    INTRODUCTION

    COMPANY PROFILE

    Incorporation and Mandate

    Kenya Pipeline Company (KPC) Limited was incorporated on 6thSeptember 1973

    under the Companies Act (CAP 486) and started commercial operations in 1978.The Company is 100 percent owned by the Government and complies with the

    provisions of the State Corporations Act (Cap 446) of 1986. The company

    operations are also governed by relevant legislations and regulations such as; the

    Finance Act, the Public Procurement Regulations, amongst others.

    Pipeline System

    The pipeline system currently consists of 450 km of Line-1 running from the port of

    Mombasa to Nairobi, 325 km of Line-2 from Nairobi to Eldoret, 121 km of Line-3from Sinendet to Kisumu, and 324 km of Line-4 from Nairobi to Eldoret. The

    installed maximum flow rate for Line-1 is 880 m3per hour while Line-2 and 3 have

    a combined flow rate of 220 m3per hour, Line-4 on the other hand has a installed

    flow rate of 378 m3per hour.

    SECTION I: INVITATION TO TENDER

    August, 2013.

    The KENYA PIPELINE COMPANY invites sealed tenders from eligible

    candidates for TENDER FOR THE SUPPLY, INSTALLATION ANDCOMMISSIONING OF A 750 KVA GENERATOR COMPLETE WITH

    AUTOMATIC TRANSFER SWITCHBOARD AT KISUMU DEPOT (PS 28)

    Interested eligible candidates may inspect and obtain the tenderdocuments at theoffice of the Procurement Manager, Kenya Pipeline Company Ltd, Nairobi

    Terminal, Nanyuki Road, and Industrial Area during normal working hours onpayment of non-refundable fee of Ksh.1,000.00 payable in cash or in form of a

    Bankers Cheque drawn in favour of Kenya Pipeline Company Limited. The tenderdocuments can also be viewed and downloaded from the websitewww.kpc.co.keat

    no cost. Bidders who download the tender document from the website will berequired to email their detailed contact information to [email protected] for

    recording,further clarifications and addenda.

    Interested firms mustensure that they comply with the following requirements andsubmit the relevant documents; (these documents must be placed in a separate

    envelope marked Mandatory Requirements)

    Prices quoted should be net inclusive of all taxes and shall remain valid for a period

    of 120 days from the closing date.

    SECTION II: INSTRUCTIONS TO TENDERERS

    2.1 Eligible Tenderers

    2.1.1 This Invitation for Tenders is open to all tenderers eligible as described in the

    Invitation to Tender. Successful tenderers shall complete the supply of goods

    by the intended completion date specified in the Schedule of Requirements

    Section VI.

    2.1.2 KENYA PIPELINE COMPANY employees, committee members, board

    members and their relative (spouse and children) are not eligible to

    participate in the tender.

    2.1.3 Tenderers shall provide the qualification information statement that thetenderer (including all members of a joint venture and subcontractors) is not

    associated, or have been associated in the past, directly or indirectly, with a

    firm or any of its affiliates which have been engaged by KENYA PIPELINE

    COMPANY to provide consulting services for the preparation of the design,

    specifications, and other documents to be used for the procurement of the

    goods under this Invitation for tenders.

    2.1.4 Tenderers shall not be under a declaration of ineligibility for corrupt and

    fraudulent practices.

    2.2 Eligible Goods

    2.2.1 All goods to be supplied under the contract shall have their origin in eligible

    source countries.

    2.2.2 For purposes of this clause, origin means the place where the goods are

    mined, grown, or produced. Goods are produced when, through

    manufacturing, processing, or substantial and major assembly of components,

    a commercially-recognized product results that is substantially different in

    basic characteristics or in purpose or utility from its components

    2.2.3 The origin of goods is distinct from the nationality of the tenderer.

    2.3 Cost of Tendering

    2.3.1 The Tenderer shall bear all costs associated with the preparation and

    submission of its tender, and KENYA PIPELINE COMPANY, will in no

    case be responsible or liable for those costs, regardless of the conduct oroutcome of the tendering process.

    2.4 The Tender Document

    2.4.1 The tender document comprises the documents listed below and addenda

    issued in accordance with clause 2.6 of these instructions to Tenderers

    (i) Invitation to Tender

    (ii) Instructions to tenderers

    (iii) General Conditions of Contract(iv) Special Conditions of Contract

    (v) Schedule of requirements

    (vi) Technical Specifications

    (vii) Tender Form and Price Schedules

    (viii) Contract Form

    (ix) Bank Guarantee for Advance Payment Form

    (x) Confidential Business Questionnaire

    2.4.2 The Tenderer is expected to examine all instructions, forms, terms, and

    specifications in the tender documents. Failure to furnish all information

    required by the tender documents or to submit a tender not substantially

    responsive to the tender documents in every respect will be at the tenderers

    risk and may result in the rejection of its tender.

    2.5 Clarification of Documents

    2.5.1 A prospective tenderer requiring any clarification of the tender documentmay notify KENYA PIPELINE COMPANY in writing or by post at the

    address indicated in the Invitation to Tender. KENYA PIPELINE

    COMPANY will respond in writing to any request for clarification of the

    tender documents, which it receives not later than seven (7) days prior to the

    deadline for the submission of tenders, prescribed by KENYA PIPELINE

    COMPANY. Written copies of KENYA PIPELINE COMPANY response

    (including an explanation of the query but without identifying the source of

    inquiry) will be sent to all prospective tenderers that have received the tender

    document.

    2.5.2 KENYA PIPELINE COMPANY shall reply to any clarifications sought by

    the tenderer within 3 days of receiving the request to enable the tenderer tomake timely submission of its tender.

    2.6 Amendment of Documents

    2.6.1 At any time prior to the deadline for submission of tenders, KENYA

    PIPELINE COMPANY, for any reason, whether at its own initiative or in

    response to a clarification requested by a prospective tenderer, may modify

    the tender documents by amendment.

    2.6.2 All prospective candidates that have received the tender documents will benotified of the amendment in writing or by post and will be binding on them.

    2.6.3 In order to allow prospective tenderers reasonable time in which to take the

    amendment into account in preparing their tenders, KENYA PIPELINE

    COMPANY, at its discretion, may extend the deadline for the submission of

    tenders.

    2.7 Language of Tender

    2.7.1 The tender prepared by the tenderer, as well as all correspondence and

    documents relating to the tender exchange by the tenderer and KENYA

    PIPELINE COMPANY, shall be written in English language, provided that

    any printed literature furnished by the tenderer may be written in another

    language provided they are accompanied by an accurate English translation

    of the relevant passages in which case, for purposes of interpretation of the

    tender, the English translation shall govern.

    2.8 Documents Comprising of Tender

    2.8.1 The tender prepared by the tenderers shall comprise the following

    components

    a. a Tender Form and a Price Schedule completed in accordance with

    paragraph 2.9, 2.10 and 2.11 below.

    b. documentary evidence established in accordance with paragraph 2.1.2

    that the tenderer is eligible to tender and is qualified to perform the

    contract if its tender is accepted;

    c. documentary evidence established in accordance with paragraph 2.2.1

    that the goods and ancillary services to be supplied by the tenderer are

    eligible goods and services and conform to the tender documents; and

    2.9 Tender Forms

    2.9.1 The tenderer shall complete the Tender Form and the appropriate Price

    Schedule furnished in the tender documents, indicating the goods to be

    supplied, a brief description of the goods, their country of origin, quantity,

    and prices.

    2.10 Tender Prices

    2.10.1The tenderer shall indicate on the appropriate Price Schedule the unit prices

    and total tender price of the goods it proposes to supply under the contract

    2.10.2Prices indicated on the Price Schedule shall include all costs including taxes,

    insurances and delivery to the premises of KENYA PIPELINE COMAPNY.

