According to Article 39(b) of the Constitution theBranch Unions who do not remit quota to the Circle Unionor to the CHQ or to the NFPE for a period of threeconsecutive months shall be liable to be suspended.

The Existing Provision - that basic pay plusDearness pay is not less than Rs. 6900/- shall besubstituted as follows: -"Pay in the pay band of Rs. 8560/- or more".(MOF DOE OM No. 12 (i)/E II-A/2008 dt. 12.12.2008)4. Study Tour to German PostDepartment of Posts had earlier finalized a 17 MemberTeam for a Study Tour to German Post including 6 staffSide representatives from NFPE. The Team was reducedto 9 consequent on MOF restriction. The Departmentthereupon without consulting the Federation reduced thequota of NFPE to only 3 without even the Secretary General
NFPE in the study tour. FNPO was given 3 representationand ASPO/ASRM given 2 representation. After discussingin the Federal Secretariat, the General Secretaries of P-3, P-4 and R-3 boycotted the Foreign Tour and gave aprotest letter to the Department. NFPE also protested theunilateral decision of Department undermining the 5:2ratio in favour of NFPE in Staff Side representation.5. ACP Orders
The DOPT has sought approval from the ElectionCommission for release of three 3 ACP orders. Replyfrom the Election Commission is awaited.6. GDS Committee
The Department is working out a proposal foreffecting payment of adhoc quantum of arrears to GDSon the following method.
TRCA+DA as on 01.01.2006 X 20% X 38 months.Out of which 40% may be paid before 31.03.2009. Theproposal should be approved by the nodal ministries.
GDS Committee proposals have cleared by JS& FA and the file has gone to Minister Communicationbefore onward transmission to Ministry of Finance.7. Paid Substitutes
The JS & FA has cleared the file for grantingminimum of Pay + Pay Band without the element of HRAto the substitutes. Orders will be released shortly.8. Group D - Non matriculates
The Ministry of Finance has cleared files to grantfixation benefits in the upgraded Group C Pay Scales tothe non matriculate Group D's immediately and imparttraining further. Orders are expected soon.9. HSG - I
One time filling up of HSG I vacancies on adhocbasis again among the HSG II officials - Proposalforwarded to DOPT and orders expected soon.10. Induction Training
The induction training period for Direct/Promotees will be reduced to 48 days instead of present75. Orders will be issued soon. It will be applicable fromthe next batch training.11. General Secretary on Tour

Subject:- CCS (RSA) Rules, 1993- Re-verification of membership for recognition of ServiceAssociation-Procedure regarding.
I am directed to refer to the Department's letter
of even number dated 29th August, 2008 on the above-
mentioned subject vide which instructions were issued
to observe the interim stay granted by Hon'ble High Court
of Judicature at Madras in WP No. 11490 of 2008 and MP
No. 2 of 2008 filed by All India RMS/MMS Assistant
Superintendent and Inspectors Association represented
by its General Secretary, Shri M.Mohanarangam.
2. The Hon'ble High Court of Judicature at Madras
in Writ Petition Nos. 4704 of 1999 filed by Bhartiya Postal
Employees Union in the matter of re-verification of
membership of service associations directed the
Department of Posts as under:-
'We direct the respondents, in order to follow and
maintain principles of natural Justice, to entrust the verification
process towards recognition of the trade unions, to an
independent officer in the rank of Divisional Superintendent
and scrutinize the option/Authorization forms in the presence
of one representative from each of the unions'.
3. With the issue of the aforesaid directions by the
Hon'ble High Court, the interim order of stay granted in
Writ Petition No. 11490of 2008 and MPNo. 2 of 2008, has
become in-fructuous. In the wake of the above directions
passed by the Hon'ble High Court, Madras, the process
of re-verification of membership for recognition of service
associations will now be started as follows:-
(i) (a) Every employee desiring to be a member of service
Association will give a letter of authorization in writing,
addressed to the DDO in the prescribed Proforma
(Annexure-II) (bearing the signature of Director (SR &
Legal) for deduction of subscription from his pay. The
letter of authorization is to be sent through the applicant
Service Association to which the membership is sought,
so as to reach the Drawing and Disbursing Officer
concerned on or before 15-05-09, who in turn will pass
FRESH VERIFICATION OF MEMBERSHIPon the authorization letters to the Divisional Head for
scrutiny. Any authorization given through a non-applicant
association will be ignored. The Associations will also
submit to the Divisional Head a list of members in
triplicate duly signed by the authorized office bearer on
each page of list by 20.05.09 At this stage, the Divisional
Head will scrutinize the letters of authorization in the
presence of one representative from each of the Union.
This job will be completed by 25.05.2009. After scrutiny,
the Divisional Head will transfer the letters of
authorizations alongwith list of members to the Drawing
and Disbursing Officers.
(b) On receipt of the above documents, Drawing &
Disbursing Officers will return one list to the authorized
office bearer duly acknowledging the receipt of lists in
duplicate and also the authorization letters. Drawing &
Disbursing Officers will display one copy of each set of
lists on the notice board from 27.05.09. to 29.05.09.
(c) In case an employee has given authorization in
favour of more than one applicant Association, it will be
treated as invalid and will not be counted for any
Association.
(d) An individual employee, whose name has been
included in more than one Associations' List exhibited on
the Notice Board, may, if he so desires, submit a
representation, to the Divisional Head by 02.06.09. The
employee concerned must specifically indicate in the
representation with supporting material, if any, that he
has given the authorization in favour of a specific
Association (Name must be given) and the authorization
in favour of the other Association (Name must be given) is
fake one. The Divisional Head on his part will scrutinize
the authorization given by the employee and in case he
finds that the authorization was not genuine, he may delete
his name from the concerned list under intimation to the
concerned Association and allow it to be included in the
list, the employee genuinely chooses. Trade union facilities
of such authorized office bearer who signed the fake/
fabricated/non-genuine authorization would be withdrawn
till the next verification process. however, if on scrutiny by
;the Divisional Head, both the authorizations are found to
be authentic given by the employee both the authorizations
would be treated as invalid and the employees concerned
would not be allowed to become member of any
Association till the next verification process. No
representation received after 02.06.09. will be entertained.
Here it may be pertinent to mention for information ofthe member employees of various service associationsthat issuing authorization letter in favour of more thanone service association is against the spirit of thegeneral instructions on the subject and createsobstruction in the way of recognition of genuine anddeserving associations. Therefore, the practive may beavoided under all circumstances.(ii) The letters of authorization received through

Service Associations be grouped category/Designation-
wise and filed securely in guard files by Drawing &
Disbursing Officers. The Drawing & Disbursing Officer
will note down the details of the authorizations in a register,
the format of which is indicated in Annexure-III The serial
number in Annexure III should also be marked on the
authorization letter placed in the guard file, duly
authenticated by Divisional Head.
(iii) (a) All the Drawing & Disbursing Officers will start
making monthly recovery from the employees who
authorize such recovery out of their pay, from the salary
for the month of June, 2009 payable on 30.06.09.
(b) Recovery of subscriptions being made in
respect of Service Associations on the basis of old
authorization will stop after May, 2009 salary (payable on
31.05.09) except for All India Association of Postal
Supervisors (GL) as in their case, as per the directions of
the Hon'ble High Court, Delhi in CWP No. 1827/97,
status-quo is to be maintained till the case is heard.
(iv) Drawing & Disbursing Officer shall make
recovery of monthly subscription from pay in favour of a
particular Association every month.
(v) An extract from the register in duplicate will be
handed over to the Cashier for making necessary entries
in the acquittance roll (ACG24) of the month concerned. A
suitable column in the acquittance roll. Viz. 'Membership/
Subscription to Service Association' may be opened to
record the deduction separately. The deduction made by
the Cashier through acquittance roll will by 'Out of account'
transactions of the Government account.
(vi) Drawing & Disbursing Officer after making the
deductions will remit the amount of the Divisional
Secretary of the concerned Association who, in turn, will
remit this amount to the All India, Circle etc. as per the
quota fixed in their respective constitutions. There is no
objection if the membership subscription is remitted to
the Circle/Central body of the Association for further
distribution, provided such a provision is made in the
constitution of the Association. The total deductions and
total number of persons covered by the amount remitted
should also be specified.
(vii) Remittance to the Association should on no
account be made by means of Service Money Orders.
(viii) The amount collected by Sub/Branch Offices at
the time of disbursement of Pay & Allowances to the staff
employed in those office and kept out-of account shall be
sent to the Head Post Office in the daily account duly
entered on the back with the remarks 'List of out of account'
attached. The amount should be put in a separate cover.
(ix) Divisional Head will ensure that work relating to
verification and its compilation is completed by 12.06.09
and is reported to the Heads of Circles with details of the
total number of persons belonging to each of the Service
Associations in the Proforma as per Annexure-IV and one
copy of Annexure-IV is displayed on the notice board on
the same day.
(x) Divisional Head will ensure that while counting
total strength in respect of a particular category, total
employees actually working and eligible for being
included in that category may be taken into account. They
should not report the total number of sanctioned posts.
(xi) The Heads of Circles will send the consolidated
statement to SR Section, Department of Posts in the
Proforma at Annexure-IV by 22.06.09 and display its one
copy on Notice Board on the same day. The Circles will
ensure that the information in respect of all Divisional
Heads has been included in the statement. The
concerned Service Associations will also be endorsed
the statement referred to above.
4. Generally the Service Associations had a grievance
that the Drawing & Disbursing Officers maintain a soft
corner for the Association to which they belong (ed).
Aggrieved with this, Bharatiya Postal Employees Union
filed Writ Petition Nos. 4704 to 4707 of 1999 in the High
Court of Judicature at Madras. Agreeing with the view point
of the Petitioner Union, the Hon'ble High Court directed
the Department of Posts to entrust the verification process
to an independent officer in the rank of Divisional
Superintendent who will scrutinize the option/
authorization form in the presence of one representative
from each of the Union. The above directions of High
Court, Madras are to be complied with scrupulously. The
Heads of Circles will see to it that absolute transparency
is observed in carrying out the reverification process and
it is conducted in a free and fair manner. In case any
irregularity is noticed on the part of any officials/officer, a
serious view in the matter be taken and prompt action
may be initiated by the competent Disciplinary/
Administrative Authorities. Further all Heads of Circles
will nominate a senior officer of the Circle (of the level of
JAG or above), who will be responsible for attending to
complaints and settlement of disputes arising in carrying
out the verifications process.
5. The terms 'Drawing & Disbursing Officer', as mentioned
above, means only such authority in charge of the work of
drawing pay and allowances for an employee.
6. In terms of instructions issued by Department of
Personnel & Training vide O.M. No. 2/13/98-JCA dated
11.02.2002, the recognition of service associations
granted as a sequel to this exercise shall be valid for a
period of five years from the date of issue of order granting
recognition.

