1 BHARTIYA POST DECEMBER, 2009 We had an unique experience in organizing two days All India Study Camp, work shop Cum seminar in the first time of our movement at Thiruvananthapuram from 04.11.09 to 05.11.09. It was the decision of the Kurukshetra CWC to experiment with such an attempt in conducting workshops to educate the leadership at the base levels. The result is encouraging and more enthusiastic. First at all, the receiption committee headed by Com. M. Krishnan, beloved CHQ President has chosen the venue in a calm with natural surroundings with peaceful atmosphere called as 'EMS Academy' which itself exhibited the success of the programme before its start. There were 153 delegates representing sixteen circles and no representation from the Himachal, Uttarakhand, Bihar, Haryana, Assam & J. K. There was only one representation from Uttar Pradesh & Delhi Circle. They had really missed the benefits of the workshop. Such absence and under representation should be avoided in future. Dr. Prabhat Patnaik, the eminent economist who consented to inaugurate the workshop could not attend and in the place, Com. C. C. Pillai, Ex- S. G. NFPE with his elegant oration inaugurated the workshop on 04.11.09 morning. His Presentation was about 1 hour which related to policies pursued by the Government and the problems of the labour in India. Com. M. Krishnan, CHQ President took the class of "History of P&T Trade Union movement" for about 2 ½ hours continuously, inspiring the delegates to know about the past history, sacrifice, and the un compromising fight of the NFPE etc. A superb presentation with all datas, details which motivated the delegates to work further more for the cause of fellow comrades. After lunch, Com. B. G. Tamhankar, Ex President, NFPE delivered his oration on the topic of 'Safeguarding against contributory negligence in S. B. cases & RTI Act" for about 1 ½ hours. The education on RTI and its usage was simply superb. The class was most educative on the subject. Thereafter com K. V. Sridharan, General Secretary has taken the subject of 'Staff rulings and the role of union activists/office bearers'. He has taken more than three hours in detailing various staff ruling and orders on all subjects and many delegates felt that it was very useful for their functioning. An interaction session with all the three comrades who have taken class was held and it was lasted for more than 3 hours. The first day workshop come to the end in the midnight of 04.11.09. On 05.11.09, morning Com. K. Ragavendran, Secretary General, NFPE has delivered his lecture on 'Policy offensives and our counter strategy'. He elaborated the cause, effect and action very nicely which is educative and encouraging. Sri. M. C. Nair, the retired SSPOs, Thirvananthapuram and also the 1968 Strike victim has taken the class on "Disciplinary Rules and the role of Defence Assistants and Trade Union". Marvelous Presentation. Even a lay man could understand about the conduct and disciplinary rules. He took about 1/ ½ hours. Thereafter he replied to all the question of the delegates on the subject of an additional 1 ½ hours. The participants were gained much about his experiences and also about the usage of loopholes in the rules by the union activists while defending the cases. In the evening Mrs. Shobha Koshy, the Chief PMG, Kerala Circle has presented the Guest lecture on 'Effect of globalisation on postal services - our task and responsibilities." This is the first time that an higher level officer attending the Trade Union seminar has spared three hours time not only for the presentation but also to answer all the queries of the participants. More applauses during her oration. Detailed and most exhaustive in all the areas of the Department's present programme and future vision. The delegates were enriched, educated and encouraged with her presentations. Around 7.30 PM, Com. K. Ragavendran Secretary General who is the working president of CHQ has delivered vote of thanks. The workshop came to the and with more claps and cheers thanking the yeoman service of the first start of the workshop in the history of Postal Trade Union. During interaction, the General Secretary has conveyed his desire to conduct similar type of workshops in each circles regions so that we can mould further. Further he suggested to consider for conducting another All India workshop for two days exclusively on disciplinary rules and role of divisional/ Circle Secretaries in drafting the staff matter and basic knowledge of drafting and taking up cases with their respective units. The feedback from all participants was most encouraging. Many felt that the workshop was most useful. There was no wastage of time during those two days and no rest was allowed to delegates. There was a total discipline in all areas and it was really and educative camp. The CHQ salutes all the participants for the creation of another mile stone in the history of our movement. However I do belive and it was discussed inthe seminar more and more seminars of this typeshould be happened at all the levels at circle, divisionallevel and CPMG of the same circle should also becalled as CPMG of Kerala was called.

More over as discussed in the seminar that aseparate seminar at the National level especially tocreate defence assistants must be industrial. q This is a wonderful thing happened to theorganization for the first time. It will come a long wayto strengthen the organization. This Seminar was very educative. No singlemoment was wasted. The subjects covered were verypertinent for this moment. UID may bank on India Post dataThe Government will take help of the

department of posts in providing unique identity numberto people in the less-accessible parts of the country.

The department of posts is already running aprogramme to electronically connect all villages of thecountry with its nearest post offices. India Post hasasked its rural post offices to identify and map theirarea of service and come up with specific data aboutthose areas. The project will see collection of datapertaining to the number of households that come withinthe domain of the respective post offices and may evendo a headcount of the people in those areas, a postaldepartment official said.

The Unique Identification Authority of India(UIDAI) may seek this data from the postal departmentin order to get access to information about the peopleliving in the less accessible rural parts of the country.

Around 1.22 lakh villages will be uplinked with all thebranch post offices spread all over the country and UIDAIhas shown its interest in this data, an official in theministry of information technology and communicationssaid on condition of anonymity.

The postal department, a part of the workinggroup in the UIDAI, is helping the newly-formed bodywith collection and verification fo data because of itswide reach, especially in the rural areas. The UIDAIproject aims at creating unique identification numbersfor all Indians by 2011.

This is not the first time that authorities haveshown interest in the data collected by post offices. Asimilar project under the ministry of statistics andprogramme implementation is underway, wherein thepost offices are collecting primary data for rural India'snew consumer price index. Dear Comrades / Colleagues,The Postal JCA of NFPE - FNPO - AIPEDEU

- NUGDS has met in the Office of NFPE on 28.10.2009and reviewed the situation as a follow up to theimplementation of GDS Committee and pendingissues of Postal Regular Employees. It has beendecided that the Postal JCA will again meet inDecember 2009 after the finalisation of demands byGDS Unions and other Unions for reviewing thesituation. However, the Postal JCA with grave concernreviewed the intensifying attack on the RMS & MMSand the new schemes and plans aimed at liquidatingthe RMS & MMS completely. The JCA has thereaftercame to the unanimous conclusion that unless themoves are resisted with all our might immediately theDepartment will go ahead with its negative moves ofmerger of RMS Divisions; Merger of SROs with HPOs;Merger / Abolition of RMS Offices in violation ofagreement between the Directorate and Staff Side;Outsourcing of MMS functions to Private Contractorsetc. It was therefore decided upon to launch an AllIndia Programme of Action under the banner of the

The Postal JCA also noted with grave concernthat the solemn agreement reached after hecticnegotiations between the Department and the Staff Sideon the matter of merger of 101 RMS Offices with allmen and materials identified with less than 10,000 mailvolumes with the neighbouring RMS Offices is beingbreached in the Second Phase of Mail Consolidation.Circle Administration here and there have started toattack the existence of RMS Offices with more volume

of work in a blatant violation of the agreement reachedat the All India level making mockery of such bilateralagreements.

The constitution of a Committee headed bythe PMG Kurnool without the knowledge of Staff Sideand the recommendations of that Committee to merge

all SROs with the HPOs and carry on the functionsunder the control of the Head Postmasters is a rudeshock to the RMS & MMS Employees. It is afraid that

such type of sweeping recommendations of the aboveCommittee without any kind of mutual discussionswith the staff side will be implemented unilaterally

resulting in the liquidation of RMS and that alreadyanother Enlarged Committee with Circle level Officershas been formed for supervising the implementation

of the recommendations.Already 5 ROs out of a total of 14 ROs in the

country have been abolished and the balance ROs

are also in the process of being liquidated.124 TransitSections including TMPs have been abolished and mailsdiverted to road conveyance causing delay in public

mails. There are actions initiated to reduce the numberof CRCs in several Metros at the command of theSecretary Department of Posts. There has been no

purposeful effort to consider the long pending demandof the Staff Side to finalise the work norms in CRCsand other branches in a scientific manner to do away

with the unilateral fixing up of CRC norms. Howeveraction has been initiated to close down the CRCs!

MMS has been operated by the Department

for the speedy and punctual mail conveyance all theseyears but the policy has been reversed to outsourcemore and more of the mail conveyance. MMS is being

replaced by CMS denoting the handing over of mailconveyance to private players as against the stiffopposition of the staff side. With the focus shifting

from letter mail to logistics more and more universally,and that the Department of Posts also had enteredinto the logistics services, the future is for a bigger

logistics operation in India due to its expanding marketof logistics. In such a scenario instead of planning tobuild our own fleet of bigger logistics vans and staff,

the outsourcing of mail, speed post and logisticsconveyance to private contractors is a totally negativeapproach aimed at liquidation of the MMS wing.

To cap it all the Department has started tomerge RMS Divisions in some circles also and theStaff Side is apprehensive that the cumulative effect of

all the attacking posture is aimed at total liquidationof RMS and MMS and merge the entire RMSoperations with Post Offices and hand over whole MMS

operations to CMS.The necessary intervention needed on the part

of the Department of Posts at the Government level

for ensuring upward revision OTA Rates which is farlow in comparison to casual labour wages and forrevising the OSA is absent. Even the re-fixing the

ceiling limit for OT entitlement is not done despite staffside representations. There have been no attempt toget the posts of Drivers and Mail Guards / MSEs filled

up despite staff shortage. This shows the Departmentof Posts is only interested in attacking the interestsof RMS & MMS and ignores the interests of staff.

