he KwaDukuza SAPS Family Violence, Child Protection and Sexual Offences Unit (FCS) has Treceived many
accolades for their stellar conviction rates in terms of rapist s c u m b a g s g e t t i n g multiple life sentences and more.
However when the Xpress Times visited t h e l a u d e d F C S operations office, we found more than what is expected of a regulation FCS unit.
Situated in a prefab, the unit comprising of 12 officers, share a very small space and most importantly victims are denied privacy and specialised care.
According to one of the officers, complaints about the working conditions have fallen on deaf ears for five years now.
A t t h e t i m e o f collecting information while the national broadcaster, the SABC, was compiling their televised report; we found that an FCS official was using the periphery of the prefabs to do work with a child

T h e I l e m b e D i s t r i c t Municipality along with councillors and officials, N d w e d w e m u n i c i p a l i t y councillors, Mashiyamahle High School pupils and teachers, Civil Society and N d w e d w e c o m m u n i t y members demonstrated their anger by picketing against Zwelakhe Max Maphumulo when he appeared in the Ndwedwe Magistrate Court last Friday, 6 May 2016 for raping and murdering young Lungile Cele - his neighbour.
The Ndwedwe community protested in court pleading with the court to give Zwelakhe life sentences for the gross violations against the community of Mwolokohlo at Ndwedwe.
Zwelakhe in 2014 raped, strangled and murdered Lungi le Cele who was returning from a school trip

Mthembu and his delegation to the Stanger main Mosque before the midday prayer on Thursday, 5 May 2016. Mthembu was informed about the practices and given insight into Islam by Moulana Cassim Xulu, before being treated to lunch.
Mthembu thanked the Muslim community for the opportunity to learn more about a new culture.

DA provincial leader visits Ilembe
Mr Zwakeke Mncwango, DA KZN leader, visited Ilembe on Thursday, 5 May 2016. He was welcomed by councillors and activists in KwaDukuza and then went to Maphumulo. The delegation was led by Cllr Madhun Sobram Sing interacted with residents and vendors, some homes visited did not have electricity while others were left in the dark due to cable theft. Vendors complained they needed shelter and had to sell their goods in the scorching heat. “At least if we were provided with umbrella it will be fine” said one vendor.

In an unlikely sequel to the front page article: “Mayor speaks ou t on recen tprotests” (Xpress Times:6/05/16), the trend continued with protests in Nkobongo and Tugela this past week.
According to reports, the protest revolved around political processes with r e g a r d s t o c a n d i d a t eselections. Like the protests locally in Rocky Park and T h e m b e n i , p r o t e s t o r sblocked the roads
in both areas. Nkobongo is a township that is in the vicinity of Shakaskraal and Protea Heights and became popular post apartheidd u r i n g t h e M a n d e l aadministration.
District Service Excellence Awards heldAWARDS CEREMONY: The Ilembe Health District Office hosted the District Service Excellence Awards at the KwaDukuza Town Hall on Friday, 6 May 2016. Officials that go beyond the call of duty were awarded at the event. Seen are some of the attendees

KWADUKUZA MUNICIPALITY
BACKGROUND:The Municipality appointed SMA Ngcobo Consortium (Tender Number MN 167/2012) as Service Provider to undertake tasks related to the Ethafeni Planning and Development Framework Plan Project. The project involves the formalisation of the Ethafeni Area through preparation of specialist's studies which will culminate to the submission and authorisation of the area in terms of a formal township establishment process.
As part of this process, consultation with various stakeholders including the department of Economic Development, Tourism and Environmental Affairs (DEDTEA) was done and DEDTEA directed the Municipality to prepare and submit an application in terms of Section 24G of NEMA which application was not part of the original scope for the original tender. It is against the above that the Municipality intends to amend the existing contract with SMA Ngcobo Consortium in terms of Section 116(3) of the MFMA in order to accommodate this additional project scope.
SECTION 24 G PROCESS:The tasks related to the preparation and submission of the Sec 24G application to the DEATEA include the preparation of specialists studies such as Wetland Functionality Study, Wetland Rehabilitation, Geohydrological Assessment and payment of S24 G Application Fees. The service provider has indicated that these additional studies will cost approximately R 664 500, 00 (excl. VAT) which costs will form part of the amendment of scope of contract.
ENQUIRIES:Members of the public who wish to make representations in relation to the above-mentioned contract amendment are hereby called to make submissions to the Municipality by no later than 12h00 on Friday, 27 May 2016.

According to KwaDukuza SAPS liaison officer, Inspector Johannes Khoza, a decomposed body was found at Sakamkhanya in Doringkop on Saturday, 7 May 2016 at 1am.
“The Umhlali Dog Unit found the body of a 38-year-old woman w i t h w o u n d s resembling chopper strikes,” said Ins. Khoza.
The dogs initially found a towel and then led handlers to the body itself.

