry?

Reply 30:

The Department of Posts had signed aMemorandum of Agreement (MOA) with the NationalBank for Agriculture and Rural Development (NABARD)on 20th May 2005 for starting a Pilot Project in TamilNadu for dispensing micro-credit through Post Officeunder NABARD's Self Help Group (SHG)-Bank linkageprogramme. A photocopy of MOA dated 20-05-2005is enclosed as Annexure "XVI", which gives completedetails of the Pilot Project launched. This scheme couldnot be launched immediately because the Ministry ofFinance withdraw the provision of opening of'Institutional Accounts' under POSB scheme w.e.f.13-05-2005. However, in the revised procedure, itenvisages the operation of the Post Office SavingsBank Accounts by two Members of the Self HelpGroup, to facilitate the implementation of the Scheme.

Thereafter, the scheme was launched on pilot basisin December 2006. The assessment of the viability ofthis project is presently under process. Once the pilotproject is evaluated, a decision about the plans of theDepartment for extending the facility to other parts ofthe country, or otherwise, can be taken.

Question 31:

What are the plans of the DOP to enter intothe area of postal life insurance? Has any proposalbeen drawn up in this regard? If so, please furnishdetails.

Brief details of Postal Life Insurance/Rural postallife insurance are furnished below:

Brief detail's of PLI/RPLI

Postal Life Insurance (PLI) was introduced on

1st February 1884 with the express approval of theSecertary of State (for India) to Her Majestry the Queen

Empreess of India. It was esentially a scheme of State

Insurence mooted by the Director General of PostOffices Mr. F.R. Hogg in 1881 as a welfare schemefor the benefit of Postal Employees in 1884 and iaterextended to the empolyees of Telegraph departmentin 1888. In 1894. PLI extended insurace cover to femaleempolyees of P&T Departement at time when no otherinsurance company corvered female lives. It is theoldest insurer in this country .

In the beginning, the upper limit of life insurancewas only Rs. 4000/-, which has now been increasedto Rs. 10 lacs (Rupees Ten lacs) for Endowmentassurance and Whole life assurance . Over the yearPLI has grown substantially from a few hundred policiesin 1884 to more then 30 lac policies as on date. It nowcovers employees of Central and State Government,Central and state public Sector Undertakings,Universities, Government aided Educationalinstitutions, Nationalized Banks, Local bodies etc. PLIalso extends to the officers and staff of the Defenceservices and Para Military forces. Apart from singleinsurance Policies, Postal Life Insurance alsomanages a Group Insurance seheme for the EextraDepartmentai Employees (Gramin Dak Sevaks). PLIoffers 5 (five) types of plans as under :

(i) Whole Life Assurance (SURAKSHA)

(ii) Convertable Whole Life Assurance(SUVIDHA

(iii) Endowment Assurance (SANTOSH)

(iv) Anticipated Endowment Assurance(SUMANGAL)

(v) Joint Life Assurance (YUGALSURAKSHA)

Scheme for physically handicapped persons:

The maximum limit of Insurance for PhysicallyHandicapped persons in PLI is Rs. 1,00,000/- and hecan take any one of the plans. Medical examinationis compulsory under this scheme in order to determinethe exact nature and extent of their handicap and itsbearing on the life being insured. Depending upon thenature and extent of handicap, normal or a slightlyhigher premium is charged.

CHILDREN POLICY

The Department has introduced Children Policyunder PLI/RPLI, with effect from 20 Jan 2006. The

salient features of this scheme are as under:-

(i) The Scheme is envisaged to provideInsurance Cover to the children of PLI/RPLI policyholders.

(ii) maximum two children in family will beeligible to take children policy.

(iii) Children between the age of 5 and 20years are eligible.

INSURANCE PLANS IN RURAL PLI

RPLI offers 5(five) types of plans as under:

(i) Whole Life Assurance (GRAMASURAKSHA)

(ii) Convertible Whole Life Assurance(GRAMA SUVIDHA)

(iii) Endowment Assurance (GRAMASANTOSH)

(iv) Anticipated Endowment Assurance(GRAMA SUMANGAL)

(v) GRAMA PRIYA

The salient features of the Whole life,Endowment, Convertible Whole Life and AnticipatedEndowment Schemes of RPLI are same as thecorresponding schemes of PLI except that theminimum Sum Assured is Rs. 10,000/- and themaximum sum assured Rs. 3 lac. The maximum agelimit of entry is 55 years in case of whole Life andEndowment assurance but 45 years in case of theother plans.

A PLI/RPLI policyholder also gets followingfacilities:

(i) Change of nomination.

(ii) Assignment of Policy to any FinancialInstitution for taking loan.

(iii) Revival of his/her lapsed policy. Policylapses after 6 unpaid premiums if itremained in force for less than 3 yearsand after 12 unpaid premiums if itremained in force for more than 3 years.

(iv) Issue of duplicate policy Bound in caseof original Policy Bond is lost, burnt ortorn/mutilation.

Question 32:

What are the proposals for providing betterfacilities and amenities to the postman in ruralareas, viz. motor cycle, modern by-cycle, well-designed bag for carrying the mail, etc?

Reply 32:

In order to facilitate faster delivery of mails, twowheelers (motor cycles) are being supplied to postmanin areas where the volume of speed post mail for delivery

is relatively higher. In rural areas there is no suchproposal to provide motorcycles to the postmen. Asregard supply of bag, the postmen delivery bag is givento Departmental Postmen for taking mail for delivery.The bags are procured by the Postal Circles accordingto their requirements. However, the Gramin DakSevaks are not provided with any such bag duringdelivery and there is no proposal under considerationof the Depatment regarding provision of such bags toGramin Sevaks who are not departmental staff.

Question 34:

Please furnish a copy of the instructionswhich stipulate that only one third of the vacantposts are to be filled up and the remaining are tobe abolished out of the vacancies arising in aparticular year. What are the difficulties beingfaced by the Department on account of this?

Reply 34:

Copies of DPOT O.M. No. 2-8/2001 PIC dated16-05-2001 and O.M. No. 2-8/2001 dated 30-08-2006are enclosed as Annexure "XVIII" & XIX".

As per Department of Personnel & Training OMNo. 2/8/2001-PIC dated 16-05-2001, which is applicable

to all the Ministries/Departments in the Governmentof India, the direct recruitment vacancies arising in a

year are subjected to the optimization schemeaccording which Annual Direct Recruitment Plan is

finalized by the Screening Committee. As per the saidinstructions direct recruitment is limited to 1/3rd of

the vacancies arising in the year subject to a furtheceiling that it does not exceed 1% of the total

sanctioned strength. The remaining vacancies arerequired to be abolished. The validity of the said scheme

has been extended upto to 31-03-2009 vide Departmentof Personnel & Training Offices Memorandum dated

3-8-2006.

In fact in spite of decrease in manpower thecomputerization and rationalization of procedures havealso helped in maintaining smooth functioning of thepostal services so far.

Toughdecrease in the number of posts everyyear under the optimization attracts our concern, thesteady increase in the revenue receipts over the yearsas indicated below would show that measures takenby this Department from time to time has not allowedit to affect our performance:

Indian Railways and the Department of PostsTuesday signed an agreement to allow the sale of reservedtickots though post offices spread across the country.

The Memorandum of Understanding signed byAK Goyal, Additional Member (Commercial), RailwayBoard, and S. Samant, Chief General Manager,Department of Posts in the presence of Railway MinisterLalu Prasad and Minister of Communication andInformation Technology A. Raja at Rail Bhavan.

Mr. Prasad said this was the joint endeavour ofhis Ministry and the Ministry of Communications and ITfor the benefit of the people especially for those living inremote areas.