The Postal Joint Council of Action after athreadbare discussion has come to the conclusion toaddress immediately to you seeking your personal

intervention for effecting a complete reversal of thepolicy of liquidation of RMS & MMS and initiatemeasures to strengthen the RMS & MMS wing through

constructive policy directions. The Postal Joint Councilof Action has also been forced to take a unanimousdecision to launch an all India Programme of Action

by the entirety of Postal Employees under the bannerof the Postal JCA immediately in the month ofNovember 2009 that will culminate in an Indefinite Strike

Action by all RMS and MMS Employees belonging toNFPE and FNPO organisations in December 2009 forwhich Notice would be submitted at the appropriate

time. The Postal JCA also expresses its hope thatthere will be change of course by the Department ofPosts and that meaningful dialogue with both our

Federations and the All India Unions affiliated with uswould be preferred on the enclosed Charter of Demandsto maintain tranquillity and peace in the India Post.

The department of posts (DoP) will deliver amonetary value to the heritage buildings, large chunksof prime land and other properties that it owns as itbraces to adopt a new accounting method that willsee its financial statement presented just ascorporates.

The assets, scattered across the country,will be assigned a financial worth, with the help ofaccounting rule-maker Institute of CharteredAccountants of India (ICAI) and the urban developmentministry. A coordination team comprisingrepresentatives of these bodies has already been setup to prepare a road map and implement the project,said a DOP official involved in the exercise.

The project is presently being experimentedin a few postal circles in the national capital before itis extended to other parts of the country. The idea tovalue heritage buildings and assets is part of thegovernment's larger objective to make its accountingpattern-scientific and corporate-like.

The department presently follows the cash-based accounting system wherein only cash inflow(in the form of receipts) and outgo (as expenditureand payments) are shown. Having found severalshortcomings in this form of accounting, it has decidedto take to the accrual basis of accounting. In an

accrual system, a transaction is recorded themoment there is certainty about it going through, evenif the attendant cash flow takes a while. This systemgives a better financial picture of an organisation.

The DoP, among the country's oldest servingpublic institutions, has over 800 heritage buldings toits name. The project will see the department's assetsas well as liabilities valued at a fair price, one whichwill be derived in accordance with the accepted normsof valuation, said the official who asked not to benamed.

The finance ministry and the planningcommission have also asked all the governmentdepartments to gradually shift to the accrual systemof accounting, under which all values of the heritagebuildings they possess may be based on the year ofits construction and all the old buildings and structureswith no historical background or data may be assigneda value of Re.1 Finalising their value is in thepreliminary stages of discussion, the official said.

While the assets will be brought together andassigned a value as per settled norms, counting theliabilities will include bringing together details of allmoney spent, which also includes payments madein lieu of interest and premium, said another official.

PENDING ITEMS WHICH REQUIRE

DISCUSSION & SETTLEMENT1. Filling up the APM Accounts LSG, posts

as per 1976 LSG Accountants Rules 1976 andformation of separate cadre for providing channel

of promotion

The channel of separate promotion forAccounts line officials is pending over three yearsbesides implementation of 1976 LSG RecruitmentRules.

Suitable action may please be taken to finalizethe issue pending over years.

2. Filling up of Residual vacancies overLGO exam since 1999 - 2000 onwards

The issue has not yet been sorted out in many circles.The unfilled vacancies in LGO exam have not beenfilled up resulting heavy shortage of staff in manydivisions.

Suitable action may please be taken to fill upall the pending residual vacancies.

3. Withdraw the orders fixing responsibilityon DDOs/APM Accounts for the over payment of

Pay & Allowance to Postman on account offixation under R. P. Rules

On 13.1.09 The Secretary (P) assured toreconsider the issue and ensure no recovery on partof APM Accounts & Accountants. The Secretaryobserved as unfortunate in the case of Rule 14 chargesinitiated on the date of superannuation of Sri. V. V.Nargida, APM, Accounts Pune city as he did not payRs.727671.61 towards contributory factor for excessdrawal to postmen on implementation of 5th CPCorders.

It is requested to withdraw the orders and dropall charge sheets fixing responsibility on DDOs sincethere was confusions at all levels at that time

4. Counting of Special Allowance for pay

fixation case of PO & RMS Accountants

The Special Allowance granted to JAO qualified officialhas been taken for pay fixation benefits on ACPpromotion similar application may be extended to PO& RMS qualified Accountants also.

5. Counting of Past services of erstwhileR.T.P. for promotion & pension as per the

Supreme Court direction

Pl refer our letters on the reference whichcontain full justification of this demand with concernedjudgments and other Govt orders. In nutshell werequest to consider the issue on the following maingrounds.

(i) As per the Directorate letter dated 19.4.96, theimplementation of the Ernakulam CAT judgmentgranting the past RTP service as regular servicefor all purposes was restricted only to theapplicants of the O.A. This is against to thedecisions of the various judicial pronouncementsthat the benefits should be extended to thesimilarly situated persons.

(ii) During 1970 to 1974, even the pre training servicesof certain officials engaged as postal clerk wereregularized. The RTPs were trained and utilizedfull time in the clerical posts to manage all theworks of the post office.

(iii)The CAT, Chennai held that the services renderedby the ex RTPs at APS shall be counted asqualifying services for all purposes. The ChennaiHigh Court, on appeal by the department hasupheld the decision of the CAT in WP No. 37117to 37119 of 2002 and directed the department toextend the benefits.

(iv)In another case, the Apex court under Civil AppealNo.5739 of2005 filed by Sri M. Mathivanan, PostalAsst, Cuddalore division upheld the decision ofextending the benefits and dismissed the appealfiled by the department with costs.

(v) The Directorate has directed the Circle Heads tocollect, compile and furnish details of ex-RTPsdeputed to APS to consider for extending thebenefits to all similarly situated persons. Thereafter there is no action in this regard.

This demand is pending over decades andthere should not be any discrimination between twoequals. It is requested to consider the case and causeappropriate orders for counting the past services ofthe RTP for all benefits.

6. Drawal of SB Allowances to all workingin SB branches on computers

No information is furnished in the ATR. With theintroduction of total computerization and SB LAN in

post offices, any official who had under gone LANtraining is ordered to work in SB branch. There is everyjustification to grant this allowance to the SPMsworking in single/double handed offices. It is requestedto grant SB Allowance to all posts in SB branch withoutcondition of passing the examination.

7. Road mileage Allowance to SystemsAdministrators

Eventhough it was assured in the meeting on13.01.09 to grant road mileage allowance to systemsAdministrators, the issue is still pending.

It is requested to cause orders early.

8. Stop harassing staff on contributory

factors for simple and flimsy reasons by misusingthe provision of 'unbecoming of Government

Servant' deviating the rules contained in VolumeIII, FHB etc.

The Directorate guidelines issued vide letterNo. 6/8/59-Disc dt. 9.7.1959, 25/49/60-Disc dt.30.11.60and 15-9/74-1NV dt. 10.2.75, and subsequent ordershave been violated and the officials have beenproceeded under contributory negligence factor forflimsy reasons and awarded with huge recoveries.

The provisions contained in Rule,106,107, 108& 111 of Postal Volume III and the provision of honesterrors can be condoned contained in Rule 204 A (1)vol II and the provision of Rule 58, Appendix 4 of F.H.B.volume I in dealing of recovery have been totally ignoredand sidelined.

The main intention of the Government that'while deciding the degree of an officer's pecuniaryliability, it will be necessary to look not only to thecircumstances of the case but also to the financialcircumstances of the officer, since it should berecognized that the tendency should not be such asto impair his future efficiency has been totally deviatedand violated in almost all the cases. There are morethan twelve references like this, we made to theDepartment.

Suitable & proper guidelines is required toarrest the menace of fixing responsibilities on innocentofficials under one pretext or the other.

In addition to the above, the following

items are required immediate attention to resolvethe items.

1. Clarification in respect of Fixation of payon promotion after 1.1.2006 requested.

Despite crystal clear orders in the R.P. Rules 2008under Rule 13 (i) that if the pay in the pay band afteradding the increment is less than the minimum of thehigher pay band to which promotion is taking place,pay in the pay band will be stepped to such minimum,

this has not been implemented in many circles inrespect of promotees in Postal Assistant cadre andalso in the case of HSG-I promotions. Similarly underRule 7 1(A) (ii) while detailing the fixation of initial payin the revised structure, it was stated that if theminimum of the revised pay band/pay scale is morethan the amount arrived at as per (i) above, the payshall be fixed at the minimum of the revised pay band/pay scale. The initial fixation has not been granted inmany places with the wrong notion that the initial payis pertaining only to the direct recruitments and notfor others. Suitable clarificatory orders may pleasebe issued to rectify the mistakes in the pay fixation.

2. Request for discontinuance the practice

of obtaining fidelity / security bond from theemployees handling cash

The 5th CPC in its report vide para 62-13recommended to discontinue the practice of obtainingfidelity / security bond from employees. In the presentstage of handling huge cash, obtaining fidelity bondfor Rs. 3000/- to Rs. 5000/- does not serve anypurpose. A lot of manpower is being wasted inAccounts branch in maintaining these records. Similaris the position of inspecting offices also. Only in rareand exceptional cases, the guarantee money isreceived. The employees are unnecessarily creditingpremium every year to obtain fidelity bond.

It is requested to consider and discontinuethe practice of security bonds which has no longerserving any purpose.

3. Non-Drawal of HRA to the officiating SPMsworking at offices having attached quarters.

It is brought to our notice that despite clear instructionsissued by the department in its letter no. 24/3/76/PAPdt. 20.8.79 also appeared in FR, SR Part IV in chapterX that HRA may be grated for the maximum period ofthree months when the official is posted to officiate ina post to which rent free accommodation is attachedbut not provided, the due HRA for three months hasnot been drawn & paid to the officiating SPMs in manyplaces.

