U BILLI fl-10 ta’ April, 2018, il-Prim Ministru ħatarni Aġent President għal matul iż-żmien li fih il-President tkun assenti minn Malta;

U BILLI jiena ħadt u ffirmajt kif imiss il-ġurament tal-kariga kif preskritt bl-artikolu 50 tal-imsemmija Kostituzzjoni;

BY THE ACTING PRESIDENT (L.S.) OF MALTA

Acting President

WHEREAS it is provided by section 49 of the Constitution of Malta that whenever the holder of the office of President is absent from Malta the functions conferred upon her by the said Constitution shall be performed by such person as the Prime Minister, after consultation with the Leader of the Opposition, may appoint;

AND WHEREAS the President is absent from Malta;

AND WHEREAS on the 10th day of April, 2018, the Prime Minister appointed me Acting President for such time as the President is absent from Malta;

AND WHEREAS I have duly taken and subscribed the oath of office as prescribed by section 50 of the said Constitution;

NOW, THEREFORE, I, DOLORES CRISTINA, do hereby notify and proclaim that I have this day under the said Constitution assumed the functions of President of Malta.

To meet our challenges

The Measures and Support Division within the Ministry for European Affairs and Equality (MEAE), designated by the Managing Authority as the Intermediate Body responsible for administering aid schemes for enterprises under the European Regional Development Fund (ERDF) under the 2014 – 2020 programming period, would like to announce calls for applications under the Business Enhance RD&I Grant Scheme.

This Grant Scheme has a budgetary allocation of €20 million to support eligible actions within the identified Smart Specialization Areas: Manufacturing, Aviation and Aerospace, Health, ICT, Tourism Product Development and Maritime Services, in line with the National Research and Innovation Strategy 2020.

By means of a decree of the 19th February, 2018, of the Rent Regulation Board, in the records of the Application in the names Adelina Formosa vs Salvatore Mamo, Application number 158/2017JD, the following publication was ordered for the purpose of effecting service on the respondent Salvatore Mamo in terms of Article 187(3) et sequitur of the Code of Organisation and Civil Procedure (Cap. 12)

By means of an application in the names Adelina Formosa (ID 391222M) vs Salvatore Mamo (ID 393737M), filed in the Rent Regulation Board, on the 29th November, 2017, the applicant Adelina Formosa (ID 391222M) requested with respect and confirmed on oath that:

That the applicant is the usufructuary of the ground floor tenement at 31A, Triq Carmel, Tas-Sliema. The applicant became the usufructuary of the said premises after the death of her husband, Magistrate Dr Giovanni Maria sive John Formosa, on the 24th December, 1993, since in the unica carta will, the applicant and her husband appointed each other as usufructuary of all their possessions (see the unica carta will here attached as Doc. A and the causa mortis declaration attached as Doc. B);

As a result of her age, the applicant gave a power of attorney to Joseph Messina (ID 90842M) to safeguard her interests. As a consequence of this, the said Joseph Messina appeared on a private writting dated 25th February, 2015, on behalf of the applicant where he granted on lease the premises above mentioned to the respondent Salvatore Mamo under a number of conditions, amongst them to pay the rent of €175 every month, €75 every month for the use of the furniture of the premises and €40 every month for the consumption of water and electricity (see private writing here attached and marked as Doc. C);

At first the respondent abided with the conditions of the lease;

But the respondent, without any reason stopped paying the rent due and till today there are more there 4 months in arrears of rent due;

According to clause 11 of the lease agreement, it was agreed that:

“Should the Lessee infringe any condition of this lease agreement or should the Lessee fail to pay the rent within

one week of due date, the lessor may rescind this agreement ipso iure and resume effective possession of the tenement”.

