According to Mohammed Sajid Sheekha News Service reports yesterday the ferry was dragged underwater and brought nearly 50 mtrs close to Marine Shore and today with the help of high tide the Ferry was salvaged by using inflatable buoys. A large number of people gathered at the Chatham Foreshore Road near Marine Dockyard to witness the salvage operation, which took more than eight hours to complete. Andaman and Nicobar Police will now seize the ferry as case property and examine it thoroughly to understand the actual reason behind the accident.

Port Blair, Feb 03: Nine for-eign warships will take partin the multilateral naval con-gregation, MILAN 2014 thatbegan here today. The shipsbegan arriving at Port Blairtoday and berthed at the Na-val and Haddo Jetties.

The ships are fromseven littoral countries fromSouth Asia, South East Asia,Asia Pacific and the IndianOcean Region. Australia willbe represented by HMASChilders, which is anArmidale-class Patrol Craft.The ship is named after theAustralian city of Childersand is capable of doingspeeds upto 25 knots.

Bangladesh will berepresented by BNS Sangu,an Island-class Coastal Pa-trol Craft. The ship is nearly54 metres in length and iscapable of doing speeds over16 knots.

KRI Sultanto, aKapitanPatimura Class Cor-vette of the Indonesian Navywill take part on behalf ofIndonesia. The ship is over75 metres in length and iscapable of doing speeds upto 24 knots. The MalaysianNavy has sent KD Keantan,a Kedah Class Offshore Pa-trol Vessel for the event. Theprimary role of the ship is

maritime surveillance and pa-trol and is over 90 metres inlength and capable of doingspeeds upto 22 knots. Thailandis being represented by HTMSPattani, an Offshore PatrolCraft while Singapore has senttwo warships, RSS Resilienceand RSS Brave. Both shipsspecialise in Anti SubmarineWarfare.

All ships will be re-ceived ceremonially on theirarrival at the Naval andHaddo Jetties. School childrenwaving flags of the participat-ing nations and the Naval andArmy Bands playing fanfareand martial tunes will formpart of the welcome cer-emony. Senior officers fromthe Andaman and NicobarCommand will also be in at-tendance to receive the ships.

Besides the war-ships, MILAN 2014 will alsosee the participation of seniordelegates from all sixteencountries making it the larg-est gathering since MILANstarted in 1995. The warshipsand delegates will interactwith each other in a numberof professional, social andsport exchanges.

Meanwhile a PressConference was held by theCommander-in-Chief ofAndaman and Nicobar Com-mand, Air Marshal PK Roy,PVSM, AVSM, VM, VSM,ADC on board INS Kesaritoday as a curtain raiser forMILAN 2014. He thereafter,unveiled the “MILANPlaque” to formally mark thecommencement of the inter-national naval gathering. Kamorta Jetty amidst huge

Panaji, Feb 03: India’s nextKargil could happen in theAndaman and Nicobar Is-lands, former Indian NavyChief Admiral Arun Prakashhas said.

“There is a realthreat that poachers, smug-glers, narcotics traffickers orterrorist groups could occupysome of the uninhabited is-lands and create a Kargil-likesituation,” Adm. ArunPrakash said Sunday on theconcluding day of a two-dayworkshop on the security ofIndia’s coastline and its is-lands organised by the Fed-eration of Integrated NationalSecurity, an RSS-backedNGO on security affairs.

India was engaged ina bitter border conflict withPakistan after its troops hadoccupied the Kargil heights inJammu and Kashmir in 1999.

Port Blair, Feb 03: AdmiralDK Joshi, PVSM,AVSM,YSM, VSM, NM,ADC, Chief of the NavalStaff arrived at Port Blair on03 Feb 14 for MILAN 2014.As reported earlier, the IndianNavy is hosting the biennialinternational naval event,MILAN 2014 in Port Blairfrom 03 to 09 February2014,under the aegisofAndaman and NicobarCommand (ANC). Sixteenforeign countries are takingpart in MILAN 2014 makingit the largest ever edition inthe MILAN series of multi-lateral naval engagementsthat was started by the IndianNavyin 1995. Some of theparticipating foreign shipsanddelegates have alreadyarrived at Port Blair.

