The General Meeting of TANSEA was held on 30.03.2013 at 10.30 AM in Institution

of Engineers (India), Tamil Nadu, State Centre, Chennai-600 005. Er. K.Ramalingam,

president/TANSEA, presided over the meeting. Er.A.Veerappan, Secretary / TANSEA

welcomed the gathering.

Er. A.Veerappan introduced Dr.M.Kumaresan & his team to the audience and requested

Dr.M.Kumaresan to deliver the lecture on “Parkinsons Disease and Dementia-

Virtual Reality Therapy” Dr.M.Kumaresan was honoured by presenting shawl by

Er.K.Alagiakrishnan on behalf of TANSEA.

Dr. M.Kumaresan delivered the lecture on ñøF «ï£Œèœ, ͬ÷¬ò àKˆî™, G¬ùõ£Ÿø™

ñŸÁ‹ ÜPõ£Ÿø™ ðŸP effectively by way of his education & experience gained from the

eminent doctors in abroad. This lecture was very useful and the audience have very

much appreciated the same. Then Dr.M.Kumaresan introduced his team of technicians

especially Tmt. Rajeswari who is efficient in practical demonstruction in treating the

above mentioned diseases by way of physical exercise. Many of our engineers did the

exercise which was really interesting. A memento was presented to Tmt.Rajeswari in

token of appreciating her talent by Er.D.Sivalingam former CE on behalf of TANSEA.

Er. A.Veerappan, Secretary/TANSEA informed that he attended a meeting in the Hotel

Asoka which was organized by the PURPU & TANSEA regarding the protection of water

bodies in TN.

The following information was also shared by Er.A.Veerappan.

i) The book titled on jkpof ghrd tuyhW written by Dr.P.Gomathynayagam (Late) is

very useful one and the cost of the book is Rs.70/- This book is verywell available.

ii) Er. S.M.Rathnavel of Madurai & Er.S.N.Kallapiran have written & published a book

“ghrd Vhpfspd; ghuk;ghpaj;ijj; Njb”

Two minutes silence was observed to mourn the demise of Er.S.Kalimuthu, a Senior

member of Madurai Branch.

The short film and handbook on Cauvery waters Dispute & solutions would be released

by the TANSEA during June 2013.

As informed earlier the TANSEA has organized a foreign tour to China and Dubai from

May 10 to May 18 2013 and about 30 Members and their family are participating in the

above Tour.

Er. K.Natarajan, Vice-President /TANSEA informed that the Govt. raised the pensioners

family security fund from Rs.35000 to Rs.50000/- many of our retired engineers will

be getting increased pension (retired prior to 1.1.2006) due to the supreme court

judgement on parity of pension. He also informed that the PPO will deduct income tax

from pension from April 2013 as per the request of the Income Tax department.

Er. K.Ramalingam, president / TANSEA appreciated Er.S.M.Ratnavel & Er.S.N.Kallapiran

for their excellent book on irrigation tanks in Tamilnadu.

Er.N.Chinnappan, MD, SEENHOPP informed that the three plots are available for sale

in Athoor Village & Guduvancherry. He has requested the housing project members to

collect their dividend which is due to them.

Er. D.Sivalingam, Former Spl. CE., PWD has contributed the entire expenditure

of the TANSEA Meeting on 30.03.2013 to a tune of Rs.9000/- and Er.N.Selvaraj

Treasurer presented ponnadai to Er.D.Sivilingam and thanked him for his fine gesture.

Er.N.Selvaraj further informed that Er.M.Devanathan has consented to contribute

Rs.10000/- for the entire expenditure of the next meeting and Er.V.Balusamy agreed

to contribute for the second meeting and thanked them for their fine gesture.

Er.V.Balusamy desired that his two books titled as 1) rpyg;gj;jpfhuj;jpy; Mly; muq;fk; and

2) fhtphp ePh; gpur;ridAk; jPh;T fhz jkpofj;jpd; Kaw;rpAk; may be released in the TANSEA

Meeting. Er.A.Veerappan Secretary / TANSEA readily accepted.

Er. S.M.Arasu informed that he proposed to invite proposal from our engineers

regarding the solution for modernizing the Coovam river. He has also suggested to form

a committee comprising of Er.K.Ramalingam, Er.V.Balusamy & Er.S.Krishnamurthy to

select the best proposal for which a honorarium of Rs.20,000/- will be granted. This

was overwhlingly welcomed by the audience.

