Produce more farmmachinery to boostagricultural production

The State is striving for development

of other sectors of the economy based on

agriculture, especially for boosting produc-

tion in the agricultural sector by rendering

all necessary assistance.

Encouragement is being given for ex-

tension of virgin and vacant land, supply of

irrigation water and use of quality strains of

crops and modern cultivation methods. At

the same time, measures are being taken for

the establishment of industries producing

farm machinery in order to see the transi-

tion to mechanized farming.

Myanmar’s farm machinery facto-

ries are located in Ingone in Kyaukse Town-

ship, Mandalay Division, and in Ywathagyi

in Yangon Division. Moreover, an farm ma-

chinery assembling workshop and the main

factory have been established in Kyaiklo

Farm Machinery Industrial Zone and an-

other farm machinery factory in Mayangon

Township.

These factories and workshops are

producing Leya-16 power tillers, Leya-16

power tillers, other power tillers, harvesters,

combined thrashers, dryers, manual pumps

and other farm equipment.

At a time when the nation is in tran-

sition to mechanized farming, the agricul-

tural sector will improve only when quality

farm machinery and equipment are manu-

factured and most extensively put to use.

YANGON, 23 Aug — The15th Myanmar Tra-ditional Cultural Performing Arts Competitions 2007of Yangon North District took place at PinmaYandayataung Hall in Insein Township today.

It was attended by Chairman of Yangon Di-vision Peace and Development Council Commanderof Yangon Command Maj-Gen Hla Htay Win andwife Daw Mar Mar Wai.

Chairman of the Organizing Committee forCompetitions Chairman of Yangon North DistrictPeace and Development Council U Thein Naingopened the competitions and explained the arrange-ments made for the competitions.

After the opening, the commander and wifeDaw Mar Mar Wai presented cash and a flowerbasket to the artists who performed at the compe-titions. A total of 190 participants took part in thecompetitions.

YANGON, 23 Aug — Deputy Minister forProgress of Border Areas and National Races andDevelopment Affairs Col Tin Ngwe together withofficials heard reports on development tasks for2007-08 fiscal year, supply of water and arrange-ments for prevention of flood presented by offi-cials at the office of Kyaukse Township Develop-ment Affairs Committee on 18 August and gavenecessary instructions.

Next, the deputy minister inspected ZawgyiWater Plant No-1 and left the necessary instructions.

At Zeetaw Water Purifying Factory No-2,the deputy minister called on officials to conductchemical and biological experiments for safety ofwater. He also gave instructions on maintenance ofwater pumps.

Next, the deputy minister and party inspectedbuilding Padauk Road in Aye Mya Kyi Lin Wardand gave necessary instructions.

Later, they looked into progress of construc-tion of bridge on Kyaukhsaungon village-to-villageroad and urged officials to upgrade the village-to-village road.

Two Americans chargedwith 2004 Iraqi killings

SAN FRANCISCO, 22Aug—Two Americanswho served as Marines inFallujah, Iraq, in 2004 facecharges of killing threemen detained in the searchof a home in whichweapons were found, USofficials said on Monday.

The charges representthe latest in a series ofincidents in whichmembers of the US ArmedForces are alleged to havecommitted violent crimesin Iraq, actions that haveintensified internationalcriticism over the USinvasion.

Military prosecutorscharged Sergeant Jer-maine Nelson “for the

unlawful murder of anunknown foreign nationalin Fallujah in 9 November,2004,” a statement fromCamp Pendleton, north ofSan Diego, said.

Nelson’s squad leader,Jose Luis Nazario, alsofaces criminal charges, butsince he has left themilitary he was chargedwith voluntary man-slaughter by the USAttorney in Riverside,California.

Nazario and otherMarines detained fourmen while searching ahouse from which they hadearlier taken fire, accord-ing to the complaint filedwith the US District Court

in Central California.They also found AK-47rifles and ammunition.

Police say seven members ofsame family killed in Iraq

US soldier dies in BaghdadBAGHDAD, 22 Aug—An American soldier died of

non-combat related cause in the Iraqi capital, the USmilitary said on Tuesday.

