Jaitley: Lokpal Bill can lead to havoc in Constitution New Delhi: The opposition today slammed the Lokpal Bill saying it would lead to “consti- tutional havoc” as the Centre would be en- couraged to “usurp” rights of states through the provision of setting up of Lokayuktas. Initiating the debate in the Rajya Sabha, Leader of the Opposi- tion Arun Jaitley also opposed minority quo- ta in the Lokpal bench, inclusion of NGOs and keeping CBI out of the purview of the om- budsman. “If you are creating history, let us not create bad history. We will be leaving a lot of task for the next generation to do,” he said. He made it clear the BJP would not support the Bill in the present form. “Please accept amendments that the colleagues have moved,” he said. Going clause-by-clause in the Lokpal and Lokayuktas Bill, 2011, Mr. Jaitley said the om- budsman was “designed to be vulnerable to con- stitutional challenge. Let us create an institu- tion which is constitutionally possible.” Referring to the provision on the setting up of Lokayuktas in the state, the BJP leader and noted lawyer said it would lead to creating “a grey area” by which the Centre can usurp pow- ers of states. “Why are you creating a constitu- tional havoc? The government is trying to make constitutional cocktail,” he said. Mr. Jaitley said the government wants to sub- vert an institution even before its creation. “You want to kill it in the womb,” he alleged. “You wanted to create a phoney Lokpal and create a smokescreen that you are giving a con- stitutional status,” he said taking a jibe at the proposal that was included at the instance of Congress general secretary Rahul Gandhi. Mr. Jaitley said his party objected to three “ab- surd and unworkable” provisions of the bill. With regard to CBI, Mr. Jaitely wanted it to be under the purview of Lokpal with a directorate of prosecution. “An effective Lokpal needs an effective investigating agency like the CBI. You are creating a Lokpal so that it becomes a rud- derless institution,” he charged. He also opposed inclusion of NGOs and trusts within the purview of Lokpal, saying it was “revenge provision” and would create a system which would be intrusive in the private life. “I don’t think members of this House will sup- port you on this,” the BJP leader said. On the provision for quota of “at least” 50 per cent for minorities in the 9-member Lokpal bench, he said it was to designed to make the law “vulnerable to constitutional challenge”, as somebody could move court. The government has majority in the 5-mem- ber panel that would appoint the Lokpal. And then the power to remove is vested with the Supreme Court, which can be approached by only the government. “If Lokpal is biased in favour of the govern- ment, the beneficiary of the bias will decide if an appeal can be filed against the appointment,” he said. Mr. Jaitley said his party was for a strong and independent Lokpal but opposed a “weak and phoney” anti-graft ombudsman. Food inflation plunges to six‑year low New Delhi: Food inflation fell sharply to a six- year low of 0.42 per cent in the week ended De- cember 17 as prices of essential items like veg- etables, onion, potato and wheat declined. Food inflation, as measured by Wholesale Price Index (WPI), stood at 1.81 per cent in the previous week. It was recorded at 15.48 per cent in the corresponding week of 2010. According to official data released today, onions grew cheaper by 59.04 per cent year-on- year during the week under review, while po- tato prices were down by 33.76 per cent. Prices of wheat also fell by 3.30 per cent. Overall, vegetables became 36.02 per cent cheaper during the week ended December 17. Experts feel the sharp fall in food inflation numbers, which was in double digits till the first week of November, comes as a big relief to both the government and the Reserve Bank, who have been battling high prices for over two years. It will also be a major incentive for the RBI to look at the option of key interest rate cuts at its next quarterly monetary policy review in Jan- uary. The last screw fell in place when the party high command yesterday gave a clear go-ahead for SadanandaGowda to continue as chief minister, dashing all hopes of comeback bid for Yeddyurappa. Yeddyurappa is known to have put forth the demand for the party high com- mand and is learnt to have set January 15 deadline before the national leaders. The wounded leader, in all likelihood, would do something drastic in the com- ing days. He would make his mind known only on January 15, which will be a land- mark event for the saffron party, which has come to power for the first time in South India. Yeddyurappa also fears that in the coming days, his support base within the party would gradually decline and the duo of SadanandaGowda and Eshwarappa would take over the reins completely. That would be disastrous for the BJP strongman, who was responsible for get- ting the