GUIDELINES TO BE FOLLOWED BYDIVISIONAL SECRETARIES
1. Ensure Annexure -II with Director SR signature
dated 17.04.2009 is photo copied for members to sign.
2. Submit the Declaration Forms before 15th May
2009 to DDOs.
3. Submit three copies of lists of membership to
Divisional Head before 20.05.2009. Divisional Secretaries

should sign at the bottom of each page of all the three
copies of membership lists.
4. Scrutiny of forms will be done by the SSPO /
SPO / SSRM/ SRM etc in the presence of our
representative only. Carefully observe the scrutiny to
protect our membership. Do not hesitate to object any
wrong action by the Divisional Head to help any other
union in an unlawful manner.
5. One Officer will be appointed by the Chief PMG
to oversee the whole verification. Do not hesitate to
approach that officer with a written complaint if need
arises to lodge complaint against any wrong action or
favouritism if any on the part of the Divisional Head.
6. Educate the workers and employees that if they sign
declaration forms in favour of more than one union, they would

at his finger's end, but in reality few have ever read
them through; and any one who attempted to obey
all their instructions would find himself sadly
hampered in the exercise of his duties." But what of
that? This frank admission by Mr. Clark does not at
all count when punishment is determined, and it goes
on merrily as ever. We must seriously take up this
question of punishment and the treatment due from
superior officers. We cannot allow our manhood to
be destroyed by such constant terror of punishment
hanging like Damocles' sword over our head."

process to the office bearers of SBCO Association.

Subject: Amendments to the constitution of All IndiaPostal Employees Union Group 'C'-request approval-reg.
I am directed to refer your letter no. PO/1-1/AIC
dated 11.12.2008 and dated 05.03.2009 on the above-
mentioned subject and to inform that the Government
has provisionally approved the proposed amendment ot
the Constitution of All India Postal Employees Union
Group 'C'. The amended version incorporating proposed
changes of substantial character will now be read as
under
Article 3 : The All India Union shall be registered under
the Trade Union Act of 1926
u To be replaced as :- 'The All India Union is
recognized under CCS (RSA) Rules, 1983'.
Article 5 : The constitution shall be interpreted with
reference to the provisions of Trade Union Act, 1926
u To be replaced by the following :- "The
constitutions shall be interpreted with reference to the
provisions of the CCS (RSA) Rules, 1983'.
Addition :- Where the rules provide, no guidance for the
interpretation of any particular Article, the interpretation of
the All India Conference shall be final and binding. The
Central Working Committee shall also be empowered to
give interpretation of such articles in between sessions
of the All India Conference. Such interpretation or
clarification of the Central Working Committee shall be
binding unless revoked by the AIC. The decision of the
CWC will be placed in the AIC for ratification.
ii) Amendment to the Constitution :- No
amendment to the Constitution shall be passed except
by two thirds majority of the voting strength of the
delegates present in the AIC and provided that the
amendment proposed to be moved shall have been given
notice of at least 10 days before the date of
commencement of the AIC to the CHQ.
Article 6(b) : A member shall not be eligible to hold an
office in any other Branch/Divisional Union except the
Branch/Divisional Union of which he is a primary member,
except for the remaining duration of the office, when he is
transferred to the jurisdiction of any Branch/Divisional
Union.
u To be replaced with the following :- (b) The
membership will automatically discontinue on a member
ceasing to belong to any one of the categories stated as
above under sub clause (a) and on retirement from
service.
u To be added :- (c) A member shall not be eligible
to hold an office in any other Branch/Divisional Union
except the Branch/Divisional Union of which he is a
primary member and therefore on transfer to another
branch/division the office bearership held in the parent
unit by the member automatically becomes vacant.
AMENDMENT TO THE UNION CONSTITUTIONRead the existing (c) as (d)
Article 7 (b) : Transfer Certificate (i) When a member is
transferred from the jurisdiction of one Branch/Divisional
Union to another, a Transfer Certificate in the prescribed
form should be forwarded to that Branch/Divisional Union
under intimation to the Circle and the All India Unions.
Such a member shall automatically cease all connection
with the concerned Br/Dn. With effect from the date of
issue of transfer certificate including his office except as
provided in article 6 (b)
(ii) In case of a member is transferred to a station
where a Branch/Divisional Union does not exist, such a
membership in the former Branch/Divisional Union.
u Deleted.
Article 9 : Investment of Funds : The funds of the Union
shall be deposited in the name of the Union in P.O. Savings
Bank or in a current, fixed deposit or Savings Bank account
in a Scheduled Bank or Post Office or Co-Operative bank/
Society and operated jointly by the Secretary and Treasurer
at various level.
u The words 'Saving Bank Account in Post Office'
to be deleted from the text of the existing Article.
Article 11 : New Addition after a (iii) of the Article
u (iv) In respect of Branch/Divisional Union splitting
up into two or more units during the financial year theelection of delegates for all these units shall be based on
the strength of membership calculated proportionately
on the amount of quota received by the respective
managing bodies up to the date of inception of new units
and thereafter on the basis of the individual quota remitted
by each unit till the end of the financial year or years
concerned.
(v) In case any Branch/Divisional Secretary/
representative refuses to countersign the membership
authorization form submitted under check off system of
any official, that official concerned may appeal to the Circle
Union and may also prefer an appeal against the decision
of Circle Union to CHQ. The decision of the Circle Union
will be final if not reversed by the CHQ.
Article 12 : New addition after (i) of the Article.
u The Branch, Divisional, Circle conference shall
be held once in two years but in any case shall not exceed
beyond three months on the completion of 24 months
period. The Circle Union shall constitute an ad-hoc
committee immediately on failure of any branch/divisional
conference within the above time frame as the whole
team of office bearers of such defaulting branch/divisional
unions cease to hold their offices on completion of the 27
months time. Similarly, the CHQ shall constitute an ad-
hoc committee to hold the Circle Conference in such
Circle Unions that fail to hold it in time.
u Add (ii) (d) after Federal Council 'However, the
General Secretary can substitute in place of those Federal
councilors absent in Federal Council due to death or

resignation or absence in accordance with the provisions
of NFPE constitution.
Article 16 : Voting , Save as provided from elsewhere in
the constitution resolutions shall be carried by a simple
majority vote by show of hands. However, a secret ballot
shall be granted if demanded even by a single member
present in respect of election of office bearers only. Voting
shall be taken for each post or posts and shall be confined
to the respective individual candidates contesting. No
panel voting shall be allowed.
u Now may be entitled as 'Election and Voting'
Following may be addition before the existing provision :-
w The election of office bearers shall be conducted
in the branches, Divisional, Circle and All India
Conference by the President of the respective level and
he shall be the election officer to conduct the election. He
may take the assistance of Working Presidents and Vice
Presidents for the election. In the absence of President,
the working president or any one of the vice presidents
will conduct the election.
w The election officer shall invite nominations to
each post from the members or delegates, as the case
may be, by proposing an seconding the name for each
post.
w The result of the election shall be announced by
the President. In case, the President himself is a
candidate for the post of President in a contest, then the
working president or vice President as the case may be
will act as the election officer for the election of the
President post only.
Article 22 : Add before existing (g)
u (g) To issue rules and bye laws for the management
affairs of the union and renumber as 'h' to 'k'
Article 26, 33, and 53 : Existing nomenclature of
"Treasurer" and "Assistant Treasurer"
u To be nomenclatured as 'Financial Secretary' and
'Assistant Financial Secretary' respectively.
Article 30 (iii) : Add the following after the last sentence in
(a)
u and in accordance with the Article II (a) (i)
Article 31 (iii) : Add the following after the last sentence (iii)

Article 37 (iv) : No Divisional or Branch Union except

the basis of the decision arrived at by the committee of
Secretaries it has been decided by the competent
authority in the Department of Posts to fill up a total of
2294 vacancies in various Groups of posts in this
Department by direct recruitment for the year 2008, under
Annual Direct Recruitment Plan in accordance with the
instructions contained in Department of personnel &
Training OM No.2/8/2001-PIC dated 16-05-2001
2. Keeping in view the requirements of the Circles,
computerization/modernization already done/being done,
quantum of work load, existing manpower, etc. in the
various Circles and above all to ensure smooth Postal
operations, the competent authority has allocated the
number of vacancies to the various Circles to be filled up
by direct recruitment in various cadres as per the enclosed
statement. You are requested to reallocate the vacancies
allotted to the Circle to the various recruiting Divisions/
Units in the Circle. The vacancies so cleared for filling up
in the Civil Wing have been communicated to Chief
Engineer (Civil) separately, who in turn will allocate the
vacancies to the various Divisions/Circles.
3. Under no circumstances the Circles shall fill up
ADR PLAN 2008 CLEARED BY THE DEPARTMENTthe remaining direct recruitment vacancies pertaining to the
year 2008 falling under the purview of Optimization Scheme.