The incident occurred on Sunday, a military statementsaid without providing further details, adding that aninvestigation was underway.

The name of the soldier is being withheld pendingnotification of next of kin, it added.

Iran, IAEA agree ways to defuse atom suspicionsTEHERAN, 23 Aug —

Iran and the UNInternational AtomicEnergy Agency said onTuesday they had agreeda plan on how to helpdefuse Western suspicionsabout Teheran’s atomwork, a move hailed as a“milestone” by a seniorIAEA official.

After two days oftalks in Teheran, the twosides said they haddrawn up a timeline foranswering outstandingquestions about Iran’snuclear programme,which the West believesis aimed at building atomic

bombs. Iran insists itsplans are peaceful.

But the United States,leading efforts to isolateIran, has said Teheranmust both cooperate withthe UN inspectors and haltsensitive nuclear work, astep Iranian officials haverejected, if it wants toavoid a third round of UNsanctions.

“We have in front ofus an agreed work plan.We agreed on modalitieson how to implement it.We have a timeline for theimplementation,” IAEAdeputy director OlliHeinonen said after the

negotiations, which hedescribed as “good andconstructive”.

“I think this was animportant milestone,” hetold a Press conference.“But this process will takeits time.”

Iran agreed in June todraw up an action planwithin 60 days to grantmore access to its nuclearsites for inspectors of theVienna-based IAEA andclear up longstandingagency questions about thenature and scope of theprogramme.

The UN body haslong complained that Iran

has stonewalled itsinquiries into the mur-ky history and scopeof Teheran’s nuclearactivities and curbedinspector movements,preventing the agencyfrom giving Teheran aclean bill of health.

Heinonen said workwould start swiftly onimplementing Tuesday’sagreement, with activitieslater this month as well asin September and October.Details of the deal wouldbe included in a report forthe IAEA board by earlySeptember.

KUALA LUMPUR, 22 Aug— Malaysia and ThailandTuesday signed a Memorandum of Understanding(MoU) on education as part of a broader effort by bothcountries to enhance cooperation and bilateral relations.

Malaysian Education Minister Hishammuddin TunHussein and his Thai counterpart Wichit Srisa-aninked the pact at a ceremony in Putrajaya, administrativecentre of Malaysia, witnessed by the prime ministersof both countries, Abdullah Ahmad Badawi andSurayud Chulanont.

The MoU focused on, among others, networkingbetween schools in Malaysia and Thailand, particularlythose in the southern provinces, covering aspects suchas religious education, curriculum as well as studentexchange and teacher training programmes, he said.

“We’ve agreed to accept some students fromsouthern Thailand to study in our schools and also forsome teachers from the area to be placed at our teachertraining institutes,” the national news agency Bernamaquoted Hishammuddin as saying.

Both countries would share information andexperience on the cluster school initiative and trainingfor school heads, he said.

Hishammuddin described the MoU as meaningfulto both the Malaysian and Thai leaderships.

JAKARTA, 22 Aug— A 28-year-old woman diedTuesday on the Indonesian resort island of Bali afterbeing treated for allegedly developing bird flusymptoms.

She used to work as chicken trader in Tabananregency. If confirmed, she could become the secondbird flu casualty on the island, following the death ofanother woman from Jembrana regency.

Work Committee chairman said, “If you agree to myproposal of designating Nay Pyi Taw, the Capital ofthe Union of Myanmar, as a Union territory placedunder direct administration of the President, detailedbasic principles to be adopted for Nay Pyi Taw shouldbe the same, as that for Yangon Council”.

Therefore, discussions are to be held andsuggestions to be made to decide whether or not theterm “Yangon” prescribed in the detailed basicprinciples on administration of Capital Yangon, aUnion territory, prescribed in para 35 and the detailedbasic principles on designation of the status of theChairman and members of Yangon Council prescribedin para 36 of the detailed basic principles adopted atthe plenary session held from 28 to 30 March 1996,should be replaced with the term “Nay Pyi Taw”, andthe term “Chairman of Yangon Council” prescribed insub-para (c) 6 of para 16 of detailed basic principle forFormation of Financial Commission with the term“Chairman of Nay Pyi Taw Council”.

principles were laid down according to the chapterheadings, the principles relevant to respective chapterswere transferred as the detailed basic principles. It isassumed that of the detailed basic principles transferredto respective chapters, some principles should continueto be prescribed in the Chapter “State FundamentalPrinciples” but some should not be done so.

