Nowadays, the government is makingall-out efforts for the emergence of a peace-ful, modern, developed and discipline-flour-ishing democratic nation. As a constitution isindispensable for every independent nationthe National Convention is being held for thedrawing of the State constitution.

The National Convention was held inthe years of 2004, 2005 and 2006. And de-tailed basic principles for the sharing of leg-islative, executive and judiciary powers to beincluded in the drawing of the State constitu-tion have been laid down.

The National Convention, which wasadjourned on 29 December 2006, is recon-vened on 18 July 2007 (today). Thedelegates have discussed and unanimouslylaid down basic principles and detailedbasic principles for eight chapter headingsout of 15 to be included in the State consti-tution.

At the National Convention in sessionthe delegates will be able to finalize the dis-cussions on detailed basic principles for theremaining seven chapter headings.

The basic principles laid down byover 1,000 delegates putting national interestin the fore for the emergence of the Stateconstitution will shape the future of the Stateand the people.

Thanks to concerted and well-coordi-nated efforts of the delegates and the respec-tive sub-committees the State constitutionwill soon emerge shortly after the NationalConvention is completed.

LONDON, 16 July—British soldiers serving inIraq are being killed at aproportionally greater ratethan their Americancounterparts for the firsttime since the start of thewar, the Sunday Telegraphreported.

As attacks surged inBasra, southern Iraq, thedeath rate of British troopshas now surpassed that ofAmericans, marking a“watershed” for Britishinvolvement in theconflict, which in turnleads to calls for thegovernment to set animmediate timetable for

withdrawal from the war-torn country, said thereport. It cited an analysisby Professor Sheila Bird,vice-president of theRoyal Statistical Society,on British and Americanfatalities from May 2006to June 2007. Two US soldiers killedin bomb attacks in Iraq

BAGHDAD, 16 July—Two US soldiers were killed inbomb attacks in Iraq on Saturday, the US military saidon Sunday. One US soldier was killed and anotherinjured when an explosively-formed penetrator, or EFP,detonated near their patrol during combat operations ineastern Baghdad on Saturday, a military statement said.

Separately, another soldier was killed when alandmine detonated near his foot patrol, the militarysaid in a brief statement without saying where theincident took place.

TOKYO, 16 July—Typhoon Man-yikilled three people and injured morethan 70 in Japan but weakened to atropical storm on Sunday as it movedacross the country’s central regionbringing heavy rain, strong winds andlandslides.

Man-yi was moving east-northeast at35 kilometres per hour (22 mph) as itreached the Tokai Region after rippingthrough the southernmost main islandof Kyushu on Saturday, the Meteo-rological Agency said.

The storm was weakening with windsof up to 162 kilometres per hour (101mph), but forecasters still warned of

flooding and landslides as it looked tobrush by Tokyo later in the day.

Man-yi, which approached Japan'ssouthern Okinawa Islands late last week,has killed three people, including an 11-year-old boy swept away by a fast-movingriver on Saturday while trying to pick upa ball.

One man was missing and 73 wereinjured, NHK television said. Man-yi wasclassified as a tropical storm by British-based website Tropical Storm Risk(www.tropicalstormrisk.com), downfrom a Category 1 typhoon on Saturdayand Category 4 on Friday.

Marines testify in courtover killing of Iraqi civilian

LOS ANGELES, 16 July —A fellow squad member ofa Marine corporal on trial for the murder of an Iraqicivilian testified in court on Saturday that the Marineswere prodded by their superiors to be cruel to Iraqis.

Saul Lopez-Romo testified in a Los Angeles courtthat he became more aggressive in dealing withsuspected Iraqi insurgents after being accused bysuperiors of being “soft”.

The Marines felt the need to prove to the commandthey were not soft by stepping up violence against thealleged insurgents, Saul Lopez-Romo testified at thecourt-martial of corporal Trent Thomas.

“We were insulted that higher-ups thought we weresoft, that we couldn’t take care of business,” Lopez-Romo testified.

“We beat people,” the corporal testified whenasked how Marines “ramped up the shock effect onIraqis,” as Lopez-Romo phrased it. He said he believedthe leadership of his platoon knew about the increasedviolence.

Lopez-Romo testified that the demeanor of squadmembers, including Thomas, changed after thecomments from his superiors. “I saw people changethat I never thought would change, their state of mindchanged,” the corporal said.

44 cars catch fire at Swissopen-air festival

FRAUENFELD (Switzer-land), 16 July—Forty-fourcars were destroyed in a

massive fire at one ofSwitzerland’s largestopen-air music festivalson Saturday, police said.