4. Since the allocation of vacancies to the various
Circles has been done keeping in view the overall
requirements of the Circles, it is requested that Head of
the Circle should personally ensure that no deviation is
made in the matter and only such posts are filled up by
direct recruitment which have been allocated to the
Circles. While filling up the vacancies the instructions
contained in the Department of Personnel & Training's
OM No.2/8/2001-PIC dated 16-05-2001, DOP&T OM No.
14014/3/2005-Est (D) dated 14th June, 2006 circulated
vide Department of Posts letter No. 24-162/2006-SPB.I
dated 4.8.2006 and other instructions issued by the said
Department, Ministry of Finance, etc. from time to time
relating to recruitment should be strictly followed.
5. The Circles are required to initiate recruitment
process immediately to fill up the direct recruitment

Heads of the Circle should draw up an action plan under
intimation to the Department and closely monitor the same

The undersigned is directed to refer to the above-
cited subject and to say that vide this departments O.M. No.2/8/
2001-PIC dated 16th May 2001, the scheme of Optimization of
Direct Recruitment to Civilian Posts was introduced for five years
with the objective of rationalization of the manpower in Various
Ministries/Departments of the Government of India. As per the
Optimization scheme, all Ministries/Departments were mandated
to prepare the Annual Direct Recruitment Plan for each year in
order to prioritize the fresh intake of manpower. After the expiry
of the initial five years period, the Optimization Scheme was
reviewed in the year 2006 in consultation with Department of
Expenditure, Ministry of Finance and it was decided to extend
the scheme for a further period of three years ie., up to 31 March
2009 subject to a review after the receipt of the recommendations
of the Sixth Central Pay Commission.
In this regard, the Sixth Central Pay Commission has
recommended, "multiskilling of the Government employees which
would increase their operational efficiency while simultaneously
optimizing the staff strength. It is however, noted that while
rightsizing in Government is necessary given the changes in the
work process due to technology and consequent reduction of
layers, a blanket ban on filling up of vacant posts across the
board can impact effective functioning. More flexibility is required
in this policy for effective service delivery and care has to be
taken that administrative delivery structures do not become hollow
or thin in critical areas………….", (Para 6.3.10)
Keeping in view the above recommendation of the
Sixth Central Pay Commission, the optimization policy has again
been reviewed in consultation with the Department of
Expenditure, Ministry of Finance and it has been decided to not
to extend the validity of the Optimization Scheme beyond
31.03.2009

organize meetings in front of all offices and convey to the
members that the ACP orders are not likely to be issued
before the election and the Government has not acceded
to the demand of the Staff Side to continue the existing
practice of effecting ACP on the basis of department
specific hierarchical set up. The grant of second
installment of arrears of 6th CPC dues is also likely to be
delayed and may not be released before August, 2009.
The meeting was apprised of the items finalized and
forwarded to the National Anomaly Committee. Those

The next meeting of the National Executive will
be held in June, 2009. All affiliates are requested to clear
the outstanding subscription dues and the special

RESOLUTION ADOPTED AT THE NATIONALEXECUTIVE MEETING OF THE CONFEDERATION
This meeting of the National executive of theConfederation of Central Government employees andworkers held at New Delhi on 2nd April, 2009 drewsatisfaction from the response of the CentralGovernment employees to the appeal made by it on24th March, 2004 to mount vigorous campaignamongst the mass of the employees to take a decisivestand against the then entire working class in thecountry a combination of those political parties whoare opposed to fundamentalist and communal forcescould be brought to power after the general electionsin 2004 in the country. Such a combination of thepolitical parties thus took over the reins of the countrywith the support extended by the left parties fromoutside on the clear understanding that the cardinalprinciple of governance would be what was agreed uponby all concerned as the national Common Minimumprogramme.
The present Govt. at the beginning kindledthe hope and aspiration of the common multitude ofthe country especially the working class. However oncein power the Prime Minister and the Finance Ministerunmindful of the strident opposition of the organizedmovement of the liberal economic policies. Thesponsoring committee of Trade Union organizationshad to perforce tread the path of struggle and organizestrike actions in 2006, 2007 and 2008 to compel theGovernment to reverse its economic policies ofliberalization and globalization. The ban on recruitmentwhich was imposed by the NDA Govt. in 2001 throughan executive fiat was not only not withdrawn but

continued; many Government departments were woundup; public enterprises initiated policy shifts makinghigher and professional education beyond the reachof the common man; service tax net was widened tocover many areas of concern to common man; variousconcessions and exemptions from taxation wereprovided to the rich and corporate bodies; subsidieswere withdrawn driving peasants to penury; the onlytax deduction available for the salaried employees i.ethe standard deduction under section 16 of the I.T.Act was withdrawn; capital gains tax on stocktransactions was abolished to give impetus tospeculative business at terrible cost to exchequer;allowed future trading on consumable food articleswhich became the edible oil vegetable, sugar etc.;allowed the monopoly houses to enter the retail traderendering thousands jobless; indulged in massivedownsizing and outsourcing of the Governmentalfunctions; raised the administrative price of petroleumproducts; proposed full capital convertibility of rupee;created innumerable special economic zones grantingpower to hire and fire to the entrepreneurs; persistedwith the financial sector reforms unmindful of the globaleconomic recession; introduced bill to withdraw thelabour welfare enactments; did everything to integratedIndian economy to the vagaries and dangers ofglobalization; weakened and almost wound up thepublic distribution system; all this done in contraventionof the agreed National Common Minimum programme.
At the instance of the proponents of the freemarket economy and with a view to boost the stockmarket operations the Government decided to privatizethe pension funds and do away with the age oldstatutory defined benefit pension scheme of theGovernment employees by introduction of the PFRDAbill in the Parliament. Almost all the State Governmentsbarring Bengal, Tripura and Kerala followed this dictumand introduced the new contributory pension scheme.Despite the stiff opposition of the Central and StateGovernment employees manifested unambiguously bea magnificent strike action on 30th October, 2007jointly organized by the Confederation and the All IndiaState Government employees Federation, theGovernment persisted with the PFRDA bill whichhowever could not obtain the Parliamentary sanctiondue to the principled and consistent opposition of theLeft parties. Still the government put into operationthe new contributory pension scheme in fact illegallyand unethically through executive instructions. At thefag end of its tenure it decided to divert the pensionfunds to stock market to boost up the falling sensex.
No different was its attitude toward theemployees in the matter of implementation of the 6thCPC report. The report itself was to perpetuate thewage differential between the top echelons of thebureaucracy and the employees. The Government's
decision was to accentuate this ill advisedrecommendation further as it chose to accept thesuggestion of the Committee of Secretaries to furtherincrease the Grade pay of all Group A officers andreject the demand of the employees for a fitmentformula to provide a minimum benefit of 40% rise inemoluments to all employees. It refused to grant theminimum wage as per the 15th ILC norms and refusedto negotiate the recommendations of the 6th CPC withthe employees' representatives. It also decided to doaway with 9 lakhs Group D posts and outsource allGroup D functions to private contractors. On thequestion of wage revision of 3.5 lakhs Grameen DakSewaks, the Government took initially an extremelynugatory attitude by not setting up a judicial committeefor their wage revision and later by not revising theirwages. Same was the attitude of this Governmenttowards the temporary and casual workers. While theregular employees were given the benefit of wagerevision, the casual and daily rated workers weredenied. Even after issuing orders for the grant of Childcare leave for women employees as per therecommendation of the 6th CPC, the Govt. later issueda clarificatory order virtually denying this benefit. Inthe case of pre-1996 pensioners the benefit of fixationon notional pay basis was denied. Even in the face ofthe impact of the world economic recession, it refusedto lift the ban on recruitment, fill up the large numberof existing vacancies or take steps to generateemployment as demanded unanimously by the entiretrade union movement in the country in the recentlyconcluded Indian Labour Conference.During the five year tenure, it discarded India'sindependent foreign policy and moved away from thetime tested non-aligned movement. It compromisedthe country's independent nuclear technologydevelopment programme by entering into a controversialagreement which became the subject matter of severecriticism from various quarters. While this had beenthe track record of the present Government, the majorconstituent of the opposition had been indulgingthroughout this period to forment social disharmony,to spread hatred and to fracture the secular socialfabric providing impetus to the growth of terrorism.In this background the National Executive appeals allaffiliates and COCs to campaign amongst the massof the employees and the people of the country tovote for those candidates who support the cause ofthe working class in general and Governmentemployees and mass meeting in front of all offices toorganize the employees for this purpose.

far. The glaring mistake held in the grant of APM Accounts
promotion by brushing aside the seniority of Sri. S. P.
Singh, who entered in the grade on 1.8.73 has not been
set aside. The deprival of his due promotion caused an
irreparable loss in his service at the fag end of his service.
This issue has not been sorted out by the Circle
administration, so far.
It is requested to intervene immediately and set
aside the irregularities by rendering justice to the
aggrieved officials.

Sri Paramasivam in order to wreck vengence against the
lady official has filed a police case against her under
PCR Act.
It is most pertinent to mention that his misdeeds
and other illicit activities are being exposed in the press
LETTERS TO DEPARTMENTand one of the same is enclosed for your reference (in
Tamil) The official has been already under orders of
transfer from pudukottai division. However his relief has
been delayed or deferred due to the reasons known the
regional administration. If he continues in the division
further, it will cause irrepairable damages to the lady
officials who openly preferred complaints against him by
way of his intimidating activities as if he resorted to Smt.
Kalaimani.
The division is in alarming condition and it is
requested that your immediate intervention alone will
mitigate the sufferings of the women employees of
Pudukottai division.

lllll Anomaly in fixation of Pay - case of TechnicalPostal Assistants - reg.
Since the Fifth Pay Commission & the Sixth Pay
Commission did not consider the issue of the Technical
Postal Assistants, the Pay of the said officials had been
fixed in the Rs. 3050/- pre revised pay scale for Grade II
and Rs.4000/- for the Grade I. Thus a grave injustice has
been met and these Technical Postal Assistants are
getting lesser scale of pay than the Postmen & Group D.
The Qualification for the recruitment of TPA (PMA)
is as follows.
TPA Grade I: - Diploma in instrument
Technology/Mechanical/Electrical Engineering/
Electronics from Technical institutes recognized by
Central/State Government.
TPA Grade II: - ITI certificate in Instrument
Technology / Mechanical / Electrical Engineering/
Electronics from Technical Institutes recognized by
Central/State Government.
Thus the officials have been recruited with higher
Technical Qualifications and they are now being attended
the works of computer printer repairs, maintenance and
other related software works and for this purpose, their
designation had been charged from PMA to Technical
Postal Assistant vide Dept's letter No. 38-3/96-PE (PT) dt.
06.01.1999.
In other departments like Ministry of Earth,
Department of Revenue & Dev, these Technical Assistants
are granted with the Grade Pay of Rs.4200/-. In respect of
Ministry of Information & Technology, Shipping, Road
Transport etc, they are granted with the grade pay of
Rs.4600/-.
It is requested to consider the same and take
appropriate action to render justice to these cadre
available in the Department.

lllll Diverting Postal business to UTI - marketed byBD section of Maharastra Circle
It is rather shocking to note that the BD Section
of Maharastra Circle has directed the Marketing Executives
and all the SPMs to distribute pamphlets of UTI to the
customers visiting post offices for procuring more
business for UTA which exhibits that making investment
in UTI is more beneficial than the investments in National
Savings certificates. The copy of the same is enclosed
herewith for your kind reference.
Diverting the Postal business to UTI under
Business Post and also pressurising the Postal Staff to
canvass for UTI by distributing such phamplets which is
detrimental to the Postal service is highly deplorable. We
are confident that no such direction would have been
given from the Directorate level. However the officials who
are responsible for such declining of Postal business
due to these kinds of business adventerism should be
brought to book in order to save the department.
May I seek your response madam for immediate
action to arrest this menace.
A line in reply about the action taken is highly
appreciated.

