Pamela Rabago, 40, passes away on Nov. 24, 2011 at Casa de la Luz Hospice in Tucson with her family by her side. She was born on June 21, 1971 in Kearny to Robert and Lilly (Romero) Rabago. Pam is preceded in death by her grandparents, Chano and Paulina Romero, Modesto and Ramona Corona and

Walter Ernest Swingle, 91, passed away Saturday, Nov. 26, 2011, at his home in Globe, with his family by his bedside. “Walt” was born in Dudleyville Oct. 25, 1920, the son of William Walter and Clara Swingle. He grew up locally and attended local schools. He served his country

in the U.S. Navy during World War II aboard the U.S.S. Saratoga, gunnery department, from 1943 to 1946. His ship also transported personnel from Pearl Harbor to San Francisco when the war was over. Walt started his working career at a cabinet shop in San Diego, California

and from there went on to Consolidated Aircraft Plant during his hitch in the service. He then worked for the U.S Indian Service in Parker, Arizona, before making his way back to the Copper Basin area where he was fi rst employed by Isbell Construction in Ray. He then went to work for Kennecott Copper Corporation and ASARCO where he retired as a mine supervisor at the Ray Open Pit in 1982. Walt was always busy. He loved fi shing and hunting and reloaded bullets. He also was a very skilled woodworker and made many kinds of interesting items out of various sorts of wood. Survivors include his son Lee (Jody) Swingle of Dudleyville; daughter Jean Swingle of Kearny; brother Phil Swingle of Oxnard, California; live-in love Hope Barnett and her two sons, Jerry and Pete Acton and daughter Lynell Corbett (who are also Walt’s nephews and niece). Also surviving are devoted grandchildren Kathy, Leigh Ann, Wanda, Michele, Richie and Pam; and great grandchildren Taylor, Ahren, Samantha, Xada, Shelby, Chris, Dustin, Christopher, Joshua and Ramon, along with stepsons Homer and Donnie Harmon

and stepdaughter Joanne Halloway. He was preceded in death by his parents, one sister, and six brothers; also his fi rst wife, Lee and Jean’s mother, Irene and second wife Juanita Harmon. Daughter Jean remembers her dad as the greatest ever, always there for her and she thinks they broke the mold when he was made. Son Lee added that he was the best dad anyone could ask for and the best person anyone could ever know while the grandkids thought of him as the greatest grandpa ever. And to Hope he was her love. Services will be held Saturday, Dec. 3, starting at 10 a.m. at Griffi th’s Mortuary Chapel in Kearny.

Candido S. Varela, 89, beloved by family, friends and all who knew him, joined our Heavenly Father on Friday, November 18, 2011 at his home in Dudleyville, AZ with his wife Maria Gloria by his side. Candido was born on March 5, 1922 in Winkelman, the son of Pablo and Romana (Soto) Varela. He is survived by his wife, Gloria; his son, Julio; daughter, Vanessa; three grandchildren and

11 great-grandchildren. He is also survived by his sister, Aurora Lopez, along with numerous cousins, nephews and nieces. In 1942 He enlisted in the Army. He served in World War II; where he received a Medal for Bravery for risking his life to save others. Candido worked at Asarco in Hayden as a Smelter Repairman. He worked for Asarco for 37 years. He later retired

in 1984. Candido loved going camping during the summers with his Family. He was a loving husband, father, grandfather and great-grandfather. Services for Mr. Varela were held Friday, Nov. 25, with the Mass of Christian Burial being celebrated at St. Joseph’s Catholic Church in Hayden and the visitation and Rosary immediately preceding. A telephone pole was cut down as well. Nov. 18 Jason Evan Scheibe, 35, Dudleyville, was arrested

in the area of Malpais Road and Highway 77, Dudleyville, on a warrant for probation violation. He was transported and booked into the Pinal County Jail in Florence. Nov. 18 Julio R. Varela, 58, Winkelman, was arrested in the area of Dudleyville Road and Chama, Dudleyville, on two warrants for failure to appear. He was transported and booked into the Pinal County Jail. According to state law, there are two methods by which police may arrest suspected offenders. The suspect may be physically taken into the department and booked into jail, or the arresting offi cer may write a citation and release the suspect to appear in court later. Six victims of a rollover accident were airlifted to University Medical Center Sunday after they were injured in the remote Putnam Canyon outside of Mammoth. According to Elias Johnson, Public Information Offi cer for the Pinal County Sheriff’s Offi ce, deputies arrived to the remote scene at approximately 4:13 p.m. Sunday where they discovered a badly damaged crew cab pick up truck and the six injured people. Two of

the victims were under the age of 18. Johnson said that the occupants stated that they were traveling down the sand wash in the canyon when the truck overturned and rolled several times. Because of the remote location, EMS and other emergency personnel had to be shuttled in by four wheel drive Sheriff’s Department vehicles. A total of six medical helicopters were landed on scene to evacuate the victims.