KDM to fork out R2 billion for Civic Centre rental
The KwaDukuza Concerned Citizens Group has undertaken making the community of KwaDukuza and surrounds aware of the facts regarding the proposed development of a shopping mall and civic precinct on the land where the sporting facilities currently stand. They have, thus far, compiled the following information:
KwaDukuza Municipality's (KDM) original plan was for re-development of the KwaDukuza Golf Course only and did not include the Recreation and Country Club Grounds and the building of a mall. KDM did not advertise its intention in any of the local newspapers. KDM's intentions appear to be to do the deal in a somewhat surreptitious manner. The developer claims that re-development of the golf course bid was advertised on the municipal website on 3 December, 2013 and in local and national newspapers.
KDM did not consult with its citizens as is required by legislation. Due processes have not been followed. Ratepayers and ward residents have not been consulted in the decision making process. Most citizens are unaware of their intentions.
The tender process was procedurally unfair because the preferred bidder changed the specifications of the development during the bidding process to include a mall, changing the site to a mixed use site and including the central sports complex that was not originally included.
Timing of the preferred bidders “gift” of a R6 million skills development centre could not have been more improper, considering that the bidder's tender was undergoing the bidding process. KDM in approving this “gift” compromised the credibility and integrity of the supply chain management process of the mall development and that both KDM and the preferred bidder did not comply with ethical and moral standards. Furthermore, KDM appears to have done too little groundwork and did not consider the negative financial impact on the entire region by embarking on a project of this magnitude e.g. increased rates, electricity, water etc.
The overall site area to be acquired by the developer is 24,213 hectares at a cost of not less than R8 million. The area is to be utilised as follows: mall development 8, 4726 hectares; civic centre 2, 0908 hectares; road reserve 1, 2408 hectares; future development including future road reserves and servitudes 8, 0374 hectares and wetland 4, 4097 hectares area to be maintained by developer. It is significant to note here that plans are in place to re-zone this area from private and public open space to general commercial zone and new street reservation in terms of the KwaDukuza/Stanger Town Planning Scheme.
Inference to be drawn from land acquisition is that as the existing sports complex has been deliberately allowed to decay over the past 21 years with very little maintenance and no upgrades. The argument advanced is that as a result of the dilapidated condition of the sports complex it is not worth more than the R8 million. However, if the area is re-zoned as commercial first and then subsequently put out to tender, surely it will fetch much more than the bid price, perhaps more in the region of R50 million.
Anticipated capital expenditure for the proposed development as provided by the developer is expected to total R707 million. The breakdown is as follows: infrastructure development R49m; sports facilities relocation a paltry R3m; retail centre R390m; civic centre R265m.
KDM maintains that it is experiencing fiscal constraints, given the economic meltdown that is likely to escalate with consumers failing to pay for services. Furthermore, it maintains that it will be difficult to arrange finances given its current financial strength; that it will be required to inject some equity and that it will have to make re-payment of the debt all of which will strain its cash flows.
Against this backdrop, hardly a week goes by without an article appearing in our local newspapers singing the praises of how good this municipality is performing as it wins accolades and awards aplenty. Also, we are bombarded with clean audit reports; how much this municipality has done and achieved for this region via expensive billboards displayed all over town etc, in the light of all this their arguments seem shallow when all of these accolades are taken into account. There is also no indication whatsoever whether any tangible efforts were made to obtain funding from national government or any financial institution. And, if the municipality is really so good on all fronts as it claims, then surely obtaining finance for this project should be a cake-walk! Unless of course, all of this is electioneering talk; everything is not as rosy as they would like everybody to believe and it really is the calm before the storm.

Letters to the Editor KDM accepted the BOT (Build Operate Transfer) model as a vehicle to deliver construction of the civic centre. This is an expensive model to use as it is obviously overpriced and the ratepayers will be compelled to fund the entire project. This model has immense financial implications for ratepayers. According to information only five wards out of a total of 27 wards (now 29) in this region contribute to the rate base. The total rentals payable to the developer will be R1, 730 billion over a 20 year period.
However, should the municipality elect to finance this project at a cost of R265 million over a 10 or 15 year period, the total repayments inclusive of capital and interest totals R465 million and R548 million respectively. The municipality is therefore paying in excess of between R1, 290 billion and R1, 182 billion respectively.
In simple terms, the municipality will repay R1, 730 billion over a 20 year period to the developer for a civic centre which costs R265 million. This effectively covers the developers entire capital cost of R707 million for the entire project i.e. mall and civic centre. The developer ends up owning the mall at the expense of the ratepayers. While the civic centre will be transferred to the municipality on the preferred BOT model option.
Our primary concern is the enormous financial implications such a huge development will have on the ratepayers of the region, the social impact the mall will have being housed in a residential area that is surrounded by no less than five schools within close proximity of the mall as well as the effect the re-location and decentralisation of our sports facilities will have on our sports people and the community as a whole.
A very important question also needs to be raised here considering the current economic climate as well as the municipality's inability to perform deliver and service the area under its jurisdiction.
Should the municipality be wasting public funds to undertake such a project? Is a civic centre costing R265 million really an absolute necessity?

