    RESOLUTiiON #2010-BY THE COMMITTEE ON PERSONNELRESOLVE D BY THE CITY COUNCIL OF THE CITY OF LANSINGWHEREAS, with the retirement of the City Council's Legislative Office Manager, theCity Council is in need of immediate temporary assistance to continue to timely fulfill itsduties and obligations; andWHEREAS, the Committee on Personnel met on Thursday, August 26, 2010 andinterviewed the Legislative Office Manager prior to her retirement and has determinedthat she is willing to return and assist City Council on a temporary employment basisafter her retirement; andWHEREAS, she would continue to serve the City Council temporarily in the capacity ofLegislative Office Manager by entering into a temporary employment contract within theconstraints of the current FY 2011 budget;NOW, THEREFORE, BE IT RESOLVED, the Lansing City Council, hereby, approvesentering into a contract with Terese A.     The City of Lansing ordains:Section 1. That the district maps adopted by and incorporated as Section 1246.02 of the Code ofOrdinance s of the City of Lansing, Michigan be amend ed to provide as follows:

    BY COUNCILMEMBER DERRICK QUINNEYRESO LVED BY THE CITY COUNCIL OF THE CITY OF LANSINGWHEREAS, on February 28, 1990, the West Junior Reunion Committee wasformed by Lawrence Ray Davis. On October 23, 2010, the West Junior ReunionCommittee will mark its twentieth and final year; andWHEREAS, over the last twenty years, the West Junior Reunion Committee hasenjoyed dances, card parties, fish fries, breakfast fundraisers, church and manyother functions with attendances reaching four hundred or m ore; andWHEREAS, it is because of Lawrence that we have been able to gather andcelebrate each other while renewing lost acquaintances, strengtheningrelationships, reliving childhood memories, and paying tribute to our wonderfulteachers at West Junior High; andWHEREAS, Lawrence was born in Lansing and educated by the Lansing PublicSchool District, attending Kalamazoo Street Elementary, West Junior High, andSexton High School; andWHEREAS, a man of stability, he married Barbara Johnson, enjoying twenty-twoyears of marriage before his passing. They had two daughters, Dionne andKheri. Lawrence gave new meaning to his former alma mater's motto, "The BestComes from the West". He was a devoted athlete during his school years,playing tennis, football, basketball, softball, and ran track and was an avidswimmer; andWHEREAS, Lawrence's love of sports did not cease after school; he went on tobring ministry to the Athletic Department of the Union Missionary Baptist Church,where he coached various teams before assuming the position of AthleticDirector. Under his leadership many victories and successes were achieved;andWHEREAS, Lawrence's genuine love of humankind was evident by his warm,caring personality; he was always concerned for the well-being of others.Outside of his love for the Lord and his family, Lawrence loved working withchildren, especially underprivileged children and young adults; andNOW, THEREFORE, BE IT RESOLVED that the Lansing City Council herebyproclaim October 23, 2010 as West Junior High Day where they will celebratetheir last reunion.NOW, THEREFORE, BE IT FURTHER RESOLVED the Lansing City Councilwishes the West Junior Reunion Committee best wishes and many memoriesthat will last forever!

    BY COUNCILMEMBER A'LYNNE ROBINSONRESO LVED BY THE CITY COUNCIL OF THE CITY OF LANSINGWHEREAS, Maggie Mae Wise was born on August 20, 1937 in Clarksdale,Mississippi to Joseph and Oceola W ells; andWHEREAS, she was the "Family Historian", sharing the stories and events oftheir close friends and family mem bers with precise accuracy and details; andWHEREAS, Maggie was a faithful and devoted member of Paradise MissionaryBaptist Church where she shared her passion for gospel music and served as amusic director and attended regular church services as long as her healthpermitted; andWHEREAS, she was a founding member of the Lansing Gospel Echoes, apopular gospel singing group; andWHEREAS, Maggie performed each year at the Silver Bells in the Citycelebration, adding to the atmosphere of m agic and wo nder of the event; andWHEREAS, as a bus driver for the Lansing School District she provided safetravels for students to and from school for over twenty years; andWHEREAS, Maggie enjoyed attending gospel concerts, fishing, traveling, andspending time w ith her great-grand-daughter; andWHEREAS, on Sunday, September 19, 2010, Maggie Mae Wise joined herhusband, Dave Wise, Sr., parents, Joseph and Oceola Wells; brothers, JamesPrice and Otis Wells; sisters, Sarah Cash and Roberta Sample in heaven withtheir heavenly father; andNOW, THEREFORE, BE IT RESOLVED that the Lansing City Council, hereby,extend its deepest condolences to Maggie's family and friends. During her life,she provided love, hope, and inspiration to those who knew her. She will bedearly missed.