I would also like to present the basic principles thatare no longer prescribed because they do not need to beprescribed as detailed basic principles. They are:

The principles transferred to the Chapter “TheHead of State”:

1. The Head of State is the President of the Union.2. The President of the Union shall be elected by

the presidential electoral college.The principles transferred to the Chapter

“Citizenship, Fundamental Rights and Duties ofCitizens”:

3. All persons who have either one of the followingrequirements are citizens of the Union ofMyanmar. All persons born of parents both ofwhom are nationals of the Union of Myanmar.Persons who are vested with citizenshipaccording to existing laws on the date thisConstitution comes into force. Citizenship,naturalization and revocation of citizenship shallbe prescribed by the law.

4. Every citizen is under a duty to uphold Non-disintegration of the Union, Non-disintegrationof national solidarity, and Perpetuation ofsovereignty.

5. Every citizen is under a duty to abide by theprovisions of the Constitution.

6. Every citizen is under a duty to undergo militarytraining in accord with the provisions of the lawand to serve in the armed forces to defend theState.

7. The above right shall not include any economic,financial, political or other secular activitiesthat may be associated with religious practice.

8. The freedom so guaranteed shall not prohibitthe State from enacting laws for the purpose ofsocial welfare and reform.

9. The State recognizes the special position ofBuddhism as the faith professed by the greatmajority of the citizens of the State.

10. The State also recognizes Christianity, Islam,Hinduism and Animism as religions existing inthe Union on the date of the coming into forceof the State Constitution.

11. The State shall render assistance and protect asfar as it can the religions it recognizes.

12. The abuse of religion for political purposes isforbidden. And any act which is intended or islikely to promote feelings of hatred, enmity ordiscord between racial or religious communitiesor sects is contrary to the State Constitution. Alaw may be adopted to punish such actions.

13. The State shall help national businessmen haveaccess to technologies, investments, machinery,and raw materials.

The principles transferred to the Chapter“General Provisions”:

14. Myanmar language is the official language.15. The State fundamental principles are the

guidelines to be followed by the legislativeHluttaws in enacting laws and interpretingprovisions of the State Constitution and ofother laws.

I consider that these detailed basic principles havebeen transferred to respective chapters, and they nolonger need to be mentioned in the Chapter “StateFundamental Principles”. Therefore, they are notprescribed”.

In this regard, para 15, sub-para 5says, “The existing laws are still in force until they arerevoked or amended by the Pyidaungsu Hluttaw, andunless they are in contrary to the Constitution”.

The plenary session of the National Conventionheld on 2 August 2007 adopted detailed basic principlesfor the Chapter “Transitory Provisions”. In this regard,para 5 says, “The existing laws are still in force until theyare revoked or amended by the Pyidaungsu Hluttaw,and unless they are in contrary to the Constitution”.

The two detailed basic principles are exactly thesame, in word and in essence. I consider that it is moreappropriate that the detailed basic principle should beprescribed in the Chapter “Transitory Provisions”. Inthe 1947 Constitution, Section 226, sub-section 1,which is similar to the detailed basic principle inmeaning is prescribed in the Chapter “TransitoryProvisions”.

Therefore, I would say detailed basic principlepara 15, sub-para 5 in the sharing of legislative powerno longer needs to be prescribed, and it will be revoked”.

the adopting of basic principles and detailed basicprinciples of the 15 chapters to be included in the StateConstitution. When the National Convention completessuccessfully, it will need to implement the second stepand third step of the State’s seven-step Road Map“After the successful holding of the NationalConvention, step by step implementation of the processnecessary for the emergence of a genuine anddisciplined democratic system” and “Drafting of a newconstitution in accord with basic principles and detailedbasic principles laid down by the National Convention”.

