13 branches are the composition of our Region along with 21 study circles. Whether it is a branch with membership of about 100 or those with membership exceeding 1000 the elected office bearers of all the branches are putting in ‘rock breaking’ effort to serve the members and students. The time and treasure spent by all the elected representatives of the branches is highly appreciable. They deserve our praise, compliments and above all they deserve our co-operation and guidance while they are discharging their duties. The generation next is in possession of a multitude of modern thoughts and ideas while the seniors are a storehouse of experience and when both meet “excellence” is the result. Let us work together to reach the horizon of excellence.

This month EIRC has scheduled a lot of programmes (please refer to Page 4 of this newsletter) which should benefit the members. EIRC will continue to put in its earnest endeavour to equip its fellow brethren to carry out the assigned responsibilities without any hindrance and to facilitate continuous professional education and interactive programmes to share and benefit from diverse experiences and vision of our learned speakers. Your ideas on continuing with this goal will be really appreciated. This year our country would be celebrating its glorious 71st Independence Day. We at EIRC have also proposed to celebrate the pious day in a grand manner by participation from its members, students and employees. Please refer the details and volunteer for the same. Also we have planned a Memorial Lecture in the memory of our Past President of this Region, CA PM Narielvala on the occasion.

Ethics & Professionalism

With the changing times, come the newer ethical dilemmas for the profession. Professionalism is not by qualification but it is an ability to demonstrate ethical choices, values and practices in decision-making and to commit to the practice of personal and professional values. Let us vouch and guarantee not to fall prey to misleading practice and tarnish the image of our Institute. We are here to grow ourselves and help others to prosper along-with us. Let us, as CAs ensure that we carry high the torch of transparency and ethics and continue to inspire future generations through our actions and deeds.

In the words of “William Ganeth”,

Dear professional colleagues,

The CA profession has travelled 68 years and as we celebrated our foundation Day on 1st July, I am sure we all have re-dedicated ourselves to the cause of the society. CA’s by their very nature are concerned about their duties and have always gone way out to serve the various stakeholders. I am proud to be a CA and proud of all my members. We had witnessed the CA Day celebration all around the country and never in the history of ICAI such a large-scale brand building exercise was taken. My

compliments to our President and to all the council members for this herculean task. If one is true to ones duties and responsibilities, it does not matter what some people have commented out of improper information and rather such comments should not be deterrent to our professional brethren to move forward.

I feel immense pleasure in communicating with all my respected, esteemed members in this column at least once in a month. It is difficult to reach out to all members of this region in person and give a patient hearing to understand the problems, demands and expectations of each of us and take necessary steps in addressing them. Through this column, at least I am able to give you certain insights about EIRC and its activities. I am however available over mails ([email protected]), mobile (94340-39003). In case you have any issues in which we can discuss, you are welcome to visit.

We Chartered Accountants are always keen to learning and I feel that our earning is just an accretion to our learning process. We are more focused towards keeping ourselves abreast with the latest developments. We professionals should swear by the three ‘P’s i.e., Patience, Practice and Persistence which I believe if possessed by all, no one can deter one to achieve and excel professionally. The world has changed so dramatically over the past decades that we cannot be in the same way as were or how were taught to be. Change can be exhilarating, exciting and on the other hand can be demoralizing and terrifying. However, the learning that comes from change is always beneficial in multifarious ways, difficult to describe. Together we hope that we put our minds in bringing about a change, which results in achieving new milestones for our Region and our country at large.

Our beloved Institute has set out its Vision for 2030, Mission, Strategic Priorities and Action Plan, which aims at harnessing the opportunities and addressing the challenges, so that by year 2030, ICAI becomes the leader in the world of Accountancy profession. We at Region offer our heartiest support to make this dream true and practical.

