The Municipalities Act [sections 53, 56, 57, 59, 61, 62 and 63]

ALTERATION OF BOUNDARIES — BETWEEN THE RESORT VILLAGE OF WAKAW LAKE AND THE RURAL MUNICIPALITY OF HOODOO NO. 401
1 Pursuant to sections 53, 56, 57, 59, and 61 of The Municipalities Act, the Council of the Resort Village of Wakaw Lake has submitted an application to alter its boundaries to the Minister of Municipal Affairs.
2 Upon consideration of the application, the Minister is of the opinion that the municipalities affected will be viable entities following the alteration of boundaries. Therefore, the undersigned hereby orders, pursuant to sections 61, 62, and 63 of The Municipalities Act, that:
(a) the boundaries of the Rural Municipality of Hoodoo No. 401 and the Resort Village of Wakaw Lake be altered by withdrawing from the rural municipality and adding to the resort village the territory described in Schedule A;
(b) Schedule B is conclusively deemed to be the legal description of the boundary of the Resort Village of Wakaw Lake; and
(c) the alteration shall take effect on and from the date of this Order.Dated at the City of Regina, in the Province of Saskatchewan, the 17th day of August, 2011.

SCHEDULE AThe boundaries of the Resort Village of Wakaw Lake are altered by adding to the resort village and withdrawing
from the Rural Municipality of Hoodoo No. 401 the following lands, lying within Township 42, Range 26, West of the Second Meridian, described as:
(1) The following portions of the south-east quarter of Section 26:
(a) Parcel A, Road Plan No. 101992507; and(b) Parcel B, Road Plan No. 102033177.

SCHEDULE BThe boundaries of the Resort Village of Wakaw Lake shall comprise the territory in the Province of
Saskatchewan lying within:
Township 42, Range 26, West of the Second Meridian and described as:
(1) All of the south-east quarter of Section 27 lying south of the south bank of Wakaw Lake;
(2) All of the south-west quarter of Section 26 lying south of the south bank of Wakaw Lake;
(3) The following portions of the south-east quarter of Section 26:
(a) That portion lying south of the south bank of Wakaw Lake and north of the south boundary of Road Plan No. AV1275;
(b) Road Plan No. 102033177; and(c) Road Plan No. 101992507;
(4) All of the most westerly 221.3 m of the north-west quarter of Section 25 lying south of the south bank of Wakaw Lake;
(5) All of the most westerly 221.3 m of the most northerly 125.6 m of the south-west quarter of Section 25 lying south of the south bank of Wakaw Lake.
Unless otherwise specified, the sections and portions of sections described in the above schedules include the adjoining south and west road allowances, intersections thereof and widenings thereto by plan of survey.
For description purposes, the land acquired by plan of survey for widening to an adjoining road allowance is deemed to be part of the road allowance.

THE CHICKEN MARKETING PLAN REGULATIONS – STATISTICS AND REPORTINGOrder No. 49/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 Producers shall provide the following information to the Board:
(a) a report on the actual number of chicks placed at the beginning of each production cycle at the time of chick placement; and
(b) full chicken production reports for any and all Board-specified production cycles.
2 Each processor shall submit to the Board any Board-requested reports relating to:
(a) the price, quantity, storage stocks, dead on arrivals, condemnations and inter-provincial movement of chicken or chicken products of any grade, quality or class at the request of the Board; and/or
(b) the processing of chicken or chicken products within 10 business days from the date of processing or, if necessary, immediately upon request of the Board.
3 Catching crews shall submit any Board-requested reports with respect to the information required in clause 2(a).
4 All hatcheries or individuals selling chicks shall report chick placements to the Board upon request.
5 Any person engaged in the marketing of chicken or chicken products shall submit to the Board information relating to the marketing of chicken or chicken products immediately on request of the Board.
6 Failure to provide any of the information listed above will result in a financial penalty of between $100 and $500 per day depending on the information that is required.
7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.
Order No. 49/11 is made pursuant to clauses 5(a), 7(f) and (h) of The Chicken Marketing Plan Regulations and shall be effective upon the date of this Order. By order of the Chicken Farmers of Saskatchewan.