    2.10.3Prices quoted by the tender shall be fixed during the Tenders performance

    of the contract and not subject to variation on any account. A tender

    submitted with an adjustable price quotation will be treated as non-

    responsive and will be rejected, pursuant to paragraph 2.10

    2.10.4The validity period of the tender shall be 90 days from the date of opening of

    the tender.

    2.11 Tender Currencies

    2.11.1Prices shall be quoted in Kenya Shillings unless otherwise specified in theAppendix to Instructions to Tenderers.

    2.12 Tenderers Eligibility and Qualifications

    2.12.1 Pursuant to paragraph 2.1 the tenderer shall furnish, as part of its tender,

    documents establishing the tenderers eligibility to tender and its

    qualifications to perform the contract if its tender is accepted.

    2.12.2 The documentary evidence of the tenderers eligibility to tender shall establish

    to KENYA PIPELINE COMPANY satisfaction that the tenderer, at the time

    of submission of its tender, is from an eligible source country as defined

    under paragraph 2.1.

    2.12.3 The documentary evidence of the tenderers qualifications to perform the

    contract if its tender is accepted shall be established to KENYA PIPELINE

    COMPANY satisfaction;(a) that, in the case of a tenderer offering to supply goods under the

    contract which the tenderer did not manufacture or otherwise produce,

    the tenderer has been duly authorized by the goods Manufacturer or

    producer to supply the goods.

    (b) that the tenderer has the financial, technical, and production capability

    necessary to perform the contract;

    (c) that, in the case of a tenderer not doing business within Kenya, the

    tenderer is or will be (if awarded the contract) represented by an Agent

    in Kenya equipped, and able to carry out the Tenderers maintenance,

    repair, and spare parts-stocking obligations prescribed in the

    Conditions of Contract and/or Technical Specifications.

    2.13Goods Eligibility and Conformity to Tender Documents

    2.13.1Pursuant to paragraph 2.2 of this section, the tenderer shall furnish, as part of

    its tender documents establishing the eligibility and conformity to the tender

    documents of all goods which the tenderer proposes to supply under thecontract.

    2.13.2The documentary evidence of the eligibility of the goods shall consist of a

    statement in the Price Schedule of the country of origin of the goods and

    services offered which shall be confirmed by a certificate of origin issued at

    the time of shipment.

    2.13.3The documentary evidence of conformity of the goods to the tender

    documents may be in the form of literature, drawings, and data, and shall

    consist of:

    (a) a detailed description of the essential technical and performance

    characteristic of the goods; and(b) a clause-by-clause commentary on KENYA PIPELINE COMPANYs

    Technical Specifications demonstrating substantial responsiveness of

    the goods and service to those specifications, or a statement of

    deviations and exceptions to the provisions of the Technical

    Specifications.

    2.13.4For purposes of the documentary evidence to be furnished pursuant to

    paragraph 2.13.3(b) above, the tenderer shall note that standards for

    workmanship, material, and equipment, as well as references to brand namesor catalogue numbers designated by KENYA PIPELINE COMPANY in its

    Technical Specifications, are intended to be descriptive only and not

    restrictive. The tenderer may substitute alternative standards, brand names,

    and/or catalogue numbers in its tender, provided that it demonstrates to

    KENYA PIPELINE COMPANYs satisfaction that the substitutions ensure

    substantial equivalence to those designated in the Technical Specifications.

    2.14Validity of Tenders

    2.14.1 Tenders shall remain valid for 120 daysor as specified in the Invitation to

    Tender after the date of tender opening prescribed by KENYA PIPELINE

    COMPANY, pursuant to paragraph 2.18. A tender valid for a shorter period

    shall be rejected by KENYA PIPELINE COMPANY as non responsive.

    2.14.2In exceptional circumstances, KENYA PIPELINE COMPANY may solicit

    the Tenderers consent to an extension of the period of validity. The request

    and the responses thereto shall be made in writing. The tender securityprovided under paragraph 2.14 shall also be suitably extended. A tenderer

    may refuse the request without forfeiting its tender security. A tenderer

    granting the request will not be required nor permitted to modify its tender.

    2.15Format and Signing of Tender

    2.15.1 The Tenderer shall prepare two copies of the tender, clearly marking each

    ORIGINAL TENDER and COPY OF TENDER, as appropriate. In the

    event of any discrepancy between them, the original shall govern.

    2.15.2The original and all copies of the tender shall be typed or written in indelible

    ink and shall be signed by the tenderer or a person or persons duly authorized

    to bind the tenderer to the contract. The letter of authorization shall be

    indicated by written power-of-attorney accompanying the tender. All pages

    of the tender, except for unamended printed literature, shall be initialed by

    the person or persons signing the tender.

    2.15.3The tender shall have no interlineations, erasures, or overwriting except asnecessary to correct errors made by the tenderer, in which case such

    corrections shall be initialed by the person or persons signing the tender.

    2.16 Sealing and Marking of Tenders

    2.16.1 The Tenderer shall seal the original and each copy of the tender in separate

    envelopes, duly marking the envelopes as ORIGINAL and COPY. The

    envelopes shall then be sealed in an outer envelope.

    2.16.2 The inner and outer envelopes shall:

    (a) Be addressed to KENYA PIPELINE COMPANY at the address given

    in the Invitation to Tender:

    (b) Bear, tender number and name in the Invitation for Tenders and the

    words, DO NOT OPEN BEFORE, 10.00 am on 17th

    September 2013.

    2.16.3 The inner envelopes shall also indicate the name and address of the tenderer

    to enable the tender to be returned unopened in case it is declared late.

    2.16.4 If the outer envelope is not sealed and marked as required by paragraph

    2.17.2, KENYA PIPELINE COMPANY will assume no responsibility for the

    tenders misplacement or premature opening.

    2.17 Deadline for Submission of Tenders

    2.17.1 Tenders must be received by KENYA PIPELINE COMPANY at the address

    specified under paragraph 2.17.2 no later than 10.00 am on 17th

    September

    2013.

    2.17.2 KENYA PIPELINE COMPANY may, at its discretion, extend this deadline

    for the submission of tenders by amending the tender documents in

    accordance with paragraph 2.6, in which case all rights and obligations of

    KENYA PIPELINE COMPANY and candidates previously subject to the

    deadline will therefore be subject to the deadline as extended.

    2.18 Modification and Withdrawal of Tenders

    2.18.1The tenderer may modify or withdraw its tender after the tenderssubmission, provided that written notice of the modification, including

    substitution or withdrawal of the tenders, is received by KENYA PIPELINE

    COMPANY prior to the deadline prescribed for submission of tenders.

    2.18.2The tenderers modification or withdrawal notice shall be prepared, sealed,

    marked, and dispatched in accordance with the provisions of paragraph 2.17.

    A withdrawal notice may also be sent by cable, telex but followed by a

    signed confirmation copy, postmarked not later than the deadline for

    submission of tenders.

    2.18.3No tender may be modified after the deadline for submission of tenders.

    2.18.4No tender may be withdrawn in the interval between the deadline for

    submission of tenders and the expiration of the period of tender validity

    specified by the tenderer on the Tender Form. Withdrawal of a tender during

    this interval may result in the Tenderers forfeiture of its tender security,

    pursuant to paragraph 2.14.7

    2.18.5KENYA PIPELINE COMPANY may at any time terminate procurement

    proceedings before contract award and shall not be liable to any person for

    the termination.

    2.18.6KENYA PIPELINE COMPANY shall give prompt notice of the termination

    to the tenderers and on request give its reasons for termination within 14 days

    of receiving the request from any tenderer.

    2.19Opening of Tenders

    2.19.1KENYA PIPELINE COMPANY will open all tenders in the presence oftenderers representatives who choose to attend, at a location specified in the

    Invitation to Tender.

    The tenderers representatives who are present shall sign a register

    evidencing their attendance.

    2.19.2The tenderers names, tender modifications or withdrawals, tender prices,

    discounts and the presence or absence of requisite tender security and such

    other details as KENYA PIPELINE COMPANY, at its discretion, mayconsider appropriate, will be announced at the opening.