EICASA

Dear Students,Since my assuming the chair as the Vice Chairperson, I have always tried and endeavoured hard to make you all understand as Shraga Silverstein felt – “If we spent less time trying to make this world a better place to live in, and more time trying to make ourselves better persons to live with, the world would be a better place to live in.” I am of the strong belief that nothing can change you, nobody can help you prospering if YOU do not strive to. We spent time delegating responsibilities, blaming and criticizing others. And this way time gets leaked out ; time – the most precious of all. By the grace of nature, we

get the leisure called sleep. Even then, we dare to, we afford to let our time be stolen away doing and saying nonsense. This I am telling for Chartered Accountancy – as a course and profession , demands optimally effective use of time. If we can do keep in mind and do what this particular profession entrusts us with, this world will sure be a better place to live in. if the students, who have cleared their terms in the just-published results, reflect upon, may well find my observations as truly correct. I suggest them to go the keenest to examine and re-examine blocks on their way to non-getting through. August has been a month of great remembrance for the Indians since the much-awaited Independence of Nation was snatched from the British. This is at the cost of bloodshed and tears and fights of many. I put in record my heartfelt reverence for all the freedom fighters – for those who found their places in the history and the numberless unnamed soldiers. I, being the first woman chairperson of EICASA, also salute the masters of freedom who had always advocated and propagated the need for make women freed from the chains of chauvinism. I wish that all my students would pursue the course not as a mere professional, but also spare

no stone unturned to contribute to the all-round development of our parents’ land by serving the professional in a divine manner.

Still the rejoicing of National Conference is reverberating amongst of all us. In the Conference we had actually celebrated the spirit of youth with participation of 1200 students from the fraternity. I take this opportunity to convey all my thankfulness to all the members of EICASA and all the employees and officers from the Institute , who had turned every stone to place this event originally successful.

August 2017 is also a no less memorable month in terms of organising events by EICASA since we are organising EICASA AGM &ELECTION , a number of Crash Courses for IPCC Students and seminars and an Industrial Visit in the wrapping-up week of the month. Dotted in events, August 2017 would be a month of activities serving the technical purpose of the students.

We have also received the dates of IPCC / FINAL Mock Test from the Head Office. Keep watching the site since you may find the details reached you before you get this issue of the newsletter. It would be commencing from 18th August,2017 to 14th September 2017. Applaudable initiative from the Institute that the Mock Tests are being conducted under the umbrella of a uniform structure in the length and breadth of the country. Do not let this opportunity go for, it helps the superlative to get acquainted with the in-depth analysis beforehand. Also requesting everybody to attend the Orientation Session to be followed by the Mock Test.

Echoing the introduction today, I would request again that time is long, if you use, and time is storm if you misuse. So, do not be ravished away by time, be the master of time, success will be yours.

1. [Notification No. 57 /2017, F.No.370142/10/2017-TPL] In exercise of the powers conferred by clause (iii) of the proviso to section 269ST of the

Income-tax Act, 1961 (43 of 1961), the Central Government hereby specifies that the provision of section 269ST shall not apply to the following, namely:- (a) receipt by a business correspondent on behalf of a banking company or co-

operative bank, in accordance with the guidelines issued by the Reserve Bank of India;

(b) receipt by a white label automated teller machine operator from retail outlet sources on behalf of a banking company or co-operative bank, in accordance with the authorisation issued by the Reserve Bank of India under the Payment and Settlement Systems Act, 2007 (51 of 2007);

(c) receipt from an agent by an issuer of pre-paid payment instruments, in accordance with the authorisation issued by the Reserve Bank of India under the Payment and Settlement Systems Act, 2007 (51 of 2007);

(d) receipt by a company or institution issuing credit cards against bills raised in respect of one or more credit cards;

(e) receipt which is not includible in the total income under clause (17A) of section 10 of the Income-tax Act, 1961. 2.

The notification shall be deemed to have come into force with effect from the 1 st day of April, 2017.