LICENCE SUSPENSION, CANCELLATION AND REINSTATEMENTOrder No. 50/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 The licence of any producer who violates a provision of the Act or The Chicken Marketing Plan Regulations shall be suspended or cancelled.
2 A producer’s licence may be suspended or cancelled if that producer fails to respond or comply within 15 business days of being notified that the producer is in violation of a Board Order.
3 All producer licence suspensions or cancellations shall take effect following the completion of the producer’s current production cycle.
4 If a producer’s licence has been suspended under section 1 or 2, the licence may be reinstated if the Board is satisfied that the producer is in full compliance with the Board Orders.
5 Suspension and cancellation notices shall be delivered to the licensed producer via registered mail, fax or e-mail at least 30 days prior to the suspension or cancellation taking effect or at the end of that producer’s production cycle.
6 A producer whose licence has been suspended may lease their base quota following the procedures of Order No. 60/11 (Base Quota Leasing) or may transfer their base quota following the procedures of Order No. 55/11 (Base Quota Transfers).
7 With respect to section 6, if a lease is not requested by the suspended producer, the Board shall allocate that producer’s’ periodic allocation to all other licensed producers on a pro rata basis.
8 A producer whose licence has been cancelled under the provisions of this Order shall have their periodic allocation re-allocated on a pro rata basis to all other licensed producers until a base quota auction can take place for the entire base quota associated with the cancelled licence.
9 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.
Order No. 50/11 is made pursuant to section 26, clauses 5(a) and 7(gg) and subclauses 7(y)(i) and (y)(ii) of The Chicken Marketing Plan Regulations and shall be effective upon the date of this Order. By order of the Chicken Farmers of Saskatchewan.

LEVIESOrder No. 51/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 All licensed producers shall be subject to the following levies on all chicken produced, marketed, or produced and marketed in the Province of Saskatchewan:
(a) a Chicken Farmers of Saskatchewan operating levy of $0.0116 per kilogram of live chicken;
(b) a development levy of $0.0025 per kilogram of live chicken; and
(c) a Chicken Farmers of Canada levy in the amount stated in the Chicken Farmers of Canada Levies Order.

2 The levies referred to in section 1 are payable to the Board by each licensed producer through a deduction from the producer’s settlement by the licensed processor at the time of marketing.
3 Each licensed processor shall make all of the prescribed deductions from the producer’s settlement and shall remit these deductions to the Board on a monthly basis on or before the fifteenth day of the month following the month the deduction is made.
4 If a licensed producer delivers to anyone other than a licensed processor, the producer shall forward the levies referred to in section 1 directly to the Board within 10 business days of the marketing.
5 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

MINIMUM LIVE PRICE FOR CHICKENOrder No. 52/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The

1 From time to time the Board shall determine and set a minimum live price based on the cost of production.
2 Notice of the minimum live price shall be sent two days prior to the beginning of the production cycle and shall be:
(a) forwarded to all licensed producers and registered processors via mail, fax or e-mail; and
(b) mailed, faxed or e-mailed to other persons as the Board deems necessary.
3 No licensed producer shall sell, and no processor shall buy, live chicken at a price that is less than the minimum live price determined by the Board.
4 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.
Order No. 52/11 is made pursuant to subsection 40(2) and clauses 5(b) and 7(bb) of The Chicken Marketing Plan Regulations and shall be effective upon the date of this Order. By order of the Chicken Farmers of Saskatchewan.

