Montana Shooting Sports Association

Washington, DC --(Ammoland.com)-I have just returned from the

national, annual, Gun Rights Policy Conference (GRPC).

This event has been hosted each year for 25 years by the Second

Amendment Foundation and the Citizens Committee for the Right to

Keep and Bear Arms.

Each year it is held at a different location in the U.S., this year at the

Hyatt Regency hotel at the San Francisco (California) airport, on the

edge of the Bay, south of and outside of San Francisco.

This event was packed with informative panels and presentations. A copy

You will see that the agenda reads like a roster of Who’s Who of the

RKBA movement in the U.S.

(except for the obvious absence of the NRA. The NRA, we are

told, is keeping a very low profile because of serious

backlash by NRA members and others over some recent

political compromises made by the NRA leadership.)

I chaired a panel on Saturday on the Montana Firearms Freedom Act,

the FFA movement, and our lawsuit to validate the MFFA, MSSA v.

Holder. This effort is seen as really big deal in RKBA circles across the

U.S. I had LOTS of people approach and congratulate me on MSSA’s

efforts in re the MFFA.

Joining me on that panel were Michael Bodin, founder of the Tenth

Amendment Center which tracks the state sovereignty movement, and

Nick Drainas, Director of the Center for Constitutional Government of

the Goldwater Institute in Arizona.

Lunchtime on Saturday was the awards banquet. At that awards

ceremony, MSSA was given the award “Affiliate of the Year.” Neat!

I can tell a funny story about that. Last year at the GRPC, I was given the

award for “Grassroots Activist of the Year.” I had no idea I would be

getting an award. When the award was announced, I was outside in the

hallway doing an interview with CNN (being a grassroots activist). So,

upon receiving the award for MSSA this year, I told the audience of my

last year’s fiasco, and that this year I was just glad to be in the room for

the award.

Anyway, MSSA is all of us and I wanted you to know about this

significant award.

MALTA, Mont. --(Ammoland.com)- Montana Fish, Wildlife & Parks

(FWP) officials report that pneumonia continues to persist in the Lost

Creek (Anaconda) bighorn sheep population in west central Montana.

The usually fatal respiratory disease was first detected in the herd on

Aug. 20.

FWP spent the rest of August and all of September monitoring the Lost

Creek herd and killing diseased sheep in an effort to protect healthy

animals from exposure.

“Some of our helicopter surveys in mid September gave us

hope that we might have killed enough sick sheep to get

ahead of the disease, but as the weeks continue we’re still

observing more symptomatic sheep and seeing some

advanced cases of pneumonia in the samples we collect,” said

Ray Vinkey, FWP wildlife biologist.

“We’re also seeing pockets of healthy sheep, which is telling

us that there is still some potential to keep the disease from

reaching all the sheep, so our efforts aren’t over yet.”

There are no known vaccines to prevent pneumonia in wild sheep, or

medications that can be practically applied to prevent the death of sick

individuals. Instead, potential relief lies in protecting healthy animals

from exposure.

FWP crews now have plans to mobilize efforts to intensively monitor the

herd through the fall season and to continue killing sheep exhibiting

symptoms of the disease.

This means that big game hunters and others can expect to see

occasional helicopters monitoring sheep in Lost Creek and West Valley

and Blue-Eyed Nellie and Garrity Mountain Wildlife Management Areas

this fall.

“We’re also asking hunters and others that plan to cover a lot

of ground in these areas over the next few months to give us a

call with their reports,” Vinkey said. “All of these public

observations are important to us as we work to get a complete

picture of the spread of the disease and condition of the

animals.”

Vinkey said that twelve hunters drew coveted licenses to hunt bighorn

rams in Hunting District 213 this fall, and their hunt will continue.

“We have enough rams to sustain the population and that’s a

good thing for ram hunters,” said Mike Thompson, FWP

regional wildlife manager. “Many hunters never draw a ram

license, and most who do may never get another chance.

Right now, it looks like we can manage the disease along with

ram hunting, and still have enough rams left over for some to

survive a full blown pneumonia outbreak.”