    SLU-4-20103300 Block, Bardaville StreetChurch in the "F" Com mercial DistrictWHEREAS, the applicant, Woodside E&D, LLC has requested a Special Land Use permit (SLU-4-2010) to construct a church with related site improvement on the vacant property locatedbetween 3310 and 3320 Bardaville Street; andWHEREAS, the property is zoned "F" Commercial District where churches are permitted subjectto obtaining a special land use permit; andWHEREAS, a review was completed by staff evaluating the character, location and impact thisproposal would have on the surrounding area and the impact on the environment, utilities,services and compliance with the Zoning Code and o bjectives of the Com prehensive Plan; andWHEREAS, the Planning Board held a public hearing on June 15, 2010, at which no commentswere received; andWHEREAS, at its meeting held on June 23, 2010, the Planning Board, based upon testimony,evidence and the staff report, voted unanimously (3-0) to recommend approval of SLU-4-2010to permit a church on the vacant property located between 3310 and 3320 Bardaville Street,with conditions; andWHEREAS, the City Council held a public hearing regarding SLU-4-2010 on August 9, 2010;andWHEREAS, the Committee on Development and Planning has reviewed the report andrecomm endation of the Planning Board and concurs therewith; andNOW THEREFORE BE IT RESOLVED that the Lansing City Council hereby approves SLU-4-2010 to construct a church on the vacant property located between 3310 and 3320 BardavilleStreet, with the following conditions:

    1. Landscaping, as de scribed in this staff report, is installed along the east an d westproperty lines.2 Any dumpsters on the site are screened per the requirements of the ZoningOrdinance.3. The seating capacity of the building is limited to the amount of on-site parking orparking that can be leased w ithin 300 feet of the site.4. The church agrees, in writing, that is will not object to the issuance of liquorlicenses within 500 feet of the site.

    BE IT FURTHER RESOLVED that this Special Land Use permit shall remain in effect only solong as the petitioner fully complies with this resolution, and if the petitioner fails to comply, theSpecial Land Use pe rmit may be term inated by City Council Resolution.BE IT FINALLY RESOLVED that in granting this request, the City Council determines thefollowing:

    1. The proposed church is compatible with the essential character of thesurrounding area, as designed.2. The proposed church will not change the essential character of the surroundingarea.3. The proposed church will not interfere with the general enjoyment of adjacentproperties.4. The proposed church will not impact adjacent properties as it will not bedetrimental to the use or character of the property under consideration.5. The proposed church will not impact the health, safety and welfare of persons orproperty in the surrounding area.6. The proposed church can be adequately served by essential public facilities andservices.7. The proposed church will not place any demands on public services and facilitiesin excess of current capacities.8. The proposed church is consistent with the intent and purposes of the ZoningCode and the Northeast Area Comprehensive plan.9. The proposed church will comply with the requirements of the "F" CommercialDistrict.

    BY THE COMMITTEE ON DEVELOPMENT AND PLANNINGRESO LVED BY THE CITY COUNCIL OF THE CITY OF LANSINGWHEREAS, the City has received a proposal to sell certain real property titled inthe name of the City of Lansing to the Neoge n Properties V, LLC; andWHEREAS, in accordance with the Lansing City Charter, Article 8, Chapter 4,and Section 208.08 of the Lansing Code of ordinances, the documentation anddetails of the sale must be placed on file in the Office of the City Clerk for a thirty(30) day period, and a public hearing on the proposed sale of the property mustbe held before the City Council subsequent to that time; andWHEREAS, the documentation and details of the sale were placed on file in theOffice of the City Clerk on July 29, 2010.NOW, THEREFORE, BE IT RESOLVED that a Public Hearing be held onOctober 11, 2010, at 7:00 p.m. in the City Council Chambers, Tenth Floor, CityHall, 124 W.     THE CITY OF LANSING ORDAINS:Section 1. That Section 1248.03 of the Codified Ordinances of the City ofLansing, Michigan, be and is hereby amended to read as fol lows:1248.03. Uses permitted subject to special conditions.

