(James Carnes photos) Winkelman art wall damaged by vandals, thieves By Mila Lira At a public hearing held last week for the Town of Kearny’s proposed 2011-2012 budget, the council voted not to increase property taxes for Kearny property owners. The Kearny Town Council held its monthly meeting and began with a final public hearing on the proposed budget for the 2011-2012 Budget and Financial plan. The council heard a few public comments on the budget and received petitions collected by James Hosea requesting the property taxes not be raised. Town Manager Gary Eide explained to the council that the proposed budget was within the expenditure limitation established for the Town with an all funds expenditure of $5,053,133.00. He shared that overall the Town continues to see a reduction in revenues from the State due to the stagnate economy and the 2010 Census. Both of these factors have caused a reduction in funds received by all the incorporated communities throughout Arizona. He stated that the Town continues to operate under a salary and benefits freeze and many positions remain vacant or have been eliminated over the past three years. Following the public hearing the council unanimously approved the budget resolution but first voted to amend the resolution to keep the property tax levy at the 2007-2008 fiscal year amount which is $128,500 and is the same amount the Town has received for several years. The Council also unanimously voted to amend Ordinance 11-186 which was originally passed in March. The ordinance had to be amended due to a state law that no longer allows communities to raise the rental property tax without a vote of the public at a regular municipal election. Kearny was one of three municipalities in Arizona that were affected by the law passed during the 2011 legislative session. The remainder of the meeting was mostly housekeeping items including approval of several of the Town insurance policies for general liability, airport insurance and employee health, adopted changes to the model tax code and approved two change orders for the Wet Well Construction Project. The council voted to cancel the July council meeting which is often common practice during the Summer once the budget has been approved. Babe DeWolf made a presentation to the Council requesting that a plaque that was erected to her Father Robert R. Henderson be replaced. She explained that the plaque was installed in the 1980’s but was vandalized and never replaced. She requested support from the Council to replace the plaque in his memory. The council tabled any action on the presentation but directed staff to come back with quotes and more information regarding this project. No new property taxes for Kearny taxpayers By Mila Lira Stern comments from the Hayden Town Council last week did not stop Dr. Glenn Wilt from asking about opening a medical marijuana facility in his building on Highway 77, the former Gila County Sheriff’s Office. Wilt and his business partner Paul Shaub made a presentation to the Council, requesting support from the Town of Hayden to develop a Medical Marijuana Dispensary. He showed the council a floor plan of the building and explained that the current layout helps meet the security and cultivation requirements. His presentation was met with firm comments from Mayor Monica Badilllo and the Council that Wilt does not always follow through on his promises and he is not doing anything to help the town by letting his buildings fall into disrepair. Badillo’s stern comments did not halt Dr. Wilt as he suggested the Council consider trying to move out of the Globe Community Health Action Area (CHAA). He stated that currently Globe is looking at a company who is already licensed in California and would lessen the chances of Hayden being licensed for a dispensary. He suggested that the town try to move into Superior/Kearny CHAA because Kearny passed an ordinance to prohibit a dispensary. Badillo politely closed the presentation by explaining that she will be in contact with Wilt before any further plans go through or the Town supports this project. In other business, the council held a second public hearing to revise the town’s CDBG project. Cindy Schofield with Central Arizona Association of Governments explained that town is eligible to be Wilt asks Hayden to consider medical marijuana facility designated as a Colonia which will assist them in qualifying for less competitive grant for the Waste Water Treatment project. This designation means that they will not have to apply for the more competitive State Special Projects Grant to fund the Waste Water Treatment Plant. Following the hearing the council handled many yearly housekeeping items including the swearing in of Badillo. Other housekeeping items included reappointing the Town Clerk, Chief of Police and Town Magistrate, designating check signers, and approved the FY 2011-12 tentative budget and the Police Protection Agreement with the Town of Winkelman. The council also approved an amendment for professional services in connection with the design and construction services for the Waste Water Treatment System Improvements. But there are very few that aspire to become a professional bull-rider. Abraham “Chacho” Romero, Jr., of Dudleyville, has decided that’s what he wants in his future and is seeking to secure his aim when he competes in the 63 rd Annual National High School Finals Rodeo that will be held July 17-23 in Gillette, Wyoming. Chacho is the son of Abe and Barbie Romero and a recent graduate of Hayden High School. His trip to the finals came when he won the average and placed second at State Finals. He is also a member of the Cinch Team and holds the highest point total in the State for H.S. bull-riding. The Reverend Carol Hosler will mark her last Sunday as Pastor of The Church of the Good Shepherd in Keany, on Sunday, July 3. She will preside at Holy Communion, and, deliver the sermon at 9 a.m. service in Ray Hall. She has served as Pastor at Good Shepherd for three years, and, was the first Episcopal priest to serve in this way, in the whole Desert Southwest Conference of the United Methodist Church. Her successor will be Pastor Nina Yardley, whose first Sunday in Kearny will be on July 17. During her three years as pastor, the people of Good Shepherd worked with her to affirm the congregation’s ecumenical outreach. The work mirrored national and international agreements between The United Methodist Church, The Evangelical Lutheran Church and The Episcopal Church. This was done with the support of the bishops of these denominations in Arizona making it possible for Good Shepherd to develop deep love and ties between these and other Christian denominations. “The time was right,” said Carol. “Ed Grant, my predecessor, as pastor for nine years, began a tradition of welcoming people of other denominations. Kearny once had both an Episcopal Church and an Evangelical Lutheran Church but circumstances did not allow them to continue as individual congregations. We wanted to build on and affirm their presence in Kearny and the people of Good Shepherd were more than willing to make this possible.” Carol’s tenure involved three years of study and action. The congregation conceived and developed a statewide conference, Seeking New Shores, which took place in Kearny last September. It Ride ‘em cowboy! Editor, Copper Basin News: Buster and I lived in the Kelvin/Riverside area for more than 50 years and I never thought, since Buster’s death, someone would come and steal from us. I am in hopes it wasn’t one of the local young men who did it, for you know, all you had to do was ask me and I would have given it to you. I was hurt, more than mad, at the thought someone from Kelvin/Riverside would actually steal the pennies off of a dead man’s eyes. All I can say is shame be on you, as you inhale what Buster’s junk got you and hope you choke on it. /s/ Billie Leep

