A. INTRODUCTION

1. Himachal Pradesh is a mountainous State in Northern India with a population of slightly over 6 million, has abundant water resources in the five major rivers flowing through the state from the western Himalayas. The hydropower generation potential of Himachal Pradesh is about 27436 MW, which is about one-fourth of the total hydropower potential of India. In its Hydropower Policy (2007), the Government of Himachal Pradesh (GoHP) targets its comparative advantage in hydropower with the goal to become the "Hydropower State" of the Country.

2. For improvement/ strengthening of existing infrastructures and addition of new infrastructure for effective power evacuation, the Government of Himachal Pradesh (GoHP) through the Government of India (GoI), has requested the Asian Development Bank (ADB) for a Multi-Tranche Financing Facility (MFF) to provide financial assistance to the power sector investment program in the State. The investment program covers investments for transmission of clean energy to National Grid of India by construction of pooling substations and EHV transmission lines. To implement this activity, Himachal Pradesh Government has established HP Power Transmission Corporation Limited (HPPTCL) vide HP Government Notification No.: MPP-A (1)-4/2006-Loose dated 11th September 2008 as the State Transmission Utility (STU) and HPPTCL was declared as the State Transmission Utility (STU) vide notification no. MPP-A (3)-1/2001-IV dated 10th June 2010.

3. The Himachal Pradesh Clean Energy Transmission Investment Program (HPCETIP) is a $350 million multi tranche financing facility (MFF) from the Asian Development Bank (ADB), which will contribute to economic development in Himachal Pradesh through expanded power supplies from clean energy sources, and support a sustainable electricity sector in the state. HPCETIP will produce the following outcomes: (i) increase availability of clean energy downstream at pooling stations for effective power evacuation in a financially sustainable manner, (ii) improve state finances and power sector financial viability from sales revenue earned from power exports, (iii) improve sector governance, (iv) improve capacity in HP Power Transmission Corporation Limited (HPPTCL) for better planning, implementation and management of power evacuation infrastructure, and energy efficiency, and (v) improvement in implementation standards of environmental and social safeguards in the sector. With ADB support, the proposed program will sustain the energy sector reform agenda, and is expected to help attract other long-term financiers to the State.

B. PROJECT DESCRIPTION

4. The Tranche-III subprojects are located in Kullu, Chamba and Shimla districts of Himachal Pradesh. The Tranche-III components of the Himachal Pradesh Clean Energy Transmission Project include construction of Power Transmission Lines & Sub-stations. Details of sub-

5. Construction works of the Tranche-III (Loan No. 3733-IND) subprojects are on-going (refer Site Progress Photographs at Annexure-I). The status of overall progress and progress during the reporting period for the sub-projects under Tranche-III is provided in Table 2.0.

D. COMPLIANCE STATUS WITH NATIONAL/STATE/LOCAL STATUTORY ENVIRONMENTAL REQUIREMENTS

6. Power Transmission projects have been exempted from Environmental Clearance as they are not listed in the schedule of MoEF&CC EIA Notification, 2006 and its subsequent amendments.

7. Wildlife clearance under Wildlife Protection Act, 1972 is required for the projects located within notified protected areas (Wildlife Sanctuary, National Park, etc.). As the subproject sites are not located within notified protected areas or its Eco-sensitive zone, Wildlife clearance is not required.

8. Since few subproject sites are in forest area, clearance under Forest Conservation Act, 1980 is required from MoEF&CC before starting construction activities in forest areas for sub projects located in the forest. Details of the sub-projects required forest clearance and status of clearance is provided in the Table-3.0.

E. COMPLIANCE STATUS WITH THE ENVIRONMENTAL COVENANTS AS STIPULATED IN THE LOAN AGREEMENT

11. The compliance status during the reporting period with the environmental covenants as stipulated in the loan agreement is provided in Table 5.0.