M. Prasad said that in future the facility of issuing e-tickets would also be provided at mutually agreed locations.

He said that in the first phase, reserved ticketswould be available at Phulbani (Orissa), Deoghar

Halfway to the 2015 deadline for achieving theMillennium Development Goals (MDG) to lift peopleout of poverty a United Nations MDG 2007 Reportpoints to the widening economic disparities andunderscores the need for political leaders to takeurgent and concerted action. It projects that climatechange will have serious and social impacts whichwill impede progress towards the MDGs.

The collective record is "mixed" in the"midpoint" report. While Asia has made dramaticprogress in the eradication of extreme poverty andhunger, halving the proportion of people living on theequivalent of a $ a day, there is evidence to suggestthat benefits of economic growth are not beingshared across different parts of the continent.

In South Asia, almost 30 per cent of thepopulation still lives on a dollar (approximatelyRs. 41) a day. South and South-East Asia are stillamong the sub-regions with the highest percentageof children under five suffering from malnutrition, "thereport said.

South Asia and sub-Saharan Africa had thehighest number of maternal deaths and the lowestproportion of skilled health attendants at birth. SouthAsia's path to MDG may be obstructed by challengesin areas such as health, environmental sustainabilityand gender equality. These include deforestation,unplanned urbanisation and the fast rate of HIV/AIDSinfections in parts of the region.

8-HOUR DAY FOR UNORGANISEDWORKERS MOOTED

The National Commission for Enterprises inthe Unorganised Sector (NCEUS) has recommendedan eight-hour working day, with at least a half-hourbreak and one paid day of rest, for workers in theunorganised sector.

In its report, "Comprehensive Legislation forProtection of Unorganised Workers," the Commissionalso suggested a statutory national minimum wage,including for home workers, and that women-specificemployment be treated on a par with work done bymen.Penal provision

The report, to be presented to the PrimeMinister by the month-end, also stressed the needfor a penal provision on delayed payment of wagesand on non-deduction of wages in the form of fines.

It ratified the right to non-discrimination on thebasis of sex, caste, religion, HIV/AIDS positive casesand place of origin.

It sought adequate safety equipment at theworkplace and compensation for accidents, besidesprotection from sexual harassment and the provisionof childcare and basic amenities.

The NCEUS has presented two draft Bills on"conditions of work" and " social security forunorganised workers" to the Prime Minister.

Ponni and Oscar put in eight years of serviceas an integral part of the Dog Squad, Chennai CityPolice, The Government has recognised their sincereservices and now after their 'retirement', they areentitled to a pension scheme. And here onwards, allthe dogs that 'retire' from the Dog Squad branches inTamil Nadu, will be entitled to the pension schemeas proposed by the State Government of Tamil Nadu.

Under the pension scheme for the Dog Squad,all the dogs which have been part of the same willavail of facilities such as regular medical check up,diet and total care. Letika Saran, Commissioner ofPolice, said, "Ever since the Dog Squad wasintroduced in the state, this is the first time ever thatsuch a scheme has come into effect. Initially, thedogs, which retired from the Dog Squad, used to beauctioned to pet lovers. But a lot of complaints cameup with regard to improper care of the dogs. A numberof welfare groups raised the issue stating that propercare and attention should be given to them, even afterthese dogs retire from service. That's how the pension

scheme for dogs came into effect.Under this scheme, the dogs will be entitled to

medical and diet facilities and above all get to stay intheir familiar surroundings in their respective kennels.Most important of all, they will get the same care asbefore. Presently, at the Chennai Dog Squad, two dogsare availing of this service-namely Ponni and Oscar."

With Ponni and Oscar, the pension scheme forthe dog squad will continue. And an added advantage ofstaying in their familiar surroundings and carry out routineactivities such as exercises. And they will get to staycloser to their trainers. At the Dog Squad, dogs aredeclared as retired when they become too old to continueworking at the same pace, or keep falling ill oftern.

The pension scheme is of great benefit to thesedogs because earlier, as soon as they retired andwere sent out they were unable to come to terms withthe sudden change in lifestyle and surroundings, asthey were trained to live in a specific environment andadjusting was tough. Now these hardworking dogs willhave a peaceful retirement

Raja begins work on postal Bill, won't

hear of private couriersfee as in the telecom sector.

The ministry official also added that theGovernment was yet to take a final call on limitingthe FDI cap at 49%. If this cap is imposed, MNCplayers such as DHL, TNT and Federal Express willhave to go scouting for Indian partners.

Besides, the draft Bill also recommends thatforeign players be subjected to an entry fee of Rs. 10lakh and a renewal fee of Rs. 5 lakh per annum,compared to Rs. 25,000 and Rs. 10,000 respectively,for Indian courier companies.

The Express Industry Council of India (EICI),the umbrella body representing domestic andinternational courier companies, has said theproposed amendments could main the Rs. 3,500 croredomestic industry, especially the small players, whilelimiting the choice for consumers. EICI has also saidif this Bill were to be enacted, it would not only restrictfurther foreign investment in the industry, but wouldalso require existing FDI in India to be sold to Indianinvestors. "This will send a message to other globalcompanies in all industries that any level ofinvestment in India could be changed arbitrarily," itsaid in its communication to the government.

The apex body has also said reducing theexisting foreign investment level in the expressservices sector was contrary to the global norms ofopening up express services to foreign investment.

AFTER putting the issue on the backburnerfor a couple of months due to strong protests fromprivate courier players, the Ministry ofcommunications under Telecom Minister A Raja hasnow revived work on amendments to the controversialpostal Bill.

Private courier companies are opposed to theproposed Bill as it seeks to prevent them from carryingany letter or parcel below 150 gm and also seeks tolimit FDI in the sector to 49%. The Bill also envisagesthat private courier companies willing to deliver lettersbelow this slab (150 gm) do so at a price which is 5times more than the rates charged by India Post or2.5 times Speed Post charges.

The Communications Ministry is yet to take acall on whether the Bill would be introduced in thecurrent session of Parliament.

"We have restarted internal work on the IndianPost Office Amendment Bill, 2007. The Governmentis very serious of getting the approval of both theCabinet and Parliament to make this a law," a sourcein the ministry of communications said. The sourcesaid despite opposition from the private courierindustry, the government is unlikely to renegotiate onkey issues such as creation of a regulator for thepostal sector (the Mail Regulatory DevelopmentAuthority), the 150 gm weight slab reservation for IndiaPost and mandating that large courier companies pay10% of total revenues as a universal social obligation

l Review of standards of work hours of Head

Post Offices/Sub Post Offices RD and MIS

Schemes clarification - reg.

Please refer to the Directorate's letter of even

number dated 1-3-2007 regarding prescribing the

manner of assessment of workloads of HOs and SOs

purely on ad-hoc basis in the wake of decentralization

of RD and MIS Scheme from Head Post Offices to

Departmental Sub Post Offices.

2. The matter has been further examined in the

light of issues raised by a Service Union and a Circle,

and following is clarified/communicated for the

information of all concerned:-

a) Time factors of 4 and 5 minutes indicated in

Annexure 'A' and 6 minutes indicated in

Annexure 'B' for Opening of Accounts of EDSO

under Heading "In Sub-Offices" are meant for

assessing the workload of EDSO only and not

for the work load of Departmental SO (Annexure

'A' and 'B' of letter of even number dated 01-03-

2007).

b) Time factor for withdrawal from RD Accounts

under PSS/MPKBY Schemes for Sub Post

Offices (Indicated in Annexure 'B' of the

Directorate letter of even number dated 01-03-

2007) may be read as 5.30 minutes instead of

5.50 minutes.

c) EDSOs are in direct account with Head Post

Office for the purpose of Savings Bank

transactions. Therefore, no time factors needs

to be prescribed for Departmental Sub Post

Offices for Savings Bank transactions occurring

in EDSOs.

d) Head Post Offices have to carry out some

miscellaneous items of work viz. receipts of

LOTs with vouchers from Sub Offices (in account

with) preparation of consolidated RD journal, its

checking transfer to SBCO, Settlement of

claims under protective scheme; indenting,

receipt, stocking and supply of pass book for

sub offices, verification of nominations/

particulars in respect of Accounts opened at

SOs before decentralization, processing of

objections raised by SBCO, settlement of

claims beyond powers of SPM etc. even after

GOVERNMENT ORDERSdecentralization of schemes which are not

performed in Sub Post Offices. In view of this,

coefficient for Sub Post Office at par with Head

Post Office is presently not justified. This will

be reviewed after IWSU of Directorate carries

out a formal study based on actual workload

impact in SOs.

e) Co-efficient for sub office as 1.3 has been

mentioned coefficient for HO in Annexure 'A' of

letter of even number dated 01-03-2007 which

is a typographical mistake.

f) Time factor for deposits in SOs under pay roll

scheme will be 2 minutes per transaction at

par with the time factor available.