Six injured in off -road accident Sunday in Putnam Canyon Johnson said that evidence at the accident scene indicated that speed and aggressive off-road driving were major contributors to the vehicle rolling over. In addition to PCSO, other agencies that

responded to the emergency were Winkelman Fire Department, Dudleyville Fire Department, Kearny Ambulance Service, Native Air Ambulance and Lifenet Air Ambulance.

By Mila Lira Recently National Public Radio published an online article and video about Hayden being listed as a community in their “Poisoned Places” series. While the article focused on the findings of the Environmental Protection Agency, the article published by NPR did not fully provide the comments or statements provided by representatives from Asarco. In an email sent to the Copper Area News, Thomas L. Aldrich stated that “the health and safety of our employees and our neighbors is a top priority and we take our responsibilities seriously.” Aldrich further explained that Asarco worked with the reporter for the Center for Public Integrity however the majority of the information provided by Asarco in two separate interviews was not included in the reports by CPI. NPR ran the investigative reporting pieces that were compiled by CPI. Aldrich explained that reporters from the Center for Public Integrity spent an entire day with representatives from Asarco for a full interview as well as a tour of the facilities in July of this year. The only time that Asarco had declined to participate in an interview with the reporter was when they requested a last minute on camera interview. According to their website CPI is one of the country’s oldest and largest nonpartisan, nonprofit investigative news organizations. Their mission: to reveal abuses of power, corruption and dereliction of duty by powerful public and private institutions in order to cause them to operate with honesty, integrity, accountability and to put the public interest first. Asarco provided the following statement to CPI in regards to the EPA’s Findings of Violation: The Finding of Violation (FOV) was unexpected. In fact, it’s even more puzzling because our smelter is in compliance

with its air permit. In Asarco’s view, the FOV is simply incorrect because the administrative record shows and we have consistently maintained that the Hayden Smelter is an area source. The administrative record is based on comprehensive tests of stack and fugitive emissions at the smelter, calculations, and emissions monitoring conducted under the oversight of the Arizona Department of Environmental Quality (ADEQ). This supports the company’s position that the smelter is an “area source” (or “minor source”) of Hazardous Air Pollutants (HAPs).Furthermore, in a 2007 rulemaking, the Environmental Protection Agency (EPA) formally designated the Hayden smelter’s emissions control technology as the benchmark of HAPs emission control technology applicable to all primary copper smelters that use the same process technology as the Hayden smelter and are “area sources” of HAPs. ASARCO works closely with its regulators and proactively seeks innovations as science evolves and environmental laws and rules are updated to be more efficient while respecting the environment and our neighbors. We look forward to working with EPA and ADEQ, setting the record straight and defending the FOV vigorously. Asarco also provided to the Copper Area News written statements they provided to questions posed by the reporter covering the story. (Questions asked by the Center for Public Integrity reporter are in bold print.)A 2009 EPA report states that “air monitoring in [Hayden] has shown levels of arsenic, lead and chromium still exceeding public health standards, probably due to toxic fumes escaping from leaks in the plant outside the smokestack.” Is this a concern to Asarco?