A kind attention is invited to the resolutions adopted in the
last conference in which we requested to take up the
issue to amend the CS (MA) Rules 1944 to enable the
employees to take treatment in Authorised Private
hospitals as other employees in CGHS area.
It is brought to our notice that after the
implementations of Fifth CPC recommendations, the
Department of pension & Pension welfare has issued
orders vide its letter No. 45/74/97-99 PW (C) dt. 15.04.97
extending the CS (MA) Rules 1944 to the Central
Government Pensioners residing in areas not covered
by CGHS which is also speak about serving employees
and the Ministry of Health & Family Welfare principally
agreed to the said proposals.
Subsequently, the Ministry of Health & Family
Welfare in its OM No. S-14025/4/96-MS dt. 05.06.1998
ordered that the benefits of medical coverage under
CGHS or under CS (MA) Rules 1944 should be extended
to pensioners also and they should be provided the
benefits of to avail of hospitalization facilities as provided
by CS (MA) Rules 1944. The copy of the said OM is
enclosed herewith for ready reference.
However, the said instructions have not been
implemented yet in our department. Since the benefits
have been extended to pensioners, the same is
applicable to the serving employees also mutadis
mundadis.
It is requested to cause immediate orders on
the same extending the facilities to serving and retired
employees of the Department of Posts without any further
delay.

lllll Appointment of retired officer as programmeofficer under project Arrow and misuse of Powers ofDivisional Head - case of Nagpur region, MaharashtraCircle.
It is brought to out notice that some retired Group
'B' officers are appointed as programme officers under
project Arrow in Nagpur region and they are exercising
the powers of the Divisional Superintendents which is
causing a serious concern. The retired officers can hold
only as short duty Assistants and they have no hold to
take control of the divisional administration and send
letters, approval, financial sanction in the place of the Sr.
Superintendent of Pos.
One Sri. R. M. S. Shaikh, Ex Group B officer
working as short duty by the PMG , Nagpur region is
misusing his powers and issuing circulars duly misusing
the designation stamp of the Sr. Supdt. of Pos, Nagpur
Mofussil Division. He is signing all the circulars as SSPOs.
It is rather shocking to know that he is drawing
TA/DA while on tour and functioning as if a reemployed
personnel. How can the retired person be competent to
sanction the bills concerning the said project. This causes
a serious concern. Some of the letters signed by him as
SSPOs, Nagpur Mofussil division is enclosed for your
kind reference.
It is requested to intervene immediately and

ten months.
The Circle Unions have now decided to launch
series of programmes demanding immediate settlement

since they have opted for accounts line at the time of their
TBOP promotions.
This has caused several dislocations to the
senior officials who are working as APM Accounts. The
representation of Sri. S. Govindarasu, APM Accounts,
Tiruvarur who has been disturbed from Accounts line to
General line which is self explanatory and exhaustive is

abovesaid official is working in Accounts line over twenty
years and he has now been posted in General line which
causes a concern.

According to Directorate letter No. 31-27/89-Bldg
dt. 29.05.1992, while assessing the reasonable rent for
private building, maintenance charges are taken as 12%
of the core rent (calcualtion standard note 6) and in case
if it is included as part of rent, annual maintenance and
repairs are to be carried out by the owner.
However, despite the fact that 12% rent has been
taken for maintenance during calculation, the colour
washing & white washing have not been carried out
aImost all the rented buildings. They are in ugly look due
to non carrying out of maintenance works in Tamilnadu
Circle. Not even a single instance has been heard that
department is carrying out the maintenance work in the
rented building eventhough they are endangering to the
lives of the officials due to defective electricity wires etc.
Villivakkam LSG PO in Chennai City is the glaring example
which has not seen white washing over twenty years and
any other maintenance.
It is therefore requested to cause suitable
instructions to Circle Head to carryout atleast white
washing to the rented buildings to have a feel good factor
to work in the premises.

It is brought to our notice that most of the
computers installed in Mumbai GPO & other Post office
in the Mumbai city are having the capacity of just 54/108
M.B RAM which could not cope up with the present
requirements. The present norms prescribed for the
computer is at least 512MB RAM. The computers now
supplied are having 1 G.B RAM which could cater the
need to dispose things easier on quick functioning.
The officials deployed at the computers where
only 54 MB RAMs are available are facing lot of problems
due to slow processing of the computers. This problem
may be prevailing in other circles also.
It is therefore requested to upgrade the capacity
of the RAM to the extent of atleast 512 MB or replace the
same with new computers at the earliest.

The counters provided under the Project Arrow
scheme in the Post offices do not have the glass panels
and there is every risk to the cash secured at the counters.
In respect of Banks, the disbursement/receipt
of cash is centralized and the cashiers are protected with
wire mesh and also with glass panel. But in our post
offices, all the PA's deployed in the counters are doing
cash transactions to the tune of lakhs of rupees and there
is serious risk across the counter in the absence of non
providing glass panles or any protection.
It is requested to consider the same and provide
glass panels in the counters in order to ensure safety
and security of the cash handled in the counters.

lethargic disposal of issues prevailing in Goa region. The

Deutsche Post worldnet Express for carrying parcels and
documents world wide with the Department of Post on tie
up are comparatatively much higher than the rates fixed
by DHL for the same parcel/documents if the customer
directly approaches them.
Since the rates fixed by the Deutsche post is
exhorbitant and no elite customer will come forward to
book their articles at the costlier rates when the DHL
open the same counter and offer lesser rates with some
incentives.
The Marketing Executives of Mumbai are being
harassed by the Circle administration to achieve the target
of 10 customers before 31.03.09 which is practically
impossible unless the tariff fixed is reduced.
You are therefore requested to kindly intervene
personally and set right the problem by revising the rates
with the German Posts or drop the business project which
is practically not feasible.

lllll Installation of over. 6-0 & 6-5 of Sanchay Postmodule - anomalities to be rectified.
After the installation of ver 6.0 & 6.5 of the
Sanchay Post module in SB, there are anomalities and
bringing resentment among the depositors.
1. Though the deposits above the prescribed limit
in POSB account does not fetch any interest as per rule
but deposits above the limit were accepted in the mode
of cheque or any other non-cash transfer method. But at
present even the ECS transfers are not allowed if the
limit of deposits has already crossed the prescribed limit
by Re.1/-. It has been seen that this is bringing resentment
of the depositors because neither they can deposit their
maturity cheque in their SB accounts nor can transfer the
amount to the SB account due to this anomaly.
The restriction in this rule may be liberalized by
allowing the depositors to deposit in cheque and non
cash transfer; and amount exceeding the limit without
any interest. If this facility has not provided, then the
depositors who does not have a bank account may not
be able to encash their maturity cheques.
2. Re-issue of maturity value of any scheme or
certificate, in part or full is well provided in the rule but the
software does not provide so. These are inviting public
complaints and also loss of investments.
3. In a RD account if deposits of 60 are completed
by auto transfer from SB account and the holder did not
apply for extension and also did not close the account,
then too the account is extended automatically and
deposits have been transferred from the respective SB
account. In this case the software did not delete
automatically the SI (auto transfer) entries after 60
deposits have been completed. Also with existing defaults
in the RD account deposits from SB account have been
automatically accepted without the RD extension form
being invoked. This is a serious error because the holder
may not come for maturity for 2 years and enjoy PMI but at
the same time may not want to extend the account. In this
case their SB account may become fund-less and their
house building loan payment cheques may get
dishonored without their knowledge.
4. Since the latest version of software has enforced
cheque issue in many cases, so installation of cheque
printing machine is urgently needed. The department
Software may be developed with its link to the Sanchay
Post, which will enable to fill up the cheque requisition
slip electronically, and in-lieu print the amount and name
on the cheque.
It is requested to consider the above and cause
rectification at the earliest.

Inordinate delay in settlement of personalclaims like T.A, O.T.A Medical etc for want of funds -case of U. P. Circle
The issue of allotment of adequate funds for
payment of pending personal claims like T.A, OTA, Medical
etc have been discussed in the past several times and it
is repeatedly replied that required funds are available to
dispose the claims.
But the fact is otherwise, Complaints are pouring
into this union that a large number of personal claims
are pending unsettled in U.P. circle since long. During
discussion in the periodical meeting (4 monthly) with the
Chief Postmaster General U.P. Circle. It is replied that, if
sufficient allotment of funds are not made, the issue will
remain unsettled.
You are requested to kindly bestow your kind
attention in this pertinent issue of U. P. Circle and arrange
special sanction of funds for payment of all personal
claims at the earliest.
1. Full Pension After 20 Years Of Qualifying ServiceRef: - Your O.M. No.38/37/08-P&PW (A) dated 11.12.2008.
I am to state that the recommendation of VI CPC
that full pension to the persons who retire between
1.1.2006 and 1.9.2008 may be granted only after
completion of 33 years of qualifying service is violative of
the fundamental right under Article 14 of the Constitution
in terms of the decision of the Supreme Court in D.S.
Nakra Vs U O I (AIR 1983 SC 130). Since the date of effect
of all recommendation of VI CPC regarding pay scale is
1.1.2006, it is necessary that the recommendation of VI
CPC for full pension after completion of 20 years
qualifying service should also be implemented with effect
from 1.1.2006. Had the Commission been appointed in
2003 and had it given its recommendation before
1.1.2006, the above recommendation would have been
implemented with effect from 1.1.2006. As such, for delay
in appointment of VI CPC and its report should not debar
employees who had retired during the period 1.1.2006 to
1.9.2008 from the benefit of full pension after completion
of 20 years qualifying service.
It is therefore requested that all those who have
completed 20 years service and have retired during the
period 1.1.2006 to 1.9.2008 may also be granted full
pension at 50% of average emoluments received during
the last 10 months or the last pay drawn whichever is
more beneficial to them.