PRODUCER LICENCEOrder No. 53/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 A “person” shall include an individual, corporation, cooperative, trust and any other entity designated as a person under The Interpretation Act, 1995 or the Income Tax Act (Canada) and shall include members of a family unit, specifically, the person, spouse, siblings, parents and issue of this person, and operating as a single economic unit.
2 Any person and/or production unit producing more than 999 chickens in a calendar year in Saskatchewan is required to hold base quota rights and must be licensed by the Board.
3 No licensed producer shall hold more than one Board-issued licence.
4 Before December 31st of each year, all producers shall apply to the Board for a licence on a Board-provided application form.
5 Producers who are licensed and are in compliance with all orders and regulations of the Board shall be eligible for licence renewal.
6 Producer licences issued by the Board shall take effect on January 1st and shall expire on December 31st of each year.
7 Any late licensing applications will be subject to a financial penalty of $500 per month which will be invoiced to the producer upon the receipt of the application by the Board office.
8 All licensed producers shall produce their base quota in a production unit owned by the licensed producer; however, the Board may give special permission for licensed producers to produce in production units owned by other licensed producers through a lease agreement on a short-term basis that does not exceed 12 months.
9 Licensed producers shall own or lease the land on which their production unit(s) is/are situated and shall provide to the Board verification of land ownership or a copy of the existing land lease agreement with legal land location(s).
10 In the event that a new producer acquires base quota through a base quota transfer at any time during the calendar year, the new producer will be issued a new licence by the Board following which the producer is required to adhere to the same application requirements as all other licensed producers.
11 Any person who is not licensed under The Chicken Marketing Plan Regulations and who produces, markets or produces and markets 1,000 or more chickens in a calendar year may be liable for a charge of $5.00 for each chicken marketed.
12 The Board may have an inspector and/or auditor inspect production sites and/or production records of licensed producers.
13 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.
Order No. 53/11 is made pursuant to sections 22, 23 and 36, clauses 5(a), 7(f) and (ff) and subclause 7(ee)(i) of The Chicken Marketing Plan Regulations and shall be effective upon the date of this Order. By order of the Chicken Farmers of Saskatchewan.

ON-FARM FOOD SAFETY ASSURANCE PROGRAMOrder No. 54/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 All production units must be Board-certified under the On-Farm Food Safety Assurance Program (OFFSAP), an animal care program established by the Chicken Farmers of Canada, and must be annually recertified by complying with the provisions of annual audits.
2 New licensed producers whose production units are not OFFSAP-certified must be engaged in the process of initial OFFSAP certification by:
(a) submitting to the Board a one-time fee of $500 plus tax within one month of the approval of their new licence; and
(b) disclosing to the Board within three months of their initial flock placement all required information regarding production unit completion and initial placement dates.
3 In the event that a licensed producer’s production unit is not OFFSAP-certified or a new licensed producer’s production unit is not engaged in the process of initial OFFSAP certification, the Board shall have the discretion to impose one or more of the following sanctions with respect to the infringing licensed producer:
(a) provide additional time to comply with certification, recertification or initial certification under certain terms and conditions;
(b) impose monetary penalties on all kilograms marketed while the production unit is not certified or compliant;
(c) reduce the producer’s periodic allocation as deemed appropriate by the Board;
(d) suspend, cancel or refuse to renew the producer’s licence; or
(e) impose other sanctions or take such actions as may be required to ensure the producer’s production units are OFFSAP-certified.
4 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

BASE QUOTA TRANSFERSOrder No. 55/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 The Board may approve the transfer of all or a portion of a producer’s base quota to another production unit or to a new licensed producer when:
(a) the transferor (seller) and the transferee (purchaser) have successfully completed and submitted all Board-required transfer forms and are in compliance with all regulations and orders of the Board;

(b) the transferee has identified to the Board:
(i) any legal interest of any nature that they may have in other base quota, production units or processing companies; and
(ii) the registered processor to whom they intend to market the transferring quota;
(c) the transferee has agreed to abide by all regulations and orders;
(d) the transfer will not result in production units larger than, or base quota ownership greater than, the limits defined by the Board as stated in section 3 of Order No. 58/11 (Base Quota Limits);
(e) the Board has determined the effective date of the transfer such that it corresponds with the end of a particular production cycle; and
(f) in the event the transferor has over-marketed, all outstanding levies and judgments with respect to that over-marketing are paid by the transferor to the Board prior to the transfer taking place.
2 Quota will not be transferred out of the Province of Saskatchewan.
3 When the transfer involves a portion of the transferor’s base quota, the transferor shall retain the production sleeve addition or reduction of kilograms prescribed in Order No. 57/11 (Over and Under Production).
4 With respect to section 3, if the kilogram reduction is greater than the transferor’s base quota, the licensed producer will be allocated zero kilograms for that periodic allocation.
5 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

PROCESSOR REGISTRATIONOrder No. 56/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The

1 Any party engaged in the processing of more than 1.0 million kilograms of live chicken in a calendar year shall register annually with the Board using an application form provided by the Board.
2 New processors that have not yet established how much live chicken they will process annually will be allowed a one-year period before registration is required.
3 A registration fee of $25 payable to the Chicken Farmers of Saskatchewan is due at the time of application.
4 Board-issued processor registrations shall take effect on January 1st and shall expire on December 31st of each year.