party elected in the state. His worries have only compounded with the JD(S) support to the chief minister. During the recent legislative council elec- tion, the JD(S) did not field a candidate and abstained from voting, allowing an easy victory for SadanandaGowda. It is said that JD(S) patriarch H D DeveGowda and party state president H D Ku- maraswamy have a soft corner for SadanandaGowda as he belongs to their community, Vokkaligas. The heartburn for Yeddyurappa has been the smooth functioning of the recent assembly session. The opposition coop- erated and the session went off without a hitch, which was in stark contrast to the sessions during Yeddyurappa regime. In all the three sessions Yeddyurappa presided over, there was ruckus and House committees had to be formed to look into the problems. It is learnt that Yeddyurappa even asked opposition party leaders why they were keeping quiet on the floor of the as- sembly now. Now Yeddyurappa is trying hard to get his grip back on the party. Youth attacks girl at exam hall in Mysore Bangalore Beat Bureau Mysore: A girl was attacked by a youth at an examination hall here today. Madhuri, a resident of Gokulam, has re- ceived serious injuries and is being treated at a private hospital. The boy, Krishna, stormed into the examination hall while Mad- huri was writing company secretary exam and hacked at her with a machete. Madhuri tried to evade the swipe and was injured se- riously in the hand. The bystanders and college staff caught Kr- ishna and handed him over to Jayalaksh- mipuram police. In a sting- ing attack, former chief minister B S Yed- dyurappa today said that party state presi- dent K S Eshwarappa was responsible for sending him to jail. “Eshwarappa is not satisfied that I had to spend 24 days in jail. Now, he has been mak- ing public statements to imply that I am guilty. He feels that if I am expelled from the party, he could become the supreme leader of the party,” Yeddyurappa, who has asked party high command to make him a chief minister again, said. “He has been making statements that I will not get a position in the party unless cleared of all court cases. It is being repeated over and over. He is talking like the party high com- mand. He has been speaking like the party national president. Even after he came back from New Delhi yesterday, he stated that I am guilty and would not be given a position in the party. I request him to stop making such statements immediately. He should realise that it is not proper to make these statements. He had been creating trouble since I became the chief minister,” he said. “I did not beg before Eshwarappa for any position of power. Neither did I want to be- come the party president. He is nurturing the dream of becoming a chief minister and is try- ing all tricks in the book to realise his aspi- rations. My blessings are with him. But it is not good for the welfare of the party. He thinks that he can strengthen the party; let him do it,” Yeddyurappa, who has reportedly asked party high command to make him a chief minister again, said. Yeddyurappa, who seemed cornered in the party, said, “Earlier, it was ‘BJP is Yeddyu- rappa and Yeddyurappa is BJP. Now you will have to change it to Eshwarappa is BJP and BJP is Eshwarappa’. He is trying to take com- plete control of the party and be the supreme leader.” He said, “Eshwarappa is the party presi- dent and D V SadanandaGowda is the chief minister. They are the leaders of our party.” “I am not the powerful leader of the par- ty, but a mere party worker and a party MLA from Shikaripur. Even during the last as- sembly session, I sat in the back benches and observed the goings on. I did not take part in any discussion. Many tried me to speak, but I did not,” Yeddyurappa said. I am confident that I can build the party without position.” Asked whether he had placed any demand for inclusion of his candidates in the cabinet during the expansion, Yeddyurappa said, “I would not like to speak about cabinet ex- pansion and I have not placed any de- mand.” Govt will collapse soon, says Cong Bangalore Beat Bureau Bangalore: “There is a fear that the pres- ent government would collapse soon. Yeddyurappa’s statement today is an in- dication,” said Congress state president G Parameshwara here today. “The administration in the state has al- ready collapsed. Now the government too will collapse. There is an atmosphere of instability in the state,” he said. On the problems within his own party, Parmeshwara said that the party has taken note of the complaints of B C Patil and others, who have declared that they were frus- trated within the Congress and would join the National Congress Party during the next assembly elections. Bangalore: The Bangalore MetroRail Corporation Ltd has issueda statement for commuters onwhat not to do while taking thetrain. The BMRCL had alreadyannounced that it would run theservices till 2 am on the NewYear’s Eve.

