An FIR was registered against the Maran brothers – Dayanidhi Maran, Kalanidhi Maran, Ralph Marshall and T Anandakrishnan yester- day, under the Prevention of Corruption Act. The CBI conducted searches in Chennai, Hyderabad and Delhi. The CBI also conducted raids at Apollo Group's Sunita Reddy's residence. Reddy, who has not been named in the FIR, was the chairperson of Aircel in 2005. The raids were being conducted in connec- tion with the Aircel-Maxis deal. The CBI had claimed earlier that it found clinching evi- dence against DMK leader Dayanidhi Maran in the Aircel-Maxis deal. The CBI alleged that Maran deliberately de- layed the licences to Aircel and that he did un- due favour to Maxis and in return investments were made by the company in Sun TV, which is a sister concern of Astro Netwrok, a company owned by one of the Maran brothers Ralph Mar- shall. The CBI alleged that kickbacks of almost Rs 600 crore were given to Maran brothers after the favour to Maxis Group. The main charges against the Maran broth- ers are those of conspiracy, misuse of official po- sition, giving bribe and accepting bribe. Reacting to the raids, Janata Party President Subramanian Swamy said, "I'm not surprised. All who have benefited should be brought to book and they should begin with Chidambaram, who has direct involvement in the spectrum scam." BJP leader Varun Gandhi tweeted, "Dayanid- hi Maran FIR long overdue, but still welcome move. You cannot use a Central ministry to fund a family business empire." Balakrishne hearing put off to Oct 26 Bangalore: The Lokayukta special court today adjourned the case of former KAS officer H D Balakrishne Gowda to October 26. Special court judge N S Sudheendra Rao also directed the Lokayukta police to submit an in- vestigation progress report to the court on Oc- tober 22. The Lokayukta police, who were sup- posed to submit the report today, sought more time. The court was hearing a case related to Pre- vention of Corruption Act against Balakrishne Gowda, who is the son of JD(S) national presi- dent H D Deve Gowda. Balakrishne Gowda has allegedly amassed wealth disproportionate to known sources of income. Balakrishna, a retired employees of Visves- varaya Iron and Steel Ltd, had filed a private complaint against Balakrishne Gowda that he nearly owns properties worth over Rs 550 crore in and around Bangalore. He also alleged that the former KAS officer, who opted for voluntary retirement, owns benami properties and prop- erties in the name of his wife Kavitha H and his brothers. As a KAS officer he could have earned only few lakhs of rupees and how did he man- age to amass properties running into several hundred crores, the complainant has ques- tioned. He was talking to media persons at the Hubli airport before leaving to Belgaum to inspect the construction of Suvarna Soudha. He said, “I will not make any allegations against the central government. But they should understand the power situation in the state. On October 14, a del- egation from the state will meet central coal minister, railway minister and sub- mit a memorandum on the supply of coal to the state to produce power.” Coal supplies to the state have been affected due to Telangana-related strike in Andhra Pradesh. “We will request the railway minister to chalk out an alternative route to supply coal to the state,”he said. “I have held talks with of- ficials of Udupi Power Cor- poration Ltd to produce power in Unit 2. With this, we can cope up with the shortage of power,” he said. “I will discuss with the energy department officials about the power situation in the state within two days and will decide whether we have to resort to load shed- ding or not.” “The government has not decided on load shedding and the people should not panic. It is only because of shortage of coal supplies. It will be set right in 10 days. We have decided to meet officials and ministers concerned,” the chief minister said. Caring about mental health Coffee Day cashier stabbed, cash looted Bangalore Beat Bureau Bangalore: A cashier at a Coffee Day outlet was stabbed and mon- ey in the cash counter was stolen at Kengeri Satellite Town last night. Five persons entered the out- let around 11.15 pm. After drink- ing coffee and running up a bill of Rs 370, one of them com- plained to the staff that there was no water at the toilet. When two workers went inside the toilet to address the issue, they were locked from outside. The miscreants then attacked cashier Abinash (22), stabbed him in the chest with a knife. They took away Rs 10,000 cash, a 13 gm gold chain and three mo- bile phones. Abinash, who received serious injuries, is being treated as an in- patient at BGS Hospital. Sadananda Gowda Money is nothing for BBMP No financial records for more than 15 yrs Aknisree Karthik Bangalore Beat Bureau Bangalore: “Money leaks out of the BBMP funds without any track or record being kept of it.” Says A L Shivakumar, chair- man, standing committee for ac- counts. “"The palike is under- going huge financial loss as it does not have any accounting system. It does not have an in- ternal auditing system right from the year 1964. Nobody knows how many employees the palike has and nobody knows how many vehicles the palike owns. Nothing is sys- tematically done here and there are no documents and files. For instance, if the palike gets Rs 10 lakh, they show that the whole amount has been spent without any other documents support- ing it. Also if the palike receives a cheque they fail to present it and they leave the cheque to be- come a stale cheque. The palike has about 480 days to pay the contractors through the 'Hundi' system, but they pay within 20- 30 days". The BBMP appears to be con- ducting its financial operations in a highly irregular and un- ethical manner. It has not main- tained any financial records for more than 15 years and due to an alleged mismanagement of funds, the BBMP has lost more than Rs. 150 crore. Ultimately it is the tax payer who suffers due to this cavalier attitude towards their money. The palike does not have any systematic accounting system and its officials do not seem to know how many Current Ac- counts they have and the amount of money that is in it. There are many Fixed Deposits for which the palike has no record and they have not col- lected the interest for these Fixed Deposits in a long while. In attempt to salvage the sit- uation, Shivakumar says “We are planning to computerize the whole system as the money leaks out of the system like any- thing. When we searched for documents, we could not find documents of many years. We are planning to 'special audit' the accounts of last 15 years. And when that is on, we along with the advice and guidance from 8 Charted Accountants, who have a great deal of social commit- ment, and financial experts from Indian Institute of Man- agement have planned to make the whole accounting system computerized. This will plug all the leaks. The Municipal Re- forms Administrative System has developed software which is used by 213 municipal corpora- tions. We are planning to come up with such software with an online accessibility and which ensures transparency. We will present this proposal in the up- coming BBMP Council meet and get the approval.” Noted ghazal singer Jagjit Singh dies Mumbai: Acclaimed ghazal singer Jagjit Singh died today in Mumbai. The 70-year-old was admitted to Mum- bai's Lilavati hospital after he suf- fered brain hemorrhage last month. He underwent two surgeries and was on life support. Born on February 8, 1941, 'the ghaz- al king' was a singer, composer, activist and entrepreneur. He has sung in several languages including Hindi, Urdu, Punjabi and Nepali. CBI raids Maran, files FIR

