We are a non-profit organization of motorcycle en-thusiasts from all walks of life. We lobby and educatethe government and the general public to promotemotorcycling in a safe and positive image. We en-deavor to enlist the cooperation and participation of all organizations and individuals that share a similarinterest in preserving our American tradition of FREE-DOM. We promote motorcycle safety, training, & po-litical awareness. We ARE NOT A CLUB OR A GANG.We fund our work through toy runs, poker runs,campouts, and other motorcycle activities. We areyour neighbors & friends who work, pay taxes, andget involved with our community. We serve and sup-

port our country and believe in freedom. We use alllegal means to protect our rights without infringingon the rights of others.

OUR GOALS

To become a powerful and viable political force inlegislative matters concerning the motorcyclist.

To promote the safe riding habits without infringingon individual freedoms.

To motivate the bikers to write letters to their legisla-tors before, during, and after the legislative session.

Presidents report 

Hello Brothers and Sisters,

Cooler dryer weather coming up and more

riding time for everyone. The Chapter birth-day party went off well although not muchparticipation by chapter members. A big

thank you to Kelly Rogers at Gear Head Tat-

too for hosting the event as well as Alan

Smith of Old Skool, Tony Allen of Hot Rodsand Hogs and Nick Lee’s World Burnout Tour,

as well as all the participants of the car andbike show and of course the public who

showed up. This month starts with Cape Bike

Night followed by the next weekend with our

State meeting up in Brooksville, home of Spooks and Scoots hosted by Peace River andWest Coast Chapters. Our second meeting at

Anthony’s went well and seems to be just

what we were looking for. Pam Cook, Legisla-tive rep for Estero River, Mark Williams,

President of Estero River Chapter and myself attended a meeting with Rep. Matt Caldwell

as we asked for him to join us and help with

the stiffer penalties bill. Rep Caldwell wel-comed the meeting and has been informed

of our plight. I look forward to an updatesoon. Rep Trudy Williams will be speaking at

our November meeting and allmembers are encouraged to

attend and show their sup-port. Tuesday nights at the

Joint at Cape Harbour is turn-ing out new members and weare selling many shirts as Ken

and Keith set up a weekly ta-

ble for safety and membershipeach week. Come on down

and show your support for

your chapter. That’s all I have

Coming Up!Please begin to look for the fliers of two upcomingevents.Biker Bible Café - will be held in our home on Decem-ber 2nd, starting at 7:30 PM. This will be our Christ-mas gathering and all bikers are invited. As we cele-brate the greatest gift ever given to man (John 3:16),we will have a fun Chinese-style gift exchange, valueunder $10.00. You can bring something new , some-thing used, or some "white elephant." There will belots of seasonal treats to eat and drink!On January 22nd, we be having the 13th Annual LeeCounty Church Crash and Slow Race Championship of the Universe. The evening before will be the Run for Ribs. As the Holiday season (Thanksgiving and Christmas)approaches, it reminds of the thanks we owe to God,for all He has provided and, for the gift of His preciousSon. It kind of brings to mind, a story, told by apreacher named Tony Evans. He tells of a child whowanted his parents to pay for the things this child did

around the house. The child wanted money for mowinthe lawn, cleaning the windows, picking up its owclothes and several other things. The child went as faas writing up a bill, totaling a few dollars and submittinit to the parents. The parents set the money on thdining room table. However, they left their own invoice saying, "For your mother carrying you for nin

months and being sick as a dog every morning, NOCHARGE. For picking up your clothes when you forgoNO CHARGE. For your dad mowing the lawn, wheyou wanted to go and play with your friends, NOCHARGE. For staying up at night with you when yowere sick, NO CHARGE. For the special clothes yowanted and we had to work overtime to pay for, NOCHARGE.Like the child who lost sight of his parents love antried to turn it into a business relationship, we some

times lose sight of the love of God and all he has giveus. And, sometimes it's most apparent during hartimes.Our favorite scripture, during this time is John 3:16 -1"For God so loved the world that He gave His only begotten Son, that whoever believes in Him should noperish but have everlasting life. For God did not senHis Son into the world to condemn the world, but thathe world through Him might be saved." Nothing cabeat His love. Nothing can beat His grace. He promised that He would never leave us nor forsake us. Aat, NO CHARGE... trial date for the individual that killed the biker in Estero. PENNSYLVANIA MEASURE WOULD

LIMIT LEARNER PERMITS

  ABATE of Pennsylvania is supporting legislation tolimit the number of motorcycle learner’s permits al-lowed before a rider must get a license. “All too oftenthose involved in serious accidents have no motorcy-

cle endorsement on their license,” lobbyist CharlesUmbenhauer of BikePAC told the National Coalitionof Motorcyclists (NCOM), adding that “In most casesthis also means they have had no formal motorcyclerider training.” 