    2.19.3KENYA PIPELINE COMPANY will prepare minutes of the tender opening.

    2.20Clarification of Tenders

    2.20.1To assist in the examination, evaluation and comparison of tenders KENYA

    PIPELINE COMPANY may, at its discretion, ask the tenderer for a

    clarification of its tender. The request for clarification and the response shall

    be in writing, and no change in the prices or substance of the tender shall be

    sought, offered, or permitted.

    2.20.2Any effort by the tenderer to influence KENYA PIPELINE COMPANY in

    the tender evaluation, tender comparison or contract award decisions may

    result in the rejection of the tenderers tender.

    2.21Preliminary Examination

    2.21.1KENYA PIPELINE COMPANY will examine the tenders to determine

    whether they are complete, whether any computational errors have been

    made, whether required sureties have been furnished, whether the documents

    have been properly signed, and whether the tenders are generally in order.

    2.21.2Arithmetical errors will be rectified on the following basis. If there is a

    discrepancy between the unit price and the total price that is obtained by

    multiplying the unit price and quantify, the unit price shall prevail, and the

    total price shall be corrected. If the candidate does not accept the correction

    of the errors, its tender will be rejected, and its tender security forfeited. If

    there is a discrepancy between words and figures the amount in words willprevail

    2.21.3KENYA PIPELINE COMPANY may waive any minor informality or non-

    conformity or irregularity in a tender which does not constitute a material

    deviation, provided such waiver does not prejudice or affect the relative

    ranking of any tenderer.

    2.21.4Prior to the detailed evaluation, pursuant to paragraph 2.23 KENYA

    PIPELINE COMPANY will determine the substantial responsiveness of each

    tender to the tender documents. For purposes of these paragraphs, asubstantially responsive tender is one, which conforms to all the terms and

    conditions of the tender documents without material deviations. KENYA

    PIPELINE COMPANYs determination of a tenders responsiveness is to be

    based on the contents of the tender itself without recourse to extrinsic

    evidence.

    2.21.5If a tender is not substantially responsive, it will be rejected by KENYA

    PIPELINE COMPANY and may not subsequently be made responsive by the

    tenderer by correction of the non conformity.

    2.22Conversion to Single Currency

    2.22.1Where other currencies are used, KENYA PIPELINE COMPANY will

    convert these currencies to Kenya Shillings using the selling exchange rate

    on the date of tender closing provided by the Central Bank of Kenya.

    2.23Evaluation and Comparison of Tenders

    2.23.1KENYA PIPELINE COMPANY will evaluate and compare the tenders

    which have been determined to be substantially responsive, pursuant to

    paragraph 2.22

    2.23.2The tender evaluation committee shall evaluate the tender within 30 days of

    the validity period from the date of opening the tender.

    2.23.3A tenderer who gives false information in the tender document about its

    qualification or who refuses to enter into a contract after notification of

    contract award shall be considered for debarment from participating in futurepublic procurement.

    2.24Preference

    2.24.1Preference where allowed in the evaluation of tenders shall not exceed 15%.

    2.25Contacting KENYA PIPELINE COMPANY

    2.25.1Subject to paragraph 2.21 no tenderer shall contact the KENYA PIPELINE

    COMPANY on any matter related to its tender, from the time of the tenderopening to the time the contract is awarded.

    2.25.2Any effort by a tenderer to influence KENYA PIPELINE COMPANY in its

    decisions on tender, evaluation, tender comparison, or contract award may

    result in the rejection of the Tenderers tender.

    2.26Award of Contract

    (a) Post-qualification

    2.26.1In the absence of pre-qualification, KENYA PIPELINE COMPANY will

    determine to its satisfaction whether the tenderer that is selected as having

    submitted the lowest evaluated responsive tender is qualified to perform the

    contract satisfactorily.

    2.26.2The determination will take into account the tenderer financial, technical, and

    production capabilities. It will be based upon an examination of thedocumentary evidence of the tenderers qualifications submitted by the

    tenderer, pursuant to paragraph 2.12.3 as well as such other information as

    KENYA PIPELINE COMPANY deems necessary and appropriate.

    2.26.3An affirmative determination will be a prerequisite for award of the contract

    to the tenderer. A negative determination will result in rejection of the

    Tenderers tender, in which event KENYA PIPELINE COMPANY will

    proceed to the next lowest evaluated tender to make a similar determination

    of that Tenderers capabilities to perform satisfactorily.

    (b) Award Criteria

    2.26.4KENYA PIPELINE COMPANY will award the contract to the successful

    tenderer(s) whose tender has been determined to be substantially responsive

    and has been determined to be the lowest evaluated tender, provided further

    that the tenderer is determined to be qualified to perform the contract

    satisfactorily.

    (c) KENYA PIPELINE COMPANYsRight to Vary quantities

    2.26.5KENYA PIPELINE COMPANY reserves the right at the time of contractaward to increase or decrease the quantity of goods originally specified in the

    Schedule of requirements without any change in unit price or other terms and

    conditions

    (d) KENYA PIPELINE COMPANYsRight to Accept or Reject Any or All

    Tenders

    2.26.6KENYA PIPELINE COMPANY reserves the right to accept or reject any

    tender, and to annul the tendering process and reject all tenders at any time

    prior to contract award, without thereby incurring any liability to the affected

    tenderer or tenderers or any obligation to inform the affected tenderer or

    tenderers of the grounds for KENYA PIPELINE COMPANYs action

    2.27Notification of Award

    2.27.1Prior to the expiration of the period of tender validity, KENYA PIPELINE

    COMPANY will notify the successful tenderer in writing that its tender hasbeen accepted and simultaneously notify the unsuccessful tenderers that their

    tenders were not successful.

    2.27.2The notification of award will not constitute the formation of the Contract

    but will have to wait until the contract is finally signed by both parties.

    2.27.3Upon the successful Tenderers furnishing of the performance security

    pursuant to paragraph 2.28, KENYA PIPELINE COMPANY will promptly

    notify each unsuccessful Tenderer and will discharge its tender security,

    pursuant to paragraph 2.14

    2.28

    Signing of Contract

    2.28.1At the same time as KENYA PIPELINE COMPANY notifies the successful

    tenderer that its tender has been accepted, KENYA PIPELINE COMPANY

    will send the tenderer the Contract Form provided in the tender documents,

    incorporating all agreements between the parties.

    2.28.2The parties to the contract shall have it signed within 30 days but not until at

    least 14 days have lapsed from the date of notification of contract award

    unless there is an administrative review request.

    2.28.3Within thirty (30) days of receipt of the Contract Form, the successful

    tenderer shall sign and date the contract and return it to KENYA PIPELINE

    COMPANY.

    2.29Corrupt or Fraudulent Practices

    2.29.1KENYA PIPELINE COMPANY requires that tenderers observe the highest

    standard of ethics during the procurement process and execution of contracts.

    When used in the present regulations, the following terms are defined as

    follows;

    (i) corrupt practice means the offering, giving, receiving, or soliciting of

    any thing of value to influence the action of a public official in the

    procurement process or in contract execution; and

    (ii) fraudulent practice means a misrepresentation of facts in order to

    influence a procurement process or the execution of a contract to thedetriment of KENYA PIPELINE COMPANY, and includes collusive

    practice among tenderer (prior to or after tender submission) designed

    to establish tender prices at artificial non-competitive levels and to

    deprive KENYA PIPELINE COMPANY of the benefits of free and

    open competition;

    2.29.2KENYA PIPELINE COMPANY will reject a proposal for award if it

    determines that the tenderer recommended for award has engaged in corrupt

    or fraudulent practices in competing for the contract in question.

    2.29.3Further a tenderer who is found to have indulged in corrupt or fraudulent

    practices risks being debarred from participating in public procurement inKenya.