Here is what it states:l Commuters should not carry

deadly arms and weapons. Vio-lations will carry a fine of Rs5,000 and a jail term of fouryears.

l Rs 500 fine for drunken mis-behaviour and troubling co-pas-sengers. The tickets of troublemakers will also be taken back.

l Rs 1,000 fine or one yearjail, or both if the BMRCL staff istroubled.

l Life term for pre-meditatedattack on commuters.

l 10 years jail for damagingthe property of Metro rail.

l Seven-year jail if the rulesare not followed.

Bangalore: The state government hasagreed to extend the deadline for adopt-ing rainwater harvesting systems fromDecember 31 to March 31, BBMP com-missioner ShankarlingeGowda told thepalike council meeting yesterday.

The government earlier set December31 deadline for putting up rainwaterharvesting systems at properties of60x40 sqftdimension and above.

At the meeting yesterday, corporatorsurged the commissioner to solve thedrinking water problem. They were notconvinced even when senior officialsof the Bangalore Urban Water Servicesand Sewerage Board told them that thesteps were being taken.

Congress corporatorSampathraj com-plained, “There has been drinking waterand drainage problem at D J Halli.Though we have complained to theBUWSSB, nothing has been done forthe last eight months. The people inthe area have been facing serious prob-lems because of this.”

He said, “The board has failed toprovide drinking water facilities to the

people of the city. At the same time, ithas asked property owners to installrainwater harvesting systems andwarned that their water supply wouldbe cut if it is not done. The deadlinehas to be extended to allow more prop-erty owners to install these systems.”

Damaged water pumps have not beenrepaired and sufficient water is notbeing supplied to all areas. Water isbeing supplied once in five or six days.Water is being supplied illegally toapartments and multi-storeyed build-ings. With this, the middle-class andpoor people are suffering, the memberscomplained.

“If the problems are not solved on apriority basis, we will lay siege to theCauvery Bhavan (BUWSSB headquar-ters),” they warned.

Chief engineer T Venkataraju repliedthat the north and west divisions ofthe city are not being supplied waterregularly. “We are trying hard to do it.”

ShankalringeGowda said that thegovernment has extended the deadlinefor installing rainwater harvesting sys-

tems till March 31. Water services min-ister S Suresh Kumar has assured theBBMP that the order would be passedsoon, he added.

Middlemen making merryThe BUWSSB is not providing any

certificate for installing rainwater har-vesting systems, neither is it collectingany fee for it, said corporator P B Ra-mamurthy.

Some middlemen have been swin-dling property owners, saying theywould get certificates for rainwater har-vesting systems. These property ownersshould approach the water board di-rectly and get their doubts clarified, headded.

The property owners should visittheir divisional water boards and get itregistered. Inspectors and meter readersshould confirm this in writing. Withthis, the water board will get properdata on installations and would helpthe officers carry out inspections. Thiswill also help in utilising rainwaterproperly, he said.

BBMP to intensify drive to remove flex banners, OFC

Bangalore: The BBMP administration isready to remove flex banners that arespoiling the beauty of the city. It is takingthe help of Bangalore Metropolitan TaskForce police to remove them. Similarly,the BBMP has also taken up a drive to re-move illegal optical fibre cables acrossthe city, palike commissioner Shankar-lingeGowda told the council meeting yes-terday.

The meeting had a long discussion onthe issue. Soon after the House convened,ruling party member B R Nanjundapparaised the issue and said, “Flex bannershave become a major nuisance. Therehave been instances of people attackingBBMP gangmen, who were trying to re-move these banners. Steps should betaken to prevent such incidents.”

“Assistant engineers and assistant ex-ecutive engineers should take the initiativeto get these banners removed with thehelp of BMTF,” he said.

Replying, ShankarlingeGowda saidthat flex banners have become an eyesore.

“Wherever you see, there are these uglybanners. We have to take a tough decisionon removing them.”

“Palike officials will take the help ofBMTF police to prevent anyone from at-tacking the gangmen and other BBMPmen. It does not help if corporators wantto put up banners in some places and toremove in other spots,” he said.

Opposition leader M Udayashankarsaid, “It is estimated that several com-panies have lain over 20,000 km of opticalfibre cables across the city. But they havedeclared that cables have been laid onlyfor 5,000 km. The palike has projected tocollect Rs 780 crore dues from these com-panies. But is it possible to do collect allthe fees before March 31.”

The commissioner replied that approx-imately, 6,000 km of such cables havebeen laid illegally in the city. The palikewill intensify the drive to remove such il-legal cables. The palike will allow thecompanies to lay cables only if they agreeto pay the fee set by the BBMP.

Bars can remain open till 1 am on New Yearʼs Eve

Bangalore: Bars and restaurantswould be allowed to keep theirbusiness open till 1 am on theNew Year’s Eve to allow revellersto enjoy for a longer time, saidcity police commissioner Jyoth-iprakashMirji.

Now, these establishments areallowed to operate only till 11.30pm.

But in view of the New Year’sEve celebrations, the deadlinehas been extended till 1 am, headded.

The people should ring in theNew Year peacefully. They shouldnot affect the law and order sit-uation in the city.

The revellers should take carenot to disturb their neighboursand affect the movement of ve-hicles, he said.

Those who will be driving un-der the influence of alcohol onSaturday night will be bookedlike any other day.

This is being done for the safe-ty of the drivers. The citizensshould not drink and drive.

If anyone wants to drink, theyhave to take a driver, who doesnot drink, along with them, hesaid.

The bars and restaurants whowould like to remain open till 1am have to take special permis-sion from the excise department.These establishments have topay Rs 11,500 as special fee forthe purpose.

The extension of deadline willnot be applicable to wine stores,said excise minister M PRenukacharya.