In response to the request made by Er.A.Veerappan Secretary / TANSEA & Er.

N.Selvaraj, Treasurer / TANSEA many Senior Engineers paid towards Spl. Contribution

in the meeting itself. The Secretary and the Treasurer thanked the Contributors for

their spontaneous response.

Er.D.Arumugam JS/TANSEA before delivering vote of thanks desired the TANSEA to

convene a meeting for EEs, SEs and CEs of PWD for better working and Er.A.Veerappan,

Secretary assured to do the same. Then Er. D.Arumugam thanked one and all and the

meeting came to conclusion at 1.30 pm with Lunch.

STUDY TOUR TO CHENNAI METRO RAIL ON 20.04.2013

TANSEA, at the initiative and efforts of Er.K.Natarajan, Our Senior Vice President and

Er.A.Veerappan, arranged for Half a day Study Tour to Chennai Metro Rail on 20.04.2013FN.

Er.V.Somasundaram, Chief General Manager, CMRL has been kind enough to permit 32

Senior Engineers and their family members for the above tour.

Er. Venkata Ramana, Er.Murugadasan, Er.Vendhan, Er.Paranikumar & CMRL staff at Thiru.

Vi.Ka Park, Shenoy Nagar, Chennai - 600 029 arranged and assisted us in the above study

tour.

It started with a warm reception at Thiru Vi ka park site and 30 minutes Power Point

presentation about the CMR project and also the progress made at this segment with

clarifications.

Then it was followed by field on the spot visit inside the lined tunnel for 90m (a depth of

20m below EGL) and to the tunnel boring machine with all protective cover in 4 batches

(every batch took about 20 minutes) and completing at 1.10pm. We sincerely thanked all

the CMRL staff for their fine gesture.

The participants had lunch in the Adayar Anandha Bhavan - A2B and dispersed to their

destination by 1.45 PM. An amount of Rs.300/- was collected from each participant towards

vehicle transportation, Lunch and other postal expenditure.

There is also a proposal with TANSEA to organise one more study tour to CMRL after 2

months in deference to the wishes of our Senior Engineers.

“A Pomegranate keeps the Cardiologists away”It is my earnest desire that the infor-mation may be widely circulated. Be-cause bypass surgery is a safer opera-tion from the point of view of surgeons and much safer than any other opera-tions and fetches a great lot of money. This the reason why bypass surgery is very much encouraged and doctor’s community is averse to any other rem-edies which may be used to avoid this operation.

Two things are full of benefits for the human being, lukewarm water and pomegranate. Pomegranate is a seasonal fruit in Pakistan so I tried an experiment with dried pomegranate seeds(DRY ANARDANA), prepared a decoction boiling the fistful of dried seeds in half litre of water for 10 minutes, squeezed the seeds, strained the decoc-tion and advised those patients suffering from painful angina to use a glass of lukewarm decoction on an empty stomach in the morning, amazing result was observed, the de-coction of dried pomegranate seeds worked like a magic, the feelings of tightness and heaviness of chest and the pain had gone,

It encouraged me to try more experiments on all types of cardiac patients so I tried other experiments on patients who were suffering from painful angina, coronary arterial blockage, cardiac ischemia (insufficient blood flow to the heart muscle) etc, waiting for a bypass surgery, the same lukewarm decoction was used empty stomach in the morning, the patients experienced quick relief in all symptoms including painful condition

In another case of coronary arterial blockage the patient started using half glass of fresh pomegranate juice everyday for one year, although all symptoms were completely re-lieved within a week but he continued taking it for a whole year, it completely reversed the plaque build-up and unblocked his arteries to normal, the angiography report con-firmed the evidence, thus decoction of dried pomegranate seeds, fresh pomegranate juice or eating a whole pomegranate on empty stomach in the morning proved to be a miracle cure for cardiac patients,

ALTERNATE DESIGN FOR FOOT OVER BRIDGE-RESPONSEToThe Managing Director,I.T. Experess way Ltd.,Sindur Partheon Plaza, 2nd Floor, 346, Pantheon Road, Egmore, Chennai-600 008.

I had the occasion to observe the usage of the foot over bridge at Tiruvanmiyur M.R.T.S. east of Tidel Park in I.T.Corridor as general manager of the project. More number of people working in TIDEL and nearby offices alight at Tiruvanmiyur MRTS. Good number of them were reluctant to use the F.O.B, as they have to climb up 5.50 metre up and another 5.50m down. Instead they will cross the road climb up the centre median. Erection of steel barricads at the point did not stop them. Later was added a flight from the platform (MRTS) to the landing of the F.O.B., which increased the usage.

