A RESOLUTION authorizing City Mayor Arlene B. Arcillas to sign and represent the City of Santa Rosa, Laguna in MEMORANDUM OF AGREEMENT by and between the Pamatansan ng Cabuyao, University of Perpetual Help System Laguna, Polytechnic University of the Philippines Santa Rosa in connection with the Accreditation of the CICL-Child in Conflict with the Law/Bahay Pag­asa Facility.

MEMORANDUM OF AGREEMENT

This Memorandum of Agreement made and executed between:

UNIVERSITY OF PERPETUAL HELP SYSTEM LAGUNA, a non-stock, non- profit educational institution, duly organized and existing under Philippine Laws with the office/business address at City Bifian, Laguna 4024 represented herein by , Dean, College of

------herein after referred to as the UNIVERSITY.

CITY GOVERNMENT OF SANTA ROSA, a Local Government Unit duly organized and existing under Philippine Laws with office/business address at J.P. Rizal Boulevard, City of Santa Rosa, Province of Laguna 4026, represented herein by ARLENE .8. ARCILLAS, City Mayor, hereinafter referred to as the LGU. .

WITNESS ETH:

The parties hereby bind themselves to undertake a Memorandum of Agreement for the purpose of supporting the UNIVERSITY'S on-the-job training for student-trainees under the following terms and conditions:

l. That the on-the-job student-trainee will be conducting practicum at CICL-Child in Conflict with the Law premises (Bahay Pag-Asa) located at Barangay Sinalhan, City of Santa Rosa, Province of Laguna.

2. The UNIVERSITY shall be responsible for briefing the on-the-job student-trainees who intend to conduct practicum exposure in the LGU as part of the UN[VERSITY'S curriculum;

3. The UNIVERSITY shall provide the on-the-job student-trainee the basic orientation on work values, behavior, and discipline to ensure smooth cooperation with the LGU; That the on-the-job student-trainee shall abide by the LGU's rules and regulations and shall comply with the policies and standards of the training program.

4 . The UNIVERSITY shall issue an .official endorsement vouching for the well being of the on-the­job student-trainee;

5. The UNIVERSITY shall voluntarily withdraw a student-trainee who is found to misbehave and/or act in defiance to existing standards, rules, and regulations of the LGU and impose necessary university sanctions to the said student-trainee:

6. The LGU, upon consultation with the UNIVERSITY, may require qualified students to submit themselves to examinations, interviews, and file pertinent documents to support their application;

7. That the time spend on the training/program in the completion of the on-the-job training requirements will not and should not be interpreted or construed as working hours and should be regarded as non-compensable. The LGU is not obliged to employ student-trainee upon completion of the training;

8. The student-trainee shall be personally responsible and made answerable for any and all liabilities or for damage to property or injury to third person arising from negligence in the performance of his/her duties and functions while under training;

9. The student-trainee shall likewise hold the LGU and UNIVERSITY free from any liability and responsibility for any sickness or injury to him/herself and third parties and damage to property which he/she may sustain and/or may occur at any time during the training program period including the time spent in travelling to and from any and all premises and locations where the student-trainee may be required to go as part of the training program;

10. There is no employer-employee relationship between the LOU and the student-trainee;

1 l. The duration of the program shall be equivalent to at least 200 working hours unless otherwise agreed upon by the LGU and the UNIVERSITY;

12. Any violation of the foregoing covenants will warrant the cancellation of the Mt:morandum of Agreement by the LGU within thirty (30) days upon notice to the UNIVERSITY;

13. This Memorandum of Agreement shall become effective upon signature of bo h parties and implementation will begin immediately and shall continue to be valid hereafte, until written notice is given by either party thirty (30) days prior to the date of intended terminati :m.