    2.30Performance Security

    2.30.1Within Thirty (30) days of the receipt of notification of award from KENYAPIPELINE COMPANY, the successful tenderer shall furnish the

    performance security in accordance with the Conditions of Contract, in thePerformance Security Form provided in the tender documents, or in another

    form acceptable to KENYA PIPELINE COMPANY.

    2.30.2Failure of the successful tenderer to comply with the requirements ofparagraph 2.27 or paragraph 2.28 shall constitute sufficient grounds for the

    annulment of the award and forfeiture of the tender security, in which eventKENYA PIPELINE COMPANY may make the award to the next lowest

    evaluated Candidate or call for new tenders.

    SECTION III: GENERAL CONDITIONS OF CONTRACT

    3.1 Definitions

    3.1.1 In this Contract, the following terms shall be interpreted as indicated:-

    (a) The Contract means the agreement entered into between KENYA

    PIPELINE COMPANY and the tenderer, as recorded in the Contract

    Form signed by the parties, including all attachments and appendices

    thereto and all documents incorporated by reference therein.

    (b) The Contract Price means the price payable to the tenderer under the

    Contract for the full and proper performance of its contractual obligations

    (c) The Goods means all of the equipment, machinery, and/or other

    materials, which the tenderer is required to supply to KENYA PIPELINE

    COMPANY under the Contract.

    (d) KENYA PIPELINE COMPANY means the organization purchasing the

    Goods under this Contract.

    (e) The Tenderer means the individual or firm supplying the Goods under

    this Contract.

    3.2 Application

    3.2.1 These General Conditions shall apply in all Contracts made by KENYA

    PIPELINE COMPANY for the procurement installation and commissioning

    of equipment

    3.3

    Country of Origin

    3.3.1 For purposes of this clause, Origin means the place where the Goods were

    mined, grown or produced.

    3.3.2 The origin of Goods and Services is distinct from the nationality of the

    tenderer

    3.4 Standards

    3.4.1 The Goods supplied under this Contract shall conform to the standards

    mentioned in the Technical Specifications.

    3.5 Use of Contract Documents and Information

    3.5.1 The tenderer shall not, without KENYA PIPELINE COMPANYs prior

    written consent, disclose the Contract, or any provision therefore, or any

    specification, plan, drawing, pattern, sample, or information furnished by or

    on behalf of KENYA PIPELINE COMPANY in connection therewith, to any

    person other than a person employed by the tenderer in the performance of

    the Contract.

    3.5.2 The tenderer shall not, without KENYA PIPELINE COMPANYs prior

    written consent, make use of any document or information enumerated in

    paragraph 3.5.1 above

    3.5.3 Any document, other than the Contract itself, enumerated in paragraph 3.5.1

    shall remain the property of KENYA PIPELINE COMPANY and shall be

    returned (all copies) to KENYA PIPELINE COMPANY on completion of

    the Tenderers performance under the Contract if so required by KENYA

    PIPELINE COMPANY

    3.6 Patent Rights

    3.6.1 The tenderer shall indemnify KENYA PIPELINE COMPANY against all

    third-party claims of infringement of patent, trademark, or industrial design

    rights arising from use of the Goods or any part thereof in KENYA

    PIPELINE COMPANYscountry

    3.7 Inspection and Tests

    3.7.1 KENYA PIPELINE COMPANY or its representative shall have the right to

    inspect and/or to test the goods to confirm their conformity to the Contract

    specifications. KENYA PIPELINE COMPANY shall notify the tenderer in

    writing in a timely manner, of the identity of any representatives retained for

    these purposes.

    3.7.2 The inspections and tests may be conducted in the premises of the tenderer or

    its subcontractor(s), at point of delivery, and/or at the Goods final

    destination. If conducted on the premises of the tenderer or itssubcontractor(s), all reasonable facilities and assistance, including access to

    drawings and production data, shall be furnished to the inspectors at no

    charge to KENYA PIPELINE COMPANY.

    3.7.3 Should any inspected or tested goods fail to conform to the Specifications,

    KENYA PIPELINE COMPANY may reject the equipment, and the tenderer

    shall either replace the rejected equipment or make alternations necessary to

    make specification requirements free of costs to KENYA PIPELINE

    COMPANY.

    3.7.4 KENYA PIPELINE COMPANYs right to inspect, test and where necessary,

    reject the goods after the Goods arrival shall in no way be limited or waived

    by reason of the equipment having previously been inspected, tested and

    passed by KENYA PIPELINE COMPANY or its representative prior to the

    equipment delivery.

    3.7.5Nothing in paragraph 3.8 shall in any way release the tenderer from any

    warranty or other obligations under this Contract.

    3.8 Packing

    3.8.1 The tenderer shall provide such packing of the Goods as is required to

    prevent their damage or deterioration during transit to their final destination,

    as indicated in the Contract.

    3.8.2 The packing, marking, and documentation within and outside the packagesshall comply strictly with such special requirements as shall be expressly

    provided for in the Contract.

    3.9 Delivery and Documents

    3.9.1 Delivery of the Goods shall be made by the tenderer in accordance with the

    terms specified by KENYA PIPELINE COMPANY in its Schedule of

    Requirements and the Special Conditions of Contract

    3.10 Insurance

    3.10.1The Goods supplied under the Contract shall be fully insured against loss or

    damage incidental to manufacturer or acquisition, transportation, storage, and

    delivery in the manner specified in the Special conditions of contract.

    3.11 Payment

    3.11.1 The method and conditions of payment to be made to the tenderer under this

    Contract shall be specified in Special Conditions of Contract.

    3.11.1Payments shall be made promptly by KENYA PIPELINE COMPANY as

    specified in the contract

    3.12Prices

    3.12.1Prices charged by the tenderer for goods delivered and services performed

    under the Contract shall not, with the exception of any price adjustments

    authorized in Special Conditions of Contract, vary from the prices by the

    tenderer in its tender.

    3.12.2Contract price variations shall not be allowed for contracts not exceeding one

    year (12 months)

    3.12.3Where contract price variation is allowed, the variation shall not exceed 10%of the original contract price.

    3.12.4Price variation request shall be processed by KENYA PIPELINE

    COMPANY within 30 days of receiving the request.

    3.13 Assignment

    3.13.1The tenderer shall not assign, in whole or in part, its obligations to perform

    under this Contract, except with KENYA PIPELINE COMPANYs prior

    written consent.

    3.14 Subcontracts

    3.14.1The tenderer shall notify KENYA PIPELINE COMPANY in writing of all

    subcontracts awarded under this Contract if not already specified in the

    tender. Such notification, in the original tender or later, shall not relieve the

    tenderer from any liability or obligation under the Contract

    3.15 Termination for default

    3.15.1KENYA PIPELINE COMPANY may, without prejudice to any other

    remedy for breach of Contract, by written notice of default sent to the

    tenderer, terminate this Contract in whole or in part

    (a) if the tenderer fails to deliver any or all of the goods within the

    periods) specified in the Contract, or within any extension thereof

    granted by KENYA PIPELINE COMPANY.

    (b) if the tenderer fails to perform any other obligation(s) under the

    Contract

    (c) if the tenderer, in the judgment of KENYA PIPELINE COMPANY

    has engaged in corrupt or fraudulent practices in competing for or in

    executing the Contract

    3.15.2In the event KENYA PIPELINE COMPANY terminates the Contract in

    whole or in part, it may procure, upon such terms and in such manner as itdeems appropriate, equipment similar to those undelivered, and the tenderer

    shall be liable to KENYA PIPELINE COMPANY for any excess costs for

    such similar goods.

    3.16 Liquidated Damages

    3.16.1If the tenderer fails to deliver any or all of the goods within the period(s)

    specified in the contract, KENYA PIPELINE COMPANY shall, without

    prejudice to its other remedies under the contract, deduct from the contractprices liquidated damages sum equivalent to 0.5%of the delivered price of

    the delayed items per working week up to a maximum deduction of 10%of

    the delayed goods. After this the tenderer may consider termination of the

    contract.