Illi invista taċ-ċirkustanzi, ir-rikorrenti interpellat lill-intimat biex jivvaka mill-fond permezz ta’ ittra legali datata t-13 ta’ Settembru, 2017. L-intimat iżda, minflok ma’ wieġeb għal din l-ittra, bagħatha lura l-uffiċċju tal-avukat sottoskritt bil-kliem ‘return to sender’ miktuba fuq l-envelop (vide Dok. D);

Illi sussegwentement, ir-rikorrent interpellat lill-intimat biex jivvaka mill-fond permezz tal-ittra uffiċjali numru 4113/2017 datata l-1 ta’ Novembru, 2017, liema ittra uffiċjali ġiet notifikata lill-intimat fit-8 ta’ Novembru, 2017, fl-ismijiet premessi iżda xorta waħda, l-intimat baqa’ inadempenti (ara vera kopja tal-istess ittra uffiċjali hawn annessa u mmarkata Dok. E);

Illi għalhekk ir-rikorrenti kellha tirrikorri għal dawn il-proċeduri;

Illi r-rikorrenti tiddikjara li sa fejn taf hi, l-intimat ma għandu ebda difiża x’jagħti kontra t-talba tagħha għall-iżgumbrament tiegħu. Invista ta’ dan, ai termini tal-Artikolu 16A (1)(a) tal-Kap. 69 tal-Liġijiet ta’ Malta, l-esponenti qed tannetti l-affidavit tagħha (ara affidavit hawn anness u mmarkat Dok. F).

Għaldaqstant, u invista tas-suespost, ir-rikorrenti umilment titlob lil dan l-Onorabbli Bord sabiex:

Due to the circumstances, the applicant solicited the respondent to vacate the premises by means of a legal letter dated 13th September, 2017. The respondent instead of responding to the said letter, sent back the letter to the office of the lawyer undersigned with the words ‘return to sender’ written on the envelope (see Doc. D attached);

Subsequently, the applicant solicited the respondent to vacate the premises by means of judicial letter number 4113/2017 dated 1st November, 2017, which judicial letter was duly notified to the respondent on the 8th November, 2017, in the said names but the respondent remained in default (see a true copy of the said judicial letter here attached and marked as Doc. E).

So the applicant had to initiate these proceedings;

The applicant declares that as far as she knows, the respondent does not have any defences to make to the applicant’s request for his eviction . Thus, in terms of Article 16A (1)(a) of Cap. 69 of the Laws of Malta, the applicant is attaching her affidavit (see affidavit attached and marked as Doc. F).

Therfore, as a result of the above mentioned, the applicant requests this Honourable Board to;

1. Decide these proceedings without proceeding to trial in terms of Article 16A of Cap. 69 of the Laws of Malta;

2. Declare the lease given by means the lease agreement dated 25th February, 2015, of the premises with number 31A, Triq Carmel, Tas-Sliema, between the applicant and the respondent Salvatore Mamo terminated;

3. Consequently orders the respondent to vacate immediately from the premises number 31A, Triq Carmel, Tas-Sliema withint a short and peremptory period that is fixed by this Board.

Whereas the plaintiff Michelle Vella (ID 367682M) filed an application under oath (No. 37/18 AL) demanding Corrections the Act of Birth of the minors Leeon, Neil and Mariella numbers 4383/2002, 4050/2003 and 1283/2006 respectively in the Public Registry.

Whosoever may have an interest therein, and wishes to oppose that demand, is hereby called upon to do so, by means of a note to be filed in the Registry of these Courts, within fifteen days from the day of the publication of this present notice in the Government Gazette.

Those who, within the aforesaid time, shall have filed such note, shall be notified by the service of a copy of the said application under oath, of the day which will be appointed for the hearing of the case.

So that within one week you declare that you have no pretensions over the premises mentioned above and you vacate from this premises leased to the late Maria Cachia and leave it free and unencumbered in favour of the interpellant nomine and you pay the sum of €1,751.13 together with legal interest from the 31st January, 2010, till the date of effective payment due to rent not paid for the years 2010 to 2018.
