B’DIN qiegħed jiġi mgħarraf illi peress li, skont l-Artikolu 17 (1) tal-Att dwar ir-Referendi, il-Qorti Kostituzzjonali tikkunsidra li r-rikors ta’ Mark Mifsud Bonnici u oħrajn tal-1 ta’ Ottubru, 2014 (Rik. Nru. 364/14), u dak ta’ Joseph Perici Calascione u oħrajn tat-2 ta’ Ottubru, 2014 (Rik. Nru. 365/14), u r-risposti għalihom, fil-materja tal-propost Referendum dwar jekk ir-Regolamenti dwar qafas biex tiġi permessa deroga li tiftaħ l-istaġun għall-kaċċa tal-gamiem u s-summien fir-Rebbiegħa (Leġiżlazzjoni Sussidjarja 504.94 – Avviż Legali 221 tal-2010), għandhomx jibqgħu iseħħu, huma ċari biżżejjed u ma humiex meħtieġa iktar sottomissjonijiet, u għalhekk tikkunsidra li ma hux meħtieġ smigħ dwarhom, l-istess Qorti Kostituzzjonali stabbiliet id-data tad-9 ta’ Jannar, 2015, fid-9.00 a.m. bħala d-data u l-ħin li fihom se tgħaddi biex tagħti d-deċiżjoni tagħha dwar ir-rikorsi msemmija, u dan skont dak previst fl-artikolu 17(6) tal-Att imsemmi.

REFERENDA ACT(CAP. 237)

IT is hereby notified that, in accordance with Article 17 (1) of the Referenda Act, the Constitutional Court considers that the application filed by Mark Mifsud Bonnici and others on the 1st October, 2014 (Appl. No. 364/14), and that filed by Joseph Perici Calascione and others on the 2nd October, 2014 (Appl. No. 365/14), and the replies thereto, in the matter of the proposed referendum on whether the Framework for allowing a derogation opening a Spring hunting season for turtledove and quail regulations (Subsidiary Legislation 504.94 – Legal Notice 221 of 2010), should not continue in force, are sufficiently clear and do not require further submissions, and therefore considers that no hearing is required, the said Constitutional Court has appointed the 9th January, 2015, at 9.00 a.m. as the date and time for the delivery of its decision on the said applications, and this in terms of article 17(6) of the said Act.

Skont il-Leġiżlazzjoni Sussidjarja 441.07, qiegħed jiġi approvat li stabbilimenti kummerċjali liċenzjati bħala stabbilimenti tal-catering, night-clubs, diskoteki jew xi post fejn isir iż-żfin jibqgħu miftuħin sal-4.00 a.m. matul il-lejl ta’ bejn l-24 u l-25 ta’ Diċembru, 2014 u matul il-lejl ta’ bejn il-31 ta’ Diċembru, 2014 u l-1 ta’ Jannar, 2015.

L-obbligi kollha li jikkonċernaw id-daqq ta’ mużika amplifikata jibqgħu japplikaw filwaqt li mhuwiex permess li jiġi kkawżat fastidju jew inkonvenjenza lir-residenti viċini b’xi xorta ta’ ħoss li jinstema’ minn barra l-istabbiliment jew b’xi aġir li jseħħ ġewwa jew barra l-istabbiliment. Fin-nuqqas ta’ konformità mad-dispożizzjonijiet ta’dan il-paragrafu l-Pulizija għandha il-jedd li tieħu kull azzjoni kif ipprovdut fil-Leġiżlazzjoni Sussidjarja 441.07.

MINISTRy FOR THE ECONOMy, INVESTMENT AND SMALL BUSINESS

Extension of Opening Hours on Christmas Eve and New Year’s Eve

In accordance with Subsidiary Legislation 441.07, it is approved that licensed catering establishments, night-clubs, discotheques or other premises where dancing is held may remain open until 4.00 a.m. on the night between 24th and 25th December, 2014 and the night between 31st December, 2014 and 1st January, 2015.

All obligations concerning the playing of amplified music remain unchanged and no annoyance or inconvenience to neighbours is permitted by any sound which may be heard from outside the premises or by anything else done inside or outside the premises. In the event of non-compliance with the provisions of this paragraph the Police may take any action provided under Subsidiary Legislation 441.07.

This is without prejudice to any other action which may be taken under the law.

No parking is allowed in Triq San Ġużepp, part of Triq il-Kunċizzjoni, Triq San Bastjan and Triq il-Kbira.

On Friday, 19th December, 2014, from 8.00 a.m till midnight of Saturday, 20th December, 2014, no parking is allowed in Triq il-Kbira (from St George’s Parish Church to Triq Santa Katarina.