State Representative Seth Grove (R-Dover Town-ship) has introduced legislation aimed at increasingmotorcycle safety by requiring riders to get a motor-cycle license rather than continuously reapplying for a motorcycle learner's permit.  

Currently, an aspiring rider can get a permit after passing a written test, which is good for a year to al-low motorcyclists to legally ride and gain experienceuntil they get their motorcycle license. However,some riders reapply to renew the permit year after year rather than getting a full license, Rep. Grovesaid.

Under Grove's proposal, a rider would only be al-lowed to reapply for a learner's permit three times in10 years.

"The purpose is to make people get the license,"stated Grove, adding that more motorcyclists takingthe skills tests or enrolling in the state’s rider trainingprogram would mean more trained riders on theroad.

If a rider doesn't get a license within 10 years of re-ceiving the first permit, he or she wouldn't be able toget another permit for seven years. The bill was re-ferred to the transportation committee earlier this

year and is expected to be addressed this fall.

ILLINOIS GOVERNOR SEEKS CHANGES

TO RED LIGHT BILL

Illinois motorcyclists who get stuck at red lights willremain stuck a while longer, as Governor Pat Quinnhas vetoed legislation that would have made it legal

to proceed through a red light that does not detectmotorcycles.

However, the bill may yet become law if legislatorsagree to make some changes. Illinois has what iscalled an Amendatory Veto, wherein the governor can reject a bill as presented for signing, but withchanges requested that, if met, will win his signature.

  As written, House Bill 2860 sponsored by Senator Gary Forby (D-Benton) and Representative DanielBeiser (D-Alton), specifies that motorcyclists couldrun red lights "after a reasonable period of time."Quinn objected that such wording is too subjectiveand “its interpretation could vary from individual toindividual and county to county." He asked that thebill be changed to specify that the motorcyclist mustwait two minutes. Quinn also asked for clarificationthat motorcyclists would still have to obey signs pro-hibiting right or left turns on red and would still haveto yield to oncoming traffic.

  ABATE of Illinois supported the measure when it

passed the legislature in May, which is similar to lawsenacted in 11 other states. “I was kind of disap-pointed with what the governor done,” said Sen.Forby. “ABATE’s going to have to make a decisionon whether they want to negotiate with the gover-nor’s office or try to override his veto.” 

The Illinois Legislature has placed the amendatoryveto on its calendar for action on October 19.

opposition to New York State's tactic of conductinghighway roadblocks which divert only motorcyclistsfrom the state's roadways for the purpose of conduct-ing "safety checks".

Because motorcycles operated in New York Stateare already required to pass annual safety inspec-

tions, the ongoing New York State Police initiativeserves only to harass, intimidate and inconveniencemotorcyclists traveling upon the state's roadways.Further, motorcycle-only roadblocks conducted in thename of "safety checks" are a discriminatory and un-constitutional infringement upon an individual's rightto travel without interference, and an abuse of discre-tionary power as acknowledged by the New YorkState Court of Appeals.

The Office of the Attorney General was reportedly

receptive to Prospector's request of an investigationinto the actions of the New York State Police, and areporting mechanism has now been implemented for direct complaints of motorcyclist profiling.

6 MILLIONTH MOTORCYCLISTGRADUATES FROM RIDER TRAINING

The Motorcycle Safety Foundation recently gradu-ated its six millionth RiderCourse student, a mile-stone reached through the ongoing efforts of nearly10,000 RiderCoaches at more than 2,000 trainingsites worldwide.

"We have RiderCourses across the nation andaround the globe, often during weekdays, and virtu-ally every weekend of the year," said Robert Glad-

den, vice president of the Motorcycle Safety Founda-tion, adding that a wide variety of MSF RiderCoursesare available in every state to provide motorcyclistseverywhere with lifelong learning opportunities.