Another 30 hunters drew ewe licenses and were given a chance at a

license refund or to start the hunting season knowing that an early

season closure was a possibility. Hunters that opted to start the season

had a few weeks in the field, and then FWP made the decision to close

the ewe season on Sept. 24 after continuing to detect more diseased

sheep.

Thompson says that the closure was necessary because ewes are essential

to the recovery of the population in the event that a large die-off occurs

later this fall and winter.

FWP cautions sheep hunters across western Montana to cook harvested

sheep meat well and contact FWP with any questions about the

suitability of the meat for consumption. There have been no known cases

of humans or pets contracting pneumonia from wild sheep, but FWP

cautions anyone who finds dead or sick bighorn sheep to leave the

animal alone. FWP also encourages the public to immediately report any

observations of sheep exhibiting symptoms of an illness or strange

behavior.

COLORADO SPRINGS, Colo. --(Ammoland.com)- As the new Youth

Programs and Athlete Development Coordinator, Michael has been

chartered to develop relationships with all those who are leading

/managing youth shooting programs, provide information and support

for any youth in those programs that have the talent and aspire to

making the U.S. Olympic Shooting Team.

He also has responsibility to promote the Progressive Position Pistol

program. All of these efforts are essential to developing a skilled athlete

pool for our future Olympic Shooting Teams.

Michael is a 1976 Olympian (50 meter Running Target), holds nine U.S.

National Championship titles, holds six U.S. Interservice National

Championship titles, U.S. International Distinguished Shooter Badge,

several National Records in 50 meter Running Target, has won a total of

20 Gold, 6 Silver and 4 Bronze medals in United States and International

competitions (plus numerous team medals).

He is a USA Shooting Certified Rifle Coach, CMP Master Instructor, 4-H

Certified Rifle Instructor, NRA Certified Instructor and Range Safety

Officer.

Michael has an MBA and 30 years of corporate and consulting

experience in Human Resource management and technology. He is also

an Adjunct Professor at Colorado Technical College.

Michael began his shooting career at S.H. Rider High School JROTC in

Wichita Falls, Texas. He was the Team Captain and city champion. He

was the Team Captain and ‘top gun’ at the Midwestern State University

ROTC Rifle Team, awarded an Army ROTC scholarship, Distinguished

ROTC Cadet and Distinguished ROTC Graduate.

He received his U.S. Army commission and was assigned to the U.S.

Army Marksmanship Unit where he was the OIC of the Running Target

Branch from 1972 to 1976. He lead the construction of the Olympic

quality double Running Target range at Ft. Benning. After active duty he

continued to compete as a member of the U.S. Army Reserve

International Rifle Team (Running Target) from 1976 to 1980.

COLUMBUS, OH --(Ammoland.com)- More than 15,000 ring-necked

pheasants will be released on 28 public hunting areas across the state

this fall, as part of a seasonal effort by the Ohio Department of Natural

Resources (ODNR), Division of Wildlife to enhance hunting

opportunities for this popular game bird.

Ring-necked pheasants will be released on the evenings (after shooting

hours) of October 22 and 29 in anticipation of the weekend’s small-game

season for youth hunters. Releases will also take place on the evenings of

November 4 and 12. The final release of the fall is scheduled for the

evening of Wednesday, November 24, to increase pheasant hunting

opportunities during the Thanksgiving weekend.

Although not listed in the 2010-2011 hunting regulations, pheasants will

be released for the youth hunts on October 22 and 29 on Ringneck Ridge

and Tiffin River wildlife areas. Hunters interested in hunting the

Ringneck Ridge Area in Sandusky County will require a free permit from

the Sandusky County Park District. For more information regarding the

issuance of these free hunting permits, contact the Sandusky County

Park Office at (419) 334-4495 or the Sandusky County Park District

Ranger Office at (419) 637-2900.

Pheasant hunting season opens Friday, November 5 and remains open

through January 9, 2011, with a daily bag limit of two rooster (male)

birds. Statewide hunting hours are sunrise to sunset.

Federation has officially adopted a position supporting the science-based

management of wolf populations.