2. Fixation of Pay In the Upgraded Pay ScalesYour kind attention is invited to Note 2A below
Rule 7 of CCS (RP) rules 2008 according to which where
a post has been upgraded as a result of the
recommendation of the Sixth CPC as indicated in Part B
or Part C of the First schedule of these rules, the fixation

of pay in the applicable pay band will be done in the
manner prescribed in accordance with clause (A) (i) and
(ii) of Rule 7, ibid by multiplying the existing basic pay as
on 1.1.2006 (obviously in the existing lower Pay Scale) by
a factor of 1.86 and rounding the resultant figure to the
next multiple of ten.
For the purpose of illustration we take the case
of an employee in a post with the existing Pay Scale of
Rs.6500-10500 drawing say Rs.7300 as pay as on
1.1.2006. VI CPC has upgraded this post to the prerevised
Pay Band corresponding to Rs.7500-12000.
Now as per clause (A) (i) of Rule 7 his revised
pay will be fixed at 13580 and as per clause (a) (ii) of Rule
7 the minimum of the revised Pay Band Corresponding
to Rs.7500-12000 in Rs.13950/-
Note: in the above computations Grade Pay has
not been added.
Therefore it follows that the above employee will
be fixed at Rs.13950 + 4800 i.e. Rs.18750/- P.M.
It has been observed that in most of the cases
fixation of pay in the upgraded pay scale as per Clause
(A) (ii) of Rule 7 of the CCS (RP) Rules, 2008 has not
been done and what has been done is to fix the pay band
as per Clause (A) (i) of the said Rule 7 and then adding
the Grade Pay of the upgraded Pay Scale.
I may, therefore, request you to issue necessary
clarification to the effect that in the case of upgraded pay
scales, the fixation of pay with reference to the minimum
of the upgraded Pay Scale should also be done and if it is
higher than what is computed on fixation of existing Pay
under Clause (A) (i) of Rule 7, ibdi, the higher amount
fixed under Clause (A) (ii) Rule 7 should be taken before
adding the grade pay of the upgraded post.

The 5th Central PayCommission had recommended extension of CS (MA)Rules, 1944 to the central government pensionersresiding in the areas not covered by CGHS. On a referencereceived from the Department of Pension and PensionersWelfare on this subject, the response of the Departmentof Health had been conveyed through the O.M. No.S.14025/4/96-MS dated 5.6.1998. The response of thisDepartment was that it did not have any objections to theproposal of extension of CS (MA) Rules, 1944 to centralgovernment pensioners residing in non-CGHS areas asrecommended by the 5th Pay Commission, subject to

the condition that the responsibility of administering theCS (MA) Rules, 1944 for pensioners would be of theDepartments/Ministries concerned.w The said O.M. dated 5.6.1998 was in reply to areference in O.M. No. 45/7497 PP&PW (C) dated15.4.1997 from the Department of Pensions andPensioners' Welfare. After that also communication betweenthese two departments-had continued on this subject. Infact in a subsequent O.M. of the same number dated12.1.1999, the views of all the Ministries/Departments ofthe Government of India had been sought before a finaldecision could be taken. But unfortunately, the O.M. dated5.6.1998 has been misinterpreted by some pensioners asthe final order of the Government of India to extend CS(MA)Rules, 1944 to pensioners. A lot of avoidable litigation hasalready taken place, because some pensioners haveobtained favourable orders from various courts/tribunalson the basis of the said O.M. dated 5.6.1998.w It is therefore considered necessary to clarifyunequivocally that the O.M. dated 5.6.1998 was notintended to be a final order extending the applicability ofCS(MA) Rules, 1944 to pensioners. In fact, it is notpossible for any individual department to take such policydecisions without obtaining views of various departments,and particularly, the Department of Expenditure. Suchbeing the case, in the process of examining therecommendation of the 5th Pay Commission on thisissue, the Department of Expenditure has categoricallysaid that in view of huge financial implications, it is notfeasible to extend CS (MA) Rules, 1944 to pensioners.w Therefore, any interpretation based on the O.M.dated 5.6.98 of this Department that the pensioners comewithin the purview of the CS (MA) Rules, 1944 is whollymisplaced.(Ministry of Health & Welfare O.M.No. S.14025/4/96-MSDated : 20-08-2004)u Construction of new building for UdumalpetHO-reg.I am directed to refer to your letter number No. P/2-19/Udumalpet dated 06.05.2008 on the above subject. However, the supply ofelectricity was temporarily managed w.e.f. 23rd to 25th ofSeptember, 2008 and on 29.09.2008, 3.10.2008 &10.10.2008 and finally, the electricity supply was restoredon 13.10.2008. Therefore, it is not true that there was noelectricity in the Post Office for over two months. Agenerator has already been installed in the Office. l While women are massively moving into the
labour market, more and more women are being
pushed into informal/unorganized/contract/
casual/daily labour in indecent work conditions
with very low wages/ earnings. They are integrated
under the worse conditions with low payment and
low working status remaining at the bottom of
the occupational hierarchy and they also tend tohave unsafe working conditions, something that
serves as tool for the attack against, labour rights.
l Poverty is increasingly feminized. Women are
60% of the world's working poor people.
l More women than ever before are unemployed
(81.8 millions). They are mostly stuck in low
productivity jobs such as agriculture, the field of
services and the-informal sector.
l Women are subjected to intense discrimination
and they are paid lower salaries than men even
for the same job. Globally women earn 20-30%
less than men. Maternity protection for vast
numbers of working women is barely guaranteed
and working women who become pregnant are
faced with the threat of losing their jobs,
suspended earnings and increased health risks
due to inadequate working conditions.
l Women are increasingly migrating, both legally
and illegally, seeking for better employment. They
represent almost 50% of all international
immigrants and they are among the most
vulnerable group exposed to exploitation and
abuse.
l Women are being trafficked for prostitution and
leisure including young girls between the ages 7
year to 14 years. This is happening within the
countries and across the border.

l Subject: Placement of non matriculate Group
‘D’ employees in the Pay Band PB-1 with effect from1.1.2006.
Consequent upon the acceptance of the
recommendations of Sixth Central Pay Commission by the
Government, non-Matriculate Government servants who were
in the pre-revised Group ‘D’ pay scales are to be granted the
revised pay structure in the following manner:
(i) Placement of all such employees initially in the
corresponding-1S pay scale of Rs. 4440-7440 with
appropriate grade pay Rs. 1300, Rs. 1400, Rs. 1600, and
Rs. 1650 w.e.f.1-1-2006.
(ii) Fixation of pay of those employees, who
already possess the revised minimum qualification of
Matriculation or its equivalent, in PB-1 with grade pay of
Rs. 1800 with effect from 1-1-2006.
(iii) Those employees who do not possess the
prescribed minimum qualification would need to be
retrained before being placed in the PB-1 pay band with
grade pay of Rs. 1800.
2 The Sixth CPC, while recommending higher pay scale
to non-matriculate Group ‘D’ in PB-1, has suggested that job
description of Group ‘D’ posts shall also be revised and redefined
with emphasis on multi-skilling so that a single employee is able
to perfrom various jobs. As per Rule 151 of Postal Manual
Volume VI Part-III the Group ‘D’ posts in the Department of Posts
are of the nature of general assistance in the office who must
be ready to give their help wherever required. The duties of
Group ‘D’ have also been defined in Rules 144 to 152 of Postal
Manual Vol VI Part III, which include wide range of functions.
Keeping in view the changed environment and need of the
time, following additional duties shall be entrusted to the staff in
the Post Offices, RMS Offices and Administrative Offices who
were in the pre-revised Group ‘D’ scales in addition to their
existing duties;-
(A). Post Offices:

ii. Preparation of Mail/Register/Parcel Lists (other than Insured
lists), Regd/Parcel delivery slips, VP Receipts, Delivery

These employees will henceforth be known by the
generic term of “Multi Skilled Employees”. However, the specific

3. The issue was referred to Ministry of Finance for
fixation of the pay scales of these employees of Department
of Posts before completion of the training and that Ministry
has concurred in the proposal subject to the conditions
that necessary computer training may be provided to
enhance their skill. Action may be initiated by the Heads of
Circles to complete the required training on computer
operations in consultation with the Training Division of the
Directorate. Training division of the Directorate will take
necessary action to get the module developed to train all
such non-matriculate employees in basic data entry and
circulate to all Circles. The Divisional Superintendents/
Controlling Authorities should ensure that the training is
imparted and required certificate is issued about completion
of the prescribed training and necessary entry recorded in
the Service Book of each official.
4. (i). All the Multi Skilled Employees who were in the
pre-revised Group ‘D’ pay scales will be placed in the revised
pay bands as indicated below with effect 1-1-2006:

(ii) Inter-se seniority of all the employees in erstwhile Group ‘D’
will be fully maintained with Group D employee in a higher Fifth
CPC pay scale within the same pre-revised pay scale, being
placed higher vis-a-vis an employee in a lower pay scale, the
seniority will be fixed on the basis of date on which the person
came to the placed in that pay scele.
5. Heads of Circles will please issue necessary
instructions to all the concerned to take prompt action to
complete the entire process including training by 30-04-2009
and report compliance to the undersigned latest by 15-05-2009.

examining some Circle Level Inquiry Reports in major fraud
cases where authorized agents found involved in
misappropriation of public money. It is observed that general
public is not so cautious towards their savings instruments and
have blind faith in authorized agents resulting in loosing their
hard earned money.
2. It has been decided that all post offices should have
a signboard (in English/Hindi and Local Language) at the counter
area with following information:-
(i) Please keep your passbook and savings certificates in
your personal custody.
(ii) Do not hand over blank withdrawal/account closure forms
with your signatures to any one including authorized
agents.
(iii) Do not appoint authorized agents as your messenger for
withdrawal of money on your behalf.
(iv) Check your balance after each transaction from the post
office.
(v) Contact Postmaster immediately in case of any suspected
fraud.