No.6-1/2006-PE-II, The question of examining

the conditions of service and emoluments and other

facilities available to the Gramin Dak Sevaks has been

under the consideration of the Government of India for

sometime. The Government has now decided to set

up a one-man committee for the purpose.

2. Shri R.S. Nataraja Murti, Retired Member of the

Postal Services Board will constitute the Committee.

3. The Committee will go into the service conditions

of Gramin Dak Sevaks and suggest Changes as

considered necessary. The terms of reference of the

Committee will, inter alia, include the following:-

(a) To examine the system of extra departmental

post offices, conditions of employment, wage structure

of the Gramin Dak Sevaks and recommend suitable

changes considered necessary.

(b) To examine the reasonableness of introducing

a social security scheme for providing provident fund

and retirement benefits to Gramin Dak Sevaks.

(c) To examine and suggest any change in the

method of recruitment, minimum qualifications for

appointment as Gramin Dak Sevaks and conduct and

disciplinary rules.

any interim relief till the time the recommendations of

the Committee are made and accepted by the

Government.

4. The Committee will function for a period of one

year, extendable at the discretion of the Government.

5. The Chairman of the Committee will be assisted

by Shri A.K. Sharma, a Senior Administrative Grade

Officer of the Department who will act as Secretary to

the GDS Committee. Adequate staff support will be

provided to the committee by the Department of Post.

The Committee will keep the VIth Central Pay

Commission informed of the progress of its work from

time to time.

6. The Committee will devise its own procedure

and may call for such information and take such

evidence, as considered necessary.

7. The headquarters of the Committee will be at

New Delhi.

l Implementation of order dated 12th April,

2005, of the High Court of Judicature of Andhra

Pradesh at Hyderabad in Review WP MP SR No.

78433 of 2004 in WP No. 8532 of 2003 - Regarding

restoration of one-third portion of commuted

pension after 15 years from the date of

commutation.

The undersigned is directed to invite reference

to this Department's Office Memorandum, No. 4/59/

97-P&PW (D) dated the 14th July, 1998, vide which

instructions were issued for restoration of one third

commuted portion of pension after 15 years from the

date of commutation or 1st April, 1985, whichever is

earlier. The revision of pension of such PSU absorbees;

in terms of the above Office Memorandum was to be

notionally fixed with reference to the recommendations

of the Fifth Central Pay Commission and one-third of

the amount so arrired: at was to be restored /paid to

those PSU absorbees. The PSU absorbees were,

however, entitled to Dearness Relief on the full notional

pension.

2. Society for the Welfare of Former Central

Government Employees Absorbed in Public

Undertakings, Hyderabad, had filed an OA, No.: 1345/

01 in the Hyderabad Bench of Central Administrative

Tribunal requesting for certain reliefs, which was allowed

by the Tribunal vide its order dated 28th November,

2002. Aggrieved by the order of the Tribunal,

Government filed a Writ Petition. No: 8532/2003 in

the High Court of Judicature of Andhra Pradesh at

Hyderabad, against the order of the Tribunal. The High

Court vide its order dated the 24th December, 2003,

while agreeing with the arguments of the Government

that PSU absorbees have surrendered their right to

draw two-thirds of their commuted pension in lieu of

terminal benefits received by them, however, held that

one-third pension is restored, if it had become for

restoration before 31st December, 1995 (Fourth Central

Pay Commission's recommendations), to which two

instalments of interim reliefs; Dearness Relief, as

appropriate and 40% fitness allowance were to be

allowed on full notional pension before arriving at the

revised pension as on 1st January, 1996 (based on

Fifth Central pay Commission's recommendations).

3. It was felt in the Government that there was an

error apparent on record in the order dated the 24th

December, 2003, a review petition, No: WPMP SR

NO. 78433 in WP No.:8532 if 2003 was filed in the

High Court praying for rectification of the error. Pending

filing of the review petition in the High Court by the

Government, a Contempt Petition No: 312/2005 was

filed by the petitioners in the High Court for non-

implementation of the order dated the 24th December,

2003, of the High Court vide its' order on 12th April,

2005, dismissed the review petition since it did not

find any calculation error in its order dated the 24th

December, 2003. The High Court, again on 12th April,

2005, dismissed the Contempt Petition holding that it

is for the individual employees to make detailed

representations with regard to the eligibility of pension

keeping in view its order dated the 24th December,

2003. While disposing of the contempt petition, the

Court directed the petitioner association to forward the

individual representations of the employees concerned

to the respect departments and the same shall be

considered and disposed of in the light or the principles

laid down by the Court in its order dated the 24th

December, 2003, as expeditiously as possible, within

a period of eight weeks from the date of submission ofthe applications. The Department of Pension &

Pensioners Welfare has been receiving endorsementsof representations addressed to the respective

Ministries/Departments by PSU absorbees for revisionof their pension in terms of the above referred order of

the High Court.

4. The present policy of the Government and the

order dated the 24th December, 2003, on the question

of the mode of calculation for restoration of one-third

portion of commuted pension of a PSU absorbee are

at variance with one another. In view of this, the

Department of Pension & Pensioners' Welfare has

advised, on 3rd June, 2005, the Office of the Comptroller

& Auditor General of India to urgently file a Special

Leave Petition (SLP) in the Hon'ble Supreme Court of

India in consultation with the Ministry of Law, against

the orders dated the 24th December, 2003 and 12th

April, 2005 and at the same time initiate steps to

obtain stay against the implementation of the orders

of the High Court. The Department of Pension &

Pensioners Welfare has not so far received any

feedback from the Office of the Comptroller & Auditor

General of India.

5. The Department of Pension & Pensioners'

Welfare has been receiving communications from

different Ministries/Departments, requesting for

clarification in the matter. In order to avoid receiving

contempt petitions all Ministries/Departments are

advised to get in touch with the Office of the Comptroller

& Auditor General of India {(Shri R. Srinivasan, Director

(Legal) (Tel.:23239535)} Office of the Comptroller &

Auditor General of India, 10, Bahadur Shah Zafar Marg,

New Delhi-110002) to know the latest position regarding

filing of a SLP in the Hon'ble Supreme Court of India

against the orders of the High Court of Andhra Pradesh

& Operations Division in Department of Posts.

A separate marketing structure for marketing

the traditional items like money orders, postal orders,

postcards and parcels was set up vide Directorate

letter No.25-21/2003-PE-I dated 17th March, 2005. It

was also decided to create a Parcel and Logistics

Division within the Business Development Directorate

under the overall control of Member (O&M). Details of

the existing marketing structure at the Directorate level

are attached at Annexure-I

2. At present the entire focus of the Department

in terms of revenue generation is on the premium

products and post office counter services -mostly

financial. The merger of the Mail Division with the BD

Directorate was intended to provide one unified

command structure for the operation and marketing of

the conventional mail and premium products. However,

mail volumes with us continued to show a decline even

when overall mail volumes in the economy as a whole

were growing at a healthy pace as witnessed by the

growing business of the courier industry and the entry

into our market of international players. While the

market for mail products is definitely on the upswing -

only India Post was not able to hold on to its share

even in the unregistered non-express segment. It is

imperative that we counter and reverse this situation

so as to increase our market share in mail business.