In drafting the State Constitution in accord withthe basic principles and detailed basic principles theNational Convention has adopted, necessaryamendments should be made to the terms, dictationand word orders without having any adverse effects tothe aims and essence of the basic principles and detailedbasic principles”.

“In conclusion, I would like to seek the approval ofthe NC to make necessary amendments to the terms,dictation and word orders without having any adverseeffects to the aims and essence of the basic principlesand detailed basic principles adopted according to theminutes of the NC in drafting the State Constitution”.

Therefore, in accord with the suggestions of theDelegate Groups of the National Convention and manydelegates of these delegate groups, the expression theNational Convention said:

“as approved by the National Convention, wewill have to make necessary amendments to theterms, dictation and word orders without havingany adverse effects to the aims and essence of thebasic principles and detailed basic principlesadopted according to the minutes of the NC indrafting the State Constitution” is put on record.Mr Chairman,

At the plenary session held on 6 August 2007, theWork Committee chairman explained the basicprinciples and detailed basic principles that should beamended, added or repealed. In that regard, the DelegateGroup of National Races made a separate suggestion.

The group said, “Sub-para (a) para 19 of GeneralProvisions states as follows:

be blamed or impeached under any of thefollowing reasons:

(1) treason;(2) violation of any of the provisions of the

Constitution;(3) misbehaviour;(4) incapability of discharging duties prescribed

in the State Constitution for a member of theConstitutional Tribunal;

(5) inefficient discharge of duties;There are similar detailed basic principles to

impeach the Chairman of the Union ElectionCommission or one of the members in accord with theabove-mentioned five points.

Only the first to fourth detailed principles arestipulated for the impeachment of the President, or theVice-President, a Union Minister, the Attorney-Generalof the Union, the Auditor-General of the Union, Regionor State Chief Minister or any of the ministers, theChief Justice of the Union or any of the judges of theSupreme Court or a Chief Justice or any of the judgesof the Region or State High Court State.

To have a contextual uniformity and to preventoccurrence of disputes in the future, the detailed basicprinciples concerning the impeachment should alwaysbe five points for every matter.

It can be assumed that the expression “inefficientdischarge of duties” is so general that there is nospecification of the person concerned or the duty. Itwill be more appropriate if the said expression shouldbe substituted with the expression “inefficientdischarge of duties assigned to him in accord withthe law”.

In our view, the point “inefficient discharge ofduties assigned to him in accord with the law”should be added as detailed basic principle 5 afterdetailed basic principle 4 concerning the impeachment.Concerning the impeachment of a member of theConstitutional Tribunal or Chairman of the UnionElection Commission or one of the members, theexpression of the point 5 “inefficient discharge ofduties” should be substituted with the expression“inefficient discharge of duties assigned to him inaccord with the law”.

The expressions are prescribed in accord with thesuggestion, all detailed basic principles on impeachmentwill be same and more specific in meaning. Similarly,the expression “inefficient discharge of duties”prescribed in para 6, sub-para 5 in Chapter “Election”should also be amended as mentioned above. Onlywhen will there be contextual uniformity in the StateConstitution.

The suggestion conforms with the already-adoptedprinciples, so it deserves serious consideration. As towhether the suggestion should be adopted as a detailedbasic principle or not, the National ConventionConvening Work Committee consulted with themembers of the panel of chairmen. Then, the members

of the panel of chairmen held discussions withrespective delegates, and submitted the opinions of thedelegate groups to the Work Committee by letter. Alldelegate groups suggested that the expressions shouldbe amended in accord with the suggestion.