The State and HPPTCL shall ensure that the preparation, design, construction, implementation, operation and decommissioning of each Subproject comply with (a) all applicable laws and regulations of the Borrower relating to environment, health, and safety; (b) the Environmental Safeguards; (c) the EARF; and (d) all measures and requirements set forth in the IEE and EMP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.

The State and HPPTCL shall ensure that all bidding documents and contracts for Works contain provisions that require contractors to:

(a) comply with the measures and requirements relevant to the contractor set forth in the IEE, the EMP, the RP and any IPP (to the extent they concern impacts on affected people during construction), and any corrective or preventative actions set out in a Safeguards Monitoring Report;

(b) make available a budget for all such Environmental and Social measures;

During the reporting period Air, Noise, Water and soil quality monitoring was carried for the projects; 22/66 kV Gas Insulated Switchgear (GIS) Pooling station at Bagipul (Construction stage), 132/220 kV, 2x80/100 MVA GIS substation at Mazra (Construction stage), 220 kV GIS switching station at Hatkoti (Construction stage), 33/132 kV 2x25/31.5 MVA GIS substation at Barshaini (Construction stage), Construction of 66/220 kV and 80/100 MVA transformer in 400/220 kV Gumma substation (Pre-construction stage) as per ADB approved monitoring plan. The results of all the tested parameters were found well within the prescribed limits of CPCB standards and are given in Annexure XVI.

H. ANY OTHER ENVIRONMENTAL ASPECTS, IMPACTS OBSERVED DURING IMPLEMENTATION, WHICH WERE NOT COVERED EARLIER DURING ENVIRONMENTAL ASSESSMENT OF THE PROJECT.

15. The effect of Pandemic due to novel Covid-19 continued during the reporting period too and the Contractor adhered to HPPTCL’s Health and Safety Plan (Ref Annexure XV) and the guidelines issued by Govt. of India or State Govt. to prevent the spread of the virus.

16. Some cases of Coronavirus infections were reported from different subprojects and all these were cured by following the guidelines in HPPTCL’s Health and Safety Plan and Govt’s guidelines. The cases reported were from subprojects i.e., C/o 66 kV double circuit (D/C) transmission line from 66 kV GIS Bagipul substation to Kotla (13 Nos) and C/o 220 kV D/C transmission line from Holi Bhajoli To Lahal (25 Nos). All these reported cases were isolated and quarantined at designated places by the Contractor and were provided with all required facilities (food and medicines). Infected workers were paid full wages during the isolation/quarantine period. All these workers rejoined the works after recovery.

I. DETAILS OF GRIEVANCE REDRESSAL COMMITTEE AND COMPLAINTS RECEIVED FROM PUBLIC AND ACTIONS TAKEN THEREOF TO RESOLVE

17. The Grievance Redressal Committee has been constituted by HPPTCL. The grievances, if any are generally addressed at PIU level efficiently. There are eight nos. of PIUs under HPPTCL. The initial Grievances are received at PIU levels in case the grievance could not be attended at PIU level; the grievance is redressed by the Head/Corporate office-level grievance redressal committee. Copy of the office order regarding the constitution of Grievance Redressal Committee (GRC) at Corporate Office level & PIU level is provided in Annexure-XVII. Copy of the same is also uploaded on HPPTCL’s website (http://www.hpptcl.com/page/Office-Orders.aspx). Contact details of GRC are also displayed at project sites & PIU offices. No Environment safeguard related grievances were received during the reporting period.

J. PUBLIC CONSULTATION PUBLIC CONSULTATION DURING PROJECT IMPLEMENTATION FOR THE REPORTING PERIOD

18. Public Consultation is a continuous process and conducted throughout the project during design, pre-construction, construction and operation. One to one interaction with affected people/families or with very few people are being conducted frequently by PIU representatives at project sites. Organized consultations with the group of the people were avoided due to restrictions of maintaining social distancing to comply with Covid-19 guidelines. During the consultations, people showed their satisfaction with the project construction activities. Also, they were anticipating the development or other benefits (like jobs or business growth) to the locals during the operational stages of the project. Figure-2 below presents the sample photograph of consultation carried by PIU representatives at Bagipul Village with local people in the presence of Environmental Expert (HPPTCL) during the reporting period.