OPEN LETTER TO THE PRESIDENT
Dear Comrade President ZumaI have agonised for a while before writing this letter to you.I am just a rank-and-file member of my ANC Branch.
However, even before the ANC opened its membership to non-Africans in the 1969. I was involved in the activities of the ANC, the South African Indian Congress, the SACP and Umkhonto we Sizwe.
In the Defiance Campaign Trial of 1952, I was among the 20 accused who were sentenced to 9 months imprisonment, suspended for 2 years.
In the Treason Trial- 1956-1961. Of the original 156 accused, I was among the last 30 who were finally acquitted in 1961.
In the 1963-1964 Rivonia Trial I was among the 8 accused sentenced to Life Imprisonment. Together with Comrade Walter Sisulu and others I was released in 1989.
Comrade Madiba was released about 4 months later.
I am immensely grateful to the ANC for the privilege of serving on the first NEC after its unbanning.
In 1997, I stepped down. I also benefited from the experience of serving for one term as Parliamentary Counsellor to President Mandela, after which I stepped down.
I am of course aware that this does not automatically bestow on me the right to address this letter to the President.
However, in all these years it never occurred to me that the time would come when I would feel obliged to express my concerns to the Honourable President.
It is, therefore, painful for me to write this letter to you. I have been a loyal and disciplined member of the ANC and broader Congress movement since the 1940s.
I have always maintained a position of not speaking out publicly about any differences I may harbour against my leaders and my organisation, the ANC. I would only have done so when I thought that some important organisational matters compel me to raise my concerns.
Today I have decided to break with that tradition.
The position of President is one that must at all times unite this country behind a vision and programme that seeks to make
tomorrow a better day than today for all South Africans. It is aposition that requires the respect of all South Africans, whichof course must be earned at all times.
I did not speak out against Nkandla although I thought it wrong to have spent public money for any President's private comfort. I did not speak out though I felt it grossly insulting when my President is called a “thief” or a “rapist”; or when he is accused of being “under the influence of the Guptas”.
I believed that the NEC would have dealt with this as the collective leadership of the ANC.
When I learnt of the dismissal of Minister Nene and the speculated reasons for this I became very worried. I'm fully aware, it is accepted practice that the appointment and dismissal of Ministers is the prerogative of the President.
This might be technically correct but in my view it is against the best traditions of our movement.
My concern was amplified when it emerged that the Deputy Finance Minister reported that he was offered the Finance Minister post by members of the Gupta family.
The people's interest must at all times remain supreme.In this instance it was clearly not the case. The resultant
crisis that the country was plunged into was clearly an indication that the removal of the Minister was not about the interests of the people.
The unanimous ruling of the Constitutional Court on the Nkandla matter has placed me in an introspective mode and I had to ask myself some very serious and difficult questions.
Now that the court has found that the President failed to uphold, defend and respect the Constitution as the supreme law, how should I relate to my President?
If we are to continue to be guided by growing public opinion and the need to do the right thing, would he not seriously consider stepping down?
I am not a political analyst, but I am now driven to ask: “Dear Comrade President, don't you think your continued stay as President will only serve to deepen the crisis of confidence in the government of the country?”
And bluntly, if not arrogantly; in the face of suchpersistently widespread criticism, condemnation and demand, is it asking too much to express the hope that you will choose the correct way that is gaining momentum, to consider stepping down?
If not, Comrade President, are you aware that your outstanding contribution to the liberation struggle stands to be severely tarnished if the remainder of your term as President continues to be dogged by crises and a growing public loss of confidence in the ANC and government as a whole.
I know that if I were in the President's shoes, I would step down with immediate effect. I believe that is what would help the country to find its way out of a path that it never imagined it would be on, but one that it must move out of soon.
To paraphrase the famous MK slogan of the time, “Therecomes a time in the life of every nation when it must chose to submit or fight”. Today I appeal to our President to submit tothe will of the people and resign.