    3.17 Resolution of Disputes

    3.17.1KENYA PIPELINE COMPANY and the tenderer shall make every effort to

    resolve amicably by direct informal negotiation and disagreement or disputearising between them under or in connection with the contract

    3.17.2If, after thirty (30) days from the commencement of such informal

    negotiations both parties have been unable to resolve amicably a contract

    dispute, either party may seek resolution through the High Court of Kenya.

    3.18 Language and Law

    3.18.1The language of the contract and the law governing the contract shall be

    English language and the Laws of Kenya respectively.

    3.19 Force Majeure

    3.19.1The tenderer shall not be liable for forfeiture of its performance security or

    termination for default if and to the extent that its delay in performance or

    other failure to perform its obligations under the Contract is the result of an

    event of Force Majeure.

    SECTION IV: SPECIAL CONDITIONS OF CONTRACT

    4.1 Special Conditions of Contact

    4.1.1 Special Conditions of Contract shall supplement the General Conditions ofContract. Whenever there is a conflict, between the GCC and the SCC, the

    provisions of the SCC herein shall prevail over these in the GCC.

    4.2 Site Visits

    Site Visit- shall be held on 10th

    September 2013 at 10.00am

    i. It is mandatory for the bidders to visit and examine the Site and its

    surroundings and obtain for himself on his own responsibility, all informationthat may be necessary for preparing the tender and entering into a contract.

    The costs of visiting the Site shall be the tenderers own responsibility.

    ii. The Employer shall conduct a pre-tender site visit for the purpose of suchinspection on a mutually agreed date. The tenderer, his personnel or agents,

    will release and indemnify the Employer from and against all liability inrespect of, and will be responsible for personal injury (whether fatal or

    otherwise), loss of or damage to property and any other loss, damage, costs

    and expenses however caused.

    iii. Tenderers must provide their own transport. The representative will not be

    available at any other time for pre-tender site inspection visits.

    iv. Each tenderer shall complete the Certificate of Tenderers Visit to Site,

    whether he in fact visits the Site at the time of the organized pre-tender site

    visit or by himself at some other time.

    v. Failure to submit a site visit certificate shall lead to automaticdisqualification.

    4.3 Warranty

    4.3.1 The supplier shall as soon as reasonably practicable repair or replace all

    goods which are or become defective during a period of twelve (12 months)from putting into service or 18 months from delivery, whichever shall be

    shorter, where such defects occur under proper usage and are due to faultydesign, suppliers erroneous instructions as to use or inadequate or faulty

    materials or workmanship, or any other breach of suppliers warranties,expressed or implied. Repairs and replacements shall themselves be subject

    to the foregoing obligations for a period of twelve (12) months from the dateof delivery, reinstallation or passing of tests, if any, whichever is appropriate

    after repair or replacement.

    4.4 Assumptions

    4.4.1 The tenderer is advised to respond to this tender in full and take account ofall aspects mentioned within. It is assumed that the tenderer will have catered

    for all the provisions of this tender in their quotation unless the tenderer

    specifically indicates otherwise.

    4.4.2

    Any requirements stated in this tender will be assumed to form part of thesuppliers obligations.

    4.4.3 KPC shall be free to request for any provisions mentioned in this tenderdocument at any time during the execution of the contract and the contractor

    shall be obliged to provide for it at no additional cost to KPC.

    4.5 Payment Schedule

    4.5.1 The payment schedule shall be as follows:

    (a)10% of contract value on receipt of design drawings, preliminarydocumentation, and Factory Acceptance Test (FAT) and trainingprograms

    (b)10% of contract value on upon confirmation of FAT and training for 6No. KPC engineers and maintenance personnel

    (c)15% of contract value upon completion of civil works and associatedcabling

    (d)20% of contract value upon supply of 750 kVA generator complete

    with automatic transfer switchboard on site

    (e)20% of contract value upon completion of installation andcommissioning works

    (f)25% of contract value upon provision of as built drawings and finaldocumentation

    4.5.2 A Performance Bond of 10% of the contract price shall be retained by KPC

    for the defect liability period and shall be returned to the contractor upon

    completions of all outstanding works and expiry of the defects liability

    periodof 1 year. It must be valid for the entire defects liability period.

    4.6 Performance Security

    4.6.1 Within Thirty (30) days of the receipt of notification of award from KENYA

    PIPELINE COMPANY, the successful tenderer shall furnish a performancesecurity equivalent to 10 % of the project cost.

    4.7 Installation Works

    4.7.1 The successful tenderer shall ensure that all installation works shall be

    carried out with minimal interruptions to normal operations of the Depot.

    SECTION V: TECHNICAL SPECIFICATIONS

    GENERAL SPECIFICATIONS

    1. Definitions

    For this and all related contracts, specification, drawings and provisions, thefollowing definitions will apply:

    1.1.Owner - refers to Kenya Pipeline Company (KPC) Limited

    1.2.Engineer, Contract Administrator or Resident Engineering Inspector - refers

    to the project engineer appointed by KPC1.3.Utility refers to Utility and Owners Electrical, Gas, Water and Process

    services of all kinds.1.4.Contractor refers to the Specialist Contractor to be engaged by the

    Owner under this contract to provide, install, connect, test, commission, and

    repair under warranty, the equipment to be installed under this contract.1.5.Tendererrefers to Contractor submitting tender or RFQ.1.6.Constructorrefers to Contractor.

    1.7.RFQ refers to Request for Quotation; may be used interchangeably withTender.

    1.8.Contract Warranty Period is the time period starting at the formal final

    acceptance (i.e. Substantial Completion) of all work to be performed under

    this contract including commissioning of the equipment to be supplied andinstalled under this contract in accordance with the technical specifications

    provided and referenced herein, and ending on the anniversary date thereof

    as further defined elsewhere in these contract documents.1.9.Contract Period - is the time period from the execution of documents

    awarding this contract and ending at the formal notification of the successful

    ending of the contract warranty period, as also defined elsewhere in thesecontract documents.

    1.10. Concealedmeans hidden from normal sight in furred spaces, shafts,ceiling spaces, walls and partitions, etc.

    1.11. Exposedmeans Work normally visible, including Work in equipmentrooms, tunnels, and similar accessible spaces.

    1.12. Providemeans supply, install and connect complete.1.13. Retrofitmeans remove existing, and provide new complete.

    1.14. Installmeans install and connect complete.1.15. Furnishmeans supply only.

    1.16. Supplymeans supply only.1.17. Workmeans the execution of all items in this contract.

    1.18. Daysmeans a required number of working days.

    1.19. Complete means installed and running to the satisfaction of theEngineer.

    1.20. Restoration means repair and renewal to good condition to thesatisfaction of the Engineer.

    1.21. Labour means all persons with the appropriate certified skills tocomplete the work.

    1.22. Materialsmeans all things required the complete the work.1.23. Commissioning means work by Specialist Sub-Contractors to test,

    verify and certify the proper condition, wiring connections and operation ofthe subject equipment.

    1.24. C/W means complete with and refers to the auxiliaries orincidentals required to be supplied.

    1.25. Remove means consult and coordinate with the Owner, make the

    subject equipment safe, disconnect and remove all subject electrical and

    support materials back to the source of electrical supply, and dispose offsite

    in a safe and approved manner, all according to Engineers instructions andapplicable Regulations.1.26. Decommissioningmeans take out of service in coordination with the

    Engineer and the Owner.1.27. Returned means supply the subject equipment in the possession of

    the contractor to the designated party.1.28. Verification means inspect, measure and test using approved

    specialist subcontractors as may by requested by the Engineer.1.29. Start-upmeans that process after commissioning to coordinate with

    the Engineer and Owner, to turn on and leave running the subject equipment.

    2. Scope of Work

    The following is a general but not necessary complete description of theelectrical work and services to be provided under this contract. All the products

    and services mentioned or shown in the documents shall be provided, includingall the incidentals necessary for a complete and working electrical system to the

    satisfaction of the Engineer.