Police were investi-gating the cause of theblaze and said arson hadnot been ruled out. Fivefirefighters suffered slightinjuries while putting theblaze out.

Six Filipinos injured inbooby-trap grenade blast

MANILA, 16 July—At least six people were injuredin a booby-trap grenade explosion Saturday night ina poor and crowded neighbourhood in Makati, MetroManila, said Philippine police Sunday.

Police remained clueless on the identities of peopleresponsible for the explosion as people in theneighbourhood refused to provide any cooperation.

State railways workershot dead in Thai south

BANGKOK, 16 July—A 52-year-old Thai StateRailways worker was shot dead while driving hispickup truck to work at Ban Salobukit Yuerae trainstation in southern Thailand’s province of NarathiwatSunday morning.

Abdullah Watae was on his way to work a dayshift when he was shot by two gunmen riding amotorcycle, according to the Thai News Agency.

Police were quoted as saying that the gunmenused automatic weapons in the attack before fleeingthe scene. Narathiwat is one of three provinces mostaffected by insurgent unrest that has claimed morethan 2,400 lives during the past three years. The othertwo provinces are Yala and Pattani.— MNA/Xinhua

Three immigrants founddead in truck in Italy

VENICE (Italy), 16 July—The bodies of three menapparently trying to enter Western Europe illegallywere found in a refrigerated truck near Venice onSaturday, police said.

A fourth man also hidden in the truck, which hadarrived in Italy by ferry from Greece and was boundfor Germany, was taken to hospital and was incritical condition.

BEIJING, 17 July— China will shift its dependencefrom corn to sorghum, cassava and sweet potato plantsto make bio-fuel in the next five years.

Part of the government’s efforts to develop bio-fuelwithout harming general food supply and security, theshift will ensure a healthy supply of corn both as foodand fodder.

Cassava and sweet potato both are high-yield plants,and though edible, they are not used as staple food. Sotheir use as raw material, as opposed to that of corn,won’t create any artificial shortage of food products.

The National Convention, which was adjourned

on 29 December 2006, will resume on 18 July 2007.

The delegates with active and fresh mind are making

preparations for attending the National Convention.

At the session the detailed basic principles of the

seven remaining chapters of 15 to be included in the

State constitution will be finalized. Some points to be

amended in the basic principles and detailed basic

principles laid down by the delegates will be discussed

and laid down again only through the wishes of the

delegates.

The delegates have unanimously laid down the

basic principles and detailed basic principles for

eight chapter headings. The delegates reported on

their reviews and suggestions for the seven remaining

headings at the sessions held in October, November

and December 2006. The panel of Chairmen will

submit the suggestions and reviews collected to the

plenary session of the National Convention to be held

on 18 July. The plenary session will lay down detailed

basic principles after discussions on the suggestions

and reviews. Finally, all the chapter headings to be

included in the State constitution will be laid down.

The National Convention to be resumed in July is the

final session of the convention and it will wind up

successfully soon.

The principles laid down by over one

thousand delegates after discussions with patience

put in the fore the people’s desire and brighter

future of the nation. The National Convention

delegates include representatives from official

political parties, representatives-elect, national race

delegates from states, divisions, districts and

townships, peasants, workers, intellectuals and

intelligentsia, State service personnel, other invited

groups) and people from all walks of life. The

delegates representing the entire people have

discussed the future of the people and the nation

and laid down the principles.

The government has laid down the seven-point

Road Map and is implementing them step by step and

building a peaceful, modern discipline-flourishing

democratic nation. According to the task-1, the National

Convention reconvened and it will end successfully

soon. Democracy processes necessary for a new nation

are under way as task-2. Law experts will draft the

State Constitution in accord with the basic principles

and detailed basic principles laid down by the National

Convention as task-3. The new constitution will be

adopted through national referendum as task-4. An

election in which the people will elect the people’s

representatives will be held in accord with the new

constitution as task-5. According to task-6, the Hluttaw

will be convened by the Hluttaw members. The Head

of State will be elected and a new government will be

formed. The Tatmadaw will transfer power to the new

government. Task-7 is that the new government under

the leadership of the Head of State (President) will

continue to build a peaceful, modern developed

discipline-flourishing democratic nation.

I have participated in the National

Convention since January 1993. The delegates to

the National Convention that will go down to the

annals of history held discussions group-wise.

Their findings were presented to the plenary

session of National Convention. The plenary

session laid down principles in line with the

wishes of the delegates. To be able to hold the

discussions the delegates studied the trend of

Myanma politics (history), the background of

constitutions and the constitutions of the global

nations. They discussed their findings among

them time and again. During their discussions

they found proper ways and were able to make an

assessment. We have been able to exercise

democracy practices.