This can be done only through restructuring and

strengthening our Mails Organization to bring it in line

with the present day demands and transform it into a

modern Business Arm of the Department ready to

take on the competition and regain its primacy in this

arena. To achieve this goal, following changes are

warranted:

A. Reorganize the entire mail set up in the

Department as a Mail Business Arm with a clear

mandate to:

- Actively market traditional mail (after studying and

analysing the entire market);

- Take on the couriers in the mails arena with a

pro-active style of functioning by approaching

customers directly, offering value additions and

customized services, total mailing solutions and

even special business packages etc., as may be

required to beat the competition;

- Bring about strategic changes in our

organizational structure as well as HR policies

necessitated by the changes in mail profile in the

market.

- Handle and process the mails in the most efficient

and time effective manner using latest technology

and IT systems.

- Use technology to sort the mails up to beat levels

or even sub beat level in designated and fully

equipped mail processing centres which are

strategically located and connected in a hub and

spoke arrangement with booking and delivery

centres.

- Intensive use of technology for Quality Assurance

and Business Development.

- Manage transportation of mails by the most viable

and economic modes whether rail, road, air or any

other means.

- Take on a delivery role in high business

concentration centres and for high volume

respondents, bypassing the post office.

- Leverage the PIN code structure and data/

knowledge uniquely accessible to the postal

system for commercial purposes and customer

acquisition/retention.

B. Divest to the extent of replacement by the Mail

Business Arm, the Post Offices of their present day

role of collection and delivery of mails. Post offices

would only handle the individual customers in terms

of booking and delivery of mail whereas the organized

and bulk customers would receive end to end service

from Mail Business Centres.

C. Refurbish and revitalize human resources available

in the RMS today to take on the hitherto unfamiliar

roles of marketing, competing, directly handling

customers, devising business proposals, handling

modern equipments and latest IT system, managing

transportation infrastructure and handling delivery

systems. This would necessitate an enormous planned

exercise aimed at a complete 'make over' of the existing

RMS personnel and also involves changes in

recruitment, promotion and placement procedures and

policies.

D. Redesign and remodel the field units for the

proposed Mail Business Arm providing for adequate

power and resources for the Heads of all these Units

in technical, financial and manpower terms.

3. The above proposed changes call for a massive

exercise of reorganization and revamping of mails

system all over the country. This exercise, which has

already been initiated, needs to be sustained over a

sufficient period of time. Tangible results are already

visible in many Circles - much more needs to be done.

MAIL BUSINESS DEVELOPMENT & OPERATIONS

DIVISION

1. In order to guide and initiate these major changes

within the existing system the need for having a very

strong Mail Business Division in the Directorate is

obvious-the present MM&TS Division cannot fulfill the

above role as an adjunct to the BD Directorate. It is,

therefore, decided to restore the Mails Division including

parcels and speed post operations to the main

Directorate and also to strengthen it further and provide

it with all the necessary resources to plan and carry

out the changes outlined above.

2. MM&TS is now designated as the Mail Business

Development & Operations Division. This Division is

expected to produce results in terms of business and

revenue just as BD Directorate, Financial Services

Division or PLI Directorate are currently expected to

do. The structure of this Mail Business Development

& Operations Division is indicated in Annexure-II. In

recognition of its enhanced role and functions, this

Division will now be headed by an HAG Officer

designated as Senior DDG/Chief General Manager.

ROLE OF BUSINESS DEVELOPMENT

DIRECTORATE

1. The BD Directorate shall continue to conceive,

design and introduce in the market all new business

products, push for greater market share of premium

products, particularly express and time sensitive

mails, all e-based services and also take on marketing

for other arms and wings including Financial Services,

PLI, Mail Business Development & Operations

Division etc. Logistics Post shall continue with BD

Directorate since it is organically a multi service

business requiring a high degree customization and

select customer base. B.D. Directorate will further

take on the responsibility for further commercial

exploitation and development of our retail network and

delivery strengths with special emphasis on the rural

market. All tie ups with Banks, Financial Services,

Public & Private organizations involving the use of

India Post's retailing and delivery capabilities will be

handled by B.D. Directorate with the aim of

harnessing synergies and leveraging its I.T. enabled

and other network and counter resources to the

maximum extent. This would be aimed at generating

revenues from the hitherto "loss making" rural postal

network and the urban network besides providing

access to services and amenities to rural India at

par with those in the urban areas.

2. The business Development Directorate's duties,

responsibilities and instructions in the changed

circumstances would be-as given in Annexure-III and IV.

This order will take immediate effect.

l Promotion in LSG, HSG.II and HSG-I-reg.

I am directed to say that it has come to the

notice of the Directorate that in many Circles, officials

in Group C are not getting promoted to LSG mainly

because as per the findings of the Departmental

Promotion Committee (DPC) they do not attain the

required benchmarks in their Annual Confidential Report

(ACR) and thus fail to get empanelled for promotion.

2. As per the amended Recruitment Rules for

Lower Selection Grade (LSG) and Higher Selection

Grade II (HSG II) post offices and RMS offices notified

on 18-05-2006, these posts are to be filled up by

promotion by 'Selection'. In the case of promotion by

'Selection', the officials are required to attain the

benchmarks as prescribed vide Department of

Personnel & Trainings (DoP&T) O.M. No.35034/7/97

Estt. (D) dated 08-02-2002. According to the DoP&T

OM. No.22011/5/91-Estt. (D) dated 27-03-1997, the

benchmark for all Group C, Group B and Group A posts

[upto the excluding the level of Rs. 3700-5000 (pre-

revised) presently JAG] is 'Good'.

3. It has been observed that many a times, the

official could not attain the required benchmarks

because of indifference shown while writing ACRs even

by the senior officers in the Department or are not

written with the required devotion and attention to

details.

4. The DPCs, while assessing the officials for

promotion as 'Fit' or 'Unfit' for LSG and HSG-II, without

diluting DoP&T guidelines, should not be guided merely

by the overall grading given by the Reporting Officer or

by the Reviewing Officer alone but should form an

assessment based on the remarks/performance

recorded in the individual columns in the ACR.

5. To sum up:

(a) The ACRs in respect of all the officials should be

written by the Reporting Officers with proper and

due application of mind.

(b) The Reporting/Reviewing Officers should take into

account the benchmarks for promotion and that

benchmarks are known to the officers while writing

the ACRs.

(c) The DPC while assessing the ACRs for promotion

of officials to various grades should not be merely

guided by the overall grading given by the

Reporting/Reviewing Officers but also satisfy

themselves by an objective assessment of the

ACRs.

(d) While prescribed benchmark should not be

diluted, the DPC should be realistic and objective

in their assessment in order to avoid unnecessary

staff grievances and depriving the due claims of

the staff for promotion.

6. All the concern officials may please be briefed

accordingly.

l Age-limit for dependent children of

Government servants and pensioners for availing

medical facilities under CGHS and Central

Services (MA) Rules, 1944

The undersigned is directed to state that the

age-limit for dependent sons and daughters was earlier

fixed vide Office Memorandum No. B-12014/7/92-

CGHS (P), dated the 31 December, 1993 (Sl. No. 4/

Section 36 of Swamy's Annual, 1994) issued by the

Ministry of Health and Family Welfare, according to

which for sons to be dependent on his father/mother,

he had to be less than 25 years of age or till he started

earning, whichever was earlier. As a result of stay

granted by the Hon'ble High Court of Delhi in Civil

Miscellaneous Petition No.: 115/97 in Civil Writ

Petition, No.:2542 of 1996 in Shri Madan Mohan

Sharma V. Union of India, the Ministry of Health and

Family Welfare issued an Office Memorandum No. 4-

24/96-C&P/CGHS/CGHS (P) on 17th September, 1999

(Sl.No. 127 of Swamy's Annual, 1999) upper age-limit

for sons was removed subject to fulfilling other

conditions regarding dependency and normally staying

with the Government servant/pensioner. The Hon'ble

High Court of Delhi has dismissed the petition by its

order on 29th November, 2006.