So, according to the suggestions of many delegates,“impeachment of the President or the Vice-

President prescribed in sub-para (a) 5 of para 16,— impeachment of a Union minister prescribed in

sub-para (a) 5 of para 4,—impeachment of the Union Chief Justice prescribed

in sub-para (a) 5 of para 8,—impeachment of Union Auditor-General

prescribed in sub-para (a) 5 of para 14,—impeachment of the Chief Minister of Region or

State prescribed in sub-para (a) 5 of para 23,—impeachment of Union Chief Justice or a justice

of Union Supreme Court prescribed in sub-para(a) 5 of para 4, and sub-para (a) 5 of para 5,

—impeachment of the chief justice or a judge ofRegion or State High Court prescribed in sub-para(a) 5 of para 12, and sub-para (a) 5 of para 13,

— impeachment of the chairman or a member of theConstitutional Tribunal prescribed in sub-para (a)5 of para 19,

—impeachment of the chairman or a member of theUnion Election Commission prescribed in sub-para (a) 5 of para 10, and

—recalling the duties of a Hluttaw member prescribedin sub-para 5 of para 6 are amended as:“inefficient discharge of duties assigned to him

in accord with the law”.Mr Chairman,

To ensure that the adopted detailed basic principlesare clearer and more comprehensible, and the StateConstitution is drafted more precisely and clearly, theWork Committee evaluated the adopted basic principlesand detailed basic principles. In that regard, para 18 onformation of courts at different levels under Region orState High Court prescribed in the formation of judiciaryand sub-para (a) of para 19 on appointment of justices,giving them judicial powers, and prescribing duties,rights and privileges state the expression “under theHigh Court of the Region or State”.

Legally, the scope of the term “under supervision”is wider than that of the term “under” in terms ofmeaning. Therefore, in meeting with the members ofthe panel of chairmen, the Work Committee presentedthat the word “under” should be replaced with theexpression “under supervision”. Then, the members ofthe panel of chairmen held discussions with respectivedelegates, and submitted the opinions of the delegategroups to the Work Committee by letter. All delegategroups suggested that the expression should be amendedin accord with the suggestion.

Thus, according to the suggestions of the delegategroups and many delegates:

Para 18 is amended as “In connection withformation of various levels of courts under thesupervision of the High Court of the Region orState:

“Under the supervision of the High Court of theRegion or State, there are the following levels of

courts”, andSub-para (a) of para 19 as: “appointing judges at

various levels of courts under the supervision of theHigh Court of the Region or State, giving themjudicial powers and prescribing their duties, rightsand privileges shall be in accord with law”.Mr Chairman,

The National Convention adopted detailed basicprinciples for prescribing self-administered areas. Inthat regard, one of the detailed basic principle says, “togroup together Hopang, Mongmao, Panwaing,Narphan, Manphant and Panyang Townships— sixtownships in Shan State into two districts and prescribeit Pa-O Self-Administered Zone”.

Now, I have presented the basic principles anddetailed basic principles the Work Committee hasadopted. The State Constitution will be drafted basedon these principles.

Binding methods and follow-up methods are statedas exceptions for the convenience of the NationalConvention in adopting the basic principles and detailedbasic principles. Moreover, the matters to be carriedout forthwith by the National Convention are prescribed.

The National Convention has carried out thesematters, so they no longer need to be mentioned.

Now, the National Convention has successfullyadopted the basic principles and detailed basic principlesto be included in the State Constitution, so I considerthat there is no need to mention the points I havepresented.

To ensure that the basic principles and detailedbasic principles are clear and simple and the mattersare notable, the exceptions and the matters to be carriedout forthwith by the National Convention are no longerprescribed. They are:

1. Sub-para 5 of para (h) of Chapter “StateFundamental Principles” and explanations prescribedat the end of that chapter,

2. Detailed Basic Principles from 1 to 5 of Chapter“The State” have been transferred to the basic principlesrelated to the State in the Chapter “State FundamentalPrinciples”. Paras from 1 to 5 and explanations,

3. Explanations in the Chapter “The StateStructure”,

4. Explanations in the Chapter “The Head ofState”,

5. Sub-paras 5 and 6 of para (d) in the Chapter“State Fundamental Principles”,

6. In accord with the methods to be implementedforthwith by the National Convention to delineate self-administered divisions and zones, the NationalConvention has delineated one self-administered divisionand five self-administered zones. paras from (a) to (d) onmethods to delineate self-administered zones,

Now, the National Convention has successfullyadopted the Basic Principles and Detailed BasicPrinciples to be included in the State Constitution. BAGHDAD, 22 Aug— At least two people were killedand four others injured in a roadside bomb explosionnear minibus in eastern Baghdad on Tuesday, whilemortar rounds struck the US-controlled Green Zone,an Interior Ministry source said.