"From the Basic RiderCourse to a much more ad-vanced day on the track, from standard motorcyclesto scooters to three-wheel motorcycles, from smallbikes to large, we cover it all," said Dr. Ray Ochs,MSF director of training systems.

In addition, the MSF collaborates with safety profes-

sionals worldwide. For example, the MSF is currentlyhelping establish rider training in the HashemiteKingdom of Jordan. The MSF works with allbranches of the U.S. Armed Services to support rid-ers in the military. And the Foundation also workswith world champion road racers on track-based pro-grams that improve rider safety everywhere.

"The MSF is still best known for its world renownedBasic RiderCourse, the best first motorcycle ride for any new street rider and the cornerstone of the

FLORIDA COPS USE SECRET FILES ON BIK-ERS TO LOBBY AGAINST GUN LAW

Florida law-enforcement officials dipped into secretintelligence files to lobby against legislation thatwould have allowed holders of concealed-weaponspermits to carry their guns openly. Newly releasedrecords show that a staff lobbyist for the OrangeCounty Sheriff’s Office handed out restricted photosof bikers with valid concealed weapons permits tolawmakers as examples of the sort of people whomight scare away tourists if they displayed their pis-tols.

"I actually stopped by every one of you guy's officethis morning and dropped off … photographs of some biker outlaw gang guys that have concealedfirearm permits. Those are the ones we're worriedabout carrying," sheriff's Capt. Mike Fewless told thestate Senate Judiciary Committee on April 12, 2011."Please defeat this terrible bill."

  After the provision allowing open carry of firearmswas removed from the bill, the state Senate votedagainst the measure, prompting accusations of fear-mongering by law-enforcement officials and raisingconcerns about police misuse of confidential files for political goals.

  All together, Fewless obtained photographs andother information for 17 "outlaw bikers" from the Or-ange sheriff’s Intelligence Squad, an undercover unitthat investigates "motorcycle gangs, white suprem-acy groups and organized crime,” specifically askingfor pictures of "One Percenters", state attorney's re-cords show. Seven of the eight photos of members of 

the Mongols, Outcasts, Outlaws, Pagans and War-locks motorcycle clubs came originally from the stateDriver and Vehicle Identification (DAVID) system,which Federal law classifies as “highly restricted per-sonal information." None of the bikers had felony re-cords and all were eligible for concealed-weaponpermits recognized by Florida and 34 other states.

The motorcyclists are now represented by Aid to In-

  jured Motorcyclists (A.I.M.) Attorney Jerry Theo-philopoulos, who said he is planning to file a lawsuitagainst the sheriff’s office. "The only way to policethe police when they break the law is to file a lawsuit,and we are prepared to get justice for all concealedweapon permit holders in this state," according to“Jerry T”, who serves as legal counsel for the Con-federations of Clubs in Florida and advises ABATE of Florida on legal matters.

DRIVING WHILE BIKER

From the Gunny’s Sack, a monthly newsletter fromOregon A.I.M. Chief of Staff Gunny Hutcheson,members of the Henchmen MC have hired a lawyer to put the San Jose Police department on notice thatharassment is not going to be tolerated without afight.

They've filed an official complaint with the city's Of-fice of the Independent Police Auditor alleging thatthe police are illegally profiling them, and the city'scode enforcement unit is digging up zoning beefs torun them out of town. They say officers routinely pullthem over, sometimes photographing their tattoos,based solely on their bad-boy reputations.

The Henchmen's complaint is not the first time a mo-torcycle club in San Jose has fought the law usingthe law. Five years ago, the Hells Angels won $1.8

million after suing police and sheriff's deputies for illegally raiding the club's headquarters and mem-bers' homes to link a bouncer, charged with killing adrunken bar patron, to the biker club. A jury acquittedthe bouncer and a federal court sided with the Hells

 Angels.

“This kind of thing has come to a halt in Washingtonwith their recent biker anti-profiling law, thanks to theWashington Confederation of Clubs and A.I.M. Attor-ney Marty Fox,” writes Gunny, “Fighting harassment

by using a lawyer and the court system.”

 A bill is introduced. The bill is assigned to a committee. The com-mittee parcels the bill out to a subcommittee. They hold hearings.

