I) Addition of New structures in bypass stretches for balancing as required

based on codal provisions and addition of structures as already exist at site but

not included in contract scope (Missed during DPR).

While carrying out structural Inventory at site, additional structures have been found at

following locations. There will be change of scope for these structures, which are not

included in Schedule B of Concession Agreement. The estimates for these additional

structures have been forwarded to IE for verification and approval. IE has forwarded the

recommendation with cost of four (4) Box culverts and eight (8) Hume Pipe culverts to

NHAI (vide letter no. ICT: 655: NCS: 2099 dated 15.02.2013, ICT: 655: NCS::2519 dtd.

26.02.2013, and ICT: 655: NCS: 12017 dtd. 01.10.2013) for their further approval.

NHAI has accorded their In-principle Approval for Additional culverts Vide Letter No:

NHAI/PIU/RAJ/2014/D-683 Dt: 24/02/24 for An Amount of 4.07 Cr.

II) Change of scope due to provision of wider median section by NHAI over a

length of 13.40 Km. to save the trees (Protected & Ficus) to get the approval from

MOEF in respect of Diversion of forest land and permission for cutting of trees in

protected forest.

In pursuant to FAC-I conditions of MOEF, a proposal for diversion of protected forest

with specific condition of having a wider median to save maximum number of trees has

been prepared over an alignment of 13.4 km length as given below.

The revised drawings to accommodate the FAC-I proposal have been approved by the

Independent Engineer. Based on the approved TCS by the IE, cost estimate worked to

Rs.11.93 Cr. has been approved already.

IV) Change of scope Notice under Clause 16.1.2 of CA due to

Rehabilitation/Reconstruction of existing structures, which are in distress condition

& beyond the limits of economical repairs

As per the recommendation of IE and the joint site visit of committee on Dt. 13 – 15

September 2012 formed as per recommendation of Hon‟ble Member Finance, the

superstructure of all the below five bridges reviewed and observed that superstructure is in a

very dilapidated condition and major distresses were noticed in all the below mentioned

structures.

Concessionaire has submitted indicative cost of dismantling, repair & rehabilitation,

construction of return walls, wind wall and median wall, construction of approaches. IE has

approved the proposal and recommended to PIU Rajkot vide letter No. ICT/655/NCS/2044

dated 14.02.13. Further NHAI, PIU, Rajkot has requested CGM, NHAI to accord approval of

change of scope vide letter No. NHAI/PI/RJK/Jet-Som/2013/D-494 dt 22.02.13. NHAI has

V) Change of scope Notice under Clause 16.1.2 of CA for construction of

Underpass for Wild life animal crossing.

While giving stage II approval for protected forest on 28.12.12, MoEF has proposed to

construct an underpass between Ch.48+000 to Ch.49+000 for wildlife crossing.

Location of proposed CUP has been finalized at Ch.46+180 jointly by Forest Department,

IE, and Concessionaire‟s representatives during site visit.

Authority has given “ In-Principle” approval for construction of structure of span 10m X

6m for crossing of animals in compliance to the Forest & Environment advisory Committee

GOI, thru letter vide NHA/PIU/RJK/ICT/2013/868 dt.22.03.13 for an amount of 2.30Cr.

VI) Change of scope Notice under Clause 16.1.2 of CA for construction of the

Syphon at Km. 60.050 (Ch. 57+490) of NH 8D.

As requested by Executive Engineer, Junagadh Irrigation project division for construction of

the Shyphon at Km. 60.050 (Ch. 57+490) of NH 8D for canal crossing vide letter No. PB-

A/Sabli/Canal/NH.Xing/5358 Dt. 9.11.2012, the matter has been evaluated by the

Concessionaire and the project Independent Engineer.

Based on the requirement by Irrigation department, concessionaire has prepared the

design and drawing for the proposed structure along with the cost estimate and it was duly

reviewed and recommended by the project Independent Engineer.

The Authority has forwarded the proposal to Irrigation department to deposit the

estimated amount of Rs. 39,26,656/-. Upon receipt of the said amount from Irrigation

department, construction of the structure can be taken up by Concessionaire to match

with the schedule of project. Authority has pursued the matter with Irrigation department

to deposit the amount to proceed further.

VI) Urgent Repair and Maintenance needs for existing Junagadh Bypass due to

non-availability / further delays in land possession for Proposed Junagadh

Bypass

JSTPL has submitted the proposal for major maintenance / strengthening of existing

Junagadh Bypass through letter No. JSTPL/2014/365 dated 10.03.14 and requested

the Authority to accord approval, under change of scope, for carrying out major

maintenance prior to monsoon period, so that excessive deterioration during

monsoon can be avoided and the existing bypass can be maintained in traffic worthy

condition for the benefit of road users.