A constitution drawn and approved by

someone could not be an enduring one representing

the people. The participation of the people is a

must in the drafting of a constitution. Priority is to

be given to national interest in drawing a

constitution. Only then, will it be in conformity

with the people’s desires. There are various kinds

of constitutions drawn by a certain authority,

approved by a party or a group or approved by the

Hluttaws (Parliaments) or approved by a

referendum. The new State constitution that will

soon emerge will be approved by a referendum. It

will become the one that is formulated according

to democratic practices.

As far as the State constitution is concerned

a large number of writers including me have already

written about it. And many books on the constitution

have been published. Myanmar people have gained

much experience on the constitution. The 1947

Constitution of the Union of Myanmar was drawn

hastily in order to regain independence as soon as

possible. It was drawn by a commission made up of

some 100 persons and approved by the Pyithu

Hluttaw’s meeting on 4 January 1948. The article that

there could be secession in accord with the law ten

years after the independence happened to be included

in the constitution.

Therefore, the Revolutionary Council

abolished the 1947 Constitution on 2 March

1962. Seeking ideas from the people the 97-member

constitution drafting commission drew a draft constitution

three times, sought opinions from the people three times

and showed it to the people two times. In the third time,

the draft constitution was approved by a referendum.

At that time the Union of Myanmar was

under the rule of the Socialist

Programme Party. So also, the

constitution was the one that highlights

Socialism or the 1974 Constitution of

the Union of Myanmar. It was approved

on 3 January 1974 with 90.19 per cent

votes.

In 1988 those who took part in

the “88” unrest disclosed that they

took a dislike to the 1974 Constitution

which was under the influence of

Socialism. Consequently, the 1974

Constitution was abolished as

demanded by the time and condition.

Beginning June 1992, party

representatives, elected

representatives and representatives

from civil service held discussions

repeatedly. And then, with

unanimous decision, the National

Convention was convened on 9

January. If a political party (NLD)

had not attempted to disrupt the

National Convention then, a new

constitution would have been drawn

already. We, delegate groups of other

invited persons, discussed a title of the

chapter concerned in two months and

submitted the proposal papers to the

National Convention Convening

Work Committee. But, some parties

delayed submission of their papers

for six or seven months with an excuse

of having to seek approval from their

members. Then those parties walked

out of the NC while it was in session.

Despite this, the National

Convention will be successfully

completed and a new constitution will

emerge soon. Most people have been

familiar with the term ‘constitution’.

The constitution of the Union of

Myanmar is not the cause of an

individual, a group or a party but the

cause of the entire people. It is because

sovereign power of the Union of

Myanmar is vested in its national

people. When Myanmar was under the

British colonial rule for more than 100

years, sovereign power was not in the

hands of Myanmar people. The British

suppressed Myanmar’s sovereign power

and independence and exploited

ancestral property and resources. That

was why the national people strove to

regain independence by risking their

lives and blood and sweat. We have our

own freedom and independence.

Having our own freedom and

sovereignty means having the right to

serve the State interest on our own

and choose our own faith. The three

branches of sovereignty — legislative,

executive and judicial powers are to

be exercised in the interests of the

State and the people.

The right to enact laws that can

help protect the State and the people and

improve the living standards, the right

to exercise executive power that enables

the people to live in peace and the right

to exercise judicial power that can

prevent those who violate laws must be

systematically included in the

constitution.

The people will have to elect

those who will be responsible for the

legislative sector and those who will

be responsible for the judicial sector

through voting. Elected Members of

Parliament, government and

administrative machinery have no

right to do anything as they wish.

The entire mass of people are in support

of the National Convention. Their voices infavour of the NC have overwhelmed the

slanderous accusations of lackeys of neo-

colonialist nations. The success of the NationalConvention is just around the corner. So, the

nearer the goal we reach, the more diligently

we will have to work.All the delegates are getting ready to

attend the National Convention again. Filled

with enthusiasm, they will march towardsthe Nyaunghnapin Camp to achieve the goal.

Nearly 10 mln in centralChina affected by rainstorms

BEIJING, 16 July—Rainstorms continued to hitcentral China’s Henan and Hubei provinces, withnearly 10 million people affected in the two provinces,said the Ministry of Civil Affairs on Sunday.

Floods leave 68 dead, 25missing in Hubei

ProvinceWUHAN, 16 July—The rainstorm and floods have

killed 68 people and 25 others were missing in centralChina’s Hubei Province since the flood season beganin June, according to local government.