2. In view of the dismissal of the Writ Petition, it

has been decided to re-fix the age-limit for dependants,

as indicated below:

(i) Son Till he starts earning or

attains the age of 25 years,

whichever is earlier.

(ii) Daughter Till she starts earning or

gets married, irrespective of

the age-limit, whichever is

earlier.

(iii) son suffering from Irrespective of age-limit.

disability of any kind

(physical or mental).

(iv) Dependent divorced/ Irrespective of age-limit.

separated

widowed daughters

and dependent

3. The other conditions of dependency and normally

Services (Medical Attendance) Rules, 1944.

6. This issues with the concurrence of IFD vide their

Dy. No. 2552/2007, dated the 15th May, 2007.

READERS FORUMMedical Reimbursement Claims - A discussion

Central Government Employees and their familymembers are divided into 2 (two) different categoriesas far as their Medical Reimbursement Claims areconcerned. Some of us are covered by the CentralGovernment Health Scheme (CGHS) facilities, whilethe remaining are governed by the CS (MA) Rules 1944.

In this article, let us talk in detail about themedical facilities prevailing for employees coveredunder CS (MA) Rules 1944, i.e. that section ofemployees (including their family members) who arenot covered under the CGHS benefits.

Authorized Medical Attendant

Any Medical Officer duly appointed by theMinistry of Health, any Department under the CentralGovernemnt, any Head of the Department, CentralGovernment Employees Co-ordination Committee, orany medical officer appointed by the CentralGovernment/State Government, is designated as anAuthorised Medical Attendant (AMA) for the centralgovernment employees and their family members ---Rule-2 of CS (MA) Rules 1944.

Government Hospital

Normally, any Hospital under the directadministrative control of the Central Government orState Government is treated as a Government Hospital.

However, under the scope and extension ofRule-2 (d) of CS (MA) Rules 1944, a GovernmentHospital also includes a hospital maintained by a localauthority or any other hospital with whicharrangements have been made by the Government forthe treatment of Government servants.

In accordance with Rule-2 (c) of CS (MA) Rules1944, the term Government means Union Governmentor the State Government.

For example, we know Christian MedicalCollege (CMC), Vellore, as a Private Hospital. But asper the provision of Rule-2 (d) of CS (MA) Rules 1944,CMC Vellore is a Government Hospital for us. Thereason for the same is that the Government ofTamilnadu, vide its Order Number GO MS No. 400dated 29-08-2000, had already accredited CMCVellore-632004, for the purpose of treatment ofCardiology, Nephrology, Neurology, Oncology &Orthopaedics, for State Government employees andtheir family members. Since the State Governemntawarded the said accredition, the same is inter aliaalso applicable for the Central Government employeesand their family members. Therefore, any CentralGovernment employees (including his/her familymembers) is entitled to get medical reimbursement incase of availing treatment at the above-mentioned

Departments at CMC Vellore. Previously, the CentralGovernment employees, not covered under the CGHSScheme, were only eligible to get medicalreimbursement for treatment under Cardio thoraces &Neuro-Surgery cases only at CMC Vellore. The samewas in accordance to the Government of India, Ministryof Health OM No.: R.31-8/60-H.I dated 30-04-1962 &OM No. 29-34/66-MA dated 03.10.1966. However, boththese orders have presently became non-functional inconsequent upon the accredion accorded by the stategovernment of Tamilnadu on 29.08.2000

Furthermore, in compliance to the Governmentof India, Ministry of Health, OM No.:- S 14025/7/2000/MSdated 28.03.2000, there is presently no need toobtain prior permission of the Chief Medical Officer ofthe state Government for getting medical treatment atthese Departments of CMC.

Competent Authority to accord permission

In accordance with the Ministry of Health,government of India OM No.: -S14025/7/2000-MSdated 28-03-2000, Central Government Employeesand their family members are entitled to undergomedical treatment at the under-mentioned Hospitals:-

(I) Hospitals recognized by the State Government,

(II) Hospitals recognized under CGHS Rules,

(III) Hospitals recognized under CS (MA) Rules,1944 &

(IV) Hospitals fully funded by the CentralGovernment or by the State Government.

Previously, the authority competent to accordpermission in this matter was the---

(a) Head of the Ministry,

(b) Head of the Department,

(c) Chief Postmaster General,

(d) Head of the Office, i.e. SSPOs/SPOs.

Currently, by a clear order of the competentauthority, the said permission can be accorded bythe SSPOs/SPOs in case of Postal Divisionsindependently. Therefore, after issuance of OM Dated28-03-2000, Central Government Employees & theirfamily members are eligible to undergo medicaltreatment anywhere in the Country and the DivisionalSuperintendent can accord the relevant permission.Therefore, there is no need to endorse these kinds ofcases to the Regional Office/Circle Office and thesecases are to be settled at the Divisional level only.However, TA/DA for such outstation medical treatmentcan only be obtained in case such treatment(s) arenot available at the workplace of the employeesconcerned.

As per the Ministry of Health O.M. dated 28-03-2000, the question of availing treatment by theCentral Government employees and their familymembers have been liberalized to a great extent. Quiteunfortunately, some high-handed Divisional authoritiesare harassing the staffs in this regard bymisinterpreting the rule. They are taking the shield ofGovernment of India's Decision number 4 below Rule-6 of CS (MA) Rules, 1944, wherein it was mentionedthat in case of availing outstation treatment & relatedreimbursement thereafter, the concerned official shallhave to obtain the recommendation of the AMA andget it countersigned by the Chief Medical Officer ofthe District if the treatment to be undertaken outside

the District or by the Chief Administrative MedicalOfficer of the State if it is to be undertaken outside theState.

It is therefore requested to all the Comrades totake utmost care while handling MedicalReimbursement Claims of Co-employees, especiallycases related to treatment undergone at CMC, Velloreor at Appollo Hospitals, Chennai, as these two arepresently the most-reputed Multi-Specialities Hospitalsin our naiton.

No interim hike in central Govt staffsalaries, says FM

The 6th Central Pay Commission has no

plans to award an interim hike in salaries of central

government employees, Finance Minister P.

Chidambaram said. The commission has informed

the Govt. it expects to submit its final report within

the stipulated date, which is April 4, 2008, he said

in a written reply to a query in Rajya Sabha. "Hence,

no interim report is contemplated," he said.

PSR BHAVAN, the Guest House constructed

at Kanayakumari by PSR Anjaneyulu Memorial Trust,

has been formally inaugurated on 11th July 2007. It

is dedicated to the memory of Late Com. PSR

Anjaneyulu who led the historic strike in July 1960

as the then Secretary General of NFPTE.

Accommodation in PSR Bhavan shall be open

to serving and retired central government employees

including BSNL staff. All the four rooms are attached

with toilets. Each room can accommodate a small

family. The Bhavan is just one kilometre away from

Kanyakumari Temple and 500 metres from

Kanyakumari Bus Terminus. While you walk from the

Temple junction through Kanyakumari-Kovalam

Highway you find the Central Government Holiday

Home first and then the Bus stand on the right side.

Walking further you find the Gujarati Bhavan and then

a Vivekananda Lodge on the left side. Adjacent to the

Vivekananda Lodge there is a 15 feet wide road to the

left. PSR Bhavan is the second building on the road.

It is an ideal location. You can watch both

sunrise and sunset sitting in PSR Bhavan. Quality

vegetarian food is available in Gujarati Bhavan, just

100 metres away. We are forced to take a nominal

amount for the facilities provided. It shall be Rs. 100

per day for a room. We have no alternative to pay

electricity/water bills etc. We do hope that our

comrades will bear with us.

Formation of Officer's Committee on GDS-Violation of AgreementJCA - Programme of Action

The Department of Post vide its resolution dated

23-07-2007 constituted a 'One Man Committee' underthe Chairmanship of Shri R.S. Natraja Nurti, retired

Member of Postal Services Board. The copy of thesame is enclosed.