There are several instances in Satara divisionin Maharastra Circle and Bhatinda in Punjab Circle.Even though the senior BCR officials were ordered tolook after the charge of PM/SPM until regular posting,HRA has not been paid to the officials who are officiatingsuch vacancies resulting loss in emoluments due toofficiating in higher posts.

Similarly, even though the power ofdequarterisation of a post attached Quarters is nowdelegated to Heads of Circle vide Directorate letterno. 10-4/2003 - Bldg. dt. 6.5.03. the Circle heads arenot according proper sanction for dequarterisation/

Suspension of Quarters for the periods of suchofficiating periods exceeding 90 days.

The officiating officials should not suffer afinancial loss due to the administrative problem of non-posting of a regular incumbent to the vacant post within the stipulated period. Prolonged officiatingarrangements is an ultimate loss to an officiating officialfor no fault on his side.

It is therefore requested to issue clarityinstructions to all Circle heads to settle the pendingissues accordingly and the copy of the same may beforwarded to union.

4. Non grant of Special Allowance to

unqualified Accountants - request orders

When TBOP / BCR Postal Assistants areordered to officiate as Accountants in HPOs, in theabsence of qualified hands, the due special allowancehas not been drawn and paid since the DDOs areconsidering TBOP as LSG. This is incorrect.Necessary clarifications may please be issued.

5. Protection of pay of defunct scale of PO& RMS Accountants who opted for general line

under directorate letter No. 2-22/88 - PE I dt.01.12.92.

A kind attention is invited to the reference citedabove in which directorate letter, the case of late NathaSingh, Accountant Punjab Circle was decided.

The decision taken in the said case was purelya policy decision and the contents of the said lettermight have been applied to all other similar cases.

Unfortunately, the said decision was notcommunicated to other circles which causes hardshipto those defunct scale Accountants who switched overto general line.

To cite an instance on Sri B.S. Dhiman,Accountant, Dharamshala Division in HimachalPradesh who opted to defunct scale earlier waspromoted to LSG APM Accounts on 11.06.91 in thepre revised scale of Rs. 1400- 2300 and his pay wasfixed under FR 22 (C). When he was switched over togeneral line, his pay has been refixed under FR 22 (a)2 considering that it did not involve higherresponsibilities. There was a drop in his emolumentsand perennial loss on emoluments.

If the decision contained in Directorate letterdt. 28.5.02 cited above is applied is his case as ifapplied in the case of Sri Natha Singh of Punjab Circle,the official will not face any reduction of pay or recovery.

It is most pertinent to mention that whiledeciding the cases of pay fixation of the officialsworking in SBCO/ Administrative officials under TBOP/BCR scheme vide Directorate letter no. 202/92 - PE I

dt. 01.12.95, they were allowed direct fixation in thepay scale of TBOP/BCR. The Directorate letter dt.28.05.02 is also based on the similar analogy but hasnot been applied in any other circle except to Punjabdue to non-circulation of the contents.

It is therefore requested to cause necessaryinstructions to all Heads of Circles bases on the letterdt. 28.05.02 of the Directorate to settle the problemsif any prevailing similar to the case of Shri B. Dhiman.

6. Payment of Special Allowance to the staffworking on MPCMs

It is rather shocked to see the communicationcontained in letter No. 1-11/2008-PC dt. 30.10.08withdrawing the payment of special Allowance to thestaff working on MPCMs without verifying the previousdecisions.

After the Fifth CPC, the issue was discussedby the Staff side and it was agreed to continue thedrawal of special allowance to the MPCM CounterAssistants considering their responsibilities and jobs.

The Directorate has clarified vide its letter No.43/3/97-Tech. dt. 21.10.97 to grant the specialAllowance only to the Counter PAs. This was issuedafter the release of the Fifth Pay Commission anddiscussions thereon. Based on this, the due MPCMallowance is being drawn and paid in many circles.

As such, the withdrawal of the said allowanceis arbitrary and unjust. Further the allowance is grantedfor the extraneous and hard work performed by theCounter PAs and not alone for the computeroperations.

It is therefore requested to withdraw the ordersdt. 30.10.08 and allow the drawal of MPCM allowanceto the officials deployed at the counter.

7. Non grant of Split Duty Allowance to

officials - Case of Punjab Circle.

The officials being brought on split dutyattendance have not been paid with due allowancedespite they fulfill requisite qualifications in all thedivisions of Punjab Circle over three years.

It is stated that the Chief PMG, Punjab Circlehas sought clarifications form the Directorate vide hisletter no Estt/4-R/2001 dt. 24.04.2008 and it is pendingat Directorate.

The orders on the subject are crystal clearand seeking clarification on the subject is unwarranted.The non payment of due allowance over three yearscauses concern.

It is requested to intervene and causenecessary orders and ensure immediate payment ofsplit duty allowance to the entitled officialsretrospectively.

It is brought to our notice that the regular LSGofficials who were ordered to officiate in regular HSG IIvacancies have not been drawn and paid with dueofficiating pay in Rewa Division. This is against to theprovisions of FR & also the Rule 50 (1) (2) & (3) ofP&T manual volume IV.

The representation of the officials have alsonot been entertained. One of such representationsubmitted by Sri. Darmuni Sharma, LSG regular official(not BCR) requesting drawal of officiating pay for hisofficiating period in HSG II is enclosed herewith foryour reference.

It is rather dismayed to note that despite theassurances made on 13.01.09 to discuss the proposalof cadre review sent by this union, there is no meetingarranged so far for this purpose.

Similarly, there is no meeting held or anyinformation sent to our union about the proposal of'Postmaster cadre'. Since both issues are interlinked,a detailed discussion is required at once.

It is further learnt that the process ofimplementation of Postmaster's cadre is beingspeeded up by getting approval of the recruitment rulesfrom the DOPT for its implementation. This causes aserious concern.

If the staff side is simply neglected or nottaken note of on this serious issue and avoid bilateraldiscussions, on cadre review & Postmaster cadre, thisis to inform that it will hamper the relations and wehave no other alternate except to agitate against theseunilateral moves of the Directorate,

One Sri. R. K. Dubey who is working in Rewa

division since his appointment on 18.02.1974, has beenaccorded LSG promotion only with effect from05.08.2008, whereas his junior one Sri M. K. Shuklawho entered the service in March 80 was accordednotional LSG Promotion w.e.f. 01.01.1998 and nowaccorded with HSG I promotion.

The official has represented since 22.09.2007to Chief PMG. The Chief PMG has sent reply that hehad preferred late representation. Again the official hasrepresented seeking justice since the irregularities inthe grant of notional LSG promotion can be settledlater also since it is not the fault of the official. TheChief PMG vide his letter No. STA/10-42/2009-Rep/DA 3 dt. 12.08.2009 has simply replied as,'Representation is accepted and rejected' There wasno reasons mentioned in the letter for the rejection ofgenuine staff greivance.

This is causing a concern. The official is atthe verge of retirement and this injustice will causeirrepairable loss in his carrier.

Despite there is no administrative necessity andall the three division justify for their continuance, proposalis being mooted out by the PMG, Vijayawada to upgradeGuntur Division by merging Tenali Division with the samein order to raise the status from Group B to the SeniorSupdt. level and also to downgrade the PrakasamDivision.

The Proposal is arbitrary and unwarranted. Thehiden reason, as widely spoken is to upgrade GunturDivision to SSP status where many are willing to workand no one desire to work or continue at PrakasamDivision at present. If it so, it is nothing but to take care ofsome personal interests and not in the interest of serviceor department.

All the three divisions are smoothly functioningand there is no need for such reorganization.

Sincethere was no discussion or decision about themodification of the decision of the JCM agreement, thisunwarranted clarification may lead to unwarrantedqueries and recoveries. Atleast the clarificatory orderswould have been given effect from the date of issue of theorder which is also silent in the contents.

Central Government Departments

The East Coast Railway vide its letter dated14.07.2009 has specified the items brought under the

Children Education Assistance Scheme introduced by

the Government vide DOT OM No. 12011/03/2008-Estt(Allowance) dt. 02.09.08 in which, they are permitting to

reimburse all the school related items spent for the

children.

For example uniform items like tie, sweater,

innerwear, shirt, suitings, pant, belt, shoes, etc, all fees

paid outside school for dance, music, sports etc, extracurricular activities like painting, drawing etc are brought

under the category of reimbursement under the

scheme. The copy of the order is enclosed herewith foryour ready reference.

Similar kind of clarification is required fromDOPT in respect of other C. G. employee since all these

items mentioned in the railway department orders are

part and parcel of school and education items only.

It is requested to take up the case with

appropriate authorities and do the best.

A DANGEROUS TREND!

GUIDELINES FOR OUTSOURCING(DG.(P) Letter No.1-10/2009 PCC dated 9.9.2009)

Outsourcing has emerged 35 one of themanagement options for delivery of services at reducedcost. Various Ministries/Departments of the Governmentof India including DOP have contracted out some servicesby outsourcing. Services have been outsourced in manyareas of work primarily in house keeping, secretarialservices as well as data entry. Defining basic principlesas part of the policy on outsourcing including laying downof norms and parameters for outsourcing has beenengaging attention of the Department for some time past.2. The issue has been considered and thefollowing guidelines are laid down on outsourcing:-(a) Principles of efficiency and economy should bethe top guiding principle while outsourcing or awardingwork on contractual basis. Work can be outsourced if theburden of cost is reduced and the work can be done withmore expertise and lesser investment of resourcessubject to Department having complete control over theoperations, data, assets and security.(b) Any outsourcing proposal that compromiseswith the control mechanism, however, efficient oreconomic it may be, should not be pursued.(c) Work should be outsourced rather thanmanpower. Therefore, outcomes need be prescribedrather than the number of workers required for the workproposed to be outsourced.(d) The competent authority for outsourcing wouldprescribe qualifications as per the requirement/nature ofthe job.3. Terms and conditions that could serve asguiding principle for outsourcing while engaging labouron contractual basis are laid down at Annexure-I. The listof terms conditions is not exhaustive and any newconditions specific to the area of services proposed to beoutsourced may be incorporated by the concernedauthority.