“The National Wild Turkey Federation supports the sound,

are no longer on the endangered species list. The NWTF

further supports our state wildlife partners in their efforts to

provide for a sustainable, huntable population of wolves

while maintaining healthy, huntable populations of

ungulates. This must work in conjunction with balancing the

habitat needs and conservation of all wildlife.”

BRUNSWICK, Ga. --(Ammoland.com)- After an amazing journey, the

pigeon-sized shorebird has settled down in the remote Coppename

Monding Nature Preserve in the South American country of Suriname.

The rest is deserved. The bird, a whimbrel, has just traveled more than

4,700 miles, including nearly 3,500 miles nonstop in five days!

While whimbrels are known for long-distance migrations, it has been

unclear how exactly far they fly and where they go after leaving Georgia.

Until now.

Chinquapin, one of two whimbrels fitted with radio transmitters in

Georgia in May, is providing key information about the species’

migration patterns to Georgia Department of Natural Resources

biologists and other partners in the study at the Center for Conservation

Biology at the College of William & Mary.

After leaving the Georgia coast, the tagged whimbrels flew north to

Hudson Bay in Canada, one of them nonstop. Transmitter data shows

that Chinquapin ended up approximately 350 miles west of the bay,

below the Arctic Circle in the Northwest Territories.

Chinquapin departed this summer territory for Coats Island in Hudson

Bay during the second week of July and stayed there until early August.

At Coats Island, he geared up for the next leg of what would become a

marathon migration flight.

During the early morning hours of Aug. 5, Chinquapin flew 600 miles

south over Hudson Bay, then continued down the length of James Bay,

over Quebec, over Maine and finally out over the open Atlantic Ocean.

Tropical Storm Colin was pumping north toward Bermuda as

Chinquapin headed south. He appears to have skirted the storm’s

cyclonic winds by swinging 300 miles east of Bermuda on Aug. 8. His

transmitter beeped next from the beaches of northwest Puerto Rico on

Aug. 10 near Playa de Isabela – a nonstop journey of 3,470 miles. That’s

the equivalent of flying about five days around-the-clock from Boston to

Anchorage, Alaska.

The small bird was not finished, though. After a two-week rest, he

headed 1,300 miles south over the island of Grenada to Suriname, his

current location.

Although from only one bird, the information received is invaluable, said

Brad Winn, a program manager with the DNR Wildlife Resources

Division’s Nongame Conservation Section.

“Chinquapin is just one tagged whimbrel, but it is important

to remember that these are gregarious birds, so it is likely he

is flying in a flock,” Winn said. “His movements also

represent thousands of other smaller shorebirds that make

similar flights from the Arctic to South America and back.

“It is pretty mind-boggling that a bird the size of a pigeon can

leave subarctic Canada and go nonstop to the beaches of

Puerto Rico. It is an amazing journey and it is something to

be awed and admired. We don’t know if he will stay at his

current site – whimbrels are known to spend winters on both

coasts – so it will be interesting to see where he goes.”

The transmitter-toting whimbrels are not only showing scientists the

resources they and their kind need to exist, such as seasonal foods and

nesting habitat, they are also reminders that maintaining the health of

coastal landscapes has implications beyond state lines and even national

borders. Whimbrels and many other species of shorebirds are in Georgia

by the thousands for a short period each year.

“These global migrants visit us on their migratory trek for

about six weeks each spring to feast on the fiddler crabs in

our marshes,” Winn said. “The energy they get from our crabs

supports them during the next 2,000- to 3,000-mile leg of

their annual migration. If our marshes are destroyed or

become polluted, the crabs will be gone and this vital link in

the migratory chain will be lost.

“We have a responsibility to be good stewards of our coastal

habitats for birds that call the entire Western Hemisphere

home.”

Whimbrels are a high-priority species in Georgia’s State Wildlife Action

Plan, a comprehensive strategy that guides DNR efforts to conserve

biological diversity.

Georgians can help conserve whimbrels and other nongame wildlife,

native plants and natural habitats through buying a wildlife license plate

featuring a bald eagle or a ruby-throated hummingbird. They can also

donate to the Georgia Wildlife Conservation Fund through the state

Washington, DC --(Ammoland.com)- Seventy-eight members of the

Congressional Sportsmen’s Caucus (CSC) signed a letter delivered last

Thursday to Lisa Jackson, Administrator of the U.S. Environmental

Protection Agency (EPA), urging the agency to dismiss the petition to

ban the use of lead in fishing products.