We are surprised to know that the Committee

had started its functioning on 24-07-2007 itself beforewe knew the constitution of the committee. The fact

about formation of 'Officers Committee' has been ujstappraised to the GDS Union orally. This is quite

shocking and surprising since the departmentimplemented its game of divide & rule.

This formation of Officers Committee to deal the

GDS issues is nothing but a blatant violation anddeviation of agreement and assurances made during

the talks on 19-04-2007. In case of rejection of to referthe GDS issues to the Sixth Pay Commission by the

Ministry of Finance, the department would haveconvened another meeting with the Staff Side and

appraised the situation as assured in the discussionsprior to the strike proposed to be held from 24-04-2007

or at least the original demand of the JCA to formJudicial Committee should have been considered afresh

with open mind.

By reglecting the Federations (both NFPE/

FNPO) and just informing the GDS Union orally andformed the one-man committee headed by a retired

officer is causing a serious concern. The Departmenthas properly utilised the 'Wide Gap prevailing on

recognition issue among us and exposed the weaknessproperly. The department desires to exploit the situation

and deviate the agreement. It was not even ready todiscuss the staff side, but implemented its own earlier

decision.

All the stern struggles launched over one yearbecome futile if we allow the present situation. On 26-

04-07, I requested Com. S.S. Mahadevaiah, GeneralSecretary, GDS Union to meet Com. C.C. Pillai in

person and discuss the issue with open mind.Accordingly we met at his office. Com. C.C. Pillai,

Secretary General, NFPE contacted to Com. D.Theyagarajan, Secretary General, FNPO immediately

in our presence for a United Programme against theformation of Officer's Committee. He also consented

immediately. All-out efforts are taken for a unitedmovement.

There is a demarcation either unknowingly or

wantonly made between the regular and GDSemployees after the recognition issue. We have to

accept the reality and take responsibility. At leastnow we have to sort it out. Wehave to unite by

shendding all our differences if need be with somesacrifices too. Otherwise, the Govt. will implement

its own agenda and we shall remain as silentspectators and allow the exploited class of GDS for

further exploitation.

We should not allow any further exploitation

and put to an end. Please adhere the followingprogrammes sincerely and seriously with all affiliates

of NFPE/FNPO.

No.6-1/2006-PE.II--The question of examiningthe conditions of service and emoluments and otherfacilities available to the Gramin Dak Sevaks has beenunder the consideration of the Government of India forsome time. The Government has now decided to setup a one-man committee for the purpose.

2. Shri R.S. Nataraja Murti, Retired Member ofthe Postal Services Board will constitute theCommittee.

3. The Committee will go into the service conditionsof Gramin Dak Sevaks and suggest changes asconsidered necessary. The terms of reference of thecomittee will, inter alia, include the following:-

(a) To examin the system of extra departmental

poost offices, conditions of employment, wage

structure of the Gramin Dak SEvaks and recommendsuitable changes considered necessary.

(b) To examine the reasonableness of introducing

(c) To examine and suggest any change in the

method of recruitment, minimum qualifications forappointment as Gramin Dak Sevaks and conduct &

disciplinary rules.

(d) To review the facilities provided to the public at

different classes of extra departmental post offices.

(e) To examine desirability and need to sanctionany interim relief till the time of recommendations of

the Committee are made and accepted by theGovernment.

4. The committee will function for a period of one

year, extendable at the discretion of the Government.

5. The Chairman of the Committee will be assisted

by Shri A.K. Sharma, a Senior Administrative GradeOfficer of the Department who will act as Secretary to

the GDS Committee. Adequate staff support will beprovided to the committee by the Department of Post.

The committee will keep the 6th Central PayCommission informed of the progress of its work fromtime to time.

6. The Committee will devise its own procedureand may call for such information and take such

evidence, as considered necessary.

7. The headquarters of the Committee will be at NewDelhi.

A meeting with Smt. Kalpana Tewari, DDG(PG

& QA) was held at Directorate to discuss about thecitizen's charter for Department of Posts at 3:00p.m.

on 26-07-07. On behalf of NFPE, Com. K.V. Sridharan,General Secretary, P-III, Com. Giriraj Singh General

Secretary, R-III; Com. Iswar Dabas, Offg. GeneralSecretary, P-IV attended the meeting. We putforth ourviews that unless the problem of shortage of staff is

mitigated, the implementation of the citizen chartercould be only in paper. We further stressed to reconsider

EarlierCom.M.S.Raja, Secy., Confederation had moved aresolution for the consideration of the house condemningthe Indo-US nuclear agreement. The declaration withamendment and additions and the resolution moved byCom.M.S.Raja were approved by the house unanimously.Copy of the declaration and the resolution are enclosed.

The house decided to call upon all participatingFederations to organize joint campaign and mobilizationfortnight between 10 th Sept., 07 to 25th Sept., 2007 byholding joint convention/meetings etc and serve the strikenotice on 19th September, 2007 on all heads of offices/Department after a massive demonstration eliciting theparticipation of all employees.

National Executive MeetingThe National Executive of the Confederation along

with the Secretaries of the COC met today. Whileendorsing the decision of the Convention, the housediscussed the various steps to be taken to make thestrike slated for 30th October a grand success. It wasdecided that the COCs will be given the list of all affiliates;the CHQ will give them the list of organizations whichhave served the strike notice on 19th; the copy of the

circular of the affiliates will be made available to all theCOCs; the Secretaries of the State COCs or the COCs ofthe State capital to chalk out campaign programmes inthe respective states to cover all employees working inmoffusil stations; leaflets and posters would be printedand circulated by all the COCs on the basis of a centrallyissued format; steps would be taken to get in touch withDefence and Railway organizations for eliciting solidarityand support action wherever possible; the need for interimrelief and the ramification that might emerge from its denialwould be explained to the employees in detail; theextreme danger that emanates from the decision tointroduce the new contributory pension scheme wouldbe explained as also the necessity to set up judicialcommittee for GDS; etc.

The Confederation CHQ in consultation with theAISGEF shall chalk out campaign programme and shallcommunicate the same to all affiliates/COCs. Theaffiliates and COCs will take necessary steps to organizethe joint convention on the dates specified by the CHQ.On the conclusion of the campaign fortnight, the COCswill chalk out tour programme for mobilization to allmoffusil station in the respective States.

Declaration adopted at the National Conventionof Central, State Government, State PSUs employeesand Teachers to be held at MPCU Shah Auditorium,Delhi On 13th August, 2007

This National Convention of Central, StateGovernment employees, teachers and State Public SectorUndertakings being held today, the 13th August, 2007 atDelhi while taking into account various burning issuesconfronting them adopts the following declaration:

2. At this moment the most dangerous issue that isconfronting the employees in the government sector isthe conspiracy to foist the IMF-World Bank dictated NewPension Scheme on them and denial of Interim Relief tothe Central Government Employees pending finalrecommendation of the 6 th CPC as had been the practiceon all earlier occasions.

The Central Govt. employees, the StateGovernment employees teachers and the workers inthe Central and State Public Sector Undertakingsparticularly, and the working class in general, had beenthe victims of severe economic offensive of thesuccessive Governments that came into existence inthe country ever since the new economic policies wereushered in 1991. While the Government of India hadbeen modulating these policies on the advice anddirection of the triumvirate viz. IMF/World Bank and WTO,the State Governments had been curtly directed toadhere to these policies. Some of the StateGovernments followed it willingly; whereas others under

various pressures exerted on them.

Systematic downsizing and closure of Governmentdepartments and PSUs;; drastically amending the labourlaws to facilitate the new entrepreneurs to indulge in hireand fire, lowering interest rate of GPF and other smallsavings like EPF, Postal Savings Schemes etc.; curtailingthe social security benefits available for the Governmentemployees; allowing the foreign and domestic monopolycapital to loot and plunder the indigenous resources; etc.had been the hall marks of these policies over the years.Acting upon the Expenditure Reforms Committee'srecommendations, the Governments both at the centreand the States could close down many Governmentalundertaking throwing thousands of workers surplus andredundant.