VII) Provision of underpass (PUP) in both sides of ROB approaches at RoB-I

near Jetalsar Village as per demand of Villagers

As submitted the demand for provision of underpass by villagers of Jetalsar through

Hon‟ble Member of Parliament, vide letter dated 22.02.14, JSTPL was instructed to submit

the proposal for provision in both sides of ROB-1, through Independent Engineer.

JSTPL has submitted the proposal through letter No. JSTPL/IE/885/2014 dated 03 March

‟14, along with the concept plan. IE has reviewed the same and recommend to PIU, Rajkot

through Letter no. ICT:655:NCS:2866 dated 12 March ‟14.

PIU, Rajkot has sent the request for approval to CGM, Gandhinagar through letter No.

NHAI/PIU/RJK/Jet-Som/2013/D-1020 dated 27.03.2014

Manager (T) for CGM (T) & RO-Gujarat has sent recommendation to NHAI, HQ for In

principle approval of the competent authority through Letter no. NHAI/12013/2/2010-RO-

GNR/Tech./Jet-Som/490 dt 23.05.2014.

NHAI has approved thru vide letter No. NHAI/11012/I/ Jetpur-Somnath/NH-8D/2013/190

dt 16.06.2014.

VIII) Provision of additional underpass (PUP) at design Chainage 113+306

under Change of Scope (Size 5 m x 3.5m)

Various applications had been received from local bodies and leaders for considering a

provision of PUP between Km 113-114 near village Dabhor for smooth connectivity for the

nearby villagers as the stretch falls under high embankment zone due to ROB-3 and Major

Bridge 113+160 and there exist access roads on both sides of the highway. The work has

been stopped by the representatives of local villagers for want of an Underpass.

Independent Engineer after conducting a detailed study of the area and 24 hr traffic survey

has submitted a proposal for necessity of an PUP at Ch. 113+306 vide its letter

ICT/IC/IND/NH-8D/NHAI-PD/933 dt 31.03.2014

Preliminary Cost estimate submitted by Concessionaire was reviewed by Independent

Engineer and the recommendation was submitted through letter no. ICT:655:NCS:4817 dt

02 May 14 with an indicative financial implication of Rs. 87.26 Lakhs.

Manager (T) for CGM (T) & RO-Gujarat has sent recommendation to NHAI, HQ for In

principle approval of the competent authority through Letter no. NHAI/12013/2/2010-RO-

Notice for Extension of Time

1. Entitlement of Concessionaire to Extension of Time ("EoT-I'') due to delays in the scheduled four-laning date caused by delayed delivery of land (as of 28 Feb ‘13 -Clause I 0.3.4, I 0.3.5, 12.4.1, 12.4.2, 35.2, 35.3 and 35. 6 and Schedule-G of CA

The appointed date for the project was delayed considerably due to delays in fulfilling CP's

by NHAI in terms of delays in land acquisition. MoEF clearances and other clearances and

the appointed date for the Project was finally declared as 31 March 2012 vide NHAI Letter

No. NHAI/BOT/DBF0/11019/02/07/27425 dt 12 April 2012. The appointed date declaration

thus happened almost 14 months after signing of the CA (and almost 19 months after bid

submission) against the stipulated period of 180 days (approximately 6 months) specified in

CA.

Clause 1 2.4.1 of the CA mandates that 910th day from the appointed date shall be the

"Scheduled Four-Laning Date''. During the meeting on 27 Mar ‘12 with NHAI for

discussions on 'Appointed Date', it was informed to Concessionaire that Land

Acquisition was in a fairly advance stage and FAC clearance for diversion of protected

forest had already been obtained on 24 Feb ‘12. Thus it was reasonably expected that

balance land shall be made available to us within 90 days of appointed date in compliance

with the provisions of clause I0.3.4 of CA.

Concessionaire have been regularly apprising NHAI and IE about this alarming position of

land availability through various communications including the key Issues requiring urgent

actions from NHAI to mitigate the delays in terms of clause 35.6 of CA. However

concessionaire has been severely constrained in his efforts for project execution due

to non-availability of RoW for the land required for the project due to various

factors and has caused irreparable damages to the project schedule.

In view of above, Concessionaire has submitted application for extension of time in terms

of clause 10.3.5 of CA for the delays occurred in the Project till 28 Feb 13 thru letter No.

JSTPL/ IE/ EOT-I/2013 dt 08 March 13 and requested to approve an interim extension of

project completion Schedule in terms of Schedule G, as above for a minimum period of

180 days (Six months).

Further these delays to the Project Completion Schedule and four-laning date will

also affect the COD for the project in terms of clause 15.1 of CA and since these

delays have happened due to breaches on the part of NHAI to provide adequate

RoW for project land as foreseen in the CA, hence also requeste d to grant an

equivalent extension of Concession period in terms of clause 35.3 of CA. IE has

reviewed the application and forwarded the recommendation to NHAI for further

approval. Now, Action from Authority is awaited.