The CSC members state in the letter, “There are 60 million

recreational anglers in America that contribute $125 billion

to our economy annually, and penalizing these men, women

and children that are the best stewards of our environment,

as well as the financial backbone to fish and wildlife

conservation in our country, would be a terrible and

unnecessary injustice.”

The CSC letter comes on the heels of a similar letter to Administrator

Jackson requesting dismissal of the petition, sent on September 15, from

the Congressional Sportsmen’s Foundation (CSF) and its partner

members of the American Wildlife Conservation Partners (AWCP) and

sportfishing communities. (See EPA Denies Petition Calling for Lead

“This issue is about protecting America’s 60 million

recreational anglers, and this attempt to ban lead based

fishing tackle could potentially drive up cost and serve as a

disincentive for Americans to fish,” said CSF President Jeff

Crane.

The Association of Fish and Wildlife Agencies (AFWA), representing the

50 state fish and wildlife agencies, also sent a letter the EPA on

September 2nd urging them to dismiss the petition.

State fish and wildlife agencies are authorized to manage most of a

state’s fish and wildlife, and therefore, closely monitor and address any

local concerns about lead based fishing tackle and any potential impacts

on local species. A federal ban on lead fishing tackle is not only

unnecessary, but intrudes upon these traditional state agencies

jurisdiction.

No scientific basis has been established to warrant any such ban on

traditional fishing equipment. A similar proposal to ban lead fishing

tackle was dismissed by the EPA in the mid-1990s because there was

insufficient data to support such a ban at that time.

Butler, PA --(Ammoland.com)- The 2010 Service Pistol Championship

match was held at the Lewistown Pistol Club on June 18 -19, 2010.

The match was broken into 2 sections, the first being a regular 1800

point possible matches, starting with .22 pistol and then Center Fire

Pistols.

The second stage was fired with Service Pistols, either 1911 .45 caliber

pistols, or Beretta M9 9mm pistols. Either pistol is permitted, but they

can only be altered for accuracy and the triggers must be adjusted to a 4

pound trigger pull weight.

Outwardly they must look military issue except for adjustable sights. If a

person did not want to participate in the Service Pistol section, they

could shoot along with a .45 pistol but their score would not be included

in the Service Pistol aggregate.

There were 2 competitors in the High Master Classification, there were 7

in competition in the Master Classification, 11 competitors in the Expert

Classification, 6 in the Sharpshooter Classification, and 7 in the

Marksman Classification for a total of 33 shooters.

Brian Keyser Penn State Service Pistol Champion

The first segment of the match was fired with .22 caliber pistols, in a

regular 900 possible point match. That match was won by Lewistown‘s

own Jerry Ford with a score of 880-30x. Jerry is a classified Master and

led the way for all. The High Master winner was Brian Keyser of

Birdsboro, PA. Brian fired a score of 877-38x.

In the Expert Class, the high score was posted by Heim Trang from

Germantown, MD. Heim fired a score of 872-32x. In the Sharp-shooter

Class, top honors went to Tim Burris of Mifflintown, PA. Tim fired an

850-30x. In the Marksman Class the high score was posted by Jon Caley,

out of York, PA. Jon fired a score of 847-23x. These last 2 shooters

should be watching the mail for their new classification cards! Both are

going to move up quickly firing scores like these!

The next segment was the Center Fire match. Again the match winner

came from the Mas-ter Class. Tom Mix from Ebensburg, PA was the

Center Fire match winner with a score of 867-26x. The top High Master

was Joe Urish, from Butler, PA. Joe fired a score of 866-30x. In the

Expert Class Heim Trang again posted the top score. Heim fired 852-28x

to lead all Experts. In the Sharpshooter Class, Tim Burris came out on

top again with an 816-11x. In the Marksman Class top honors went to

Jon Caley with a score of 812-18x.