Why would the smelter’s emissions exceed public health standards? The 2009 EPA newsletter is incorrect. Levels of arsenic and chromium in the ambient air of the Hayden area do not exceed applicable public health standards. The numerical thresholds that the 2009 EPA newsletter cited for arsenic and chromium have not been promulgated as applicable standards because they are not deemed representative of acceptable risk to human health. The federal Clean Air Act and corresponding federal and Arizona regulations provide the standards of acceptable risk to human health. Those standards are based on the EPA’s consideration of the latest health literature and have been developed to protect human health with an adequate margin of safety. Notably, the EPA in 2008 revised the Clean Air Act’s National Ambient Air Quality Standard (NAAQS) for lead from 1.5 μg/m3 to 0.15 μg/m3. In response, Asarco is investing $9 million to retrofit the smelter’s anode refining furnaces to significantly reduce lead emissions to ensure the ambient air of the Hayden area is in attainment of this new NAAQS. Asarco is doing this even though the EPA has not made a determination that the ambient air of the Hayden area is in nonattainment of the new NAAQS. At Asarco’s request, the ADEQ included the retrofit in Asarco’s air quality control permit and the retrofit is scheduled to be completed in early 2012. Because the retrofit involves the installation of additional emissions control technology that targets particulate emissions, which are the primary vehicle of hazardous air pollutant (HAP) emissions, the retrofit will significantly reduce not only lead emissions but other HAP emissions, including arsenic and chromium emissions.Asarco and the ADEQ

apparently consider the Hayden smelter to be a minor source of HAPs; Jack Garrity said a total of 14 to 15 tons per year are emitted. And yet, by other measures (SO2, PM) the smelter appears to be a major source. Does Asarco consider itself to be a “synthetic minor source” of HAPs? The facts in the administrative record of the smelter—based on comprehensive tests of stack and fugitive emissions at the smelter, calculations, and emissions monitoring conducted under the oversight of the ADEQ—squarely indicate the smelter is an “area source” (or “minor source”) of HAPs. In fact, in a 2007 rulemaking, the EPA formally designated the Hayden smelter’s emissions control technology as the benchmark of HAPs emission control technology applicable to all primary copper smelters that use the same process technology as the Hayden smelter and are “area sources” of HAPs. Sulfur dioxide (SO2) and particulate matter (PM) emissions per se do not constitute HAPs and therefore are not counted in determining whether a smelter is an “area source” or “major source” of HAPs; although, HAPs emissions control technologies control HAPs emissions specifically by controlling PM emissions, which are the primary vehicle of HAPs emissions. By way of example, the retrofit of the smelter’s anode refining furnaces, which is discussed in the response to question 2 above, will, by controlling PM emissions, reduce the smelter’s potential to emit all HAPs combined from about 14 tons/year (pre-retrofit) to about 8 tons/year (post-retrofit). The smelter presently is not a “synthetic minor source” of HAPs because the smelter’s air quality control permit, issued under Title V of the Clean Air Act, does not include limitations voluntarily accepted for the specific purpose of avoiding

The Other Side of ‘Poisoned Places’: Asarco responds“major HAPs source” status. The smelter is an “area source” rather than a “major source” of HAPs for the simple reason that its potential to emit any individual HAP does not equal or exceed 10 tons/year and its potential to emit all HAPs combined does not equal or exceed 25 tons/year. (See 42 U.S.C. § 7412(a)(1).) By definition the smelter is a “major source” for SO2 and PM ten microns in size or smaller (PM10) for purposes of the Clean Air Act’s Prevention of Significant Deterioration (PSD), nonattainment new source review (NNSR) and Title V operating permit programs (which are different from the HAPs program). The smelter’s air quality control permit includes conditions

pursuant to the PSD, NNSR and PSD programs and Asarco complies fully with them.In our interview last July, you told me, “We believe we’ve done everything we need to” with regard to the Hayden cleanup. That same month, the EPA told Asarco in a letter that there were “serious deficiencies” in the company’s work plan. Among other things, it cited a lack of meaningful air sampling. How does the company respond? The statement that Asarco believes it has done everything necessary pertained to the cleanup of soils on residential properties, public areas and vacant lots in Hayden and Winkelman. Asarco

By Nolberto Waddell The Hayden High School basketball teams traveled to San Manuel to take on the Miner teams in the season opener for the Lobos. It did not turn out to be a successful opener for the Lobos dropping all three scheduled games. The Lobo boys JV team was on the court to start the action against a taller and bigger in numbers team from San Manuel and the lack of

players and height for the Lobos soon proved to be too much for the Lobo JV. Both teams started out slow with the score only 4-5 Miners at the end of the first quarter. The Lobo JV could not find the basket in the second quarter scoring only two points and found themselves on the wrong end of a 6-11 score at the end of the first half. Things got worse for the Lobo JV in the third quarter getting

outscored 18-0 to give the Miner JV a commanding 6-34 lead after three quarters. The scoring for the JV Lobos did not get any better in the final stanza scoring only four points to lose their season opener 10-51. Robert Sandoval led Lobo scoring with four points with Aaron Lagunas, Steven Butler and Gabriel Ramos adding two points apiece. The Lady Lobos were on the court next and for a while