Admiral DK Joshi,PVSM, AVSM,VSM,YSM,NM, ADC joined the IndianNavy as a cadet in NavalAcademy in 1972 and wassubsequently commissionedon 01 April 1974. AdmiralJoshi is an Anti SubmarineWarfare specialist and is agraduate of the Staff Coursefrom Naval War College,USA. He is also an alumnusof College of Naval Warfare(NHCC), Mumbai and Na-tional Defence College, NewDelhi. He has commanded

three frontline warships in theWestern Fleet, viz., the Mis-sile Corvette Kuthar, theKashin Class DestroyerRanvir and the Aircraft Car-rier Viraat. He was awardedthe Nao Sena Medal (NM),the Vishisht Seva Medal(VSM) and the Yudh SevaMedal (YSM) respectivelyduring these Command as-signments. EDITORIAL.....Right to silence

As young students in law col-lege our t eachers taught usabout "presumption of inno-cence" and "right to silence" ofan accused. We were told thatthey have constitutional protec-t ion. Both these r ights wereconsidered by the law commis-sion in its 180th Report (2002),which recommended that thelaw needed no change in India.

Yet every time there isa case or an allegation of an of-fence against a person who isin the media glare, we have thepress - electronic and print -asking the person so accused todeclare his innocence on theground that the people have aright to know.

And heaven forbid if theindividual responds with "nocomment", asserting his right tosilence. Try it and be brandedguilty straight away even be-fore an investigation has begun- or if begun is still underway.All the while your conduct andlikely consequences becomethe subject of public discourse.

Members of the mediahave often done a great job inreminding people in high placesto maintain high standards inpublic life and in exposing scan-dalous and criminal conduct.Yet a balance is necessary be-tween ensuring probity in pub-lic life while preserving therights of individuals.

The game has anothertwist when investigating agen-cies join the fray with selectiverelease of information when in-vest igat ion has jus t begun.Even content of case diaries(which is confidential) gets re-leased to the public. The factthat case diaries contain onlyinformation gathered by inves-tigators irrespective of its ac-ceptability as evidence is for-gotten.

Noting this in RajendranChingaravelu vs CIT, the Su-preme Court held: "There is...agrowing tendency among in-vestigating officers (either po-lice or other departments) toinform the media, even beforethe completion of investigation,that they have caught a crimi-nal or an offender... Prematuredisclosures or 'leakage' to themedia in a pending investigationwill not only jeopardise and im-pede further investigation, butmany a time allow the real cul-

prit to escape from law."In this melee, the casu-

alty is the rights of the indi-vidual as well as criminal law.Critics of our system are quickto procla im tha t i t ha s notworked, but we should blamethe inquisitorial culture wherethe right to presumption of in-nocence is not guaranteed.

Today, there is world-wide recognition of the need forrule of law and preservation ofhuman rights even in the fightagainst terror ism, organisedcrime, money laundering andassociated crimes. The GlobalCounter Terrorism Forum - abody with members includingthe US, UK, India, Pakistan -declared two years back that"respecting human rights andthe rule of law while combat-ing terrorism, is based on a rec-ognition that they are comple-mentary and mutually reinforc-ing". The European Conventionon Human Rights Article 6(2)too acknowledges presumptionof innocence a s pa r t of theright to a fair trial.

Concerned with report-ing of sub judice matters, a Con-stitution Bench of the SupremeCourt in Sahara India Real Es-tate Corporation Ltd v SEBI(2012) observed: "Presumptionof open justice has to be bal-anced with presumption of in-nocence, which. . . i s nowrecognised as a human right.

T hese presumptionsexisted at the t ime when theConstitution was framed andthey cont inu e t i l ldate...constitutional protectionin Article 21 which protects therights of the person for a fairtrial is, in law, a valid restric-tion operating on the right tofr ee s peech u nder Ar t ic le19(1)(a)."

In India the growinggap between an individual'srights and right of the people toinformation needs urgent bal-ancing. I t ' s high t ime t hestakeholders had a hard relookat the presumption of inno-cence and the right to silence -both of which have secured lib-erty of countless citizens.

Of course this frenzydoes keep members of my (le-gal) community in great de-mand, as experts or to voice aclient's view point on prime-time TV, the web or in print!