Next came the State Service Pistol Championship. This match is fired in

a 900 possible point match, just as the .22 and CF stages are fired. This

match determines not only the State Champion, but also the members of

the PRPA Service Pistol Team that will compete at the National Matches

at Camp Perry in July. The members of the team are picked by the top 5

shooters (that are going to Perry) and the 6th shooter is the ―New

Shooter.

This shooter is a member that has not been on a CMP team in the past.

Every year a ―New Shooter must be picked, and that shooter must fire

in the Team Competition at Camp Perry. The other 3 shooters are

determined by the scores fired during the individual matches fired at

Camp Perry earlier on Sunday July 18th. They have much to live up to as

the 2009 PRPA Service Pistol Team was the Na-tional Champion Civilian

Team.

There were 21 competitors who participated in the Service Pistol

Championship. After the smoke cleared and the scores were totaled up,

Brian Keyser was firmly on top of the board. Brian fired a score of 836-

23x to lead all shooters and claim his first PRPA State Service Pistol

Cham-pionship! Second place went to Joe Urish. In third was Steve

Gibbons from Lewistown, PA.

The members of the PRPA Service Pistol Team at Camp Perry as

determined by the match scores are as follows. Joe Urish, Steve Gibbons,

Tom Mix, Brian Dean, Dennis Kriek, and the ―New Shooter is Kirk

Anderson of State College, PA. It is the custom that the State Champion

is named the team captain for the team. This year Brian will not be able

to go to Camp Perry. Also some familiar names of shooters that will not

be competing at Camp Perry in 2010 are Patrick Kelly Jr and Russ

Wallander. We are going to miss all of them at Perry, both as members of

the PRPA Teams and, as good friends and competitors. Here‘s hoping

that they will be back in 2011!

In addition to the regular match there was a CMP EIC match fired, This

match was won by Brian Keyser with a score of 283-10x. The top score by

a Non-Distinguished shooter was posted by Anthony Brong from

Harrisburg, PA. Tony fired a score of 259-4x. Then a Distinguished Re-

volver match was conducted. The winner of this match was again Brian

Keyser. Brian tops the field with a score of 273-8. The top scoring non-

distinguished shooter was Steven Welsh of Stroudsburg, PA. Steve

posted a score of 253-2x

Congratulations Brian Keyser, State Service Pistol Champion, and we

wish you many more wins! Good luck to the shooters on the PRPA

Service Pistol Team at Camp Perry!

We want to commend the Lewistown Pistol Club for their continuing

support of the shooters of Pennsylvania! Not only was the match run in a

very professional and cordial manner, but the club put together a nice

assortment of door prizes with 2 Springfield Armory pistols as prizes!

We look forward to working with the club in the future in this

and all competitions they plan! Good Shooting!

Butler, PA --(Ammoland.com)- I just returned from visiting a relative

in Canada. Since we were traveling to a remote part of Canada, I decided,

as in the past, to bring along a rifle and ammo.

I filled out the appropriate one page Canadian Customs Firearms

Declaration form. When I told the agent at the border crossing that I was

bringing in a rifle, he looked alarmed and asked “what for?” “Protection

from wildlife” was my response, which is one of the stated purposes on

their Customs form.

“Well”, he replied. “They probably won’t let you in, because

you have no need, but drive over to the Customs office”.

When I presented my Customs form I had to undergo a third degree

questioning. Then the Customs agent asked to see the rifle (never

experienced that before, but certainly a reasonable request).

He must have measured the barrel 3 times, and finally stamped the form

and let us proceed into Canada with my rifle.

If you try to smuggle a handgun into Canada, you face arrest and

confiscation of your vehicle.

Canadian residents are not legally allowed to own or carry any handguns,

tasers, etc. for personal defense, or any business purpose. Canadian

police officials in most localities have to check out and turn back in their

handguns at a shift change.

You can own a rifle or shotgun, with severe limitations, although there is

currently legislation on the books requiring registration of same.

Remember, in 1929 all German citizens were required to register their

firearms, then in 1935, the Gestapo came and confiscated firearms, then

a few years later, they came back, arrested some of the prior owners, and

killed them, because they figured, once a gun owner, always a gun

owner!