5 For late registration applications, a financial penalty of $500 per month will be invoiced to the processor upon the receipt of the application by the Board office.

OVER AND UNDER PRODUCTIONOrder No. 57/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 A production sleeve between 95% and 105% shall be established by the Board.
2 Licensed producers who market less than 100% of their allocated kilograms during a production cycle but not less than 95% of the allocated kilograms will have this deficit added to their periodic allocation six production cycles later.
3 Licensed producers marketing in excess of 101% of their allocated kilograms during a production cycle will have those excess kilograms deducted from their periodic allocation six production cycles later.
4 With respect to the excess kilograms referred to in section 3, in the event that those kilograms are greater than the base quota held by the licensed producer in the production cycle in which the deduction is to occur, the remaining excess kilograms will be deducted in the immediate consecutive production cycle(s).
5 Each licensed producer producing more than 101% of their assigned periodic allocation will be invoiced by the Board overproduction penalties of:
(a) $0.44 per kilogram marketed for all production over 105% but less than 110%; and
(b) $0.88 per kilogram marketed for all production over 110%;
which must be paid to the Board within 20 business days of the invoice date.
6 The failure to pay any overproduction charges referred to in section 5 will result in the Board requesting that the processor deduct and submit to the Board the overproduction penalties from the licensed producer’s next production cycle marketings.
7 The processor shall deduct any requested overproduction penalties as described in section 6 and shall remit those monies to the Board within five business days of the payment being made to the penalized producer for the next production cycle marketings.
8 If the overproduction penalty is not collected by any of the above means, the Board shall suspend the producer’s licence in accordance with Order No. 50/11 (Licence Suspension, Cancellation and Reinstatement).
9 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

BASE QUOTA LIMITSOrder No. 58/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 The following definitions are applied in this Order:
(a) “person” shall include an individual, corporation, cooperative, trust and any other entity designated as a person under The Interpretation Act, 1995 or the Income Tax Act (Canada) and shall include members of a family unit, specifically, the person, spouse, siblings, parents and issue; and
(b) “interest” shall be determined by deeming a person to have full ownership of any corporation, partnership or cooperative such person has ownership in, or any other contractual or other relationship with which such person is involved.
2 No person, either directly or indirectly, in any manner whatsoever including without limiting the generality of the foregoing through an interest in a corporation, partnership, cooperative or in any other manner including by agreement through a trust, through his or her spouse, siblings, parents or issue, may hold more than 6.0% of the total base quota allocated by the Board, unless such trust, spouse, siblings, parent or issue constitutes a separate economic unit.
3 No more than 6.0% of all base quota allocated by the Board may be produced at one production facility and premises.
4 For the purpose of sections 2 and 3, the amount of base quota shall be determined as follows:
(a) the holding of base quota for a person is the sum of:
(i) the base quota held by that person;
(ii) the full quota of any corporation, partnership, cooperative or any other entity in which a person has an ownership interest; and
(iii) any base quota in which the person has an ownership interest as a lessee of quota; and
(b) the holdings of a corporation, partnership, cooperative or any other entity is the sum of:
(i) the base quota held by that corporation, partnership, unincorporated organization or group of individuals;
(ii) the full quota of any corporation, partnership, cooperative or any other entity which a person has ownership interest in; and
(iii) any base quota in which the corporation, partnership, cooperative or any other entity has an ownership interest as a lessee of quota.

5 The Board shall not allocate, reallocate or approve the lease of any base quota if as a result of that allocation, reallocation or lease, any person would hold quota in excess of that allowed pursuant to this Order.
6 Subject to section 9 of the Act, the Board may reduce, suspend, or cancel base quota if the licensed producer to whom it was allocated or the person to whom is has been leased:
(a) has failed to observe, perform or carry out the provisions of the Act, these regulations or an order of the Board;
(b) is not utilizing or has voluntarily given up all or part of that producer’s base quota or portion leased;
(c) has not received the approval of the Board for any change of ownership interest in relation to that producer if a base quota has been allocated or leased in the name of a company; or
(d) has had their licence cancelled or suspended.
7 Base quota that has been cancelled pursuant to section 6 shall be returned for auction in accordance with procedures described in Order No. 65/11 (Base Quota Auction Process).
8 No producer shall be compensated for any quota cancelled pursuant to section 6.
9 Quota that is allocated to a licensed producer shall relate to and be attached to a particular production unit that is situated in Saskatchewan on a legally defined parcel of land registered at the Land Titles Office.
10 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