    2.1.5Provide one (1) 750 kVA diesel fuelled backup generator set, including

    engineering, design, manufacturing, delivery, site placement and assembly,start-up and commissioning.

    3. Related Sections

    3.1.This section includesspecifications for products, criteria and characteristics,

    methods and execution that arecommon to one or more sections and is to be

    read accordingly.

    3.2.This section is part of the Contract Documents and is to be read accordingly.

    4. References, Codes and Standards4.1.All components and assemblies are to be designed, manufactured, tested an

    installed in accordance with the latest applicable EEMAC/NEMA, ANSI,

    and/or IEEE standards4.2.Where any code, regulation, by-law or standard is quoted it means, unless

    otherwise specifically noted, the current edition including all revisions andamendments at the time of the Contract. Where references are made to

    printed instructions, it means the current edition of such instructions.4.3.Where regulatory codes, standards and regulations are at variance with the

    Contract Documents, the more stringent requirement shall apply.

    5. Equipment Manufacturer Qualifications

    5.1.The Manufacturer of the assembly shall be the manufacturer, or an OEM

    company certified by the Manufacturer, of the components used within theassembly.5.2.The Manufacturer shall be approved and registered with the International

    Standards Organization in the applicable ISO 9000, ISO14000 or ISOproduct manufacturing category.

    5.3.The specified/acceptable Manufacturer requesting approval to substitute anew product line and Manufacture of an alternate shall have produced

    similar electrical equipment with a sufficient installation base for a minimumperiod of five (5) years. When requested by the Engineer an acceptable list

    of installations (installation base) with similar equipment shall be provided

    demonstrating compliance with this requirement.5.3.1.The Manufacturer of the new product or alternate without the sufficient

    installation base for the above stipulated time period shall:

    (a)Provide in addition to the standard warranty, the extended warrantyand technical support for minimum of five (5) years without increase

    in the equipment price and without additional incremental cost to theOwner.

    (b)Provide access to the Engineer of the standard installation, functional

    and operational drawings for the complete assembly, sub-assemblies

    and components, as well as the copies of the required regulatorycertificates and test results.

    (c)The Manufacturer shall arrange a visit to the manufacturing and designfacilities for inspection and verification. In addition, the Manufacturer

    shall be responsible for transportation, meals, lodging and incidental

    cost (i.e. out of pocket allowance equivalent to the applicable

    Government of Kenya rates for the country of origin) for up to six (6)

    Engineer's representatives for a period not less than 2 days excludingtravelling days.

    6. Specified, Acceptable and Alternative Manufacturers, Equipment and

    Materials

    6.1.Naming a specific manufacturer, equipment or material does not implyacceptance of their standard products nor relieve them from meeting these

    specifications in their entirety.

    6.2.Materials and equipment scheduled and/or specified in the Contract

    Documents have been selected to establish a performance and qualitystandard, and, in some instances, a maximum dimensional standard. In most

    cases, acceptable manufacturers are stated for any material or equipment

    specified by manufacturer's name and model number. The Schedule of Prices

    may be based on materials and equipment supplied by any of the

    manufacturers named as acceptable for the particular material or equipment.If acceptable manufacturers are not stated for a particular material orequipment, base the Schedule of Prices on material or equipment supplied by

    the specified manufacturers.

    6.3.If materials or equipment supplied by a manufacturer named as acceptable

    are used in lieu of the manufacturer specified, be responsible for ensuringthat the substituted material orequipment is equivalent in performance and

    operating characteristics to the specifiedmaterials or equipment, and, it is tobe understood that any additional costs, and changes to associated or

    adjacent work resulting from provision of materials supplied by a

    manufacturer other than the specified manufacturer is included in theSchedule of Prices. In addition, in equipment locations where equipmentnamed as acceptable is used in lieu of specified equipment and the

    dimensions of such equipment differs from the specified equipment,prepareand submit for review, accurately dimensioned layouts for the locations

    affected.6.4.In addition to the manufacturers specified or named as acceptable,

    alternative manufacturersof materials or equipment may be proposed to the

    Engineer for acceptance prior to closing date, listing in each case a

    corresponding credit for each alternative proposed, however, theSchedule ofPrices must be based on equipment or materials specified or named as

    acceptable.6.4.1.At least two (2) weeks prior to closing date, the

    manufacturers/suppliers of alternate materials and equipment shall

    submit certified documentation to the Engineer showing itemized

    compliance to these specifications and the manufacturers specific

    experienceto the proposed equipment including a list showing details ofthe proposed installationand application.

    6.4.2.Acceptance of alternates will be solely at the discretion of the Engineerand Owner.

    6.4.3.The manufacturer/supplier submitting a proposal for the substitution ofthe specified oracceptable product, with an alternate material or product,

    will be allowed to submit tothe Engineer for evaluation where they aredeemed an acceptable product supplier by the Owner. All associated

    engineering fees to review the submission of alternate material, andequipment and installation methods for compliance to the specifications

    is the direct responsibility of the party submitting the Alternate.6.4.4.There will be no increase in the Schedule of Prices by reason of any

    changes to associated equipment, mechanical and/or electrical, required

    by acceptance ofproposed alternatives.

    6.4.5.Provide the Appendix to the Schedule of Prices with the

    manufacturers information required for the major materials andequipment to be supplied. Note that the names of manufacturerson thelist must be one of the names stated as acceptable for the particular

    products, unlessprior written permission has been given for use ofproducts by alternative manufacturers.

    7. Warranty

    7.1.The Manufacturer shall warrant the equipment in strict accordance with the

    ContractDocuments and free from all defects in materials and assemblies for

    a period of one (1) year minimum from the date of an acceptance of thecommissioning report, unless otherwise stated in the specific sections.Indicate any no-charge extended warranty including theconditions of such

    warranty.7.2.The Manufacturer or manufacturers certified technical representative shall

    repair and/or replace any defects that appear in equipment and assemblieswithin the warranty period, dueto the ordinary wear and tear, and expected

    environmental agents, without additional expense or deductibles to the

    Owner, such as travel time, service hours, repair parts cost, etc. Where such

    defects occur, be responsible for all costs incurred in making the defective equipment and assemblies good, including repair or replacement of building

    finishes, other materials, or damage to other equipment caused by suchdefects, or by subsequentreplacement and repairs.

    8. Shop Drawings and Product Data

    8.1.The term "shop drawings" means drawings, diagrams, illustrations,

    schedules, performance charts, brochures and other data which are to beprovided to illustrate details of a portion ofWork.

    8.2.Submit shop drawings as indicated in individual specification sections.8.2.1. Indicate materials, methods of construction and attachments or

    anchorages, erectiondiagrams, connections, explanatory notes and otherinformation necessary for completion of Work. Where articles or

    equipment attach or connect to other articles orequipment, indicate thatsuch items have been coordinated, regardless of Section under which

    adjacent items will be supplied and installed. Indicate cross references to

    design drawings and specifications.

    8.2.2.Accompany submissions with transmittal letter, containing: date,

    project title andnumber, Manufacturers/Contractor's name and address,identification and quantity of each shop drawing, product data andsample, and other pertinent data.

    8.2.3.Endorse each shop drawing copy to be in accordance with specificationand contract documents, including your company name, the submittal

    date, and signature. Shop drawings that are received and are notendorsed, dated and signed will be returned forre-submittal. The number

    of copies of shop drawings will be as later directed.

    (a)Provide three (3) copies of each shop drawing, two (2) for the

    Engineers use and one (1) to be returned to the contractor for

    copying and distribution.(b)Also submit non-editable electronic copy of shop drawings in

    AutoCAD DWF, or PDF format.

    (c)Also submit electronic copy in PDF format of product data sheetswhere shop drawings will not be prepared due to standardized

    manufacture of product. Supplement standard information to providedetails applicable to project anddelete information not applicable to

    project for clarity and ease of reading.

