Lee, (1997 PIAVA/DC President) who presented the award. Cole started his agency as a ‘scratch’ agency in 1998 and has grown it to one that boasts $3M in premium volume. Every agency wants to save money. When you meet any one of the criteria listed below, a 5% credit is applied to your premium – up to a maximum of 10% credit. At the end of each year, agency ownership/management does the typical “crunching of the numbers” to assess how the agency fared. An overall review will include an evaluation of premium and policy count changes, an assessment of how well various objectives/metrics were met and a careful dissection of the agency’s financial picture. Looking at these issues, as well as producers’ hit ratios and by-customer policy numbers, reveals your status from the business side of the equation. Yet how well do they determine the agency’s “E&O health?” To a significant degree they don’t, creating a need to perform a review that probably does not get as much attention as it should. Namely, "auditing" many of the key agency procedures to verify to what degree each of the staff is meeting the various agency ex-pectations. Most important If your agency has not been performing a staff audit, now is a good time to start, focusing on those procedures/expectations that are most important. This includes documentation – is it being done promptly, accurately and profession-ally? – the handling of e-mails, policy checking, and more. Employees not meeting the agency’s expectations increase the potential for an E&O issue to arise, so it is best to dis-cover the issue and resolve it before it grows. Moreover, the possibility that agency expectations are not being met could result from employees not completely understanding those expectations, which suggests a need for further training. When it comes to producers, how comfortable do you feel with the way they perform their duties? When was the last time the agency owner/sales manager “rode along” with a producer to see how the call is handled, hear what is said and note how those discussions are documented? Throughout the year Ideally, an audit process – essentially a review of a set number of files per-person based on his or her position – works best when the review is broken down and performed at periodic times during the year. Most agencies should perform this review quarterly. It is more efficient that way, and allows for a "quicker" identification of problems or issues that must be addressed via training or individual/group consultation. While performing periodic quality control audits helps management understand what’s happening within the agency, it will also demonstrate that the staff is being held accountable for their work product and the performance of agency procedures. While the mention of an audit process might get some folks nervous, the staff must realize that audit-ing is performed in virtually every business and helps ensure the organization’s health. Trust, but verify If you don’t have an audit form today, don’t worry about getting the process perfect right from the beginning. As you perform quality-control audits, you will be able to identify areas that must be added – or deleted – from the audit form. How many files should be reviewed? Many agencies strive for a 10% sampling, although the proper number will depend greatly on the amount of work performed. The goal is to review the number of files that provides credibility to the final score. If, for example, you are reviewing files for all customer service representatives, make sure it really does include all customer service representatives. While you may want to trust that your 30-year veteran is doing his or her job, it’s still best to “trust, but verify.” Because your agency probably consists of numerous disciplines – marketing, customer service, sales, accounting, etc. – ensure that each of these is reviewed. Each area has procedures that, if disregarded or not performed properly, could cause problems for the agency. Now is also a good time to review the agency’s website and promotional material to deter-mine to what degree they continue to accurately portray the agency. Are you using any of the “dangerous words” such as “expert” or “specialist?” If so, you might want to change them. Make it complete Results should be tabulated and reviewed for each of the areas within the agency and for each employee. Advise staff members who performed well on the review and thank them for their efforts and commitment. For those that struggled or did not “pass” the review, meet with them individually to better understand the reasons. Is there a need for additional training or another reason, such as the employee thinks his or her way is the better way? Consider factoring the audit re-sults into an employee performance review to add some “teeth” to the process. Bottom line, it is difficult to grow in professionalism and efficiency without an auditing process. Your year-end agency re-view is not really complete without a review of the year-end audit results.