    (3 ) The floor area of a garage or carport space in a Planned Residential Developmentshall not exceed 770 square feet.(4 ) The floor area of an accessory building shall not exceed the ground floor area ofthe p rincipal building.(5 ) A single-family lot shall not have more than one storage shed and one garage ordetached carport.(6 ) Each accessory structure shall not be located closer than 60 feet from the front lotline, nor closer than three feet to a rear or side lot line, unless attached to the structurecontaining the principal use. Detached accessory structures of 1,000 square feet ormore shall be setback not less than six feet from a side lot line and a rear lot line. If anaccessory structure is attached to a structure containing the principal use, it shall meetall dimensional requirements imposed upon the structure containing the principal use,except as p rovided in subsection (n) hereof.(7 ) Accessory structures for an approved nonresidential use shall comply with thesetback requirements for the principal structures and shall provide landscaping,screening and buffering in accordance with Chapter 1290. These accessory structuresare not su bject to the size limitations of this section.(8 ) On through lots, an accessory structure located behind the principal structure shallconform to the front yard setback o f the district in which it is located.(9 ) An attached garage with doors, that is designed for three or more vehicles, shallhave at least one vehicle stall offset by not less than two feet from the front facade ofthe rem aining vehicle stalls.(10) The accessory structure shall not involve the operation of a business.(11) An accessory structure shall not be used to service or repair a motor vehicleowned by a person other than a person having a legal or equitable interest in the lot onwhich the accessory structure is located.(12) No accessory structure may be a public garage.(13) An accessory use on a lot shall not include motor vehicle repair. "Motor vehiclerepair" does not include minor motor vehicle service which is completed within a 24-hour period and is limited to:A. Chang ing oil or other fluids;B. Minor tuneup;C. Tire rotation; andD. Changing brake p ads if the vehicle is supported in a safe m anner.

    (14) An accessory use of a lot may include the parking of up to four operable vehiclesor one operable vehicle for each licensed resident driver at the dwelling, whichever isgreater. All vehicles must be incidental to the primary use and not be stored on the lot.(15) An accessory use on a lot shall not include junk storage.(c) A temporary structure or a temporary use which meets all of the followingconditions shall be permitted in an A, A-1 or B Residential District:(1 ) In the case of a temporary structure, a permit has been issued by the BuildingSafety Office authorizing the temporary structure.(2 ) In the case of a temporary use, a permit has been issued by the Planning Division.In determining whether to issue a permit, the Planning Division shall review a request inaccordance with the standards outlined in Section 1282.02(f)(1) to (9) and shall approvethe request, deny it or approve it with conditions.(3 ) The person issued a permit under subsection (c)(1) or (2) hereof agrees in writingto remove the tem porary structure or cease tempo rary use pursuant to the permit.(4 ) Permits issued under subsection (c)(1) or (2) hereof shall be for a period not toexceed two weeks, and upon request may be extended twice for a period not to exceedtwo weeks for each extension.(d) The temporary use of a permanent structure as a real estate office for the purposeof marketing new residential development which meets all of the following conditionsshall be permitted in an A, A-1 or B Residential District:(1 ) The temporary use of the permanent structure is located within the residentialdevelopment.(2 ) The temporary use of the permanent structure shall be removed after three years,or after 90 percent of the residential development is sold, whichever comes first.(e) A home occupation which meets all of the following conditions shall be permitted inan A, A-1 o r B Re sidential District:(1 ) No person, other than a member of the family residing in the dwelling unit, SHALLengages in the home occupation AND NO MORE THAN ONE PRIMARY CAREGIVER,AS THAT TERM IS DEFINED IN THE MICHIGAN MEDICAL MARIHUANA ACT,BEING MCL 333.26421 ET SEQ., AS AMENDED, SHALL ENGAGE IN THEACTIVITIES OF A PRIMARY CAREG IVER ON ANY LOT.(2 ) The use of the dwelling unit as a home occupation SHALL BE is clearly incidentaland subordinate to its use for residential purposes.