    8.3.Submissions shall include details as applicable including fabrication; layout,

    elevation and plans, showing dimensions, including identified fielddimensions and clearances; setting or erection details; capacities and

    operating weight; performance characteristics; standards; relationship toadjacent work and technical data sheets.

    8.4.Allow fifteen (15) days for Engineers review of each submission. The

    Engineer will review shop drawings and will indicate his review status by

    stamping shop drawing copies.

    8.4.1. "Reviewed" or "Reviewed as Noted" - If the Engineer's review of ashop drawing is final, the Engineer will stamp the shop drawing

    "Reviewed" or "Reviewed as Noted" (appropriately marked). Afterwhich fabrication and installation of Work may proceed.

    8.4.2."Revise and Resubmit" - If the Engineer's review of a shop drawing isnot final, the Engineer will stamp the shop drawing "Revise and

    Resubmit", mark the submission with comments, and return thesubmission. Revise the shop drawing in accordancewith the Engineer's

    notations and resubmit.

    8.4.3.It is understood that the following is to be read in conjunction with the

    wording on theEngineer's shop drawing review stamp applied:This review by the Engineer is for the sole purpose of ascertaining

    conformance with the general design concept. This review does not

    mean that the Engineer approves the detail design inherent in the shop

    drawings, the responsibility for which remains with the Manufacturer,

    and such review does not relieve the Contractor of theresponsibility forerrors or omissions in the shop drawings or of their responsibility for

    meeting all requirements. Contractor is responsible for dimensions to be

    confirmed and correlated by them at the job site, for information thatpertains solely to fabricationprocesses or techniques of construction and

    installation, and for co-ordination of thework of all sub-trades.

    8.5.Make changes in shop drawings as the Engineer may require, consistent with

    ContractDocuments. When resubmitting, notify the Engineer in writing ofany revisions other thanthose requested.

    8.6.Adjustments made on shop drawings by the Engineer are not intended to

    change Contract Price. If adjustments affect value of the Work, state such inwriting to the Engineer prior toproceeding with the Work.

    8.7.If upon review by the Engineer, no errors or omissions are discovered or if

    only minorcorrections are needed, 1 copy in PDF format or hard copy willbe returned. The Contractor is responsible for distribution of the required

    numbers of hard copies, after which fabrication andinstallation of the Workmay proceed.

    8.8.No purchase, supply or delivery to be made of any product without the

    required shop drawingbeing reviewed and approved by the Engineer.

    9. Materials and Equipment

    9.1.Provide all materials and equipment including incidentals necessary for a

    complete andworking system to the satisfaction of the Engineer.

    9.2.Unless otherwise specified, all materials and apparatus for permanent

    installations are to be new. All expressly permitted used material andequipment shall be tested and certified priorto use.

    10.Manufacturers QualityControl and Factory Testing

    10.1. All assemblies and sub-assemblies shall be inspected and/or tested for

    conformance to the manufacturers engineering and quality assurancespecifications. The specifications shall be available to the Engineer upon

    request.10.2. All factory tests required by the latest NEMA/EEMAC, ANSI and or

    IEEE standards shall be performed for complete assembly, includingoperation of all power andcontrol components.

    10.3. A certified test report of all production tests shall be available to theEngineer upon request.

    11.Installation

    11.1. The generator set is to be installed by the Manufacturer or approved

    General Contractor, to be engaged by the Manufacturer11.2. The Manufacturer will coordinate delivery, storage, start-up andcommissioning, andinstallation with the Contractor.

    11.3. The Manufacturer will provide the services of the factory trainedtechnician(s) to provide start-up,commissioning, and technical assistance to

    the Contractor during installation.

    GENERATOR SPECIFICATIONS

    1. General

    This section includes specifications for products, specific criteria andcharacteristics, methods and execution for diesel-engine-driven generator set. The

    generator sets shall be designed and configured to include;1.1.Vandal proof enclosure with powder coated steel or aluminium surface

    3.1.Starting and continuous rating as indicated above are guidelines. The

    generator shall be sized as follows:

    3.1.1.The generator set shall be capable of sustaining a minimum of 90% ofrated no load voltage

    3.1.2.Assume all pre-load and post-load to be modelled as a constantimpedance load

    3.2.Voltage regulation shall be 0.5%.for any constant load between no load andrated load for both parallel and non-parallel applications; random voltage

    variation with any steady load from no load to full load shall not exceed0.5%.

    3.3.Frequency regulation shall be isochronous from steady state no load tosteady state rated load. Random frequency variation with any steady load

    from no load to full load shall no exceed 0.25%.3.4.Generator set shall be capable of single step load pick up of 100% full load,

    power factor, and at operating temperature.

    3.5.The generator set shall be capable of sustaining a minimum of 80% of rated

    no load voltage with the starting capability kVA at near zero power factor

    applied to the generator set.3.6.The alternator shall produce a clean AC voltage waveform, with not morethan 5% total harmonic distortion, 3% in any single harmonic, without 3rd

    order harmonics or their multiples, measured line to neutral, at full load.Telephone influence factor shall be less than 40.

    3.7.The generator set shall be certified by the engine manufacturer to be suitablefor use at the installed location and rating, and shall meet all applicable

    exhaust emission requirements at the time of commissioning.3.8.The generator set shall share real and reactive load proportionally within

    3% with all other generator sets in the system.

    3.9.The time required to automatically start, accelerate to rated speed andvoltage, synchronize to the system bus on a normal power failure shall notexceed 15s.

    4. Construction

    4.1.The engine-generator set shall be mounted on a heavy-duty steel base tomaintain alignment between components. The base shall incorporate a

    battery tray with hold-down clamps withinthe rails.

    4.2.All switches, lamps, and meters in the control system shall be oil-tight and

    dust-tight. There shall be no exposed points in the control with the dooropen.

    5. Connections

    5.1.The generator set load connections shall be composed of tin-plated copper

    bus bars, drilled to accept mechanical or compression terminations of thenumber and type as shown on the drawings. Sufficient lug space shall be

    provided for use with cables of the number and size as shown on thedrawings.

    5.2.Power connections to auxiliary devices shall be made at the devices, withrequired protectionlocated at a wall-mounted common distribution panel.

    5.3.Generator set control interfaces to other system components shall be madeon a common,permanently labelled terminal block assembly.

    6. Engine and Equipment

    6.1.The engine shall be fan cooled 4-stroke-cycle diesel engine. The horsepowerrating of the engine at its minimum tolerance level shall be sufficient to drivethe alternator and all connected accessories.

    6.2.An electronic governor system shall provide automatic isochronousfrequency regulation. The governing system dynamic capabilities shall be

    controlled as a function of engine coolant temperature to provide fast, stableoperation at varying engine operating temperature conditions. The control

    system shall actively control the fuel rate and excitation as appropriate to thestate of the generator set. Fuel rate shall be regulated as a function of

    starting, accelerating to start disconnect speed, accelerating to rated speed,

    and operating in various isochronous or parallel states.6.3.Skid-mounted radiator and cooling system rated for full load operation in

    40C ambient as measured at the generator air inlet, based on 0.12kPa

    external static pressure. Radiator shall be sized based on a core temperaturewhich is 10C higher than the rated operation temperature, or prototype

    tested to verify cooling performance of the engine/radiator/fan operation in acontrolled environment. Radiator shall be provided with a duct adapter

    flange. The cooling system shall be filled with a 50/50 ethylene glycol/water

    mixture by the equipment manufacturer. Rotating parts shall be guarded

    against accidental contact.6.4.Electric starter(s) capable of three complete cranking cycles without

    overheating.6.5.Positive displacement, mechanical, full pressure, lubrication oil pump.

    6.6.Full flow lubrication oil filters with replaceable spin-on canister elements

    and dipstick oil level indicator.

    6.7.An engine driven, mechanical, positive displacement fuel pump. Dual fuelfilters with on-line replaceable spin-on canister element. Fuel cooler, suitable

    for operation of the generator set at full rated load in the ambienttemperature specified shall be provided if required for operation due to the

    design of the engine and the installation.6.8.Flexible supply and return fuel lines.