The Sponsoring Committee of Central TradeUnions and the National Platform of Mass organizationswere spearheading the resistance against these illadvised economic policies. The Confederation of CentralGovernment Employees and workers and the All IndiaState Government employees Federation and most ofthe Federations of the Government employees, teachersand PSU workers were working closely with theSponsoring Committee of Trade Unions and the NPMOand had been the participants in all the Strike actionsorganized against these economic policies.

In view of the continuing and unabated offensiveunleashed by the Government of India and various StateGovernments and especially in the background of (i) doingaway with the existing statutory defined benefit pensionscheme;(ii) the denial of interim relief despite the settingup of the Pay Commission,(iii) the continuedcontractorization of regular employment in theGovernmental Sector, (iv) reduction of interest rates ofthe Provident Fund accumulations despite the risingmarket rates of interest,(v) the refusal to fill up the existingvacancies in various departments of the Governmentsdespite the increasing unemployment;(vi) the refusal ofmany State Government to merge the DA with basic pay(vii)the spiraling inflation, the Central and StateGovernment employees, teachers and workers of someof the State owned PSUs have jointly decided to mobilizethe employees and workers for a decisive action and tohold a convention to discuss and deliberate upon theissues confronting them.

To bring about the so called pension reforms and

make available the pension funds for stock market

operations had been one of the significant directives of

the World Bank. In December, 2003, the then NDA Govt.

notified the new contributory pension scheme to replace

the existing statutory defined benefit scheme of pension

for Central Govt. employees who join service on or after

1.1. 2004. Almost all State Governments adopted the new

scheme enunciated by the Govt. of India. In order to give

statutory effect to the said notification of the NDA Govt, the

UPA Govt. brought about an ordinance in December,

2004, which was later replaced by the PFRDA Bill.However, the Bill could not be made into an Act, due tothe principled objection of Members of Parliamentbelonging to the Left Parties. The Conference of the ChiefMinisters and State Finance Ministers convened by thePrime Minister on 22 January, 2007 also met with stiffresistance to the contemplated pension reforms.However, this did not deter the Finance Minister of theUPA Govt. to go ahead with the Pension reform processin a most undemocratic manner. The new PensionScheme was rejected by the West Bengal, Kerala andTripura Left Front Finance Ministers. On the strength ofthe support rendered by the other State Governments,the UPA Govt. has now appointed the Fund Managersand has also decided to make available 5% of theaccumulated contributions from the employees recruitedon or after 1.1.2004 to the Stock market for which there isno legal sanction.

The very concept of a defined adequate pension (being a deferred pay) capable of providing socio-economic justice to the employees at their old age, asproclaimed by the Supreme Court of the country, nowstands dismantled as Pension under the newdispensation would be a fluctuating or vanishingphenomenon, dependent upon the vagaries of the Stockmarket. The terms of reference of the study group set upby the 6th Pay Commission to go into the pensionstructure amply indicates a possible migration of theexisting employees to the new contributory pensionregime.

Moreover, overzealous with the motive of aidingprofit generation of the International and Domestic financecapital, the Central Government has allowed the PSUsto invest upto 30% of their surplus cash in equity of mutualfund resulting the flow of about Rs. 70,000 Crores to theshare market

It was in the face of the Supreme Court decision in

August, 2003 denying the right to strike to the workingclass and especially to the Government employees the

All India State Government employees Federation andthe Confederation of Central Govt. employees jointly took

the decision to organize a one day strike on 11 th Feb.2004, which was shifted to 24th Feb. 2004 at the instance

and insistence of the Central Trade Unions to make it amuch bigger trade union action against the atrocious

judgment. What was the most disturbing aspect of theapex court decision was the iniquitous and democratically

unsustainable position taken against the internationallyrecognized basic right to strike for the workers. It was

absolutely in contrast with the International LabourOrganization's conventions on "Freedom of Associations

and Protection of the right to organize ( No.87) and theapplication of the principles of the right to organize and

bargain collectively (No. 98) neither of which India hasunfortunately ratified. To bolster the demand for making

the right to strike an invaluable and legal right through an

Act of Parliament under the provision of Article 309, ( whichthe Parliament and the State Legislatures were ordainedto do so) a memorandum signed by the 40 Million peoplewas submitted to the Speaker Lok Sabha by a delegationof the Central and State Employees organizations. Inresponse to several queries that were raised in theParliament later, the UPA Govt. took the condemnableposition that the right to strike is uncalled for as the Govt.employees are highly protected and have ample scopefor effective bargaining.

In a bid to intensify the downsizing and privatizationand outsourcing of Governmental functions, the UPA Govt.Continued with the Policy of ban on recruitment andabolition of posts imposed by the NDA Govt. in 2001. InNovember, 2006, they have further introduced a total banon recruitment to be operative for the next three years.The Central Govt. health scheme is on the anvil of beingreplaced with the Medical Insurance scheme for the benefitof the multinational corporations. All catering, watch andward, scavenging related jobs have been contractorisedin almost all the Departments of the Central and StateGovernments. The faculty members of the EducationalInstitutions are now contract workers. Even the sovereignfunctions of the Govt. viz. Tax collection, mint and printingcurrency notes are either privatized or outsourced.

Many State Governments who follow the Centralpattern of DA have not merged 50% of DA, though such adecision was taken by the Government of Indian as earlyas in April, 2004. Some of the State Governments are yetto make payment of various instalments of the Dearnessallowance to their employees.

In departure to the conventions and principles,the UPA Govt. did not sanction the Interim Relief inOctober, 2006, when the notification was issued settingup the 6 th CPC, but referred the same for theconsideration of the Commission itself of the need anddesirability of Interim Relief. The 6th Pay Commissiondeclined to submit any report on the grant of Interim Relief.It is, therefore, incumbent upon the Government of Indiato immediately announce the grant of interim relief to allCentral Govt. employees at the rate of 15% of Pay + DPsubject to a minimum of Rs.1000 with effect from1.1.2006, a demand the Central Government employeesraised.

The other issues included in the charter ofdemands appended to this declaration viz. setting up ofJudicial committee for GDS; removing the 5% cap oncompassionate appointments; regularization ofcontingent, daily rated, casual workers; implementationof Board of Arbitration awards; raising the ceiling onbonus; hiking the interest rates on provident fundaccumulation on par with the prevailing market rates etc.had been the subject matters of discussions with theGovernment for the past 3-4 years without reachingsettlement.

This National Convention, therefore, demands theCentral and State Governments to withdraw the New

Contributory Pension scheme, halt downsizing operationsand other anti-employee and anti people moves andinitiate actions to settle the demands included in thecharter of demands.

Charter of demands1. Scrap the PFRDA Bill and Cancel appointment

of the Pension fund Managers; Introduce statutorypension scheme for the new recruits;

2. Grant full Trade Union rights including the rightto strike to all Government employees throughappropriate legislation;

3. (a) Stop downsizing the Government departments,privatization and contractorization/ casualisationof Governmental and teaching functions. Stopcontractual appointments of teachers andworkers, regularize all daily rated, casual andcontingent employees

(b) Lift the Ban on recruitment and fill up theexisting vacancies of all Governmentdepartments, educational institutions and Stateundertakings; Provide job to jobless

4. Grant Interim relief of minimum of Rs.1000/-/ to allCentral Government employees. Implement the6 th CPC recommendation with effect from1.1.2006.

5. Bring down the abnormally rising prices ofessential commodities and strengthensubsidized public distribution system.

6. Merge of 50% DA with basic pay with allconsequential benefits and release of all DAinstatements to the State Govt. employees.

7. Withdraw the 5% cap and other restrictions oncompassionate appointment. Restore thecompassionate appointment scheme whereverit stands abolished.