Lobos, Lady Lobos lose openers to San Manuelit seemed like nobody was going to score. After the first quarter the score was 3-1 Lady Lobos. The Lady Lobos picked it up in the second quarter behind the scoring of Melissa Islava to take a 13-4 lead when the first half came to an end. The second half was a different game. The Lady Miners adjusted and came out hot outscoring the Lady Lobos 10-14 in the third quarter to cut the Lobo lead to 23-18 at the end of three quarters of play. The final quarter was disastrous for the Lady Lobos. They came out cold in the fourth quarter and watched as the Lady Miners caught up and passed them with seconds left in the game. The Lady Lobos would score only one basket in the fourth quarter while the Lady Miners hit for eight points for the final 25-26 score. Melissa Islava and Yvonnah Gonzales led Lady Lobo scoring with nine points apiece. Demitria Boltarez added six points and Melinda Marinez had one point. The varsity boys match was intense from the start to the finish with the Miners’ superior height advantage and better bench being a bit too much for the Lobos to

overcome. Julian Gomez’s eight first quarter points kept the Lobos close at the end of the first quarter trailing 13-16 when time ran out in the first stanza. The Lobos kept fighting

back not giving in to the taller Miners keeping the score close at 24-30 at the end of the first half. Fresh players coming in for the Miners soon took a toll on the

Public Meeting Regarding the Use of CDBG FundsThe Town is expected to receive approx. $280,000 in FY2012 federal CDBG funds from the Arizona Department of Housing Regional Account (RA). The Town also may apply for up to$300,000 in FY2010 CDBG funds from the State Special Projects (SSP) account; $300,000 from HOME funds and 300, 000 from Colona’s funds

CDBG funds must be used to benefit low-income persons and areas, alleviate slum and blight or address urgent need. A public meeting will be held at 7:30 p.m. on December 19, 2011, and January 16, 2011 at 912-C Tilbury Road to discuss the potential projects. It is expected that the Town Council will select the final projects at this meeting. The potential CDBG projects are as follows:

Lobos in the second half. The Miners added to their lead at the end of three quarters increasing the lead to 34-45. The Lobos did not go down quietly playing the Miners even in the final period but the eleven point lead the Miners took into the fourth quarter was too much to overcome for the Lobos dropping their season opener 42-54. Matthew Manriquez led Lobo scoring with 12 points followed by Julian Gomez’s 10 points. Marcos Gonzales and Adrian Ochoa added eight points apiece with Roman Padilla adding four points. All the scoring came from the Lobo starters with the bench not contributing a point. On the San Manuel side of the books, eight of their 10 listed players scored. Again, turnovers and missed easy shots did the Lobos in. The Lobo varsity traveled to Tucson on Friday and Saturday to play in the Immaculate Heart Holiday Hoops Tournament. The Lady Lobo team will be off until Dec. 1 when they travel to Globe High School to play in the 31st Annual Copper Cities Girls Basketball Invitational. The Lady Lobos will have another shot at the Lady Miners in their first game of the tournament on Thursday at 12:15 p.m. on the Globe High court. The Lady Lobos will move to the High Desert Middle School court for their next game against the Lady Sabercats of San Tan Foothills High School at 3:15 p.m. The final Thursday game for the Lady Lobos will be at 7 p.m. also at High Desert against the Lady Gophers of Florence High School. The

Lady Lobos return to the High Desert court on Friday to play their final pool game against the team from Sandra Day O’Conner with the tip-off set for 1:30 p.m. The next game for the Lady Lobos will

depend on the outcome of their record in pool play with the top two seeds getting a bye into Saturday’s bracket play and the other eight teams playing Friday evening after the conclusion of pool play.