BASE QUOTA LEASINGOrder No. 59/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 All transactions in which a licensed producer leases their base quota (leaser) to another licensed producer (lessee) must adhere to the requirements outlined in this Order.
2 A lease application must be made on the basis of kilograms of base quota to be produced in a given production period.
3 A complete, written lease quota application signed by both the leaser and lessee must be:
(a) submitted to the Board office four weeks prior to the lessees’ chick placement date;
(b) limited to one production period at a time; and
(c) include any other information that the Board requires.
4 Subject to section 5, the maximum allowable amount of quota that may be leased out by any licensed producer at any given time is 25% of that producer’s base quota.

5 More than 25% of a producer’s base quota may be leased at any given time upon the approval of the Board and the request of the leaser if:
(a) an ‘Act of God’ requires a licensed producer’s production unit to be out of operation for a period of time; or
(b) a start-up period of no longer than five production cycles is needed to allow for new licensed producers to build or acquire production units acceptable for production.
6 Any lease authorization granted by the Board may be subject to terms and/or conditions that the Board considers appropriate in the circumstances.
7 The leaser and lessee are:
(a) jointly responsible for the marketing of chicken in accordance with these regulations; and
(b) jointly and individually liable for:
(i) all service charges and levies assessed pursuant to these regulations; and
(ii) any judgment obtained in respect of service charges or levies assessed pursuant to these regulations.
8 The Board shall not allow a lease of base quota from a leaser to a lessee if:
(a) either party has outstanding service charges, overproduction penalties or levies payable to the Board; or
(b) the proposed lessee would exceed the base quota limit established by these regulations.
9 No subleasing of base quota shall be permitted.
10 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

COMMUNAL GROUP PRODUCTION EXEMPTIONOrder No. 61/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 A “communal group” shall be defined as persons living in a communal situation for such reasons as faith, lifestyle or other valid reason and whose resources and income are shared in some manner other than by partnership or joint venture.
2 By filing a complete, Board-provided application form, a communal group may apply to the Board for a communal group production exemption (exemption) to produce 5,000 or less chickens in any given year without having to own quota or meet the licensing requirements of Order No. 53/11 (Producer Licence).
3 The Board may grant an exemption if the applying communal group:
(a) is not a licensed producer with the Board; and
(b) resides on or adjacent to the same parcel of land on which the production facilities are located at which the chicken is produced.
4 Chicken produced under an exemption must only be:
(a) used by the communal group for personal use; and/or
(b) marketed to consumers from:
(i) the land referred to in clause 3(b);
(ii) the land that is adjacent to the land referred to in clause 3(b);
(iii) a stall at a farmers market; or
(iv) any other means of sale that the Board deems acceptable.
5 Exemption service charges in the amount of $350 must be paid to the Board by:
(a) the exemption applicant when submitting an exemption application; and
(b) the exemption holder by January 31st of each year.
6 Failure to submit the annual service charge required in clause 5(b) may result in the Board cancelling the exemption.
7 An exemption may not be sold, transferred, reallocated, leased or divided.
8 Within two weeks of the delivery of chicks to the exemption holder, the exemption holder must report to the Board, via a copy of the delivery invoice, the number of chicks so acquired.

9 If the exemption holder is granted an allocation or reallocation of an authorized base quota, the exemption is cancelled.
10 An exemption may be reduced or cancelled, either permanently or for such period as the Board considers appropriate, if an exemption holder:
(a) produces in excess of 5,000 chickens in any calendar year;
(b) fails to comply with clause 4(b) when marketing any chicken; or
(c) fails to report the information required by section 8.
11 Before the Board proceeds to amend this Order, the Board must:
(a) provide 30 days written notice of the proposed amendments by ordinary mail to all exemption holders; and
(b) accept and consider any and all relevant feedback provided by the exemption holders with respect to the proposed changes.
12 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

