From: Officer Alberto Duarte #14337\L-(51 ) 11 El Office of the Chief of Police San Francisco Police Department

Date: Tuesday, July 07, 2020

Subject: DGO 2.01, rule 27-Accepting Gifts

Issue:

On today's date, I received a call from personnel at Southern Police Station that a Fireman from Station #4, Mission Bay, had dropped off 10 small sealed boxes filled with See's Candies.

I picked up the boxes and each box weighs approximately 1/4 of Lb. (pound). They are filled with a small bag of assorted See's Chocolate Candies, and there are 5 decorative surgical mask with the ten boxes.

Upon further investigation, I observed that the Boxes were a gift from the San Francisco Rotary Club/Chinatown. There is business card for Vanita Louie, Community Advocate for The Rotary Club of Chinatown.

Discussion:

Accepting the candy would violate DGO 2.01;

Rule 27- GIFTS, PRESENTS, COMPENSATION, REWARDS. Members shall not solicit or accept any gift, compensation or reward for the performance of their duties, except with the permission of the Police commission. When offered money or gifts for police services (other than monies received pursuant to Section 10 B. I of the City Administrative Code), members who wish to accept the money or gift being offered shall submit a written report to their commanding officer. The report shall include a request for permission to accept the money or gifts, and include the date the offer was made, the name and address of the donor, and a brief description of the services rendered. Commanding officers shall forward these reports through channel to the Police Commission. The Commission may grant or deny the member permission to accept all or part of the money or gifts.

Conclusion:

Our office did not accept the gifted candy. However, it is now in our possession. I will continue to hold them until permission is granted or denied on accepting the gift.

Recommendation:

I recommend forwarding this memorandum to the police commission for direction.

If permission is granted, I will distribute the candy to our units in Headquarters.

If the direction is denial, I will make arrangements to return the gift to Ms. Vanita Louie, The Rotary Club Chinatown.

Humbly submitted,

Officer Alberto Duarte