That the necessity of this Application was solely instigated by the behaviour of the defendant as after February 2014, she persuaded the applicant’s mandator to come from Libya to Malta to spend some time with their minor son Karim, so that whilst she takes a holiday, she applies for Maltese citizenship.

4. That however after this and even after the mandator plaintiff had (ingenuously) accepted that their som Karim attend a kindergarten herein Malta, so that he be occupied and can learn something during their staying, which he believes was solely temporary, it happened, that since some months, the defendant, his wife, started to refute to return to Egypt with the minor and common son of their marriage.

5. That the applicant works as a pilot with an air charters company, and he cannot and does not want to bring the family to Malta, as is his right to chose as the head of the Egyptian, Family, and he cannot be forced to do this capriciously, or due to a unilateral decision of his wife, simply because she acquired Maltese citizenship ...omissis... when the conjugal home and the habitual residence of the minor are particularly in Egypt.

6. That thus it is upheld that by this behaviour the defendant committed and is persisting in the ‘abduction’ of their minor and common son Karim.

7. That in the interval of all this, the applicant mandator Atef started to send various funds to his wife in Malta to cover their maintenance as he felt it was his duty nothwithstanding that his wife was defying him. However, in order to continue defying him, his wife informed him that now as a Maltese citizen she can benefit from all the social services in Malta, and that she has already applied for the social services ...omissis... it is good that one knows that this Honourable Court knows that when the defendant came to Malta, her husband gave her three thousand Euro (Euro 3,000) in cash, and during the months he sent her various other amounts as shall be proved.

8. That this is being mentioned and stated because it is related to the fact of the ‘abduction’ by showing how the defendant is not credible and is a traitor, who can end up doing everything, to cut every point of return of their son to his country, but furthermore in order to further dishearten him and create complications for him, it is good that this Court knows that she is already inventing new allegations to try and create a case for separation.

9. Thus keeping in view that the applicant Nasr Eldin has the patria potestas over son according to the Egyptian law to the exclusion of the mother, apart from the fact that the care and custody of the minor is not an exclusive right of the mother, the applicant nomine is asking this Honourable Court so that saving the necessary ascertainments and necessary proof.

1. It declares that the refusal on the part of the defendant to return her minor son Karim (four years) to the father and to their habitual residental home amounts to ‘international abduction’.

2. The fact that the defendant took Maltese citizenship has no relevance against such proposal.

3. That every allegation in this cause or in another procedure that can be introduced of lack of maintenance, excesses, insults and other things as a pretended basis for personal separation is to be considered ultra vires, and considered as a separate thing which should not obstruct or

Illi fl-intervall ta’ dan kollu, l-attur mandanti Atef beda jibgħat diversi flejjes favur martu f’Malta biex ikopri l-manteniment tagħhom billi ħass li dan hu dover tiegħu nonostanti li sfida li tagħmillu l-konvenuta. Però, biex tkompli tisfida, il-konvenuta infurmatu li issa bħala ċittadina Maltija tista’ tibbenefika mis-servizzi soċjali kollha f’Malta, u li anżi diġà applikat għall-għajnuna soċjali...omissis... tajjeb li dina l-Onorabbli Qorti tkun taf li meta ġiet Malta, il-konvenuta żewġha kkonsenjalha tliet elef Ewro (Ewro 3,000) fi flus kontanti, u matul ix-xhur bagħtilha diversi ammonti oħra kif jista’ jiġi ppruvat.

By a decree of the Court of Magistrates (Malta), of the 5th November, 2014, the publication of the following extract was ordered for the purpose of service in terms of Article 187 (3) of the Code of Organisation and Civil Procedure (Cap. 12).

Jeffrey Francalanza (ID 478185M), of St Gerald, Flat 3, Bordin Street, Gwardamanġa, and Alan Darmanin (ID 178284M), of 102, Triq id-Duluri, Ħamrun, in their own name, and for and on behalf of Glow Promotions, and also as organisers of the contest Face of Malta, filed a Claim, on the 18th July, 2014, whereby they asked the Court to condemn Casey Pace (ID 128296M), of Dhalia Flats, Flat 2, Triq Paceville, Paceville, and/or Ent. E, Flat 4, Triq Ġużè Ellul Mercer, Swatar, to pay the plaintiff, the sum of €8,150 which amount is due to the plaintiff.

In the meantime, you are being warned that if you fail to make what is being requested from you within the stipulated time limit, the interpellant company will be constrained to proceed further against you in Court without further notice.