The following terms and conditions areprescribed to be laid down while engaging labour oncontractual basis.(i) Outsourcing should be made through aregistered/licensed agency/company after verifying itsgenuineness and capability of providing trustworthy andskilled manpower as per the requirement.(ii) Selection of the agency should be made aftercalling tenders as per Rules No. 179, 180 & 181 of GFR2005 from the open market and duly scrutinized/recommended by a constituted Departmental Committeewith concurrence of IFW/CFA as the case may be.(iii) Employer who awards the work to the agency/company/contractor should have full powers to cancelthe contract after giving him an opportunity of show cause,

if at a later date it is found that a license has been obtainedby the contractor by misrepresenting or suppression ofany material fact or the holder of a license has withoutreasonable cause failed to comply with the conditions ofthe tender.(iv) The engagement does not confer any right forcontinuation or extension of the contract on any account.This will purely be short term temporary arrangement oncontractual basis. Any statutory increase in wages/DA etc.is to be absorbed by the agency.(v) the agency shall also comply with all laws inrelation to its employees including payment of minimumwages as laid down by or under any law.(vi) The services may be provided on all workingdays or any holidays when staff attend duly on that day.The selected agency will immediately provide a substitutein the event of any person remaining absent himself fromthe job due to personal reasons. On urgent requirement,contractor will have to provide services even on holidays/Saturday/Sunday at the required site. Negligence on thisaccount may lead to penal action against the contractoras deemed by the Principal Employer.(vii) It may also be ensured that the person engagedwill observe office discipline and decorum and may notmisbehave with any official. It may be ensured that theantecedents of person engaged are properly verified fromthe police authorities by the contractor who will furnish acertificate to this effect.(viii) The payment to such engaged contractlabourers will be subject to discharging of satisfactoryservice which may be certified by the officers/sectionswhere they are engaged. Escalation clause shall not beaccepted on any ground during the period the contract isin force.(ix) The contract shall be in force for one year orless as per requirement and can be renewed furtherdepending upon the performance and quality of the work.The contract can be terminated by the competent authorityat any time without assigning any reason.(x) The agency shall be liable for theimplementation of Labour laws and Social Legislationssuch as EPF, ESI, workmen compensation Act, Shop andEstablishment Act, Minimum Wages Act etc. as applicablein respect of staff engaged by him or carrying on hisbusiness. The Share of EPF/CPF of the worker(s) if anywill be paid to the agency/company for depositing withconcerned organization. Contribution towards CPF,Gratuity etc. Is to be met by the agency.(xi) The payment will be released on monthly basisby cheque after making penal deductions, if any, forlapses on the part of contractor as mentioned above.(xii) In case the contractor fails to make payment of

wages within the prescribed period or makes shortpayment, then lie principal employer shall be liable tomake payment of wages in full or the unpaid balancedue, as the case may be, to the contract labour employedby the contractor and recover the amount so paid fromthe contractor either by deduction from any amountpayable to the contractor under any contract or as a debtpayable by the contractor.(xiii) Before commencement of contract, the agencyshall submit a security deposit amount of 10% of the totalannual charges with the Ministry. The security depositreceipt at least for period of 12+2 months from the date ofcommencement of the contract from any nationalized bankin favour of DDO CONCERNED.(xiv) No medical facilities or reimbursement thereofwill be provided by the ministry.(xv) Agency will be required to provide uniform andwages to the staff.

(xvi) The award of the contract will be subject to thefulfillment of the conditions laid down in Rule 157, 158 &160 of GFR, 2005 as amended from time to time.(xvii) The person engaged shall not claim any benefit/compensation/absorption/regularization of services fromthis Ministry under the provisions of Industrial DisputesAct 1974 or Contract Labour (Regulation & Abolition) Act,1970.(xviii) Any liability regarding Government dues as wellas any human loss/injury suffered during the course ofwork will be the personal responsibility of the contractor.(xix) The contractor shall also comply with all laws inrelation to its employees including payment of minimumwages as laid down by or under any law.

The list of terms and conditions is not exhaustive.Any new conditions specific to the area of serviceproposed to be outsourced may be incorporated by theconcerned division.

Technology Architecture and System

The Department of Post (DoP) has awarded a45-month information technology (IT) modernizationcontract to Accenture (NYSE: ACN) to design a newenterprise IT architecture and migrate the DoP to a moreefficient, reliable and user-friendly IT system.Accenture also will advise DoP on the development of awide-area network environment that helps connect allpost offices on which various online services can run,and will study the feasibility of implementing anenterprise solution for the department's core bankingand advanced financial services.

"The technology enablers will help DoPtransform itself by increasing operational performanceand achieving efficiencies through "last mile"connectivity," said Krishna G.V. Giri, who leads Accenture'sManagement Consulting practice within its Health &Public Service operating group in the Asia Pacific region."Armed with greater speed, efficiency, and flexibility atDoP, the government will be much better positioned toshare various social schemes, such as the MahatmaNational Rural Employment Guarantee Scheme, witheven the most remote citizens."

Accenture's work began in September with abusiness process re-engineering (BPR) exercise acrosskey departments and core operations, such as mail

operations, banking and advanced financial systems.Following the BPR exercise, Accenture will help selectand monitor a vendor to enable the DoP to consolidateits technology infrastructure and applications.The project is designed to help the DoP drive greaterrevenue and regain market share in different servicesand products, including bill payment, e-posts, lifeinsurance, money transfer and banking.According to Giri, DoP expects that the technologyupgrade also will benefit citizens via speedier and moreefficient banking and insurance services, track and traceabilities, and retail services. NOTES OF THE MONTHv The Department of Post has introduced theM.O Videsh (EUROGIRO) Service recently. Throughthis service, any one can send money to the othersresiding in Foreign countries. The salient features ofthe scheme: -(i) Maximum amount can be sent to the equivalent

amount of US $2500(ii) Eurogiro Post office (EGPO) will function from PTC

Mysore. The Director, PTC, Mysore will beincharge.

(iii) Upto Rs. 50,000/- all transactions will be handledin the form of cash. Above Rs. 50000/-, it will behandled only in the form of cheque. There is afacility to debit/credit in POSB account.

(iv) There should not be more than 12 transactions ina year.

(v) All the foreign transactions will be handled byEGPO and further the MO will be transmittedthrough EMO. While sending MO Videsh, the POwill send EMO to EGPO for further processing.

v Ministry of Finance vide its memo No. F. No.1/1/2008-IC dt. 13.11.2009 has revised the Grade payof Rs. 4200/- granted to the existing Pre-revised scaleof Rs. 6500-10500 to Rs.4600/- w.e.f. 01.01.2006. Thisis not applicable to HSG-I & HSG-II BCR officials. Thiswill be applicable to Inspectors cadre in theGovernment Department who were in the pre revisedPay scale of Rs. 6500-10500.v The Ministry of Personnel vide its Memo No.15/87/2007-CS I (R) dt. 29.10.09 informed that thereis a proposal of computerisation of the work relatingto maintenance of APARs and subsequently developon online system for submission and monitoring ofAPARs. NIC has been requested to develop a commonsoftware for all Ministries/cadre units, which shall bemade available in due course in time.v The Postal Directorate has recently introducedthe system of online submission of enumeration data(Post office wise) on line. It will be very muchproblematic in future so far as submission of data inrelation to ordinary Postal article which are generallyexaggregated during the enumeration. It has nowbecome very much sensitive so far as detailing ofdatabase as designed by the Directorate. Utmost careis needed at the base level as the matter is examinedonline by the National Administrator (i.e) top authoritiesat the Directorate level.v The DOPT vide its No. F. NO. 13/09/2009-Estt (Pay I) dated 21.10.09 has clarified on the pointof employees seeking transfer to a lower post underFR 15 (a) that pay & Pay band of the GovernmentServant will be fixed of a stage equal to the pay in the

pay band drawn by him prior to his appointment againstlower post. In all cases he will draw his incrementsbased on the pay in the pay band & grade pay.v A Meeting with DDG (Establishment) was heldon 22.10.09 to discuss the issues out of the ActionTaken Report. software, E-Commerce, Money remittances etc.The new system is expected to use the technology toenable the last mile connectivity and use technologyto efficiently provide universal services to every citizen.This ill establish Postal Department as the one stopshop for all citizen centric services catering to theneeds of the common man across the length andbreadth of the nation. Accenture will work with DOPon this project for duration of 45 months starting fromSeptember 2009. DOP has already initiated theprocess of Business process Reengineering for all itsproducts as well as for process and geared up its seniormanagement, for large scale revamp, prior to the actualappointment of consultant.

READER'S FORUMv ASSURANCE TO CAREER PROGRESSION CANBE ADVANCED WITH PROGRESSIVE VIEW AND LIBERALATTITUDE

1. The Govt. of India, Ministry of Personnel, PublicGrievances and Pension, Department of Personnel andTraining, in O.M.No. 35034/3/2008-Estt.(D) dated 19-05-2009 has implemented the Modified Assured CareerProgression Scheme (MACPs) with effect from 1-9-2008to all Central Govt. Civilian Employees.

