Project Legacy The project forms ‘Phase 2’ of the Kelowna Conservatory Project and will house 87 market rental residential units. Early discussions with The City and the final issuance of the Development Permit was based on the provision of a northward oriented, 4 storey wood-framed “L” shaped / footprint building. The Phase 2 building footprint provided the landscaped / pool area / courtyard which was previously exposed to Glenmore Road. Due to privacy requirements and also to maximise sunlight penetration the design of the building was designed to be up against the building setback line. Variance Request (along Glenmore Road) The Development and Building Permits were submitted and subsequently approved using the survey prepared by DA Goddard Survey for the site. We note that a later survey was prepared by the same land surveyor dated February 2, 2018 which shows apparent road widening and a geometric revision to the west property line (Glenmore Road). The later survey shows the project currently within the building setback 2.44m at its’ worst point and 0.31m at its’ best point. Due to the discrepancy between these surveys, issuance of both Development and Building Permits and that the project is nearing construction completion, we request a setback variance along Glenmore Road. Variance Request Design Rationale Based on the current project being sited within the (new) building setback along Glenmore Road, we provide the following points in support of our request for variance as follows: •The project’s parking structure is within the building setback and any visual appurtenance related to the parkade will be minimized. •The residential building above is smaller than the parking structure; as such, the largest projection into the setback is 1.278m and is isolated to the most north-western corner of the site. •The residential building also articulates in and out providing pockets where a greater setback occurs. This undulation occurs throughout the length of the west façade. As such, the building façade is not monolithic and has undulating massing; •As noted, the current building location was established to maximise sunlight penetration into the (new) courtyard while maintaining residents’ privacy. •Aside from the 3 identified areas - the NW and SW parkade corners and the most north-western corner above grade – a large majority of the western façade is beyond the 6m setback