If underground sub-way is provided they have to climb down 2.40m + slab thickness say 3.00m only. We wanted to provide a sub-way at Sholinganallur junction. But the ducts for rainwater, electrical cables, were in place and Chennai Metro water had to run their water lines and sewer lines. Because of this sub-way proposal could not be implemented.

Er.C.Anantharaman, a member of Tamilnadu PWD Senior Engineers Association has visualised a good design, which I believe will be very convenient to the public as they have to climb down 1.2m only (i.e.) half of standard subway (ref end) compared to F.O.B. this is very cost effective.

The width of sub-way (Refer enclosure) can be decided taking into account security concerns. As

TNRDC may execute the widening of corridor from Siruseri, I believe this will be of use.

WRCP (Water Resources Consolidation Project) implementation was sanctioned in GO MS No.530 dated 03-07-95 and 4 regions were formed under water resources organization. The G.O and details of headquarters and staff relocations are enclosed.

2007-2008 Tamil Nadu has embarked on the Rs.2,547-crore World Bank-aided Irrigated Agriculture Modernization and Water bodies Restoration and Management (IAMWARM) project and it is expected to be completed by 2010. Budget for 2007-08 is Rs.714.94 crores.

The project covers 6.17 lakh hectares spread over 63 sub-basins. There are in all 127 sub-basins in the state. In the first year, 2007-08, nine sub-basins covering 2.94 lakh hectares at an investment of Rs.714.94 crore were taken up, according to the Public Works Budget. In 2008-09, 16 more sub-basins spread over 80,000 hectares would be taken up with an outlay of Rs.585 crores. The balance 38 sub-basins would be taken up in 2009-10.

“The project aims to improve the service and delivery of irrigation systems and productivity of irrigated agriculture with effective management of integrated water resources in a sub-basin frame work” as narrated in the Policy Note of Department tabled in the Assembly.

The Project has four specific components and seven departments are involved in its implementation. The five components are : Irrigation systems modernization in a sub-basin frame work, agricultural intensification and diversification, institutional modernization for irrigated agriculture, and water resource management.

Water resources organization, agriculture department, horticulture department, Tamil Nadu Agriculture University, Agriculture marketing, Animal husbandry department and Fisheries department are agencies responsible for its implementation.

TASK FORCE ON CAUVERY DELTA MODERNISATION

Tamil Nadu government has set up a task force, headed by well-known irrigation expert Er. A.Mohanakrishnan, for modernising Cauvery delta irrigation system. The force is expected to submit its report before July 2010. The government has also initiated a performance evaluation study’s of some of the major irrigation projects in the state to increase water use efficiency to 60% from the present 40-45%. To begin with, the study would be in Cauvery delta, Vaigai and Tambaraparani irrigation schemes.

That major irrigation systems in the Cauvery delta like Lower Coleroon needed extensive improvements of infrastructure and modernisation of existing irrigation structures for optimum utilization of Cauvery waters.

Though modernisation was long overdue, it could not be taken up as Karnataka opposed the move on the plea that the Cauvery water dispute was pending.

Now that the Cauvery dispute has reached the final stage, the government thought it fit to keep ready modernization schemes to be launched once the final orders are published.

2008-2009 Budget provision is Rs.672 crores.

there is not one of the biographies of which its subject was not worthy of the honour of

permanet record. India has afforded unequalled opportunities for the display of the highest

altruistic qualities of which our race is capable. “Englishmen and Englishwomen will work, and

have worked, for India until they drop.” In the foremost rank of such Englishmen, Arthur

Thomas Cotton stands second to none. It is no biogrpaher’s enthusiasm which declares

that he is, without doubt, the greatest benefactor of British birth the Indian people have ever

known. More people have had enough to eat day by day, have worn sufficient and comfortable

clothing, have lived in good houses, have had something to spare for the conveniences of life,

because Sir Arthur Cotton laboured for India, than can be placed to the credit of any other

man of whom I have read or heard. Again, I say this is no biassed eulogium. In chapter XIV

of this work will be found, in statistical form, so far as that is possible, what Arthur Cotton’s

work representes to the IndianGovernment and to the people themselves. To that chapter I

1900) are the scenes of awful suffering, had Sir Arthur Cotton’s ripe experience not been

overborne by administrative jealousy and by official unacquaintance with what really could be

done by means of irrigation in almost every part of India.