LICENCE SUSPENSION OR CANCELLATION CRITERIA WITH RESPECT TO ANIMAL CRUELTY ISSUES
Order No. 62/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 Acceptable criteria to suspend or cancel a licence include, but are not limited to, one or more of the following:
(a) a written statement indicating the inhumane treatment of poultry that is made on behalf of a processor, hatchery, federal or provincial official, veterinarian or any other group which the Board deems to be a relevant industry stakeholder;
(b) the confirmed mistreatment of poultry causing unnecessary suffering including, but not limited to, lack of feed and water, bird discomfort, pain, injury, disease, fear, distress and lack of ability to express normal behaviour;
(c) a registered producer being charged and convicted under section 445 or 446 of the Criminal Code, which relates to the prevention of cruelty to animals; or
(d) the receipt of notification from a CFIA inspector indicating that poultry failing to meet federal or provincial government standards has arrived at a processing plant.
2 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

1 In this Order a production cycle is defined as the established production cycle set out by the Chicken Farmers of Canada.
2 Licensed producers who plan to switch from their current processor to a different processor must:
(a) provide notice to the current and future processors, as well as Chicken Farmers of Saskatchewan Board, no less than three production cycles in advance of the anticipated switch; and
(b) continue to market chicken to their current processor for the three production cycles (inclusive) following the provision of notice.
3 The three production cycle notice requirement of section 2 is not required if:
(a) both affected processors submit to the Board written documentation indicating that the licensed producer will be switching processors and that both processors agree to an earlier switch date; or
(b) the transfer forms indicate that the licensed producer’s transferred base quota is not produced in the same production unit as the un-transferred production.
4 All processor transfers in which the transferred base quota is being produced in the same production unit must respect the three cycle time frame.
5 Marketing in violation of this Order may result in the suspension of a producer’s licence.
6 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 Prior to August 31, 2013 all licensed producers must be in full compliance with all Animal Care Program (ACP) guidelines (as established by the Chicken Farmers of Canada) with the exception of the stocking density requirement.
2 As of September 1, 2013 all licensed producers must be in full compliance with all ACP guidelines including the stocking density requirement.
3 In the event that a licensed producer does not meet the ACP guidelines within the timeframes established in sections 1 and 2, the Board shall have the discretion to impose one or more of the following sanctions with respect to the infringing licensed producer:
(a) provide the producer with additional time to comply with certification, recertification or initial certification under certain terms and conditions;
(b) impose monetary penalties on all kilograms marketed while the production unit is not certified or compliant;
(c) reduce the producer’s periodic allocation as deemed appropriate by the Board;
(d) suspend, cancel or refuse to renew the producer’s licence; or
(e) impose other sanctions or take other actions as may be required to ensure that producer’s production units are ACP certified.
4 Using the same schedule established by Order No. 54/11 for the On-Farm Food Safety Assurance Program (OFFSAP), the farms of licensed producers will be audited under the ACP.
5 The Board may establish guidelines that can be used for the enforcement, administration and application of the ACP.
6 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.
Order No. 64/11 is made pursuant to clauses 5(a), (d) and 7(h) of The Chicken Marketing Plan Regulations and shall be effective upon the date of this Order. By order of the Chicken Farmers of Saskatchewan.

BASE QUOTA AUCTION PROCESSOrder No. 65/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 In the event that an auction is to be held, the Board shall advertise the time, date and location of the auction.
2 As determined by the Board, the base quota will be set out in blocks of kilograms, the size of which will be dependent on the overall amount of base quota to be auctioned.

3 The auction will be performed by a licensed auctioneer.
4 The highest bidder for each block of kilograms will be the successful bidder for that block of base quota; however, the Board reserves the right to refuse the highest bid if that purchaser has exceeded their base quota limit maximum as defined by Board Order No. 58/11 (Base Quota Limits).
5 In the event of an auction for the base quota resulting from the cancellation of a licence, the licensed producer shall receive the auction’s net proceeds, i.e., the total auctioned value of the cancelled base quota less all Board expenses related to the conduct of the auction, including advertising.
6 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.
Order No. 65/11 is made pursuant to section 33, clause 7(dd), and subclauses 7(y)(i) and (y)(ii) of The Chicken Marketing Plan Regulations and shall be effective upon the date of this Order. By order of the Chicken Farmers of Saskatchewan.