of all post offices and ensure district compliance of the aforesaid
order.

l CCS (CCA) Rules, 1965 - Promotion to a higher
Grade or post-Clarifications regarding effect of
warnings etc. on promotion.
The undersigned is directed to refer to the DOPT's
O.M. No. 22011/2/78-Estt. (A) dated 16th February, 1979 on the
above mentioned subject and to say that at present,
administrative devices like warning, letter of caution, reprimand
etc. are being used by the various administrative Ministries/
Departments for cautioning the Government servants against
such minor lapses as negligence, carelessness, lack of
thoroughness and delay in disposal of official work with a
view to toning up efficiency or maintaining discipline. These
administrative actions do not, however, constitute any of the
penalties specified in rule 11 of the CCS (CCA) Rules, 1965.
Doubts have often been raised about the actual effect of such
informal administrative actions as warning, letter of caution
and reprimand on the promotion of a Government servant.
2. In this connection, the existing provisions regarding the effect
of warning etc. as distinguished from Censure on promotion
are reiterated and clarified as follows:-
(i) There is no objection to the continuance of the practice
of issuing oral or written warnings. However, where a copy of
the warning is also kept on the Confidential Report dossier, it
will be taken to constitute an adverse entry and the officer so
warned will have the right to represent against the same in
accordance with the existing instructions relating to
communication of adverse remarks and consideration of
representations against them.
(ii) Warnings, letters of caution, reprimands or advisories
administered to Government servants do not amount to a penalty
and, therefore, will not constitute a bar for consideration of
such Government servants for promotion.
(iii) Where a departmental proceeding has been instituted,
and it is considered that a Government servant deserves to be
penalized for the offence/misconduct, one of the prescribed
penalties may only be awarded and no warning recordable or
otherwise, should be issued to the Governments servant.
(iv) The term 'empanelment' occurring in para 1 of DOPT's
O.M. No. 11012/11/2007-Estt. (A) dated 14.12.2007 relating to
guidelines on grant of vigilance clearance does not cover cases
of promotion. Cases of promotion of Government servants
during the pendency of disciplinary proceedings would be
regulated by DOPT's O.M. No. 22011/4/91-Estt. (A) dated
14.09.1992. , O.M. No. 22012/1/99-Estt.(D) dated 25.10.2004
and after imposition of any of the prescribed penalties as per
O.M. No 22034/5/2004-Estt. (D) dated 15-12-2004.
3. All Ministries/Departments are, therefore, requested
to keep in view the above guidelines while dealing with cases
of promotion of the Government servants.

it is informed that an Inspection Schedule has been prepared in

maintained by some Circles and subordinate offices, it has
been noticed that the Rosters and the Summary are not prepared
and maintained in the proper fromat.

and Summary Proforma -II are enclosed.

Consequent upon the implementation of the Sixth
Central Pay Commission’s recommendations, the matter
regarding the rates of remuneration payable to Gramin Dak
Sevaks engaged as substitutes in short term departmental
vacancies of Postmen, Mail Guards & Group ‘D’ (Future Multi
Skilled Employee) has been reviewed.
2. It has now been decided that the remuneration of the
Gramin Dak Sevaks engaged as substitutes in short term
departmental vacancies of Postmen, Mail Guards &Group ‘D’
(Future Multi Skilled Employee) may be calculated on the basis
of the minimum of the pay in the respective revised pay band of
the post plus grade pay concerned i.e. Postmen,. Mail Guards
Rs. 5200+ Rs.2000 and Group ‘D’ Rs. 5200+ Rs.1800 as the
case may be as defined in the CCS (Revised Pay) Rules, 2008
plus admissible Dearness Allowance thereon only excluding
House Rent Allowance and Transport Allowance with
effect from 1.1.2006.
3. In future, GDS who are willing to work as
substitutes with the minimum pay of the revised pay
band of the respective post plus admissible DA
excluding House Rent Allowance and Transport
Allowance, should be engaged as substitutes only after
obtaining an undertaking in this regard.
4. The issue relating to grant of revised wages to casual
labourers of Full time/part-time contingent workers is under
examination and orders will be issued separately.
5. This issues with the concurrence of Ministry of
Finance, Department of Expenditure I.C. vide their U.O. No. 7.6/
7/2009-IC dated 12.03.2009.

l CLARIFICATIONS REGARDING PAY FIXATION OF
EXISTING GROUP 'D' EMPLOYEES IN THE REVISED PAY
STRUCTURE
Consequent upon the acceptance of the
recommendation of the Sixth Central Pay Commission by the
Government, related to Group 'D' cadres in Central Government,
all existing Group 'D' employees are required to be upgraded to
the prerevised Group 'C' scale of Rs.2750-4400 corresponding
to the grade pay of Rs.1900 in PB-1 (Rs.5200-20200) in the
manner prescribed in the CCS (Revised Pay) Rules, 2008
(attention is drawn towards Note 1 below Rule 7 of CCS (Revised
pay) Rules 2008, Which prescribes the procedure for fixation
of the pay of Group 'D' employees in the revised pay structure).
Further, in future, posts will be created only in PB-1 and there
shall be no recruitment in-IS pay band save in exceptional
circumstances as indicated in para 2.2.10 of the Report of the
Sixth Central Pay Commission.
Following the notification of the CCS (Revised Pay)
Rules, 2008, this Department has received references from
some administrative departments, seeking clarification regarding
various aspects of placement of existing Group 'D' employees
in the revised pay structure. The matter has been considered in
this Department. The points of doubt raised by administrative
departments and the clarifications thereto are issued as under:
1. How will the pay of those Group 'D' officials who do
not possess the minimum qualification and have retired/died
in harness from 1.1.2006 till date be fixed in the revised
structure? Whether they will be placed in - IS pay band or in
the pay band PB-1?
Those Group 'D' employees who did not possess the
minimum qualification and who have retired/died in harness
between 1.1.06 and date of notification of Revised Pay Rules
will be granted pay band - 1S and the grade pay corresponding
to their pre-revised pay scale as notified in CCS (RP) Rules,
2008.
2. What will be the training curriculum, period and the
procedure for placement of those Group 'D' officials in PB-1
band who do not possess the minimum prescribed
qualification?
Each administrative department concerned will design
a training curriculum suited to its requirements. As far as
possible, the training programme should not exceed 3 months
and it may be imparted during working days for not more than 2
hours per day. The Department concerned will bear the
expenditure for training.
3. In the case of those Group 'D' officials who where in
the pre-revised scale of Rs.2550-55-2660-60-3200 (e.g. Peon)
and who are to be placed in the pay band PB-1 with Grade Pay
of Rs.1800 w.e.f. 1.1.06 and are subsequently granted ACP/
Promotion, it is not clear as to what will be their grade pay. If
the grade pay remains unchanged, the officials will not be
getting any benefit on promotion/ACP. In case they are granted
next higher grade in the hierarchy of revised pay structures, it
wil l put seniors viz. Daftry/Senior Peons etc. at a
disadvantageous position.
Government servants who have been granted
financial upgradation to a higher scal under the ACP Scheme
will be granted the grade pay corresponding to the higher pre-
revised pay scale that was granted to them under ACP. However,
in case of erstwhile Group 'D' employees, all such eligible
employees will be granted grade pay of Rs.1800 in PB-1,
irrespective of their pre-revised Group 'D' pay scale whether
granted to them on regular appointment/promotion or under ACP.
l INTEREST ON ARREARS OF SIXTH PAY
COMMISSION DEPOSITED BY GOVERNMENT SERVANTS IN
THEIR GPF ACCOUNT - CLARIFICATION REGARDING
Vide Para 7 of this Department's Office Memorandum
of even number dated 30th August, 2008 on the subject
captioned "implementation of Sixth Central Pay Commission

recommendation - fixation of pay and payment of arrears -
instruction regarding", instructions were issued that in case a
Government servant wishes to deposit his arrears in his General
provident Fund account (GPF a/c), he may be permitted to do
so. Clarifications are now being sought by some departments
as to whether the amount of arrears so deposited by the
Government servants in their GPF accounts will earn interest.
In this connection, it is clarified that the O.M. dated 30th August,
2008 does not specify otherwise, and as such, the amount of
arrears deposited by government servants in their GPF account
will earn interest. Such interest will be payable from the date of
deposit of the arrears in the GPF account.
All Ministries/Departments are requested to bring this
to the notice of their subordinate/attached offices.