You cannot purchase any ammo in Canada, down to .22 caliber, without

a license. This is European, Progressive, UN type gun grabbing at its

finest, and it’s just a few few hours away from us.

Thank God, James Madison, and the Supreme Court for our

2nd Amendment rights.

Why Can’t My Rifle Maintain That Perfect Zero?

often is, “How do I maintain that perfect zero once I’ve already done it? I

seem to keep losing it.”

Keeping a perfect zero is tough, because there are a combination of

mechanical and physiological factors that can alter the configuration of

the relationship with the scope and gun.

What changes your zero?

Cleaning

When you clean your gun, you are moving parts around, which most

likely will shift your alignment

Tightening

Any time you tighten:

• Screws

• Rings

• Pillar Bolts

You are again shifting the original alignment, especially if you do not

apply equal distribution of torque on component parts

To avoid unequal distribution, a torque tool is a good way to tighten

everything up equally.

Mixing Ammo

To maintain the perfect zero, you cannot switch up the ammunition. You

have to shoot with the same brand, types, and weights.

Temperature

Dramatic ranges of temperature will change your zero, because the air

density affects the velocity of the bullet. With increased temperature,

there is a higher velocity.

Personal Shooting Practices

If you change up any of the following, you will most likely alter your zero:

• Having another individual shoot the gun for you

• Holding loose vs. tight on the shoulder

• Holding loose vs. tight on the cheek weld

Differing your Gun Rest

Be sure to use the same kind of gun rest, whether it is a sand bag,

mechanical rest, box, etc. It should be stable and easy to repeat the same

position each time.

Transportation of Weapon

Even if you don’t mishandle your weapon in the slightest, it is possible

that a shift of zero could occur.

• Turret knobs Not Covered

If the turret knobs are not protected, they can rub against clothing, gear,

storage bags, scabbard, etc. If the knobs turn, it will definitely shift over

your alignment and cause your point of impact to be off.

Defective scope

Having a defective scope is a possibility, but it is not likely. If you have

taken conscientious efforts to avoid any of the above in your shooting

endeavors and you still aren’t accomplishing that zero, then maybe you

really do have a defective scope and need to get that checked!

McDonald, PA --(Ammoland.com)- For nearly 6 years we have ‘all’

been working to improve the use of force laws (known as Castle

Doctrine) here in Pennsylvania so that gun owners would feel that they

would be treated fairly ‘if’ they have to use force to defend their families

with lethal force.

Unfortunately we have been frustrated by the idiosyncrasies of

Pennsylvania politics. Again, we want ‘nothing more’ than what other

states have: reasonable legislation that will provide important

protections for ‘law-abiding’ citizens who must use protective force

when confronting criminals. Thousands of volunteer organizations’

dollars and thousands of man-hours have been dedicated to this effort.

Grassroots leaders of Pennsylvania gun rights organizations have bent

over backwards trying to be fair in a good faith effort to accommodate

critics of this important legislation.

Sadly, this legislation has been held hostage by a shrill

minority in the legislature consisting of the Philadelphia

Legislative caucus and certain agencies.

They are using their political connections to thwart the desire of the

people. The people want a vote and they want this bill on the governor’s

desk for signature ASAP-THIS SESSION. It is unconscionable to have

tremendously popular legislation, with nearly 2/3 of the House of

Representatives as co-sponsors, be denied a timely, fair, and honest vote.

The Pennsylvania organizations that support this legislation (identified

below) are fully aware of the parliamentary options that are available to

leadership to advance this legislation and we ask your support to

encourage legislators and leadership to speedily resolve these issues and

move this legislation with all possible haste-THIS SESSION!

Our organizations are receiving many complaints from individual gun

owners, such as you, about legislative ambivalence and antipathy

towards this concept and HB 40. Our members, officers, and board

members insist upon a more proactive stance and firm and definitive

action on the part of legislators whom we have supported. To this end we

know there will be a vote on a discharge petition in the House of

Representatives on Monday, September 27, and we encourage you to

stress the importance of their support for not only this effort but also any

other effort to advance House Bill 40 (Castle doctrine) through the

legislative process in the next few coming days.