Be forewarned... The 2013-2014 Virginia CE biennium ends December 31, 2014. Virginia’s insurance continuing education laws have changed. The former biennial requirement for a two-hour Laws & Regulations class has changed to a three-hour re-quirement for Ethics content. Although the Virginia Laws & Regulations topic is accepted for the Ethics credit, it must be an approved three-hour class; not just two hours. A combination of Laws and Ethics credits is allowed if they equal 3 hours total. The most significant change for the 2013-2014 biennium concerns insurance license revocation. There is no longer a seven-month “grace period” at the end of this biennium. If you fail to have all your CE completed; fail to register online to claim your CE credits and pay your biennial $15 fee by November 30, 2014, you may receive a com-munication from the BOI advising you that your license may be terminated January 1, 2015. So don’t put off getting in compliance with all your Virginia CE requirements. In January 2015, there won’t be any excuses good enough for you to keep your license if you don’t have your CE or have not paid your paid you continuance fee. What to expect, when you’re expecting…….to go to the Virginia General Assembly Many of us find the political process either distasteful or fascinating. Usually, there is very little room for any other feeling between the two extremes. But love it or hate it, there may come a time when you find that a bill being intro-duced in the General Assembly may have an impact on your business, your financial health or personal life. If you have the curiosity or need to stand up and be heard, then by all means, speak up. As a citizen of the Commonwealth of Vir-ginia, it is your right to voice your opinion regarding pending legislation. There are many ways in which citizens can com-municate with their legislator; phone calls, letters, email, or through visits to their legislative offices. The purpose of this article is to help you navigate the landscape and understand the language of politics. The Virginia General Assembly dates from the establishment of the House of Burgesses at Jamestown in 1619. It is heralded by Virginians as the "oldest continuous law-making body in the New World." It was then and is now a legislative body comprised of “citizen legislators,” elected representatives that serve in a part-time capacity meeting full-time re-sponsibilities.¹ Before you make the trip to the State Capital, you should familiarize yourself with the facilities and especially the parking. When the General Assembly is in session, parking can be difficult to locate. The best place to begin is the Vir-ginia General Assembly website. www.virginiageneralassembly.gov Under the tab, Virginia State Capital/Visiting the State Capital, there is a wealth of easy-to-navigate topics including: Directions and Parking; Maps; Tours & Guidelines; Café and Shop; Visiting During Session, and Meeting & Events. For the fans of social media, there is a Facebook page for the Virginia General Assembly with links for both the Virginia Senate and the Virginia House of Delegates. Let’s start by assuming that you know or have heard about a bill that may have an effect on you. First, you should gather as much information about the proposed legislation as possible. The best place to start is the Virginia Legislative Information System, website: https://lis.virginia.gov If you know the bill number, you can go directly to the proposed legislation. If not, check the searchable database on the left of the screen where you can enter keywords to find related bills. For example, you could enter a keyword of “insurance” or a specific code section for insurance, “38.2” to find all the proposed legislation. Find a bill you are interested in following and click on: Bills & Resolutions: Status of individual bills and related infor-mation. Enter the bill number into the search. From this point you can see the history of the legislation. This search will show the patron(s) of the legislation, a small summary of the bill, a link to the full text document of the bill, any amend-ments and the status of the bill. The status is where you can find what committee or sub-committee the bill has been assigned/reassigned and any voting (Yeas/Nays), to move the bill forward or stop it. When a bill comes up for discussion in committee, this is one of the best places you can go to speak for or against proposed legislation. There is a language to the political process that can often be found rooted back to Parliamentary Procedures as well as outlined in Robert’s Rules of Order. In general, the following committee actions are the most common terms that you will hear: Carry Over (Continue): Action which removes the measure from consideration during an even-numbered year Session and provides for its reconsideration at the next regular Session of the General Assembly. No bill may be carried over in an odd-numbered year Session. A carry-over bill retains its assigned bill number in the odd-numbered year Ses-sion. Fail to Report (Defeat): The committee rejects a motion to report a bill to the full house. Incorporate: The committee incorporates one or more bills into another bill. No Action Taken: No motion is made on the bill and it dies at the time of the committee deadline. (Continued from page 7) allows the committee to reconsider legislation at a later meeting. If the committee takes no further action, the bill is dead. Report: The majority of the committee approves the bill and it is reported to the floor. The bill may be reported three ways: without amendment(s), with amendment(s), or with an amendment in the nature of a substitute. A bill may also be reported and referred to another committee. Strike: The bill is removed from the docket. This action frequently occurs at the request of the patron.