l FIXATION OF PAY AND GRANT OF INCREMENTS IN
THE REVISED PAY STRUCTURE CLARIFICATION REGARDING
Following the notification of the CCS (Revised Pay)
Rules, 2008, this Department has received references from
some administrative departments, seeking clarification regarding
various aspects of fixation of pay in the revised pay structure
as also pay fixation and grant of increments in future under the
revised pay structure as also pay fixation and grant of
increments in future under the revised pay structure. The matter
has been considered in the Department. The points of doubt
raised by administrative departments and the clarifications
thereto are issued as under: -
1. As per the provisions of FR22 (I) (A) (1), split option
has to be submitted by the eligible employee (other than those
appointed on deputation to ex-cadre post or ad hoc basis or
on direct recruitment basis) within one month of promotion.
Some of the employees, promoted before 1.1.2006 as well as
after 1.1.2006 but before notification of Revised Pay Rules,
2008 implementing 6th CPC recommendations, had opted for
their pay fixation on promotion from the date of their next
increment which was falling after 1.1.2006 in the 5th CPC
scales as per the rules/pay structure then in force. Consequent
upon implementation of recommendation of 6th CPC in August/
Sept 2008 effective from 1.1.2006, the option submitted by a
number of employees has now turned to be disadvantageous.
Whether such employees may be allowed to revise their options
under FR22 (I) (A) (I).
l DOP & T's OM No. 6/8.2000-Estt. (Pt.-I) dt. 25.2.2003
provides that a Government Servant may give a revised option
for pay fixation under FR 22 (I) (a) (1) within one month from
the date of orders of such unforeseen developments or change
of rules. In any such cases, that have resulted from the
notification of CCS (Revised Pay) Rule, 2008, Government
Servants may be allowed to exercise a revised option for fixation
of their pay in the promotion post within one month from the
date of issue of these clarifications. If they have already not
been allowed to do so under DOPT's O.M. dated 25.2.2003
mentioned above.
2. As per Rule 5 of the Central Civil Services (Revised
Pay) Rules 2008, a Government Servant placed in a higher
pay scale between 1.1.2006 and the date of notification of
these rules on account of promotion, upgradation of pay scales
etc. can elect to switch over to the revised pay structure from
the date of such promotion (i.e. after placement in the
promotional grade), upgradation etc. The employees promoted
or upgraded to higher grade have option to have their pay
fixed/re-fixed as per the provisions of FR 22/FR 23 from the
date of next increment etc.
Whether such employees covered by Rule 5 of CCS
(RP) Rules, 2008 can also revise their options now to choose
either from the date of promotion/upgradation or the date of
increment etc. (Which may fall on the 1st July 2006, 2007,
2008 or 2009 etc.) as annual increment in the new structure is
given uniformly on 1st July?
l Proviso to Rule 5 of CCS (RP) Rules, 2008 states that
a Government servant may elect to continue to draw pay in the
existing scale until the date on which he earns his next or any
subsequent increments in the existing scale, or until he vacates
his post, or ceases to draw pay in that scale.
The Rule ibid further provides that in cases where a
Government servant has been placed in a higher pay scale
between 1.1.2006 and the date of notification of these Rules
on account of promotion, upgradation of pay scale etc. the
government servant may elect to switch over to the revised
pay structure from the date of such promotion, up gradation,
etc.
It is clarified that such case will be regulated under
proviso to Rule 5 of the CCS (Revised Pay) rules, 2008. After
switching over to the revised pay structure, Clarification 2 (the
method of fixation of pay on promotion after 1.1.2006) issued
vide O.M. No. 1/1/2008-IC dated 13.9.2008 will apply.
In the case of ad-hoc promotions granted between
1.1.2006 and date of notification of CCS (RP) Rules, 2008, a
Government Servant has the option to have his pay fixed under
provision to Rule 5. However, Clarification 2 (the method of
fixation of pay on promotion after 1.1.2006) issued vide O.M.
No. 1/1/2008-IC dated 13.9.2008 will not apply in such cases.
3. As per Rule 13 (i) of CCS (RP) Rules, 2008, in the
case of promotion from one grade pay to another and that
involving change of pay band, one increment equal to 3% of
basic may be allowed and in addition higher grade pay of the
promotional post may also be allowed. As per clarification 2 of
MOF OM No. 1/1/2008-IC dated 13.09.2008, on promotion from
one grade to another, a Government servant has an option
under FR 22 (I) (a) (1) to get his pay fixed in the higher post
either from the date of his promotion, or from date of his next
increment. As per the provisions of FR 22(1) (a) (1), the benefit
of fixation under above rule is admissible only in cases of
appointment involving duties & responsibilities of greater
importance. Further , the grant of option under above FR is
also subject to the condition that the appointment is not on
deputation on ex-cadre basis/ad-hoc or direct recruitment
basis It is not clear whether.
(a) FR 22 (1) (a) (1) still holds good in its present form
with all the attendant conditions: or
(b) The same has got modified on introduction of Sixth
CPC Pay Structure; and if yes
(c) What is the extent of modification to above FR.

l Point No. (a): FR 22 (i) (a) (i) still holds good.
Point No. (b) & (c): Clarification No. 1/1/2008-IC dated 13th
September, 2008 prescribes the method of fixation of pay under
FR22(1) (a) (1) after introduction of the system of Pay bands
and grade Pay.
4. Methodology for rounding off:
As per Rule 9 of the notification, the rate of increment in the
revised pay structure will be 3% of the pay in the pay band and
grade pay applicable, which will be rounded off to the next
multiple of 10. Whether rounding off to next multiple of 10 has
to be done in terms or rupees or even a paisa has to be
rounded off the next multiple of 10. For example, if the pay
after drawl of increment works out to Rs.10510.10 the same
has to be rounded off to 10520 or 10510.
l In the case Fitment Tables annexed with this
Department's OM of even number dated 30.08.2008, rounding
off has already been done and the same should be implemented
without any modification.
In the case of calculation of increments under the
revised pay structure, paisa should be ignored, but any amount
of a rupee or more should be rounded off to next multiple of 10.
To illustrate, if the amount of increment comes to Rs.1900.70
paisa, then the amount will be round off to Rs.1900; if the amount
of increment works out to be Rs.1901, then it will be rounded off
to Rs.1910.
5. Grant of stagnation increment:
Whether the employees who have been granted stagnation
increment between February 2005 or thereafter are to be
granted additional increment w.e.f. 1.1.2006, while fixing the
pay or not? Since they have reached at the maximum of the
existing pay scale.
l In all cases, where a Government servant has been
granted an increment (whether normal annual increment or
stagnation increment) after January 1, 2005, no increment will
be allowed on 1.1.2006 at the time of fixation of pay in the
revised pay structure.
2. All Ministries/Department are requested to take note
of the above clarification.

l INTEREST BEARING ADVANCES/SIXTH PAY
COMMISSION RECOMMENDATION
The undersigned is directed to refer to this
department's OM of even number dated 24th October, 2008 on
the above subject and to say that the eligibility criteria for grant
of advances for purchase of moped under Rule (17 (iv) and
purchase of computer under Rule 21 (5) of the Compendium

l Relaxation of procedures to be followed in
considering requests for medical reimbursement.
The undersigned is directed to state that under the extant
instructions, a CGHS card holder, who wishes to apply for
reimbursement of the expenditure incurred by him/her on medical
treatment of either self or his/her dependent family members,
the present reimbursement procedure needs verification of bills
and issue of essentiality certificate by the treating doctor, and
the Medical Suprintendent of the hospital. The process of
verification of bills and issue of essentiality certificates are
time consuming with the doctor at times being busy or being
away from office for whatever reason. This necessitates
repeated visits to the hospital for getting the verification done
and essentiality certificate obtained. Representations have been
received in the Ministry of Health & Family Welfare requesting
for doing away with the two requirements and for the Ministries/
authorities concerned to verify and check the authenticity of
the claims on the basis of the prescription slip and the diagnostic
report submitted by the Government servant/pensioner. In the
event of any doubt, the concerned Ministry/Authority can
always get verification done from the hospital concerned.
2. The undersigned is also directed to state that CGHS
guidelines currently provide for relaxation of guidelines to cover
full reimbursement in individual cases depending upon merits of
each case. In the case of Hon'ble Members of Parliament, the
powers to relax the guidelines have been delegated to the Lok
Sabha Secretariat and Rajya Sabha Secretariat respectively
and in the case of Hon'ble Chief Justice of Supreme Court and
Judges of the Supreme Court to the Secretary General of the
Supreme Court.
3. In order to reduce the burden on the specialists in
individual cases of medical reimbursement claim, it has been
decided with the approval of heads of the hospitals to revise
the guidelines for reimbursement by the competent authority,
as follows:
(1) It has now been decided to do away with the
procedure for verification of bills and issue of
essentiality certificate by the treating doctor, and the
Medical Superintendent of the hospital. Ministries/
authorities concerned may verify and check the authenticity of
the claims on the basis of the prescription slip and the diagnostic
report submitted by the Government servant/pensioner. In the
event of any doubt, the concerned Ministry/Authority can
always get verification done from the hospital concerned.
Modified reimbursement claim from along with checklist is
annexed.
(2) All cases involving requests for relaxation of rules

for reimbursement of full expenditure will henceforth be referred
to a Technical Standing Committee, to be chaired by the DGHS/
Addl. DGHS and consist of Director (CGHS) and subject matter
specialists. If the Technical Standing Committee recommends
the relaxation of rules for permitting full reimbursement of
expenditure incurred by the beneficiary, the full reimbursement
may be allowed by the Secretary (Health & Family Welfare) in
consultation with IFD. A check list for consideration of requests
for reimbursements in excess of approved rates may include:
(a) The treatment was obtained in a private non-empanelled
hospital under emergency and the patient was admitted
by others when the beneficiary was unconscious or
severely incapacitated and was hospitalized for a
prolonged period;
(b) The treatment was obtained in a private non-empanelled
hospital under emergency and was admitted for prolonged
period for treatment of Head Injury, coma, Septicemia,
Multi organ failure, etc.;
(c) The treatment was obtained in a private non-empanelled
hospital under emergency for treatment of advanced
malignancy;
(d) The treatment was taken under emergency in higher type
of accommodation as rooms as per his/her entitlement
are not available during that period;
(e) The treatment was taken in higher type of accommodation
under specific conditions for isolation of patients to avoid
contacting infections;
(f) The treatment was obtained in a private non-empanelled
hospital under emergency when there is a strike in
Government hospitals;
(g) The treatment was obtained in a private non-empanelled
hospital under emergency, while on official tour to non-
CGHS covered area;
(h) Approval for air-fare with or without attendant on the
advice of treating doctor for treatment in another city
even though he is not eligible for air travel/treatment
facilities are available in city of residence and
(i) Any other special circumstance.
4. The Office Memorandum is issued with the
concurrence of IFD vide Dy. No. 908/AS&FA/2009 dated the
20th February, 2009.