Chennai: The CBI today conducted raids at for-mer telecom minister Dayanidhi Maran's resi-dence in connection with the 2G spectrumscam.

Hubli: The people of thestate need not panic onthe power situation in thestate, said chief minister DV Sadananda Gowda.

Assocham opposes norms for NBFC NPAs

Bangalore: Industry body Assocham hasopposed the government’s classificationof non-performing assets (NPAs) belong-ing to non-banking financial companies(NBFCs) which provides for secured andunsecured advances if the overdue periodexceeds 90 days.

Under the existing norms, an unsecuredasset overdue beyond 90 days and a se-cured asset overdue beyond 180 daysare treated as NPAs.

“NBFCs are a major source of fundingfor unorganised sector of the economy.The revised classification will eventuallyincrease capital requirements of NBFCsand their cost of lending,” said the Asso-ciated Chambers of Commerce and In-dustry of India (Assocham) in responseto draft recommendations of the ReserveBank of India (RBI) working group.

It also suggested an enhanced timeframe of five years due to difficult anduncertain economic conditions for tierone capital for capital to risk weightedassets ratio (CRAR) at 12 percent – insteadof within three years as proposed by thegroup.

NBFCs should be allowed to deploysurplus liquidity in government securities,treasury bills and money market withmaturity beyond 30 days. For computingtotal financial assets, cash and bank de-posits, such instruments may be deductedand treated as part of financial assets,said Assocham secretary-general D S

Rawat.On regulating loans to stock brokers

and merchant bankers, it suggested thatstatus quo may be maintained as thepresent restriction of capital market ex-posure of 10 percent of net worth bybanks will restrict the ability of NBFCs tolend to this sector.

To increase CRAR from 100 to 150 per-cent for capital market exposure and 125percent on real estate exposure, the cham-ber said this will increase the cost of bor-rowing for NBFCs and also be a deterrentfor banks to lend to NBFCs.

Borrowing through external commer-cial borrowings (ECB) route or NBFC is

currently prohibited. It should be allowedso that NBFCs have a window to raisefunds at substantially low rate of inter-ests.

Any further tightening may create sys-temic risk for the sector. Mr Rawat saidno asset size ceiling should be insisted ifthe NBFCs are not accessing public fundsfor registration with the RBI.

Inter-corporate deposits may be ex-cluded from the definition of public fundswhere the lending company has not re-ceived any public funds and both thelending as well as borrowing companybelong to the same group.

As the term business has not been de-

fined, companies which are holding long-term investments in shares of group com-panies (and thus are merely investmentcompanies) may not be considered ascarrying on the business of NBFCs.

To tackle the problem of bad assetsand asset recovery, the RBI WorkingGroup has proposed that NBFCs shouldbe brought under the Securitisation andReconstruction of Financial Assets andEnforcement of Security Interests (SAR-FAESI) Act. The chamber said it is a boldstep and NBFCs should be able to accessthe service of Debt Recovery Tribunalsas well.

Existing non-deposit taking NBFCshaving a net worth above Rs 500 croreand desirous of converting to NBFCs-Dshould be allowed to do so automaticallywith intimation to the RBI.

Also, assessing officers may be directedto issue nil tax deducted at source (TDS)certificates wherever the customer baseexceeds 1,000 subject to the conditionthat the assessed pays an advance amountequal to the average of its tax paid inlast three years.

NBFCs account for nearly 12 per centof advances of the total financial systemand can play a major role in furtheringfinancial inclusion. There are 12,630NBFCs registered with the RBI providingcredit delivery in asset financing andhire purchase. In 2010-11 they deliveredcredit to the tune of Rs 4.62 lakh crore.

NGOs demand govt passmining bill in next session

Bangalore: The mines and minerals(development and regulation) bill of2011 has to be tabled and passed withoutamendments in the winter session ofParliament, NGOs, who have been work-ing with tribals and others affected bythe mining industry, have demandedthe government.

The NGOs point out that a staggering82,000 accounts of illegal mining havebeen reported in western parts of thecountry, especially in Karnataka andMaharashtra. Violations have also takenplace in Jharkhand, Chhattisgarh andOrissa.

The Mines Minerals and People(MMP), an NGO, has conducted a studyafter coordinating with other not-for-profit organisations working in the field,like Samatha in Andhra Pradesh, San-thulam in Maharashtra, Patar Kadhamand Mazdoor Sangha in MadhyaPradesh, Jan Chethana in Chhattisgarh,Adivasi Mahasabha in Jharkhand, So-ciety for the Project Affected People inWest Bengal, Kasi Students’ Union inMeghalaya, POSCO Prathirodhak Sang-ha in Orissa.

The billnot only aims at stricter regulations onmining activities, but also stipulatesthat a part of the mining proceeds beshared with the affected communities.The bill specifies that 26 percent of allearnings by the mining companiesshould be shared with communitiesliving next to mining areas.

NGOs have been demanding that thecommunities should also be made partowners of the mines.

The government is now ponderingover the revolutionary concept. But theindications are that the governmentmay not agree for part ownership, butis amenable to sharing the profits bymining companies.

MMP coordiator R Sridhar and hiscolleague Aruna Chandrashekar toldBangalore Beat: “We have been de-manding part ownership in the interestof communities affected by illegal min-ing. Not just iron ore, but all miningactivities, including coal and granite,should be brought under the rule.”

They said, “We have been workingin areas affected by illegal mining ac-

tivities, and the general degradation ofenvironment and adverse effects on thepeople in these areas is disturbing. Thegovernment and mining companieshave been talking about rehabilitationof these communities. But that is outof question.”

The NGO has carried out the studyamong more than 150 communities,which are directly or indirectly, affectedby mining activities. “We have workedwith other NGOs and collated informa-tion from different states,” they added.

Asked how do they wish to work onthe rehabilitation of the communities,they said, “First, the government hasto pass the MMDR bill. Only then canwe address issues affecting these com-munities. Environmental aspects of il-legal mining too need to be workedout.”

The new act would lay down rulesfor miners, depending on land owner-ship and encroachment that occurredearlier. “In many cases, the lands re-turned by miners to the governmentare not in order. A lot of violations haveoccurred. Miners, who came up withsteel plants and plundered the naturalresources, need to be penalised.”

All NGOs working in the field arekeen that issues like protection of landrights, environment and resettlementand habitation are addressed properly,they added.

Jagjit Singh entered the musiccircuit at a time which was pri-marily dominated by Pakistanighazal singers, and Indiansingers were considered relativelylesser authentic than their Pak-istani counterparts.

Unlike other ghazal singers,Singh did not hesitate in lendinghis voice for films. His silky voiceruled during early 80's in filmslike Prem Geet, Saath Saath andArth. However, his major workis spread over more than 60 filmyand non filmy albums.

Jagjit Singh was also knownfor modern approach and infu-sion of technology in the tradi-tional art of ghazal singing. Singhwas the first Indian music di-rector to use the technique ofmulti-track recording for his al-bum 'Beyond Time'.

Recipient of Padma Bhushan,Jagjit Singh was the man behindmaking the ghazal genre avail-able and understandable to all.Prior to Singh, ghazal singingwas considered as an elite art,

which was difficult for the com-mon mass to understand due tohigh class Urdu and Persian.

Jagjit Singh broke this mythby coming up with songs suchas 'Kaagaz ki kashti', 'Chaak jigarke', 'Kal chadhanvi ki raat thi',and 'Shaam se aankh me namesi hai'. He mixed the words oflegends like Ghalib, Qateel Shifai,Firaq Gorakhpuri, Nida Fazli andSudarshan Faakir with melodi-ous indigenous tunes andachieved a state where nothingcame in between him and hislisteners.

When TV started showcasingmusic videos, he was among theprominent members of the musicfraternity to avail of the facility.He again came up with brilliantalbums such as 'Face to Face','Marasim', 'Aaeena', and 'DilKahin Hosh Kahin'.

He is survived by his wife Chi-tra Singh, with whom he hadproduced several record-breakingalbums. Their only son VivekSingh had died in a road accidentin 1990.

After he lost, Nataraj had harassed Mu-rugan and his followers. A frustrated Mu-rugan gave supari for Rs 25 lakh. The firstinstalment of Rs 5 lakh had been paid.”

Murugan, who runs his establishmentbehind Nataraj theatre, had got in touchwith accused Girish and Ashok through hisacquaintance Mani. The murderers had alsosought the help of Rajendra alias A Paul,who was a close associate of Nataraj for thelast 10 years. The plot to kill the corporatorwas being hatched for the last seven toeight months.

Rajendra had also passed on the infor-mation that Nataraj was planning to getMurugan killed. That was also one of thereasons for Murugan to give the supari, thepolice commissioner said.

Girish received the first instalment of thesupari money. He got in touch with hisfriends and co-accused Vijay Kumar, Mohan,

Srinivas, Nagesh, Naveen and Mahesh toexecute the murder. In fact, a month ago,all the accused had gone in a car bearingregistration number (CKH – 4362) and madea vain attempt to kill Nataraj.

Mirji said, “The accused had hatched anintelligent plot to kill the corporator. Theyhad not left any clues at the spot of the

murder. The special police team formed tonab the culprits has managed to crack thecase in 10 days.”

For almost 20 days, they kept track ofcorporator’s movements. On October 10,they followed Nataraj, who was riding amotorcycle, and butchered him using longknives and machetes, Mirji said.

The arrested are: Mohan (24), a residentof Kurubarahalli; V Srinivas (29), a residentof Bagalagunte; Girish D R (28), a residentof Sreerampura; Mani V (30), a resident ofSeshadripuram, R Murugan (45), a residentof Seshadripuram, Rajendra alias A Paul(27), a resident of Gandhinagar; Mahesh DR (24), a resident of Sreerampura; and Ashok(29), a resident of Bangarappa Nagar.

Two accused are Naveen and Nagesh areabsconding.

The police have seized the car used forthe crime, four long knives, one dagger anda mobile phone.

disturbed. “People’s participation is very important to es-

SC stays Kasab'sexecution

New Delhi: The Supreme Courttoday stayed 26/11 accused AjmalKasab's execution and issued anotice to the Maharashtra gov-ernment on his plea. Kasab's ex-ecution has been stayed till am-icus curae report is heard. TheSupreme Court will hear Kasab'scase regularly from January 31,2012.

The apex court has asked thestate government to reply toKasab's plea. No specific timeframe has been set for the Ma-harashtra government to reply,but the court stressed on thefact that the case would be dealtwith expeditiously.

While passing the order, thejudge said that the case has tobe decided on a top prioritybasis, adding that after such actsKasab does not deserve an ap-peal.

The case is in its preliminarystage in the Supreme Court.Around three to four monthsback, the court first heard Kasab'scase in which most documentswere in Marathi and it asked thegovernnment to come back withthe documents translated in Eng-lish.

Special Public prosecutorUjjwal Nikam said that since thiswas a judicial process no specifictime frame can be set.

It has also appointed Raju Ra-machandran as the amicus cu-rae.

Kasab was convicted on thecharges of criminal conspiracy,waging war against the nation

and murder. Kasab, the sole con-vict in the case, has filed the pe-tition through jail authorities inthe SC which has appointed sen-ior advocate Raju Ramachan-daran as amicus curie to assistit in deciding the appeal.

On September 2, the apexcourt had agreed to hear theplea of Maharashtra governmentagainst the acquittal of two ac-cused Faheem Ansari andSabauddin Ahmed in the 26/11case.

It, however, had refused topass any order on Kasab whenthe state government pleadedthat his letter to the SupremeCourt challenging his death sen-tence should be tagged with thisappeal.

"We are taking a step regard-ing this (Kasab's letter)," thebench had said.

The Bombay High Court hadin its February 21 verdict upheldthe trial court order of deathsentence of Kasab for the 'brutaland diabolical' attacks aimed at'destabilising' the government.

Kasab's death penalty was up-held on charges of criminal con-spiracy, waging war against thenation, IPC section related tomurder and under sections ofUnlawful Activities (Prevention)Act.

The Bombay High Court hadalso upheld his conviction on19 counts under IPC, Arms Act,Explosives Act, Explosive Sub-stances Act, Foreigners Act, Pass-port Act and Railway Act.

The trial court had acquittedFaheem and Sabauddin.

Kasab, the sole 26/11 terroristcaptured alive, had been sen-tenced to death by a special anti-terror court on May 6 last year.

He and his accomplices hadlanded at Budhwar Park in SouthMumbai on November 26, 2008night from Karachi by sea andwent on a shooting spree at var-ious city landmarks, leaving 166people dead and many morewounded.

He urged scientists and facultyof Nimhans to take up the issueand find a cure for issues con-cerning mental health of the peo-ple.

“Today, Bangalore has becomethe suicide capital of the country

as a lot of people are sufferingfrom mental illnesses and stress.The life has become mechanicaland people don’t have time torelax and entertain themselves.This is leading to high levels ofstress, culminating in suicides.There have been many caseswhere people have committedsuicide over petty issues,” hesaid.

Nimhans should take up men-tal health workshops to helppeople cope with stress. Theyshould seek the help of NGOs inturning the programme effective.

Nimhans has been a reputed or-ganisation turning out good doc-tors. “It is evident from patientswho get cured here fast,” hecommended.

The state government is com-mitted to set up a nursing andpara-medical university in thestate. Already, a committee hasbeen set up to study the feasibilityand submit a report. The pro-posal will be placed in the nextassembly session, he said.

Sibal also said that he wantsIndia to become a hub fortelecommunication. "Draft NTPtargets broadband on demand,"Sibal said.

The draft telecom policydelinks spectrum from licence.According to it, radiowaves willbe made available at marketprice.

Revenue generation for gov-ernment will have secondaryrole under draft NTP, Sibal said.

He also said that 300 MHz ofspectrum will be made availableby 2017 and

200 MHz will be made avail-able by 2020.

CAG auditors todepose as PAC

meet on 2GNew Delhi: Fireworks are ex-pected at the Public Accountscommittee (PAC) meet on Mon-day with the Opposition set totear into the government on thefinance ministry's 2G note, whilethe Congress will try to rebutthe CAG's alleged inflated lossesin the spectrum allocation.

PAC has decided to call DeputyCAG RP Singh to depose as wit-ness. CAG Vinod Rai and DeputyCAG Rekha Gupta will deposeto explain how the total amountof loss was arrived at.

Rai wrote to PAC saying hecan explain loss figures.

The documents accessed byCNN-IBN had suggested that Di-rector General Audit RP Singhcalculated the issue of UnifiedAccess Licences and allotmentof spectrum caused a loss of Rs2645 crores.

While the CAG headquarterson its own hiked the loss to Rs1,76,000 crore. And that differ-ence of opinion had cropped upbetween Deputy CAG Rekha Gup-ta and Singh during report fi-nalisation.

In the PAC meeting on Mon-day, the Congress is expected torebut the CAG's allegedly inflatedlosses.

However, the BJP will wantto know why the finance min-istry's note which embarrassedHome Minister P Chidambaramwas not a part of official records.

The PAC has 22 members andthe UPA is one short of a major-ity.

Earlier, Finance MinisterPranab Mukherjee distancedhimself from inferences in theFinance Ministry note, whileHome Minister P Chidambaramclaimed that the matter is closed.

But the BJP disagreed andasked how Chidambaram canclose the 2G issue when he him-self is under the scanner.

The party demanded resigna-tion of the Home Minister P Chi-dambaram, saying loss couldhave been stopped if he had tak-en correct decisions.

The CBI had also defendedthe Home Minister in the

Supreme Court saying it's easyto "attack the Minister as it'sfruitful politically".

The agency further arguedthat the finance minister couldnot have cancelled the licencesby himself as it had to be a majorpolicy decision by Government.

"It is not an easy matter totake a decision and you cannotattach criminality against theFinance Minister," the CBI said.

"It must be the job of a hackerbecause I have never used a pub-lic computer nor have I sharedthe financial details of my cardwith anyone," Shukla said.

Not just Shukla, recently, in-dustrialist Kumar Mangalam Bir-la's credit card was reportedly

cloned and used to make a pur-chases worth Rs 2.8 lakh in Ban-galore, while Birla was in Mum-bai.

The crime isn't that difficultto pull off. The first way is bycloning or skimming your creditcard, where all the details areobtained through a pager-sizedscanner and copied on to a coun-terfeit card. Often, this is donewith the help of a bartender or asalesperson.

The second way is phishing,that is, stealing sensitive infor-mation like usernames, passwordand credit card details wherefraudulent websites disguise aslegitimate ones to steal sensitivedata.

Cyber security expert DominicKarunesudas said, "The key toreducing online credit card ordebit card fraud is only throughtraining and awareness."

HC OKs GujaratLokayuktaʼs appointment

Ahmedabad/ New Delhi: TheGujarat High Court has upheldthe Governor order appointingJustice RA Mehta as the Lokayuk-ta of the state. While upholdingGujarat Governor Kamla Beni-wal's appointment order, theHigh Court observed that anyadvice by council of ministerswould have been unconstitu-tional.

Governor Kamla Beniwal hadappointed Justice RA Mehta asthe Lokayukta without consult-ing the Chief Minister NarendraModi, which led to accusations

and counter-accusations amongthe Bharatiya Janata Party (BJP)and the Congress.

The BJP had moved the HighCourt against the Governor's de-cision and challenged JusticeMehta's appointment as the stateLokayukta.

A BJP delegation, led by vet-eran leader Lal Krishna Advani,had also met President PratibhaPatil demanding recall of theGujarat Governor. Modi had alsowritten a letter to Prime MinisterManmohan Singh demandingthat the governor be recalled.