Letter to the Editor: Stealing from a dead man?

Mary Violet “ Vi” Looney Jones was born at home, May 15, 1917 in Deskins, VA, to Burke and Nancy Looney. She passed away in Mesa on June 25, 2001. Vi married Robert D. Jones in Waverly, Ohio, on May 4, 1940. In January of 1946, Vi and Bob moved to Arizona, where they built a house in Kyrene, the area known today as Awatukee. After being there for several years, the family ended up in Ray in 1959. By the summer of 1960, they

moved the family to Cement Hill in Hayden. In the summer of 1961, Bob and Vi settled in Kearny. In the mid 60s, Vi had worked for the General Kearny Inn as a dishwasher and advanced cook. She was very proud of her job and greatly enjoyed the working atmosphere and social acquaintances. While working at GKI, she was never far from her family. Vi was very proud to be the mother of fi ve boys. She was active in the Fellowship Baptist

Church, until she slowed down, later in life. She was preceded in death by her husband, Robert D. Jones; son, Lynn Jones; parents; sisters, twin Debbie, Pansy Hankins; and, three of her brothers: Casey Looney, Odell Looney and Leland Looney. She is survived by a brother, Burke Looney; sons, Paul (Judy), Bob (Pam), Glenn and Mike (Becky); as well as numerous grandchildren, and, great-grandchildren. Interment was held Tuesday, June 28, at Kearny Memorial Cemetery, followed by a Celebration of Life at the Fellowship Baptist Church, presided over by Pastor Joe Palmer. Griffi th Mortuary assisted the family.