    SERVICES OR SUBSTANCE ABUSE TREATMENT AND REHABILITATIONSERVICES, AS THOSE TERMS ARE DEFINED IN PART 61 OF PA 368 OF 1978,BEING MCL 333.6101 ET SEQ, ARE OFFERED; OR(B) WITHIN 100 FEET OF A PUBLIC OR PRIVATE YOUTH CENTER, PUBLICSWIMM ING POOL, OR VIDEO ARCADE FACILITY.(10) ALL MARIHUANA PLANTS SHALL BE KEPT IN AN ENCLOSED, LOCKEDFACILITY, AS THAT TERM IS DEFINED IN THE MICHIGAN MEDICAL MARIHUANAACT.(11) THIS SECTION SHALL APPLY TO EVERY PERSON ENGAGING IN THEACTIVITIES OF A PRIMARY CAREGIVER AS A HOME OCCUPATION,REGARDLESS OF WHETHER OR NOT THE ACTIVITIES COMMENCED PRIOR TOTHE ENACTMENT OF THIS SECTION.(f ) A temporary bulletin board or sign which meets all of the requirements of Chapter1440 of Part Fourteen--the Building and Housing Code and does not exceed ten squarefeet in area shall be permitted in an A, A-1 or B Residential District, if the signadvertises the sa le or lease of a structure or lot on wh ich the sign is located.(g ) An educational facility, except an educational facility or an agent thereof that is ahigh school, college, university, trade or vocational school or a community or juniorcollege, shall be perm itted in an A , A-1 or B R esidential District.(h ) A group day care home which meets all of the following conditions shall beperm itted in an A, A-1 o r B R esidential District:(1 ) The facility provides and maintains on the lot not less than 900 square feet ofoutdoor play space.(2 ) The use of the structure as a group day care home shall be clearly incidental to theprincipal residential use.(3 ) One person, other than a member of the family residing in the dwelling, may beemployed, so long a s that person is not the primary caregiver.(4 ) No change occurs in the o utside appearance of the dwell ing.(5 ) No signs are permitted.(6 ) The outdoor play space shall be fenced. This requirement can be waived byapproval of the Planning Division if the specified outdoor area is common open spaceshared with other dwelling units.

    (i) A golf course which meets all of the following conditions shall be permitted in an A,A-1 or B Residential District:(1 ) The lot on which the golf course is located has not less than one lot line abutting aprincipal or minor arterial, as defined in the Comprehensive Plan.(2 ) Each vehicular ingress or egress is directly onto a principal or minor arterial, exceptif approval is obtained from the Planning Board after a public hearing is held pursuant tothe procedures described in Section 1282.02.(j) An outdoor swimming pool which is owned and operated by a governmental entityand which meets all of the following conditions shall be permitted in an A, A-1 or BResidential District:(1 ) Front, rear and side yards are not less than 80 feet, except as provided inparagraph (j)(2) hereof.(2 ) If a front, rear or side yard is abutting a D-1, E-1, E-2, F, G-1, G-2, H, I or J District,then the yard which abuts such District shall meet the dimensional requirements of theDistrict which abuts such ya rd.(3 ) No p arking exists in the front yard.(4 ) No accessory structure is located in the front yard.(k) An indoor swimming pool which is owned and operated by a governmental entityand which meets all of the following conditions shall be permitted in an A, A-1 or BResidential District:(1 ) Front, rear and side yards are not less than 25 feet, except as provided inparagraph (k)(2) hereof.(2 ) If a front, rear or side yard abuts a D -1, E-1, E-2 , F, G-1, G-2, H, I or J District, thenthe yard which abuts such District shall meet the dimensional requirements of theDistrict which abuts such front, rear or side ya rd.(I) A library or museum which is owned and operated by a governmental entity andwhich meets all of the following conditions shall be permitted in an A, A-1 or BResidential District:(1 ) Front, rear and side yards are not less than 25 feet, except as provided insubsection (1)(2) hereof.(2 ) If a front, rear or side yard abuts a D -1, E-1, E-2 , F, G-1, G-2, H, I or J District, thenthe yard which abuts such District shall meet the dimensional requirements of theDistrict which abuts such front, rear or side ya rd.