2. [Notification No. 61 /2017/F. No. 149/136/2014-TPL] In exercise of the powers conferred by section 50CA and sub-section (2) of section 56

read with section 295 of the Income-tax Act, 1961 ( 43 of 1961), the Central Board of Direct Taxes hereby makes the following rules further to amend the Income-tax Rules, 1962, namely:-

1. (1) These rules may be called the Income-tax (20th Amendment), Rules, 2017. (2) They shall come into force from the 1st day of April, 2018 and shall apply in

relation to assessment year 2018-19 and subsequent years. 2. In the Income-tax Rules, 1962, — (A) in rule 11UA, sub-rule (1), in clause (c), for sub-clause(b), the following sub-

clause shall be substituted, namely:- “(b) the fair market value of unquoted equity shares shall be the value, on the valuation date, of such unquoted equity shares as determined in the given manner.

(B) after rule 11UA, the following rule shall be inserted, namely:- “Determination of Fair Market Value for share other than quoted share. 11UAA. For the purposes of section 50CA, the fair market value of the share of a company other than a quoted share, shall be determined in the manner provided in sub-clause (b) or sub-clause(c),as the case may be, of clause (c) of sub-rule (1) of rule 11UA and for this purpose the reference to valuation date in the rule 11U and rule 11UA shall mean the date on which the capital asset, being share of a company other than a quoted share, referred to in section 50CA, is transferred.” .

3. [Notification No. 68 /2017/F. No. 300196/01/2017-ITA-I] In exercise of the powers conferred by clause (46) of section 10 of the Income-tax Act,

1961 (43 of 1961), the Central Government hereby notifies for the purposes of the said clause, ‘National Biodiversity Authority’, Chennai, an authority established under the

Biological Diversity Act, 2002 (18 of 2003), in respect of the following specified income arising to that Authority, namely:— (a) amount received in the form of Grant-in-aid from Government of India; (b) benefit sharing fee and royalty received; (c) amount received in form of Application fee; (d) amount received in form of Interest; and (e) amount received in form of Penalty.

2. This notification shall be effective subject to the conditions that National Biodiversity Authority, Chennai,— (a) shall not engage in any commercial activity; (b) activities and the nature of the specified income shall remain unchanged

throughout the financial years; and (c) shall file return of income in accordance with the provision of clause (g) of

sub-section (4C) of section 139 of the Income-tax Act, 1961.

CIRCULAR No. 23 /2017 - F. No. 275/59/2012-IT (B) Subject: Modification of Circular No.1 of 2014 in view of substitution of Service Tax by

Goods and Services Tax (GST). The Central Board of Direct Taxes (the Board) had earlier issued Circular No. 112014

dated 13.01.2014 clarifying that wherever in terms of the agreement or contract between the payer and the payee, the Service Tax component comprised in the amount payable to a resident is indicated separately, tax shall be deducted at source under Chapter XVIl-B of the Income tax Act, 1961 (the Act) on the amount paid or payable without including such Service Tax component.

2. References have been received in the Board seeking clarification as to what treatment would be required to be given to the component of Goods and Services Tax (GST) on services, which has been introduced by the Government with effect from 1" of July, 2017 and into which the erstwhile Service Tax has been subsumed.

3. The matter has been examined. It is noted that the Government has brought in force a new Goods and Services Tax regime with effect from 01.07.2017 replacing, an10ngst others, the Service Tax which was being charged prior to this date as per the provisions of Finance Act, 1994. Therefore, there is a need to harmonize; the contents of Circular No. I/2014 of the Board with the new system for taxation of services under the GST regime.

4. In the light of the fact that even under the new GST regime, the rationale of excluding the tax component from the purview of TDS remains valid, the Board hereby clarifies that wherever in terms of the agreement or contract between the payer and the payee, the component of 'GST on services' comprised in the amount payable to a resident is indicated separately, tax shall be deducted at source under Chapter XV Il-B of the Act on the amount paid or payable without including such 'GST on services' component. GST for these purposes shall include Integrated Goods and Services Tax, Central Goods and Services Tax, State Goods and Services Tax and Union Territory Goods and Services Tax.

5. For the purposes of this Circular, any reference to 'service tax ' in an existing agreement or contract which was entered prior to 01.07 .2017 shall be treated as 'GST on services' with respect to the period from 01.07.20 17 onward till the expiry of such agreement or contract.