Antonio “Tony” Rios Lopez passed away June 22, 2011 peacefully with his family by his side. Tony was a Army veteran serving during the Berlin Crisis. Tony made his living as a mine worker under Kennecott and Asarco before retiring. Tony played sports while in school, and volunteered his time coaching Little League baseball, youth basketball, and as a fi refi ghter; he later drove buses for the Hayden-Winkleman School District. Tony could often be found watching Little League baseball and supporting the Lobos’ sports teams. A memorial mass will be given for Tony Friday, July 1, at 11 a.m. at St. Joseph’s Catholic Church in Hayden. In lieu of fl owers, donations can be made to Odyssey Hospice of Tucson, or the VA.

The Pinal County LEPC is inviting the public, local businesses, communities, private citizens and government agencies and their employees to attend our quarterly meetings on the 1st Thursday after the 1st Monday in the months of February, May, August, and November.

What Is the Pinal County LEPC?

The Pinal County LEPC is one of the 15 state LEPCs that is overseen by the Arizona State Emergency Response Commission (AZSERC), which is tasked with the implementation of the Emergency Planning and Community Right to Know Act (EPRCA) in Arizona. Our LEPCs play the critical role of providing information of existing chemical hazards within the county in order for everyone to be better prepared to understand, manage, and respond to these potential hazards. The LEPC does this by forming partnerships between responders, local governments, communities, businesses, media, academia, and the public.

His journey began early as a little kid, Chacho said. “Dad would put us on cattle…and then I got on a steer during a Winkelman Blow-Out, I got thrown off, but got right back on and was hooked.” In 2009, Chacho decided he was ready for bulls…and again got bucked off and still didn’t give up. He has been mentored by long time bull-rider Armando Rodriguez, also of Dudleyville, who has taken him under his wing. “I have learned so many lessons from Mando,” Chacho said. “He showed me the right way to ride rank bulls.” Dad, in anticipation of his son’s dream, built a bucking ring on the family property and over the last few years has borrowed a bull twice a week when needed to help his son improve. There is also a bucking device Chacho gets on to practice spinning. “I have a little trouble away from my hand, but into

my hand I can ride anything,” he said. “And Mando is still helping me.” The family has traveled all over Arizona to compete in High School Rodeos and he has also ridden in the SWPBR where he placed first in the standing to win his first buckle. In addition he has placed in the Lost Dutchman Days Rodeo in Apache Junction and competed in the Grand Canyon Pro Rodeo. Last year he qualified for the Silver State Rodeo where he placed 16th out to 60 riders. After the Finals in Gillette Chacho plans to set his sites on getting his membership card and go pro. “I want to win the Pro Nationals and ride in Vegas,” he said. Mom’s take on all this? “We have always supported his choices and this one, although scary, is a wild and fun ride.” Featuring over 1,500 contestants from 41 states, five Canadian Provinces, and Australia, the National High School Finals is the world’s largest rodeo. In addition to competing for over $200,000 in prizes, NHSFR contestants will also be competing for more that $350,000 in college scholarships and the chance to be named the National High School Rodeo National Champion. To earn this title, contestants must finish in the top 20 after two Go-Rounds of intense competition before advancing to Saturday night’s final championship performance. I heard my husband Cliff yelling for me. Before I got to him the yelling had stopped, so I had the terrible feeling that I would find him dead. After I found him alive and sitting

on the ground by the farm tractor, he told me that he had been trying to bolt the small dozer onto the tractor, and had the tractor running so he could use the hydraulic to help lift the dozer arm, but when his hand was between the hot exhaust pipe and the dozer arm, the hydraulic

slipped and his right index finger was caught. The end of that finger was really burning when he was finally able to reach a crowbar with his other hand and pry himself loose. The end of that finger didn’t look so pretty after that. After dark one evening, I heard a rattlesnake in a corner of our long open porch, so I yelled for Cliff. When he ran out to me he was stark naked because he had started to take a shower, and not knowing why I had yelled so loud, he had grabbed a shotgun on the way out. It was a good thing that a car hadn’t come down the road then because its headlights would have brightened up the scene! As his father had, Cliff always liked to garden, and one day as he was walking between the rows of his large squash plants, a rattlesnake struck at him, but the snake’s fangs hung up in the front crease of one of his pant legs! Cliff jumped all over the garden, hoping the snake would fall loose, not bite him, and go away! It finally did that, and when Cliff got to the house he was shaking all over as he took his pants off to look at his leg which he was sure was hurting, but our son Neal said he took his pants off for another reason! Neal had signed up for the U.S. Navy in January of 1976, as my brothers, Bill and Charley Kishbaugh, had in the early 1950s. We planned a big party for Neal,