² Another common action on legislation you will hear in committee or on the floor of the General Assembly is to “Lay on the Table”. Various euphemisms may be added to the phrase, “Lay on the Table”, such as “Gently” or “Softly” but the meaning is still the same. The motion to lay on the table refers to temporarily setting aside a pending motion (or a series of pending motions) to take care of something else deemed urgent. The motion to lay on the table is less about the busi-ness being discussed than about the assembly needing to handle something else immediately. One such motion may be: "Madam President, because our speaker has arrived, I move to lay the pending motion on the table." And although the motion is just a temporary disposition of the pending business, no time is taken to decide in advance when to get back to the motion being laid on the table. The subsidiary motion to lay on the table: Can't interrupt a speaker who has the floor. Must be seconded. Isn't debatable. Isn't amendable. Requires a majority vote. Can't be reconsidered if adopted because the motion to take from the table is easier to use for that purpose. Reconsideration is permitted if lay on the table fails, as long as no material debate has progressed on the motion or motions to which it was applied. If additional debate has oc-curred, a reconsideration vote is unnecessary. The motion to lay on the table just needs to be renewed.³ Even though the preceding guidelines suggest this is a temporary measure, it has been my observation that the motion to “lay on the table” is used to bypass a bill indefinitely especially if the bill has political implications. In theory, once a bill has been laid on the table, it can easily be removed from the table for discussion and voting. Now, you have found and researched legislation that you would like to speak to in committee. The status of the bill will show which committee or sub-committee will be hearing public comment. The legislative information system will show when the committees will meet and a list of bills to be considered each day. Most of the committee meetings as well as offices for the members are in the General Assembly building (GAB) located at 1000 Bank Street Richmond, VA 23219. The entrance to the facility employs the same scrutiny as an airport with guards and metal detectors. Be sure to turn off any audible electronic devices before entering either a committee meeting or House/Senate floor (located in the Capital). Business attire is suggested for attendance. Check with any groups that may be representing the same position as you advocate. Groups such as the Retail Mer-chants, AARP, industry trade groups, philanthropic organizations etc. often take a position on legislation. By bringing your personal story forward with general industry support (or opposition) could mean the difference in a bill making it out of committee or not. Just as a side note… a trip to the General Assembly to see government in action, is an amazing, educational and inter-esting trip for the family as well.

As memories of a brutal winter fade, it’s important to remember that warmer weather can bring serious flood risks. Heavy rains, snowmelt, ice jams, and flash flooding all increase the risk of flooding during this time of year. As an insurance professional, you can ensure your clients are covered for floods caused by spring thaw. The National Weather Service has predicted an above-normal chance of flooding this spring following a series of snowstorms this past winter. This has created more snowpack, which in turn can lead to snowmelt as temperatures begin to rise. The risk of flooding will also escalate if the snow continues to fall throughout the early spring months. A spring thaw can produce large amounts of runoff in a short period of time. Each cubic foot of snow that accumu-lates during the winter contains about a gallon of water. When the ground is frozen, water cannot penetrate and be reab-sorbed. The water then runs off the surface and flows into lakes, streams, and rivers—or pools in low-lying areas—causing flooding. Remember, typically there is a 30-day waiting period before a policy goes into effect, so it is important for you cli-ents to have flood insurance in place before the spring flood season begins. Tools To Help You Have the Flood Talk Your clients might not be aware of or understand their flood risk; they might even be hesitant to talk about it. Tools and talking points on the newly updated Agents.FloodSmart.gov are designed to help you have the flood talk more effec-tively by helping your clients and prospects visualize the risk and costs of not purchasing a flood insurance policy. You will also find interactive tools, widgets, and testimonial videos to help communicate flood risk and the financial burden of a flood on FloodSmart.gov. Help your clients visualize how floods happen by sharing the Flood Risk Scenarios tool with them. Registration Instructions: • If you are a company rep or licensed agent and plan on attending the entire convention (Sunday Trade Fair through Tuesday Dinner), you should

register as a FULL Convention Attendee. The only activities not included in a FULL registration would be Sunday lunch at the Professional Designation Conferee Event and Monday dinner at Chick’s Oyster Bar.