Mandeni Municipality Mayor, Councillor Sphesihle Zulu introduced IMPROC (PTY) LTD as the contractor that will construct about 500 houses for the community of Ward 1.
Zulu said that now is the time for the housing project to occur, adding that about 41 houses will be constructed per month. In his address, the Mayor said these houses will be built in consultation with the ward Councillor, Mr Khiphinkunzi Dube, as well as his Project Steering Committee.
With regard to the poverty alleviation programmes, Zulu said there will be an increase in the number of people employed by the Community Works Programme.
A sick manA 64-year-old Glenhills woman was shocked to
find her mentally challenged daughter missing from home. She, together with family, tried in vain to contact her. The following day the young woman answered her cellphone and directions were given to the family as to where she was. On being questioned, she informed them that she was taken away by a man who forced her to consume a concoction and allegedly raped her. Police arrested a 49-year-old resident who was denied bail. He is due back at court on 17 May to lodge an application for bail.
Not safeA 29-year-old worker on her way to work at 7am in
the San Souci area has become a victim of rape. According to the woman, she noticed that she was being followed. The attacker pulled her into a sugarcane field where he demanded cash and a cellphone which she did not have. He allegedly raped her and fled. She flagged a vehicle who contacted the police. On the way to the police station, she spotted the culprit at a local store and police arrested him. A 30-year-old farm labourer was charged and granted bail. He is due back at court on 20 July.
UndeservedA Grade 10 girl who returned home in the early
hours of the morning after a night of partying has been left scarred by her night of joy. She alleges that she and her sister went to sleep and left the kitchen door unlocked due to a problem with the latch. She awoke and found a man on top of her. Unable to comprehend the actions of the man, she fell off to sleep again and awoke in the morning to discover that she had in fact been raped. The culprit, a 40-year-old local, has been kept in custody pending a bail application on 18 May.

Street is a worried woman. The 35-year-old alleges she was approached by a youth requesting a packet for his goods purchased elsewhere. She refused and he picked up a stone and struck her on the head. She lost consciousness and was rushed to hospital with an open head injury. Her boyfriend apprehended Sifiso Mbatha (18) who resides at the Shakaville dumpsite. He is due back at court on 24 June.

lesson about foreigners. She alleges that she was at Blythedale with her Yugoslavian boyfriend and his family having a party over the long weekend. She requested they tone down the music which unleashed a violent and vicious attack on her. Grabbing her by the throat, he began squeezing her, pulling her hair and assaulting her. Family members encouraged the assault and she eventually broke free and locked herself in a room. Rajko Radonojic (29) is due back at court on 22 June.

Frendz and Cool Leaders have secured final berths when they won their respective semi-final clash last Wednesday in the KZN Car Paints Specialist knock out cup for corporate league teams h o s t e d b y K w a D u k u z a Volleyball Association last Wednesday.
Both semi-finals show cased the skills of the older generation as the matches were evenly poised.
In the first semi-final Frendz came up against the youthful TV and Gates Boys and they entertained the crowd with some electric fiery volleyball the experience of the Frendz outfit were up against a barrage from the young generation TV and Gate Boyz. The game was a humdinger with TV and Gate Boys using their youthful skills to retrieve and attack whilst Frendz relied on their sheer experience to out-manoeuvre the. In the end, experience was the key for Frendz success as they held on to win 25-23, 23-23 to secure a place in the final.

CHAMPIONS: Dawnheights Cricket Cup crowned KZN Challenge League champions
Natal Cricket Union Challenge League (Stream II) at the Awards Function held at the Kingsmead Cricket Stadium in Durban
last Friday. The Indian national was not present at the awards ceremony as he presently back in India.
Arora played in 13 of Dawnheights matches and batted in 11 scoring 414 runs that included a highest score of 108. His average for the season was a healthy 41.4. His innings also included 2 half century. Others to feature in the top 15 were Mathew Michael Dean in 9th place and Adesh Bageloo and Arun Kumar in 11th and 12th place respectively. Dean also featured in the top 15 of the bowlers list coming in 11th place after capturing 19 wickets for 181 runs with an average of 9.53.
Speaking to the Xpress Times, Suveer Mahara j , sk ipper of Dawnheights, congratulated Arora on his fine performance throughout the season. Maharaj added that it was an all-round team effort that produced the results for Dawnheights. He said that the youth of the team blended in well with the experienced players and he felt that Dawnheights success can be attributed to the all-round contribution by all his charges.
Dawnheights, meanwhile were crowned the KZN Challenge League (Stream II) champions at the glittering ceremony attended by who's who of the cricketing fraternity. Dawnheights played 13 games in the 2015/2016 season and won 12 games losing just 1. They now get automatic promotion into the Challenge League (Stream I).
iLembe Cricket can be proud as
iLembe Cricket Club came 2nd in Stream I and also won the KZN T20 KO Cup. iLembe will now be represented by Dawnheights and iLembe in the KZN Challenge League (Stream I) in the 2016/2017. Winner of this league will then be promoted into the
prestigious Premier League and hopefully, one of these teams will do iLembe proud.