• In the homes of many thousands of families in India, living in comfort, “Cotton” with what

he did, is an honoured, almost worshipped, entity; in Britain, it is probable that, owing to his

manifold activities by voice and pen throughout many years, no other Anglo-Indian has ever

been so widely known. A discussion recently took place in a London assemblage on the causes

of famines in India. Incidentally, Sir Arthur Cotton’s name was mentioned. Subsequently, one

of the leading public men of the metropolis remarked : “Sir Arthur Cotton’s name has been

mentioned. We, here, know Sir Arthur Cotton; we believe in Sir Arthur Cotton and in what he

did for India. He came to us here, and he told us what India needs; we want to see his policy

prevail.”

• What Arthur Cotton did in India was sorely needed. What he woulds have done is still more

sorely needed.

• In one of his letters, quoted later, Sir Arthur Cotton asks his correspondent whether the

people, to whom reference was made, could really pronounce the short “o”, adding that in

Northern Madras his name was pronounced as though the “o” were long.

• Because his counsel was not followed, again and again have destitution and hideous suffering

overtakesn vast mutlitudes, while the progress of one-sixth of the population of the whole

would has been arrested. What has been will again be. A few years hence, an even more

disastrous famine than that of to-day will afflict our Indian fellow-subjects, a continuing

decadence of country and people will prevail, unless the readers of this biography, and the

English people generally, determine that Sir Arthur Cotton’s works shall follow him.

• Therefore is it that this biography is offered to Arthur Cotton’s countrymen and countrywomen,

with the hope that its countrymen and countrywomen, with the hope that its narrative of

his work and teaching will carry conviction to many minds and produce such beneficent

consequences that the present sorrowful condition of India’s population shall, so far as

widespread irrigation can ensure this, become a matter of regretful historical interest only.

be a source of strength and wealth and credit to us as a nation, it is due to

THE NATIONAL WATER POLICY - 2012AN AFFRONT ON FEDERALISM -Justice Dr. A. K. RAJAN

1. As per the scheme of the Constitution of India, “water” is a State subject; List II Entry 17 reads, as follows:-

“Water, that is to say, water supplies, irrigation, and canals, drainage and embankments water storage, and water power subject to the provisions of entry 56 of List I ”. Further ‘Agriculture’, falls under entry 14 List I I; and ‘right over land ‘falls under Entry 18 List II. Entry56 List I read thus: -

“Regulation and development of inter-State rivers, and river valleys to the extent of which such regulation and development under control of the Union is declared by Parliament by law to be expedient in public interest.”

A combined reading of the above entries would make it clear that, power to make law on water related matters, including the ground water,is vested with the States: It is made subject only to matters related to “inter-state rivers, and “ river valleys “. It also clear that the power to make law by the Parliament is limited, by the constitution, to make law only on inter-state rivers and river valley systems..

1.2; That is, the Union Govt. has power to make law or to regulate only matters relating to inter – state rivers or river valleys. With respect to all other matters, outside those aspects, are beyond the legislative competency of the Union. Therefore, on matters relating to water- supply, irrigation, canals, ground- water, drainage etc. only the States have the legislative competency to make law or to regulate.

2. While so, surprisingly, the Union Govt. has framed the ‘National water policy 2012’, (NWP) as recommended by the National Water Board (NWB). In view of the distribution of legislative powers by the Constitution, as stated above, National Water Policy can be made by NWB only if it is relatable to inter-state rivers and/ or river valleys. But the said policy made by NWB and approved by the Union Cabinet goes beyond the executive or legislative power conferred by the Constitution on the Union Govt. Therefore, the NWP as recommended by the NWB, except as regards inter-state rivers and river valleys is ultra vires the Constitution

3: The object of NWP is ‘creation of a system of laws and institutions and for a plan of action with a unified National perspective’.

The NWB is of the view, inter alia, that

i) water is need to be managed as a common pool community resource; ii)water may be treated as ‘economic goods; iii) an agricultural system should be evolved, to economise the water use and bring maximum efficiency and to avoid wastage; iv) water quality and quantity should be managed in an integrated manner; v) the allocation and use of water should be governed by the principle of equity and social justice;

The above aspects appear to be in the nature of some directions issued by the Union to States on matters relating to the regulation on use of water. But as per the Constitutional scheme, relating to Administrative relations between the Union and the States, such administrative directions cannot be issued by the Union Govt. Art. 257 (1) provides that the “the executive power of the Union shall extend to the giving of such directions to a state as may appear to the Govt. of India to be necessary for the purpose of” ensuring the executive power of the State are exercised in such a manner “not to impede or prejudice the exercise of executive power of the Union”. Art. 257(2) provides that Union govt. can give directions to a State on the construction and maintenance of means of communication declared in the direction to be of national or military importance. Art.