The bill will be much more likely to pass and be put on the Governor’s

desk IF we can count on you to generate help support. We know this is a

last minute request and apologize for it but the broken promises of

certain legislators in leadership has intentionally, we believe, left us with

little time to maneuver. We have tried every reasonable method to break

HB 40 free of this legislative log jam without bothering you, to no avail.

Now we are asking for your help once again!

**Please contact your legislator and members of the House of

Representatives leadership and let them know that you not only support

this legislation but that you want them to ‘swiftly’ move it through the

House to the Senate and to the Governor.

To Review: The Bill: HB 40 does not change the use of force

requirements. What it does do is eliminate the honest citizen’s duty to

retreat when confronted by violent criminals and provide honest citizens

with legal protection if they defend themselves from criminals. It

contains an anti-carjacking provision that will change state law so that if

a criminal illegally and forcibly enters an occupied vehicle, the

presumption is that he intends to harm the passengers. Protections

against civil actions are also provided, should your assailant or his

relatives sue you for harming the criminal when you defended yourself

and this includes protections for law enforcement as well.

This legislation has been enacted in twenty three states and eighteen of

these states have also enacted ‘No Duty to Retreat’ and is pending in

even more. Crime is down in these states.

Killers are more concerned about law-abiding citizens than police having

firearms. This was proven in the Wright-Rossi study and more recently

by the example that the Columbine killers (Dylan and Klebold) “shared

opposition to a bill in the state legislature that would have made it

easier to carry concealed weapons” (NYT, 6/29/1999).

LAS VEGAS, NV --(Ammoland.com)- Inventor James McNulty, a

senior member of the Society of Manufacturing Engineers, who was a

member of the research staff of the late TASER inventor John “Jack”

Cover and instrumental in development of the early law enforcement

model TASERS, today announced that he has sued Taser International,

Inc. (Nasdaq: TASR) for patent infringement for its nascent production

of wireless TASER shells, that can be discharged from conventional

firearms (federal case docket no. 2:09-cv-00289-KJD-PAL).

The suit claims that Taser sells the shells in violation of McNulty’s

“5,831,199″ and “6,877,434″ patents. The suit seeks an injunction

against further sales, compensatory, exemplary (punitive) and enhanced

damages and attorney’s fees. A case filing lists the aerospace giant BAE

Systems, Ltd., manufacturer of the Harrier Jump Jet, and its affiliate

Defense Technology Corporation as entities that may have a direct

financial interest in the successful outcome of McNulty’s case.

Documents produced in the suit and other public filings show that

affiliates of a number of the world’s 10 largest defense contractors are

potential competitors of Taser for any substantial military markets that

may develop for less lethal electronic shock weapons.

Documents produced in the suit show that one affiliate has already

developed in competition with Taser’s X12 and X RAIL a combination

weapon, that fires ammunition cartridges that can also be

interchangeably fired from and sold as replacement ammunition for

Taser’s X26 and M26 stun pistols, and that the affiliate has already

manufactured stocks of thousands of the ammunition rounds.

McNulty, a 27 year participant in the industry commented,

“Documents already produced in the case show that this

competitive ammunition technology has application in the

law enforcement market for TASERS and TASER

ammunition. Securities and Exchange Commission filings

show that resale of ammunition for the over 359,000 M26

and X26 stun pistols, which have been sold by Taser to the

law enforcement market, is a significant source of revenue for

the company. In its last reported quarter ending June 30,

2010, Taser’s ammunition cartridge sales accounted for over

25% of its total business. Taser has no basic patents that

prevent any other company from manufacturing and selling

competing ammunition for the X26 and M26 products.

The prospect in my opinion is that Taser shall fight for ever

smaller shares of competitively diminishing law enforcement

and military markets for projectile stun guns and

ammunition and against interest of such behemoth

enterprises. Taser’s Securities and Exchange Commission

filings show that many of Taser’s assets are plant and

equipment, intellectual property and inventory for

manufacture and sale of its current line of stun pistols and

ammo. The value of these types of assets can quickly vaporize

with advent of new competitive electronic control device

technologies. I shall vigorously protect my advanced IP in

this field for its licensees/prospective licensees.”