l TIMELY PREPARATION AND MAINTENANCE OF
ACRS
The undersigned is directed to say that this
Department has been emphasizing from time to time the need to
complete the Annual Confidential Reports of all classes of
employees in time for smooth consideration of cases pertaining
to confirmation, promotion, deputation to ex-cadre posts, etc. A
time schedule was prescribed for various stages in the matter
of writing of Confidential Reports in this Department's O. M. No.
35014/4/83-Estt.(A) dated 23.9.1985. The writing of ACR is a
public trust and responsibility. All Ministries/Departments are
again requested to ensure that the time schedule for preparation
of Confidential Reports and other instructions as laid down in
this Department's O.M. dated 23.9.1985 are followed to ensure
that ACRs are completed in time.
2. As cases continue to occur where confirmation,
regular promotion, appointment to sensitive posts, etc., could not
be considered in time because of non availability of ACRs for the
relevant period, the matter of timely completion of ACRs was
further reviewed in this Department and it has been found
necessary to prescribe a time limit after which the Reporting/
Reviewing Officer shall forfeit his right to record the ACR. It has
been decided that while the time-limits prescribed in the aforesaid
O. M. dated 23.9.1985 should be adhered to as far as possible,
in case the ACR is not initiated by the Reporting Officer for any
reason beyond 30th June of the year in which the financial year
ended he shall forfeit his right to enter any remarks in the ACR of
the officer to be reported upon and he shall submit all ACRs held
by him for reporting to the Reviewing officer on the next working
day. Similarly, the Reviewing Officer shall also forfeit his right to
enter any remarks in the ACR beyond 31st August of the year in
which the financial year ended. The Section entrusted with
maintaining the ACRs shall, while forwarding the ACRs for self-
appraisal with copy to the Reporting/Reviewing Officers, also
annex the schedule of dates as enclosed herewith. It shall also
bring to the notice of the Secretary concerned in the case of
Ministry/Department and the Head of the organization in the case
of attached and subordinate offices, the names of those Group
A and B Reporting Officers and Group A Reviewing Officers in
the month of October after receiving the completed CRs who
have failed to initiate/review the ACRs even by 30th June or 31st
August as the case may be. The Secretary in the Department/
Head of the organization in the case of attached/subordinate
offices may direct to call for the explanation of the concerned
officers for not having performed the public duty of writing the
ACRs with in the due date and in the absence of proper
justification direct that a written warning for delay in completing
the ACR be placed in the ACR folder of the defaulting officer
concerned.
3. In case the remarks of the Reporting officer or
Reviewing Officer as the case may be have not been entered in
the ACR due to the concerned officer forfeiting his right to make
any entry as per the provision in para 2 above, a certificate to
this effect shall be added in his ACR for the relevant period. In
case both the Reporting officer and Reviewing officer had
forfeited their rights to enter any remarks, the CR format with the
self appraisal given by the officer to be reported upon will be
placed in his ACR dossier.
4. All the Ministries/Departments are requested to kindly
bring to the notice off all concerned the above instructions for
future preparation and maintenance of ACRs. These instructions
shall be applicable for the ACRs for the period 2008-09 onwards.
In case any CR for the past period is pending completion, the
concerned Head of the Organization in the case of attached/
subordinate offices and the Joint Secretary concerned in the
Ministries/Departments may taken appropriate measures to
ensure that the CR dossier is complete within the next 6 months
either with the relevant CR or the required 'No Report Certificate"
for valid reasons.

The question of continuance of payment of Split Duty
Allowance to Group 'C' and Group 'D' employees of the
Department of Posts who are placed on split duty has been
examined further in the Directorate in consultation with integrated
Finance wing and it has been decided by the competent authority
to continue the payment of Split Duty Allowance at Rs.50/- P.M.
for the period from 01.7.2005 to 30.06.2008 and for a further
period from 01.7.2008 to 30.06.2011. The terms and conditions
will be as follows:
(i) The break between two duty spells is not less two
hours.
(ii) The Split duty allowance will be admissible for actual period
for which the official is on split duty and when he is placed
on a continuous duty, he will forfeit the right to draw the
split duty allowance.
(iii) The Split duty allowance will not be admissible during the
period of leave and training.
(iv) The official residing beyond 5kms from his duty place are
only eligible for this allowance. This issues with the
concurrence of the Finance Advice (Postal) vide their Dy.
No. 30/FA/CS/09 dated 12.02.2009.

l Date of next increment in cases where Government
servants are not able join posts in a particular grade pay on
promotion/appointment on 1st of January of a year due to
Sunday or Gazettd holiday-clarification regarding.
As per the provisions of Rule 10 of CCS (RP) Rules,
2008 w.e.f 1.1.2006, in the case of all Central Government
employees there is a uniform date of increment, i.e. 1st of July
of every years Government servants completing six months
and above in the revised pay structure as on 1st of July are
eligible to be granted the increment. From the above provision
of CCS(RP) Rules it flows that Government servants who have
rendered less than 6 months of service as on 1st of July of a
year will not be eligible to draw increment on that day and their
date of increment will fall 12 months later on the next 1st of
July. Accordingly, all the Government servants who join posts
in a particular grade on account of promotion/appointment etc.,
on 1st january of a year will be eligible to draw their annual
increment on the 1st of July of that year. However, those who
join the posts between 2nd January and 30th June will not be
eligible for the same.
2. In the light of the above position, some administrative
departments have sought clarification from this Department
regarding date of next increment in cases where Government
servants are not able join posts in a particular grade pay on
promotion/appointment on 1st of January of a year due to 1st of
January falling on a Sunday or Gazettd holiday. In this connection,
it is clarified that in the normal course, if a Government servant

l Recommendations of Sixth Central Pay
Commission-clarification regarding encashment of leave.
With regard to entitlement of encashment of leave
during LTC, a doubt has arisen whether the leave encashment
during LTC can be allowed fro less than 10 days period. The
issue was referred to Department of personnel and Training
for clarification.
2. Department of Personnel and Training has clarified

FIVE LAKH PEOPLE LOST JOBS-OSCARFERNANDES
The government on Friday (20.02.2009) said
five lakh people lost their jobs between October and
December 2008 owing to economic slowdown.
Minister of State (Independent charge) Oscar Fernandes
said the global financial crisis affected certain
segments of the Indian economy also and the
government was concerned about the adverse impact
of this crisis on labour.
He was replying to a calling attention motion
in the Lok Sabha on "situation arising out of large scale
retrenchments, lay-offs, wage cuts and withdrawal of
statutory benefits of workers in the organized and
unorganized sectors and steps taken by the
government in this regard, "moved by Gurudas
Dasgupta, Rupchand Pal and Santasri Chatterjee.

Schedule Financial Powers of the Head of Postal Division
l Revision of Financial powers of Head of Postal
Division in the Department of Posts.The matter relating to revision of Financial powers of
the Head of Postal Division was under consideration of the
department of Post for some time post. After careful consideration
of all the aspects and in consultation with the Integrated Finance
Wing, the Secretary, Department of Posts is pleased to delegate
financial powers to the Head of Postal Division, as detailed in the
enclosed Schedule-III.
(2) The Secretary, Department of Posts in consultation
with the Financial Advisor of the Department is also pleased to
declare the Head of Postal Division as Head of Office (as
mentioned in FR&SR, GFR, FHB and CCS (Pension) Rules in
respect of the staff under their administrative control, in terms
of Rule 14 of DFPRs.
(3) These financial powers shall be exercised subject to
the conditions and limitations mentioned in Note-1 to Note-7 of
Schedule-III of Schedule of Financial Powers.
(4) The revised delegated financial powers contained in
Schedule-III, as enclosed, will replace the existing Schedule-XII
and Schedule-XIII of Schedule of Financial Powers, so far as
relates to Head of Postal Division with immediate effect.
(5) The matter of revision of financial powers of Director
GPO and Director Foreign Post will be examined separately in
the Directorate. Till that time they will continue to exercise the
existing financial powers.

Schedule Containing the Financial Powers of the Head
of Postal Division
Note-1 : For the purpose of this schedule, the term Head of
Postal Division includes Head of a Postal Division in Group A
and Group B and also includes Chief Postmaster, Sr. Postmaster
and Superintendent Foreign Post. The officers will exercise
these financial powers as per operational requirements in
respect of offices/establishments under their administrative
control.
Note-2 : The financial powers contained in this schedule are
subject to the limitations and restrictions laid down in the
Delegation of Financial Powers Rules 1978, regarding the
financial powers of the authorities subordinate to the President
and they can be exercised only in respect of the officers and
the establishment under the control of the Director General
(Post).
Note-3 : The powers mentioned herein shall be exercised
subject to the condition that expenditure involved shall be met
from the funds placed at his disposal by competent authority.
Note-4 : No work requiring sanction of higher authorities may
be sanctioned by the officer in parts as two or more distinct
works.
Note-5 : These powers shall not be delegated further nor any
person shall be authorized to exercise these powers.
Note-6 : Financial Powers contained in this schedule shall be
exercised keeping in view the conditions and limitations
contained in the Delegation of Financial Powers, General
Financial Rules, Financial Hand Book Volume-I, Fundamental
Rules & Supplementary Rules, Departmental Code Books,
Manuals and instructions/guidelines issued by the Ministry of
Finance from time to time.
Note-7 : All conditions/instructions as contained in column-4 of
the schedule shall be complied with while exercising financial
powers so delegated.

held at Vishakapatnam A. P. from 29.03.09 to 31.03.09
under the presidentship of Com. Milan Bhattacharya.

flag & NFPE flag respectively. Com. S. K. Humayun, Deputy
General Secretary anchored the open session with his

organised thereafter. Com. Ch. Hanumantharao
President P4 Guntur Division Presided the meeting. The

v A State level convention of Systems
Administrators of Tamilnadu Circle was organised by the
Divisional Union, Tiruchirappalli on 07.04.09. Com. N.
Selvan, Divisional President presided the meeting. Com.
Senthil, System Administrator presented a key note on
the issues confronting the Systems Administrators. More
than 15 SAs from various divisions participated in the
discussions. Com. P. Arumugam, Circle President (Elect),
Com. J. Ramamoorthy, Circle Secretary (Elect) Com. S.
Raghupathy, convenor Adhoc committee were the main
speakers other than Com. K. Ragavendran, Secretary
General NFPE and Com. K. V. Sridharan, General
Secretary. A Purposeful convention enlighting the issues
of SAs ended with the optimistic note that NFPE & P3
union will take care of their issues sincerely and seriously.

RETIRED FROM SERVICEIt was a sudden shock to the CHQ that
Com. Subhash Sharma, Ex-Treasurer CHQ and
Circle Secretary Haryana Circle has suddenly retired
from the Service on 16.03.09 under voluntary
retirement. He did not inform his decision to any of
his friends who could have advised him to desist
such move and serve for the remaining six years of
Service.
He was the Circle Secretary, Haryana Circle
over 17 years and also the Member, RJCM over
twenty years and served a lot to this movement. His
contribution to CHQ as Treasurer is rememberable.
A Felicitation meeting was organized by the
Gurgaon Comrades on 31.03.09. Since the General