257(3) empower the Union Govt. for “giving of directions to a State as to the measures to be taken to for the protection of the Railways within the State.” Therefore, it is clear that the Union Govt. can give any executive or administrative direction only (1) for ensuring that the exercise of executive power by a State does not impede or is not prejudicial to the executive power of the union. (2) On matters of means of communication declared to be of National or military importance, (3) on measures to be taken for the protection of Railways within the State. Hence the directions, given in the name of National Water Policy, by the NWB do not fall within the Constitutional Scheme of Administrative Relations between the Union and States.

4. A recommendation has also been made that i) A National Legal Frame work and necessary authority to deal with local situation should be created; and (ii) such a legal frame work must recognise water as a scarce resource of the State. That is a law should be made by Parliament creating “National Level Authorities”, to be under the control of Union Govt., to govern matters relating to water. This suggestion or recommendation is an affront to Constitutional scheme. It creates a genuine doubt, whether these recommendations are made deliberately or oblivion of the provisions of the Constitution.

5. Another startling and shocking recommendation is that ‘The proprietary rights created by the Indian Easements Act 1882 and the Irrigation Acts, on the land owners on the ground water under his lands, should be modified’, and ‘The proposed law should be a statement of GENERAL PRINCIPLES governing exercise of legislative and/or executive (or devolved) powers by the Centre, State, and the local governing bodies’. If this principle becomes a law, it is likely to result in far reaching consequences on the agriculturists in the entire nation. The law and order situation over the entire Nation is likely to become uncontrollable. That may create a chaotic situation in every piece of land. The agricultural land owner cannot have any control over his own well since others also can claim right over the water in the well. This suggestion is tantamount to saying that the legislative entry ‘water’ should no longer be a State subject.

6. Other important directions are that

i)‘ Use of water for domestic, agricultural, recreation, hydro- power, thermal power, and navigation , should be optimised;

ii). Community based water management should be institutionalised; community to be sensitised to adapt utilisation of water as per local availability;

7. Agriculturists presently determine the crop pattern according to the availability of water within his reach; but the NWP requires that ‘strategies for compatible cropping pattern and improved water application methods such as drip/ sprinkler irrigation to enhance water use efficiency should be adopted’. There is no difficulty in accepting the drip irrigation or sprinkling method of irrigation. But even the Crop - pattern will have to be followed as per the directions of the authorities. That is, even if a land owner has sufficient water for the crop he intends to grow in his lands, yet he can grow only the crop suggested by the authorities. This would directly violate the fundamental right to carry on ones profession.

8. The other recommendations are that i) availability of water and its use in various basin should be scientifically assessed every five years for planning ; ii) Inter- basin of transfers of water should be considered on the basis of merits of each case after evaluating the environmental ,economic and social impacts of such transfers. iii) An institutional arrangement for efficient use of water at basin/sub- basin level will be established at National level.

9. Water Pricing:

The NWB has given a few directions as follows:-

i) Water should increasingly be subjected to allocation and pricing on economic principles;

ii) Water regulatory authority should be established in each State .It will, inter alia, fix and regulate the water tariff system and charges and such tariff will be periodically reviewed;

iii) Water users Associations (WUA) should be given statutory powers to fix rates and to collect and retain a portion; it can manage the volumetric quantum of water allotted to them and maintain distribution system; WUA should be given freedom to fix the rates subject to the floor rates fixed by WRA.

The use of the words ‘economic principles’ is capable of varied interpretation ; basically it will be relatable to costs and out-put; that is unless it is a profitable proposition water may not be allotted in certain cases. Each State is compelled to establish a Water regulatory authority for fixing water tariff and to periodically revise the tariff. It is also required that water user association (WUA) should be established with Statutory Powers.