Another 402,200 people have been evacuated fromaffected areas, said Liu Hui, deputy head of the disasterrelief office under the provincial civil affairs departmentat a Press conference on Sunday afternoon.

Hubei, which is also called “the province ofthousands of lakes”, has experienced six majorrainstorms since June, which have triggered floods inmore than 2,000 rivers, mountain torrents andlandslides, causing an economic loss of more than3,800 million yuan, said Liu.

The central and local governments had allocatedmore than 90.5 million yuan of relief fund to theaffected areas and all the evacuated people have beenwell accommodated, said Liu.

BEIJING, 16 July — A strange fishcaught by fishermen in Zanzibar hasproved to be a coelacanth, a “livingfossil” once thought to have gone extinctwith the dinosaurs 65 million years ago,media reported on Monday.

The fish, which weighes 27 kg and is1.34 metres long, was caught off thetropical island’s northern tip, accordingto researcher Nariman Jidawi of Zan-zibar’s Institute of Marine Science.

“The fishermen informed us they hadcaught this strange fish and we quicklyrushed to find it was a coela-canth,”Jidawi was quoted assaying bynewsmedia.

The coelacanth is known from fossilrecords dating back more than 360million years. In 1938, a coelacanthwas caught by a South African museumcurator on a local fishing trawler off the

eastern coast of South Africa — a majorzoological find. In recent years, around30 have been caught off Tanzania.

Coelacanths are the only living animalsto have a fully functional intercranialjoint, a division separating the ear andbrain from the nasal organs and eye.

Iraqi media worker killedBAGHDAD, 16 July — An Iraqi translator working for foreign media was killed in Baghdad by gunmen in

southern Baghdad, an Iraqi media watchdog said on Sunday. “Unknown gunmen

shot dead a translatorworking for Reuters newsagency and two of hisbrothers were killed onWednesday by gunmen inthe Jesr Diyala area insouthern part of the capital,”the Journalistic FreedomObservatory (JFO) said in astatement.

The JFO statement didnot identify the victim,according the victim’sfamily request.

A day after, two ofReuters’ Iraqi staff were also

killed during clashesbetween insurgents and theUS troops in Baghdad’ssoutheastern neigh-bourhood of al-Amin.

Nameer Noor al-Deen, 22, who work as aphotographer and hisdriver Saeed Shmagh, 42,were killed during theclashes but the cause ofdeath was not clear,although witnesses talkedabout an explosion in thearea where they killed,Reuters’s Baghdad officesaid in a statement.

The Iraqi policereported the incident but didnot confirm the cause ofdeath, saying “the deathmight be caused by a USaerial bombing or a mortarattack.”

NAY PYI TAW, 17 July — Member of the StatePeace and Development Council Lt-Gen Maung Bo ofthe Ministry of Defence, Chairman of Mon State Peaceand Development Council Commander of South -EastCommand Maj-Gen Thet Naing Win, Chairman ofKayin State Peace and Development Council Brig-Gen Zaw Min, senior military officers and officials ofthe State Peace and Development Council Office anddepartmental heads inspected regional developmenttasks in Htokawkoe region in Kawkareik District,Kayin State on 14 July.

Lt-Gen Maung Bo and party inspected rubberfarms, cultivation of monsoon paddy and road sectionon Kawkareik-Nabu Road.

Lt-Gen Maung Bo and party also inspectedpaving of Nabu-Htokawkoe Road in Htokawkoe Vil-lage.

Director of Kayin State Development AffairsCommittee U Maung Maung reported on measuresundertaken for development of Htokawkoe region,water and power supply, a new building and furniturefor basic education middle school, construction ofdelivery room, paving of Nabu-Htokawkoe Road,arrangements for construction of Htokawkoe-KyawkhoRoad and cultivation of paddy, sugarcane and rubber.

Lt-Gen Maung Bo then gave instructions andfulfilled the requirements. Next, he presented rice,clothing, books and stationery to leaders of nationalraces of the region.

He inspected installation of iPStar telephone,houses of the villagers, Winthuza shop, dispensary anddelivery room, library and barber shop.

Lt-Gen Maung Bo and party inspected growingof physic nut, monsoon paddy and road section onNabu-Kawkareik Road.

Lt-Gen Maung Bo attended the tree-plantingceremony held at No 2 Basic Education High School in

Kawkareik. He presented saplings to officials of Dis-trict Union Solidarity and Development Association,District Maternal and Child Welfare Supervisory Com-mittee, Township Women’s Affairs Organization (See page 11)