2. The Govt. of India, Ministry of Communicationand IT, Department of Posts in O.M. No. File No. 4-7/MACPS/2009-PCC dated 18-09-2009 has implementedthe MACP Scheme w.e.f. 1-9-2008 and simultaneouslyTime Bound One Promotion Scheme (TBOPs) introducedw.e.f. 30.11.1983 and Biennial Cadre Review (BCR)introduced w.e.f. 1.10.1991 in the Dept. of Posts havebeen withdrawn w.e.f. 1.9.2008.

3. If the MACP Scheme is implemented w.e.f. thedate of order(19.05.2009) Civilian employees who havealready completed 30 years of service but retired before19-5-2009 without getting third ACP can be easilyconvineed by saying they cannot expect anything withretrospective effect. Normally career progression shouldbe combined with revision of pay scale as perrecommendation of the 6th Pay Commission. MACPScheme should have been implemented with effect from1.1.2006 along with pay revision and pension revision.The selection of date as 1.9.2008 for implementation ofMACP is unjustified and illogical. if the Schemeannounced only 9.5.2009 can be advanced to 1.9.2008for implementation, why can't be advanced to 1.1.2006?Why this assured career progression should be delayedor denied to good number of employees who havecompleted 10, 20, 30, Years of service before 1.9.2008?Pensioners:

Employees who were on service on 1.1.2006and received revision of pay scale on the recommendationof 6th Pay Commission have been denied the MACPs asthey retired before 1.1.2006 all employees who were onservice would get the benefit of MACP also beforeretirement. 90% of such retirees have earned more than30 years of service and they would have obtained 3rdACP with consequent increase in pension benefits. Theloss of pensioners who have retired without getting 2 or 3ACP before 1.9.2008 is too much. There is no scientificreason for the Govt. to fix 1.9.2008 for career progressionscheme. The vagaries of the Govt. in selecting the dateof implementation of assured career progression schemehas hit the pensioners below their belt. We should seeksome remedy through all available sources.

Employees :

Working employees who have completed 10,20, 30 years service before 1.9.2008 have made to waitunjustly till 1.9.2008 for their assured career progress.

This is not fair. Only those who were directly appointed on1.9.1998 will get first ACP on 1.9.2008 without waiting.

Under the old ACP Scheme one will get firstACP on completion of 12 years. One appointed on1.8.1996 will get first ACP old on 1.8.2008. But, anotherwho was appointed only 1.10.1996 will complete 10 yearsservice on 1.10.2006 but, he has to wait till 1.9.2008 toMACP(i.e.) for two years. Same problems are faced bythose who earn 20 or 30 years service before 1.9.2008and after 1.1.2006.

Postal employee:

Postal employees who were appointed on1.8.1992 would get TBOP on 1.8.2008 on completion of16 years service. Those who were appointed after1.9.1992 will not get TBOP as the TBOP scheme is withdrawn on 1.9.2008. But, they have completed 10 yearsservice on 1.9.2002 but they have to wait till 1.9.2008 toget first MACP. This long waiting can be reduced if theMACP scheme is advanced to 1.2.2006. Similar is caseof Postal employees who complete 20 or 30 years serviceon or after 1.1.2006 but before 1.9.2008.

If the Govt. is not agreeable to advance the MACPScheme, alternate suggestion is that for employees whoare eligible for MACP benefits during the period from1.1.2006 and 1.9.2008, pay may be fixed on the due datebut the financial benefits may be drawn from 1.9.2008. Incase of employees who retired during the period from1.1.2006 and 1.9.2008, due MACP may be given andpension may be revised and benefits on pension may begiven in cash and the pay arrears may be withheld.

Night guard, Ram ChandraPoddar, the then Oftg. PM Munger HO. Tarun Kishore, thethen Treasurer, Munger HO and ten armed Home Guarddeployed on duty for the scrutiny and safety of the buildingsproperty and valuable goods of the HPO.c) Subsidiary offanders : S/Shri T.K. Mishra, the thenSPOs, Munger, J.L. Srivastava, Dy. PM, Munger HO (NSC/KVP/RD) and Ravi Shankar Chaudhary, APM Counter (SB/MIS/TD).ii) As per directives contained in the Circle Levelinvestigation report, the CO Principal offenders andsubsidiary offenders were proceeded against. After losing an earlier attempt to exempt filenotings from the Right to Information (RTI) Act, theUnion government on Wednesday began a fresh effort.It is now referring to "file notings, " in a differentincarnation, as "disussions/consultations that takeplace before arriving at a decision".

Suggesting, "some procedural and legislative"changes in the Act, the Department of Personnel andTraining (DoPT) has said " Discussions andconsultations that go into the decision-making processare of no relevance to the general public and shouldbe exempted from disclosure under RTI."

This proposal was put forth by the DoPT, at aday-long meeting here, before the InformationCommissioners, who, however, immediately turned itdown. They found no merit in the Department'scontention that disclosure of such discussions/consultations hampered free flow of thought within thegovernment.

"Knowing full well that any attempt to exemptfile notings would meet with stout resistance from civilsociety, the government is packaging it differently topush through and agenda that is as old as the Actitself," said one Information Commissioner.

Leading the charge against any more toamend the law was Chef Information Commissioner(CIC) Wajahat Habibullah, who said RTI Act had notyet been tested to its fullest and made out a strongcase for better implementation and greater financial

Further, it was pointed out, most of the changesbeing suggested by the Department could be madeby tweaking the rules and did not require anamendment. The only change that found some supportpertained to frivolous and vexatious requests.Frivolous requests

The Department has suggested that if thePublic Information Officer is convinced that a certainrequest is frivolous or vexatious-the processing of whichwould unreasonably divert resources of the publicauthority-then he/she can refuse information afterfurnishing reasons.

Though some Commissioners welcomed thisproposal- given that frivolous/vexatious requests makefor a sizable number of RTI applications-most were ofthe view that this is subjective and could lead toarbitrariness.

Further, such a provision would be against thespirit of the Act.

Other changes mooted by the DoPT includedisclosure of Cabinet papers 60 days after a decisionis taken, greater clarity on whcih non-governmentbodies come undr the Act, fine-tuning applicationprovedures to facilitate applications by NRIs, andremoving certain security agencies from the exemptedcategory.

LUDHIANA: The Right to Information Act (RTI) wasenacted for the convenience of the general public whereinthey could access records of the Central and stategovernment.

However, a city resident has alleged that somedepartments were not supplying relevant information tothem under the Act.

According to information, RTI activist RohitSabharwal in his complaint has stated that the postaldepartment was not displaying information mandatoryfor every government office to do so. Besides, it isnecessary to install display boards in three languagesfor the general public, but the department had failed todo the same.

Sabharwal has sought an answer underSection 4 of the RTI Act why the department had notdisplayed information regarding public informationofficers and their designations, which otherwise has tobe done within 120 days of the enactment of the law.

Discussing the issue, Sabharwal said, "RTI isfor the convenience of the general public but it is sadthat public departments are not following norms which

Speaking on the condition of anonymity, a staffmember, said, "A few days ago, a government officerwas fined Rs 7,500 for violating norms. However, suchviolations are still going unchecked."

Sabharwal's complaint further mentions thatthe department had not displayed information in English,Hindi and a vernacular language of the area.

More so, instructions regarding bribe are alsonot being mentioned. Sabharwal says, "If an official asksfor bribe or if one has knowledge about any corruptactivity, one can complain to the head of the department,chief vigilance officer or to the SP. But, the departmenthas not initiated efforts to display the advisory."

Customer is attended by the Postmaster/Dy.Postmaster and asked for the documents to be producedfor identity and verification.3. The relevant documents are checked andverified by the Postmaster/Dy. Postmaster and afterconfirmation of the identity, the documents are transferredto the Postal Asstt. designated and trained on the WesternUnion Software recording an order "log in" under his datedinitials.4. The designated Postal Asstt. Verifies from thecomputer through the documents whether an electronicclearance for the receiver has been received on thecomputer. If the same has been received and exists onthe computer, then the PA fills in the details required onthe computer screen.5. After authorizing the transaction from F 10 key,the PA takes the print out when the MTCN windowappears.6. The concerned Postal Asstt. fills up the requisiteinformation in the prescribed register containing 11columns. Column 1 to 6 are filled in by the PA and putssignature in column 7. Thereafter he puts up the registeralong with the all documents to the Postmaster/Dy.Postmaster for examination.7. After examination and satisfaction, thePostmaster/Dy. Postmaster passes the orders forpayment and issues a Cheque /Pay Order in favour of thereceiver, writer its number in column 8 and puts hissignature in column 11 and on the documents.8. The cheque is handed over to the receiver underclear receipt on the voucher in the presence of thePostmaster/Dy. Postmaster.9. In case of cash payment, after receiving the ordersfrom the Postmaster/Dy. Postmaster on the documents,the same are furnished to the Treasurer and cash iscollected by the Postal Asstt. and handed over to thereceiver in the presence of Postmaster/Dy. Postmasterunder clear receipt.10. Thereafter copies of all the vouchers are sent totreasurer of the post office for onward submission to theA/c branch of the concerned post office.