“A roadside bomb went off at noon near a minibuscarrying passengers in Baghdad’s al-Jadidaneighbourhood, killing at least two people andwounding four others,” the source told Xinhua oncondition of anonymity.

Earlier in the day, several mortar rounds landed onthe heavily fortified Green Zone, which houses theIraqi Government offices and foreign embassies,including the US Embassy, the source added.

ISLAMABAD, 22 Aug— Pakistani authorities havedetected an outbreak of the H5N1 strain of bird flu ata poultry farm in a northwestern town and have culledmore than 35,000 birds, a government official said onTuesday.

Several outbreaks of H5N1 strain of avian influenzahave been found in birds this year in Pakistan, wherethe virus first appeared in early 2006. Pakistan has hadno human cases.

The new outbreak was found in late July at a bigfarm in Mansehra Town, 80 kilometres (50 miles)north of the capital, Islamabad.

“Samples were tested after reports of the death ofabout 14,000 chickens,” said Food and AgricultureMinistry official, Rafiq-ul-Hassan Usmani.

The committee took stock of the progress madeso far and agreed on the framework of the financialand operations model for the proposed company ata workshop held in Dubai on Monday.

China national tourist office opens in India

French researchers discover newknowledge on HIV’s persistence

PARIS, 22 Aug—The HIV virus modifies the pH ofcellular compartments where it accumulates itself inthe macrophages, thus preventing the activation ofenzymes charged with degrading it, according to astudy conducted by French researchers published onMonday. HIV attacks the cells of the immune system,where it multiplies itself. It forms stocks in some cellswhich are difficult to access by anti-viral treatments.

In order to understand this multiplication of thevirus in the white blood cells, a team of researchersfrom the French national centre for scientific research(CNRS), Pasteur institute and the French nationalinstitute for health and medical research (INSERM)studied the proliferation of HIV in macrophages, anddiscovered that viral particles accumulates themselvesin certain compartments of infected macrophages.

But, these compartments normally possess pH acidwhere HIV is not supposed to survive. But pH measurescarried out by the French researchers revealed anacidification defect in these compartments: HIVmanages to modify this hostile milieu to create afavourable environment for its survival and storage.

MNA/XinhuaBEIJING, 22 Aug.— Chemical analyses and tastetests by humans have revealed — contrary to popularbelief — that only 15 percent of the bitter taste in dark-roasted coffees comes from caffeine.

“Everybody thinks that caffeine is the main bittercompound in coffee, but that’s definitely not the case,”said study leader Thomas Hofmann, a professor offood chemistry and molecular sensory science at theTechnical University of Munich in Germany, whopresented his findings Tuesday at a meeting of theAmerican Chemical Society in Boston.

Hofmann and his colleagues found two classes ofcompounds give coffee the bulk of its bitterness. Bothare antioxidants found in roasted coffee beans, not inthe green (raw) beans.

One class, called chlorogenic acid lactones, is presentat high levels in light- to medium-roast brews. Darkroasts, such as espresso, showed high levels ofphenylindanes, which form when the chlorogenic acidlactones break down and give a more lingering, harshtaste than their precursors, Hofmann said. “Roasting isthe key factor driving bitter taste in coffee beans. So thestronger you roast the coffee, the more harsh it tends toget,” Hofmann explained.—Internet

BEIJING, 22 Aug— China Southern Airlines said onTuesday that it has signed a deal with Boeing to buy 55Boeing 737s to meet rising market demand and renewits fleet.

The aircraft, including the 737-700 and 737-800models, would be delivered between May 2011 andOctober 2013, said a statement from China Southern,the country’s largest carrier in terms of fleet size.