and not long before the party was to take place, our septic system backed up! What a mess to clean up in one of our bathrooms! “Dub” Ragels of Dub’s Plumbing Service in Oracle took care of the outdoor problem after finding out that instead of there being a leach line, there were two metal barrels, one on top of the other, and the barrels had rusted and collapsed. Dub’s son, Tim, who was there with his father, was a cute, very young boy then. Well, our party for Neal took place, with barbequed meat from our barbeque pit, and the fun of horseshoe and washer games. By 1976, Cliff’s and my daughters, Ann and Francie, had been married for a few years and each had a daughter born to them, and during that year Cliff and I bought a Citizens Band Radio (CB), mostly because it was a way for us to keep in touch with Francie and her family on their Flying UW Ranch that was quite a ways west of the San Pedro River, as they had no telephone or electricity where they lived and had to rely on generators. For a while, it was a “fad” to have a CB, and every user had a “handle”, or name, to use when talking; mine was “GiGi”, and Cliff’s was “Poker Chip”, because he liked to play poker. The Jep Whites also had a CB; Peggy was called “Aravaipa Grandma” and Jep was called “Half Hitch”. A CB was handy during emergencies, if one could get through the other noises, such as someone mooing like a cow, cussing, or playing music! One day, a man who appeared to be drunk stopped his car by our front gate and asked if he could use our bathroom. I told him no, that

we had plumbing problems, which we didn’t have, and Cliff told him there were plenty of bushes down the road! Two boys who were driving up the road one day stopped and tore down the no trespassing sign where the Millers’ right-a-way road started just above our house, but they were seen doing it. I waited for them to drive back down the road, and after they saw me and stopped, I told them that they had been seen tearing

down the sign. One of the boys used some foul language which made me angry, so after getting the vehicle’s license number I reported it to the Pinal County Sheriff’s Office. I later received an apologetic phone call from the mother of the boy who hadn’t used the foul language, but whose family car they had been riding in. I believe that is the kind of mother every young person would be fortunate to have, and to be thankful for.

this coming school year. The STEM Model of education will include the integration of all core academic subjects by incorporating project based learning activities that address real world problems. The purpose of STEM model is to help students develop problem solving skills, which is the number one attribute employers are looking for as we move further into the 21st century. “The HWUSD made the decision

HWUSD teachers attend STEM academyto move towards the more rigorous and hands-on STEM Model of education to help students be better prepared for careers of the future,” said HWUSD superintendent Jeff Gregorich. One of the District’s primary goals is to improve students understanding of math and science and its application to the real world situations. The district has already begun the transitional process of moving towards a STEM Model this school year. This coming school year for the first time, all Leonor Hambly Middle School eighth grade students will be taking high school algebra, which will be taught by a highly qualified high school Math teacher. In addition to Algebra, all eighth grade students will receive the traditional regular eighth grade math period that will focus on the Arizona eighth grade math standards.

“To prepare the students for this challenge and be prepare to take high school algebra in the eighth grade, all K-seventh grade students will receive 2.25 hours of math instructions per day. The District’s goal is to eventually having a majority of the high school students ready to take calculus by their junior year,” said Hayden High School math teacher Michael Hohl. Hohl added, “I am very excited that 20 high school students are signed up for the summer accelerated math class. I believe if they are successful, some of them will be ready to take AP calculus the following year, which is our ultimate goal.” Teachers and employers understand the need for all students to have a strong foundation of both math and science to compete for the high paying careers of the future.