Georgie Digs ...By Georgie Wood([email protected]) Of great concern was the early morning Aravaipa Creek flood on Aug. 1, 2006 that caused much damage to different properties, and, luckily, no hikers were in the Aravaipa

Canyon Wilderness (ACW) at that time due to the rains previous to the flooding. It was very obvious that the extensive damage done to my creekside field and the Newtons’ property immediately upstream of it was due to the upper fish barrier on the Indian

Allotment land just downstream of my field. The stream bed had silted in to the top of the barrier, causing more backup of the water than some had predicted. Also, the so-called “waterfall” from the top of the barrier was less than the predicted four feet. I took lots of pictures after the flood, and after getting in touch with the Phoenix-area office of the Bureau of Reclamation (BOR), I received a phone call informing me that BOR’s main focus was the fish barriers, not the clean-up of the flood debris, and that the Central Arizona Project (CAP) would clean up the flood debris on the pipe-rail fencing that had been erected along the edge of the county road just downstream of my field.

I arranged a meeting at my field on Nov. 17, 2006, during which people from BOR, CAP, and the San Carlos Agency, Bureau of Indian Affairs (BIA) looked at the flood damage. Also attending were two members of Pinal County’s emergency team. It was not easy walking through all the silt, and missing all of the debris buildup including old car bodies and large tree trunks! Because so many attended the meeting, I was

By Mila Lira Readers of the Copper Area News answered questions to our online survey about Hayden being listed in their Poisoned Places series. Of the 26 readers from throughout the copper corridor responded to the survey. The votes per community broke out like this: Hayden 5, Kearny 3, Mammoth 2, Oracle 3, San Manuel 2, Superior 4, Winkelman 1. Six respondents preferred not to answer.Question 1: Do you feel that NPR is correct to list Hayden as a “Poisoned Place”. 65.3% (17) of those responding said yes they feel that NPR is correct to list Hayden as a “Poisoned Place”. 34.6% (9) of those responding said no. Some of the comments received to this question were:• Listing Hayden as a “Poisoned Place” is pure theatrics and a misrepresentation of the facts by a couple of locals and by activists that have never been in or worked in a mine, mill, or smelter! Sensationalism sells, and brings notoriety to the accusers, regardless of the truthfulness of their statements!• I think it has value, however painful, to hear the way the outside world sees us. The environmental abuses by earlier mine operators has been a part of the fabric of the region for so long it is easy to lose sight of the total cost to our personal and economic vitality.• As per EPA we can’t pretend there are no health problems in Hayden-Winkelman due to the smelter and mining.Question 2: Do you feel that mining conditions of the past and the pollution from those operations are a source of cancer related deaths in the area? 69.2% (18) of those responding voted yes that the conditions of the past and the pollutions from

those mining operations are a source for cancer related deaths in the area. 30.7% (8) of those surveyed said no. Those providing comments to this question said:• Outrageous accusations were made, claiming to have a long list of documented statistical information, showing multiple deaths in the area related to airborne contaminants. That is pure hog-wash, and an intentional misrepresentation by a few environmental activists. The proof is in the pudding! Lets see the names, places and causes of these alleged deaths! People’s chosen lifestyles, such as poor eating habits, substance abuse, and use of tobacco products, cause most illnesses and deaths.• Possible. There seems to be a lot of Leukemia in the area. This should be studied.• Yes, just look at many of the death certificates of area residents. “Down Winders” (nuclear testing in Nevada also contributed).• I believe that tainted water and air can lead to illnesses, which in turn can lead to cancer-related deaths if left untreated.Question 3: Do you believe that the State of Arizona is doing all that it can to enforce the Air Quality Act? 26.9% (7) of those responding said yes that the State of Arizona is doing all that it can to enforce the Air Quality Act. 69.2% (18) voted no, they did not believe the State is doing all that it can to enforce the Air Quality Act. There is was one participant who did not vote on this question. There were several comments to this question:• The State is doing all it can to enforce its present laws and regulations.• The State and Gov. Brewer are for the copper companies... just look at the copper mine in