 A subcommittee acts on the bill. A full committee acts on the bill.There is floor action (discussion, changes to the bill, votes), in thatchamber.After Both Chambers Complete the Process: 

 A conference committee irons out the differences in the two ver-sions. Both houses vote on the reconciled bill. If passed by boththe House and Senate, the bill goes to the President (or Gover-nor) for their signature or veto. INCREASES IN TOLLS FOR INFLATION COMING The Florida Department of Transportation is proposing to imple-ment the indexing of toll rates for all FDOT toll roads and bridges,including the Florida Turnpike. Cars will typically see a 25-cent increase ateach plaza. The agency recently held one rule development work-shop on the proposal, during which officials said SunPass rateswill go up from 6 to 7 cents per mile, and cash rates will be raisedfrom 7.5 to 8.5 cents per mile. The FDOT is basing the increaseon the Consumer Price Index’s rate of 11.7 percent inflation over the past five years.DHSMV WANTS ENHANCED DRIVER LICENSES 

The state Department of Highway Safety and Motor Vehicleswants to offer drivers an "enhanced driver license," which wouldhave security features allowing the card to be used instead of apassport when crossing some land or sea international borders.Several other states have such cards, particularly states that bor-der Canada. That allows drivers to go back and forth across theborder without having to carry a passport. In Michigan, the li-censes even have technology in the card that allow them to bescanned from a distance, speeding up border crossings. Driverscan simply hold up their card. One reason they could be useful inFlorida is that re-entry into the United States from several Carib-bean countries could be made with just the driver's license, allow-ing travelers to go on Caribbean cruises without the expense of 

having to get a passport, said Steven Fielder, legislative affairsdirector for DHSMV. Fielder mentioned that the agency is explor-ing the concept, and wants to offer the licenses, when he pre-sented the department's legislative agenda Tuesday to the HouseTransportation and Highway Safety Subcommittee. The agency isstill studying how much it would cost, but Fielder said officialsthink they could offer the card for around $75. In Michigan, theenhanced licenses are $45.HOUSE HIGHWAY SAFETY CHAIR: PANEL WILL LOOK AT

TEXTING WHILE DRIVING The chairman of the House subcommittee that deals with highwaysafety pledged Tuesday that the panel will take up legislationaimed at reducing distracted driving. Rep. Brad Drake, R-Eucheeanna, said that he was open to considering a change inthe law, or at least looking at the problem of driving while textingor doing other things. Drake's comments came after Rep. IrvSlosberg, a longtime advocate for more stringent driving safetylaws, used the appearance in the committee of an official from theDepartment of Highway Safety and Motor Vehicles to raise thepoint that it remains legal to text and drive. Slosberg, who oftensays he went into politics to make roads safer because of thedeath in a car crash of one of his daughters, asked HSMV legisla-tive affairs director Stephen Fielder how many distracted drivingtickets are given in a year by the Highway Patrol, which is over-seen by the agency. "None, because there is not a law prohibitingdistracted driving," Fielder acknowledged.

the signature blue permit tag dangling for the mirror, Sen. GwenMargolis, D-Miami, and Rep. John Julien, D-North Miami Beach,have filed bills to require local officials to more frequently checkthe rolls of permit holders to make sure they are still among theliving and in need of the free parking pass. Margolis' bill, SB 226was filed Wednesday and is similar to a measure, HB 27, Julienfiled in June. The bills require motorists to renew their permits inperson.  A proposed amendment (SJR 90), filed Tuesday by Sen. Arthe-nia Joyner, matches a House version (HJR 23) filed earlier thisyear by Rep. Rick Kriseman, It would ask voters to put into theconstitution a ban on exploration, drilling, extraction or produc-tion of oil in Florida waters."There are people still suffering from the big spill," Joyner saidWednesday. "Do you want to expose Florida to the possibility of another spill – but closer to our shore? I just can't believe peoplewant to bring it that close, after seeing what happens when it'sfarther out."To open up our shoreline to the possibility of oil is ludicrous,"Joyner said.The move, which would need three-fifths approval of both cham-bers to get the proposal before voters, comes as backers of drill-ing have begun again raising the prospect of new exploration for both oil and gas to combat high energy prices, as well as andreducing American dependence on foreign sources of energy.Senate President Mike Haridopolos has said he has no intentionof pushing for new drilling in Florida waters this year. Harido-polos, R-Merritt Island, was a backer of a bill in 2010 that wouldhave removed a moratorium on drilling in Florida waters, butchanged his stance after the BP oil spill began in April of that