“Having a high school education is not enough today. Employers expect employees to come to work with problem solving skills and the ability to collaborate to address 21st century challenges. This is why it is critical that the District make the move to the STEM Model of education this year,” Gregorich said. “The STEM Model is a project centered approach to education that helps students connect the purpose for learning. All content areas teachers will work together in problem based learning

activities that addresses real world problems. This is how the real world works and it will be much more engaging to students,” added Gregorich. “Beyond the values of learning and working together as a team, the STEM Model will be more fun and exciting to students and teachers,” Gregorich said. “I am looking forward to the change and so are my teachers. In 2000, the Arizona Department of Environmental Quality (ADEQ) completed a Source Water Assessment of Winkelman's three ground water wells, which are the sources of water used by Arizona Water Company's Winkelman water system. The Assessment reviewed the adjacent land uses that may pose a potential risk to the wells. These risks include, but are not limited to: gas stations, landfills, dry cleaners, agriculture fields, waste water treatment plants, and mining activities. Once ADEQ identified the adjacent land uses, they were ranked as to their potential to affect the wells. The result of the Assessment was a high risk to the sources of water.

Residents can help protect sources of water by practicing good septic system maintenance, taking hazardous household chemicals to hazardous material collection sites, and limiting pesticide and fertilizer use. The EPA requires that Arizona Water Company provide the following information. Drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of various contaminants does not necessarily indicate that water poses a health risk. More information about contaminants and potential health effects can be obtained by calling the Environmental Protection Agency's Safe Drinking Water Hotline (800-426-4791).

Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/CDC guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbial contaminants are available from the Safe Drinking Water Hotline (800-426-4791).

The sources of drinking water (both tap water and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs, and wells. As water travels over the surface of the land or through the ground, it dissolves naturally-occurring minerals and, in some cases, radioactive material, and can pick up substances resulting from the presence of animals or from human activity.

Constituents that may be present in source water include: (A) Microbials, such as viruses and bacteria, which may come from sewage treatment plants, septic systems, agricultural livestock operations, and wildlife. (B) Inorganics, such as salts and metals, which can be naturally-occurring or result from urban stormwater runoff, industrial or domestic wastewater discharges, oil and gas production, mining, or farming. (C) Pesticides and herbicides, which may come from a variety of sources such as agriculture, urban stormwater runoff, and residential uses. (D) Organics, including synthetic and volatile organic chemicals, which are by-products of industrial processes and petroleum production, and can also come from gas stations, urban stormwater runoff, and septic systems. (E) Radionuclides, which can be naturally-occurring or be the result of oil and gas production and mining activities.

In order to ensure that tap water is safe to drink, EPA prescribes regulations which limit the amount of certain constituents in water provided by public water systems. FDA regulations establish limits for constituents in bottled water which must provide the same protection for public health.

SALES TAX RATE; PROVIDING FOR SEVERABILITY; AND DESIGNATING AN EFFECTIVE DATE.