K. INSTITUTIONAL SET-UP FOR EMP IMPLEMENTATION

19. Environment & Social Monitoring Cell (ESC) at the PMU level has been constituted, a copy of the same is provided in Annexure-XVIII. Copy of the same is also uploaded on HPPTCL’s website (http://www.hpptcl.com/page/Office-Orders.aspx). ESC is headed by GM, Projects and supported by other members consisting, Sr. Manager Projects, Dy. Manager Projects Environmental Expert (Consultant) and Social Safeguard Expert (Consultant).

20. The Environment and Social Cell (ESC) monitors the policy and implementation related to environmental impacts of all projects of HPPTCL. Environmental Expert (Consultant) was mobilized during the reporting period in the team of ESC, HPPTCL to assist PIUs in all

environmental aspects of the projects in compliance with HPPTCL’s Environment and Social Safeguards Policy, May 2011 and ADBs Safeguard Policy Statement, 2009.

21. Environmental Expert (HPPTCL) visited different subprojects i.e., C/o 22/66 kV Gas Insulated Switchgear (GIS) Pooling station at Bagipul, c/o 66 kV double circuit (D/C) transmission line from 66 kV GIS Bagipul S substation to Kotla, c/o 400 kV (D/C) transmission line from 220/400 kV Lahal substation upto Rajera (Chamera II), 132/220 kV, 2x80/100 MVA GIS substation at Mazra, c/o 220 kV D/C transmission line from 132/220 kV GIS substation Mazra to 33/220 kV Karian substation, c/o 220 kV GIS switching station at Hatkoti in the month of December, 2020 to monitor the compliance status of Environment Safeguard measures at the site. PIU and Contractor’s representatives were also oriented with compliance requirements ADB’s Safeguard Policy Statement, 2009 during the site visit by the Environmental Expert. Figure-3 below presents the discussions carried during the interactive session by the Environmental Expert and representatives of PIU and Contractor at Bagipul Substation site during the site visit of Expert.

Annexure-XII: Status of Muck Disposal

As a result of construction-related activities, soil and debris is generated. Improper disposal of the debris will have an impact on the surrounding ecology, public health and scenic beauty. If not planned properly, dumped materials interfere with the drainage pattern of the area, any water bodies, agricultural lands, marshlands and down slope or any environmental sensitive areas. To avoid any impact on the environment, spoil materials (soil, sand, rock) generated from construction activities is being used for site leveling and back-filling (wherever possible). Wherever, there is excess muck, it has to be disposed at pre identified dumping site. Prior approval has to be obtained for such dumping grounds/land fill sites from relevant concerned authorities such as Forest, Roads, or Panchayats (local community) by the contractor as per contract provisions. Following is the status of muck disposal of the sub-projects.

1. 33/132kV GIS Substation Barshaini

Being the hilly area and steep site for construction of this substation, a huge volume of excavated soil (approx. 25,000 to 30,000 cum) needs to be dumped from the site of the substation. Excess muck approx. 14,000 to 15,000 cum needs to be disposed of at pre identified designated muck disposal location. For this private land has been acquired and an accord in the form of minutes of meeting held between negotiation committee and the land owner is attached over leaf. Provision of Protection works in the form of crate wall has been made by HPPTCL. The site is still in use and photograph of the site is shown below (LHS).

2. 66/22 kV GIS Baghipul Sub-Station

Site selection and development of layout design is such that the muck generated during the construction was minimum and was to be utilized in backfilling. If in future, there is an excess debris generation then it will be disposed of at pre identified approved sites.

3. 33/132/220 kV GIS Mazra Substation

As per design, the excavated material was to be utilized in backfilling. Though, a location in the land of HPPTCL land near to substation has been designated to dispose of excess muck. The site is in use and photograph of the site is shown below (RHS).