CONSERVATION OF RIVER CORRIDORS, WATER BODIES AND INFRASTUCTURE:

10. River corridors and water bodies should be conserved by not allowing encroachments and restoring the encroachments already made should be restored to the earlier level to the extent possible. There can be no difference of opinion on this aspect. But the next direction is that “diversion of water bodies like (rivers, lakes, tanks, ponds etc.).................must not be allowed; wherever it has taken place it has to be restored to the extent possible, and maintained properly.” If this principle is examined closely it may extend to Mullai Periyar, Parambikulam, Aliyar, Siruvani rivers as these are systems of diversion of water flow; similarly it may also apply to diversion of Cauvery waters by Karnataka to Mandya and other areas. The consequences of any attempt to restore to the original flow of these rivers are unimaginable. That may result in virtual war between the concerned States. Further it is contrary to the policy of linking all the rivers, as advocated by many leaders, including the former president A.P.J. Abdul Kalam.

11. The two other directions that I)Sources of water bodies should not be allowed to get polluted; and ii)It needs to be ensured that industrial effluents ,residues of fertilizer and chemicals etc. do not reach the ground water; are already have became law. The Pollution Control Acts are already in force. Why another direction here is difficult to understand.

12. This is a National Water Policy; hence the matter relating to safety of DAMS does not come within the ambit of water policy. Yet it has been provided for Dam safety as well. Thanks to the contribution of some vested interests. There is the following direction as well; - “Legally empowered Dam Safety services need to be ensured in the States as well as in Centre; appropriate safety measures, including downstream flood management, for each dam should be under taken on top priority”.

It looks tailor made for the benefit of Kerala State, as against the interest of Tamil Nadu. It would be difficult to dispel the view that it is motivated. Dam safety cannot be read ‘ejusdem generis’ with Water policy for regulation of supply, use, crop pattern, fixing of differential price, for each use. Dam safety is beyond the scope of NWP. Hence it appears that it is a calculated attempt to defeat all acts done and unsettle all the decisions by the Supreme Court and rob all the benefits accrued over the years to the farmers of Tamil Nadu.

INSTITUTIONAL ARRANGEMENTS;

13. Another and one of the most important and most controversial directions is that water supply which is one of the services provided by the States to its people, is sought to

be modified by transferring that service to Private Sectors. The NWP states that ‘Water resources projects and services should be managed with community participation; wherever State Governments or local bodies so decide the private sector can be encouraged to become a service provider in public private partnership model to meet agreed terms of service delivery’. This would prove to be a dangerous proposition, if implemented. The result would be disastrous; a situation the people of INDIA experience now on the fixation of price for petroleum products may become a lesser evil.

IMPLEMENTATION OF NATIONAL WATER POLICY:

14. There is also a direction that The State Water Policies should be revised in accordance with this policy. As seen above the constitutional scheme is that water supplies, irrigation, and canals and embankments, water storage etc except relating to inter- state rivers and river valleys, fall within the legislative competency of the States; and it is outside the purview of the Parliament’s power to make law or issue directions to any State. Yet these directions have been given .This is nothing but blatant violation of the constitutional provisions. Times of India reports in its 8th March 2013 issue that

“The 13th finance Commission has recommended that the states set up water regulatory authorities (WRA) for getting grants for water management. Each WRA is mandated to fix and regulate tariff and charges for surface and sub-surface water used for domestic, agriculture, industrial and other purposes”. But Tamil Nadu representative has opposed the proposal for fixing tariff for water.

15: At this juncture one gets reminded of the statement of N. A. Palkhivala, in his famous book “We, the people”: While dealing with the Centre –State relations he has stated thus,

“over a period of years the Centre has acted in a manner which at best has been contrary to the spirit of the Constitution and at worst has been tantamount to a fraud upon the Constitution” ........................... “Without any amendment to the Constitution, ‘Industries’ has been nefariously transformed into a Union subject and has cease to be a State subject. ........there can be no doubt that this is an indefensible violation of the Constitution”. ..................... “The ways in which the Centre unduly dominates the States are beyond enumeration and are symptomatic of Centre’s attitude towards its “vassals”.

He has also stated in the book that

Dr. K. Subba Rao wisely observed “ Unless the party that happens to be in power in the Centre develops conventions to shed its party affiliations in the matter of its relations with the States, the federal Government cannot effectively function in our country”

It appears that it would be very difficult to deny or ignore these statements, even today. The Union Govt. has issued executive direction over a matter which does not fall within its competency, and without making any amendment to the Constitution. At the same time it tries to compel the States to fall in line with its directions, by using its financial powers. These things happen while most of the people are in dark. Unless the States become aware of the consequences and rise to the occasion the legislative entries 14,17and 18 of List II [State List] will get obliterated.