Whereas, the Arizona Legislature passed S.B. 1160 titled “city sales tax; residential rental” during the 2011 legislative session; and Whereas, S.B. 1160 prohibits a city or town that levies a transaction privilege, sales, gross receipts, use, franchise or other similar tax or fee, however denominated, from imposing or increasing the rate of tax applied to the business of renting or leasing real property for residential purposes unless approved by the qualified electors of the city or town at any regular municipal election; and Whereas, S.B. 1160 does not apply to health care facilities, long-term care facilities or hotel, motel or other transient lodging business; and Whereas, the Legislature provided that the restrictions in S.B. 1160 are retroactive to January 1,2011; and Whereas, the Town of Kearny, on March21, 2011, duly passed Ordinance 11-186 “relating to an increase to the general sales tax rate”; and Whereas, Ordinance 11-186 is now in violation of S.B. 1160. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF KEARNY, ARIZONA: Section 1. Sec. 8A-445 of the Town tax code is amended to read: Sec.8A-445. Rental, leasing, and licensing for use of real property. (a) The tax rate shall be at an amount equal to three TWO AND ONE-HALF PERCENT percent (3 2.5%) of the gross income from the business activity upon every person engaging or continuing in the business of leasing or renting real property located within the Town for a consideration, to the tenant in actual possession, or the licensing for use of real property to the final licensee located within the Town for a consideration including any improvements, rights, or interest in such property; provided further that: (1) Payments made by the lessee to, or on behalf of, the lessor for property taxes, repairs, or improvements are considered to be part of the taxable gross income. (2) Charges for such items as telecommunications, utilities, pet fees, or maintenance are considered to be part of the taxable gross income. (3) However, if the lessor engages in telecommunication activity, as evidenced by installing individual metering equipment and by billing each tenant based upon actual usage, such activity is taxable under Section 8A-470. (b) If individual utility meters have been installed for each tenant and the lessor separately charges each single tenant for the exact billing from the utility company, such charges are exempt. (c) Charges by a qualifying hospital, qualifying community health center or a qualifying health care organization to patients of such facilities for use of rooms or other real property during the course of their treatment by such facilities are exempt. (d) Charges for joint pole usage by a person engaged in the business of providing or furnishing utility or telecommunication services to another person engaged in the business of providing or furnishing utility or telecommunication services are exempt from the tax imposed by this Section. (e) (Reserved) (f) A person who has less than three (3) apartments, houses, trailer spaces, or other lodging spaces rented, leased or licensed or available for rent, lease, or license within the State and no units of commercial property for rent, lease, or license within the State, is not deemed to be in the rental business, and is therefore exempt from the tax imposed by this Section on such income. However, a person who has one (1) or more units of commercial property is subject to the tax imposed by this Section on rental, lease and license income from all such lodging spaces and commercial units of real estate even though said person may have fewer than three (3) lodging spaces. (g) (Reserved) (h) The tax prescribed by this Section shall not include gross income from the rental, leasing, or licensing of lodging or lodging space to an individual who resides therein. (q) Charges to patients receiving “personal care” or “directed care”, by any licensed assisted living facility, licensed assisted living center or licensed assisted living home as defined and licensed pursuant to Chapter 4 Title 36 Arizona Revised Statutes and Title 9 of the Arizona Administrative Code are exempt. (r) Income received from the rental of any “low-income unit” as established under Section 42 of the Internal Revenue Code, including the low-income housing credit provided by IRC Section 42, to the extent that the collection of tax on rental income causes the “gross rent” defined by IRC Section 42 to exceed the income limitation for the low-income unit is exempt. This exemption also applies to income received from the rental of individual rental units subject to statutory or regulatory “low-income unit” rent restrictions similar to IRC Section 42 to the extent that the collection of tax from the tenant causes the rental receipts to exceed a rent restriction for the low income unit. This subsection also applies to rent received by a person other than the owner or lessor of the low-income unit, including a broker. This subsection does not apply unless a taxpayer maintains the documentation to support the qualification of a unit as a low-income unit, the “gross rent” limitation for the unit and the rent received from that unit. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. and registration support to satellite high school counselors as well as

providing counselor services to high school students

attending central campus programs. This position

will also be responsible for managing CTE grants.

Certification preferred. Arizona Administrative Certification will also be

considered. • A minimum of 3 years

experience as a high school counselor or administrator.

Salary & Contract Terms: • Full-time Program

Counselor/ CTE Grant Coordinator to be allocated among the 5 CVIT satellites

and the Central Programs sites.

Blazers host alumni game With another summer softball season underway, Blazers softball team hosted its first ASA Alumni Game last Thursday. Two Blazer teams consisting of nine players each competed in a friendly game. At the end of five innings, Team B edged out Team A with a final score of 7-6. Thanks goes out to the returning ASA players, Ace Hardware, Frank Lopez, Julian Gomez, Karla Flores, and the volunteers from the Hayden-Winkelman Little League Board for making this game possible. The Blazers have traveled this summer to Coolidge, Oracle and Mammoth for “friendly” games and have hosted home games at the H-W Little League field so far. The month of July will be another exciting month for the Blazers. The Blazers plan to host the Third Annual Blazer Invitational Saturday, July 16, in Hayden. They also will be traveling to Prescott July 22-24, to test their softball skills against other ASA softball teams in the “Best of the West” tournament. The Blazers players, parents, and coaches would like to thank the local communities and business for their continued support.