2. Entitlement of Concessionaire to Extension of Time ("EoT'') due to affected by the Force Majeure Event (as of 14 Sep I 3 -Clause 12.4.1, 12.4.2, 34.2, 34.5 and 34. 6 and Schedule-G of CA)

As the project has been witnessed by heavy rainfalls during the on-going monsoon season,

which shall be considered as extremely adverse weather conditions under clause 34.2 of

CA. This heavy rainfall is severely impaired all the works at site including borrow areas

operation, over moist of already laid earth layers, stacked materials of aggregate, stone

dust and sand, which was led to non-execution of any kind of pavement works including

Asphalt works.

Therefore, Concessionaire has requested thru letter no. JSTPL/2013/284 dt 14 Sep ’13 to

consider a minimum entitlement of extension of time by 2.25 months as on 14 Sep ’13, in

terms of Clause 34.6.2 (a) of CA.

3. Entitlement of Concessionaire to Extension of Time ("EoT-II'') due to

delays occurred (till 31 Dec ’13) in handing over ROW for the project at

various stretches due to delay in Land Acquisition and possession thru letter

No. JSTPL/IE/EOT dt 15 Feb ’14.

Delays occurred in the project till Feb’13 due to various reasons as follows:

a. Delays in handing over RoW for the land required for the Project at various

stretches due to delays in Land Acquisition and possession

b. Delays in handing over RoW for the land required for four (4) Villages of Choki,

Bhiyal, Kathrota & Tantivela in a length of 9.6 km due to delays in Land Acquisition

c. Inordinate delays in handing over land at Pedla Village, which has severely affected

the Project works in the stretch of Jetpur Bypass and the surrounding areas

starting from Km 0.000 to km. 11.150 (villages of Navagadh, Pedla, Jetalsar, Navi

Sakli and June Sakli)

d. Delays in the stretch from Km. 99+580 to Km 110+500 due to Special Civil

Application No. 9269 of 2012 against Land Acquisition by NHAI in Six (6) Villages

of Simar, Shukpur, Dari, Supasi, Sidokar, & Kindarwa.

e. Delays in land acquisition and availability of RoW for Junagadh bypass land as per

the alignment proposed in CA.

f. Delays due to change in proposed alignment and delayed approval of revised

alignment for Keshod bypass (due to local representation) leading to revision in LA

requirements and delays in handing over RoW for the land in Keshod Bypass.

g. Delays in land Acquisition due to missing 3D for 27 Villages (missing survey

numbers from earlier published 3D) causing non-availability of RoW for the land

stretches in the affected areas.

h. Delays due to non-availability of RoW for the Toll Plazas (including Traffic Aid Post

& Medical Aid Posts) due to delays in Land Acquisition for the same

i. Delay in start of work for construction of ROB due to non-availability of RoW for

ROB land

j. Delays in handing over RoW for the lane in the stretch from Km. 9+000 to Km.

35+000 due to notice received from DCF for the consent of NBWL

k. Delays in cutting of trees in the non-notified protected forest in the stretch from

Km. 11+120 to Km 20+850 and Km 112+600 t Km 122+130 due to the PIL’s (Writ

Petition No. 99 of 2012 and Writ Petition No. 117 of 2012) causing delay in the

said process and affecting handing over of RoW for those stretches.

l. Delay in procurement of the approval from MoEF for diversion of 129.971 ha of

protected forest land causing delay in handing over of RoW for those land

stretches of the Project.

m. Delays in availability of RoW for the land affected by Utility Shifting of GETCO

n. Delays in availability of RoW for the land affected by Utility of PGVCL

o. Delays in availability of RoW for the land affected by Utility Shifting of GWSSB

The delays occurred due to land acquisition & possession as mentioned above, to the

project completion Schedule and four-laning date, will also affect the COD for the

project in terms of clause 15.1 of CA, and since these delays have happened due to

breaches on the part of NHAI to provide adequate RoW for project land as foreseen

in the CA, concessionaire requested Authority to grant an equivalent extension of time

of Concession Period in terms of clause 35.3 of CA.

PD-NHAI has recommended 96 days EOT (addition to EOT-I recommendation) i.e. shifting of Milestone –IV up to 30th June ’15 to the Authority through letter no. NHAI/PIU/RJK/Jet-Som/2013/D-038 dt 27.03.2014. As RO, NHAI has raised certain observations on this, JSTPL has JSTPL submitted the clarifications to the observations raised by NHAI RO through letter no. JSTPL/IE/991/2014 dt 21 May 2014. Approval from NHAI is awaited for revision of Milestones and extension of Project Completion Schedule.