China Southern would pay for the aircraft at adiscount with its own funds and loans from commercialbanks, said the statement. But the company did notdisclose the value of the deal or the number of eachmodel.

At catalogue prices, a 737-700 costs 57 million to67.5 million US dollars, while a 737-800 costs 70.5million to 79 million US dollars.

New York State names 27 persistentlydangerous schools

NEW YORK, 23 Aug —New York State EducationCommissioner RichardMills announced Tuesdaythat 27 schools have beenidentified as “persistentlydangerous” in the state, upfrom 18 last year.

As required by federallaw, the list of schools wasannounced so that parentscan exercise their right ofschool choice.

“We know schoolofficials work hard toensure that children in theircare are safe and learn tothe best of their ability,”Mills said. “Nonetheless,some schools reportincidents that raise seriousconcerns about children’swelfare. It’s criticallyimportant that schoolleaders intervene quicklyto keep children safe.”

Schools are consideredpersistently dangerous ifthey have had six seriousincidents for 100 studentsenrolled for at least twoconsecutive school years.

Serious incidentsinclude homicide, forcibleand other sexual offences,robbery, assault resulting inserious physical injury,arson, kidnapping, reck-less endangerment, and

possession, use orthreatened use of a weapon.

Seventeen of the 27“persistently dangerous”schools are newly namedthis year, while 10 remainfrom last year.

All schools designatedas “persistently dangerous”must provide school choiceto students where transferoptions exist. Each schoolalso receives a 100,000-dollar grant to help improveschool safety.

Commissioner Millssaid this is the first of twoannouncements to be made.Later this year, a “WatchList” of schools, which isexpected to be larger, willbe identified. These schoolsmust improve to avoidbeing designated as“persistently dangerous”.

YANGON, 23 Aug— The following is theclarification of Chairman of the National ConventionConvening Work Committe Chief Justice U Aung Toeyesterday on matters regarding the amendments, theadditions and the repeals out of the fundamentalprinciples and detailed basic principles that havebeen adopted by the National Convention.Mr Chairman,

At the plenary session held on 6 August 2007, theWork Committee chairman said that regarding thedesignation of Union territories, the NationalConvention plenary session held on 9 April 1994 laiddown detailed basic principles. They are:

“(a)Yangon City, that is the Capital of theUnion, is designated as Union territoryplaced under direct administration of thePresident of the Union.

(b) Cocogyun Township which has a specialsituation is designated as Union territoryand placed under direct administration ofthe President of the Union.

(c) if need arises to designate areas that havespecial situation in connection with nationaldefence, security, administration andeconomy etc as Union territories they maybe so designated as Union territories afterenacting laws”.

Internationally, the city where the office of thecentral government is based is designated as the capitalof the State. And in some countries, the capitals areplaced under direct administration of the President orthe Union. Now, the government of the Union ofMyanmar and the offices of the central governmentsare based in Nay Pyi Taw. So, the capital of the Stateis Nay Pyi Taw. Therefore, need arises to amend theexpression “Yangon City, that is the Capital of theUnion” prescribed in one of the three above-mentioneddetailed basic principles. Yangon is not the capital ofthe nation any longer, and it remains a commercialcity. The designation of Yangon as a Union territoryunder the direct administration of the President shouldbe revoked. And the municipal area of Nay Pyi Taw,which has become the Capital of the State, should bedesignated as a Union territory placed under the directadministration of the President.

Yangon is no longer the Capital of the State, so theterm “Capital Yangon” will be replaced with the term“Yangon”. Moreover, the detailed basic principle“Cocogyun Township which has a special situation isdesignated as Union territory and placed under directadministration of the President of the Union” should berevoked. The designation of Yangon and CocogyunTownship as Union territories is revoked, so, they will

remain as Yangon Region.As I have presented that by revoking the designation

of Cocogyun Township as a Union territory, the detailedbasic principle of the sub-para (b) no longer needs to beprescribed. However, sub-para (c) should still exist.So, sub-para (c) should be sub-para (b). Therefore,discussions are to be held and suggestions, to be madeto decide whether or not the detailed basic principles:5. Designation of Union territories
