WISHFUL OPINION vs. LEGAL FACT.....facts and opinions

MANY AGREE that St. Marie property titles need tobe legally cleaned up and that Article X of the ProtectiveCovenants needs to be clarified legally. The opinions of afew Investor/Developers Hold no water LEGALLY.THESE TWO ISSUES must be argued by lawyers in aCourt of Law with a Judge studying the LEGAL FACTS andmaking a Legal Ruling. To think otherwise is frivolousfolly. Having said that..... in comparison:LOOK at the current NVCCA (North Valley County CondoAssoc) efforts by Marv Bethea, Terry-Lee, Dan Dale, andMary Henry that appear stymied. WHY? ...by NOT followingLEGAL protocol and procedure. The so called NVCCADirectors and Association itself are INVALID as it standstoday. Folks cannot say and do whatever they wish and say itis so.....ITS NOT LEGAL. (Theyre not Attorneys or Judges)A MAILING was sent to all St. Marie post officeboxes addressed to Box Holder. It stated that a CovenantOwners gathering is to be held on Aug 15th in the BaseChapel to nominate and vote on 3 new Board Membersfor the Village, to make recommendations for the NewAmended and Restated Protective Covenants, and acceptpetitions for other issues. It noted Call XXX-XXXX forInformation- I called and Terry-Lee answered. Were allLEGAL PROCEDURES followed? NO - Will the meetingresults be LEGAL? NOLETS REFLECT and renagulate on the past.1. In 2013 nine out of over 1000 St.Marie condo owners hada meeting at the old post office, claimed a 51 % majorityof owners and held elections. It was held invalid becauseMike Mitchell of NSM LLC did not assign his many proxyvotes to that effort. (He put that in writing)2 In 2014 a protected covenants meeting was called toamend the covenants, WHY? It was signed by Frantz,Terry-Lee, and Bethea. Nothing came out of it.3. Now 2015 and another attempted Village Associationtakeover meeting! WHY? Could it be a repeat of the past?....take control, write self contracts, special assess, possiblyfine, lien and foreclose? Theres a resolution in force (came

out of Judges ruling) that states An association member inarrears cannot vote or hold office. Thats what got Bethearemoved from the Village Board in past, ironically Betheahimself wrote an NVCCA resolution stating the same thingwhen he was president of NVCCA! The Big 4 investor/developers are $330,436 in arrears on their Village bills asof 8-7-15!!EVANGELIST UPDATE- Preacher John Collins onceagain delivered an enlightening sermon! Before entering theBase Chapel I again spoke to Evangelist Collins on the Chapelsteps. I asked: Preacher, how do you intend to get some folksto Tell the Truth: and Do the Right Thing? John Collinsanswer was, A strong church promotes a strong town, Imhere to do good things, one person at a time. During hisservice he told the whole story of Apostle Paul, emphasizingthat he wanted to promote hope, pride, self esteem, and getthe community to come together. Preacher added that hewanted reduced Busy Bodying and Slandering. My answerto that is that Everyone writes their own story and the truthalways prevails. Those that through Due Diligence reportin an honest, ethical, legal fashion the facts and events of theday are doing so, to at times warn and protect other folksfrom financial and legal harm.SOME CANT HANDLE THE TRUTH!~ Nick Chiechi- Due Diligence*additions, corrections, opinions welcomed*
