quarry lease of "Ordinary Sand" mining project as per the EIA

Notification of 14-Sep.-2006.

Sir,

I, the applicant Vedant Enterprise has been granted a L.O.I. of lease of

minor mineral “Ordinary Sand” by the Collector, Patan (Gujarat) on Sarasvati

Nadi Patt Paiky, Sr. No. 85, 116, 123 Ne laug, Block No. 01 of Vill : Dethali,

Ta : Patan, Dist. Patan, Gujarat for the lease area of 06-03-41 Ha.

According to the direction of Honourable Supreme Court of India,

MoEF’s OM dt. 18th May 2012 and latest amendment of the EIA Notification

on 9th September 2013, environmental clearance is required to be obtained for

our mining project.

You are well aware that the last term of the S.E.A.C. and S.E.I.A.A. for

Gujarat State is already expired in July, 2013 and presently there is no

S.E.A.C. and S.E.I.A.A. for Gujarat State. Kindly note that in absence of

S.E.A.C. and S.E.I.A.A. for the Gujarat State, previous secretariat of S.E.A.C.

and S.E.I.A.A. located at Gujarat Pollution Control Board (GPCB) has stopped

accepting all kind of environmental clearance applications.

Para 4 (iii) of the EIA Notification, 2006, states that “In the absence ofa duly constituted SEIAA or SEAC, a Category ‘B’ project shall beconsidered at the Central Level as a Category ‘B’ project”. In view of this

provision, though our project falls under B category project, we are required to

submit our application at the central level Expert Appraisal Committee for

consideration. It may be noted that the District Collectorate is neither granting

new lease nor renewing the existing lease for want of environmental

clearance. Due to this, we are unable to continue mining operations and

losing our only source of income and livelihood.

In consideration of above, we humbly request you to accept our

application to accord environmental clearance at the earliest.

NOTE :

1. The projects involving clearance under Coastal Regulation Zone Notification.

1991 shall submit with the application a C.R.Z. map duly demarcated by one

of the authorized agencies. showing the project activates, w.r.t. C.R.Z. (at the

stage of TOR) and the recommendations of the State Coastal Zone

Management Authority (at the stage of EC). Simultaneous action shall also be

taken to obtain the requisite clearance under the provisions of the C.R.Z.

Notification, 1991 for the activites to be located in the CRZ.

2. The projects to be located within 10 km of national Parks. Sanctuaries.

Biosphere Reserves, Migratory Corridors of Wild Animals, the project

proponent shall submit the map duly authenticated by Chief Wildlife Warden

showing these features vis-à-vis the project location and the

recommendations or comments of the Chief Wildlife Warden thereon (at the

stage of EC)".

3. All correspondence with the Ministry of Environment & Forests including

submission of application for TOR/Environmental Clearance, subsequent

clarification, as may be required from time to time, participation in the EAC

Meeting on behalf of the project proponent shall be made by the authorized

signatory only. The authorized signatory should also submit a document in

support of his claim of being an authorized signatory for the specific project".