year. Since then, Haridopolos has said there is a need for newdrilling in American waters, but has given assurances that Flor-ida waters – which extend about 10 miles in the Gulf, and closer in the Atlantic - would remain off the agenda in the coming year.FLORIDA LAWMAKERS OFFER DREAM ACT BILL Two state lawmakers have offered a bill for the 2012 legislativesession that would create a pathway for students brought to thecountry illegally to get in-state tuition. The bill (HB 81, SB 106)allows an immigrant brought here illegally who has spent three

years at a Florida high school to be eligible for in-state tuition ata Florida college or university. A similar bill at the national level called the DREAM Act has beenoffered for years, but has yet to be approved by Congress. Themeasure has been proposed in Florida before as well, but hasn'tpassed.Civic Leader Changes His Plea to “Guilty” Tavares, FL, September 20, 2011 – While riding back home fromBiketoberfest on October 17, 2009, Herbert “Steve” Muller washit and killed by Lake County civic leader Bruce Duncan. Dun-can’s Blood Alcohol was twice the legal limit in addition to the ½empty bottle of vodka FHP found in his truck. In court today,Duncan did not dispute these facts.

 After many hearings in this case, on September 19 & 20, 2011

Mr. Duncan changed his plea to Guilty of DUI Manslaughter.This case took on a life of its own when Duncan’s defense teambegan lining up figures such as Florida State Representative H.Marlene O'Toole (R-Lady Lake), two Circuit Court Judges, Presi-dent of Lake-Sumter Community College Dr. Charles Mojock,Tavares City Administrator John Drury, as well as fifteen other community leaders to be defense witnesses in Duncan’s hearing.

 Although there were several hours of testimony from family andfriends on both sides, not all the defense witnesses had the op-portunity to testify.

 ABATE of Florida, Inc. State President, James “Doc” Reichen-bach II, did testify for the prosecution, asking that the Court notdepart from the recommended sentencing guidelines, and how

drivers killing motorcyclists are getting away with insignificantfines. Asst. State Attorney Sue Purdy recommended that CircuitJudge Michael Takac impose a 12 ½ year prison sentence and apermanent license suspension. The state sentencing guidelinesrecommend a sentence of 10 years and a few months, but thedefense attorneys have asked the Court to depart from theseguidelines and sentence Duncan to only 4 years, the absoluteminimum sentence allowed by law. The defense also motionedto suppress the testimony of “Doc” Reichenbach, claiming preju-dice and that ABATE is not an affiliate. Judge Takac denied thismotion, stating that he allowed numerous testimonies from de-fense witnesses that could very well be deemed prejudice aswell.On September 30, 2011 at 8:30 am Judge Takac will sentenceBruce Duncan at the Fifth Judicial Courthouse, Lake County, on550 W Main St. Tavares, FL. TEA Extension The Motorcycle Riders Foundation (MRF) haslearned that, with current authorizations set to expirein the next couple of weeks, the U.S. Congresspassed legislation that would authorize surface trans-portation programs for several more months.

By voice vote, the House passed a bill (HR 2887)that would extend surface transportation programsthrough March 31, 2012. The bill also would extendcertain highway-related taxes, including the gas tax,which is set to expire on September 30 under themost recent long-term surface transportation reau-thorization. The Senate also passed the extensionlate on Thursday, September 15. This bill has beenthe vehicle for numerous motorcycle-related laws.HR 2887 is expected to be signed into law very soon."The extension keeps the current motorcycle aware-ness and education grants flowing. So far the gov-

ernment has returned $49 million dollars to the mo-torcycle riders in the country; I call that a good start,"said Jeff Hennie, MRF Vice President of GovernmentRelations.The bill, which should be the most bipartisan bill inthe entire Congress, has been stymied for a number of legislative and political reasons – so much so thatis now linked to the Federal Aviation Administrationfunding bill which is on its 22nd extension going back

to 2007.House Transportation and Infrastructure CommitteeChairman John Mica (R-FL) said the short extensionrepresented a "bipartisan, bicameral agreement tomove forward," but warned that it should not be a"temporary Band-Aid."
