WHAT IS FLEET DRIVER TRAINING? Fleet driver training is an integral component of a fleet management programme. Thegoal is to eliminate or reduce risks encountered by company drivers whilst at the sametime, lowering fleet costs by reducing accidents, fuel costs and insurance premiums.

Fleet driver training is recognised by the HSE as a due diligence check (in the form of riskassessment/management) on the part of a company and its officers ensuring that legalobligations are met. Cost savings in various areas from reduced fuel consumption andmaintenance costs to lower insurance costs as a result of reduced insurance claims. Inmany cases this has resulted in better productivity from staff as companies are in abetter financial position to pay bonuses.

LEGAL OBLIGATIONSDrivers, Managers, Directors and Business Owners all have legal obligations in relationto the management of occupational road risk. The Health and Safety executive summarise the legal responsibilities as follows:- Legalresponsibilities of employers Health and safety law states that organisations must:Provide a written health and safety policy (if they employ five or more people); Assess risks to employees, customers, partners and any other people who could beaffected by their activities; Arrange for the effective planning, organisation, control,monitoring and review of preventive and protective measures; Ensure they have accessto competent health and safety advice; Consult employees about their risks at work and current preventive and protectivemeasures.

The maximum penalty is an unlimited fine and the court can additionally make apublicity order requiring the organisation to publish details of its conviction(s) andfine(s).

Legal liability of individual board members for health and safety failures if a health andsafety offence is committed with the consent or connivance of, or is attributable to anyneglect on the part of, any director, manager, secretary or other similar officer of theorganisation, then that person (as well as the organisation) can be prosecuted undersection 37 of the Health and Safety at Work Act 1974.

Recent case law has confirmed that directors cannot avoid a charge of neglect undersection 37 by arranging their organisation’s business so as to leave them ignorant ofcircumstances which would trigger their obligation to address health and safetybreaches.

Failure to comply with these requirements can have serious consequences– for both organisations and individuals. Sanctions include fines, imprisonment anddisqualification.

Under the Corporate Manslaughter and Corporate Homicide Act 2007, an offence will becommitted where failings by an organisation’s senior management are a substantialelement in any gross breach of the duty of care owed to the organisation’s employees ormembers of the public, which results in death.

Those found guilty are liable for fines and, in some cases, imprisonment. In addition, the Company Directors Disqualification Act 1986, section 2(1), empowers the court todisqualify an individual convicted of an offence in connection with the management of acompany. This includes health and safety offences. This power is exercised at thediscretion of the court; it requires no additional investigation or evidence.

Individual directors are also potentially liable for other related offences, such as thecommon law offence of gross negligence manslaughter. Under the common law, grossnegligence manslaughter is proved when individual officers of a company (directors orbusiness owners) by their own grossly negligent behaviour cause death. This offence ispunishable by a maximum of life imprisonment.

Legislation that can be relevant to anyone driving in connection with work includes:-

Road Traffic Acts supported by the Highway Code

The Highway Code applies to all road users and includes information on signs andmarkings, road users, the law and driving penalties.

It is an offence for an organisation to set driver schedules which may cause them tobreak speed limits and / or have payment reward schemes which in any wayincentivise them to do so. EC Drivers’ Hours Rules UK Domestic Drivers’ Hours RulesTachograph Regulations Corporate Manslaughter and Corporate Homicide Act 2007.The Act introduces an important new option for certain very serious seniormanagement failures which result in fatality. Prosecutions will be of the corporatebody, not individuals, but the ability to prosecute directors or other individuals underhealth and safety law or the general criminal law, in appropriate cases, will beunaffected. The corporate body itself and individuals can also still be prosecuted forseparate health and safety offences.

The Workplace (Health, Safety and Welfare) Regulations 1992

These Regulations cover a wide range of basic health, safety and welfare issuesincluding traffic routes for vehicles within the workplace.

Management of Health and Safety at Work Regulations 1999

Employers are required to carry out risk assessments, make arrangements toimplement necessary measures, appoint competent people and arrange forappropriate information and training.

Health and Safety at Work Act 1974

Employers have a ‘duty of care’ for the safety of employees at work, regardless of thetype or size of the business. There is also a duty of care to others who may be affectedby their business activities, which, in the case of driving, means all other road users.

It is an offence under the Road Traffic Act (1988) for an employer to allow an employee to drive a car ormotor vehicle without the correct driving Licence. Driving licence checks should be carried out at least once a year, but since penalty points canaccumulate rapidly, it may be advisable to do it more frequently. Some organisations apply a scale sothat, for example, those drivers who are three points away from losing their licence have frequentchecks while those with no or few points have their checks annually.

BUSINESS DRIVER TRAINING (CLASSROOM)

To complement our on-road driver training coaching, we also offer an engaging one-to-one or groupapproach to company driver training (at the clients discretion). As part of our flexible approach to FleetTraining we can organise classroom sessions for our clients. A CTJ Fleet Driver Trainer can run aninteractive session for a maximum of 10 candidates. Larger groups can be arranged if required whichwould involve addition trainers. The sessions are not lectures but rather are managed focus groupsthat are fully interactive with active participation required by the candidates and maintains interestand motivation. Experience has shown that candidates may feel under less pressure as part of a groupand this may enhance the learning process. Equally, facilitated discussions with peers can lead to achange of attitude towards driving and road safety. This is an effective and engaging approach toprofessional driver training.

PRACTICAL IN-CAR TRAININGOur practical corporate driver training sessions are delivered by fully qualified CTJ FleetDriver Trainers who have all signed both the DVSA and CTJ Driver Training Fleet Code(s)of Conduct and are regularly checked and closely monitored by our in-house qualityassurance team.

Suitable routes can be planned in advance if necessary, to ensure all appropriate road and trafficenvironments are incorporated.

Upon meeting the candidate, the Fleet Driver Trainer will check the driving licence or a passportpurely for identification purposes. A full licence checking procedure is also available as part of theservice offered.

The Fleet Driver Trainer will ensure that the candidate’s eyesight meets the minimum legalstandard.

The Fleet Driver Trainer will ensure the candidate conducts full vehicle checks if required by theclient or alternatively can ‘spot check’ one or more areas.

A short driving assessment is usually carried out to allow the candidate to relax and demonstratetheir normal style of driving. The purpose is to identify driving behaviour that puts the candidateat risk of being involved in an accident or breaching traffic law and subsequently collecting pointson their licence.

HERE’S HOW A TYPICAL IN-CAR TRAINING SESSION IS CONDUCTED All sessions are structured in line with DVSA guidelines. The CTJ Fleet Driver Trainer will deliver eithera session that the client has specifically requested, or a session designed to meet each driver’s needs.These sessions are designed for individual candidates. Written reports are provided following everysession.

Using expert coaching techniques, the Fleet Driver Trainer will then work on enhancing the currentskills of the driver checking that the appropriate knowledge and understanding is in place. Ifnecessary, practical demonstrations will be offered to the candidates focusing on:
