Howard James Billingsley, born in Phoenix, May 20, 1936, died in Payson, Jan. 19, 2013. As a youngster of eight years, this third generation Arizona native rode the Coronado Trail on horseback with his father. As a young man he water-skied on Apache Lake for bragging rights and a few trophies. Howard met his sweetheart when they were 14, and when

they began dating three years later, a romance that lasted six decades began. Together they raised three children and had many adventures motorcycling, camping and hunting in the mountains or boating at the lake. His family shares fond memories of Howard cooking breakfast on these summer trips and telling tales around the fire in the evenings. As grandchildren were born, “Grandpa” was

Howard James BillingsleyMay 20, 1936 - January 19, 2013actively involved in their lives, cheering them on in their achievements. Family was important to Howard and in 2000 he organized a family reunion attended by 100 people from across the United States. After attending the University of Arizona Howard went to work for the copper mining company Kennecott (Asarco) first as an assayer in the lab, then onto metals accounting. He retired after 34 years as a Front Line Supervisor for the open pit mine. The Billingleys raised their

family in Kearny where Howard was active in the community as Assistant Fire Chief for the volunteer department. A gregarious man, now-grown children of that community were always coming up to say hello to the man they remembered as their Boy Scout Master, Little League Umpire, or the man who dressed up on Halloween as “Granny Goodwitch”, and told them they were supposed to say, “Happy Birthday.” A member of the York Rite Body in Winslow, Howard was a Master of the White Mountain Masonic Lodge

#3 in Globe and a four-time Master of the Ray-Winkleman Masonic Lodge #24 in Kearny. Upon retirement, Howard and Shirley moved to a home in Payson, triple the size of their little one in Kearny so there was plenty of room for visitors. He was active in the Masons, was a AARP tax preparer, an Inspector of Precincts for the Gila County Election Board, and a Mogollon Health Alliance volunteer, giving more than 2,000 hours of service in 10 years. When you asked Howard a question he would often say, “Well...” and then the story would come. Howard is survived by his loving wife of 56 years, Shirley Billingsley; children, Karen (Rich) Thomas of Winslow, Sandy Billingsley of Florence, and Ken (Teresa) Billingsley of Mesa; 10 grandchildren, Jennifer Torres (Mateo Lawrence),

Marco Torres (Stephanie), Carmen Alonzo (Tony), Patrick Thomas (Anna), Dorothy Bryer (Eric), Michelle Thomas, Matthew Simpson (Carley), Katie Billingsley, Eric Billingsley and Kendra Paynter; and six great-grandchildren, Tallon Simpson, Lilly and Lexi Torres, Santana Lawrence, Xavier Alonzo and Josiah Paynter. Howard is also survived by his sister June Jacobs and nephew Mike Jacobs. Howard was preceded in death by his parents, Bob and Rose Billingsley. In lieu of flowers donations can be made to Hospice Compassus or the Humane Society of Central Arizona. Memorial services were held at 1 p.m., Saturday, Jan. 26, at Ray-Winkleman Lodge #24, 318 Fairhaven, Kearny, and will be held at 1 p.m., Saturday, Feb. 2, at Payson Masonic Lodge #70, 200 East Rancho, Payson.

Jose V. Martinez passed away on Friday, Jan. 25, 2013 at Santa Rosa Care Center in Tucson. He was born in Hayden on March 6, 1927 to Epimeniro Martinez Sr. and Josefa B. Ramirez. Jose proudly served in the U.S. Army during World War II as a military police-man stationed at Ft. McKin-

ley, Manila, Philippine Islands. Upon his return home he worked as a boiler-maker at ASARCO for 38 years before retiring. He was preceded in death by his father Epimenio Mar-tinez Sr., his mother Josefa B. Ramirez and stepfather Antonio Ramirez Sr., and his brothers, Manuel Marti-nez Sr. Epimenio Martinez

By Mila Besich-Lira Sterlite Industries, a subsidiary of Vedanta Resources, the London-based FTSE 100 metal and mining group, announced in March 2008 the signing of an agreement with Asarco, for purchase of, substantially, all the operating assets of Asarco. The then bankrupt Tucson-based Asarco agreed to sell all its copper mining assets to a subsidiary of Sterlite Industries of India. The agreement at the time was subject to the approval of the U.S. Bankruptcy Court for the Southern District of Texas, Corpus

Christi Division. But in May of 2008, Sterlite Industries decided to back out of the purchase, claiming that it was due to the economic downturn and the declining cost of copper. Asarco successfully sued Sterlite over the breach of the purchase agreement. Federal Judge Richard S. Schmidt found that had Sterlite not breached the purchase in 2008 the reorganization of ASARCO could have been complete by March of 2009. Because of the breach, it took until November of 2009 for the bankruptcy court to approve Asarco’s

purchase by Grupo Mexico. Judge Schmidt also found that there were no provisions in the purchase agreement to allow Sterlite to back out of the purchase due to declining global economics or copper prices. He awarded Asarco $132.8 million in damages, less a $50 million letter of credit that Asarco was authorized in 2009 to draw down. Sterlite Industries will be heading back to court to fend off another lawsuit stemming from the breach. Upon backing out of the agreement the company did not pay their legal fees to

Sterlite Industries sued for breach of contract in failed ASARCO purchase

Harkins Cunningham LLP. On Wednesday, Jan. 23, 2013, Harkins Cunningham LLP filed a breach of contract suit against Sterlite. Harkins claims that Sterlite owes the firm $80,000 for services rendered over a 30-day

period while the company was planning on acquiring ASARCO for $2.6 billion. Harkins claims that Sterlite breached their written agreement. The law firm has attempted to collect payment from Sterlite

for the services rendered for three years. They are seeking payment of legal fees, plus prejudgment interest, costs and other expenses.Story compiled from an article posted online at Law360.com.

By Mila Besich-Lira During the Hayden Town Council meeting on Tuesday, Jan. 22, 2013, the council heard from many citizens regarding the recent dismissal of the Animal Control officer who was hired in late 2012 and other safety concerns. Katie Quinn who was the person originally hired as the Animal Control

Officer specifically expressed her concerns that she was let go without cause. She explained her qualifications stating that she has a bachelor’s degree in Animal Sciences and is capable of writing grants to further aid her in the position during public comments. Hayden Mayor Monica Badillo apologized to the

council and the public that she missed a few meetings due to family emergencies but she did say that Quinn was highly qualified for the job. She explained that when a dog is found with rabies the animal must be decapitated, Quinn is experienced with this procedure from working at a slaughter house. In late 2012, the council voted to have the town manager work with a committee to hire an animal control officer due to the rise in dogs roaming the town. In December, the council expressed concern that they did not vote and approve the hiring of the position. According to Hayden Town Code the Town Manager can hire for this position. Quinn was let go from her position after the council inquiry was made despite the rules in the code book. After a lengthy discussion on the subject of creating a temporary full-time Animal Control officer and how the process was completed the first time, Councilmember Rhonda

Hayden – The Town of Hayden, ASARCO, the Arizona Department of Environmental Quality and Western Recyclers are sponsoring a free E-Waste Recycling event. This event is great for those with unwanted TVs, computers, monitors, printers, batteries, chargers, cell phones, VCRs, CD and DVD players, fax machines, small appliances, cables and cords. Saturday, Feb. 9 from 8 a.m. to noon is the time to empty your home of all your obsolete electronics and drive them over for free disposal at Hayden Town Hall, 520 North Velasco Avenue. The proposal disposal

of electronic waste is a worldwide problem. Much is exported to foreign countries where, without proper control, the pieces are stripped of their valuable materials and dumped. This exposes low grade components, which contain lead and other toxic materials, creating unsafe work conditions for the employees who handle materials as well as wreak havoc on environments. These pollutants can also affect areas where food may be grown and imported into the United States. With proper handling by licensed companies that have to follow correct control procedures, the

On Mar. 12, 2013 the Town of Hayden will be holding a primary election. On the ballot will be all seven council seats and Hayden’s Home Rule Option. There will be no polling places, as this will be a vote-by-mail election. Official ballots will be mailed to each qualified elector

beginning Thursday, Feb. 14, 2013. It is important that the Gila County Recorder’s Office has your current information on file. Election material cannot be forwarded. Electors will need to re-register if they have had a name change, address change, or wish to change

Hayden election coming March 12

By Mila Besich-Lira During the past few weeks there have been several fires and other vehicle emergencies in the area. Through these particular emergencies, officials at Hayden Fire Department have learned that many of

the 911 calls placed by cell phones for assistance have been dispatched through Pinal County in Florence instead of the Kearny dispatch. When the calls go through Florence there is a longer wait time for local authorities to respond to the emergency.

Hayden Fire Chief Johnny Silva explained that residents who need assistance and are using a cell phone should call directly to dispatch 520-363-5566. Those calling from a land line should still continue to use 911 in the event of an emergency.

the Lobo basketball team had been victimized by a hot-shooting player that lit up the scoreboard. The Lobo coaches decided to install a fast-paced defense, not allowing any one player to take control. In the last three games, that defense came up big.

The defense started to develop in the Miami Vandal game last Tuesday when the stifling defense led to numer-ous turnovers for easy Lobo scores. The Lobos did not allow any Vandal player to take control with the Vandal high scorer only hitting for 11 points while just about every Lobo player on the court that night was on the score sheet. The Lobos had a 29-24 lead after one half of play on their way to a 67-58 win over the Vandals. Julian Gomez was the leading scorer for the night hitting for 24 points with help from Michael Rabago with 12 points and Marcos Gonzales with 10 points.

Rodney Ortiz, a defensive thorn for the Vandals, had six points with Adrian Ochoa, an-other tough defensive player, getting five points. Roman Pa-dilla, tough under the boards, and Matt Martinez each had four points in the win. A scoreless second quarter led to a loss for the Lobo JV and they never recovered, dropping their game to the Vandal JV with a score of 62-29. In the girls’ varsity game, the Lady Lobos were missing their top scorer and the rest of the team had a lot of trouble getting the basketball into the bucket. The Lady Lobos fell behind 23-9 at the end of the first half and were unable to stop the Lady Vandal attack, losing the game 54-21. Ashley Cruz led Lady Lobo scoring with eight points with Angelica Cabrera adding four points. Kyana Garcia had three points for the Lobos with Makayla Ramos, Clarissa Chavez and Melinda Marinez each hitting for two points

apiece. The Lobos next game was an opportunity for the team to show that the best team on the court is not always the winner. With the handcuffs off and an officiating crew that allowed them to play their tough defense, their intensity on the court almost backfired on them when they could not convert on numerous easy shots at the bucket. Their aggressive defense came up big, holding the Miner’s top scorer to only eleven points; this player had twenty-three points in their first meet-ing. The game was close in the first half, with the Lobos hold-ing an 18-16 lead at the end of the first half. The Lobos came out hot in the second half and their aggressive defense held the Miners to only ten second half points, winning the game 39-26. Julian Gomez again led Lobo scoring with 11 points with Rodney Ortiz and Marcos Gonzales each getting eight

points. Playing tough defense and blocking numerous shot attempts, the trio of Roman Padilla, Michael Rabago and Adrian Ochoa each scored four points. The Lobo JV team played the best they have played against the Miner JV, but again, a scoreless second quarter led to a disappointing loss. The team lost on two free shots with seven tenths of a second left, ending with a score of 24-22. The Lady Lobo game, with one starter out due to illness and several others fighting bad colds, were never in the game against the tall and run-ning Lady Miner team. With the height of the Lady Miners allowing for only one shot at the bucket for the Lobos, they could just not get the basketball in the bucket. They suffered their worst loss of the season, losing to the Lady Miners with a lopsided score of 51-9. Melinda Marinez was the Lo-bos leading scorer with only

coming to a close, every game becomes important in the power point standings to de-termine who goes to the state basketball tournament. The Lobos had two tough games to play last week.

The Lobo teams boarded the bus for a trip to Globe to take on a tall Globe Tiger team that did not look at all like the team they played ear-lier in the season. This Tiger team was much taller and played much faster, but the Lobos were up to the test. The first quarter was a battle of three point shots and ac-curacy at the free throw line. The Lobos were winning the battle at the free throw line to take an 11-9 after one quarter. With the Tigers playing very aggressively, the Lobos again

went to the charity line often to increase their lead at the first half with a score of 21-18. The hard play continued in the third quarter with the Tigers coming out hot to tie the score at 29 apiece when the third period buzzer went off.The Lobos got into problems in the fourth quarter. Adrian Ochoa fouled out and Michael Rabago was on the bench with an illness while there was a big Tiger line-up on the court.With no experienced big bod-ies on the Lobo bench, the Lobo coaches inserted sopho-more Steven Lucero into the game. He responded with a great defensive game, holding his own against the tall Tiger team under the boards to al-low the rest of his teammates to play tough on offense.

They pulled the game out in the final seconds to win with a 46-43 score. Julian Gomez was high scorer for the Lobos with 19 points, followed by eight points each from the hard playing Roman Padilla and Marcos Gonzales. Adrian Ochoa finished with four points and Erik Rivera hit a clutch three pointer. Rod-ney Ortiz, playing another hard defensive game, had two points. The Lobo JV team had a hard time finding the bucket opening, scoring only sixteen points to lose 53-16. Jose Gomez and Steven Lucero led Lobo scoring with six points apiece, while Devin Santa Maria pulled three points and Aaron Lagunas one. The Lady Lobos also had a hard time scoring in their con-test against the Lady Tigers,

falling behind 10-2 after one quarter of play. They scored better in the second quarter but still could not trim the Tiger lead, trailing 20-10 at the half time break. With the Lady Lobos still struggling to get the basket-ball in the bucket, the Lady Tigers came out hot in the third period to up their lead to 34-17 after three periods of play. The scoring was bet-ter for the Lobos in the final period, but it was too late, as they dropped the game to the Tigers 44-30. Cheyanne Gaona led the scor-ing for the Lobos with 15 points as Amber Sharp came off the bench to score eight fourth-period points. The last game of the week had the Lobos’ boys’ varsity team traveling to Coolidge to take on the Imagine Prep Ea-gles, a team they easily defeat-ed. The Friday before that had the Eagles coach complaining that the Lobos had run up the score on his team.The coach still had some ill feelings for the Hayden team when they traveled to his court allowing his players to play, for lack of a better term, dirty tactics. The Lobos did not come out too aggressive, not wanting to run up the score leading 24-17 at the half time break. After witnessing the tactics of the Eagle players, the Lobo coaches turned the Lobo team loose, playing their tough defense and allowing only three Eagle players to score. The Lobos scored at will on their way to another lopsided win over the Eagles, 67-38.Every Lobo player that got

They will board the bus again on Jan. 25, traveling to Surprise to take on the Arizona Charter Academy team.

a Gila County road grader kept it in fairly good condition.There was one particularly treacherous stretch however! It ran for about 8 miles alongside of the Gila River, between the

towns of Christmas and Winkelman. It was narrow and in places, barely wide enough for two cars to pass each other. There are still portions of that old road visible today, even though it was replaced with a modern paved highway. This old road holds many memories in the minds of motorists that were brave enough to travel over it. I

think it was built in about 1920, as a more direct route from Globe to the mining towns of Hayden and Winkelman. Portions ran along the steep rock embankments adjacent to the Gila River, so steep that in order to make a roadbed, it required that rocks be carried and stacked along the outer edge, to make a retaining

wall for the roadbed. Those retaining walls are still visible today. When I was growing up in the 1940s, all of the roads both in and out of the area were dirt roads. Traffi c accidents on these treacherous roads were not unusual. I remember one accident well, as it involved my cousins. On Christmas

morning, in about 1947, Bill & Genevieve Matthews and their young daughter Genny were approaching Winkelman on the old Christmas Road and were only about a mile out of town when the accident occurred. Bill Matthews, the driver, was hugging the right side of the road as much as

By N. Waddell The Hayden Junior High basketball season came to an end last week with a sweep of the games against the Junior High Vandal teams from Miami Junior High School. The seventh grade Lady Lobos started the action against the Vandals breaking out to a 7 to 3 lead after a quarter of play behind the scoring of Brandi Lopez. Lopez continued her scoring in the second period with her teammates playing good defense and rebounding to take a 12 to 5 lead into the half time break. The break cooled off the Lady Lobos going scoreless in the third period but the defense played

hard holding the Vandals to only two third period points to take a 12 to 7 lead into the final stanza. The Vandals and Lobos played even in the final period to give the Lady Lobos a hard earned 16 to 11 win. Only two Lady Lobos were able to score with Brandi Lopez doing most of the damage with 12 points. Jayden Gonzales scored four points for the team. The seventh grade boys’ teams were on the court next and this game turned into a close battle. The Vandals took a first quarter led of 4 to 8 and protected the lead to go into the half time break leading 8 to 12. The Lobos came out in the third period

determined not to lose cutting the Vandal lead to 16 to 18 at the end of the third period and outscored and out hustled the Vandals in the final quarter to win the game 25 to 22. Julian Cruz was a force for the Lobos scoring 13 points to lead the Lobo scoring. Emitt Sims playing tough defense scored five points Mario Mariscal had three points with Julian Corona and Joaquin Camarena each getting two points. The only rout of the night was turned in by the Lady Lobo eighth grade team over the Vandal girls team. Led by the scoring of Lexy Gomez and Leticia Vargas, the Lady Lobos broke out to an 11 to 4

lead at the end of one quarter of play. The defense of the entire team came up big in the second quarter holding the Vandals scoreless while the Lobo offense increased the lead to 19 to 4 at the half time break. Gomez continued with her hot hand leading the Lobos to a big 32 to 9 lead going into the final period of play. The Lobo defense again came up big in the fourth period again holding the Lady Vandals scoreless while the offense put the game away to win 40 to 9. Lexy Gomez had the hot hand for the Lobos pumping in 18 points with Leticia Vargas and Brandi Lopez each getting six points. Jayden Gonzales had a three

The seventh grade Lobo team will go into the tournament as the number one seed and the eighth grade team qualified as the number four seed in the tournament. By Mila Besich-Lira Last week, Copper Area News reported that State Representative TJ Shope had dropped a memorial to encourage the US Congress to pass a land exchange bill for the Resolution Copper project.

At press time, LD-8 Senator Barbara McGuire had not been contacted to support the bill introduced by Shope. Since she was not a sponsor, her name was not included as a supporter of the bill via the legislature’s website. “I am 100 percent in support

of Resolution Copper,” McGuire said in a telephone interview, “had I been asked to sign onto the bill I would have.” McGuire further explained that the memorial dropped by Shope “is like sending Congress a post card.”

McGuire explained that she is also planning to work with the Arizona Congressional delegation to assist with supporting the land exchange. At press time, a new land exchange bill has not been introduced into Congress. The Lady Lobos were on the court first to take on the Lady Bulldogs, whose offense con-sisted mostly of three point shots and putting back the missed opportunities. The Lady Lobos were a little better at three-point shooting in the first period, taking an 8-4 lead. However, they went cold in the second period, hit-ting for only one point while the Lady Bulldogs got their game going to take a 16-9 lead at the half. With the officials whistle tak-ing over the game in the sec-ond half, the Lady Lobos lost two starters to foul problems and they could not overcome their cold shooting, losing the game 40-27.

Cheyanne Gaona again led Lobo scoring with nine points with Melinda Marinez getting six and Kyana Garcia scoring five. Angelica Cabrera scored four points, Ashley Cruz had two and Devin Estrada had one. The Lobo-Bulldog game would have been great if the officials whistle had gone both ways. Despite the calls, the Lobos played hard and gave it all they had.However, they could not over-come the sixth and seventh men on the court in the sec-ond half as they were whistled for thirteen fouls to only four for the other team. The score was tied at 45 with two min-utes left when the whistles really came into effect.The Lobo coaches tried to get explanations on the calls with no response from the officials. With the Lobos down 38-36 to start the final stanza, the Lobos could not overcome the calls, losing the hard-played game with a score of 53-45.

Julian Gomez led the Lobos on the score sheet with 27 points with Marcos Gonzales adding nine, Adrian Ochoa with six and Roman Padilla getting three. The Lobo teams have three more games left on the regu-lar season schedule, all on the road. This Tuesday, they travel to Miami to take on the Vandals, on the road again on Thursday to Superior for a contest against the hard-play-ing Panther teams and ending the regular season with a trip to San Carlos for a tussle with the always hard-playing Braveson Friday. All three games are crucial in the AIA power point standings and the outcome of the games will determine if the Lobos will be in the state basketball tournament. The Lady Lobos, having a tough learning season with a very young team, have been eliminated from state tourna-ment competition.

possible, as he approached a blind curve to the right. Suddenly a northbound car full of people came around the curve on the wrong side of the road. The driver over corrected and the car went hurdling off the side of the road, rolling and tumbling down the steep rocky embankment. As I recall, a couple of the people were killed and one man lost part of his leg. I don’t remember all of the details, but someone had to drive into Winkelman to get help. There were no radios or cellular phones in those days. I remember as a teenager

driving my stripped down 1928 Chevrolet Coupe over that road and trying to drive over the steep Christmas Hill without shifting. This required getting up a lot of speed before approaching the steep grade. In those younger days, I thought I was invincible! In 1954, I had a job driving a ten-wheel white dump truck over that road for George Luman. My job entailed moving mine tailings from the old mine and mill dump at Christmas, to the railroad spur down along the Gila River. The railroad spur ran from Christmas to Winkelman. Its former track bed now makes up part of today’s Highway 77 roadbed. A couple of days a week, I would have to go haul

silica ore from Sy Bobbitt’s Mine to the AS&R smelter in Hayden. The silica mine was located in the mountains on the west side of the Gila River near Hayden. When I was relocating between the two work sites, I would sometimes meet unsuspecting motorists on the old Christmas Road. If they were on the outside, overlooking the drop to the river, their eyes would often be wide and they would be looking straight ahead, their hands strongly gripping the steering wheel. Now I drive 50 to 60 miles per hour down the paved highway that once was the old Christmas Road and I reminisce about the old days, when you actually had to “drive” an automobile.

On or about 2/15/13 the Town of Kearny will submit a request to the Arizona Department of Housing for the release of Community Development Block Grant funds under Title 1 of the Housing and Community Development Act of 1974 as amended, to undertake a project known as Well 2A Improvements, for the purpose of installing a new well.Further, in order to comply with Executive Orders 11988 or 11990 and the Water Resources Council’s Floodplain Management/Wetlands Protection Guidelines, the Town of Kearny hereby states that this Well 2A Improvement lies within an identified floodplain or wetlands or will impact on a floodplain or wetlands. However, the Town of Kearny reached a decision that this is the only practicable alternative for this project.Its decision is based on an evaluation of the following alternatives: none. The Town of Kearny will however, ensure that this project will conform to all state and/or local floodplain or wetlands protection standards, and will take the following actions to mitigate the flood hazard/impact on wetlands and to restore and preserve natural and beneficial values: the engineer is cognizant of measures to ensure no adverse impact to the floodplain.FINDING OF NO SIGNIFICANT IMPACTThe Town of Kearny has determined that the project will have no significant impact on the human environment. RELEASE OF FUNDSThe Town of Kearny certifies to ADOH that Samuel O. Hosler in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. ADOH’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Town of Kearny to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

Some lucky students who drive to school early enough can claim some prime parking spaces out of the hot (usually) Arizona sun. This “covered” parking is thanks to some solar panels installed at the school to help the district offset electricity bills. The panels were installed as part of a grant from APS. Dr. Robert Dunn, Ray School Superintendent and Ray High School principal, said, “Yes, the lights are on, the area is cleaned up and the company has moved on.” He added that hopefully the District will see some benefits soon with lower power bills.