Florence and how PRO SHE IS TOWARDS IT. Can we talk to her ‘’ assistant’’ that’s also a lobbyist for the copper mines..• Az. (ADEQ) has been very lax in enforcing air quality standards. They also are concerned with job loss and economic impact to the area and State.• Apparently it has done nothing with respect to lead and other pollutants for which is has responsibility. Lead can cause death, brain damage, neurological problems, and deafness. ADEQ has been gutted by budget cuts. For Gov. Brewer to declare that this is a “paperwork problem” is unconscionable and another example of her low regard for human life and health.• I believe that it is too difficult for the state to enforce regulations with diminished resources, and companies would rather not spend the money for self-enforcement.Question 4: Do you think your community should be considered a poisoned place as well? 42.3% (11) of the voters said yes they believed their community should be listed as a poisoned place. 53.8% (14) of those responding did not believe their community should be listed as a poisoned place. There was one respondent who did not vote on this question. Comments to this question included: • I live in a rural area that is not downwind of the mining and smelting operations. I probably am exposed to more airborne contaminants from the smelter across the border in Mexico, than from the Hayden smelter. I grew up in close proximity to the Hayden Smelter and the tailings ponds. My siblings and I have all lived past the 3/4 century mark have enjoyed relatively good health in the process. So much for “Poisoned Places”.

under the EPA’s oversight has completed the cleanup of the soils on residential properties, public areas and vacant lots in both towns and, in doing so, achieved all the required cleanup levels. The EPA’s notice of deficiency concerns Asarco’s April 2011 revised remedial investigation/feasibility study (RI/FS) work plan for addressing media other than soils on residential properties, public areas and vacant lots. Asarco has objected to the notice and the notice and objection are the subject of a dispute resolution process that is ongoing before the EPA.Do the emissions inventory data you submit to the ADEQ annually include fugitive emissions? If not, why not? If so, has the ADEQ required any capture efficiency testing for the furnace and concentrator operations? Recent inventories list capture efficiency at 1.00, which would imply 100-percent capture (i.e., no fugitive emissions escaping from furnaces, process buildings). I understand this is very difficult to do. Even a 1 percent difference could have a huge impact on the amount of emissions. For instance, if you had a 100 lb/hr lead source controlled by a 99.9-percent efficient baghouse, a 1% fugitive rate (99 percent capture) would emit 10 times more (1 lb/hr) than the controlled baghouse emission rate (0.1 lb/hr). The emissions inventory data for the Hayden smelter

which Asarco submits to the ADEQ include fugitive emissions. The ADEQ has not required “capture efficiency testing” because the EPA’s rules do not require such testing. What the EPA’s rules and ADEQ do require, through Asarco’s air quality control permit, is that Asarco routinely conduct performance testing of certain equipment, including air pollution control devices, to ensure they are operating within applicable specifications such as numeric limits and other performance standards that are included in the permit. The results of the performance tests are used along with other information to prepare the emissions inventories as well as Asarco’s Toxic Release Inventory reports (discussed in the response to question 7, below). In addition, the ADEQ required and Asarco performed, consistent with applicable rules, a thorough six-month long empirical fugitive emissions study. The results of the fugitive emissions study were used along with the routine performance test results to estimate all HAPs emissions at the smelter in a submittal to the ADEQ in 2004. Based on its review of the documentation, the ADEQ determined that there is no indication the Hayden smelter is a “major source” of HAPs. The information compiled in this article was provided to the investigative journalists from CPI but was never mentioned in the articles that were published by NPR.

The Town of Hayden is expected to receive approx. $140,000 in FY2012 federal CDBG funds from the Arizona Department of Housing Regional Account (RA). An April 3, 2007 letter from Carol Lynn Erwin, Manager of BOR’s Phoenix-area office, stated, “CAP personnel will continue to clean up around our fish barriers, but we will not ask them to remove debris on either your lands or those of other individuals, including the lands along and within the Indian Allotment.” She also stated, “The buildup of debris along a stream channel is a likely occurrence after any major flood event and existed prior to the construction of the fish barriers. Additional deposits of debris caused by runoff from flood events should be expected.” In my reply to her, I told her it wasn’t necessary to make those statements to me as I had lived along Aravaipa Creek for many years and have experienced many creek floods and their after-effects. Until Aug. 1, 2006, there had never been an Aravaipa Creek flood that was exacerbated by human intervention in the natural flowage of the creek. The fish barriers were a human intervention in the natural flowage of the creek, and because BOR had stated that during flood conditions their construction of the two fish barriers would increase the potential of inundation of portions of our land, I and others felt that BOR should be held accountable for the flood damage done to my field; the possible dying of the field’s pecan trees because of the extreme amount of silt that should be removed; and damage done by trespassing cattle because of the destroyed fencing.