AAP govt seeks probe againstSheila Dikshit over unauthorized colonies

NEW DELHI: The Delhi government on Mon-day wrote to the President seeking actionagainst former chief minister Sheila Dikshit foralleged irregularities in regularizing unauthorizedcolonies in the metropolis. The move comesafter President Pranab Mukherjee sought Delhigovernment's comments on the report of theLokayukta in which Justice Manmohan Sarinin November 2013 had ruled that granting ofprovisional certificate for regularisation of un-authorized colonies in 2008 by Dikshit wasdone to gain political mileage in the elections.During the subsequent hearings, the Lokayuktaalso had observed that the conditions of theSupreme Court order have not been complied

with during the issuance of the provisionalcertificates prior to the election and sent thereport to the President.A complaint regardingthe matter was filed by BJP leader HarshVardhan in 2010.Vardhan had alleged thatDikshit had misused her power while issuingprovisional regularization certificates to unau-thorized colonies in 2008. Delhi governmenthad issued provisional regularization certifi-cates to over 1,218 unauthorized colonies be-fore the 2008 assembly polls and had an-nounced regularization of 1,639 colonies justbefore the polls now. These unauthorized colo-nies in which around 40 lakh people reside donot have basic amenities.

Admiral Joshi is not new tothe Andaman and Nicobar Islands.He was the Commander-in-Chief,Andaman and NicobarCommand(CINCAN) from Sep-tember 2009 to December 2010. Hehas also been closely associatedwith MILAN, as the seventh edi-tion of MILAN in 2010 was heldduring his tenure as the CINCAN.Admiral Joshi has taken personalinterest in ensuring the ever increas-ing scope, participation and conductof MILAN over the years.

It is a unique occasion forthe largest ever edition of MILANto be conducted with Admiral Joshiat the helm of the Indian Navy. TheANC has also gained substantiallyduring Admiral Joshi’s tenure as theChief of the Naval Staff. The lastone year saw an unprecedentedlevel of induction of naval assets inANC that include the first NavalOffshore Patrol Vessel (NOPV) ofthe Indian Navy, INS Saryu and fourFast Interceptor Craft (FIC). Thesehave enhanced the security capa-bilities of the Command significantly.The rebasing of a HydrographicSurvey Vessel, INS Investigator to

Port Blair and induction of threeYard Support Craft hasfurtherstrengthened the maritime capabil-ity of the Command. Several navalprojects to consolidate and expandthe existing infrastructure in theAndaman and Nicobar Islands tosupport naval operations in the re-gion are making steady progress.

On his arrival at Port Blair,Admiral Joshi was received with aGuard of Honour. During his stay,he will be given an operational up-date at HQAndaman and NicobarCommand. Admiral Joshi will alsoparticipate in the MILAN eventsand he will deliver the KeynoteAddressat the International Mari-time Seminar. He will call on theHon’ble Lieutenant Governor dur-ing his visit.

Admiral Joshi will be ac-companied by his wife, Mrs ChitraJoshi, who will also attend variousevents of MILAN 2014 in her offi-cial capacity as President, NavalWives Welfare Association(NWWA). During her stay at PortBlair, Mrs Joshi will interact withthe wives of service personnel ofAndaman and Nicobar Commandand visit the local NWWA Kendrawhere she will witness various wel-fare initiatives being run for thefamilies of service personnel postedat Port Blair.

The visit by the Chief of theNaval Staff underscores the impor-tance attached to MILAN 2014.

Cancer is one o f t heleading causes of deaths in In-dia, which has nearly three mil-lion patients suffering from thedisease, they said.

Annua lly, near ly500,000 people die of cancer inIndia. The WHO said this num-ber is expec t ed t o r ise t o700,000 by 2015.

"The number of cancercases in India is increasing ev-ery year," P. K. Julka, head ofthe oncology department at theAll India Institute of MedicalSciences, told IANS.

Acco rd ing t o WHO,lung, oral, lip, throat and neckcancers are the most commonamong men while women suffermore from cervix, breast andovarian cancers.

"Incidence of cancer hasincreased in India, especiallyprostate cancer in elderly menbesides kidney, penis and intes-t ine cancer," Nayan KumarMohanty, director,

Department of Urology,Saket City Hospital said.