Each and every transaction of HO/SOs is feddate wise in the computer i.e amount and detailedaddress of payee for preparation of fortnightly scheduleof Western Money Transfer transaction i.e. from 1st to15th & 16th to last day of the month.5. The print of schedule is taken out, twice in amonth and the total of schedule is tallied with cash book.6. Both fortnightly schedules prepared in the A/cbranch are sent once in a month to the concerned PostalAccounts Office of the Circle.B. Role of Postal Accounts Office of the Circle

Computerized process in Book Section1. Circle office on receipt of CD from PostalDirectiorate prepares a copy of the CD and sends toPostal Accounts Office.2. The copy of above CD is received in the BookSection of Postal Accounts Office of the Circle. Booksection segregates the date through CD filter option inthe Computer.' Since the CD is containing data of all India,thus first of all, data is segregated of its own Circle alongwith total transactions and amount of the Circle andthereafter is filtered HO wise data along with transactionand amount, Before filtering HO wise data, first of all,serial numbers are allotted to all the HOs alphabeticallyi.e. for 16 HOs of Haryana, serial 1 to 16 and for Punjab 1to 22 are allotted.3. Same serial number allotted to HO is marked toall the SOs falling under that HO and segregates all theSOs comes under a particular HO through CD filter optionin Excel. e.g. if serial 1 is allotted to Ambala GPo of HaryanaCircle, the same serial number i.e. 1 is allotted to all SOsof Ambala GPO. Similarly allotted serial numbers to allthe SOs comes under the remaining HOs.4. Now to come out with detailed list of transactionsof each HO and its SOs and thereafter to arrive at the totaltransactions and total amount of each HO plus its Sos.5. The grand total of amount and transactions ofall the HOs along with their SOs is tallied with the total ofthat Circle initially noted from CD which is received fromCSC Delhi.6. The detailed list of all the transactions of Hosplus its SOs of Circle showing total transactions andamount of all these IIOs is generated and supplied to theconcerned cash account portion holder of the DAP.

Maunal process in PA Section1. Initially the paid vouchers are tallied with thedetails of transactions as per detail shown in scheduleof WUMT for confirmation of receipt of paid voucher on

receipt of 1st forthnightly as well 2nd fortnightly by cashaccount portion holder.2. All the cash account potion holders check totalof both the fortnightly returns of western moneytransactions along with paid schedule. Paid vouchersand cash account figures which should be agreed witheach other. In case of any discrepancy, it is noted in theobjection book of circle payment and the same iscommunicated to the concerned HO/CSD/ Directorate.3. Now the cash account portion holder checkseach and every transaction of the computerized generatedlists of HOs/SOs with the paid vouchers already receivedalong with fortnightly cash account return after pairing thepaid voucher with the transaction computer generatedlist. In case of any discrepancy, it is noted in the objectionbook and the same is communicated to the concernedHO/CSC/Directorate.4. Now cash account portion holder makesagreement of both sides of paired and un paired itemsand amount as agreed with cash account figures of CirclePayment and with the computer generated list of HOsplus SOs already supplied and the same is maintainedin the register meant for it.5. The discrepancies noted regarding last datedtransactions as unpaid of CD statement are paired withthe items/amounts of unpaired items and amount ofCircle payment of next month's first fortnightly and theeffect of these paired items and amount is taken intoaccount of current month of circle payment and CDstatement of OB register in PA Section.6. Proper watch of unpaid items and amount ofboth the sides is made by the cash account holdersthrough correspondence with concerned units till all theitem/amount settled, and information regardingsettlement/pairing of previous items amount with currentmonth transaction will be intimated to PA Misc Sectionalong with the statement of agreement or separately sothat the effect of paid/settled items amount of unpaired ofprevious period/previous month cash account may betaken into the Circle Broad sheet as well as in thereconciliation statement for onward submission toDirectorate/ Nodal Office.7. All the cash account portion holders send thestatements of agreement of both sides (Circle paymentand computerized lists) to PA Misc Section showing thedetail of paired and unpaired items and amount of currentmonth.8. PA Misc Section prepares consolidations onreceipts of statement of agreement from the cash accountholders of PA Wing and reconciliation statement is alsoprepared from the unpaired items as communicated bythe PA Section for its onward submission to Nodal officeDelhi.9. Circle broad sheets are maintained in PA MiscSection for both the sides on the basis of statements ofagreements which receives from PA section for up to daterecord of yearly and monthly in respect of settled and

nnnnn Provision of Police Guards the Post Offices

for overnight security of cash and other valuables.We have been receiving references from a few

circles regarding the monetary limit of cash retained inthe post offices beyond which police guards are requiredto be kept in the post offices for overnight security. Enquiriesmade from different circles have revaled that circles arefollowing their own yard stick for provision of police guardsfor the security and safe custody of cash and otherproperties. This is being done by the heads of circlesafter consulting the local police and depending upon the

local circumstances in individual cases.It has been also observed that in some circles

considerable sum of money is being spent in arrangingfor the police guards from the State Governments. Thematter has been examined afresh and its is felt that thelimit of cash beyond which police guards are to bearranged will depend on the local circumstances suchas locality in which the post office is housed, theconstruction and the layout of the building, kinds of safeused in the post office, the distance between the nearestpolice station and the post office and the general law andorder situation at a particular place. it is therefore notconsidered appropriate to pre scribed a single monetarylimit of cash for provision of police guards on a uniformbasis all over the country.

It has therefore now been decided that theprovision of police guards in the post offices will bedecided by the head of circles keeping in view the localsituation and in consultation with the local policeauthorities, and their respective Internal FinancialAdvisers. It will be very difficult for the Directorate tolaydown uniform monetary limit for all the post offices allover the country irrespective of their varying localsuitations. It may however be ensured that the arrangingof police guard from the State Governments does notbecome a source of recurring expenditure to thedepartment irrespective of its requirements on a particularday or time (It may be remembered that many privateestablishments, shops etc. Which handle for more cashand retain for more valuables overnight, than in mostHead Post Offices, do not arrange for police or otherSecurity guards).(No. 32-1/86-CI Dated 9-4-1986)

nnnnn Provision of Armed Guards for Post Officesfor overnight security of cash and valuables.

Kindly refer to this Directorate letter No. 32-1/86-CI dated 09-04-1986 regarding provision of PoliceGuards in Post Offices for overnight security of cash andvaluables. In this connection, full Administrative andFinancial Powers are available to the Heads of PostalCircles.

The instances of Post Offices retaining heavycash overnight without any Armed Guards have beenreported to this Directorate. In order to provide adequatesecurity overnight to the Post Offices retaining heavy cashand valuables, all the Heads of Postal Circles arerequested to take necessary measures to providerequired Armed Guards/Police Guards to such PostOffices by maintaining liaision with the Head Post Mastersand Postal Divisional Heads.In addition to above, in cases of the safe and securecarriage of heavy cash from one Post Office to anotherPost Office/Bank and vice versa, necessary ArmedGuards/Police Guards may be provided without fail. Forthese purposes, the availability of Police Guards to escortcash, security situation in particular city/town and prevalentpractices pertaining to security arrangements to escort

cash amongst the banks operating there. If the PoliceGuards are not available to escort cash, the posibility ofaranging the Private Armed Guards may be exploredwithin the Administrative and Financial Powers delegatedto the Heads of Circles.These instructions may kindly be kept in view to befollowed at each level besides their monitoring by theHeads of Circles. Product manufactured/marketed as foodsupplement, cosmetics and ayurvedic preparationprescribed by allopathic doctors will be inadmissible.2. Supply of vitamins, minerals and anti-oxidantswill be restricted to prevalent CGHS formulary only.3. Vaccines, in general, will be admissible, exceptHepatitis B, Influenza and Leprovac Vaccines for high riskindividual, is recommended by specialist with justificationand countersigned by HOD of concerned speciality ofGovernment Hospital.

nnnnn Deduction of Tax and surcharge oncommission paid to SAS/MPKBY/PPF Agents- aclarification regarding

The undersigned is directed to refer to this officeletter of even number dated 25-5-2007 (SB Order No. 3/2007) vide which the rate of TDS to be deducted form theagent's commission was conveyed.2. Now this office is receiving many referenceswhere Income Tax Authorities have issued certificatesunder Section 197 of Income Tax Act 1961 for deductionof TDS at lower rates.3. It is further Clarified that under Section 197 of ITAct 1961, Income Tax Authority can issue certificate fordeducation of TDS at lower than prescribed rate andwhenever such certificate is presented by any agent, thatshould be accepted and TDS should be deducted at therate mentioned in the certificate. The certificate shouldbe collected from the agent and attached with theschedule.4. It is requested that this may be brought to thenotice of all post offices immediately for informationguidance and necessary action.5. nnnnn Cheating by impersonation and fake telephonecalls purportedly made by Senior Postal Officers.

I am directed to refer to this office letter No. 7-4/GUJ-01/2003-Inv, dated 20.03.2003 on the above-mentioned subject. Xerox copy of the same is enclosedfor ready reference.2. Instructions contained in the Directorate Circularreferred to above stressed inter-alia that "money shouldnot be paid to any one on behalf of such fictitious callsand contents of such call should promptly be verified fromthe officer or office of the concerned officer".3. Still this office continues to receive reports ofduping of postal officials where miscreantsimpersonating as Senior Officers of the Department-quiteoften as Chief PMG-made telephonic calls to the SPOs,PMs and the SPMs to deposit certain amounts of moneyin their accounts standing in the Bank. Within minutes ofdeposits, the amount was with drawn from the bank bythe miscreants Rs. 1,20,000/- was this way recently lootedby the miscreants in three incidents in Jharkhand Circle.4. It is again enjoined upon all Heads of PostalCircles and Regions to suitably bring these instructionsto the notice of all concerned to prevent recurrence ofsuch incidents. Porvisions enshrined in this regard in

Rules 10-70 of FHB Volume-I, Rule 38 and 40 of FHBVolume-II, and rules/instructions in other Volumes shouldbe strictly followed while making payments.5. This has been seen by Secretary (Posts)(No.7-22/JKD-01/2009-Inv.Dated 15-9-2009)

nnnnn Cheating by impersonation and FakeTelephone calls as Senior Postal Officers.1. Recently some cases of cheating byimpersonation have come to light in a few citiesparticularly in AP, Maharastra & Gujrat Circles in the country.Investigations carried out in these cases have revealedthat the miscreant adopted a simple and unique modusoperandi. The cheater would telephone a Postmaster/SPM impersonating as collector Customs or some highranking postal officer (DPS/PMG/CPMG)or near relativeof a very senior officer and ask for huge money from Govt.cash/post office pretending it to be ordered by the DPs/PMG/CPMG in their private capacity with instructions notto disclose it to anyone else. The caller would then askthe postal officials (Most probably post Master of a HeadOffice) to come with required cash in lakhs at a fixed spot& time. The cheater would then take the cash & slip waytelling that the DPS/PMG/CPMG would be coming aftersome time and would credit the money back intoGovernment accounts.

