RECREATION FOR NATIVES IN TOWNS,

There has been a re-crudesceDce of the "amalaita" nuisance re­cently in some of the towns in Natal and the Transvaal. Num­bers of .I)Iative youths, finding time hang very heavy on their hands on the few days when they do not have to work, have banded themselves into ItBngs or " impis" and come out on Sunday after­noons to pit themselves against other gangs. There is generally much noise, a few broken beads, much police activity and then articles in the European press about Bolshevism among Natives and the usual demand for "more police." There are two ob­seBSions among certain sections of Europeaos today. The one is that

Police are not going . to end the "amalaita!' nuisance. One might as well expect police to prevent people from falling in love or running down their neigh. bours. The gang and fighting instincts are part of human nature, white and black, and will continue 81 long as we are what we are. The same instinct can be seen in the young of other animals. They love to gather into herds and to fight with each otber. Every Saturday afternoon, and on mOlt Sunday afternoons also Europeaos gather together to compete with each other in the games which are provided for them. They work 011' the ganging instinct without being a nuisance to their neigh­bours.

It was the 88me in Native life before the Europeans canie, aod indeed is the same in rural Native life today. misreported by the Press. Asked what was his Native policy the Prime Minister replied that he had none at the present, and that he was still going to learn. He promised to visit Native Territories with the object of obtaining materials for his Native policy. The first territory he visited was Basutoland. This visit naturally aroused suspicion in the minds of those of us who had read his statement in Parliament. Coinciding with this visit was the move made by certain white settlers on the Northern part of Bechuana:­land who sent a deoutation to inter­view the Right Honourable J. H. Thomas, His Majesty's Secretary of State for the Colonies in Jobannes­burg with a view to induce His Majesty's Imperial Government to either grant the white settlers of Northern Bechuanaland some mea­!\UTe of self·government or to sanc­tion the incorporation of the settle­ment into the Union. This move together with General Hertzog's visit to Basutoland made some of us . think very seriously of the segrega­tion policy. For it showed us that there was somethihg in the air, more especially as General Hertzog and Mr. Thomas weot to Basutoland to­gether.

Sometime after this memorable visit, Mr. Arthur Barlow of Bloem­fontein, and a member of the Pact, let the cat out of the bag by stating that Basutoland should be incor· porated into the Union for the pur­poses of segregation. He declared that the country could accom­modate four millions of Native peooles .

To·day we are informed that the Government is making negotiations with the Imperial autorities for the purposes of taking over Swaziland and Bechuanaland. No mention is made of course about Basutoland. But probabilities are great that this territory will eventually share the fate that awaits the former countries. There can be no doubt that in the incorporation of these territories into the Union General Hertzog sees the solution of the so-called Native problem. The segregation of the Bantu people in the Union cannot be carried out without interfering with vested rights, and consequently the Government find that to ask the farmers to sacrifice of their farms will be to public opinion, or more that of the Backveld, . And when it is remembered that a Bill is to be introduced in the House of Assembly next session in which Parliament Will be asked to confer upon the Government powers to remove any Native tribe flOID one part of the country to another, to ileprive the Native people of the rights of access to the High Courts of Justice, to abolish the Natal Native High Court, and to create a special Court for Natives, it will be seen that my suaaestioDS are within the realm of posSfi,i1ities. territories under the "Flag" of the Union. The question, therefore, is, shall the Union Government force the hands of the Imperail Govern­ment? While under the Act of Union the Union Government is entitled to approach Great Britain on this matter yet the latter is under an obligation to safe-guard and protect Native interests. Great Britain is a trustee of Native inter­ests and rights, and she cannot hand over this trust to the Union authori­ties Witl,out the consent of the people concerned. As a matter of fact she has made a definite promise to Basutoland and Bechuanaland peoples that their countries could not he transferred to the jurisdiction of the Union without their knowlegde and consent. This is a solemn undertaking. And no doubt the Imperial Govel1'lment cannot think of sanctioning the incorporation of these territories without satisfying themselves that the Union Govern­;nent's Native policy is such as to commend itself to the approval of the civilised world. At the present the position of the Native people of the Union is the cause of the reluctance of the people of the territories to come under the rule of the Union. It is to he hoped that the Imperial Government will not accede to the proposals of General Hertzog without securing the con­sent of the peoples concerned.

The amazing thing is that matters of so revolutionary a nature are being brought before Parliament and the country without the knowledge of the people concerned. The Native people of the Union are not consulted in the Bill which is to be laid hefore the House of Assembly. And yet under the Native AffaIrs Act they are entitled to consultation. The Government saw fit to consult Native opinion with regard to the Taxation Bill but on a measure of so far reaching effect they did not think it wise to take the Natives in­to their confidence. This is strange! The policy of segregation is viewed with suspicion by many of my people, and in consequence a Bill dealing with it should not be rushed through Parliament as was the Na­tives Land Act 1913. At the recent Governmen' Conference held in Pretoria, Mr. John L. Duhe asked the Deputy Prime Minister to make a statement in connection with this policy. But Mr. Tielman Roos re­plied that the Prime Minister would deal with the matter in the House of Assembly. This did not make the members of the Conference antici­pate the introduction of a Bill in Parliament. For they had inlplicit faith in the honour of the white race. They did not for a moment think that the people who had laid down the principle of consulting Native people in matters which affect their welfare would trample upon that principle when it suits their purpose. This action of the Government is a violation of our rights and it is our duty to oppose it with all our might. The 1920 Act is our Magna Charta and we can­ne>t, without injury to our status, agree to the violation of its provi­sions without a protest. The princi­ple of consultation has given us a place in the national life Qf South Africa. We must stick to it and c1ainl it because it is a stepping stone to higher things. It is a right conferred upon our race by Parlia­ment and the Government of this country. Consequently we must guard It jealously.

I he!ieve t!te Commission has been taking eVId­ence for nearly a month, but no statement has yet been submitted to set forth the Native case. What has struck me is the absence of an official to watch the interests of mine Natives. In former Commission Natives had an official of the Native Affairs Department to watch their interests, and Col. Pritchard render­ed invaluable services. Many re­grettable things have been said against the Natives, unfortunately no one has been in a position to report these things I hope you, sir will do the best you can to make good this unfortunate omission as the Commission is designed to determine the future relationship of Europeans and Natives working on the mines.