Manju Khemani, Headof the Department, Institute ofObs and Gynae at the hospital,said: "Cervical cancer is the sec-ond most common in womenworldwide. Unlike some othercancers, it strikes as early as32-35 years of age."

According to health min-istry data, out of more than 300cancer centres in India, 40 per-cent a re no t adequa te lyequipped with advanced cancercare equipment. India will needat least 600 additional cancercare centres by 2020 to meetthe requirements.

Gaurav Thukral, Head,Medical Services, HealthCareat Home (HCAH), told IANS:"High treatment costs are one ofthe main reasons why cancercare is out of reach for millionsof Indians. If detected early,t r ea tment is e ffec t ive and

cheaper. However, if detectedlate, it is more expensive (caneven lead to bankruptcy) andalso reduces the chances of sur-vival."

In India, a skewed doc-tor-to-patient ratio only wors-ens the situation. The health min-istry is working towards a tar-get doctor-pat ient rat io o f1:1,000 by 2021, which atpresent is 1:2,000.

Julka said: "In India, therequirement is 1 cancer care unitper 100,000 population, whichis a far cry from the current sce-nario".

He, however, added thegovernment was taking a num-ber of steps to combat the situ-ation, including setting up a can-cer care institute in Jhajjhar inHaryana.

Doctors say the causesof such a high incidence of can-cer may be both internal like ge-netic, hormonal and poor im-mune conditions as well as ex-ternal orenvironmental like foodhabits, industrialization, overg ro wth o f po pu lat ion andlifestyle.

Ignorance among thepublic, delayed diagnosis andlack of adequate medical facili-ties has given cancer the dubi-ous distinction of being a "killerdisease". However, the fact re-mains that if cancer is detectedin its early stages, it can betreated and an individual canlead a healthy life, Thukral said.

Mohanty said: "It is im-portant to create awarenessabout common types of cancerand their symptoms among thegeneral public. Passing blood inurine is the first alarming signand should not be neglected. Itis important to know that foodplays a pivotal role in cancerprevention."Avoid a high-cho-lesterol diet like meat, liver andmilk products. Intake of antioxi-dant-rich foods like guavas,tomatos, grapes and pineapplescan help protect against cancer.Adding dietary fibre to yourfood can protect you from in-testine cancer," Mohanty added.

NASA aircraft soon topredict Indian cyclones

New Delhi : Hit by five cy-clones on its eastern coast lastyear, India is planning to pro-cure a NASA aircraftequipped with a lab to studywind patterns at high altitudefor better prediction of suchcalamities. “We are procuringMcDonnell Douglas DC-8 air-craft from NASA and weshould hopefully get it by 2015-2016. This aircraft has a labo-ratory within itself and will behelpful in studying wind pat-terns,” Ministry of Earth Sci-ence (MoES) SecretaryShailesh Nayak said.The gov-ernment has also tied up with

University of Massachusetts,US for research on weatherpatterns in the country espe-cially in the Bay of Bengal, hesaid.The aircraft will help ingathering data at high alti-tudes, especially the wind pat-terns, and to conduct experi-ments in the aircraft itself,” ascientist at MoES said. Single gene that separatesqueen bee from workers discovered

Washington: A team of researchershas identified a single gene in hon-eybees that separates the queenfrom the workers.

The team led by WayneState University, in collaborationwith Michigan State University,unraveled the gene's inner workings.The gene, which is responsible forleg and wing development, plays acrucial role in the evolution of bees'ability to carry pollen.

"The gene - Ultrabithorax,or Ubx - is responsible for makinghind legs different from fore legs sothey can carry pollen," AleksandarPopadic , principal investigator ofthe study, said. "In some groups,like crickets, Ubx is responsible forcreating a 'jumping' hind leg. In oth-ers, such as bees, it makes a pollenbasket - a 'naked,' bristle-free leg re-gion that creates a space for packingpollen."

Ubx represses the devel-opment of bristles on bees' hind legs,creating a smooth surface that can

be used for packing pollen. Thisimportant discovery can be used asa foray into more commercial stud-ies focused on providing means toenhance a bee's pollination ability-the bigger the pollen basket, themore pollen that can be packed in itand transported back to the hive.

In another interesting find-ing, researchers identified that beesliving in more complex social struc-tures have an advantage over iso-lated populations in developingthese important functions.