8. Stop the proposal to replace the CGHS by Medicareinsurance scheme.

9. Implement all pending awards of the Board ofArbitration.

10. Remove the quantum ceiling on Bonus and grantbonus to all.

11. Set up a Judicial Committee for wage revision ofGrameen Dak Sewaks in replacement of NatarajaMurthy Committee.

12. Increase GPF& Small Savings' interest rates andrestore to its early level.

This National Convention urges upon all organizationsof the Central and State Government employees and theteachers to unite and mobilize the employees for asustained struggle and organize a countrywide nationalstrike on 30th October 2007 in order to realize thedemands.

This Convention calls upon the Central and StateGovernment employees and the teachers to jointlyorganize campaign fortnight between 10th and 25th of

September, 2007 by holding joint conventions, meetingsetc. It also appeals all organizations to observe 19thSeptember, 2007 as Strike Notice Serving Day by holdingmassive demonstrations and meetings in front of alloffices and serve strike notice.

This National Convention strongly urges upon theCentral and State Governments to Scrap the NewContributory Pension Scheme and settle the Charter ofDemands immediately failing which the Central and StateGovernment employees, teachers and others will beconstrained to resort to more vigorous agitationsincluding indefinite strike action.

R E S O L U T I O N

1. This National Convention of Central & StateGovernment employees, teachers and State PublicSector undertakings held at MPCU Auditorium, Delhion 13 th August, 2007 resolves to urge theGovernment to take into consideration the seriousconcern expressed by various political parties,Senior Scientists, intellectuals and others of thecountry in respect of the Indo-US bilateral NuclearCo-operation Agreement.

2. This bilateral agreement known as "123 agreement"cannot be seen outside the context of the Hyde Actwhich is the "National Law" of USA passed by USSenate in December, 2006. The "123 Agreement"binds India in perpetuity whereas legitimizes the USabiding by its "National Laws"

3. The areas of concern expressed from variouscorners include threat on security of India, deviationin the foreign policy, continuation of sanction on dualuse of technologies and materials, failure to fulfillthe assurance given to the Parliament by the PrimeMinister on 17th August, 2006.

4. Many scientists have cautioned the government thatthe "123 agreement" may slow down India's attemptto build a self reliant nuclear power programmepowered by thorium.

5. Hence this Convention appeals to the governmentto go with the "Sense of Parliament" and review theagreement in the Parliament on Indo-US BilateralNuclear Co-operation in the interest of thesovereignty of the country.

The Postal JCA comprising of NFPE and FNPO hasdecided to intensify the agitation in pursuance ofthe demand for setting up Judicial committee forGDS and has called upon the members to organizethe relay hunger strike in front of all Divisional,Regional, Circle and Directorate offices from 19thSeptember, 2007 to 21st September, 2007. All COCsare requested to get in touch with the Postal JCA intheir state and give solidarity and support to theprogramme of action.

The Federal Secretariat Meetings of NFPE washeld on 14th August, 2007 at 5 P.M. All General Secretariesand Office Bearers available in Delhi Were attended.

The following agenda was discussed in anelaborate manner:

1. Organizational issues

2. Writ petition filed by E.D. Unions against NFPE.

3. April, 07 Strike demands-review.

4. Future Course of Action and Campaign Programme.

5. Central/State Govt. Employees Strike on 30th Oct.2007 Charter of demands

6. Financial position of NFPE

Secretary General reporter elaborately on allissues notified in the agenda. The Recognition ofFederation is held up due to writ petition filed by E.D.Union in Jodhpur High Court. DOP&T, Dept. of Posts andNFPE are respondents. We have engaged a seniorAdvocate from Delhi and one another local advocate fromJodhpur and filed our reply. DOP&T and Dept. of Postsalso filed their reply. The writs was posted for hearing on22nd June, 25th June, 19th July, 2nd August, and 9thAugust, 2007. The next date has not been decided. Noarguments have been taken place. In all these abovedates an advocates and Offg. S.G. appeared before theCourt. A very heavy expenditure is being incurred asadvocate fees and others traveling expenditure.

The entire balance has been exhausted. AS ontoday the balance is Nil. We find it extremely difficult tofurther meet the expenditure. Filing case against NFPEwas totally unwarranted as entire negotiating forum hasdismantled. Non functioning of negotiating forum will notin any manner affect the ED Union and GDS staff. It onlyaffected regular employees of theDepartment of Posts.The Federal Secretariat has unanimously remit to theFederation at the earliest so as to meet the expenditureon Court Case and future organizational activities.

2. The Federal Secretariat has discussed theorganizational issues and decided unanimously to holdthe Federal Council session during first/second week ofOctober, 2007. Those Unions recognized underCCS(RSA) Rules 1993 which are affiliated with theNational Federation of Postal Employees are eligible todepute their Federal Councilors, as per guid lines issuedby the DOP&T and Deaprtment of Posts in this matter, tothe Federal Council. The Federal Secretariat hasunanimously decided to authorize Com. R.N. ParasharSecretary NFPE as Offg. Secretary General w.e.f.

01-09-2007 vice Com. Des Raj Sharma who is retiringon 31st August, 2007.

3. Com. Des Raj Sharma is authorized to continueto look after the Writ Petition filed by E.D. Union RajasthanCircle against NFPE.

4. The Charter of demands of April, 2007 strike has notbeen implemented. The demand for setting up of JudicialCommission as before has been rejected and Shri NatarajaMurti, retired Member (Post) has been appointed as ChairmanED Committee. The Postal JCA has strongly protested againstit and observed protest demonstration and Dharna throughout the country on 3rd and 8th August, 2007 respectively. Itwas also decided to convene JCA very soon for further Courseof action. In consultation with FNPO Secretary General thefollowing programme of action has been decided againstunilateral appointment of ED Committee.

Relay Hunger strike will be organized before AllDivisional Heads/Regional PMGs/CPMGS and PostalDirectorate from 19th September to 21st September, 07. Ithas also been decided to organize strike in Department ofPosts on 30th October, 2007. The demandfor setting up ofJudicial Commission for GDS instead of Nataraja MurtiCommittee would be placed as number one demand inthe Charter of demands. All Circle/Divisional Unions haveto organize these programmes and make it a big success.

Nation wide strike on 30th October, 2007 has beendecided in the Joint National Convention of Central/StateGovt. Employees/School Teachers, College and UniversityTeachers, Central PSUs and Defence employees held inNew Delhi on 30th August. Efforts are on to mobilizeRailways Workers also in the strike for implementationof 12 point Charter of Demands.

FNPO Secretary General Shri D. Theagarajan hasalready consented to join the nationwide strike on 30thOctober, 2007 and he has consented to join the strike.

The NFPE/JCA will organize nationwide campaignfor successful conduct of our above programmesincluding one day strike.

of October, 2007

2. Hunger strike from 19th Sep. 07 to 21 Sep.07 beforeOffice of Divisional office/PMG/CPMG/DG Posts,demanding implementation of April 07 Strike Charter.

3. One day nationwide strike on 30th October, 2007.

4. Collect Rupees 10/- (Rs.Ten) from all members andremit to NFPE immediately.

R.S.Nataraja Murthy, Ex-Member of the Postal Directorate to examine theservice condition and demands of the GDS. TheCommittee will submit its report within one year. TheCommittee invited suggestions from all the Unionsbefore 31.8.2007. NFPE recorded its protest againstthe formation of the Committee violative the assurancesmade on 19.4.2007.JCA Call: The Postal JCA of NFPE and FNPO hasdecided to organize three days relay hunger fast from19.09.2007 to 21.07.2007 in front of Divisional /Regional / Circle / Directorate headquarters demandingto dissolve the Nataraja Murthy Committee and formJudicial Committee to consider the GDS issues.One Day Token Strike on 30.10.07: The NationalConvention of Central and State Governmentemployees and teachers' Organizations has calledupon their affiliates for one-day token strike on30.10.2007.