Apparently, the miscreant could cheat the staffworth lakhs of Rupees, taking advantage of theircarelessness and non-vigilant attitude, clearly violatingthe Departmental rules and procedures, according towhich, money cannot be paid to anyone without properand valid sanction/order from the competent authority.Had the Staff been a little vigilant, applied their mind andconfirmed the contents of message passed by the culprit,purportedly from their DPS/PMG/CPMG or even form theirSPOs/SSPOs, the incidents could have been avoided andthe department would have been saved from hugelosses.

It is likely that the miscreant would try to furtherhis luck at other places also by cheating andimpersonation . In order to avert such cases of cheatingin future, it is enjoined upon all concerned that custodiansof Government money/property should exercise utmostvigllance and security of public money as in respect oftheir own. Money can not be given to anyone, be it anofficer of high rank or otherwise, without a proper and validsanction by the competent authority. It is therefore, stressedupon that money should not be paid to anyone on behalf ofsuch fictitious calls and contents of such calls shouldpromptly be verified from the officer or office of the concernedofficer. As and when any such call is received, a trap shouldbe laid to apprehend the cheater.

These instructions should be brought to thenotice of all concerned as a precautionary measurecautioning the staff. Anybody, violating the instruction andlaundering money to anyone without proper and validauthority will be held personally responsible for the actand would be dealt sternly.

Following the subsequent judgment of theSupreme Court of 26th August, 2004 in the case of MedhaKotawl Lele Vs UOI it has been laid down that the reportof the Complaints Committee as envisaged in thejudgment in Visakha case would be deemed to be aninquiry repot under the relevant conduct rules, and thedisciplinary authority would be required to act on the reportin accordance with the Rules. Following this Judgment,the CCS (CC&A) Rules, 1962 have been amended w.e.f.10th July, 2004 to provide the legal basis for functioningof the Committee.3. Recently by Cabinet Secretariat Order No- 501/28/1/2008-C.A.V. dated 26the September, 2008, aComplaints committee which consists, inter-alia, ofretired officers at very senior levels has been constitutedto enquire into complaints of sexual harassment madeagainst officers of the level of Secretary and AdditionalSecretary to the Government of India.4. While institutional mechanisms have been putin place following the series of judgments of the ApexCurt mentioned above, it is necessary to ensure that thereis no delay in dealing with complaints of sexualharassment made by women in the work place, and

whenever such complaints are made there is no occasionfor either an attitude of disinterest or indifference. Anydelay, or dismissive attitude with regard to complaintswill serve to nullify the letter and spirit not only ofGovernment instructions, but also the guidelines laid downby the Apex Court and would itself invite action.5. I shall be grateful if the above issues are kept inmind, with a view to reinforcing the administrativemachinery that might already be in place, so that suchcomplaints receive prompt and immediate attention. The undersigned is directed to say that thisoffice has received some complaints/referencesregarding calculation of interest in RD accounts wherethe depositor extended the accounts for some periodwith monthly deposits under rule 10(2)(a) of PORDRules 1981 and then stopped monthly deposits butretained the maturity value for further period withoutany monthly deposits.2. The matter was referred to Min. of Finance forclarification and MOF has clarified vide its letter No. 2/7/2009-NS-II dated 24.09.2009 that in such cases thematurity value is to be first calculated as per tables givenunder Rule 10(2)(a) of PORD Rules 1981 and then theamount payable is to be calculated as per tables givenunder Rules 11 of PORD Rules 1981 for the period thematurity value retained without further deposits.3. Instances have come to notice whereGovernment servants on account of physical handicap/disability of self or dependent family members areunable to perform the LTC journey by the authorizedmodes of transport and are compelled to undertakethe journey by own car or private taxi. Representationsare being received to allow reimbursement in suchcases. Matter has been examined in consultation withthe Ministry of Finance, Department of Expenditureand it has been decided in relaxation of LTC Rules toauthorize the Head of Department of allow use of own/hired taxi for LTC journey on account of disability ofthe government servant or dependent family memberafter obtaining following papers/conditions to avoid

Pay Commission relating to encashment of leavein respect of Central Government employees.

The undersigned is directed to refer to thisDepartment's O.M. of even number dated 25thSeptember, 2008 on the subject mentioned aboveaccording to which encashment of leave in respect ofCentral Government employees will be considered bothfor earned leave and half pay leave subject to overalllimit of 300 days and in respect of encashment of halfpay equivalent of other retirement benefits. In case ofshortfall in earned leave, effective from the 1stSeptember, 2008. The matter was reconsidered in thisDepartment in consultation with the Department ofExpenditure (Implementation Cell) and it has beendecided to modify the date of effect of thisDepartment's O.M. of even number dated 25thSeptember, 2008 to 01.01.2006 instead of 01.09.2008subject to the following conditions:-(i) The benefit will be admissible in respect ofpast cases on receipt of applications to that effectfrom the pensioners concerned by the AdministrativeMinistry concerned.(ii) In respect of retirees who have alreadyreceived encashment of earned leave of maximum limitof 300 days together with encashment of HPL standingat their credit on the date of retirement, such casesneed not be reopened. However, such cases in whichthere was a shortfall in reaching the maximum limit of300 days can be reopened.(iii) Calculation of cash equivalent in respect ofHPL at credit shal be made mutatis mutandis in themanner given in this Department's O.M. of even numberdated 25.09.2008.2. OFFICE MEMORANDUMGrant of the revised pay structure of grade

pay of Rs. 4600 in the pay band PB-2 to posts thatexisted in the pre-revised scale of Rs. 6500-10500as on 1.1.2006 and which were granted thenormal replacement pay structure of grade payof Rs. 4200 in the pay band PB-2.

Sixth Pay Commission recommended merger of thethree pre-revised scales of Rs. 5000-8000, Rs. 5500-9000 and Rs. 6500-10500 and replaced them by therevised pay structure of grade pay of Rs. 4200 in thepay band PB-2. Vide para 2.2.21(v) of its Report theCommission recommended that on account of themerger of these 3 scales, some posts whichconstituted feeder and promotion grades would cometo lie in an identical grade. The commission gavespecific recommendations in its Report granting highergrade pay of Rs.4600 to some categories of theseposts. As regards the other posts the Commissionrecommended that it should first be seen if the postsin these 3 scales can be merged without any functionaldisturbance and if possible the same should be done.Further the Commission recommended that in case itis not feasible to merge the posts in these pay scaleson functional consideration, the posts in the scale ofRs. 5000-8000 and Rs. 5500-9000 should be mergedwith the posts in the scale of Rs. 6500-10500 beingupgraded to the next higher grade in the pay bandPB-2 with grade pay of Rs. 4600 corresponding to thepre-revised scale of Rs. 7450-11500. In case a postalready exists in the scale of Rs.7450-11500, the postbeing upgraded from the scale of Rs. 6500-10500should be merged with the post in the scale of Rs.7450-11500.2. The above recommendations of the Sixth PayCommission were notified vide para (ii), Section I inParts B and C of the First Schedule to the CCS (RP)Rules, 2008. While Part B of the First Schedule to theCCS (RP) Rules related to revised pay scales forcommon categories of staff, Part C notifies revisedpay structure for certain posts in Ministries,Departments and Union Territories. The aboveprovisions of the Rules specifically mentioned thatupgradations in terms of para (ii) Section I may bedone in consultation with Department of Expenditure,Ministry of Finance.3. Consequent upon the Notification of CCS(RP)Rules, 2008, Department of Expenditure has receiveda large number of references from administrativeministries/departments proposing upgradation of theposts which were in the pre-revised scale of Rs. 6500-10500 as on 1.1.2006 by granting them grade pay ofRs. 4600 in the pay band PB-2. The matter has beenconsidered and it has now been decided that the postswhich were in the pre-revised scale of Rs. 6500-10500as on 1.1.2006 and which were granted the normalreplacement pay structure of grade pay of Rs. 4200 inthe pay band PB-2 corresponding to the pre-revisedscale of Rs. 7450-11500 w.e.f. 1.1.2006. Further, interms of the aforementioned provisions of CCS (RP)Rules, 2008 in case a post already existed in the pre-revised scale of Rs. 7450-11500, the posts beingupgraded from the scale of Rs. 6500-10500 should be

merged with the post in the scale of Rs. 7450-11500.4. Accordingly, in terms of Rule 6 of CCS(RP)Rules, 2008 revised pay of Government servants inthe pre-revised scale of Rs. 6500-10500 who were earliergranted grade pay of Rs. 4200 and who have alreadyexercised their option for drawal of pay in the revisedpay structure in the format prescribed in the SecondSchedule to the Rule, will be fixed again in accordancewith illustration 1A annexed to CCS (RP) Rules, 2008.5. In case of all such Government servants inthe pre-revised scale of Rs. 6500-10500 who were earliergranted grade pay of Rs. 4200 and who had opted tohave their pay fixed under CCS (RP) Rules, 2008 actionas prescribed in this Department's O.M. of evennumber dated 30th August, 2008 will be taken. In caseas Government servant desires to revised his earlieroption for coming over the revised pay structure, hemay be permitted to do so without making anyreference to this Department.6. On account of pay fixation in the revised paystructure of grade pay of Rs. 4600 in the pay bandPB-2, arrears of pay will recalculated and difference ofarrears in respect of the entire amount will be paidimmediately. Subsidy-Clarification.The undersigned is directed to refer to DOP&T

OM No. 12011/3/2008-Estt.(Allowance) dated 2ndSeptember, 2008 on the above subject and to say thatthis Department has been receiving various referencesfrom Government servants, Ministries/Departmentsseeking clarification whether Vidyalaya Vikas Nidhi(VVN) charged by Kendirya Vidyalayas is reimbursableas per items detailed in para l(e) of the abovementioned OM. The matter has been considered inconsultation with Ministry of Finance. It is clarified thatVidyalaya Vikas Nidhi charged by KendriyaVidyalayas will also form part of para 1(e) of the saidOM and can be claimed for reimbursement under thescheme of Children Education Allowance subject tothe annual ceiling of Rs. 12000 per child. Where VidyalaVikas Nidhi has not been admitted for reimbursementin past cases, the same may now be considered forreimbursement, subject to the other conditions.