BASE QUOTA ALLOCATIONSOrder No. 66/11. The CHICKEN FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The
Chicken Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 Base quota allocations granted to licensed producers shall be stated in terms of the maximum number of live kilograms per production cycle.
2 The Board may establish quota allocations and the length of a production period.
3 From time to time the Board may change the length of a production period.
4 The Board shall provide each licensed producer with a quota allocation notice that shall remain in effect until further notice.
5 Periodic quota allocations shall relate to the quantity of chicken to be marketed during each production period; for each production period these allocations shall be stated in numbers of live kilograms and as a percentage of a licensed producer’s base quota.
6 Permits may be issued for the temporary production and marketing of specific quantities of chicken in a specific production period for research purposes; such permits do not qualify the holder toward the allocation of permanent base quota.
7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.
Order No. 66/11 is made pursuant to sections 30 and 34 and subclauses 7(y)(i) and (y)(ii) of The Chicken Marketing Plan Regulations and shall be effective upon the date of this Order. By order of the Chicken Farmers of Saskatchewan.

SASKATCHEWAN REAL ESTATE COMMISSION — BYLAW AMENDMENTSTHAT the Saskatchewan Real Estate Commission approves the following bylaws:
Title
1 These bylaws may be cited as The Saskatchewan Real Estate Commission Professional Corporation Bylaws.
Definitions
2 In these bylaws:
(a) “Commission” means the Saskatchewan Real Estate Commission;

(b) “Real Estate Agent” means real estate agents as defined in “The Professional Corporations Regulations”;
(c) “Professional Corporation” means a professional corporation within the meaning of The Professional Corporations Regulations;
(d) “Registrar” means the registrar of the Commission appointed pursuant to s.7 of The Real Estate Act, S.S. 2005, c.R-1.3.
(e) “Professional Services” means the activities permitted under The Real Estate Act, The Real Estate Regulations and the Saskatchewan Real Estate Commission Bylaws.
Delegation to registrar
3 Pursuant to section 11 of The Professional Corporations Act, the Commission delegates to the registrar the power to:
(a) register professional corporations;
(b) issue permits to professional corporations; and
(c) revoke a permit issued to a professional corporation.
Application for and renewal of permit
4(1) A real estate agent may apply to the Commission on behalf of a professional corporation for a permit pursuant to section 8 of The Professional Corporations Act by providing to the registrar the information required by that section together with an application fee of $500 and an application in Form 1.
(2) A real estate agent may apply to the Commission on behalf of a professional corporation for a renewal of a permit pursuant to subsection 8(5) of The Professional Corporations Act by providing to the registrar the information required by that subsection together with a renewal fee of $200 and a renewal application in Form 2.
Register
5 The registrar shall keep and maintain a register of professional corporations which shall include the following information:
(a) the name of each professional corporation;
(b) the registered office and business addresses of each professional corporation;
(c) the name and address of each director of each professional corporation;
(d) the dates of issuance and renewal of permits; and
(e) the conditions attached to each permit.
Corporation shares
6 A real estate agent must own more than 51% of the common shares of the professional corporation.
Fees
7 The fees prescribed by the Saskatchewan Real Estate Commission must be paid upon initial application for a permit and then annually in respect of any renewal of the permit before December 1 for the following year.
Procedure
8 The professional corporation shall file the application for renewal of an annual permit by December 1 of each year for the following year.
Late payment fee
9 A professional corporation failing to file the application for renewal by December 1 for the following year is subject to a late payment fee of $100 at the discretion of the Commission.

10 A professional corporation providing professional services must advertise in the name as stated on the issued permit preceded by the name of the real estate agent associated with the professional corporation pursuant to section 6 of The Professional Corporations Act.
Proposed changes in corporate structure
11(1) A professional corporation shall immediately notify the registrar in writing of any proposed change of name or of any proposed changes to its corporate structure, ownership or directors.
(2) The registrar may provide his or her consent to a change in the name, corporate structure, ownership or directors of a professional corporation if he or she is satisfied that:
(a) the proposed name of the corporation is not so similar to the names of other professional corporations as to be misleading or confusing; and
(b) the professional corporation will meet the requirements of The Professional Corporations Act.
Refusal by registrar to issue a permit
12 Where the registrar makes a decision to refuse the issuance of a permit to a professional corporation, the real estate agent who is aggrieved by the registrar’s decision has a right to a review of the decision pursuant to section 12 of The Professionals Corporations Act.
Coming into force
13 In accordance with subsection 19(2) of The Professional Corporations Act, these bylaws come into force when they are approved by the Minister of Justice and are published in the Gazette.