    6.9.Replaceable dry element air cleaner with restriction indicator.6.10. Vibration isolators, spring/pad type, quantity as recommended by the

    generator set manufacturer. Isolators shall include seismic restraints to Zone1 level.

    6.11. Engine mounted battery charging alternator, with solid-state voltageregulator.

    7. Automatic Transfer Switchboard

    7.1.A fully automatic change-over system must be provided to isolate the mains

    supply and connect the standby set to the outgoing feeder in case of a mains

    failure and reverse this procedure on return of the mains. The AutomaticTransfer Switchoard shall include:7.1.1.Circuit breakers on both the normal and transfer sides,

    7.1.2.3 Phase utility voltage sensing adjustable from 65 to 100%, withadjustable time delay 10 to 60 seconds,

    7.1.3.Return to normal time adjustable 010 minutes,

    7.1.4.Engine cool-down timer adjustable 010 minutes,

    7.1.5.Engine start contact,

    7.1.6.Utility position SCADA contacts 2N.O. and 2 N.C,

    7.1.7.Transfer position SCADA contacts 2N.O. and 2 N.C,

    7.1.8.Transfer input which upon closure of a dry contact (e.g. from SCADA)will cause the transfer switch to move to the transfer position,

    7.1.9.A four position selector marked AUTO, MANUAL, TEST, and

    OFF. With the selector on:

    7.1.9.1. AUTO, the generator shall automatically start and stop,

    according to the mains supply being available or not.

    7.1.9.2. TEST, it shall only be possible to start and stop the set with

    the pushbuttons, but the running set shall not be switched to the

    load.

    7.1.9.3. MANUAL, the generator must take the load when started with

    the pushbutton, but it must not be possible to switch the set on to the

    mains, or the mains onto the running set.

    7.1.9.4. OFF, the generator shall be completely disconnected from the

    automatic controls, for cleaning and maintenance of the engine.

    7.2.The switchboard shall be equipped with an on-load isolator to isolate the

    mains and a manually operated on-load by-pass switch, which shall either

    connect the incoming mains to the automatic control gear or directly to the

    outgoing feeder. In the latter position the automatic control gear, including

    the main contractors, shall be isolated for maintenance purposes. It shall not

    be possible to start the engine except with the selector switch in the TESTposition. It is required that this by-pass switch and mains isolator be

    mounted away from the automatic control gear, in a separate compartment

    either on the side or in the lower portion of the switchboard cubicle, and that

    the switches operated from the front of the compartment.

    8. Coolant Heater

    8.1.Engine mounted, thermostatically controlled, coolant heater(s) for each

    engine, designed to provide proper venting of the system.8.2.The coolant heater to be installed on the engine with high temperaturesilicone hose connections; steel tubing wherever the length of pipe run

    exceeds 300mm; using quick disconnect/automatic sealing couplers allowthe heater element to be replaced withoutdraining the engine cooling system

    or significant coolant loss.8.3.Provide 120Vac or 24Vdc thermostat, installed at the engine thermostat

    housing with an AC power connection box for a single AC powerconnection to the coolant heater system.

    8.4.The coolant heater(s) shall be sized as recommended by the engine

    manufacturer to warmthe engine to a minimum of 40C in a 0C ambient, incompliance with NFPA110 requirements, or the temperature required forstarting and load pickup requirements.

    9. Exhaust Silencer

    9.1.Provide exhaust silencer(s) for each engine of size and type as

    recommended by thegenerator set manufacturer and approved by the enginemanufacturer. The mufflers shall be critical grade (25-35dB attenuation).

    Exhaust system shall be installed according to the engine manufacturersrecommendations and applicable codes and standards.

    10.Battery and Charger

    10.1. Provide parallel redundant battery chargers for each generator set

    battery bank. Generator sets incorporating two battery banks shall beprovided with two charger sets separated by diodes so that a fault on one

    bank cannot affect the other. Charger alarm outputs shall be connected inparallel.

    10.2. Chargers shall be compliant with the requirements of EN61000-4-5 forvoltage surge resistance; EN50082-2 for immunity; EN61000-4-2 for ESD;

    EN61000-4-3 for radiated immunity; ANSI/IEEE C62.41 category B andIN61000-4-4 for electrically fast transient; EN61000-4-6 for conducted

    emissions; and FCC Part 15 Class A for radiated emissions.10.3. The charger shall be capable of charging a fully discharged battery

    without damage to the charger or battery. It shall be capable of returning afully discharged battery to fully charged condition within 24 hours. The

    charger shall be CSA/CUL labelled with the maximum battery amp-hourrating that can be recharged within 24 hours.

    10.4. The charger shall incorporate a 4-state charging algorithm, to provide

    trickle charge rate to restore fully discharged batteries, a bulk charge rate to

    provide fastest possible recharge after normal discharge, an absorption state

    to return the battery to 100% charge, and a float stage to maintain a fullycharge battery and supply battery loads when the generator set is notoperating. In addition, the charger shall include an equalization timer.

    Charge rates shall be temperature compensated based on the temperaturedirectly sensed at the battery.

    10.5. The DC output voltage regulation shall be within 1%. The DC outputripple current shall not exceed 1A at rated output current level.

    10.6. The charger shall include the following features10.6.1. Multiple-line alphanumeric display with programming keys to

    allow display of DC output ammeter and voltmeters (5% accuracy or

    better), display alarm messages, and perform programming;10.6.2. LED indicating lamp(s) to indicating normal charging condition

    (green), equalize charge state (amber), and fault condition (red);

    10.6.3. AC input over-current, over-voltage, and under-voltageprotection;

    10.6.4. DC output over-current protection;10.6.5. Alarm output relay;

    10.6.6. Corrosion resistant aluminium enclosure.

    10.7. Starting and Control Batteries shall be calcium/lead antimony type,

    12/24Vdc, sized as recommended by the engine manufacturer, complete withbattery cables and connectors.

    11.Fuel Tank

    11.1. Provide 8 hours capacity in-skid, factory assembled fuel transfer tank

    for each generator set, made of corrosion resistant steel with weldedconstruction, and pressuretested to 3 PSI. The fuel transfer day tank shall be

    a standard product of the manufacturer ofthe engine-generator set, equippedfor automatic unattended operation.

    11.2. The day tank shall incorporate an integral fuel pump and motor withminimum 10m lift. Provide a hand operated pump to bypass the motor

    driven pump and valves, foremergency use. The fuel day tank control shallbe provided with On/Off/Emergency Run switch; Test and Reset push

    buttons; AC circuit breaker; DC circuit breaker; and relay contacts andLEDindicator lamps for ready status (supply & control power available),

    high/low fuel alarm, low fuel shutdown, fuel overflow alarm, and pumprunning.Provide an overflow/rupture basin for the day tank with a minimum

    capacity of 150% of the day tank volume. Include an overflow alarm toindicate fuel in the basin.

    12.AC Generator

    12.1.

    The AC generator shall be; synchronous, four pole, 2/3 pitch,revolving field, drip-proof construction, single pre-lubricated re-greasablebearing, air cooled by a direct drive centrifugal blower fan, and directly

    connected to the engine with flexible drive disc. All insulation systemcomponents shall meet temperature limits for Class F insulation system.

    Actual temperature rise measured by resistance method at full load shall notexceed ratedtemperature rise.

    12.2. The alternator shall be capable of delivering rated kVA output at ratedfrequency and powerfactor, at any voltage within 5% of rated voltage.

    12.3. A permanent magnet generator (PMG) shall be included to provide a

    reliable source of excitation power for optimum motor starting and shortcircuit performance. The PMG and controls shall be capable of sustainingand regulating current supplied to a single phase or three phase fault at

    approximately 300% of rated current for not more than 10s.12.4. The sub-transient reactance of the alternator shall not exceed 0.12 per

    unit.12.5. The alter