This Department has also been receivingreferences seeking clarification whether ChildrenEducation Allownace can be claimed in respect of anytwo children by Government Servants who have morethan two children. It is clarified that Children EducationAllowance is admissible for the two eldest survivingchildren only, except when the number of childrenexceeds two due to second child birth resulting inmultiple births.(No.12011/16/2009-(Allowance) Dated : 13.11.2009)

The fragile promotional schemes in thisdepartments were such that time bound LSG/HSG-II/HSG-I was swapped for mere fiscal upgradation.

The toppers you and me used to come to thedepartment of posts while the third grades opted for P.S.U.Banks. The contemporaries are now in chief posts thanksto liberal promotional policies there while the brightestone are rotting here.

We mooted a probation officers type ofpromotional aspect for this department "a La" upgradationof subordinated offices/posts and supervisory posts toLSG/HSGII/HSG-I and promotion to such post byexaminations. Instead the Govt. introduced the fast trackand shut the door for the seniors for ever.

Cadre review, needless to say, is the need of thehour. A balance cadre review can balance the aspirationof the young aspirants and old "Ladder Riders"

You have hit the nail in the Head to haveprioritised cadre review of the group-C. Since modifiedACP scheme is implemented, there would not have anyfinancial implications for upgradation of supervisory,subordinate posts grade wise. PAS can be posted on theseniority basis corresponding to their scales in pay bandand grade pay.

This will not only bring justice to the cadre butalso boost of efficiency and better service in the

department.

There is never the less a feel good factor in therank and file for the present leadership for theircommitment and achievement. But the final examinationis yet to be passed.

The applicant previously worked as Postal Assistantin the District of Purba Midnapore. He is aggrieved by ordersdated 29.4.2002, 7.8.2002 and 16.9.2002 of the Postal Authoritiesremoving him from service which are in turn based on letterdated- 2.7.1999 of the Project Officer-cum-District WelfareOfficer.2. The facts of the case are as follows:3. The applicant has passed Class IX. He was employedas ED Agent on contract basis in 1977 under the Superintendentof Post Offices, Tamluk. Thereafter he was promoted to Group'D' post by virtue of a Departmental Examination againstScheduled Caste Quota in 1983.4. The Scheduled Caste Ststus had been obtained by theapplicant on the basis of a certificate issued by the Sub-DivisionalOfficer, Tamluk on 20.2.1986. It was noted in the certificate thathe belonged to Scheduled Caste against Bhuimali caste. Hebecame EDDA Sagarbarh on 4.2.1986 and started functioningas such. He was promoted to TSPA cadre after undergoing atraining course for 81 days. His caste certificate was sent forverification before the Sub/Divisional Officer, Tamluk and on11.6.1993 the SDO informed that his caste certificate wasgenuine.5. In connection with certain irregularities regarding dateof birth in his descriptive roll, proceedings were started againstthe applicant. In this connection, a letter was sent to the DistrictMagistrate, Medinipore. In terms of the letter of the Project Officer-cum-District Welfare Officer on behalf of the District Magistrate

CALCUTTA BENCH

CALCUTTAdated 2.7.1999 stating that the applicant was not a member ofScheduled Caste, he was removed from service on 29.4.2002by the orders of the Superintendent of Post Officers, Tamluk.6. The applicant thereupon appealed before the AppellateAuthority and by order dated 7.8.2002 his appeal was rejected.Thereupon he filed a revisional application before the Post MasterGeneral on 16.9.2002. The Post Master General toned down theorder of removal from service to one of compulsory retirement.The applicant then made a demand justice notice on 7.8.2006before the respondent No.1 who is the Principal Secretary of theDepartment. But there has been no response.7. The applicant then approached the Hon'ble High Courtby filing Writ Petition No. 3338 of 2003. The Hon'ble High Court on04.12.2006 dismissed the Writ Petition stating, inter-alia, in thejudgment that 'whether the letter in question was meritoriouspiece of evidence could have a question of decision of theTribunal'. The applicant filed this OA in the context of the remarksof the Hon'ble High Court.8. In short, the case of the applicant is that therespondents have removed him from service on the strength ofthe letter of 2.7.1999 given by the Project Officer-cum-DistrictWelfare Officer stating that the applicant was not a member ofthe Scheduled Caste community. The Project Office had clearlyacted beyond his jurisdiction in doing so and the entire case wasbased on this letter resulting in removal of the applicant fromservice. It was also stated that in OA 1671 of 1993 the CAT,Chennai Bench had clearly held that as long as a communitycertificate stands, there can be no disciplinary proceedings onthat account.9. In reply, the respondents have stated that the applicanthad produced a Scheduled Caste certificate in 1986 from theSub-divisional Officer, Tamluk Which was further reiterated bythe same officer on 25.5.1993. However, on 12.7.99 the ProjectOfficer-cum-District Welfare Officer on behalf of the DistrictMagistrate, Medinipore on a reference from the Postal Authoritieshad stated that the applicant was not a member of the ScheduledCaste community. Under the circumstances, the applicant, aftergoing through the due proceedings in the Department, had beenremoved from service. The applicant had no case since hisappointment to service and further promotion was entirely basedon his being a member of the Scheduled Caste community. Sincesuch matter had been brought into question by the DistrictAuthority, removal from service was the consequential step.However, the Post Master General as Revisional Authority hadchanged the order of removal from service to compulsoryretirement in consideration of the fact that the applicant hadalready put in long years in service. On merit, therefore, theapplicant had no case.10. Heard Ld. Counsel for the applicant and therespondents.11. The short point to be determined here is to determinethe legal position in respect of the caste certificate of theapplicant. The relevant legislation in respect of the State of WestBengal in this matter is the West Bengal Scheduled Castes andScheduled Tribes (Identification) Act, 1994. On going throughthe provisions of Act, it is seen that Section 5 of the Act mentionscategorically that in a District other than South 24 Parganas, theauthority for giving a scheduled cast certificate is the Sub-

Divisional Officer (SDO). Only in the case of South 24-Parganas,the District Magistrate is the certificate giving authority. Section 7of the same Act indicates who has the power to refuse suchcertificate. Once again it has been stated that in all other Districtsother than South 24-Parganas, the Sub-Divisional Officer is thecompetent authority to refuse a certificate. Under Section 8 ofthe same Act indicates an appeal against such refusal ofcertificate by the SDO shall be made to the District Magistrate.Section 9 lays down provision regarding steps to be taken wherea certificate has been obtained falsely. Section 11 deals withmatters concerning issue of such certificate prior to thecommencement of the Act. The Rules under Scheduled Castesand Scheduled Tribes (Identification) Act, 1994 are dated14.10.1996. Section 3 (i), (ii) and (iii)lays down procedure forcancellation of certificates. This includes the provision for hearingetc.12. From a perusal of the above Act it is clear that theDistrict Magistrate is not authorized under this Act to issue anycertificate outside of 24-Parganas (South) and he is the appellateAuthority only where such certificate is refused by the SDO.Since the Applicant is from Medinipore, the District Magistrate isnot the authority under the act to issue such certificate. Thatpower vests with the SDO. Neither is the District Magistrate theAppellate Authority since no refusal of certificate is involved.Under the circumstances, the District Magistrate or the Project

Officer-cum-District Welfare Officer on his behalf was clearlybeyond his jurisdiction in writing the letter dated 2.7.1999 statingthat the applicant was not a member of the Scheduled Castecommunity.13. Our attention has also been drawn to the decision ofthe Coordinate Madras Bench of this Tribunal where in OA 1671of 1993 orders dated 22.11.1995 reported in 394, Swamy's CLDigest 1996/1 is has been stated "Unless and until the communitycertificate is cancelled by the competent authority, it will continueto be valid and has to be acted upon by the authorities and therecan be no disciplinary proceedings on the basis that the certificateis false".14. Keeping, therefore, all the above factors in view andthe decision of the Madras Bench in OA 1671 of 1993 we quashthe orders dated 29.4.2002, 7.8.2002 and 16.9.2002 of the PostalAuthorities. The applicant should be re-instated in service fromthe date of his removal from service and give in all consequentialbenefits. The entire exercise should be completed within a periodof three months from the date of issue of this order. The OA isallowed. No costs.Note : The official has been reinstated into service w.e.f.

29.04.2009 with consequential benefits vide department
